3. उपायु(cid:200)त सह िजला द(cid:214)डा(cid:876)धकार(cid:547), धनबाद के प(cid:287)ांक-443/ (cid:874)व(cid:876)ध, (cid:465)दनांक-18.03.2023 एवं प(cid:287)ांक-1423/(cid:874)व(cid:876)ध, (cid:465)दनांक-03.11.2023 (छाया(cid:292)(cid:467)तः संल(cid:202)न) के (cid:622)वारा, (cid:302)ीः हरेश कु मार राम, सहायक लोक अ(cid:871)भयोजक, M.P/M.L.A Court िजला अ(cid:871)भयोजन काया(cid:91)लय, धनबाद का प(cid:287)ांक-642, (cid:465)दनांक- 22.02.2023 क(cid:551) छाया(cid:292)(cid:467)त (cid:874)वभांग को उपल(cid:222)ध कराया गया है, िजसम(cid:581) (cid:302)ी अ(cid:467)नल कु मार (cid:871)संह, (cid:292)भार(cid:547) लोक अ(cid:871)भयोजक धनबाद (cid:622)वारा (cid:465)दया गया मंत(cid:229)य (cid:467)न(cid:224)नवत ् है:-
(cid:302)ी जगरनाथ महतो व अ(cid:219)य के (cid:874)व(cid:509)(cid:622)ध (cid:465)दनांक-01.06.2016 धारा- 147/148/149/323/188/308/353/304/328 भा०द०(cid:874)व० के अंतग(cid:91)त आरोप सम(cid:874)प(cid:91)त क(cid:551) गयी है तथा उ(cid:200)त (cid:467)त(cid:876)थ (01.06.2016) को ह(cid:547) माननीय (cid:219)यायालय (cid:622)वारा सं(cid:163)ान म(cid:581) (cid:871)लया गया है ।
अ(cid:871)भयु(cid:200)तगण/(cid:874)वप(cid:162)ी अ(cid:876)धव(cid:200)ता अपने ऊपर लगाये गये आरोप/आरोप गठन के (cid:874)व(cid:510)(cid:622)ध माननीय उ(cid:205)च (cid:219)यायालय झारख(cid:214)ड, राँची म(cid:581) Criminal Revision 221/2018 दायर (cid:873)कया गया। उसम(cid:581) माननीय उ(cid:205)च (cid:219)यायालय (cid:622)वारा (cid:465)दनांक- 14.05.2019 के आदेश, से सा(cid:234)य क(cid:551) कमी को देखते हु ए आरो(cid:874)पत धारा-304/149 तथा 328/149 भा०द०(cid:874)व० को (cid:874)वलो(cid:874)पत कर (cid:465)दया गया। त(cid:215)प(cid:230)चात माननीय अपर स(cid:287) (cid:219)यायाधीश 02 फा(cid:232)ट (cid:282)ैक कोट(cid:91) बेरमो (तेनुघाट) के (cid:622)वारा माननीय (cid:219)यायालय, झारख(cid:214)ड, राँची के आदेश से 18.09.2019 को, आरोप ग(cid:465)ठत धारा-304/149 तथा 328/149 को (cid:874)वलो(cid:874)पत करते हु ए के स अ(cid:871)भलेख को माननीय (cid:219)या(cid:467)यक द(cid:214)डा(cid:876)धकार(cid:547) के कोट(cid:91) म(cid:581) (cid:874)वचारण हेतु भेज (cid:465)दया गया ।46 झारख(cid:214)ड गजट (साधारण), बुधवार, 15 जनवर(cid:547), 2025 के स/(cid:620)यूट(cid:547) म(cid:581) गवाह(cid:585) ने घटना का पूण(cid:91)तः समथ(cid:91)न नह(cid:547)ं (cid:873)कया है िजसके कारण Cr.. Revision म(cid:581) माननीय उ(cid:205)च (cid:219)यायालय ने गंभीर (cid:292)कृ (cid:467)त के धारा-304/149 तथा 328/149 भा०द० (cid:874)व०. को (cid:874)वलो(cid:874)पत कर (cid:465)दया गया ।
माननीय उ(cid:205)च(cid:419)म (cid:219)यायालय (cid:871)शव नंदन पासवान बनाम ् रा(cid:207)य (cid:466)बहार (A/P) 1987 SC. के आलोक म(cid:581), The Government Appointed SPL P.P. and on the Govt- advise, he moved an application u/s 321 CRPC before CIM Seeking court permission to withdrawal from prosecution on four grands.
P Khalid and Natrajan JJ.
Section-321 of Cr. pc. needs 3 requites to make an order under it valid.
In my opinion lack of prospect of successful prosecution in the light of evidence.
(i) वाद(cid:547) ने पु(cid:871)लस कै (cid:874)प(cid:871)सट(cid:547) म(cid:581) रहकर यह वाद दायर (cid:873)कया है और माननीय उ(cid:205)च(cid:419)म (cid:219)यायालय S.C के उ(cid:200)त चार (cid:466)ब(cid:219)दुओं म(cid:581) पहला (cid:466)ब(cid:219)दु को इस वाद म(cid:581) अ(cid:218)ययन (cid:873)कया जाय तो म(cid:583) अ(cid:871)भयोजन क(cid:551) ओर से यह पाता हू ँ, (cid:873)क इस वाद म(cid:581) उ(cid:205)च (cid:219)यायालय ने Criminal. Revision म(cid:581) मु(cid:201)य धारा-304/149, 328/149 को (cid:874)वलो(cid:874)पत कर (cid:465)दया है और 8 गवाह(cid:585) क(cid:551) गवाह(cid:547) से यह वाद Lack of prosecution क(cid:551) (cid:302)ेणी म(cid:581) आता है तथा सा(cid:234)य के कमी दशा(cid:91)ता है। िजसे अ(cid:871)भयोजन, उपयु (cid:91)(cid:200)त अ(cid:871)भयु(cid:200)तगण के (cid:874)व(cid:510)(cid:622)ध अ(cid:871)भयोजन सा(cid:466)बत कर सकता है, यह संदेह है ।
(ii) अतः, सा(cid:234)य के आधार पर (cid:219)या(cid:467)यक (cid:292)(cid:873)(cid:272)या का पालन करते हु ए यह वाद 'सरकार वापस कर सकती है (यह वाद सरकार चाहे तो Withdrawal यो(cid:202)य है)। यह वाद राजनी(cid:467)तक (cid:622)वेष से माननीय (cid:874)वधायक पर (cid:873)कया गया है ।
(iii) माननीय उ(cid:205)च(cid:419)म (cid:219)यायालय का तीसरा Point के अनुसार इस वादं म(cid:581) Public Policy Involve नह(cid:547)ं है और न ह(cid:547) money matter Involve है तथा Public interest भी नह(cid:547)ं दशा(cid:91) रहा है । के स क(cid:551) वत(cid:91)मान ि(cid:232)थ(cid:467)त यह है (cid:873)क उपरो(cid:200)त के स म(cid:581) माननीय (cid:219)यायालय (cid:302)ीमती संतोषनी मुमू (cid:91) (cid:874)वशेष, (cid:219)या(cid:467)यक द(cid:214)डा(cid:876)धकार(cid:547) M.P/M.L.A Court, धनबाद के कोट(cid:91) म(cid:581) अ(cid:871)भयोजन सा(cid:234)य हेतु चल रहा है। कु ल 8 गवाह(cid:585) क(cid:551) गवाह(cid:547) हो चुक(cid:551) है िजसम(cid:581) 4 * सरकार(cid:547) तथा 4 गैर सरकार(cid:547) गवाह है। सरकार(cid:547) गवाह(cid:585) ने के स का अंशतः समथ(cid:91)न (cid:873)कया है • तथा अ(cid:871)भयु(cid:200)त गुण के (cid:874)व(cid:510)(cid:622)ध पया(cid:91)(cid:220)त सा(cid:234)य नह(cid:547)ं आया है। चार(cid:585) गैर सरकार(cid:547) गवाह 'प(cid:162)(cid:289)ोह(cid:547) घो(cid:874)षत (cid:873)कये गये ह(cid:583)। Case Advance Stage म(cid:581) है। चार सरकार(cid:547) गवाह के वल मशाल जुलूस (cid:467)नकालने का समथ(cid:91)न (cid:873)कये है। उ(cid:219)ह(cid:585)ने घटना का पूण(cid:91)तः संमथ(cid:91)न नह(cid:547)ं (cid:873)कया है । साथ ह(cid:547) माननीय सव(cid:574)(cid:205)च (cid:219)यायालय State of Kerala V/s K. Ajith S.C 510 के आलोक म(cid:581) सहायक लोक अ(cid:871)भयोजक, धनबाद का मंत(cid:229)य (cid:467)न(cid:224)नवत ् है :-
47 झारख(cid:214)ड गजट (साधारण), बुधवार, 15 जनवर(cid:547), 2025(i) Immunities and Privileges: The protest against the " STHANIYA NITI" by M.L.A is proteted by immunities and Privilege under Art 194 (3) of the constitution.
(ii) Breach of previeges :- A vilation of the right and imunities granted to M.L.A. is a breach of previleges.
(iii) Sanction of the speaker: An offence which is committed by M.L.A cann't be registered by the Police without the permission of the speaker. Police Officer require authorization from the competent Authority to investigate a breach of law.
(iv) Public Interest:- The freedom granted to M.L,A are necessary for the functionity of the Democracy and are subject to the powers of the speaker. The continues of the trail of M.L.A in absence of the sanction of the speaker lowers, the dignity amonst citizen.
(v) Absent of mens rea:- According to chargesheet, the incident occurred during a protest by the M.L.A aganist the "SHTANIYA NITI" This it is difficult to assess the 'reus' of the offence.
(vi) Lack ot evidence:- The statements of the witnesses under 161 of cr.p.c are vague and there is an absence of proper identification of the person involved and the participations of the alleged offence.
(vii) The Vediography/(C.D) Photographs at the incident lacks Certification under section 65 (B) of the Indian evidence Act 1872 and the admissibility of this evidence would be challenge in the trail.....".
अतः, सहायक लोक अ(cid:871)भयोजक, धनबाद का मंत(cid:229)य है (cid:873)क अ(cid:871)भलेख का अवलोकन, गवाह(cid:585) का बयान तथा माननीय उ(cid:205)च (cid:219)यायालय, राँची के (cid:622)वारा (cid:873)(cid:272)(cid:871)मनल (cid:464)र(cid:871)भजन म(cid:581) (cid:465)दये गये आदेश के आलोक म(cid:581) यह वाद धारा-321 CRPC के अंतग(cid:91)त (cid:292)(cid:215)याहरण (Withdrawal) यो(cid:202)य है ।
4. व(cid:872)ण(cid:91)त ि(cid:232)थ(cid:467)त से (cid:232)प(cid:231)ट है (cid:873)क (cid:292)ासं(cid:876)गक वाद के मु(cid:201)य आरोपी (cid:232)व० जंगरनाथ महतो क(cid:551) मृ (cid:215)यु हो चुक(cid:551) है एवं वह(cid:547) धरना के ' नेतृ (cid:215)वकता(cid:91) थे। (cid:232)व० जगरनाथ महतो के नेतृ (cid:215)व म(cid:581) (cid:232)थानीय नी(cid:467)त के (cid:874)वरोध म(cid:581) (cid:873)कये गये आंदोलन के (cid:272)म म(cid:581) नावाडीह थाना कांड़ सं(cid:201)या-19/2016, (cid:465)दनांक-13.05.2016 दर्ज है। यह वाद राजनी(cid:467)तक (cid:622)वेष से माननीय (cid:874)वधायक पर दज(cid:91) (cid:873)कया गया था। वाद म(cid:581) Public Policy Involve नह(cid:547)ं ह(cid:583) और ना ह(cid:547) Money matter Involve है तथा Public interest भी नह(cid:547)ं ह(cid:583)। यह48 झारख(cid:214)ड गजट (साधारण), बुधवार, 15 जनवर(cid:547), 2025 आंदोलन नीिज (cid:465)हत के (cid:871)लए नह(cid:547)ं ह(cid:583)। दज(cid:91) (cid:873)कये गये कांड म(cid:581) सा(cid:234)य क(cid:551) कमी है। कांड वापसी से रा(cid:207)य के (cid:874)व(cid:876)ध-(cid:229)यव(cid:232)था पर कोई (cid:292)(cid:467)तकू ल (cid:292)भाव नह(cid:547)ं पड़ने वाला है ।
5. अतः (cid:292)भार(cid:547) लोक अ(cid:871)भयोजक, धनबाद का मंत(cid:229)य, एवं उपायु(cid:200)त, धनबाद क(cid:551) अनुशंसा के आलोक म(cid:581) माननीय (cid:874)वधायक (त(cid:215)काल(cid:547)न) डु मर(cid:547) (cid:874)वधान सभा, (cid:232)व० जगरनाथ महतो एवं अ(cid:219)यं के (cid:874)व(cid:510)(cid:622)ध दज(cid:91) नावाडीह थाना कांड सं(cid:201)या-19/2016, (cid:465)दनांक-13.05.2016 धारा- 147/148/139/188/323/353 'भा०द०(cid:874)व० को वापस लेने के (cid:292)(cid:232)ताव को रा(cid:207)य मं(cid:466)(cid:287)प(cid:464)रषद क(cid:551) बैठक (cid:465)दनांक-09.01.2024 के मद सं(cid:201)या 30 म(cid:581) (cid:232)वीकृ त (cid:873)कया गया है ।

Memo No.-10/C.B.L.-419/2024-4005--Government of Jharkhand hereby accord consent under Section 6 of the Delhi Special Police Establishment Act, 1946 (25 of 1946) to all the members of Delhi Special Police Establishment Act to exercise power and jurisdiction under the said Act in the State of Jharkhand, upon request made vide letter No.-364/CO-6/2023-R, dated 12.06.2024 of DIG of Police/Head of Branch, CBI, ACB, Ranchi for registration of a regular case against the following:-
