THE KARNATAKA GRAM SWARAJ AND PANCHAYAT RAJ (AMENDMENT) BILL, 2023 (LA Bill No. 16 of 2023)
A Bill further to amend the Karnataka Gram Swaraj and Panchayat Raj Act, 1993 (Karnataka Act 14 of 1993).
Whereas, it is expedient further to amend the Karnataka Gram Swaraj and Panchayat Raj Act, 1993 (Karnataka Act 14 of 1993) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the seventy fourth year of the Republic of India, as follows:-
1. Short title and commencement.- (1) This Act may be called the Karnataka Gram Swaraj and Panchayat Raj (Amendment) Act, 2023.
(2) It shall be deemed to have come in to force with effect from 16th day of September, 2023.
2. Amendment of section 160.- In the Karnataka Gram Swaraj and Panchayat Raj Act, 1993 (Karnataka Act 14 of 1993) in section 160, in the first proviso, before the word "Chikkamagalur" the words, brackets and punctuation "Shivamogga (excluding Bhadravati, Shivamogga and Shikaripura Taluks)," shall be inserted.
3. Repeal and savings.- (1) The Karnataka Gram Swaraj and Panchayat Raj (Amendment) Ordinance, 2023 (Karnataka Ordinance 03 of 2023) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the Principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the Principal Act, as amended by this Act.
STATEMENT OF OBJECTS AND REASONS
It is considered necessary to amend the Karnataka Gram Swaraj Panchayath Raj Act, 1993 (Karnataka Act 14 of 1993) to comply with the direction of the Hon'ble High Court of Karnataka in the writ petition No.20426/2021 to conduct the election to the rural local bodies within the time limit by prescribing population limit for election to the Taluk Panchayat and zilla panchayat by excluding Bhadravathi, shivamogga and shikaripura taluk of shivamoga district in proportion to their population5 As the matter was urgent and both Houses of the State Legislature were not in a session, the Karnataka Gram Swaraj and Panchayat Raj (Amendment) Ordinance, 2023 (Karnataka Ordinance 03 of 2023) was promulgated to achieve the above object.
This Bill seeks to replace the said Ordinance.
Hence the Bill.

160. Elected members.- The elected members of the Zilla Panchayat shall consist of not less than twenty five members elected from the Taluks in the district, the number of members to be elected from each Taluk being fixed by the Government in accordance with the scale of one member for every population between thirty five thousand and forty-five thousand or part thereof of the population :
Provided that, in case of Chikkamagalur (excluding Tarikere, Kaduru, Ajjampura Taluks) Uttara Kannada and Kodagu Districts it shall be one member for every rural population between eighteen thousand to twenty five thousand or part thereof
Provided further that, in case of a district having rural population of more than seven lakhs but not more than nine lakhs fifty thousand there shall be twenty eight elected members.
