संख्याः-राज०स्था०खान-19/2019-2072--माननीय झारख(cid:7003)ड उ(cid:7340) न्यायालय, राँची में दायर वाद संख्या- W.P(S)-4018/2021 निशान्त अभिषेक एवं अन्य बनाम झारख(cid:7003)ड राज्य एवं अन्य में माननीय न्यायालय द्वारा दिनांक- 03.07.2024 को Jharkhand Mining Engineering Service Rules, 2011 के प्रावधान के अनुसार सेवा संपुष्ट एवं वा(cid:7414)षक वेतन वृ(िcid:7373) प्रदान किए जाने का आदेश पारित किया गया है ।
माननीय झारख(cid:7003)ड उ(cid:7340) न्यायालय, राँची में दायर वाद संख्या-W.P(S)-4018/2021 निशान्त अभिषेक एवं अन्य बनाम झारख(cid:7003)ड राज्य एवं अन्य में माननीय न्यायालय द्वारा दिनांक- 03.07.2024 को पारित आदेश के अनुपालन में वादीगणों/वर्ष 2017 में नियुक्त/कार्यरत सहायक खनन पदाधिकारियों को देय तिथि से सेवा संपुष्टि एवं वेतनवृ(िcid:7373) अनुमान्य किये जाने हेतु एकबारीय (cid:7390)वस्था के तहत सेवा नियमावली में प्रावधानित विभागीय परीक्षा में उत्तीर्णता के आवश्यक शर्त /अर्हता में छू ट प्रदान करने के निमित्त अधिसूचित झारख(cid:7003)ड खनन अभियंत्रण सेवा नियमावली के भाग- VII के नियम-17 (ग) एवं भाग- X के नियम-28 को, माननीय झारख(cid:7003)ड उ(cid:7340) न्यायालय में दिनांक- 21.10.2024 को दायर LPA के आदेश के फलाफल से प्रभावित होने तथा पूव(cid:7299)(cid:7373)ारण नह(cid:7277) समझे जाने की शर्त के साथ, क्षान्त/शिथिल किया जाता है ।

No.Raj.Stha.Khan-19/2019-2072--An order has been passed by Hon'ble Jharkhand High court in WP(S) 4018/2021 Nishant Abhishek & others Vs. the State of Jharkhand & others on 03.07.2024 to confirm the services and providing increment to the officers in terms of Jharkhand Mining Engineering Service, 2011.
In compliance of the order passed by Hon'ble Jharkhand High court in WP(S) 4018/2021 Nishant Abhishek & others vs. the State of Jharkhand & others on 03.07.2024, provisions related to condition/qualification of passing of departmental examination mentioned in Rule 17 (c) of Part VII and Rule 28 of Part X of Jharkhand Mining Engineering Service Rule, are relaxed by confirming services and providing increment from due date to the petitioners/appointed in 2017/working Assistant Mining Officers as one time measure with the condition that it shall be subject to the outcome of the order of LPA filed on 21.10.2024 in the Hon'ble Jharkhand High Court and it shall not be treated as precedent.
