No :- 3/PMC/ Work /389/2019.. In compliance to order dated 18.01.2013 passed in WP (PIL) No-4663/2009 Hemendra Pratap Dehati vs the State of Jharkhand and ors, a High Power Committee under the chairmanship of Hon'ble Justice Deoki Nandan Prasad, Retd. Judge, Jharkhand High Court, Ranchi was constituted vide Gazette Publication No. 103 Ranchi dated 04.03.2013 read with notification no. 1333 dated 01.03.2013 to examine and suggest a concrete plan on tapping water from Kanhar river for providing irrigation and drinking water facilities to the drought prone areas of Palamu Division.
2. While hearing the instant Writ WP(PIL) no. 4663/2009, the Hon'ble High Court, Jharkhand have been pleased to pass an order dated 24.01.2025 as follows:-
(i) Issues of this nature are very complex and it must be left to the discretion of the executive to decide when and in what manner they wish to complete the work of the project in light 2 Jharkhand Gazette (Extraordinary), Thursday, 11th September, 2025 (ii) It is not a matter for this court to be determine in exercise of its writ jurisdiction under Article 226 of the Constitution of India and fix any timeline for completing the construction of the barrage.
(iii) Since the respondents have stated categorically that they wish to take further steps to ensure that the project in question proceeds further and since it is to take further time in view of the difficulties expressed, we see no reason to keep this Public Intrest Litigation pending.
(iv) Accordingly, the same is hereby closed.
3. In pursuance of aforesaid order dated 24.01.2025 and the proceeding of 98th meeting of the High Power Committee, the aforesaid High Power Committee constituted vide gazette publication no. 103, Ranchi dated 04.03.2013 read with notification no. 1333 dated 01.03.2013 is dissolved.
4. This proposal has obtained the approval of Hon'ble Minister, Water Resources Department, Government of Jharkhand.
This notification will come into force with immediate effect.
