ವಿಷಯ : ಹೋಲಿಕ್ರಾಸ್ ಇನ್ಸ್‌ಟಿಟ್ಯೂಟ್ ಆಫ್ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಸೈನ್ಸ್‌ಸ್ ಚಿಕ್ಕಮಗಳೂರು - ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಕೋರ್ಸ್‌ಗಳ ಮಂಜೂರಾತಿ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ : ಕರ್ನಾಟಕ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್‌ನ ಸದಸ್ಯ ಕಾರ್ಯದರ್ಶಿಯವರು ಮೇಲೆ ಓದಲಾದ ತಮ್ಮ ಪತ್ರದಲ್ಲಿ ಹೋಲಿಕ್ರಾಸ್ ಇನ್ಸ್‌ಟಿಟ್ಯೂಟ್ ಆಫ್ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಸೈನ್ಸಸ್ ಚಿಕ್ಕಮಗಳೂರು – ಇವರಿಗೆ ಡಿಪ್ಲೋಮೊ ಇನ್ ಲ್ಯಾಬೊರೇಟರಿ ಟೆಕ್ನಾಲಜಿ ಕೋರ್ಸ್‌ನ ಮಂಜೂರಾತಿಗಾಗಿ ಅರ್ಜಿಯನ್ನು ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಮಂಡಳಿಗೆ ಸಲ್ಲಿಸಿದ್ದಾರೆಂದು, ಮಂಡಳಿಯು ವಿಷಯ ತಜ್ಞರ ತಂಡವನ್ನು ರಚಿಸಿ ಕೋರ್ಸುಗಳನ್ನು ಸಂಸ್ಥೆಯು ನಡೆಸಲು ಹೊಂದಿರುವ ಮೂಲಭೂತ ಸೌಕರ್ಯಗಳನ್ನು ಪರಿವೀಕ್ಷಿಸಿ ಅದರ ವರದಿಯನ್ನು ಸಲ್ಲಿಸಲು ಸೂಚಿಸಿತ್ತೆಂದು, ತಜ್ಞರ ತಂಡವು ಸಂಸ್ಥೆಗೆ ದಿನಾಂಕ : 28- 07-2007ರಂದು ಭೇಟಿ ನೀಡಿ ಪರಿವೀಕ್ಷಿಸಿ, ವರದಿಯನ್ನು ಸೂಕ್ತ ಶಿಫಾರಸ್ಸಿನೊಂದಿಗೆ ಮಂಡಳಿಗೆ ಸಲ್ಲಿಸಿತ್ತೆಂದು, ತಜ್ಞರ ತಂಡದ ಪರಿವೀಕ್ಷಣ ವರದಿಯನ್ನು ದಿನಾಂಕ : 07-12-2007 ರಂದು ನಡೆದ ಮಂಡಳಿಯ ಸಭೆಯಲ್ಲಿ ವಿಶ್ಲೇಷಿಸಿ ಕೋರ್ಸ್‌ಗಳನ್ನು ಮಂಜೂರು ಮಾಡಲು ಶಿಫಾರಸ್ಸು ಮಾಡಿದೆಯೆಂದು ವರದಿ ಮಾಡುತ್ತಾ ಮಂಜೂರಾತಿ ನೀಡುವಂತೆ ಸರ್ಕಾರವನ್ನು ಕೋರಿರುತ್ತಾರೆ. ಪ್ರಕರಣವನ್ನು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿದ ನಂತರ ಹೋಲಿಕ್ರಾಸ್ ಇನ್ಸ್‌ಟಿಟ್ಯೂಟ್ ಆಫ್ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಸೈನ್ಸ್‌ಸ್ ಚಿಕ್ಕಮಗಳೂರು – ಇವರಿಗೆ ಡಿಪ್ಲೋಮೊ ಇನ್ ಲ್ಯಾಬೊರೇಟರಿ ಟೆಕ್ನಾಲಜಿ ಕೋರ್ಸನ್ನು 20 ಸೀಟುಗಳ ವಾರ್ಷಿಕ ಪ್ರವೇಶ ಮಿತಿಯೊಂದಿಗೆ 2009-10ನೇ ಸಾಲಿನಿಂದ ಪ್ರಾರಂಭಿಸಲು ಮಂಜೂರಾತಿ ನೀಡಲು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿ ಈ ಆದೇಶವನ್ನು ಹೊರಡಿಸಿದೆ.

ಸರ್ಕಾರದ ಆದೇಶದ ಸಂಖ್ಯೆ, ಆಕುಕ 03 ಎಂಎಂಇ 2008, ಬೆಂಗಳೂರು ದಿನಾಂಕ : 06ನೇ ಜನವರಿ 2010

ಹೋಲಿಕ್ರಾಸ್ ಇನ್ಸ್‌ಟಿಟ್ಯೂಟ್ ಆಫ್ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಸೈನ್ಸಸ್ ಚಿಕ್ಕಮಗಳೂರು – ಇವರಿಗೆ 20 (ಇಪ್ಪತ್ತು) ಸೀಟುಗಳ ವಾರ್ಷಿಕ ಪ್ರವೇಶ ಮಿತಿಯೊಂದಿಗೆ ಡಿಪ್ಲೋಮೊ ಇನ್ ಲ್ಯಾಬೊರೇಟರಿ ಟೆಕ್ನಾಲಜಿ ಕೋರ್ಸನ್ನು 2009-10ನೇ ಸಾಲಿನಿಂದ ಹೊಸದಾಗಿ ಪ್ರಾರಂಭಿಸಲು ಈ ಕೆಳಕಂಡ ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಗಳಿಗೆ ಒಳಪಟ್ಟು ಮಂಜೂರಾತಿ ನೀಡಿದೆ.

ಷರತ್ತುಗಳು

(1) ಯಾವುದೇ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಕೋರ್ಸುಗಳನ್ನು ಪ್ರಾರಂಭ ಮಾಡುವ ಮೊದಲು ಸಂಸ್ಥೆಯು ಸಂಯೋಜನಾ ಶುಲ್ಕದ ರೂಪದಲ್ಲಿ ಪ್ರತಿ ಕೋರ್ಸಿಗೆ ರೂ. 30,000/- (ಮೂವತ್ತು ಸಾವಿರ ರೂಪಾಯಿಗಳು ಮಾತ್ರ) ಹಾಗೂ ಪ್ರತಿ ವರ್ಷ ಸಂಯೋಜನಾ ನವೀಕರಣ ಶುಲ್ಕವಾಗಿ ರೂ. 10,000/- (ಹತ್ತು ಸಾವಿರ ರೂಪಾಯಿಗಳು ಮಾತ್ರ) ಅನ್ನು ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡಿಗೆ ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು. (೪೯೭)ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ ್ರ, ಗುರುವಾರ, ಫ ೆಬ್ರವರಿ ೧೧, ೨೦೧೦ ಭಾಗ-೧ ೪೯೮ (2) ಸಂಸ್ಥೆಯವರು ಕೋರ್ಸನ್ನು ಪ್ರಾರಂಭಿಸುವ ಮೊದಲು ಬೋರ್ಡ್ ನಿಗದಿಪಡಿಸುವ ಬ್ಯಾಂಕ್ ಗ್ಯಾರಂಟಿಯನ್ನು ಒದಗಿಸತಕ್ಕದ್ದು.

(3) ಸದರಿ ಕೋರ್ಸುಗಳಿಗೆ ವಿದ್ಯಾರ್ಥಿ ಪ್ರವೇಶವನ್ನು ವರ್ಷಕ್ಕೆ ಒಂದು ಬಾರಿ ನವೆಂಬರ್ ತಿಂಗಳೊಳಗೆ ತೆಗೆದುಕೊಂಡು ಜನವರಿ ಅಥವಾ ಫೆಬ್ರವರಿ ತಿಂಗಳ ಮಧ್ಯಾಂತರದೊಳಗೆ ವಿದ್ಯಾರ್ಥಿಗಳ ಪಟ್ಟಿಯನ್ನು ಮೂಲ ಅಂಕಪಟ್ಟಿ ಮತ್ತು ದೃಡೀಕರಣಗಳನ್ನು ಬೋರ್ಡಿಗೆ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

(4) ಸದರಿ ಕೋರ್ಸುಗಳಿಗೆ ಪ್ರವೇಶ ಪಡೆದ ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಗೆ ರೂ. 500.00 ರಂತೆ ನೊಂದಣಿ ಶುಲ್ಕದೊಂದಿಗೆ ವಿದ್ಯಾರ್ಥಿಗಳ ಆಯ್ಕೆ ಪಟ್ಟಿಯನ್ನು ಅವರ ವಿದ್ಯಾರ್ಹತೆಯ ಪ್ರಮಾಣ ಪತ್ರದೊಂದಿಗೆ ಮಂಜೂರಾತಿಗಾಗಿ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡಿಗೆ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

(5) ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಕೋರ್ಸಿಗೆ ಪ್ರವೇಶ ಪಡೆಯಲು ಕನಿಷ್ಟ ವಿದ್ಯಾರ್ಹತೆಯು ಎಸ್.ಎಸ್.ಎಲ್.ಸಿ. ಅಥವಾ ತತ್ಸಮಾನ ವಿದ್ಯಾರ್ಹತೆಯನ್ನು ಹೊಂದಿರಬೇಕು. ಕೋರ್ಸ್‌ನ ಅವಧಿ ಮೂರು ವರ್ಷಗಳಾಗಿರತಕ್ಕದ್ದು.

(6) ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಕೋರ್ಸಿಗೆ ಪ್ರವೇಶ ಪಡೆದ ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಯಿಂದ ಸರ್ಕಾರ ನಿಗದಿಪಡಿಸಿದ ಶುಲ್ಕವನ್ನು ಮಾತ್ರ ಪಡೆಯತಕ್ಕದ್ದು.

(7) ಸರ್ಕಾರ ಮಂಜೂರಾತಿ ನೀಡಿದ ಪ್ರವೇಶ ಮಿತಿಗಿಂತ ಹೆಚ್ಚಿನ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಪ್ರವೇಶ ನೀಡತಕ್ಕದ್ದಲ್ಲ. ಒಂದು ವೇಳೆ ನಿಗದಿಪಡಿಸಿದ ಪ್ರವೇಶ ಮಿತಿಗಿಂತ ಹೆಚ್ಚಿನ ಪ್ರವೇಶ ಮಾಡಿಕೊಂಡಲ್ಲಿ ಅದರಿಂದ ಉಂಟಾಗುವ ಅನಾನುಕೂಲ ಸಮಸ್ಯೆಗಳಿಗೆ ಸಂಸ್ಥೆಯೇ ಜವಾಬ್ದಾರಿಯಾಗಿರುತ್ತದೆ.

(8) ಸಂಸ್ಥೆಯವರಿಗೆ ನಿಗದಿಪಡಿಸಿದ ಸೀಟುಗಳಲ್ಲಿ ಶೇ. 20 ರಷ್ಟನ್ನು ಸರ್ಕಾರದಿಂದ ಆಯ್ಕೆ ಮಾಡಿದ ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ಪ್ರವೇಶ ನೀಡಲು ಸಂಸ್ಥೆಯು ಬದ್ದವಾಗಿರತಕ್ಕದ್ದು.

(9) ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್ ನಿಗದಿಪಡಿಸಿದ ನಿಯಮಾವಳಿಯಂತೆ, ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಕೋರ್ಸಿಗೆ ಪ್ರವೇಶ ಪಡೆಯುವ ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಯ ವಯೋಮಿತಿ, ಪಠ್ಯಕ್ರಮ, ಕೋರ್ಸಿನ ಅವಧಿ ಹಗೂ ಪರೀಕ್ಷಾ ಕ್ರಮ ಮತ್ತು ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್ ನಿಗದಿಪಡಿಸಿದ ಇತರೆ ನಿಯಮಗಳನ್ನು ಸಂಸ್ಥೆಯು ಚಾಚೂ ತಪ್ಪದೇ ಕಡ್ಡಾಯವಾಗಿ ಪಾಲಿಸತಕ್ಕದ್ದು.

(10) ಸಂಸ್ಥೆಯು ಸುಸಜ್ಜಿತ ತರಗತಿ ಕೊಠಡಿ, ಪ್ರಯೋಗಶಾಲೆ, ವಾಚನಾಲಯ, ವಿದ್ಯಾರ್ಥಿನಿಲಯ ಹಾಗೂ ಇತರೆ ಸೌಲಭ್ಯವನ್ನು ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಒದಗಿಸತಕ್ಕದ್ದು.

(11) ಸದರಿ ಸಂಸ್ಥೆಯು ಹೊಂದಿರುವ ಮೂಲಭೂತ ಸೌಕರ್ಯಗಳ ಬಗ್ಗೆ ವಿದ್ಯಾರ್ಥಿಗಳು ಮೊದಲ ವರ್ಷದ ಪರೀಕ್ಷೆಯನ್ನು ತೆಗೆದುಕೊಳ್ಳುವ ಪೂರ್ವದಲ್ಲಿ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್ ಇಚ್ಛಿಸಿದಲ್ಲಿ ಎರಡನೇ ಬಾರಿಗೆ ಸಂಸ್ಥೆಯನ್ನು ತಪಾಸಣೆ ಮಾಡತಕ್ಕದ್ದು.

(12) ಸರ್ಕಾರದಿಂದ ಯಾವುದೇ ಆರ್ಥಿಕ ಸೌಲಭ್ಯ ಅಥವಾ ಅನುದಾನವನ್ನು ಸಂಸ್ಥೆಗೆ ನೀಡಲಾಗುವುದಿಲ್ಲ.

(13) ಸಂಸ್ಥೆಯನ್ನು ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್‌ನಲ್ಲಿ ನೋಂದಣಿ ಮಾಡಿಸತಕ್ಕದ್ದು ಹಾಗೂ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್ ನಿಗದಿಪಡಿಸುವ ಮಾದರಿಯನ್ನು ಅನುಸರಿಸತಕ್ಕದ್ದು.

(14) ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಕೋರ್ಸಿನ ಅಂತ್ಯದಲ್ಲಿ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡ್ ನಡೆಸುವ ಪರೀಕ್ಷೆಯನ್ನು ವಿದ್ಯಾರ್ಥಿಗಳು ತೆಗೆದುಕೊಂಡು, ಉತ್ತೀರ್ಣರಾಗುವ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಪ್ರಮಾಣಪತ್ರವನ್ನು ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡಿನಿಂದ ಪಡೆಯತಕ್ಕದ್ದು.

(15) ಪ್ರತಿ ತಪಾಸಣೆಗೆ ಮತ್ತು ಒಂದು ಕೋರ್ಸಿಗೆ ಸಂಸ್ಥೆಯು ರೂ. 10,000/- (ಹತ್ತು ಸಾವಿರ ರೂಪಾಯಿಗಳು ಮಾತ್ರ) ಅನ್ನು ತಪಾಸಣಾ ಶುಲ್ಕವಾಗಿ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡಿಗೆ ಪಾವತಿ ಮಾಡತಕ್ಕದ್ದು.

(16) ದಿನಾಂಕ : 30-03-1999 ಸಂಖ್ಯೆ ಆಕುಕ 144 ಎಂಎಂಇ 98ರ ಸರ್ಕಾರಿ ಆದೇಶದಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವ ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಕಟ್ಟುನಿಟ್ಟಾಗಿ ಪಾಲಿಸತಕ್ಕದ್ದು ಹಾಗೂ ಆಕುಕ 328 ಎಂಎಸ್ಎಫ್ 07, ದಿನಾಂಕ : 27-07-2007ರಲ್ಲಿ ತಿಳಿಸಿರುವ ಆದೇಶವನ್ನು ಪಾಲಿಸತಕ್ಕದ್ದು.

(17) ಪ್ರಸ್ತುತ ವಿಧಿಸುತ್ತಿರುವ ಮೇಲ್ಕಂಡ ನಿಗದಿತ ಷರತ್ತುಗಳನ್ನು ಉಲ್ಲಂಘಿಸಿದ ಸಂದರ್ಭದಲ್ಲಿ ಅಂತಹ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಶಾಲೆ/ಕೋರ್ಸ್‌ನ ಮಾನ್ಯತೆಯನ್ನು ರದ್ದು ಪಡಿಸಬಹುದೆಂದು ಸಂಸ್ಥೆಯು ರೂ. 100 ಛಾಪಾ ಕಾಗದದಲ್ಲಿ ಮುಚ್ಚಳಿಕೆಯನ್ನು ನೀಡತಕ್ಕದ್ದು.

(18) ಪ್ರಸ್ತಾವಿತ ಶಾಲೆಯ ಕಟ್ಟಡವು ಬಾಡಿಗೆ/ಲೀಸ್ ಆದ ಪಕ್ಷದಲ್ಲಿ ಬಾಡಿಗೆ/ಲೀಸ್ ಕರಾರು ಪತ್ರವು ರೂ. 100 ಛಾಪಾ ಕಾಗದದಲ್ಲಿರಬೇಕು ಮತ್ತು ಬಾಡಿಗೆ/ಲೀಸ್ ಅವಧಿಯು ಕನಿಷ್ಠ 10 ವರ್ಷಗಳಿಗಿರಬೇಕು.

(19) ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಶಾಲೆ/ಕೋರ್ಸ್ ಮಂಜೂರಾತಿ ಆದ ದಿನಾಂಕದಿಂದ 5 ವರ್ಷದೊಳಗಾಗಿ ಮಂಜೂರಾತಿ ಪಡೆದ ಸಂಸ್ಥೆಯು ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಶಾಲೆ/ಕೋರ್ಸನ್ನು ನಡೆಸಲು ತನ್ನದೇ ಆದ ಸ್ವಂತ ಕಟ್ಟಡವನ್ನು ಹೊಂದುವುದಾಗಿ ರೂ. 100 ಛಾಪಾ ಕಾಗದದಲ್ಲಿ ಮುಚ್ಚಳಿಕೆಯನ್ನು ನೀಡತಕ್ಕದ್ದು.

(20) ಸಂಸ್ಥೆಯು ಪ್ರತಿವರ್ಷ ವಿದ್ಯಾರ್ಥಿಗಳ ಪ್ರವೇಶವನ್ನು ಮಾಡುವ ಮೊದಲು ಸಂಸ್ಥೆಯು ಪ್ರಾಂಶುಪಾಲರನ್ನು ಒಳಗೊಂಡಂತೆ ಎಲ್ಲಾ ಸಿಬ್ಬಂದಿಗಳ (ಬೋಧಕ ಮತ್ತು ಬೋಧಕೇತರ) ಸಂಪೂರ್ಣ ಮಾಹಿತಿಯನ್ನು ನೀಡತಕ್ಕದ್ದು.

(21) ಮೇಲ್ಕಂಡ ಯಾವುದೇ ಷರತ್ತುಗಳನ್ನು ಸಂಸ್ಥೆಯು ಉಲ್ಲಂಘಿಸಿದಲ್ಲಿ ನಿಯಮಾನುಸಾರ ಕ್ರಮ ಕೈಗೊಳ್ಳಲಾಗುವುದು.

(22) ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಹೊಸ ಕೋರ್ಸ್‌ಗಳನ್ನು ಪ್ರಾರಂಭಿಸಲು ಬ್ಯಾಂಕ್ ಗ್ಯಾರಂಟಿ ಅಫಿಲಿಯೇಷನ್ ಫೀ ಮತ್ತು ವಿದ್ಯಾರ್ಥಿಗಳ ಮೂಲ ದಾಖಲೆಗಳನ್ನು ಸಂಸ್ಥೆಗಳು ದಿನಾಂಕ : 31-01-2010ರೊಳಗಾಗಿ ಪ್ಯಾರಾ ಮೆಡಿಕಲ್ ಬೋರ್ಡಿಗೆ ನೀಡಿದಲ್ಲಿ 2009-10ನೇ ಸಾಲಿಗೆ ಮಂಜೂರಾತಿಯು ಅನ್ವಯಿಸತಕ್ಕದ್ದು ಅಥವಾ ದಿನಾಂಕ : 01-02-2010ರ ನಂತರ ನೀಡಿದಲ್ಲಿ 2010-11ನೇ ಸಾಲಿಗೆ ಮಂಜೂರಾತಿಯು ಜಾರಿಗೊಳಿಸತಕ್ಕದ್ದು.

ವಿಷಯ : ಶ್ರೀ ಆರ್.ಎನ್. ಪಠಾಣ್, ನಿವೃತ್ತ ಸಹಾಯಕ ಸರ್ಕಾರಿ ಅಭಿಯೋಜಕರು, ಗದಗ್ ಇವರ ವಿರುದ್ಧ ದಾಖಲಾಗಿರುವ ಲೋಕಾಯುಕ್ತ ಪ್ರಕರಣದ ಕುರಿತು ಇಲಾಖಾ ವಿಚಾರಣೆಯನ್ನು ನಡೆಸುವ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ :

ಮೇಲೆ (1) ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ: 08.12.2005ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಶ್ರೀ ಆರ್.ಎನ್.ಪಠಾಣ್, ಸಹಾಯಕ ಸರ್ಕಾರಿ ಅಭಿಯೋಜಕರವರು ಈ ಹಿಂದೆ ಜೆ.ಎಂ.ಎಫ್.ಸಿ. ನ್ಯಾಯಾಲಯ, ಗದಗ್ ಇಲ್ಲಿ ಕಾರ್ಯ ನಿರ್ವಹಿಸುತ್ತಿದ್ದಾಗ ಅಕ್ರಮ ಸಂಭಾವನೆಯನ್ನು ಸ್ವೀಕರಿಸುವಾಗ ಲೋಕಾಯುಕ್ತ ಪೋಲೀಸರ ಬಲೆಗೆ ಸಿಲುಕಿದ್ದು, ಲೋಕಾಯುಕ್ತರ ಪ್ರಸ್ತಾವನೆ ಮೇರೆಗೆ ಸಕ್ಷಮ ನ್ಯಾಯಲಯದಲ್ಲಿ ಕ್ರಿಮಿನಲ್ ಮೊಕದ್ದಮೆ ಹೂಡಲು ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತರಿಗೆ ಅನುಮತಿ ನೀಡಲಾಗಿದೆ. ಮೇಲೆ (2) ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ: 30.10.2006ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಸದರಿ ಅಧಿಕಾರಿಯ ವಿರುದ್ಧ ಮೇಲೆ (1) ರಲ್ಲಿ ಓದಲಾದ ಪ್ರಕರಣದ ಸಂಬಂಧ ಇಲಾಖಾ ವಿಚಾರಣೆಯನ್ನು ನಡೆಸಲು ಮಾನ್ಯ ಲೋಕಾಯುಕ್ತರು, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ಇವರಿಗೆ ವಹಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ (3) ರಲ್ಲಿ ಓದಲಾದ ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತರ ಪತ್ರದಲ್ಲಿ ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ರವರು ಮೇಲೆ (2) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶವು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 14 (ಎ) ರನ್ವಯ ಕ್ರಮಬದ್ಧವಾಗಿಲ್ಲವೆಂದು ತಿಳಿಸಿರುತ್ತಾರೆ.

ಆದ್ದರಿಂದ, ಪ್ರಸ್ತಾವನೆಯನ್ನು ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ: ಒಇ 197 ಪಿಪಿಇ 2006, ಬೆಂಗಳೂರು,ದಿನಾಂಕ: 7ನೇ ಜನವರಿ 2010. ಮೇಲಿನ ವಿವರಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಆಡಳಿತಾತ್ಮಕ ಕಾರಣಗಳಿಂದಾಗಿ ಸರ್ಕಾರದ ಆದೇಶ ಸಂ: ಒಇ 197 ಪಿಪಿಇ 2006, ದಿನಾಂಕ:30.10.2006ನ್ನು ಹಿಂದಕ್ಕೆ ಪಡೆದಿದೆ. ಮುಂದುವರೆದು, ಶ್ರೀ ಆರ್.ಎನ್.ಪಠಾಣ್, ನಿವೃತ್ತ ಸಹಾಯಕ ಸರ್ಕಾರಿ ಅಭಿಯೋಜಕರು, ನಿಪ್ಪಾಣಿ ಇವರ ವಿರುದ್ಧ ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ನಮೂದಿಸಿರುವ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಆರೋಪಗಳ ಬಗ್ಗೆ ಇಲಾಖಾ ವಿಚಾರಣೆ ನಡೆಸಲು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಾವಳಿಗಳು, 1957ರ, ನಿಯಮ 11 ರೊಡನೆ ಓದಿ, ನಿಯಮ 14 ಎ ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರದನ್ವಯ ಮಾನ್ಯ ನಿರ್ದೇಶಕರು, ಅಭಿಯೋಗ ಮತ್ತು ಸರ್ಕಾರಿ ವ್ಯಾಜ್ಯಗಳ ಇಲಾಖೆ, ಬೆಂಗಳೂರು ಇವರು ನಡೆಸುವಂತೆ ಆದೇಶಿಸಿದೆ.

ಪ್ರಸ್ತಾವನೆ :

ಪಂಚಾಯತ್ ರಾಜ್ ಸಂಸ್ಥೆಗಳಿಂದ ಅನುಷ್ಠಾನಗೊಳ್ಳುತ್ತಿರುವ ಕಾರ್ಯಕ್ರಮಗಳ ಪರಿಶೀಲನೆಯನ್ನು ಹಾಲಿ ಇರುವ ತಾಲ್ಲೂಕು ಜಾಗೃತ ಸಮಿತಿಯಿಂದ ಕೈಗೊಳ್ಳಲಾಗುತ್ತಿದೆ. ಸದರಿ ಸಮಿತಿಗೆ ತಾಲ್ಲೂಕಿನ ಅತೀ ಹೆಚ್ಚು ವಿಧಾನಸಭಾ ಕ್ಷೇತ್ರವನ್ನು ಪ್ರತಿನಿಧಿಸುವ ವಿಧಾನಸಭಾ ಸದಸ್ಯರು ಅಧ್ಯಕ್ಷರಾಗಿರುತ್ತಾರೆ ಹಾಗೂ ತಾಲ್ಲೂಕಿನ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಇತರ ವಿಧಾನ ಸಭಾ ಸದಸ್ಯರು ಸಹ-ಅಧ್ಯಕ್ಷರಾಗಿರುತ್ತಾರೆ.

ಈ ವ್ಯವಸ್ಥೆಯಿಂದಾಗಿ ವಿವಿಧ ಕಾರ್ಯಕ್ರಮಗಳಡಿ, ಫಲಾನುಭವಿಗಳ ಆಯ್ಕೆ ಹಾಗೂ ಯೋಜನೆಗಳನ್ನು ರೂಪಿಸುವಲ್ಲಿ ತೊಂದರೆಯಾಗುತ್ತಿರುವುದು ಸರ್ಕಾರದ ಗಮನಕ್ಕೆ ಬಂದಿರುತ್ತದೆ. ಹೀಗಾಗಿ ಪ್ರಸಕ್ತ ತಾಲ್ಲೂಕು ಜಾಗೃತ ಸಮಿತಿಯ ಬದಲಿಗೆ ವಿಧಾನಸಭಾ ಸದಸ್ಯರ ಅಧ್ಯಕ್ಷತೆಯಲ್ಲಿ ವಿಧಾನಸಭಾ ಕ್ಷೇತ್ರವಾರು ಜಾಗೃತ ಸಮಿತಿಯನ್ನು ರಚಿಸಲು ಸರ್ಕಾರವು ನಿರ್ಧರಿಸಿರುತ್ತದೆ. ಆದುದರಿಂದ ಈ ಆದೇಶ.

ಪಂಚಾಯತ್ ರಾಜ್ ಸಂಸ್ಥೆಗಳಿಂದ ಅನುಷ್ಠಾನಗೊಳ್ಳುತ್ತಿರುವ ಸರ್ಕಾರದ ಕಾರ್ಯಕ್ರಮಗಳ ಪರಿಶೀಲನೆ ಮಾಡಲು ಉಲ್ಲೇಖ (2) ರ ಆದೇಶದ ಮೂಲಕ ರಚಿಸಲಾಗಿದ್ದ ತಾಲ್ಲೂಕು ಜಾಗೃತ ಸಮಿತಿಯ ಬದಲಿಗೆ ವಿಧಾನಸಭಾ ಕ್ಷೇತ್ರವಾರು ಜಾಗೃತ ಸಮಿತಿಯನ್ನು ಈ ಕೆಳಕಂಡಂತೆ ರಚನೆ ಮಾಡಲಾಗಿದೆ.

ಸದರಿ ಸಮಿತಿಯ ಕಾರ್ಯಚಟುವಟಿಕೆಗಳು ಈ ಕೆಳಗಿನಂತಿರುತ್ತದೆ:

ಸದಸ್ಯ ಕಾರ್ಯದರ್ಶಿಗಳು ಪ್ರತಿ ತ್ರೈಮಾಸಿಕದಲ್ಲಿ ಕನಿಷ್ಠ ಒಂದು ಸಭೆಯನ್ನು ನಡೆಸಲು ಕ್ರಮ ತೆಗೆದುಕೊಳ್ಳಬೇಕು.

ಸಮಿತಿಯ ಅಧ್ಯಕ್ಷರಿಂದ ಸಭೆಯ ದಿನಾಂಕವನ್ನು ಪಡೆದು 7 ಕೆಲಸದ ದಿನಗಳ ಅವಧಿಯ ನೋಟೀಸನ್ನು ನೀಡಿ ಸಭೆ ನಡೆಸಬೇಕು. ಸಭೆ ನಡೆದ 3 ಕೆಲಸದ ದಿನಗಳ ಒಳಗಾಗಿ ನಡವಳಿಗಳನ್ನು ಹೊರಡಿಸಿ ಸಂಬಂಧಪಟ್ಟ ಎಲ್ಲ ಸದಸ್ಯರಿಗೆ ಅಗತ್ಯ ಕ್ರಮಕ್ಕಾಗಿ ಕಳುಹಿಸಬೇಕು. ಅಲ್ಲದೆ ಜಿಲ್ಲಾ ಪಂಚಾಯತ್ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಾಹಕ ಅಧಿಕಾರಿಗಳು ಹಾಗೂ ಜಿಲ್ಲಾ ಮಟ್ಟದ ಅಧಿಕಾರಿಗಳಿಗೆ ಮುಂದಿನ ಕ್ರಮ ಕೈಗೊಳ್ಳಲು ವರದಿ ಕಳುಹಿಸಬೇಕು.

ಪ್ರಸ್ತಾವನೆ : ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು, ಮೈಸೂರು ಜಿಲ್ಲೆ, ಮೈಸೂರು ರವರು ಮೇಲೆ ಓದಲಾದ ದಿನಾಂಕ : 17-06-2009ರ ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ, ಮೈಸೂರು ತಾಲ್ಲೂಕು, ಬೆಳವಾಡಿ ಗ್ರಾಮದ ಸರ್ವೆ ನಂ. 166 ರಲ್ಲಿ 1.36 ಎಕರೆ, ಸರ್ವೆ ನಂ. 192ರಲ್ಲಿ 7.04 ಎಕರೆ, ಒಟ್ಟು 9.00 ಎಕರೆ ಜಮೀನು ಇದ್ದು, ಸದರಿ ಜಮೀನು ಸರ್ಕಾರಿ ಖರಾಬು ಕಲ್ಲುಮಂಟಿಯೆಂದು ಆರ್.ಟಿ.ಸಿ.ಯಲ್ಲಿ ನಮೂದಾಗಿರುತ್ತದೆ. ಪ್ರಸ್ತುತ ಜಮೀನು ಖಾಲಿ ಇರುವುದಾಗಿ, ನಮೂನೆ 50 ಹಾಗೂ 53ರಲ್ಲಿ ಯಾರೂ ಅರ್ಜಿ ಸಲ್ಲಿಸಿರುವುದಿಲ್ಲ, ಸದರಿ ಜಮೀನಿನಲ್ಲಿ ಯಾವುದೇ ಬೆಲೆ ಬಾಳುವ ಗಿಡಮರಗಳು ಹಾಗೂ ಖನಿಜ ಸಂಪತ್ತು ಮತ್ತು ಕಟ್ಟಡಗಳು ಇರುವುದಿಲ್ಲವೆಂದು ಹಾಗೂ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರದಿಂದ ಮತ್ತು ಚೇತನ ಗೃಹ ನಿರ್ಮಾಣದವರು ನಿರ್ಮಿಸಿರುವ ಬಡಾವಣೆಗೆ ಹೊಂದಿಕೊಂಡಿರುತ್ತದೆ. ಸದರಿ ಜಮೀನನ್ನು ಈ ಹಿಂದೆ ಏರ್ ಫೋರ್ಸ್ ನಾವೆಲ್ ಹೌಸಿಂಗ್ ಬೋರ್ಡ್‌ಗೆ ಮಂಜೂರು ಮಾಡಲು ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನು ಯಾರಿಗೂ ಮಂಜೂರು ಮಾಡಿರುವುದಿಲ್ಲ. ಈಗ ಆ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕೈಬಿಟ್ಟು ಸದರಿ ಜಮೀನನ್ನು ರಾಷ್ಟ್ರೋತ್ಥಾನ ಪರಿಷತ್, ಬೆಂಗಳೂರು ರವರಿಗೆ ಶೈಕ್ಷಣಿಕ ಸಂಸ್ಥೆಗಳನ್ನು ತೆರೆಯುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಮಂಜೂರು ಮಾಡುವಂತೆ ಕೋರಿರುತ್ತಾರೆ. ರಾಷ್ಟ್ರೋತ್ಥಾನ ಪರಿಷತ್ ಸಂಸ್ಥೆಯು, ಬೆಂಗಳೂರಿನಲ್ಲಿ ಕ್ರಮ ಸಂಖೈ : 155/1964-65ರಲ್ಲಿ ನೋಂದಣಿಯಾಗಿದ್ದು ಹಾಲಿ ಸಂಸ್ಥೆಯು ಅಸ್ತಿತ್ವದಲ್ಲಿರುತ್ತದೆ. ಸದರಿ ಸಂಸ್ಥೆಗೆ ಶೈಕ್ಷಣಿಕ ಸಂಸ್ಥೆಗಳನ್ನು ತೆರೆಯುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಜಮೀನು ಮಂಜೂರು ಮಾಡುವುದು ಸೂಕ್ತವಾಗಿರುತ್ತದೆ. ಇದರಿಂದ ಗ್ರಾಮಾಂತರ ಪ್ರದೇಶದಲ್ಲಿನ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಶೈಕ್ಷಣಿಕ ಸೌಲಭ್ಯ ದೊರೆಯುವಂತಾಗುತ್ತದೆ ಎಂದು ತಿಳಿಸಿರುತ್ತಾರೆ. ಪ್ರಸ್ತಾವಿತ ಜಮೀನಿನ ಪ್ರಸಕ್ತ ಮಾರುಕಟ್ಟೆ ಬೆಲೆ ಎಕರೆ ಒಂದಕ್ಕೆ ರೂ. 12.00 ಲಕ್ಷಗಳು ಎಂದು ಪ್ರಾದೇಶಿಕ ಆಯುಕ್ತರು ವರದಿ ಮಾಡಿದ್ದು ಅದರಂತೆ ಮಂಜೂರಾತಿಗೆ ಕೋರಿರುವ ಒಟ್ಟು 9.00 ಎಕರೆ ಜಮೀನಿನ ಪ್ರಸಕ್ತ ಮಾರುಕಟ್ಟೆ ಬೆಲೆ ರೂ. 108.00 ಲಕ್ಷಗಳಾಗುವುದರಿಂದ, ಆರ್ಥಿಕ ಇಲಾಖೆಯಿಂದ ಈ ಕೆಳಕಂಡಂತೆ ಅಭಿಪ್ರಾಯ ಪಡೆಯಲಾಗಿದೆ :-

ಈ ಜಮೀನಿಗೆ ರಾಷ್ಟ್ರೋತ್ಥಾನ ಪರಿಷತ್ ಸಹ ಅರ್ಜಿ ಹಾಕಿದೆ. ಕಾರಣ ಈ ಜಮೀನನ್ನು ರಾಷ್ಟ್ರೋತ್ಥಾನ ಪರಿಷತ್‌ಗೆ ಶೈಕ್ಷಣಿಕ ಮತ್ತು ಸಾಮಾಜಿಕ ಯೋಜನೆಗಳಿಗೆ ನೀಡಲು ಈಗಾಗಲೇ ಮಾನ್ಯ ಮುಖ್ಯಮಂತ್ರಿಗಳು ಕಂದಾಯ ಇಲಾಖೆಗೆ ಸೂಚನೆ ನೀಡಿರುತ್ತಾರೆ. ಆದುದರಿಂದ, ಏರ್ ಫೋರ್ಸ್ ನಾವೆಲ್ ಹೌಸಿಂಗ್ ಬೋರ್ಡ್‌ಗೆ ಪರ್ಯಾಯ ಜಮೀನು ನೀಡುವ ಬಗ್ಗೆ ಪರಿಶೀಲಿಸಬೇಕೆಂದು ಕಂದಾಯ ಇಲಾಖೆಗೆ ತಿಳಿಸಿದೆ.

ಕರ್ನಾಟಕ ಭೂ ಮಂಜೂರಾತಿ ನಿಯಮಗಳು 1969 ನಿಯಮ 19ರ ಪ್ರಕಾರ ಶೈಕ್ಷಣಿಕ ಸಂಸ್ಥೆಗಳಿಗೆ ಗುತ್ತಿಗೆ ಆಧಾರದ ಮೇಲೆ ಮಾತ್ರ ಸರ್ಕಾರಿ ಜಮೀನನ್ನು ಮಂಜೂರು ಮಾಡಲು ಅವಕಾಶವಿದೆ. ಆದ ಕಾರಣ ಕರ್ನಾಟಕ ಭೂ ಮಂಜೂರಾತಿ ನಿಯಮಗಳು 1969 ನಿಯಮ 27ರಲ್ಲಿನ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಸದರಿ ನಿಯಮ 19ನ್ನು ಸಡಿಲಿಸಿ ಶೈಕ್ಷಣಿಕ ಉದ್ದೇಶಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ಭೂ ಮಂಜೂರಾತಿ ನಿಯಮ 21ರಡಿಯಲ್ಲಿ ಪ್ರಚಲಿತ ಮಾರುಕಟ್ಟೆ ಮತ್ತು ಇತರೆ ಶುಲ್ಕಗಳನ್ನು ವಿಧಿಸಿ ರಾಷ್ಟ್ರೋತ್ಥಾನ ಪರಿಷತ್, ಬೆಂಗಳೂರು ರವರಿಗೆ ಮಂಜೂರು ಮಾಡಲು ಪರಿಶೀಲಿಸಿ ಸದರಿ ಜಮೀನನ್ನು ಕರ್ನಾಟಕ ಭೂ ಮಂಜೂರಾತಿ ನಿಯಮ 1969ರ ನಿಯಮ 27ರಲ್ಲಿನ ಪದವತ್ತಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಶೈಕ್ಷಣಿಕ ಉದ್ದೇಶಕ್ಕಾಗಿ ರಾಷ್ಟ್ರೋತ್ಥಾನ ಪರಿಷತ್, ಬೆಂಗಳೂರು ಇವರಿಗೆ ಮಂಜೂರು ಮಾಡಲು ನಿರ್ಣಯಿಸಿದ್ದು ಅದರಂತೆ ಈ ಆದೇಶ.

ವಿಷಯ : 2006-07ನೇ ಸಾಲಿನಲ್ಲಿ ವೃತ್ತಿ ಶಿಕ್ಷಣ ಕೋರ್ಸುಗಳಿಗೆ ಸಿಇಟಿ ಮೂಲಕ ಹೆಚ್ಚುವರಿ ಶುಲ್ಕ ಕೋಟಾದಡಿ ಪ್ರವೇಶ ಪಡೆದ ಇಂಜಿನಿಯರಿಂಗ್ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಪ್ರವೇಶ ಶುಲ್ಕ ಸಹಾಯಧನ ನೀಡುವ ಯೋಜನೆ ಬಗ್ಗೆ.

ಓದಲಾಗಿದೆ: 1. ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ : ಇಡಿ 123 ಟಿಇಸಿ 2006 ದಿನಾಂಕ : 22-6-2007.

ಪ್ರಸ್ತಾವನೆ :

2006-07ನೇ ಸಾಲಿಗೆ ಸಿ.ಇ.ಟಿ. ಮೂಲಕ ಇಂಜಿನಿಯರಿಂಗ್ ಕೋರ್ಸುಗಳಿಗೆ ಹೆಚ್ಚುವರಿ ಶುಲ್ಕ ಕೋಟಾದಡಿ ಪ್ರವೇಶಾತಿ ಪಡೆದ 4379 ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಪ್ರವೇಶ ಶುಲ್ಕದಲ್ಲಿ ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಗೆ ರೂ. 0.25 ಲಕ್ಷದಂತೆ ಮರುಪಾವತಿಸಲು ಕೆಲವು ಷರತ್ತುಗಳೊಂದಿಗೆ ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (1)ರ ಆದೇಶದಲ್ಲಿ ಸರ್ಕಾರವು ಮಂಜೂರಾತಿ ಮಾಡಲಾಗಿತ್ತು.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (2)ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ತಾಂತ್ರಿಕ ಶಿಕ್ಷಣ ನಿರ್ದೇಶಕರು 2006-07ನೇ ಸಾಲಿಗೆ ಸಿ.ಇ.ಟಿ.

ಮೂಲಕ ಇಂಜಿನಿಯರಿಂಗ್ ಕೋರ್ಸುಗಳಿಗೆ ಹೆಚ್ಚುವರಿ ಶುಲ್ಕ ಕೋಟಾದಡಿ ಪ್ರವೇಶಾತಿ ಪಡೆದ ಅರ್ಹ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಪ್ರವೇಶ ಶುಲ್ಕದಲ್ಲಿ ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಗೆ ರೂ. 0.25 ಲಕ್ಷದಂತೆ ಒಂದು ಬಾರಿಗೆ ಮಾತ್ರ ಮರುಪಾವತಿಸಲಾಗಿದೆ. ಆದರೆ ಸದರಿ ಸೌಲಭ್ಯವನ್ನು ಉಳಿದ ಮೂರು ವರ್ಷಗಳಿಗೂ (2007-08, 2008-09 ಮತ್ತು 2009-10) ವಿಸ್ತರಿಸುವಂತೆ ಕೋರಿ ವಿದ್ಯಾರ್ಥಿಗಳು, ಪೋಷಕರು ಹಾಗೂ ಕಾಲೇಜಿನ ಪ್ರಾಂಶುಪಾಲರುಗಳು ಕೋರಿಕೆ ಸಲ್ಲಿಸಿರುವುದನ್ನು ಪರಿಶೀಲಿಸಿ 2006-07ನೇ ಸಾಲಿನಲ್ಲಿ ಹೆಚ್ಚುವರಿ ಶುಲ್ಕ ಕೋಟಾದಡಿ ಪ್ರವೇಶ ಪಡೆದಿರುವ ವಿದ್ಯಾರ್ಥಿಗಳ ಮುಂದಿನ ಶೈಕ್ಷಣಿಕ ಹಾಗೂ ಭವಿಷ್ಯದ ಹಿತದೃಷ್ಟಿಯಿಂದ 2007-08 ರಿಂದ 2009-10ನೇ ಸಾಲಿನವರೆಗೂ ಅನ್ವಯವಾಗುವಂತೆ ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಗೆ ರೂ. 25000-00 (ಇಪ್ಪತ್ತೈದು ಸಾವಿರ) ದಂತೆ ಪ್ರವೇಶ ಶುಲ್ಕ ಸಹಾಯಧನ ಮಂಜೂರು ಮಾಡುವುದು ಸೂಕ್ತವೆಂದು ಅಭಿಪ್ರಾಯ ವ್ಯಕ್ತಪಡಿಸಿ ಸರ್ಕಾರದ ಆದೇಶವನ್ನು ಕೋರಿರುತ್ತಾರೆ.

ನಿರ್ದೇಶಕರ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸರ್ಕಾರವು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, 2006-07ನೇ ಸಾಲಿನಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿರುವ ಹೆಚ್ಚುವರಿ ಶುಲ್ಕವು ಅಧಿಕವಾಗಿದ್ದು ಮಧ್ಯಮ ವರ್ಗದ ಕುಟುಂಬದಿಂದ ಬಂದಂತಹ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಶುಲ್ಕಗಳನ್ನು ಭರಿಸಲು ಸಾಧ್ಯವಾಗುವುದಿಲ್ಲವೆಂದು, ಕಾಲೇಜುಗಳಿಗೆ ಪಾವತಿಸಬೇಕಾದ ಶುಲ್ಕದಲ್ಲಿ ಬದಲಾವಣೆಯಾಗದೆ ಹಾಗೆಯೇ ಇದ್ದರೂ ವಿದ್ಯಾರ್ಥಿಗಳ ಮೇಲಿನ ಅಧಿಕ ಹೊರೆಯನ್ನು ಕಡಿಮೆ ಮಾಡಲು ತೀರ್ಮಾನಿಸಿ 2007-08ನೇ ಸಾಲಿಗೂ ಕರ್ನಾಟಕದ ಅರ್ಹ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಸಹಾಯ ಧನ ಸೌಲಭ್ಯ ವಿಸ್ತರಿಸಲು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿದೆ. ಅದರಂತೆ ಈ ಕೆಳಕಂಡ ಆದೇಶ.

2006-07ನೇ ಸಾಲಿನಲ್ಲಿ ಸಿ.ಇ.ಟಿ. ಮೂಲಕ ಇಂಜಿನಿಯರಿಂಗ್ ಕೋರ್ಸುಗಳಿಗೆ ಹೆಚ್ಚುವರಿ ಶುಲ್ಕ ಕೋಟಾದಡಿಯಲ್ಲಿ ಪ್ರವೇಶಾತಿ ಪಡೆದ 4379 ವಿದ್ಯಾರ್ಥಿಗಳಲ್ಲಿ 2007-08ನೇ ಸಾಲಿಗೆ ಅರ್ಹತೆ ಹೊಂದಿದ ವಿದ್ಯಾರ್ಥಿಗಳಿಗೆ ಪ್ರವೇಶ ಶುಲ್ಕದಲ್ಲಿ ಪ್ರತಿ ರೂ. 0.25 ಲಕ್ಷದಂತೆ ಸಹಾಯಧನವಾಗಿ ನೀಡಲು ರೂ. 800.00 ಲಕ್ಷ (ರೂಪಾಯಿ ಎಂಟು ನೂರು ಲಕ್ಷಗಳು ಮಾತ್ರ) ಗಳನ್ನು ಮರುಪಾವತಿಸಲು ತಾತ್ವಿಕವಾಗಿ ಸರ್ಕಾರವು ಮಂಜೂರಾತಿ ನೀಡಿದೆ.

ಈ ಉದ್ದೇಶಕ್ಕಾಗಿ ರೂ. 800.00 ಲಕ್ಷಗಳನ್ನು ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆ 2203-00-107-1-00-117(ಪಿ) ಯೋಜನೆಯಡಿ 2009-10ನೇ ಸಾಲಿನಲ್ಲಿ ನಿಗಧಿ ಆಗಿರುವ ಆಯವ್ಯಯ ಮಿತಿಯಲ್ಲಿ ಭರಿಸಲು ನಿರ್ದೇಶಕರು, ತಾಂತ್ರಿಕ ಶಿಕ್ಷಣ ಇಲಾಖೆ, ಬೆಂಗಳೂರು. ಇವರಿಗೆ ಈ ಕೆಳಕಂಡ ಷರತ್ತನ್ನು ವಿಧಿಸಿ ಬಿಡುಗಡೆ ಮಾಡಲಾಗಿದೆ.

ಷರತ್ತುಗಳು :

1. ಪರಿಶಿಷ್ಟ ಜಾತಿ/ಪರಿಶಿಷ್ಟ ಪಂಗಡದ ವಿದ್ಯಾರ್ಥಿಗಳ ಶುಲ್ಕವನ್ನು ಇದರಿಂದ

ಭರಿಸಬಾರದು.

2. ಶುಲ್ಕ ಮರುಪಾವತಿಯ ಮೊತ್ತವನ್ನು ಸಂಬಂಧಿಸಿದ ವಿದ್ಯಾರ್ಥಿಗಳ ಬ್ಯಾಂಕ್ ಖಾತೆಗೆ

ಜಮಾ ಮಾಡತಕ್ಕದ್ದು.

3. ವಿದ್ಯಾರ್ಥಿಗಳು ತಾವು ವ್ಯಾಸಂಗ ಮಾಡುತ್ತಿರುವ ಸಂಸ್ಥೆಯ ಮುಖ್ಯಸ್ಥರಿಂದ ನಿರಾಕ್ಷೇಪಣಾ ಪತ್ರವನ್ನು ಪಡೆದು ಸಲ್ಲಿಸಿದ ನಂತರವೇ ಹಣವನ್ನು ಅವರ ಬ್ಯಾಂಕ್

ಖಾತೆಗೆ ಜಮಾ ಮಾಡತಕ್ಕದ್ದು.

4. ವಿದ್ಯಾರ್ಥಿಯು ಹಾಲಿ ವ್ಯಾಸಂಗ ಮಾಡುತ್ತಿರುವ ತರಗತಿಯಲ್ಲಿ ಉತೀರ್ಣರಾಗಿ ಮುಂದಿನ ತರಗತಿಗೆ ಅರ್ಹತೆ ಇರಬೇಕು. ಒಂದು ವೇಳೆ ಕೋರ್ಸಿನ ಯಾವುದೇ

ವರ್ಷದಲ್ಲಿ ಅನರ್ಹರಾದ ಪಕ್ಷದಲ್ಲಿ ಅಂತಹ ವಿದ್ಯಾರ್ಥಿಗಳು ಶಾಶ್ವತವಾಗಿ ಈ

ಸೌಲಭ್ಯವನ್ನು ಪಡೆಯಲು ಅರ್ಹರಾಗಿರುವುದಿಲ್ಲ.

Preamble:

As per the modified guidelines issued by the Government of India, Minor Irrigation schemes with potential of more than 50 hectares which serve tribal areas and drought prone areas in the non-special category States are eligible for inclusion under Accelerated Irrigation Benefit Programme (AIBP) effective from December 2006. Karnataka State is classified as one of the non-special category States. 81 taluks in the State are approved under Drought Prone Area Programme (DPAP). Minor Irrigation schemes with potential more than 50 hectares in these 81 taluks are eligible for inclusion under Accelerated Irrigation Benefit Programme (AIBP), Central Assistance will be in the form of Central Grant that will be 90% of the project cost. The balance cost of the project will have to be borne by the State as State's share.

Government of Karnataka has identified new Minor Irrigation Schemes in these taluks for seeking Government of India approval under AIBP. Finance Department, Government of Karnataka has also approved the proposal of the Water Resources Department (Minor Irrigation) for according approval to such schemes. The Chief Engineer, Minor Irrigation South Zone in the letter read above has requested for according administrative approval to the estimates of the works proposed under AIBP. Accordingly the following schemes in DPAP taluks are being considered for according administrative approval.

Head of Account 4702-00-101-1-10-139 AIBP Major Works Rs. in lakhs.

Government Order No. SANEEYEE 236 MASAVI 2009 (20) Bangalore, Dated 07th January 2010

In view of the above, the Administrative approval is hereby accorded for taking up the above 12 works with an estimated cost totaling to Rs. 495.00 lakhs (Four hundred ninety five lakhs only) subject to the following conditions.

1. Implementaton of these projects should be taken up only after receipt of necessary approval from the GOI.

2. The projects are to be completed within a period of 2 years after receipt of approval of Government of India to these schemes.

3. The funding of the scheme is in the ratio of 90:10 between the Central Govt. and State Govt. 4. The Central share is in the form of grant to the State.

5. The projects will be implemented by the Water Resources Department (Minor Irrigation) as per the KTPP Act.

6. The implementation of the project shall adhere to the terms and conditions of the guidelines issued by the GOI.

Karnataka State is classified as one of the non-special category States. 81 taluks in the State are approved under Drought Prone Area Programme (DPAP). Minor Irrigation schemes with potential more than 50 hectares in these 81 taluks are eligible for inclusion under Accelerated Irrigation Benefit Programme (AIBP), Central Assistance will be in the form of Central Grant that will be 90% of the project cost. The balance cost of the project will have to be borne by the State as State's share.

Government of Karnataka has identified new Minor Irrigation Schemes in these taluks for seeking Government of India approval under AIBP. Finance Department, Government of Karnataka has also approved the proposal of the Water Resources Department (Minor Irrigation) for according approval to such schemes. The Chief Engineer, Minor Irrigation South Zone in the letter read above has requested for according administrative approval to the estimates of the works proposed under AIBP. ಪ್ರಸ್ತಾವನೆ: ಚಿಕ್ಕಮಗಳೂರು ಜಿಲ್ಲೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ಕಾಯ್ದೆ-1964 ಕಲಂ71ರನ್ವಯ ``ಮೀಸಲು ಅರಣ್ಯ''ವೆಂದು ಘೋಷಿಸಿರುವ 136619-30 ಎಕರೆ ಸರ್ಕಾರಿ ಜಮೀನುಗಳನ್ನು ಸರ್ವೆ ಮಾಡಿ ಹದ್ದುಬಸ್ತು ಗುರುತಿಸಲು ಜಂಟಿ ಮೋಜಣಿ ತಂಡವನ್ನು ರಚಿಸಿ, ದಿನಾಂಕ: 30-12-2007ರೊಳಗಾಗಿ ಮೇಲ್ಕಂಡ ಜಮೀನುಗಳ ಸರ್ವೆ ಮತ್ತು ಹದ್ದುಬಸ್ತು ಗುರುತಿಸುವ ಕೆಲಸವನ್ನು ಪೂರ್ಣಗೊಳಿಸಲು ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ: (1) ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ: 1-07-2007ರ ಆದೇಶದಲ್ಲಿ ಸೂಚಿಸಲಾಗಿತ್ತು. ಸರ್ವೆ ಮತ್ತು ಹದ್ದುಬಸ್ತು ಗುರುತಿಸಲು ವಲಯ ಅರಣ್ಯಾಧಿಕಾರಿಗಳು, ಅರಣ್ಯ ಮೋಜಣಿದಾರರು, ನಕ್ಷೆದಾರರ ಸುಮಾರು 21 ಹುದ್ದೆಗಳು ಖಾಲಿ ಇದ್ದ ಕಾರಣ ಮೋಜಣಿ ಕಾರ್ಯವನ್ನು ನಿಗಧಿತ ಕಾಲಾವಧಿಯಲ್ಲಿ ಗುರುತಿಸಿ ಪೂರ್ಣಗೊಳಿಸಲು ಸಾಧ್ಯವಾಗದ ಕಾರಣ, ಪ್ರಧಾನ ಮುಖ್ಯ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಯವರ ಕೋರಿಕೆಯಂತೆ ಜಂಟಿ ಮೋಜಣಿ ತಂಡದ ಕಾಲಾವಧಿಯನ್ನು ದಿನಾಂಕ: 31-5-2009ರವರೆಗೆ ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ: (2)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ: 14-11-2008ರ ಪತ್ರದಲ್ಲಿ ವಿಸ್ತರಿಸಲಾಗಿತ್ತು. ಮಳೆಗಾಲ ಪ್ರಾರಂಭವಾದ ಕಾರಣ ಸರ್ವೆ ಕಾರ್ಯವನ್ನು ಸ್ಥಗಿತಗೊಳಿಸಲಾಗಿದ್ದು, ನಿಗಧಿತ ಸಿಬ್ಬಂದಿ ವರ್ಗದ ಅಲಭ್ಯತೆಯಿಂದಾಗಿ ಸರ್ವೆ ಕಾಮಗಾರಿಯನ್ನು ನಿರ್ವಹಿಸಲು ಸಾಧ್ಯವಾಗದ ಕಾರಣ ಮೇಲ್ಕಂಡ ಕೆಲಸವನ್ನು ಪೂರ್ಣಗೊಳಿಸಲು ದಿನಾಂಕ: 31-5-2010ರವರೆಗೆ ಕಾಲಾವಕಾಶವನ್ನು ವಿಸ್ತರಿಸಲು ಪ್ರಧಾನ ಮುಖ್ಯ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಯವರು ಮೇಲೆ ಕ್ರಮಾಂಕ (3)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ: 14-7-2009ರ ಪತ್ರದಲ್ಲಿ ಕೋರಿರುತ್ತಾರೆ. ಮೇಲ್ಕಂಡ ಎಲ್ಲಾ ಅಂಶಗಳನ್ನು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ ಚಿಕ್ಕಮಗಳೂರು ಜಿಲ್ಲೆಯಲ್ಲಿ ಮೀಸಲು ಅರಣ್ಯದ ಜಮೀನುಗಳ ಮೋಜಣಿ ಮತ್ತು ಹದ್ದುಬಸ್ತು ಕಾರ್ಯಕ್ಕಾಗಿ ರಚಿಸಲಾಗಿರುವ ಜಂಟಿ ಮೋಜಣಿ ತಂಡದ ಅವಧಿಯನ್ನು ವಿಸ್ತರಿಸಲು ನಿರ್ಧರಿಸಿ ಈ ಮುಂದಿನಂತೆ ಆದೇಶಿಸಿದೆ.

Preamble :

In the Government Order read at (1) above, sanction has been accorded for implementation of 81.60 MW capacity wind power project at Gopalpura, Mahadevanakatte, Horakere-Devarapura villages, Jogimatti wind zone, Chitradurga District to M/s Enercon (India) Limited.

In the O.M. read at (2) above, permission was given for transfer of 4.2 MW wind power capacity to M/s Shriram Investments Limited from M/s Enercon (India) Limited. M/s Shriram Investments Limited got amalgamated with M/s Shriram Transport Finance Company Limited as per the Hon'ble High Court of Madras Order dated 25-11-2005.

The Managing Director, Karnataka Renewable Energy Development Limited, Bangalore in his letter read at (3) above has recommended for transfer of commissioned 4.2 MW wind power capacity in೫೨೭ ಭಾಗ-೧ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ ್ರ, ಗುರುವಾರ, ಫ ೆಬ್ರವರಿ ೧೧, ೨೦೧೦ favour of M/s NU Power Renewables Limited from M/s Shriram Transport Finance Company Limited at Nakkikere village, Hosadurga Taluk and Budipura village, Holalkere Taluk of Chitradurga District.

The proposal has been examined in detail and the following Orders are issued.

Government order No. EN 610 NCE 2009, Bangalore, dated 13-01-2010

Government accords approval for transfer of commissioned 4.2 MW wind power capacity in favour of M/s NU Power Renewables Limited from M/s Shriram Transport Finance Company Limited at nakkikere village, Hosadurga Taluk and Budipura village, Holalkere Taluk of Chitradurga District as detailed below and subject to the following conditions :-

1. M/s NU Power Renewables Limited shall execute an agreement with Government within 45 (Forty five) days from the date of issue of this Order.

2. PPA is assigned to BESCOM, BESCOM shall execute the PPA / Wheeling and Banking with M/s NU Power Renewables Limited within a period of one month from the date of agreement.

3. The Government has reserved the power to Cancel/modify this Order

The other terms and conditions of the Government Order No. : DE 46 NCE 2000, dated : 17-7 2000 shall IPSO FACTO applicable.

ವಿಷಯ : ಮೆ|| ಶ್ರೀ ರಾಮ ಎಂಟರ್‌ಪ್ರೈಸಸ್ ಇವರಿಗೆ 0.5 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡುವ ಬಗ್ಗೆ :-

ಓದಲಾಗಿದೆ : 1. ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರ ಪತ್ರಗಳ ಸಂಖ್ಯೆ : ಕೆಆರ್ಇಡಿ/06/ಸೂಳೆಕೆರೆ/09/1198, ದಿನಾಂಕ : 7/11-3-2009 ಮತ್ತು ಸಂಖ್ಯೆ : ಕೆಆರ್ಇಡಿ/06/ದೊಡ್ಡರಸಿನಕೆರೆ ಎಂಹೆಚ್ಎಸ್/3061, ದಿನಾಂಕ : 14/16-9-2009.

ಪ್ರಸ್ತಾವನೆ : ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (1)ರ ಪತ್ರದಲ್ಲಿ ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರು ಮೆ|| ಶ್ರೀ ರಾಮ ಎಂಟರ್‌ಪ್ರೈಸಸ್ ಇವರಿಗೆ ಮಂಡ್ಯ ಜಿಲ್ಲೆಯ ಮದ್ದೂರು ತಾಲ್ಲೂಕಿನ ದೊಡ್ಡರಸಿನಕೆರೆ ಗ್ರಾಮದ ಸೂಳೆಕೆರೆ ಕಾಲುವೆಗೆ ಅಡ್ಡಲಾಗಿ 0.5 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡುವಂತೆ ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕಳುಹಿಸಿರುತ್ತಾರೆ. ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (2)ರಲ್ಲಿ ಓದಲಾದ ನಡವಳಿಯ ಪ್ರಕಾರ ದಿನಾಂಕ : 23-10-2009 ರಂದು ಜರುಗಿದ ಹಂಚಿಕೆ ಸಮಿತಿ ಸಭೆಯ ಮುಂದೆ ಸದರಿ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಮಂಡಿಸಲಾಗಿತ್ತು. ಮೆ|| ಶ್ರೀ ರಾಮ ಎಂಟರ್‌ಪ್ರೈಸಸ್ ಇವರಿಗೆ 0.5 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡಲು ಹಂಚಿಕೆ ಸಮಿತಿಯು ಪರಿಗಣಿಸಿರುತ್ತದೆ. ಆದುದರಿಂದ ಈ ಕೆಳಗಿನಂತೆ ಆದೇಶಿಸಲಾಗಿದೆ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ : ಇಎನ್ 231 ಎನ್‌ಸಿಇ 2009, ಬೆಂಗಳೂರು, ದಿನಾಂಕ 08-01-2010

ಮೆ|| ಶ್ರೀ ರಾಮ ಎಂಟರ್‌ಪ್ರೈಸಸ್ ಇವರಿಗೆ ಮಂಡ್ಯ ಜಿಲ್ಲೆಯ ಮದ್ದೂರು ತಾಲ್ಲೂಕಿನ ದೊಡ್ಡರಸಿನಕೆರೆ ಗ್ರಾಮದ ಸೂಳೆಕೆರೆ ಕಾಲುವೆಗೆ ಅಡ್ಡಲಾಗಿ 0.5 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು (Weirಕರ್ನಾಟಕ ರಾಜ್ಯಪತ ್ರ, ಗುರುವಾರ, ಫ ೆಬ್ರವರಿ ೧೧, ೨೦೧೦ ಭಾಗ-೧ ೫೨೮ Latitude: 12o30'15'' Longitude : 77o0'30'' E Power House-Latitude : 12o30'25'' Longitude : 77o0'40'') ಈ ಕೆಳಗಿನ ನಿಬಂಧನೆಗೊಳಪಟ್ಟು ಹಂಚಿಕೆ ಮಾಡಲಾಗಿದೆ:-

1(ಅ) ಸದರಿ ಯೋಜನೆಯಿಂದ ಕೆಳತೊರೆ ಮತ್ತು ಮೇಲ್ತೊರೆ ಯೋಜನೆಗಳಿಗೆ ಯಾವುದೇ ಹಾನಿಯಾಗಬಾರದು.

(ಆ) ಹಂಚಿಕೆದಾರರು ಈ ಆದೇಶ ಹೊರಡಿಸಿದ 45 ದಿನಗಳ ಒಳಗಾಗಿ ಸರ್ಕಾರದೊಂದಿಗೆ ಒಡಂಬಡಿಕೆಯನ್ನು ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದು. ಇಲ್ಲದಿದ್ದಲ್ಲಿ, ಈ ಹಂಚಿಕೆ ತಂತಾನೇ ರದ್ದಾಗುವುದು. ನಂತರ, ಕಂಪನಿಯ ಹಂಚಿಕೆಗೋಸ್ಕರ ಪುನಃ ಹೊಸದಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು. ಯಾವ ಕಾರಣಕ್ಕೂ ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತವು ಸ್ವೀಕರಿಸಿದ ಅರ್ಜಿ ಪರಿಷ್ಕರಣಾ ಶುಲ್ಕವನ್ನು ಹಿಂದಿರುಗಿಸಲಾಗುವುದಿಲ್ಲ.

(ಇ) ಒಡಂಬಡಿಕೆಯನ್ನು ರೂ. 400-00ರ ಛಾಪಾ ಕಾಗದದ ಮೇಲೆ ಮಾಡಿಕೊಂಡು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದವರಿಗೆ ಕಳುಹಿಸಿ ಪ್ರಮಾಣೀಕರಿಸಿ ಸರ್ಕಾರಕ್ಕೆ ಕಳುಹಿಸಿಕೊಡತಕ್ಕದ್ದು.

(ಈ) ಈ ಒಡಂಬಡಿಕೆಯನ್ನು ಮಾಡಿಕೊಳ್ಳುವ ಮೊದಲು ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತಕ್ಕೆ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು (ಡಿ.ಪಿ.ಆರ್.) ಪರಿಷ್ಕರಿಸಲು ಮೆಗಾವ್ಯಾಟ್ ಒಂದಕ್ಕೆ ಸರ್ಕಾರದ ಆದೇಶಾನುಸಾರ ವಿವರವಾದ ಯೋಜನಾ ವರದಿ ಪರಿಷ್ಕರಣ ಶುಲ್ಕವನ್ನು ತುಂಬುವುದು.

2(ಅ) ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ಸಂಬಂಧಪಟ್ಟ ಎಲ್ಲಾ ಇಲಾಖೆಗಳಿಂದಲೂ ಅಂದರೆ ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆ, ಅರಣ್ಯ, ಜೀವಿಶಾಸ್ತ್ರ ಮತ್ತು ಪರಿಸರ ಇಲಾಖೆ, ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತ, ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ನಿಗಮ ನಿಯಮಿತ, ಕರ್ನಾಟಕ ಮಾಲಿನ್ಯ ನಿಯಂತ್ರಣ ಮಂಡಳಿ ಮತ್ತು ಕಂದಾಯ ಇಲಾಖೆಗಳಿಂದ ಕ್ಲಿಯರೆನ್ಸ್‌ಗಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು ಒಡಂಬಡಿಕೆ ಮಾಡಿಕೊಂಡ ಒಂದು ವರ್ಷದೊಳಗಾಗಿ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

(ಆ) ಹಂಚಿಕೆದಾರರು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತಕ್ಕೆ ಠೇವಣಿ ಇಡುವ ಹಣವನ್ನು ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು (ಡಿಪಿಆರ್) ಆವಿಷ್ಕರಿಸುವುದಕ್ಕೋಸ್ಕರ ಹೊಂದಾಣಿಕೆ ಮಾಡಿಕೊಳ್ಳಲಾಗುವುದು.

3 ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತವು ಯೋಜನಾ ವರದಿಗೆ ತಾಂತ್ರಿಕ ಅನುಮೋದನೆ ಕೊಟ್ಟ ಆರು ತಿಂಗಳ ಒಳಗಾಗಿ ಫೈನಾನ್ಸಿಯಲ್ ಕ್ಲೋಷರ್‌ನ್ನು ಸಾಧಿಸತಕ್ಕದ್ದು.

4 ಫೈನಾನ್ಸಿಯಲ್ ಕ್ಲೋಷರ್‌ನ್ನು ಸಾಧಿಸಿದ 24 ತಿಂಗಳ ಒಳಗಾಗಿ ಯೋಜನೆಯನ್ನು ಮುಗಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಹಂಚಿಕೆದಾರರು ಕಾರ್ಯಪ್ರವೃತ್ತರಾಗತಕ್ಕದ್ದು.

5 ಮೇಲೆ ತಿಳಿಸಿದ 2,3 ಮತ್ತು 4 ಅಂಶಗಳ ಯೋಜನಾ ಅನುಷ್ಠಾನ ಮಾಡಲು ಸಫಲವಾಗದಿದ್ದಲ್ಲಿ ಈ ಹಂಚಿಕೆಯು ತಂತಾನೇ ಯಾವ ಮುನ್ಸೂಚನೆಯನ್ನೂ ನೀಡದೆ ರದ್ದಾಗುವುದೆಂದು ತಿಳಿಯತಕ್ಕದ್ದು.

6 ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ವಿದ್ಯುತ್‌ನ್ನು ಮೂರನೆಯವರಿಗೆ ಮಾರಾಟ ಮಾಡುವ ಸಂದರ್ಭದಲ್ಲಿ ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತದೊಂದಿಗೆ ವೀಲಿಂಗ್ ಅಂಡ್ ಬ್ಯಾಂಕಿಂಗ್ ಒಡಂಬಡಿಕೆ ಮಾಡಿಕೊಳ್ಳಲು ಮತ್ತು ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತಕ್ಕೆ ವಿದ್ಯುತ್ತನ್ನು ಮಾರಾಟ ಮಾಡುವ ಸಂದರ್ಭದಲ್ಲಿ ವಿದ್ಯುತ್ ಖರೀದಿ ಒಡಂಬಡಿಕೆ (ಪಿಪಿಎ) ಮಾಡಿಕೊಳ್ಳಲು ಅನುಮತಿ ನೀಡಲಾಗಿದೆ.

7 ಈ ವಿಷಯದಲ್ಲಿ ಹಂಚಿಕೆದಾರರು ರಾಜ್ಯ ಮತ್ತು ಜಿಲ್ಲಾ ಮಟ್ಟಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಅಧಿಕಾರಿಗಳ ಸಹಾಯ / ಸಹಕಾರವನ್ನು ಪಡೆದು ನಿಗದಿತ ಅವಧಿಯೊಳಗೆ ಯೋಜನಾ ಅನುಷ್ಠಾನ ಪೂರ್ಣಗೊಳಿಸತಕ್ಕದ್ದು.

8 ಈ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯ ಸ್ಥಳದಲ್ಲಿ ಯಾವುದಾದರು ಸರ್ಕಾರಿ ಜಲ ವಿದ್ಯುತ್ / ನೀರಾವರಿ/ ಕುಡಿಯುವ ನೀರಿನ ಯೋಜನೆಗಳು ಬಂದಲ್ಲಿ ಸರ್ಕಾರಿ ಯೋಜನೆಗಳಿಗೆ ಮೊದಲ ಆದ್ಯತೆ೫೨೯ ಭಾಗ-೧ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ ್ರ, ಗುರುವಾರ, ಫ ೆಬ್ರವರಿ ೧೧, ೨೦೧೦ ದೊರಕುವುದು ಹಾಗೂ ಈ ಯೋಜನೆಗೆ ಯಾವುದಾದರೂ ಇತರೆ ಯೋಜನೆಗಳಿಂದ ಧಕ್ಕೆಯಾದಲ್ಲಿ ಯಾವುದೇ ಪರಿಹಾರವನ್ನು ಅಭಿವೃದ್ಧಿದಾರರು ನಿರೀಕ್ಷಿಸುವಂತಿಲ್ಲ.

9 ಸ್ಥಳೀಯವಾಗಿ ಉದ್ಭವಿಸುವ ಯಾವುದಾದರೂ ಅಕ್ಷೇಪಣೆಗಳಿಗೆ ಅಭಿವೃದ್ಧಿದಾರರೇ ಸಂಪೂರ್ಣವಾಗಿ ಹೊಣೆಗಾರರಾಗಿರುತ್ತಾರೆ.

10 ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ನಿಗಮ ನಿಯಮಿತದ ಯಾವುದೇ ಯೋಜನೆಗಳಿಂದಾಗಿ ಸದರಿ ಯೋಜನೆಯು ಮುಳುಗಡೆಯಾದಲ್ಲಿ, ಒದಗಬಹುದಾದ ಸಂಪೂರ್ಣ ತೊಂದರೆಗಳಿಗೆ ಅಭಿವೃದ್ಧಿದಾರರೇ ಪೂರ್ಣ ಜವಾಬ್ದಾರರಾಗಿರುತ್ತಾರೆ.

11 ಸದರಿ ಆದೇಶವನ್ನು ರದ್ದು ಪಡಿಸುವುದು/ಮಾರ್ಪಾಡು ಮಾಡುವ ಅಧಿಕಾರವನ್ನು ಸರ್ಕಾರವು ಹೊಂದಿರುತ್ತದೆ.

12 ಡಿ.ಪಿ.ಆರ್. ತಯಾರು ಮಾಡಿದ ಮೇಲೆ ಕ್ರೆಡಲ್ ಸಂಸ್ಥೆಯು ಪರಿಶೀಲಿಸಿದ ನಂತರ ಇತರ ಸಂಬಂಧಿಸಿದ ಇಲಾಖೆಗಳಿಗೆ ಡಿ.ಪಿ.ಆರ್. ಸಲ್ಲಿಸುವುದು ಹಾಗೂ ತದನಂತರ ತಾಂತ್ರಿಕ ಅನುಮೋದನೆಗಾಗಿ ಕ್ರೆಡಲ್‌ಗೆ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

ಪ್ರಸ್ತಾವನೆ : ಮೇಲೆ (1)ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ವಿದ್ಯುಚ್ಛಕ್ತಿ ಸುಧಾರಣಾ (ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತದ (ಕವಿಪ್ರನಿನಿ) ಉದ್ಯಮಗಳು ಮತ್ತು ಅದರ ಸಿಬ್ಬಂದಿಯು ವಿದ್ಯುಚ್ಛಕ್ತಿ ವಿತರಣಾ ಮತ್ತು ಚಿಲ್ಲರೆ ಸರಬರಾಜು ಕಂಪನಿಗಳಿಗೆ ವರ್ಗಾವಣೆ) ನಿಯಮಗಳು, 2002, ನಿಮಯ 4(13)(1) ಪ್ರಕಾರ ನಿರ್ದಿಷ್ಟಪಡಿಸಲಾದ ಸಿಬ್ಬಂದಿಯ ಸೇವೆಗಳನ್ನು ಎರಡನೇ ವರ್ಗಾವಣೆ ದಿನಾಂಕ ಜಾರಿಗೆ ಮೊದಲು ಮತ್ತು ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಮಂಡಳಿ ಮತ್ತು ಕ.ವಿ.ಪ್ರ.ನಿ.ನಿ.ಗೆ ನಿರ್ದಿಷ್ಟಪಡಿಸಲಾದ ಸಿಬ್ಬಂದಿಯು ಸಲ್ಲಿಸಿದ ಸೇವೆಗಳಿಗಾಗಿ ವಿವೃತ್ತಿ ವೇತನ ನಿಧಿಗಳು ಮತ್ತು ಶಾಸನ ಪ್ರದತ್ತ ಹಾಗೂ ಇತರೇ ಸಿಬ್ಬಂದಿ ಸಂಬಂಧಿತ ನಿಧಿಗಳ ಸಂಗ್ರಹಣೆಗೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಜವಾಬ್ದಾರಿಯಾಗಿರುವುದೇ ಹೊರತು ವಿದ್ಯುತ್ ಸರಬರಾಜು ಕಂಪನಿಯದಲ್ಲ ಮತ್ತು ನಿರ್ಧಿಷ್ಟಪಡಿಸಲಾದ ಸಿಬ್ಬಂದಿಯ ಎರಡನೇ ವರ್ಗಾವಣೆ ಜಾರಿಯಾದ ಆಯಾಯ ದಿನಾಂಕದಲ್ಲಿದ್ದಂತೆ ನಿಧಿ ಸಂಗ್ರಣೆ ಮಾಡುವ ಮಟ್ಟಿಗೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಹೊಣೆಯಾಗಿರುವುದೇ ಹೊರತು ವಿದ್ಯುತ್ ಸರಬರಾಜು ಕಂಪನಿಯದಲ್ಲವೆಂದು ತಿಳಿಸಲಾಗಿದೆ.

ಮೇಲೆ (2) ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರದ ಆದೇಶದ ಪ್ರಕಾರ, ಕ.ವಿ.ಪ್ರ.ನಿ.ನಿ. ಪಿಂಚಣಿ ಮತ್ತು ಗ್ರಾಚ್ಯುಟಿ ಟ್ರಸ್ಟ್‌ನ್ನು, "ಕ.ವಿ.ಪ್ರ.ನಿ.ನಿ. ಮತ್ತು ಎಸ್ಕಾಂಗಳ ಪಿಂಚಣಿ ಮತ್ತು ಗ್ರಾಚ್ಯುಟಿ ಟ್ರಸ್ಟ್‌ಗಳೆಂದು" ಮರುನಾಮಕರಣ ಮಾಡಿ Pay As You Go ಪದ್ಧತಿಯನ್ನು ಅನುಸರಿಸಿ ಕ.ವಿ.ಪ್ರ.ನಿ.ನಿ. ಮತ್ತು ಎಸ್ಕಾಂಗಳ ನೌಕರರ ನಿವೃತ್ತಿ ಸೌಲಭ್ಯಗಳನ್ನು (Terminal Benefits) ಪಾವತಿಸಲು ಒಪ್ಪಿಗೆ ನೀಡಿದೆ.

2009-10ನೇ ಸಾಲಿನ ಆಯವ್ಯಯದಲ್ಲಿ "2801-80-101-1-13-106 (ಯೋಜನೇತರ) ಸಹಾಯಧನ" ಲೆಕ್ಕಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿ 300 ಕೋಟಿ ರೂ. ಗಳನ್ನು ಒದಗಿಸಲಾಗಿರುತ್ತದೆ. ಕ್ರಮಾಂಕ 3 ಮತ್ತು 4 ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರಿಕರ್ನಾಟಕ ರಾಜ್ಯಪತ ್ರ, ಗುರುವಾರ, ಫ ೆಬ್ರವರಿ ೧೧, ೨೦೧೦ ಭಾಗ-೧ ೫೩೦ ಆದೇಶದಲ್ಲಿ ಕ್ರಮವಾಗಿ ಮೊದಲನೇ ಕಂತು 100 ಕೋಟಿ ರೂ. ಮತ್ತು ಎರಡನೇ ಕಂತು 100 ಕೋಟಿ ರೂ. ಒಟ್ಟು 200 ಕೋಟಿ ರೂ.ಗಳನ್ನು ಪ್ರಸ್ತುತ ಸಾಲಿನಲ್ಲಿ ಈಗಾಗಲೇ ಬಿಡುಗಡೆ ಮಾಡಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ ಕ್ರಮಾಂಕ-5 ಮತ್ತು 6ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರಗಳಲ್ಲಿ ಪಿಂಚಣಿ ಹಣ 300 ಕೋಟಿ ರೂ. ಗಳನ್ನು ಆರ್ಥಿಕ ವರ್ಷ 2009-10ಕ್ಕೆ ಪಾವತಿಸಲು ಹಾಗೂ ಹಿಂದಿನ ಬಾಕಿ 488.64 ಕೋಟಿ ರೂ.ಗಳನ್ನು ಪಾವತಿಸಲು ಕ.ವಿ.ಪ್ರ.ನಿ.ನಿ. ಮತ್ತು ಎಸ್ಕಾಂಗಳ ಪಿಂಚಣಿ ಮತ್ತು ಗ್ರಾಚ್ಯುಟಿ ಟ್ರಸ್ಟ್ ಸರ್ಕಾರವನ್ನು ಕೋರಿರುತ್ತಾರೆ.

2009-10ನೇ ಸಾಲಿನಲ್ಲಿ ಮೂರನೇ ಕಂತು 50 ಕೋಟಿ ರೂ.ಗಳ ಅನುದಾನ ಬಿಡುಗಡೆ ಮಾಡುವ ಕುರಿತು ಟ್ರಸ್ಟ್‌ಗಳ ಕೋರಿಕೆಯನ್ನು ಸರ್ಕಾರವು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಈ ಕೆಳಕಂಡ ಆದೇಶವನ್ನು ಹೊರಡಿಸಿದೆ.

ಸರ್ಕಾರಿ ಆದೇಶ ಸಂಖ್ಯೆ : ಇಎನ್ 33 ಪಿಎಸ್ಆರ್ 2009 ಬೆಂಗಳೂರು, ದಿನಾಂಕ 15-01-2010

ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತ ಮತ್ತು ಎಸ್ಕಾಂಗಳ ಪಿಂಚಣಿ ಮತ್ತು ಗ್ರಾಚ್ಯುಟಿ ಟ್ರಸ್ಟ್‌ಗಳಿಗೆ 2009-10ನೇ ಸಾಲಿನಲ್ಲಿ ಹಿಂದಿನ ವರ್ಷಗಳ ಮತ್ತು ಪ್ರಸ್ತುತ ಸಾಲಿನ ಪಿಂಚಣಿ ಪಾವತಿ ಸಲುವಾಗಿ ಮೂರನೇ ಕಂತಾಗಿ 50 ಕೋಟಿ ರೂ.ಗಳನ್ನು (ಐವತ್ತು ಕೋಟಿ ರೂ.ಗಳು ಮಾತ್ರ) ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತಕ್ಕೆ ಬಿಡುಗಡೆ ಮಾಡಿದೆ.

ಸದರಿ ವೆಚ್ಚವನ್ನು "2801-80-101-1-13-106 ಸಹಾಯಧನ (ಯೋಜನೇತರ)" ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆಯಡಿ ಭರಿಸತಕ್ಕದ್ದು.

ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತವು ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ, ಇಂಧನ ಇಲಾಖೆಯವರ ಮೇಲು ರುಜುವನ್ನು ಸ್ವೀಕೃತ ರಸೀದಿಯಲ್ಲಿ ಪಡೆದು ಹಣವನ್ನು ಪಡೆಯತಕ್ಕದ್ದು.

ಈ ಹಣವನ್ನು ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತವು "ಕವಿಪ್ರನಿನಿ ಮತ್ತು ಎಸ್ಕಾಂಗಳ ಪಿಂಚಣಿ ಮತ್ತು ಗ್ರಾಚ್ಯುಟಿ ಟ್ರಸ್ಟ್‌ಗಳಿಗೆ" ಹಣ ಪಡೆದ 2 ದಿನದೊಳಗೆ ಪೂರ್ಣವಾಗಿ ಪಾವತಿಸಿ ಸರ್ಕಾರಕ್ಕೆ ವರದಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

ಈ ಆದೇಶವನ್ನು ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಅನಧಿಕೃತ ಟಿಪ್ಪಣಿ ಸಂಖ್ಯೆ : ಎಫ್‌ಡಿ 1839 ವೆಚ್ಚಗಳು-1/2009 ದಿನಾಂಕ 31-12-2009ರ ಸಹಮತಿಯೊಂದಿಗೆ ಹೊರಡಿಸಲಾಗಿದೆ.

ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡುವ ಬಗ್ಗೆ :-

ಓದಲಾಗಿದೆ : 1. ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರ ಪತ್ರಗಳ ಸಂಖ್ಯೆ : ಕೆ.ಆರ್ಇಡಿ / 06 / ಹಿರೇಮಳಲಿ ಎಂಹೆಚ್ಎಸ್ / 2009 / 1188, ದಿನಾಂಕ: 6/9-3-2009 ಮತ್ತು ಸಂಖ್ಯೆ : ಕೆಆರ್ಇಡಿ/06/ಹಿರೇಮಳಲಿ ಎಂಹೆಚ್ಎಸ್/2009/3142, ದಿನಾಂಕ 22-9-2009.

ಪ್ರಸ್ತಾವನೆ : ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (1)ರ ಪತ್ರಗಳಲ್ಲಿ ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರು ಮೆ|| ಸುಭಾಷ್ ಕಬಿನಿ ಪವರ್ ಕಾರ್ಪೋರೇಷನ್ ಲಿಮಿಟೆಡ್ ಇವರಿಗೆ ದಾವಣಗೆರೆ ಜಿಲ್ಲೆಯ ಚೆನ್ನಗಿರಿ ತಾಲ್ಲೂಕಿನ ಹಿರೇಮಳಲಿ ಗ್ರಾಮದ ಭದ್ರಾ ಬಲ ದಂಡೆ ಕಾಲುವೆಗೆ ಅಡ್ಡಲಾಗಿ 3.00 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡುವಂತೆ ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕಳುಹಿಸಿರುತ್ತಾರೆ.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (2) ರಲ್ಲಿ ಓದಲಾದ ನಡವಳಿಯ ಪ್ರಕಾರ ದಿನಾಂಕ 23-10-2009 ರಂದು ಜರುಗಿದ ಹಂಚಿಕೆ ಸಮಿತಿ ಸಭೆಯ ಮುಂದೆ ಸದರಿ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಮಂಡಿಸಲಾಗಿತ್ತು. ಮೆ|| ಸುಭಾಷ್ ಕಬಿನಿ ಪವರ್ ಕಾರ್ಪೋರೇಷನ್ ಲಿಮಿಟೆಡ್ ಇವರಿಗೆ 3.00 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡಲು ಹಂಚಿಕೆ ಸಮಿತಿಯು ಪರಿಗಣಿಸಿರುತ್ತದೆ. ಆದುದರಿಂದ ಈ ಕೆಳಗಿನಂತೆ ಆದೇಶಿಸಲಾಗಿದೆ.

ಮೆ|| ಸುಭಾಷ್ ಕಬಿನಿ ಪವರ್ ಕಾರ್ಪೋರೇಷನ್ ಲಿಮಿಟೆಡ್ ಇವರಿಗೆ ದಾವಣಗೆರೆ ಜಿಲ್ಲೆಯ ಚೆನ್ನಗಿರಿ ತಾಲ್ಲೂಕಿನ ಹಿರೇಮಳಲಿ ಗ್ರಾಮದ ಭದ್ರಾ ಬಲ ದಂಡೆ ಕಾಲುವೆಗೆ ಅಡ್ಡಲಾಗಿ 3.00 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು (Weir Latitude: 14o03'42'' Longitude : 75o52'00'' Power House- Latitude : 14o03'40'' Longitude : 75o52'00'') ಈ ಕೆಳಗಿನ ನಿಬಂಧನೆಗೊಳಪಟ್ಟು ಹಂಚಿಕೆ ಮಾಡಲಾಗಿದೆ:- 1(ಅ) ಸದರಿ ಯೋಜನೆಯಿಂದ ಕೆಳತೊರೆ ಮತ್ತು ಮೇಲ್ತೊರೆ ಯೋಜನೆಗಳಿಗೆ ಯಾವುದೇ ಹಾನಿಯಾಗಬಾರದು.

(ಆ) ಹಂಚಿಕೆದಾರರು ಈ ಆದೇಶ ಹೊರಡಿಸಿದ 45 ದಿನಗಳ ಒಳಗಾಗಿ ಸರ್ಕಾರದೊಂದಿಗೆ ಒಡಂಬಡಿಕೆಯನ್ನು ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದು. ಇಲ್ಲದಿದ್ದಲ್ಲಿ, ಈ ಹಂಚಿಕೆ ತಂತಾನೇ ರದ್ದಾಗುವುದು. ನಂತರ, ಕಂಪನಿಯು ಹಂಚಿಕೆಗೋಸ್ಕರ ಪುನಃ ಹೊಸದಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು. ಯಾವ ಕಾರಣಕ್ಕೂ ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತವು ಸ್ವೀಕರಿಸಿದ ಅರ್ಜಿ ಪರಿಷ್ಕರಣಾ ಶುಲ್ಕವನ್ನು ಹಿಂದಿರುಗಿಸಲಾಗುವುದಿಲ್ಲ.

(ಇ) ಒಡಂಬಡಿಕೆಯನ್ನು ರೂ. 400-00ರ ಛಾಪಾ ಕಾಗದದ ಮೇಲೆ ಮಾಡಿಕೊಂಡು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದವರಿಗೆ ಕಳುಹಿಸಿ ಪ್ರಮಾಣೀಕರಿಸಿ ಸರ್ಕಾರಕ್ಕೆ ಕಳುಹಿಸಿಕೊಡತಕ್ಕದ್ದು.

(ಈ) ಈ ಒಡಂಬಡಿಕೆಯನ್ನು ಮಾಡಿಕೊಳ್ಳುವ ಮೊದಲು ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತಕ್ಕೆ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು (ಡಿ.ಪಿ.ಆರ್.) ಪರಿಷ್ಕರಿಸಲು ಮೆಗಾವ್ಯಾಟ್ ಒಂದಕ್ಕೆ ಸರ್ಕಾರದ ಆದೇಶಾನುಸಾರ ವಿವರವಾದ ಯೋಜನಾ ವರದಿ ಪರಿಷ್ಕರಣ ಶುಲ್ಕವನ್ನು ತುಂಬುವುದು.

2(ಅ) ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ಸಂಬಂಧಪಟ್ಟ ಎಲ್ಲಾ ಇಲಾಖೆಗಳಿಂದಲೂ ಅಂದರೆ ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆ, ಅರಣ್ಯ, ಜೀವಿಶಾಸ್ತ್ರ ಮತ್ತು ಪರಿಸರ ಇಲಾಖೆ, ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತ, ಕರ್ನಾಟಕ ನಿದ್ಯುತ್ ನಿಗಮ ನಿಯಮಿತ, ಕರ್ನಾಟಕ ಮಾಲಿನ್ಯ ನಿಯಂತ್ರಣ ಮಂಡಳಿ ಮತ್ತು ಕಂದಾಯ ಇಲಾಖೆಗಳಿಂದ ಕ್ಲಿಯರೆನ್ಸ್‌ಗಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು ಒಡಂಬಡಿಕೆ ಮಾಡಿಕೊಂಡ ಒಂದು ವರ್ಷದೊಳಗಾಗಿ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

(ಆ) ಹಂಚಿಕೆದಾರರು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತಕ್ಕೆ ಠೇವಣಿ ಇಡುವ ಹಣವನ್ನು ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು (ಡಿಪಿಆರ್) ಆವಿಷ್ಕರಿಸುವುದಕ್ಕೋಸ್ಕರ ಹೊಂದಾಣಿಕೆ ಮಾಡಿಕೊಳ್ಳಲಾಗುವುದು.

3 ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತವು ಯೋಜನಾ ವರದಿಗೆ ತಾಂತ್ರಿಕ ಅನುಮೋದನೆ ಕೊಟ್ಟ ಆರು ತಿಂಗಳ ಒಳಗಾಗಿ ಫೈನಾನ್ಸಿಯಲ್ ಕ್ಲೋಷರ್‌ನ್ನು ಸಾಧಿಸತಕ್ಕದ್ದು.

4 ಫೈನಾನ್ಸಿಯಲ್ ಕ್ಲೋಷರ್‌ನ್ನು ಸಾಧಿಸಿದ 24 ತಿಂಗಳ ಒಳಗಾಗಿ ಯೋಜನೆಯನ್ನು ಮುಗಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಹಂಚಿಕೆದಾರರು ಕಾರ್ಯಪ್ರವೃತ್ತರಾಗತಕ್ಕದ್ದು.

5 ಮೇಲೆ ತಿಳಿಸಿದ 2,3 ಮತ್ತು 4 ಅಂಶಗಳ ಯೋಜನಾ ಅನುಷ್ಠಾನ ಮಾಡಲು ಸಫಲವಾಗದಿದ್ದಲ್ಲಿ ಈ ಹಂಚಿಕೆಯು ತಂತಾನೇ ಯಾವ ಮುನ್ಸೂಚನೆಯನ್ನೂ ನೀಡದೆ ರದ್ದಾಗುವುದೆಂದು ತಿಳಿಯತಕ್ಕದ್ದು.

6 ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ವಿದ್ಯುತ್‌ನ್ನು ಮೂರನೆಯವರಿಗೆ ಮಾರಾಟ ಮಾಡುವ ಸಂದರ್ಭದಲ್ಲಿ ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತದೊಂದಿಗೆ ವೀಲಿಂಗ್ ಅಂಡ್ ಬ್ಯಾಂಕಿಂಗ್ ಒಡಂಬಡಿಕೆ ಮಾಡಿಕೊಳ್ಳಲು ಮತ್ತು ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತಕ್ಕೆ ವಿದ್ಯುತ್ತನ್ನು ಮಾರಾಟ ಮಾಡುವ ಸಂದರ್ಭದಲ್ಲಿ ವಿದ್ಯುತ್ ಖರೀದಿ ಒಡಂಬಡಿಕೆ (ಪಿಪಿಎ) ಮಾಡಿಕೊಳ್ಳಲು ಅನುಮತಿ ನೀಡಲಾಗಿದೆ.

7 ಈ ವಿಷಯದಲ್ಲಿ ಹಂಚಿಕೆದಾರರು ರಾಜ್ಯ ಮತ್ತು ಜಿಲ್ಲಾ ಮಟ್ಟಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಅಧಿಕಾರಿಗಳ ಸಹಾಯ / ಸಹಕಾರವನ್ನು ಪಡೆದು ನಿಗದಿತ ಅವಧಿಯೊಳಗೆ ಯೋಜನಾ ಅನುಷ್ಠಾನ ಪೂರ್ಣಗೊಳಿಸತಕ್ಕದ್ದು.

8 ಈ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯ ಸ್ಥಳದಲ್ಲಿ ಯಾವುದಾದರು ಸರ್ಕಾರಿ ಜಲ ವಿದ್ಯುತ್ / ನೀರಾವರಿ/ ಕುಡಿಯುವ ನೀರಿನ ಯೋಜನೆಗಳು ಬಂದಲ್ಲಿ ಸರ್ಕಾರಿ ಯೋಜನೆಗಳಿಗೆ ಮೊದಲ ಆದ್ಯತೆ ದೊರಕುವುದು ಹಾಗೂ ಈ ಯೋಜನೆಗೆ ಯಾವುದಾದರೂ ಇತರೆ ಯೋಜನೆಗಳಿಂದ ಧಕ್ಕೆಯಾದಲ್ಲಿ ಯಾವುದೇ ಪರಿಹಾರವನ್ನು ಅಭಿವೃದ್ಧಿದಾರರು ನಿರೀಕ್ಷಿಸುವಂತಿಲ್ಲ.

9 ಸ್ಥಳೀಯವಾಗಿ ಉದ್ಭವಿಸುವ ಯಾವುದಾದರೂ ಅಕ್ಷೇಪಣೆಗಳಿಗೆ ಅಭಿವೃದ್ಧಿದಾರರೇ ಸಂಪೂರ್ಣವಾಗಿ ಹೊಣೆಗಾರರಾಗಿರುತ್ತಾರೆ.

10 ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ನಿಗಮ ನಿಯಮಿತದ ಯಾವುದೇ ಯೋಜನೆಗಳಿಂದಾಗಿ ಸದರಿ ಯೋಜನೆಯು ಮುಳುಗಡೆಯಾದಲ್ಲಿ, ಒದಗಬಹುದಾದ ಸಂಪೂರ್ಣ ತೊಂದರೆಗಳಿಗೆ ಅಭಿವೃದ್ಧಿದಾರರೇ ಪೂರ್ಣ ಜವಾಬ್ದಾರರಾಗಿರುತ್ತಾರೆ.

11 ಸದರಿ ಆದೇಶವನ್ನು ರದ್ದು ಪಡಿಸುವುದು/ಮಾರ್ಪಾಡು ಮಾಡುವ ಅಧಿಕಾರವನ್ನು ಸರ್ಕಾರವು ಹೊಂದಿರುತ್ತದೆ.

12 ಡಿ.ಪಿ.ಆರ್. ತಯಾರು ಮಾಡಿದ ಮೇಲೆ ಕ್ರೆಡಲ್ ಸಂಸ್ಥೆಯು ಪರಿಶೀಲಿಸಿದ ನಂತರ ಇತರ ಸಂಬಂಧಿಸಿದ ಇಲಾಖೆಗಳಿಗೆ ಡಿ.ಪಿ.ಆರ್. ಸಲ್ಲಿಸುವುದು ಹಾಗೂ ತದನಂತರ ತಾಂತ್ರಿಕ ಅನುಮೋದನೆಗಾಗಿ ಕ್ರೆಡಲ್‌ಗೆ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

ಪ್ರಸ್ತಾವನೆ : ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (1)ರ ಪತ್ರಗಳಲ್ಲಿ ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರು ಮೆ|| ಸುಭಾಷ್ ಕಬಿನಿ ಪವರ್ ಕಾರ್ಪೋರೇಷನ್ ಲಿಮಿಟೆಡ್ ಇವರಿಗೆ ಮಂಡ್ಯ ಜಿಲ್ಲೆಯ ಪಾಂಡವಪುರ ತಾಲ್ಲೂಕಿನ ಹುಲಿಕೆರೆ ಕೊಪ್ಪಲು ಗ್ರಾಮದ ವಿಶ್ವೇಶ್ವರಯ್ಯ ಕೆನಾಲ್‌ಗೆ ಅಡ್ಡಲಾಗಿ 3.00 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡುವಂತೆ ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕಳುಹಿಸಿರುತ್ತಾರೆ.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (2) ರಲ್ಲಿ ಓದಲಾದ ನಡವಳಿಯ ಪ್ರಕಾರ ದಿನಾಂಕ 23-10-2009 ರಂದು ಜರುಗಿದ ಹಂಚಿಕೆ ಸಮಿತಿ ಸಭೆಯ ಮುಂದೆ ಸದರಿ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಮಂಡಿಸಲಾಗಿತ್ತು. ಮೆ|| ಸುಭಾಷ್ ಕಬಿನಿ ಪವರ್ ಕಾರ್ಪೋರೇಷನ್ ಲಿಮಿಟೆಡ್ ಇವರಿಗೆ 3.00 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು ಹಂಚಿಕೆ ಮಾಡಲು ಹಂಚಿಕೆ ಸಮಿತಿಯು ಪರಿಗಣಿಸಿರುತ್ತದೆ. ಆದುದರಿಂದ ಈ ಕೆಳಗಿನಂತೆ ಆದೇಶಿಸಲಾಗಿದೆ.

ಮೆ|| ಸುಭಾಷ್ ಕಬಿನಿ ಪವರ್ ಕಾರ್ಪೋೕರೇಷನ್ ಲಿಮಿಟೆಡ್ ಇವರಿಗೆ ಮಂಡ್ಯ ಜಿಲ್ಲೆಯ ಪಾಂಡವಪುರ ತಾಲ್ಲೂಕಿನ ಹುಲಿಕೆರೆ ಕೊಪ್ಪಲು ಗ್ರಾಮದ ವಿಶ್ವೇಶ್ವರಯ್ಯ ಕೆನಾಲ್‌ಗೆ ಅಡ್ಡಲಾಗಿ 3.00 ಮೆಗಾ ವ್ಯಾಟ್ ಸಾಮರ್ಥ್ಯದ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯನ್ನು (Weir Latitude: 12o34'00'' Longitude : 76o45'05'' Power House- Latitude : 12o34'05'' Longitude : 76o46'30'') ಈ ಕೆಳಗಿನ ನಿಬಂಧನೆಗೊಳಪಟ್ಟು ಹಂಚಿಕೆ ಮಾಡಲಾಗಿದೆ:-

1(ಅ) ಸದರಿ ಯೋಜನೆಯಿಂದ ಕೆಳತೊರೆ ಮತ್ತು ಮೇಲ್ತೊರೆ ಯೋಜನೆಗಳಿಗೆ ಯಾವುದೇ ಹಾನಿಯಾಗಬಾರದು.

(ಆ) ಹಂಚಿಕೆದಾರರು ಈ ಆದೇಶ ಹೊರಡಿಸಿದ 45 ದಿನಗಳ ಒಳಗಾಗಿ ಸರ್ಕಾರದೊಂದಿಗೆ ಒಡಂಬಡಿಕೆಯನ್ನು ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದು. ಇಲ್ಲದಿದ್ದಲ್ಲಿ, ಈ ಹಂಚಿಕೆ ತಂತಾನೇ ರದ್ದಾಗುವುದು. ನಂತರ, ಕಂಪನಿಯು೫೩೩ ಭಾಗ-೧ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ ್ರ, ಗುರುವಾರ, ಫ ೆಬ್ರವರಿ ೧೧, ೨೦೧೦ ಹಂಚಿಕೆಗೋಸ್ಕರ ಪುನಃ ಹೊಸದಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು. ಯಾವ ಕಾರಣಕ್ಕೂ ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತವು ಸ್ವೀಕರಿಸಿದ ಅರ್ಜಿ ಪರಿಷ್ಕರಣಾ ಶುಲ್ಕವನ್ನು ಹಿಂದಿರುಗಿಸಲಾಗುವುದಿಲ್ಲ.

(ಇ) ಒಡಂಬಡಿಕೆಯನ್ನು ರೂ. 400-00ರ ಛಾಪಾ ಕಾಗದದ ಮೇಲೆ ಮಾಡಿಕೊಂಡು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತದವರಿಗೆ ಕಳುಹಿಸಿ ಪ್ರಮಾಣೀಕರಿಸಿ ಸರ್ಕಾರಕ್ಕೆ ಕಳುಹಿಸಿಕೊಡತಕ್ಕದ್ದು.

(ಈ) ಈ ಒಡಂಬಡಿಕೆಯನ್ನು ಮಾಡಿಕೊಳ್ಳುವ ಮೊದಲು ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತಕ್ಕೆ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು (ಡಿ.ಪಿ.ಆರ್.) ಪರಿಷ್ಕರಿಸಲು ಮೆಗಾವ್ಯಾಟ್ ಒಂದಕ್ಕೆ ಸರ್ಕಾರದ ಆದೇಶಾನುಸಾರ ವಿವರವಾದ ಯೋಜನಾ ವರದಿ ಪರಿಷ್ಕರಣ ಶುಲ್ಕವನ್ನು ತುಂಬುವುದು.

2(ಅ) ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ಸಂಬಂಧಪಟ್ಟ ಎಲ್ಲಾ ಇಲಾಖೆಗಳಿಂದಲೂ ಅಂದರೆ ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆ, ಅರಣ್ಯ, ಜೀವಿಶಾಸ್ತ್ರ ಮತ್ತು ಪರಿಸರ ಇಲಾಖೆ, ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತ, ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ನಿಗಮ ನಿಯಮಿತ, ಕರ್ನಾಟಕ ಮಾಲಿನ್ಯ ನಿಯಂತ್ರಣ ಮಂಡಳಿ ಮತ್ತು ಕಂದಾಯ ಇಲಾಖೆಗಳಿಂದ ಕ್ಲಿಯರೆನ್ಸ್‌ಗಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು ಒಡಂಬಡಿಕೆ ಮಾಡಿಕೊಂಡ ಒಂದು ವರ್ಷದೊಳಗಾಗಿ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

(ಆ) ಹಂಚಿಕೆದಾರರು ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತಕ್ಕೆ ಠೇವಣಿ ಇಡುವ ಹಣವನ್ನು ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು (ಡಿಪಿಆರ್) ಆವಿಷ್ಕರಿಸುವುದಕ್ಕೋಸ್ಕರ ಹೊಂದಾಣಿಕೆ ಮಾಡಿಕೊಳ್ಳಲಾಗುವುದು.

3 ಕರ್ನಾಟಕ ನವೀಕರಿಸಬಹುದಾದ ಇಂಧನ ಅಭಿವೃದ್ಧಿ ನಿಯಮಿತವು ಯೋಜನಾ ವರದಿಗೆ ತಾಂತ್ರಿಕ ಅನುಮೋದನೆ ಕೊಟ್ಟ ಆರು ತಿಂಗಳ ಒಳಗಾಗಿ ಫೈನಾನ್ಸಿಯಲ್ ಕ್ಲೋಷರ್‌ನ್ನು ಸಾಧಿಸತಕ್ಕದ್ದು.

4 ಫೈನಾನ್ಸಿಯಲ್ ಕ್ಲೋಷರ್‌ನ್ನು ಸಾಧಿಸಿದ 24 ತಿಂಗಳ ಒಳಗಾಗಿ ಯೋಜನೆಯನ್ನು ಮುಗಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಹಂಚಿಕೆದಾರರು ಕಾರ್ಯಪ್ರವೃತ್ತರಾಗತಕ್ಕದ್ದು.

5 ಮೇಲೆ ತಿಳಿಸಿದ 2,3 ಮತ್ತು 4 ಅಂಶಗಳ ಯೋಜನಾ ಅನುಷ್ಠಾನ ಮಾಡಲು ಸಫಲವಾಗದಿದ್ದಲ್ಲಿ ಈ ಹಂಚಿಕೆಯು ತಂತಾನೇ ಯಾವ ಮುನ್ಸೂಚನೆಯನ್ನೂ ನೀಡದೆ ರದ್ದಾಗುವುದೆಂದು ತಿಳಿಯತಕ್ಕದ್ದು.

6 ಯೋಜನಾ ಅಭಿವೃದ್ಧಿದಾರರು ವಿದ್ಯುತ್‌ನ್ನು ಮೂರನೆಯವರಿಗೆ ಮಾರಾಟ ಮಾಡುವ ಸಂದರ್ಭದಲ್ಲಿ ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತದೊಂದಿಗೆ ವೀಲಿಂಗ್ ಅಂಡ್ ಬ್ಯಾಂಕಿಂಗ್ ಒಡಂಬಡಿಕೆ ಮಾಡಿಕೊಳ್ಳಲು ಮತ್ತು ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತಕ್ಕೆ ವಿದ್ಯುತ್ತನ್ನು ಮಾರಾಟ ಮಾಡುವ ಸಂದರ್ಭದಲ್ಲಿ ವಿದ್ಯುತ್ ಖರೀದಿ ಒಡಂಬಡಿಕೆ (ಪಿಪಿಎ) ಮಾಡಿಕೊಳ್ಳಲು ಅನುಮತಿ ನೀಡಲಾಗಿದೆ.

7 ಈ ವಿಷಯದಲ್ಲಿ ಹಂಚಿಕೆದಾರರು ರಾಜ್ಯ ಮತ್ತು ಜಿಲ್ಲಾ ಮಟ್ಟಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಅಧಿಕಾರಿಗಳ ಸಹಾಯ / ಸಹಕಾರವನ್ನು ಪಡೆದು ನಿಗದಿತ ಅವಧಿಯೊಳಗೆ ಯೋಜನಾ ಅನುಷ್ಠಾನ ಪೂರ್ಣಗೊಳಿಸತಕ್ಕದ್ದು.

8 ಈ ಕಿರು ಜಲ ವಿದ್ಯುತ್ ಯೋಜನೆಯ ಸ್ಥಳದಲ್ಲಿ ಯಾವುದಾದರು ಸರ್ಕಾರಿ ಜಲ ವಿದ್ಯುತ್ / ನೀರಾವರಿ/ ಕುಡಿಯುವ ನೀರಿನ ಯೋಜನೆಗಳು ಬಂದಲ್ಲಿ ಸರ್ಕಾರಿ ಯೋಜನೆಗಳಿಗೆ ಮೊದಲ ಆದ್ಯತೆ ದೊರಕುವುದು ಹಾಗೂ ಈ ಯೋಜನೆಗೆ ಯಾವುದಾದರೂ ಇತರೆ ಯೋಜನೆಗಳಿಂದ ಧಕ್ಕೆಯಾದಲ್ಲಿ ಯಾವುದೇ ಪರಿಹಾರವನ್ನು ಅಭಿವೃದ್ಧಿದಾರರು ನಿರೀಕ್ಷಿಸುವಂತಿಲ್ಲ.

9 ಸ್ಥಳೀಯವಾಗಿ ಉದ್ಭವಿಸುವ ಯಾವುದಾದರೂ ಅಕ್ಷೇಪಣೆಗಳಿಗೆ ಅಭಿವೃದ್ಧಿದಾರರೇ ಸಂಪೂರ್ಣವಾಗಿ ಹೊಣೆಗಾರರಾಗಿರುತ್ತಾರೆ.

10 ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ನಿಗಮ ನಿಯಮಿತದ ಯಾವುದೇ ಯೋಜನೆಗಳಿಂದಾಗಿ ಸದರಿ ಯೋಜನೆಯು ಮುಳುಗಡೆಯಾದಲ್ಲಿ, ಒದಗಬಹುದಾದ ಸಂಪೂರ್ಣ ತೊಂದರೆಗಳಿಗೆ ಅಭಿವೃದ್ಧಿದಾರರೇ ಪೂರ್ಣ ಜವಾಬ್ದಾರರಾಗಿರುತ್ತಾರೆ.

11 ಸದರಿ ಆದೇಶವನ್ನು ರದ್ದು ಪಡಿಸುವುದು/ಮಾರ್ಪಾಡು ಮಾಡುವ ಅಧಿಕಾರವನ್ನು ಸರ್ಕಾರವು ಹೊಂದಿರುತ್ತದೆ.

12 ಡಿ.ಪಿ.ಆರ್. ತಯಾರು ಮಾಡಿದ ಮೇಲೆ ಕ್ರೆಡಲ್ ಸಂಸ್ಥೆಯು ಪರಿಶೀಲಿಸಿದ ನಂತರ ಇತರ ಸಂಬಂಧಿಸಿದ ಇಲಾಖೆಗಳಿಗೆ ಡಿ.ಪಿ.ಆರ್. ಸಲ್ಲಿಸುವುದು ಹಾಗೂ ತದನಂತರ ತಾಂತ್ರಿಕ ಅನುಮೋದನೆಗಾಗಿ ಕ್ರೆಡಲ್‌ಗೆ ಅರ್ಜಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

Preamble:

The Director of Mines and Geology, Bangalore in his letter read above has stated that Shri M. Srinivasulu is holding Mining Lease No. 2552 for Iron ore, over an area of 134.00 hectares in Donimalai Range, Sandur Taluk, Bellary District, for a period of 20 years w.e.f. 03.07.2007. The lessee has requested to transfer of Mining Lease No. 2552 in favour of M/s. Gavi Siddeshwara Minerals, to develop the mine on a large scale to have optimum utilization and production of the mine in a most scientific manner. M./s. Gavi Siddeshwara Minerals., have also agreed to take over the Mining lease on transfer as per Rule 37 of MC Rules, 1960 subject to terms and conditions of mining lease. Since both the applicants have fulfilled all the requirements as per MC Rules, 1960, the Director of Mines and Geology has recommended to the Government for transfer of Mining Lease No. 2552 held by Shri M. Srinivasulu in favour of M/s. Gavi Siddeshwara Minerals, as per rule 37 of M.C. Rules, 1960.

The proposal has been examined.

In the circumstances explained in the preamble, the Government are pleased to accord sanction for transfer of Mining Lease No. 2552 held by Shri M. Srinivasulu in Donimalai range, Sandur taluk, Bellary District, over an area of 134.00 hectares in favour of M/s. Gavi Siddeshwara Minerals, under Rule 37 (1)(a) of MCR, 1960, subject to the conditions that the Transferee shall accept all the conditions and liabilities, which the Transferor was having in respect of the said mining lease. The Transferee shall comply with the provisions of the Mines and Minerals (Development and Regulation) Act, 1957 and Mineral Concession Rules, 1960 and other applicable Acts and Rules including Forest (Conservation) Act, 1980, Environmental Protection Act, 1986, EIA Notification 2006 etc., as amended from time to time and Rules made thereunder.

ಪ್ರಸ್ತಾವನೆ :

ಬಾಗಲಕೋಟೆ ಜಿಲ್ಲೆ, ಬನಹಟ್ಟಿಯ ದಿ ಬನಹಟ್ಟಿ ಸಹಕಾರಿ ನೂಲಿನ ಗಿರಣಿ ನಿಯಮಿತದ ಆಧುನೀಕರಣ ಯೋಜನೆಗೆ ರೂ. 13.05 ಕೋಟಿಗಳ ಆರ್ಥಿಕ ಸಹಾಯವನ್ನು ಸರ್ಕಾರವು ಮಂಜೂರು ಮಾಡಿ, ದಿನಾಂಕ 5.11.2007ರಂದು ಸರ್ಕಾರದ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿತ್ತು (ಉಲ್ಲೇಖ-2). ರೂ. 13.05 ಕೋಟಿಗಳ ಪೈಕಿ, ರೂ. 11.70 ಕೋಟಿಗಳನ್ನು ಅವಧಿ ಸಾಲವನ್ನಾಗಿ ಮತ್ತು ರೂ. 1.35 ಕೋಟಿಗಳನ್ನು ಷೇರು ಬಂಡವಾಳವಾಗಿ ಬಿಡುಗಡೆ ಮಾಡಲು ಹಾಗೂ ಸದರಿ ಮೊತ್ತಗಳನ್ನು ಶೇಕಡ 25, 50 ಮತ್ತು 25ರ ಕಂತುಗಳ ಪ್ರಕಾರ ಬಿಡುಗಡೆ ಮಾಡಲು ಈ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಆದೇಶಿಸಿ ಕೆಲವು ಷರತ್ತುಗಳನ್ನು ವಿಧಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲ್ಕಂಡ ಆದೇಶದಂತೆ, ಅವಧಿ ಸಾಲ ಮತ್ತು ಷೇರು ಬಂಡವಾಳದ ಶೇ. 25ರ ಮೊದಲ ಕಂತಾಗಿ ಕ್ರಮವಾಗಿ ರೂ. 2.925 ಕೋಟಿ ಮತ್ತು ರೂ. 0.3375 ಕೋಟಿಗಳನ್ನು ದಿನಾಂಕ 29.3.2008ರ (ಉಲ್ಲೇಖ 3) ಮತ್ತು ದಿನಾಂಕ 31.3.2008ರ (ಉಲ್ಲೇಖ-4) ಆದೇಶಗಳ ಮೂಲಕ ಬಿಡುಗಡೆ ಮಾಡಲಾಗಿರುತ್ತದೆ.

ಮೇಲ್ಕಂಡಂತೆ ಬಿಡುಗಡೆ ಮಾಡಿರುವ ಮೊದಲ ಕಂತನ್ನು ಗಿರಣಿಯ ಆಧುನೀಕರಣಕ್ಕಾಗಿ ವಿನಿಯೋಗಿಸಿರುವುದರಿಂದ, ದಿನಾಂಕ 5.11.2007ರ ಆದೇಶದ ಪ್ರಕಾರ ಆರ್ಥಿಕ ನೆರವಿನ ಎರಡನೇ ಕಂತು ಶೇಕಡ 50ರಷ್ಟನ್ನು ಬಿಡುಗಡೆ ಮಾಡುವಂತೆ ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ಹಾಗೂ ನಿರ್ದೇಶಕರು ತಮ್ಮ ದಿನಾಂಕ 8.7.2008ರ ಪತ್ರದಲ್ಲಿ ಕೋರಿರುತ್ತಾರೆ (ಉಲ್ಲೇಖ-5). ನಂತರ, ತಮ್ಮ ದಿನಾಂಕ 26/27.11.2009ರ ಪತ್ರದ ಮೂಲಕ, ಈಗಾಗಲೇ ಬಿಡುಗಡೆಯಾಗಿರುವ ಮೊತ್ತವನ್ನು ಗಿರಣಿಯು ವಿನಿಯೋಗಿಸಿರುವ ಬಗ್ಗೆ ವಿವರವಾದ ವರದಿಯನ್ನು ಸಲ್ಲಿಸುತ್ತಾ, ಎರಡನೇ ಕಂತಿನ ಆರ್ಥಿಕ ಸಹಾಯವನ್ನು ಬಿಡುಗಡೆ ಮಾಡುವಂತೆ ಕೋರಿರುತ್ತಾರೆ (ಉಲ್ಲೇಖ-6). ಈ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವಂತೆ ಬಾಗಲಕೋಟೆ ಜಿಲ್ಲೆ, ಬನಹಟ್ಟಿಯ ದಿ ಬನಹಟ್ಟಿ ಸಹಕಾರಿ ನೂಲಿನ ಗಿರಣಿ ನಿಯಮಿತದ ಆಧುನೀಕರಣ ಯೋಜನೆಗೆ ಮಂಜೂರು ಮಾಡಿರುವ ರೂ. 11.70 ಕೋಟಿ ಅವಧಿ ಸಾಲದ ಪೈಕಿ ಶೇ. 50ರ ಎರಡನೇ ಕಂತಾಗಿ ರೂ. 585 ಲಕ್ಷ ಹಾಗೂ ಮೊತ್ತದ ರೂ. 1.35 ಕೋಟಿ ಷೇರು ಬಂಡವಾಳದ ಪೈಕಿ ಶೇ. 50ರ ಎರಡನೇ ಕಂತಾಗಿ ರೂ. 67.50 ಲಕ್ಷಗಳನ್ನು ಬಿಡುಗಡೆ ಮಾಡಲು ಈ ಮೂಲಕ ಸರ್ಕಾರದ ಮಂಜೂರಾತಿಯನ್ನು ನೀಡಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡಂತೆ ಬಿಡುಗಡೆ ಮಾಡಲಾಗುತ್ತಿರುವ ಮೊತ್ತಗಳ ಪೈಕಿ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆ 6860-01-101-0-07-394- (ಸಾಲಗಳು)ರಡಿಯಲ್ಲಿ ರೂ.585.00 ಲಕ್ಷಗಳನ್ನು ಹಾಗೂ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆ 4860-01-190-5-01-211-(ಬಂಡವಾಳ ಹೂಡಿಕೆ)ರಡಿಯಲ್ಲಿ ರೂ. 67.50 ಲಕ್ಷಗಳನ್ನು (ಪೂರಕ ಅಂದಾಜು SE-I 09-10ರಲ್ಲಿ ಒದಗಿಸಿರುವಂತೆ) ಭರಿಸತಕ್ಕದ್ದು.

ಈ ಮೊತ್ತವನ್ನು ಗಿರಣಿಯು ಯಂತ್ರೋಪಕರಣಗಳ ಖರೀದಿಗೆ ಮಾತ್ರ ಉಪಯೋಗಿಸಿಕೊಳ್ಳತಕ್ಕದ್ದು. ದಿನಾಂಕ 5.11.2007ರ ಆದೇಶದಲ್ಲಿ ವಿಧಿಸಿರುವ ಷರತ್ತಗಳು ಮತ್ತು ದಿನಾಂಕ 15.2.2008ರಂದು ಸಹಿ ಮಾಡಿರುವ ಸಾಲದ ಒಡಂಬಡಿಕೆಯಲ್ಲಿ ವಿಧಿಸಿರುವ ಷರತ್ತುಗಳು ಮತ್ತು ನಿಬಂಧನೆಗಳನ್ನು ಪಾಲಿಸತಕ್ಕದ್ದು.

ಹಣ ಸಂದಾಯ ಸ್ವೀಕೃತಿಯ ಮೇಲೆ ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ಹಾಗೂ ನಿರ್ದೇಶಕರು, ಕೈಮಗ್ಗ ಮತ್ತು ಜವಳಿ ಇಲಾಖೆ, ಬೆಂಗಳೂರು, ಇವರ ಮೇಲು ರುಜುವಿನೊಂದಿಗೆ ಹಣವನ್ನು ಖಜಾನೆಯಿಂದ ಪಡೆದು ಸದರಿ ಗಿರಣಿಗೆ ಬಿಡುಗಡೆ ಮಾಡತಕ್ಕದ್ದು.

ಈ ಆದೇಶವನ್ನು ದಿನಾಂಕ 4.1.2010 ಸಂಖ್ಯೆ: ಆಇ 382 ವೆಚ್ಚ-2/09ರ ಅನಧಿಕೃತ ಟಿಪ್ಪಣಿಯ ಮೂಲಕ ಆರ್ಥಿಕ ಇಲಾಖೆಯು ನೀಡಿರುವ ಸಹಮತಿಯನ್ವಯ ಹೊರಡಿಸಲಾಗಿದೆ.
