NOTIFICATION

Whereas, the draft of the Karnataka Civil Services (counselling based transfers in Stamps and Registration department) Rules, 2026 was published as required by clause (a) of sub-section (2) of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) vide Notification No.RD/13/MSE1/2026, dated 27.04.2026, in Part IV-A of the Karnataka Gazette extra ordinary dated: 27.04.2026 (No. 333) inviting objections or suggestions from all the persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.

And whereas, the said Gazette was made available to the public on 27.04.2026.

And whereas objections and suggestions received in this regard have been considered by the State Government.

Now therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) Government of Karnataka hereby makes the following rules, namely:-

(1)2 RULES

1. Title and commencement: -

(1) These rules may be called the Karnataka Civil Services (counselling based transfers in Stamps and Registration department) Rules, 2026.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Definitions: - (1) In these rules, unless the context otherwise requires:

(a)"Act" means the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990);

(b) "District" means registration district as defined in the registration act 1908 (Central Act No. 16 of 1908);

(c) "Minimum period of service" means two years of service for District Registrar, Head Quarter Assistant and Senior Sub-Registrar or Sub-Registrar in one office of posting and four years of service for First Division Assistant, in one office of posting;

(d) "Zonal Period of service" means cumulative years of service rendered by an officer in a particular zone calculated by combining services rendered in different offices of a particular zone as defined in table,-

(e) "Section" means section of the Act.

(f) "Officers/Officials" means officers and officials serving in Group-A, Group-B and Group-C cadres of the Karnataka State Stamps and Registration Department;

(g) "Transfer" means posting of officers and officials from one place of working or post to another place of working or post of equivalent cadre which excludes change from one post to another post in the same office;

(h) "Special category offices" means offices in which Senior Sub-Registrar or Sub-Registrar posts which are vacant and held in charge for long time3 due to low transaction or low revenue will be notified by the Government from time to time;

(i)"Competent Authority" means the competent authority for transfer of officers or officials specified in table of rule 3;

(j) "Zone-A Offices" means all sub-registrar offices within the Jurisdiction of the Bengaluru Metropolitan Region Development Authority and Corporation areas specified in Schedule-I for cadre of senior sub-registrar or sub-registrar and Schedule-II for the cadre of First Division Assistant; (k) "Zone-B offices" means all sub-registrar offices which are not listed in Zone-A and Zone-C Offices specified in Schedule-I for cadre of senior sub- registrar or sub-registrar and Schedule-II for the cadre of First Division Assistant; and

(l)"Zone-C office" means all non-executive posts and special category offices specified in Schedule-I for cadre of senior sub-registrar or sub- registrar and Schedule-II for the cadre of First Division Assistant. (2) All other words and expressions used herein but not defined in these rules shall have the same meaning assigned to them in the Act.

3. Competent Authority.- The authority specified in column (3) of the table below shall be the competent authority for the transfer of officers and officials specified in column (2) thereof,-

4. Method of Transfer:

(1) The transfer of the officer and officials specified at serial numbers 4, 5 and 6 in the table of the rule 3 shall be only through counselling by digital mode.

(2) Transfer Guidelines notified by the Department of Personnel Administrative Reforms from time to time shall be applicable for the purpose of transfer of all other employees excluding those who are under counselling.

5. Criteria for transfers: - (1) The transfer shall not be claimed as a matter of right by any officer or official.

(2) An official will be eligible for transfer on completion of minimum period of service or zonal period of service whichever is earlier:

Provided that the Competent Authority may order for premature transfer (without counselling), in public interest and administrative convenience, by recording reasons in the following cases namely: -

(i) In case of an officer or official having Special Knowledge/Expertise to be transferred to Central office; or

(ii) On grounds of Criminal case or Lokayukta or Departmental enquiry or serious complaints/allegations against the officers. In such cases the officers shall be transferred only to non-executive/Zone-C offices specified in Schedule-I or Schedule II as the case may be.

(3) On completion of zonal period of service, an officer will be compulsorily transferred, even if minimum period of service in current posting is not completed.

(4) The transfer of officers or officials shall be done in the following manner, namely:-

(i) Every official in the cadre of Senior Sub-Registrar or Sub-Registrar who are working as Sub-Registrar for five years or more out of last eight years in any of the Sub Registrar offices in Zone-A offices, shall be compulsorily transferred.

Only posts outside Zone-A may be available for selection in counselling for these officers.

(ii) Every official in the cadre of First Division Assistant or Stenographer who have worked for six years or more out of last eight years in any of the Sub Registrar offices in Zone-A offices, shall be compulsorily transferred. Only posts outside Zone-A may be available for selection in counselling for these officers.

(iii) An officer may not be eligible to choose a post in Zone-A as long as they fall under compulsory transfer category i.e. Senior Sub Registrars or Sub Registrars who have worked five years out of last eight years in Zone-A offices and First Division Assistants or Stenographers who have worked six years out of last eight years in Zone-A offices.

(iv) Transfers of all officials working in all other cadres except serial number-4, 5, 6 of Table under rule 3 shall be done as per the existing transfer guidelines published time to time by the Government.

(5) The competent authority may undertake transfers of cadres as in serial number 4, 5 & 6 of Table under rule 3 not exceeding five percent of the total number of posts in Zone –B and C, by recording reasons in writing.

Provided that, transfer on discretionary grounds under sub-rule (5) shall not apply to compulsory transfer cases and shall cover only posts within Zone-B and C and shall not apply for those transferred on disciplinary grounds.

6. Procedure for Transfer by counselling.-

1. Following calendar of events shall be followed for Transfer Counselling every

Provided that on account of unavoidable circumstances if transfers by counselling could not be conducted during the month of April to June of particular year, the State Government may permit transfer by counselling beyond the month of June for that particular year.

2. The criteria for assigning ranking for counselling will be as below;

3. The officials with the lowest number of points as per Table-3 will be ranked higher than the officials having higher points and the highest rank will be for officials having no disciplinary case presently i.e. Zero points.

4. If there are more than one official with same score, then their inter seniority will be determined by their ranking in the latest Seniority List of the cadre.

5. No transfer shall be made to keep the officer or official in compulsory waiting period for posting.

6. In order to avoid vacancies remaining unfilled due to non-availability of officers/officials possessing the prescribed minimum eligible service, it is proposed to provide that, after completion of the first round of counselling, if vacancies still remain unfilled, a second list of eligible officers/officials may7 be prepared by relaxing the minimum tenure criteria in a phased manner, based on descending order of length of service, subject to a minimum of one year of service for SSR/SR and two years for FDA.

7. In cases where an officer/official fails to attend counselling due to medical or other valid grounds, such officer/official may be permitted to participate in the subsequent round of counselling and shall be eligible to exercise option only against the vacancies available at that stage. No claim shall lie in respect of posts notified or allotted in earlier rounds. If the officer/official fails to attend the subsequent round also, posting shall be made by the counselling authority based on seniority in alphabetical order against the remaining vacancies.

7. Relaxation in certain cases,- (1) Exemption shall be given to physically challenged officers or officials and those who becomes physically challenged while in service, from periodical and repetitive Transfers. The transfer request of such officials may be considered after the submission of necessary certificate issued by the competent medical board.

(2) Where a female government servant is a widow/spinster/un-married/divorcee she may be transferred and in case she is appointed for the first time may be posted to a place of her choice subject to availability of vacancy.

(3) Where both the spouses are government servants and if one of the spouses is transferred, then the other spouse may be accommodated to that place or a place near subject to the availability of vacancy, even if he/she has not completed the minimum period of service at the place where he/she is currently employed.

(4) Where an officer/official is an office bearer of Karnataka Rajya Sarkari Naukarara Sangha shall be eligible to claim relaxation under orders issued by the Government from time to time.

(5) Where an officer/official is having less than one year of service before retirement as on date of publication of rank list shall be eligible to claim relaxation:

Provided that,-

i. Those who utilise the above mentioned options shall be eligible to choose only offices in Zone-B and C of the Schedule-I and Schedule –II as applicable.

ii. The relaxation is not applicable for compulsory transfer and transfer due to enquiry/suspension under 5(2)(ii).

iii. On receipt of applications from those who claim such relaxations and after validation a separate list ranked as per criteria laid in sub rule (2) of rule 6 shall be prepared. They will be given first priority in counselling.

8. Misconduct.-

1. If any officer or official brings influence seeking transfer to a particular post or place, directly or indirectly, such an attempt shall be construed as grave misconduct, and the officer or official shall be liable for disciplinary action under the provisions of Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957.

2. If transferred officer or official do not report to transferred post even after utilising the joining time shall be liable for disciplinary action under the Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957.

3. If other than medical grounds, transferred officer or official applies for leave without reporting to transferred post the leave shall not be granted. And it shall be treated as absence from the duty and disciplinary action will be initiated under the Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957.

9. Kalyana Karnataka post.- The officers and officials recruited against vacant posts of the Kalyana Karnataka area offices in different cadres under the provisions of Article 371(J) of the Constitution of India shall not be transferred before completion of 10 years of service in Kalyana Karnataka from the joining date to places other than Kalyana Karnataka area.

10. Modification of the Schedule.- Government may modify the list of offices in schedule-I or schedule-II by issuing notification.
