सॊ.76/झायखण्ड-रो.स./01/2024/सी.ई.एभ.एस.-।।।--मत:, बायत शनवााचन आमोग द्वाया ददनाॊक-07.05.2024 की अशधसूचना सॊ0 आ.अ.119 (अ) के अनुसयण भें झायखण्ड के 01-याजभहर रोकसबा शनवााचन ऺेत्र के शरए साधायण शनवााचन 2024 आमोजजत दकमा गमा था; औय
मत: रोक प्रशतशनशधत्व अशधशनमभ, 1951 की धाया 78 के अनुसाय, दकसी शनवााचन भें, शनवााचन रड़ यहा प्रत्मेक अमथी, शनवााशचत अमथी के शनवााचन की तायखख से 30 ददनों के बीतय शनवााचन व्मम का रेखा जजरा शनवााचन अशधकायख के ऩास दाजखर कयेगा जो उ्त अशधशनमभ की धाया 77 के अॊतगात उसके द्वाया मा उसके शनवााचन अशबकताा (एजेंट) द्वाया यखे गए रेखे की एक सत्म प्रशत होगी; औय
मत: झायखण्ड के 01-याजभहर सॊसदखम शनवााचन ऺेत्र के साधायण शनवााचन का ऩरयणाभ रयटशनंिग ऑदपसय द्वाया ददनाॊक 04.06.2024 को घोषति दकमा गमा था औय इस प्रकाय शनवााचन व्मम रेखे दाजखर कयने की अजततभ तायखख 04.07.2024 थी; औय2 झायखण्ड गजट (असाधायण) ुिक्रवाय, 6 जून, 2025 मत:, शनवााचनों का सॊचारन शनमभ, 1961 के शनमभ 89 के उऩ-शनमभ (1) अॊतगात, जजरा शनवााचन अशधकायख, साहेफगॊज की रयऩोटा ददनाॊक 20.07.2024 जो भुख्म शनवााचन अशधकायख, झायखण्ड से ददनाॊक 17.10.2024 के ऩत्र सॊ0 02/शन.-EE-24-24/2024/5593 को प्राप्त हुई थी, के अनुसाय सुश्री दखऩा टु डु जो झायखॊड के 01-याजभहर सॊसदखम शनवााचन ऺेत्र 2024 से शनवााचन रड़ने वारे अमथी है, षवशध द्वाया मथाऩेजऺत यखशत से अऩने शनवााचन व्मम के रेखे दाजखर कयने भें असपर यहे हैं; औय,

शनवााचनों का सॊचारन शनमभ, 1961 के शनमभ 89 के उऩ-शनमभ (5) के अॊतगात सुश्री दखऩा टु डु को अऩने शनवााचन व्मम रेखे र्प्तुत नहखॊ कयने के शरए कायण फतान नोदटस सॊ. 76/झायखॊड- रो.स./01/2024/सी.ई.एभ.एस.-।।। ददनाॊक 11.12.2024 जायख दकमा गमा था; औय,
मत:, उऩमु्त कायण फतान नोदटस के जरयए औय शनवााचनों का सॊचारन शनमभ, 1961 के शनमभ 89 के उऩ-शनमभ (6) के अनुसाय सुश्री दखऩा टु डु को व्मम रेखा र्प्तुत न दकए जाने सॊफॊधी कायणों को ्ऩष्ट कयते हुए, आमोग को अऩना अमावेदन शरजखत प ऩ भें र्प्तुत कयने औय नोदटस के प्राप्त होने की तायखख से 20 ददनों के बीतय जजरा शनवााचन अशधकायख, साहेफगॊज को अऩने शनवााचन व्मम का ऩूणा रेखा र्प्तुत कयने का शनदे िददमा गमा था; औय
मत:, भुख्म शनवााचन अशधकायख, झायखॊड से ददनाॊक 06.03.2025 के ऩत्र सॊ. 02/शन.-EEM- 24-54/2024/468 के द्वाया सूशचत दकमा है दक उ्त कायण फतान नोदटस अमथी के ससुय श्री प्रधान फेसया के द्वाया ददनाॊक 22.12.2024 को ताभीरा दकमा गमा था; औय
मत:, जजरा शनवााचन अशधकायख, साहेफगॊज ने ऩत्र सॊ. 234/शनवाा. ददनाॊक 04.04.2025 के द्वाया र्प्तुत की गई अनुऩूयक रयऩोटा भें मह फतामा गमा है दक सुश्री दखऩा टु डु ने शनवााचन व्मम का रेखा र्प्तुत नहखॊ दकमा है। इसके अशतरय्त, उ्त नोदटस की ऩावती के उऩयाॊत, सुश्री दखऩा टु डु ने षवशध के अॊतगात मथा षवदहत रेखा दाजखर कयने भें असपरता के शरए बायत शनवााचन आमोग को न तो काई कायण फतामा औय न हख कोई ्ऩष्टखकयण ददमा है; औय
मत:, रोक प्रशतशनशधत्व अशधशनमभ, 1951 की धाया 10क भें उऩफॊशधत दकमा गमा है दक:-
''मदद शनवााचन आमोग का सभाधान हो जाता है दक कोई व्मष-ि
(क) शनवााचन व्ममों का रेखा उस सभम के बीतय औय उस यखशत भें जैसी इस अशधशनमभ के द्वाया मा अधीन अऩेजऺत है, दाजखर कयने भें असपर यहा है; औय3 झायखण्ड गजट (असाधायण) ुिक्रवाय, 6 जून, 2025 (ख) उस असपरता के शरए कोई अच्छा कायण अथवा तमामोशचत्म नहखॊ यखता है, तो शनवााचन आमोग, ािसकीम याजऩत्र भें प्रकाशति आदे िद्वाया उसको शनयदहात घोषति कयेगा औय ऐसा व्मष िउस आदे िकी तायखख से तीन वाि की कारावशध के शरए शनयदहात होगा। मत:, तथ्मों औय उऩरधध रयकाडडों के आधाय ऩय आमोग का मह सभाधान हो गमा है दक सुश्री दखऩा टु डु अऩने शनवााचन व्मम के रेखे दाजखर कयने भें असपर यहे हैं उनके ऩास ऐसा कयने भें असपर यहने के शरए कोई बी उशचत कायण अथवा औशचत्म नहखॊ है, औय
अत:, अफ रोक प्रशतशनशधत्व अशधशनमभ, 1951 की धाया 10क के अनुसयण भें बायत शनवााचन आमोग एतदद्वाया घोणिा कयता है दक झायखण्ड याज्म के साधायण शनवााचन, 2024 के 01-याजभहर सॊसदखम शनवााचन ऺेत्र से शनवााचन रड़ने वारे अमथी सुश्री दखऩा टु डु , ग्राभ-शबराई, ऩो. योराग्राभ, थाना-भहेऩिुय, जजरा-ऩाकु ड़, षऩन-816106 (झायखॊड) इस आदे िकी तायखख से तीन वाि की अवशध के शरए सॊसद के दकसी बी सदन अथवा याज्म अथवा सॊघ याज्म-ऺेत्र की षवधान सबा अथवा षवधान ऩरयद् िका सद्म चुने जाने अथवा होने के शरए शनयदहात होंगे।

No. 76/Jharkhand-PC/01/2024/CEMS-III--WHEREAS, the General Election to LokSabha of Jharkhand, 2024 for 01-Rajmahal Parliamentary Constituency was held in pursuance of the
, 18 नवम्फय, 2016
Election Commission of India Notification No. O.N. 119(E), dated 07.05.2024; and
ीीझायखण्ड गजट (असाधायण) ुिक्रवाय, 20 ददसम्फय, 2024
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the elections for 01-Rajmahal Parliamentary Constituency of Jharkhand 2024 was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of Election Expenses was 04.07.2024; and
WHEREAS, as per the District Election Officer Sahibganj report dated 20.07.2024 forwarded by the Chief ElectoralOfficer, Jharkhand vide its letter no. 02/शन.-EEM-24-24/2024/5593, dated 17.10.24, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Ms. Dipa Tudu a contesting candidate from Parliamentary Constituency of Jharkhand has failed to lodge her account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Sahibganj, a Show-Cause notice No.76/झायखॊड-रो.स./01/2024/सी.ई.एभ.एस.-।।।, dated 11.12.2024 was issued under sub- rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Ms. Dipa Tudu for not lodging of her accountof Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Ms. Dipa Tudu, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Sahibganj within 20 days from the date of receipt of the Notice; and
WHEREAS, the Chief Election Officer, Jharkhand, vide its letter No. 02/शन.-EEM-24- 54/2024/468, dated 06.03.2025 has informed that notice was received by the candidate's father in law Sh. Pradhan Besara, on 22.12.2024; and
WHEREAS, the District Election Officer, Sahibganj in his Supplementary Report, vide its letter no. 234/शनवाा., dated 04.04.2025 has reported that Ms. Dipa Tudu, has not submitted her account of election expenses. Further, after receipt of the said notice, Ms. Dipa Tudu, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and5 झायखण्ड गजट (असाधायण) ुिक्रवाय, 6 जून, 2025 WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required
by or under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order
published in the Official Gazette, declare him to be disqualified and any such person shall
be disqualified for a period of three years from the date of the order. "
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Ms. Dipa Tudu, has failed to lodge her account of election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Ms. Dipa Tudu resident of Village - Bhelai, P.O. - Rolagram, PS - Maheshpur, Distt. Pakur, Pin - 816106 (Jharkhand), a contesting candidate in 01- Rajmahal Parliamentary Constituency of General Election to the LokSabha of Jharkhand, 2024 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
