ईसीआई/ऩीएन/316/2025 और सॊ. ईसीआई/ऩीएन/317/2025 दोनों ददनाॊक 06 अक्टू बर, 2025 के जररए घोषति षबहार षवधान सभा के वतामान साधारण शनवााचन एवॊ 7 राज्यों के 8 षवधानसभा शनवााचन ऺेत्रों (अनुऱग्नक के अनुसार) के उऩचुनावों के शऱए कायाक्रम की घोणिा कर दी गई है; और

2. यत्, ऱोक प्रशतशनशधत्व अशधशनयम 1951 (सॊऺेऩ में ऱो.प्र.अशधशनयम, 1951) की धारा 126क में यह षवशनददाष्ट दकया गया है दक "(1) कोई भी व्यष िकोई शनगाम मत सवेऺण नहीॊ करेगा और दकसी शनगाम मत सवेऺण के ऩररणाम का, ऐसी अवशध के दौरान जो शनवााचन आयोग द्वारा इस सॊबॊध में अशधसूशचत की जाए, षप्रॊट या इऱेक्रॉशनक मीदडया के माध्यम से प्रकानि या प्रचार या दकसी भी प्रकार की अन्य रीशत में प्रसार नहीॊ करेगा।

(2) शनवााचन आयोग, उऩधारा (1) के प्रयोजन के शऱए, शनम्नशऱश्वखत को ध्यान में रखते हुए साधारण आदे िद्वारा तारीख और समय अशधसूशचत करेगा, अथाात :-

(क) साधारण शनवााचन की दाि में, वह अवशध मतदान के ऩहऱे ददन के सॊबॊध में मतदान के शऱए शनयत समय के आरॊभ होने से ुिरू होगी और सभी राज्यों और सॊघ राज्य-ऺेत्रों में मतदान समाप्त होने के आधे घॊटे तक जारी रहेगी;

(ख) दकसी उऩ-शनवााचन या एक साथ कराए जाने वाऱे अनेक उऩ-शनवााचनों की दाि में वह अवशध मतदान के ऩहऱे ददन से ही मतदान के शऱए शनयत समय के आरॊभ होने से ुिरू होगी और मतदान समाप्त होने के ऩश् चात आधे घॊटे तक जारी रहेगी; , 18 नवम्बर, 2016

ऩरॊतु शभन्न-शभन्न ददनों ऩर एक साथ कराए जाने वाऱे अनेक उऩ-शनवााचनों की दाि में, वह ीीझारखण्ड गजट (असाधारण) ुिक्रवार, 20 ददसम्बर, 2024

अवशध मतदान के ऩहऱे ददन के सॊबॊध में मतदान के शऱए शनयत समय के आरॊभ होने से ुिरू होगी और अॊशतम मतदान समाप्त होने के ऩश् चात आधे घॊटे तक जारी रहेगी।

(3) कोई व्यष,ि जो इस धारा के उऩबॊधों का उल्ऱॊघन करेगा ऐसी अवशध के कारावास से, जो दो वाि तक की हो सकेगी या जुमााने से या दोनों से, दॊडनीय होगा।"

3. अब, इसशऱए, ऱोक प्रशतशनशधत्व अशधशनयम, 1951 की धारा 126क की उऩधारा (1) के अधीन षियिों का प्रयोग करते हुए शनवााचन आयोग उक्त धारा की उऩ-धारा (2) के उऩबॊधों के दृषष्टगत, 6 नवम्बर, 2025 (गुरुवार) को ऩूवााह्न 7:00 बजे तथा 11 नवम्बर, 2025 (मॊगऱवार) को अऩराह्न 6:30 बजे के बीच की अवशध को, ऐसी अवशध के रूऩ में अशधसूशचत करता है श्वजसके दौरान ऊऩर उश्वल्ऱश्वखत साधारण एवॊ उऩ-शनवााचनों के सॊदभा में दकसी भी प्रकार के एश्वग्जट ऩोऱ का आयोजन करने तथा षप्रॊट या इऱेक्रॉशनक मीदडया द्वारा इसके ऩररणाम के प्रकानि या प्रचार अथवा दकसी भी अन्य तरीके से उसका प्रचार-प्रसार करने ऩर प्रशतबॊध होगा।

4. यह भी स्ऩष्ट दकया जाता है दक ऱोक प्रशतशनशधत्व अशधशनयम, 1951 की धारा 126(1)(ख) के अधीन उऩयु ा िसाधारण एवॊ उऩ-शनवााचनों के सॊबॊध में मतदान की समाशप्त के शऱए शनयत समय ऩर समाप्त होने वाऱी 48 घॊटों की अवशध के दौरान दकसी भी इऱेक्राशनक मीदडया में दकसी भी ओषऩशनयन ऩोऱ या दकसी अन्य मतदान सवेऺण के ऩररणामों सदहत दकसी भी प्रकार के शनवााचन सॊबॊधी मामऱे के प्रदािन ऩर प्रशतबॊध होगा।

उऩरो िअशधसूचना का अॊग्रेजी में शनम्नशऱश्वखत अनुवाद झारखण्ड राज्यऩाऱ के प्राशधकार से इसके द्वारा प्रकाशति दकया जाता है जो भारतीय सॊषवधान के अनुच्छे द 348 के खण्ड (3) के अधीन अॊग्रेजी भााि में उसका प्राशधकृ त ऩाठ समझा जायगा।

NOTIFICATION

No. 576/EXIT/2025/SDR/Vol.I-- Whereas, the schedule for the current general election to the Legislative Assembly of Bihar and bye-elections to 8 Assembly Constituencies in 7 States (as per annexure) has been announced by the Election Commission vide Press Notes No.

ECI/PN/316/2025 and No. ECI/PN/317/2025 both dated 6th October, 2025; and

2. Whereas, Section 126A of the Representation of the People Act, 1951(in short R.P. Act, 1951) specifies that "(1) No person shall conduct any exit poll and publish or publicise by means of the print or electronic media or disseminate in any other manner, whatsoever, the result of any exit poll during such period, as may be notified by the Election Commission in this regard.

(2) For the purposes of sub-section (1), the Election Commission shall, by a general

order, notify the date and time having due regard to the following, namely: —

(a) in case of a general election, the period may commence from the beginning

of the hours fixed for poll on the first day of poll and continue till half an hour after closing

of the poll in all the States and Union territories;

(b) In case of a bye-election or a number of bye-elections held together, the

period may commence from the beginning of the hours fixed for poll on and from the first

Provided that in case of a number of bye-elections held together on different days,

the period may commence from the beginning of the hours fixed for poll on the first day of

poll and continue till half an hour after closing of the last poll.

(3) Any person who contravenes the provisions of this section shall be punishable with

imprisonment for a term which may extend to two years or with fine or with both."

3. Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951, the Election Commission, having regard to the provisions of sub-Section (2) of the said Section, hereby notifies the period between 7:00 A.M on 6th November, 2025 (Thursday) and 6:30 PM on 11th November, 2025 (Tuesday) as the period during which conducting and publishing or publicizing exit poll by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the aforesaid General and bye elections, shall be prohibited.

4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for the conclusion of the poll in connection with the aforesaid general and bye-elections.
