The draft of the following rules further to amend the Central Relief Committee and Local Committee (Recruitment) Rules 1990, which the Government of Karnataka proposes to make in exercise of the powers conferred by Section 27 read with Section 40 of the Karnataka Prohibition of Beggary Act 1975 (Karnataka Act 25 of 1975) is hereby published as required by sub section (3) of section 40 of the said Act for the information of persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the official Gazette.
Any objection or suggestion, which may be received by the State Government from any person with respect to the said draft before the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Secretary to Government, Social Welfare Department, 2nd Floor, Room No. 233, Vikasa Soudha, Bangalore-560001.
Draft Rules
1. Title and Commencement:- (1) These rules may be called the Central Relief Committee and Local Committee (Recruitment) (Amendment) Rules, 2009.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Amendment of rule 4:- In the Central Relief Committee and Local Committee (Recruitment) Rules, 1990 (hereinafter referred to as the said rules), in rule 4, in sub-rule(2), in clause (i), for the figures "2003", the figures "2009", shall be substituted .
3. Insertion of new rule 5:- After rule 4 of the said rules, the following new rule shall be inserted. namely:-
"5. Departmental Examinations Committee:- The Committee consisting of the following officers shall conduct Departmental Examinations for employees of the Committee and declare the results, namely:-

(First published in the Karnataka Gazette extra ordinary on the Eighteenth day of March 2009) THE KARNATAKA FISCAL RESPONSIBILITY (AMENDMENT) ACT, 2009
(Received the assent of the Governor on the Sixteenth day of March 2009)
An Act further to amend the Karnataka Fiscal responsibility Act, 2002.
Whereas it is expedient further to amend the Karnataka Fiscal Responsibility Act, 2002 (Karnataka Act 16 of 2002) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the Sixtieth year of the Republic of India as follows:-
1. Short title and commencement.- (1) This Act may be called the Karnataka Fiscal Responsibility (Amendment) Act, 2009.
(2) It shall be deemed to have come into force with effect from the 28th day of February 2009.
2. Amendment of Section 4.- In the Karnataka Fiscal Responsibility Act, 2002 in section 4, in sub-section (3), after the first proviso, the following shall be inserted, namely:-
3855"provided further that the fiscal deficit during the year 2008-09 may exceed the limit up to 3.5 percent of estimated Gross State Domestic Product as a part of economic stimulus package. The additional market borrowings availed under the limits so relaxed shall be used for undertaking capital expenditure during the year 2008-09. As a measure of compliance an accompanying Report with details and stating the likely impact of such capital expenditure shall be placed before both the Houses of the Legislature.

In exercise of the powers conferred by sub-section (2) of Section 7 of the Karnataka Tax on Professions, Tradings, callings and Employment Act, 1976 (Karnataka Act 35 of 1976), the Government of Karnataka hereby notifies with immediate effect, that the assessment of all employers in respect of any year up to the year ending 31st March 2008, which has not been completed under Section 7 of the said Act, shall be deemed to have been made on the basis of returns submitted by such dealers in accordance with sub section (1) of section 6 of the said Act without requiring the presence of the employer or production of accounts or other documents by the employer subject to the following conditions namely:-
(i) The employer has submitted correct and complete return in Form-5 within the prescribed time.
(ii) For the assessment year, the employer is not found to have attempted to conceal or suppress any tax payable for the year.
(iii) Every assessment made under this Notification shall be subject to the provisions of Section 8,9 and 18 of the said Act.

Whereas the draft of the following rules further to amend the Karnataka Excise (Sale of Indian and Foreign Liquors) Rules, 1968, was published as required by Sub-section (1) read with Sub-section (3) of Section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966) in Notification No.FD 17 PES 2009, dated 27.06.2009 in Part-IVA of the Karnataka Gazette (Extra Ordinary) dated 27.06.2009 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.
And whereas the said Gazette was made available to the public on 27th June 2009.
And whereas, the objections and suggestions received within the period specified above, have been considered by the Government. Now, therefore, in exercise of the powers conferred by Section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966), the Government of Karnataka hereby makes the following rules namely:-

1. Title and commencement.- (1) These rules may be called the Karnataka Excise (Sale of Indian and Foreign Liquors) (Amendment) Rules, 2009.
(2) They shall come into force with effect from the 1st day of July, 2009.
2. Amendment of rule 8.- In the Karnataka Excise (Sale of Indian and Foreign liquors) Rules, 1968, in rule 8, in sub – rule (1),-
(i) in item 2, for sub-item (d) and (e) and entries relating thereto, the following shall be substituted, namely:-
"(d) Town Municipal Council areas/Town Panchayat areas Rs. 3,00,000/- per year
Rs. 3,00,000/- per year " (e) Other areas
(ii) in item 9, for sub-item (d) and (e) and entries relating thereto, the following shall be substituted, namely: -
"(d) Town Municipal Council areas/Town Panchayat areas Rs. 3,20,000/- per year

Whereas the draft of the Karnataka Municipalities (Absorption of the employees appointed under the Scheme of Swarna Jayanthi Shahari Rozgar Yojana (SJSRY) in Urban Local Bodies) (Amendment) Rules, 2008 which the Government of Karnataka proposes to make in exercise of the powers conferred by clause (g) of sub-section (2) of section 323 of Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964), was published as required by sub-section (1) of section 323 of the said Act in Notification No. UDD 78 EMC 2004, dated 26.05.2008 in PART IV-A No. 509 of the Karnataka Gazette (Extraordinary) dated 26.05.2008 inviting objections and suggestions from all the persons likely to be affected within 30 days from the date of publication of the said Notification in the official gazette.
And whereas, the said Gazette was made available to the public on 26.05.2008.
And whereas, the Objections/Suggestions received have been considered by the State Government.
Now therefore, in exercise of the powers conferred by sub-section (1) of Section 323 of the Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964) the Government of Karnataka hereby makes the following rules, namely,-
RULES
1. Title and Commencement:- (1) These Rules may be called the Karnataka Municipalities (Absorption of the Employees appointed under the Scheme of Swarna Jayanthi Shahari Rozgar Yojana in Urban Local Bodies) (Amendment) Rules, 2008.
(2) They shall come into force from the date of their publication in the official gazette.
2. Amendment of Rule 2.- In the Karnataka Municipalities (Absorption of the Employees appointed under the Scheme of Swarna Jayanthi Shahari Rozgar Yojana in Urban Local Bodies) Rules, 2005 (hereinafter referred to as the said rules), in rule 2, in sub-rule (1), after clause (c), the following shall be and shall always be deemed to have been inserted namely,-
"(d) "employees" means employees appointed on contract basis against a post created under the Swarna Jayanthi Shahari Rozgar Yojana in urban local bodies and includes persons appointed against `Faculty' posts in the State Institute for Urban Development under Swarna Jayanthi Shahari Rozgar Yojana scheme".
3. Amendment of rule 3.- For rule 3 of the said rules, the following shall be and shall always be deemed to have been substituted, namely.-
"3. Absorption of employees working under the Swarna Jayanthi Shahari Rozgar Yojana scheme in urban local bodies,- Notwithstanding anything contained in the rules of recruitment of group "B" and group "C" posts issued under section 323 (2) (g) of Karnataka Municipalities Act 1964, Karnataka Municipalities (Recruitment of Officers and Employees) Rule, 2004 and subject to the conditions specified in these rules, the employees working as faculty, Project Officers, Community Organisers, Junior Engineers, Programme Coordinator, Computer Operator and Driver under Swarna Jayanthi Shahari Rozgar Yojana scheme on contract basis mention in column (2) of the Schedule shall, with effect from the date of commencement of these rules, be absorbed in the corresponding category of posts and pay scale specified in column (5) and (6) thereof, respectively in the posts in the urban local bodies and Karnataka Municipalities (Recruitment of Officers and Employees) Rule, 2004.
Provided that no such person shall by absorbed,
(i) if he was disqualified for appointment under the Karnataka Municipalities (Recruitment of Officers and Employees) Rule, 2004 or any other rules applicable for recruitment in local bodies or institutions in which they are appointed.
3859(ii) if he does not possess the required academic qualification specified in the rules of recruitment applicable for recruitment of the said posts and in respect of new Faculty posts also.
(iii) if any posts reserved for the persons belonging to the scheduled caste and scheduled tribes or other Backward Classes to which he was appointed on contract Faculty, Junior Engineer and Drivers under Swarna Jayanthi Shahari Rozgar Yojana scheme, if he is found to by not belonging to such casts, tribes or classes as the case may be.
4. Amendment of the Schedule,- In the schedule to the said rules,-

No. 576/3/EVM/2009/SDR(LA):- Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may, having regard to the circumstances of each case specify; and
2. Whereas, the Commission has considered the circumstances in 197-Ilayangudi, 103-Thondumuthur, 134-Cumbum, 78-Bargur and 226-Srivaikuntam Assembly Constituencies in Tamil Nadu, 145-Bow Bazar Kolkata and 156-Sealdah Kolkata Assembly Constituencies in West Bengal, 16-Moradabad West, 391-Morna, 291-Bidhuna and 83-Malihabad (SC) Assembly Constituencies in Uttar Pradesh, 185-Channapatna, 166-Govindrajnagar, 40-Chittapur (SC), 183-Ramanagar and 222-Kollegal (SC) Assembly Constituencies in Karnataka, 17-Laitumkhrah Assembly Constituency in Meghalaya, and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the above mentioned Assembly Constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;
3. ಕ್ರಮ ಸಂಖ್ಯೆ (2)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ 21.10.1995ರ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977ರ ನಿಯಮ 9(1ಎ)ಯನ್ನು ತಿದ್ದುಪಡಿ ಮಾಡಿ, ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಸಮೂಹ-ಸಿ ಮತ್ತು ಸಮೂಹ-ಡಿ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ಅಂಗವಿಕಲರಿಗೆ ಶೇ. 5ರಷ್ಟು ಸಮತಳ ಮೀಸಲಾತಿ (Horizontal reservation) ಕಲ್ಪಿಸಲಾಗಿದೆ.
ಕ್ರಮ ಸಂಖ್ಯೆ (3)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ 3.9.2005ರ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977ರ ನಿಯಮ 9(1ಎ)ಗೆ ತಿದ್ದುಪಡಿ ಮಾಡಿ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಸಮೂಹ-ಎ ಮತ್ತು ಸಮೂಹ-ಬಿ ವೃಂದದ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ಅಂಗವಿಕಲ ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ಶೇ.3ರಷ್ಟು ಸಮತಳ ಮೀಸಲಾತಿ ಕಲ್ಪಿಸಲಾಗಿದೆ.
ಕ್ರಮ ಸಂಖ್ಯೆ (4)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ 22.11.2002ರ ಆದೇಶದಲ್ಲಿ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ಅಂಗವಿಕಲರಿಗೆ ಕಲ್ಪಿಸಿರುವ ಸಮತಳ ಮೀಸಲಾತಿಯೂ ಒಳಗೊಂಡಂತೆ ಇತರ ಸಮತಳ ಮೀಸಲಾತಿಗಳನ್ನು ಕಾರ್ಯಗತಗೊಳಿಸುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸಾಮಾನ್ಯ ಅರ್ಹತೆ, ಪರಿಶಿಷ್ಟ ಜಾತಿ, ಪರಿಶಿಷ್ಟ ಪಂಗಡ ಮತ್ತು ಪ್ರತಿ ಹಿಂದುಳಿದ ವರ್ಗಗಳಿಗೆ ಪ್ರತ್ಯೇಕವಾಗಿ ಲಭ್ಯವಾಗುವ 20 ರಿಕ್ತ ಸ್ಥಾನಗಳ ಸಮೂಹದಲ್ಲಿ ರೋಸ್ಟರ್ ಬಿಂದುಗಳನ್ನು ನಿಗದಿಪಡಿಸಲಾಗಿದೆ.
ಕ್ರಮ ಸಂಖ್ಯೆ (5)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ 4.1.2008ರ ಆದೇಶದಲ್ಲಿ ಅಂಗವಿಕಲ ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ನಿಗದಿಪಡಿಸಿದ್ದ ರೋಸ್ಟರ್‌ನ 19ನೇ ಬಿಂದುವಿಗೆ ಬದಲಾಗಿ, ರೋಸ್ಟರ್‌ನ 4ನೇ ಬಿಂದುವನ್ನು ನಿಗದಿಪಡಿಸಿ ಆದೇಶಿಸಲಾಗಿದೆ. ಇದೇ ರೋಸ್ಟರನ್ನು 20 ರಿಕ್ತ ಸ್ಥಾನಗಳ ಬದಲಾಗಿ 100 ರಿಕ್ತ ಸ್ಥಾನಗಳಿಗೆ ಅನ್ವಯಿಸಿದಲ್ಲಿ ಅಂಗವಿಕಲ ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ಲಭ್ಯವಾಗುವ ರೋಸ್ಟರ್ ಬಿಂದುಗಳ ಸಂಖ್ಯೆಗಳು 4, 24, 44, 64 ಮತ್ತು 84 ಆಗುತ್ತವೆ. ಈ ರೋಸ್ಟರ್ ಬಿಂದುಗಳು ಸಮೂಹ-ಸಿ ಮತ್ತು ಸಮೂಹ- ಡಿಗೆ ಸೇರಿದ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಗೆ ಅನ್ವಯವಾಗುತ್ತವೆ.
ಕ್ರಮ ಸಂಖ್ಯೆ (6)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ 5.9.2005ರ ಸರ್ಕಾರಿ ಆದೇಶದಲ್ಲಿ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಸಮೂಹ-ಎ ಮತ್ತು ಸಮೂಹ-ಬಿ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ಅಂಗವಿಕಲರಿಗೆ ಕಲ್ಪಿಸಿರುವ ಶೇ.3ರಷ್ಟು ಸಮತಳ ಮೀಸಲಾತಿಯನ್ನು ಜಾರಿಗೊಳಿಸಲು ಸೂಚನೆಗಳನ್ನು ನೀಡಲಾಗಿದೆ. ಈ ಆದೇಶದನ್ವಯ, ಸಾಮಾನ್ಯ ಅರ್ಹತೆ, ಪರಿಶಿಷ್ಟ ಜಾತಿ, ಪರಿಶಿಷ್ಟ ಪಂಗಡ ಮತ್ತು ಪ್ರತಿ ಹಿಂದುಳಿದ ವರ್ಗಗಳಿಗೆ ಪ್ರತ್ಯೇಕವಾಗಿ ಲಭ್ಯವಾಗುವ ರಿಕ್ತ ಸ್ಥಾನಗಳ ಸಮೂಹದಲ್ಲಿ ಪ್ರತಿ ನೂರರ ಒಂದು ಗುಂಪಿನಲ್ಲಿ ಪ್ರತಿ 19, 59 ಮತ್ತು 99ನೇ ರೋಸ್ಟರ್ ಬಿಂದುಗಳನ್ನು ಅಂಗವಿಕಲ ಅಭ್ಯರ್ಥಿಗಳಿಗಾಗಿ ಮೀಸಲಿರಿಸತಕ್ಕದ್ದೆಂದು ಮತ್ತು ಈ ಮೂರು ಬಿಂದುಗಳಲ್ಲಿ 19ನೇ ಬಿಂದುವನ್ನು ದೃಷ್ಟಿಮಾಂದ್ಯರಿಂದ (blindness or low vision), 59ನೇ ಬಿಂದುವನ್ನು ಶ್ರವಣ ದೋಷವುಳ್ಳವರಿಂದ (hearing impairment) ಮತ್ತು 99ನೇ ಬಿಂದುವನ್ನು ಚಲನವಲನ ವೈಕಲ್ಯ (locomotor disability or cerebral palsy) ಇರುವ ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ಮೀಸಲಿರಿಸತಕ್ಕದ್ದೆಂದು ಆದೇಶಿಸಲಾಗಿರುತ್ತದೆ. ಅಲ್ಲದೇ ಈ ಬಿಂದುಗಳೆದುರು ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಅಂಗವಿಕಲತೆಯುಳ್ಳ ಅಭ್ಯರ್ಥಿಗಳು ಲಭ್ಯವಾಗದಿದಲ್ಲಿ ಬೇರೆ ಅಂಗವಿಕಲತೆಯುಳ್ಳ ಅಭ್ಯರ್ಥಿಗಳನ್ನು ಈ ಬಿಂದುಗಳೆದುರು ಆಯ್ಕೆಗೆ ಪರಿಗಣಿಸತಕ್ಕದ್ದೆಂದು ಆದೇಶಿಸಲಾಗಿದೆ. ಇದೇ ತತ್ವವನ್ನು ಅನುಸರಿಸಿ, ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಸಮೂಹ-ಸಿ ಮತ್ತು ಸಮೂಹ-ಡಿಗೆ ಸೇರಿದ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ದೃಷ್ಟಿ ಮಾಂದ್ಯರಿಗೆ, ಶ್ರವಣ ದೋಷವುಳ್ಳವರಿಗೆ, ಚಲನವಲನ ವೈಕಲ್ಯ ಉಳ್ಳವರಿಗೆ ಹಾಗೂ ಕುಷ್ಠರೋಗದಿಂದ ಗುಣಮುಖರಾದವರಿಗೆ ಮೀಸಲಾತಿಯನ್ನು ಅನ್ವಯಿಸುವ ಬಗ್ಗೆ ಸರ್ಕಾರ ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಸಮೂಹ-ಸಿ ಮತ್ತು ಸಮೂಹ-ಡಿ ಹುದ್ದೆಗಳಿಗೆ ಮಾಡುವ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ನಿಗದಿಪಡಿಸಿರುವ ಶೇ.5ರ ಮೀಸಲಾತಿಯಲ್ಲಿ ಶೇ.2ನ್ನು ದೃಷ್ಟಿಮಾಂದ್ಯತೆಯುಳ್ಳವರಿಗೆ, ತಲಾ ಶೇ.1ನ್ನು ಶ್ರವಣದೋಷವುಳ್ಳವರಿಗೆ, ಚಲನವಲನ ವೈಕಲ್ಯವುಳ್ಳವರಿಗೆ ಮತ್ತು ಕುಷ್ಠರೋಗದಿಂದ ಗುಣಮುಖರಾದ ಅಂಗವಿಕಲರಿಗೆ / ಬುದ್ಧಿಮಾಂದ್ಯತೆ / ಮಾನಸಿಕ ಅಸ್ವಸ್ಥತೆ (Mental retardation/Mental illnes) ಹೊಂದಿರುವವರಿಗೆ ಮೀಸಲಿರಿಸಲು ಆದೇಶಿಸಲಾಗಿದೆ. ಈ ಮೀಸಲಾತಿಯನ್ನು ಜಾರಿಗೊಳಿಸಲು ದಿನಾಂಕ 4.1.2008ರ ಆದೇಶ ಸಂಖ್ಯೆ: ಸಿಆಸುಇ 53 ಸೆನೆನಿ 2007ರಲ್ಲಿ ನಿಗದಿಪಡಿಸಿರುವ 20 ಬಿಂದುಗಳ ರೋಸ್ಟರನ್ನು 100 ರಿಕ್ತ ಸ್ಥಾನಗಳಿಗೆ ಅನ್ವಯಿಸಿ, ಅದರಲ್ಲಿ 4, 24ನೇ ಬಿಂದುಗಳನ್ನು ದೃಷ್ಟಿಮಾಂದ್ಯತೆಯುಳ್ಳವರಿಗೆ, 44ನೇ ಬಿಂದುವನ್ನು ಶ್ರವಣ ದೋಷವುಳ್ಳವರಿಗೆ, 64ನೇ ಬಿಂದುವನ್ನು ಚಲನವಲನ ವೈಕಲ್ಯ ಇರುವವರಿಗೆ ಮತ್ತು 84ನೇ ಬಿಂದುವನ್ನು ಕುಷ್ಠರೋಗದಿಂದ ಗುಣಮುಖರಾದ ಅಂಗವಿಕಲರಿಗೆ / ಬುದ್ಧಿಮಾಂದ್ಯತೆ / ಮಾನಸಿಕ ಅಸ್ವಸ್ಥತೆ ಹೊಂದಿರುವವರಿಗೆ ಮೀಸಲಿರಿಸತಕ್ಕದ್ದೆಂದು ಮತ್ತು ಈ ಬಿಂದುಗಳೆದುರು ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಅಂಗವಿಕಲ ಅಭ್ಯರ್ಥಿಗಳು ಲಭ್ಯವಾಗದಿದ್ದಲ್ಲಿ ಬೇರೆ ಅಂಗವಿಕಲತೆ ಇರುವವರನ್ನು ಆಯ್ಕೆಗೆ ಪರಿಗಣಿಸತಕ್ಕದ್ದೆಂದು ಆದೇಶಿಸಲಾಗಿದೆ.

Whereas Rule 9(1A) of the Karnataka Civil Services (General Recruitment) Rules, 1977 provides for three percent reservation (horizontal reservation) in recruitment for Group 'A' and 'B' posts for persons with disabilities;
Whereas as per Section 32 of the Persons With Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 the State Government has to identify category of posts which can be reserved for persons with disabilities in Government Departments.
Whereas in exercise of the powers conferred by sub-section (1) of section 32 of the Persons With Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (Central Act of 1996) and Rule 9(1A) of the Karnataka Civil Services (General Recruitment) Rules, 1977 the Government3883 of Karnataka identified the posts for physically handicapped persons in Notification No. DPAR 104 SRR 2005, dated 13.9.2005.
Whereas as per Section 32 (b) of the Persons With Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (Central Act of 1996) the State Government shall at periodical intervals not exceeding three years, review the list of posts identified and update the list taking into consideration the developments in technology. Now, therefore, in exercise of the powers conferred by sub-section (a) and (b) of section 32 of the Persons With Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (Central Act of 1996) and Rule 9(1A) of the Karnataka Civil Services (General Recruitment) Rules, 1977 the Government of Karnataka hereby identifies the posts specified in Col. 3, 4, and 5 of the Schedule below in respect of the category of the disabled persons specified in the headings of the respective columns in the Departments specified in col.(2) thereof.

Government of Karnataka, by virtue of its powers conferred under Section 18(1) & 19 of the Haj Committee Act 2002, constituted the Karnataka State Haj Committee vide Notification No: SWD 04 WHJ 2006, dated: 16-08-2006, whose term of office expires on 15-08-2009.
The State Government by virtue of the powers conferred under Section 22(1) of the Haj Committee Act 2002 re-constitute the Karnataka State Haj Committee as follows. This new Committee shall hold the office as members of the State Haj Committee for a period of 3 years with effect from 16-08-2009.

PREAMBLE.
In letter read at serial (1) the Karnataka State Board of Wakfs has sent proposal to Government to delegate powers for issuing Marriage Certificate by Karnataka State Board of Wakfs. Since, all the marriages conducted within the jurisdiction of the Masjid concerned are entered in the register maintained by the Mosque and all the Mosque within the State are under the general supervision of the Board as per the Central Wakf Act 1995, the Karnataka State Wakf Board was issuing the Marriage Certificates, after verifying the entries in the Marriage Register maintained by the respective Mosques.
In order to regulate the issuance of the Marriage Certificate, the Government deems it necessary to issue an order authorizing the Karnataka State Wakf Board in this regard. Hence, this order.
ORDER NO: MWD 319 WES 2009, BANGALORE, DATED : 3rd AUGUST, 2009
After careful examination of the matter the Government is pleased to authorize the Karnataka State Board of Wakfs and the District Wakf Advisory Committees to issue Marriage Certificates to the Muslim applicants after fulfilling the following conditions.
1) The Bride & Bridegroom should file a joint affidavit indicating the date of marriage, place of marriage, name of the Vakil names of the witness, name of the parent etc.,
2) The applicant shall furnish a letter from the management of the mosque certifying that their marriage was performed in that mosque and that the copy of the Nikahnama was issued by them.
3) Original Nikahnama issued by the concerned Muthawalli of the mosque to be obtained by the Wakf Board before issuing the marriage certificate.
4) The Board shall verify the original marriage register maintained by the mosque before issue of the marriage certificate by the Wakf Board.
3890 5) The Board shall obtain joint photographs of the Bride & Bridegroom and affix the same on themarriage certificate, which is being issued.
6) No marriage certificate shall be issued on telephonic and web based Nikah.

ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 ರ (1990 ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) 8ನೇ ಪ್ರಕರಣದೊಡನೆ ಓದಿಕೊಂಡ 3 ನೇ ಪ್ರಕರಣದ (1) ನೇ ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ಗೆಜೆಟೆಡ್ ಪ್ರೋಬೇಷನರ್‌ಗಳ ನೇಮಕಾತಿ (ಸ್ಪಧಾತ್ಮಕ ಪರೀಕ್ಷೆಗಳ ಮೂಲಕ ನೇಮಕ) ನಿಯಮಗಳು, 1997 ಕ್ಕೆ ತಿದ್ದುಪಡಿ ಮಾಡಲು ಈ ಕೆಳಕಂಡ ನಿಯಮಗಳ ಕರಡನ್ನು, ಸದರಿ ಅಧಿನಿಯಮದ 3 ನೇ ಪ್ರಕರಣದ (2) ನೇ ಉಪ ಪ್ರಕರಣ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ, ಅದರಿಂದ ಬಾಧಿತರಾಗಬಹುದಾದ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಈ ಮೂಲಕ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡನ್ನು ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಅದು ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳ ತರುವಾಯ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ಸೂಚನೆ ನೀಡಲಾಗಿದೆ.
ಮೇಲೆ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಅವಧಿಯು ಮುಕ್ತಾಯವಾಗುವುದಕ್ಕೆ ಮೊದಲು ಸದರಿ ಕರಡಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಯಾವುದೇ ವ್ಯಕ್ತಿಯಿಂದ ರಾಜ್ಯ ಸರ್ಕಾರವು ಸ್ವೀಕರಿಸಬಹುದಾದ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ ಅಥವಾ ಸಲಹೆಯನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರ ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಸಿಬ್ಬಂದಿ ಮತ್ತು ಆಡಳಿತ ಸುಧಾರಣೆ ಇಲಾಖೆ, ವಿಧಾನ ಸೌಧ, ಬೆಂಗಳೂರು-560 001, ಇವರಿಗೆ ಕಳುಹಿಸಬಹುದು.
ಕರಡು ನಿಯಮಗಳು
1. ಶಿರೋನಾಮೆ ಮತ್ತು ಪ್ರಾರಂಭ :- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಗೆಜೆಟೆಡ್ ಪ್ರೋಬೇಷನರ್‌ಗಳ ನೇಮಕಾತಿ (ಸ್ಪಧಾತ್ಮಕ ಪರೀಕ್ಷೆಗಳ ಮೂಲಕ ನೇಮಕ) (5ನೇ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2009 ಎಂದು ಕರೆಯುವುದು.
(2) ಇದು ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಣೆಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.
2. ಪರಿಶಿಷ್ಟ - II ರ ತಿದ್ದುಪಡಿ :- ಕರ್ನಾಟಕ ಗೆಜೆಟೆಡ್ ಪ್ರೋಬೇಷನರ್‌ಗಳ ನೇಮಕಾತಿ (ಸ್ಪಧಾತ್ಮಕ ಪರೀಕ್ಷೆಗಳ ಮೂಲಕ ನೇಮಕ) ನಿಯಮಗಳು, 1997 ರ ಪರಿಶಿಷ್ಟ - II ರಲ್ಲಿ
(i) ಸೆಕ್ಷೆನ್ I ರಲ್ಲಿ " ಸಿ-ವ್ಯಕ್ತಿತ್ವ ಪರೀಕ್ಷೆ" ರಡಿ "ಅಭ್ಯರ್ಥಿಗಳ ಐದು ಪಟ್ಟು ಸಂಖ್ಯೆಯ" ಪದಗಳಿಗೆ ಬದಲಾಗಿ "ಅಭ್ಯರ್ಥಿಗಳ ಮೂರು ಪಟ್ಟು ಸಂಖ್ಯೆಯ" ಪದಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು.

The draft of the following rules further to amend the Karnataka Recruitment of Gazetted Probationers (Appointment by Competitive Examinations) Rules, 1997 which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) is hereby published as required by clause (a) of sub-section (2) of section 3 of the said Act, for the information of persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the Official Gazette.
Any objection and suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above will be considered by the State Government. Objections and suggestions may be addressed to the Secretary to Government, Department of Personnel and Administrative Reforms, Vidhana Soudha, Bangalore – 560 001.
DRAFT RULES
1. Title and commencement .- (1) These rules may be called the Karnataka Recruitment of Gazetted Probationers (Appointment by Competitive Examinations) (5th Amendment) Rules, 2009.
2. Amendment of Schedule II.- In the Schedule II to the Karnataka Recruitment of Gazetted Probationers (Appointment by Competitive Examinations) Rules, 1997-
(i) under "C-Personality Test" in Section I, for the words "five times the number of candidates," "three times the number of candidates" shall be substituted.
