ವಿಷಯ ಃ-

ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಸರ್ಕಾರದ ಪದನಿಮಿತ್ತ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿಗಳು ಹುದ್ದೆಯನ್ನು ಹಿರಿಯ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಪದನಿಮಿತ್ತ ಸರ್ಕಾರದ ವಿಶೇಷ ಕಾರ್ಯದರ್ಶಿಗಳು ಎಂದು

ಪುನರ್ ಪದನಾಮೀಕರಿಸುವ ಬಗ್ಗೆ.

ಪ ್ರಸ್ತಾವನೆ:-

ಲೋಕೋಪಯೋಗಿ ಸಚಿವಾಲಯದ ಆಯವ್ಯಯ ಮತ್ತು ವಿತ್ತೀಯ ಉಸ್ತುವಾರಿ ಕೋಶವು ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಸರ್ಕಾರದ ಪದನಿಮಿತ್ತ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿಗಳ ನೇತೖತ್ವದಲ್ಲಿ ಪೂರಕ ಸಿಬ್ಬಂದಿಗಳೊಂದಿಗೆ ಕಾರ್ಯ ನಿರ್ವಹಿಸುತ್ತಿರುತ್ತದೆ. ಸದರಿ ಶಾಖೆಯಲ್ಲಿ ಲೋಕೋಪಯೋಗಿ ಇಲಾಖೆಯ ವಿತ್ತೀಯ ನಿರ್ವಹಣೆ, ಉಸ್ತುವಾರಿ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ವಿಚಾರಣೆ, ಪ್ರತಿ ವರ್ಷ ಆಯವ್ಯಯ ಹಾಗೂ ವಿವಿಧ ಯೋಜನೆಗಳ ಕ್ರಿಯಾಯೋಜನೆಗಳ ತಯಾರಿಕೆ, ವಿವಿಧ ಯೋಜನೆಗಳಡಿ ಅನುದಾನ : ಹಣ ಹಂಚಿಕೆ ಹಾಗೂ ವಿತರಣೆ, ಕೋಶದ ಆಡಳಿತ ಮತ್ತು ಇನ್ನಿತರೆ ಕರ್ತವ್ಯಗಳ ನಿರ್ವಹಣೆ, ಇಂತಹ ಲೋಕೋಪಯೋಗಿ ಇಲಾಖೆಯ ಪ್ರಸ್ತುತ ಕೆಲಸ ಕಾರ್ಯಗಳ ಜೊತೆಗೆ, ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆಯ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಎಲ್ಲಾ ಕಚೇರಿ : ವಲಯಗಳು, ನಿಗಮಗಳು ಮತ್ತು ಘಟಕಗಳ ಆರ್ಥಿಕ ವ್ಯವಹಾರಗಳ ನಿರ್ವಹಣೆ, ವಾರ್ಷಿಕ ಆಯವ್ಯಯ ತಯಾರಿಕೆ, ಬಾಕಿಬಿಲ್ಲು ಹಾಗೂ ಹಣ ಬಿಡುಗಡೆ, ಅನುದಾನದ ನಿರ್ವಹಣೆ, ಅಪೆಂಡಿಕ್ಸ್-ಇ ತಯಾರಿಕೆ, ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಯ ವಿಷಯ ನಿರ್ವಹಣೆ, ಆಡಿಟ್ ಪತ್ರಗಳ ನಿರ್ವಹಣೆ, ಲೆಕ್ಕ ಮರುಹೊಂದಾಣಿಕೆ, ಹಣಕಾಸು ಆಯೋಗಗಳೊಂದಿಗೆ ಪತ್ರ ವ್ಯವಹಾರ, ಅಂದಾಜು ಸಮಿತಿ, ವಿಷಯ ಸಮಿತಿ, ಅನುಸೂಚಿತಜಾತಿ ಮತ್ತು ಅನುಸೂಚಿತ ಪಂಗಡಗಳ ಕಲ್ಯಾಣ ಸಮಿತಿ ಹಾಗೂ ಸಂಬಂಧಿತ ಸಮಿತಿಗಳೊಂದಿಗೆ ಸಮನ್ವಯ, ಇಲಾಖೆಯ ಪ್ರಗತಿಯಲ್ಲಿರುವ ಯೋಜನೆಗಳು ಹಾಗೂ ಉದ್ದೇಶಿತ ಹೊಸ ಯೋಜನೆಗಳ ಆರ್ಥಿಕ ಹಾಗೂ ವಿತ್ತೀಯ ವ್ಯವಹಾರಗಳ ಮೇಲ್ವಿಚಾರಣೆ ಹಾಗೂ ಸಮರ್ಪಕ ನಿರ್ವಹಣೆಯ ಜವಾಬ್ದಾರಿಗಳೊಂದಿಗೆ ಸಚಿವಾಲಯದ ಇತರ ಶಾಖೆಗಳಿಗೆ ಆರ್ಥಿಕ ವಿಷಯದಲ್ಲಿ ಸಲಹೆ, ಅಭಿಪ್ರಾಯ ನೀಡುವುದು ಈ ಎಲ್ಲಾ ಪ್ರಮುಖ ಕರ್ತವ್ಯಗಳನ್ನು ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಈ ಶಾಖೆಗೆ ವಹಿಸಲಾಗಿದೆ.

ಇಷ್ಟೇ ಅಲ್ಲದೇ, ಕರ್ನಾಟಕ ರಸ್ತೆ ಅಭಿವೃದ್ಧಿ ನಿಗಮ ನಿಯಮಿತ ಹಾಗೂ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಭಿವೃದ್ಧಿ ಯೋಜನೆ ವತಿಯಿಂದ ರಾಜ್ಯದಲ್ಲಿ ಸವಿಸ್ತಾರವಾದ ಹಾಗೂ ಸುವ್ಯವಸ್ಥಿತವಾದ ರಸ್ತೆ ಸಂಪರ್ಕ ಜಾಲ ಕಲ್ಪಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಕರ್ನಾಟಕ ರಸ್ತೆ ಅಭಿವೃದ್ಧಿ ಬೃಹತ್ ಯೋಜನೆಯಲ್ಲಿ ಪಿಪಿಪಿ ಪ್ರಾಜೆಕ್ಟ್‌ಗಳನ್ನು ಕೈಗೆತ್ತಿಕೊಂಡು ಪ್ರಾರಂಭಿಸಲಾಗಿರುತ್ತದೆ. ಅಗಾಧವಾಗಿ ಬೆಳೆದಿರುವ ಇಲಾಖೆಯ ಕಾರ್ಯಚಟುವಟಿಕೆಗಳನ್ನು ಸಕಾಲದಲ್ಲಿ ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಅನುಷ್ಠಾನಗೊಳಿಸಲು, ಅಷ್ಟೇ ಸಮರ್ಪಕವಾಗಿ ಇಲಾಖೆಯ ಆರ್ಥಿಕ ಹಾಗೂ ಹಣಕಾಸಿಗೆ ಸಂಬಂಧಪಟ್ಟ ಎಲ್ಲಾ ವಿಷಯಗಳ ಜವಾಬ್ದಾರಿಯನ್ನು ಹಾಲಿ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಸರ್ಕಾರದ ಪದನಿಮಿತ್ತ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿಗಳು ನಿರ್ವಹಿಸುತ್ತಿದ್ದಾರೆ. ಆದ್ದರಿಂದ ಹುದ್ದೆಯ ಕಾರ್ಯಭಾರ ಹಾಗೂ ಕಾರ್ಯದ ಒತ್ತಡ ಮತ್ತು ಜವಾಬ್ದಾರಿಯನ್ನು ಪರಿಗಣಿಸಿ ಈ ಹುದ್ದೆಯನ್ನು ಮೇಲ್ದರ್ಜೆಗೇರಿಸಿ4890 ವೇತನಶ್ರೇಣಿ ರೂ.28275-675-30300-750-34800-850-39900ರಲ್ಲಿ ನಿಗದಿಪಡಿಸಿ ಈ ಹುದ್ದೆಯ ಪದನಾಮವನ್ನು ಹಿರಿಯ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಪದನಿಮಿತ್ತ ವಿಶೇಷ ಕಾರ್ಯದರ್ಶಿಗಳು ಎಂದು ಮರು ಪದನಾಮೀಕರಿಸಿ, ಪ್ರಸ್ತುತ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸುತ್ತಿರುವ ಶ್ರೀ ಆರ್.ಗೋವಿಂದರಾಜು, ಇವರನ್ನು ಪುನರ್ ಪದನಾಮೀಕರಿಸಿದ ಹಿರಿಯ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಪದನಿಮಿತ್ತ ಸರ್ಕಾರದ ವಿಶೇಷ ಕಾರ್ಯದರ್ಶಿಗಳು ಹುದ್ದೆಯಲ್ಲಿ ಬಡ್ತಿಯನ್ನು ನೀಡಿ, ಶಾಶ್ವತವಾಗಿ ಜಾರಿಯಲ್ಲಿರುವಂತೆ ಇಲಾಖೆಯಲ್ಲಿಯೇ ಮುಂದುವರಿಸಬೇಕಾಗಿರುತ್ತದೆ.

ಆದ್ದರಿಂದ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂ.: ಲೋಇ:100:ಐಎಫ್ಎ:2010, ಬೆಂಗಳೂರು ದಿನಾಂಕ: 24ನೇ ಏಪ್ರಿಲ್ 2010 ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಸಚಿವಾಲಯದಲ್ಲಿರುವ ಆಯವ್ಯಯ ಮತ್ತು ವಿತ್ತೀಯ ಉಸ್ತುವಾರಿ ಶಾಖೆಯಲ್ಲಿ ಇಲಾಖೆಯ ವಿತ್ತೀಯ ನಿರ್ವಹಣೆ, ಉಸ್ತುವಾರಿ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ವಿಚಾರಣೆ, ಪ್ರತಿ ವರ್ಷ ಆಯವ್ಯಯ ಹಾಗೂ ವಿವಿಧ ಯೋಜನೆಗಳ ಕ್ರಿಯಾಯೋಜನೆಗಳ ತಯಾರಿಕೆ, ವಿವಿಧ ಯೋಜನೆಗಳಡಿ ಅನುದಾನ : ಹಣ ಹಂಚಿಕೆ ಹಾಗೂ ವಿತರಣೆ, ಕೋಶದ ಆಡಳಿತ ಮತ್ತು ಇನ್ನಿತರೆ ಕರ್ತವ್ಯಗಳ ನಿರ್ವಹಣೆ, ಇಂತಹ ಲೋಕೋಪಯೋಗಿ ಇಲಾಖೆಯ ಪ್ರಸ್ತುತ ಕೆಲಸ ಕಾರ್ಯಗಳ ಜೊತೆಗೆ, ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆಯ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಎಲ್ಲಾ ಕಚೇರಿ : ವಲಯಗಳು, ನಿಗಮಗಳು ಮತ್ತು ಘಟಕಗಳ ಆರ್ಥಿಕ ವ್ಯವಹಾರಗಳ ನಿರ್ವಹಣೆ, ವಾರ್ಷಿಕ ಆಯವ್ಯಯ ತಯಾರಿಕೆ, ಬಾಕಿಬಿಲ್ಲು ಹಾಗೂ ಹಣ ಬಿಡುಗಡೆ, ಅನುದಾನದ ನಿರ್ವಹಣೆ, ಅಪೆಂಡಿಕ್ಸ್-ಇ ತಯಾರಿಕೆ, ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಯ ವಿಷಯ ನಿರ್ವಹಣೆ, ಆಡಿಟ್ ಪತ್ರಗಳ ನಿರ್ವಹಣೆ, ಲೆಕ್ಕ ಮರುಹೊಂದಾಣಿಕೆ, ಹಣಕಾಸು ಆಯೋಗಗಳೊಂದಿಗೆ ಪತ್ರ ವ್ಯವಹಾರ, ಅಂದಾಜು ಸಮಿತಿ, ವಿಷಯ ಸಮಿತಿ, ಅನುಸೂಚಿತ ಜಾತಿ ಮತ್ತು ಅನುಸೂಚಿತ ಪಂಗಡಗಳ ಕಲ್ಯಾಣ ಸಮಿತಿ ಹಾಗೂ ಸಂಬಂಧಿತ ಸಮಿತಿಗಳೊಂದಿಗೆ ಸಮನ್ವಯ, ಇಲಾಖೆಯ ಪ್ರಗತಿಯಲ್ಲಿರುವ ಯೋಜನೆಗಳು ಹಾಗೂ ಉದ್ದೇಶಿತ ಹೊಸ ಯೋಜನೆಗಳ ಆರ್ಥಿಕ ಹಾಗೂ ವಿತ್ತೀಯ ವ್ಯವಹಾರಗಳ ಮೇಲ್ವಿಚಾರಣೆ ಹಾಗೂ ಸಮರ್ಪಕ ನಿರ್ವಹಣೆಯ ಜವಾಬ್ದಾರಿಗಳೊಂದಿಗೆ ಸಚಿವಾಲಯದ ಇತರ ಶಾಖೆಗಳಿಗೆ ಆರ್ಥಿಕ ವಿಷಯದಲ್ಲಿ ಸಲಹೆ, ಅಭಿಪ್ರಾಯ ನೀಡುವುದು ಇಷ್ಟೇ ಅಲ್ಲದೇ, ಕರ್ನಾಟಕ ರಸ್ತೆ ಅಭಿವೃದ್ಧಿ ನಿಗಮ ನಿಯಮಿತ ಹಾಗೂ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಭಿವೃದ್ಧಿ ಯೋಜನೆ, ವತಿಯಿಂದ ರಾಜ್ಯದಲ್ಲಿ ಸವಿಸ್ತಾರವಾದ ಹಾಗೂ ಸುವ್ಯವಸ್ಥಿತವಾದ ರಸ್ತೆ ಸಂಪರ್ಕ ಜಾಲ ಕಲ್ಪಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಕರ್ನಾಟಕ ರಸ್ತೆ ಅಭಿವೃದ್ಧಿ ಬೃಹತ್ ಯೋಜನೆಯಲ್ಲಿ ಪಿಪಿಪಿ ಪ್ರಾಜೆಕ್ಟ್‌ಗಳನ್ನು ಕೈಗೆತ್ತಿಕೊಳ್ಳಲಾಗಿರುತ್ತದೆ. ಅಗಾಧವಾಗಿ ಬೆಳೆದಿರುವ ಇಲಾಖೆಯ ಕಾರ್ಯಚಟುವಟಿಕೆಗಳನ್ನು ಸಕಾಲದಲ್ಲಿ ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಅನುಷ್ಠಾನಗೊಳಿಸಲು, ಅಷ್ಟೇ ಸಮರ್ಪಕವಾಗಿ ಇಲಾಖೆಯ ಆರ್ಥಿಕ ಹಾಗೂ ಹಣಕಾಸಿಗೆ ಸಂಬಂಧಪಟ್ಟ ವಿಷಯಗಳ ಜವಾಬ್ದಾರಿಯನ್ನು ಆಯವ್ಯಯ ಮತ್ತು ವಿತ್ತೀಯ ಉಸ್ತುವಾರಿ ಕೋಶದ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಸರ್ಕಾರದ ಪದನಿಮಿತ್ತ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿಗಳು ನಿರ್ವಹಿಸುತ್ತಿದ್ದಾರೆ. ಆದ್ದರಿಂದ ಹುದ್ದೆಯ ಕಾರ್ಯಭಾರ ಹಾಗೂ ಕಾರ್ಯದ ಒತ್ತಡ ಮತ್ತು ಜವಾಬ್ದಾರಿಯನ್ನು ಪರಿಗಣಿಸಿ ಈ ಹುದ್ದೆಯನ್ನು ಮೇಲ್ದರ್ಜೆಗೇರಿಸಿ ಹುದ್ದೆಯ ಪದನಾಮವನ್ನು ಹಿರಿಯ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಪದನಿಮಿತ್ತ ವಿಶೇಷ ಕಾರ್ಯದರ್ಶಿಗಳು ಎಂದು ಮರುಪದನಾಮೀಕರಿಸಿ, ವೇತನಶ್ರೇಣಿ ರೂ.28275-675-30300-750-34800-850-39900ರಲ್ಲಿ ನಿಗದಿಪಡಿಸಿ ಪ್ರಸ್ತುತ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ)ಹುದ್ದೆಯಲ್ಲಿ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸುತ್ತಿರುವ ಶ್ರೀ ಆರ್.ಗೋವಿಂದರಾಜು, ಇವರನ್ನು ಪುನರ್ ಪದನಾಮೀಕರಿಸಿದ ಹಿರಿಯ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಪದನಿಮಿತ್ತ ಸರ್ಕಾರದ ವಿಶೇಷ ಕಾರ್ಯದರ್ಶಿಗಳು ಹುದ್ದೆಗೆ ಬಡ್ತಿಯನ್ನು ನೀಡಿ ಶಾಶ್ವತವಾಗಿ ಜಾರಿಯಲ್ಲಿರುವಂತೆ ಇಲಾಖೆಯಲ್ಲಿಯೇ ಮುಂದುವರಿಸಲಾಗಿದೆ.

• ಸರ್ಕಾರಿ ಆದೇಶ ಸಂ.:ಲೋಇ:10: ಐಎಫ್ಎ:2009, ಬೆಂಗಳೂರು ದಿನಾಂಕ:22ನೇ ಸೆಪ್ಟೆಂಬರ್ 2009ರಲ್ಲಿ ಸೃಜಿಸಲಾದ ಪೂರಕ ಸಿಬ್ಬಂದಿಯನ್ನು ಮುಂದುವರಿಸಲಾಗಿದೆ.

• ಆಯವ್ಯಯ ಹಾಗೂ ವಿತ್ತೀಯ ಉಸ್ತುವಾರಿ ಕೋಶದ ಹಿರಿಯ ನಿರ್ದೇಶಕರು (ಆರ್ಥಿಕ) ಹಾಗೂ ಪದನಿಮಿತ್ತ ಸರ್ಕಾರದ ವಿಶೇಷ ಕಾರ್ಯದರ್ಶಿಗಳ ವೇತನ, ತುಟ್ಟಿಭತ್ಶೆ, ಸಾರಿಗೆ:ವಾಹನ ಭತ್ಯೆ ಮತ್ತು ಇತರೆ ಭತ್ಯೆಗಳನ್ನು ಪ್ರಸ್ತುತ ಡ್ರಾ ಮಾಡುತ್ತಿರುವಂತೆಯೇ, ಕೇಷಿಪ್ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆಯಡಿ ಡ್ರಾ ಮಾಡತಕ್ಕದ್ದು. ಕೇಷಿಪ್ ಯೋಜನೆಯ ಅವಧಿ ಮುಕ್ತಾಯಗೊಂಡಲ್ಲಿ ಸದರಿ ಅಧಿಕಾರಿಗಳ ವೇತನ ಹಾಗೂ ಭತ್ಯೆಗಳನ್ನು ಲೋಕೋಪಯೋಗಿ ಇಲಾಖೆಯ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆಯಡಿ/ಸಿಬ್ಬಂದಿ ಮತ್ತು ಆಡಳಿತ ಸುಧಾರಣಾ ಇಲಾಖೆಯ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆಯಡಿ ಭರಿಸಬಹುದಾಗಿರುತ್ತದೆ.

• ಮೇಲ್ಕಂಡ ಕೋಶವು ಲೋಕೋಪಯೋಗಿ ಸಚಿವಾಲಯದ ಒಂದು ಭಾಗವಾಗಿದ್ದು, ಸರ್ಕಾರದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ, ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆ, ಇವರ ನೇರ ನಿಯಂತ್ರಣ ಹಾಗೂ ಅವರ ಆಡಳಿತ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸತಕ್ಕದ್ದು.

Subject :- Extension of pay scale applicable to Graduate Junior Engineers to the non- Graduate Junior Engineers - Implementation of the orders dated 19-01-2010 passed by the Hon`ble Supreme Court in SLP No.16890/06 (Civil Appeal No.3412/07) c/w SLP No.1006/07 (Civil Appeal No.4515/07) – reg

PREAMBLE:-

In pursuance of the orders passed by the Hon'ble Supreme Court in Civil Appeal Nos.5816 to 5846 and other connected impleading Applications in the said Civil Appeals, Government, after careful consideration, by Government Order dated 29-01-1998 read with Corrigendum dated 04-03-1998 read at (1) above, extended the pay scale applicable to Graduate Junior Engineers to the non-Graduate Junior Engineers of the Public Works Department subject to the following conditions:-

(a) that all the Applicants in A.Nos.2874 to 2891 of 1988 (G.Narsimha Reddy & others) and the Applicants in A.Nos. 3016 to 3068/88 c/w A.Nos.2914 to 2927 of 1988 (B. K. Gopala Krishna and others) shall be entitled to the benefit of Government letter No.LoE 38 SeSaki 87 dated 04.12.1987 and their pay shall be fixed in the Graduate Junior Engineers' scale of pay with effect from 01.01.1957 or from the date of their appointment, as the case may be, and they shall be entitled to arrears of salary consequent upon such fixation of pay only up to 08.01.1974 or till they retired from service or till they ceased to be in service for any reason whatsoever, whichever is earlier. The same shall be drawn and paid to them, if not already done.

(b) that if any of the Applicants above named has been promoted to the cadre of Assistant Engineer (now Assistant Executive Engineer) during the period from 01.01.1957 to 08.01.1974, he shall be entitled to protection of his pay in the Graduate Junior Engineers' scale as on the date of his promotion as such and for regulation of his pay thereafter from time to time;

(c) that if any of the applicants above named has retired from service on or before 08.01.1974, he shall be entitled to pensionary benefits with reference to his pay fixed in the Graduate Junior Engineers' scale of pay.

(d) that the Applicants above named shall not be entitled to Graduate Junior Engineers' scale of pay after 09.01.1974, and with effect from that date, their pay shall be fixed in the scale of pay of non-Graduate Junior Engineer, not on the basis of the pay drawn by them in the scale of pay of Graduate Junior Engineer but at the stage at which they would have drawn their pay; had they not been extended the benefit of Graduate Junior Engineers' scale of pay, during the period from 01.01.1957 to 08.01.1974.

Aggrieved by the aforesaid Government Order dated 29-01-1998 read at (1) above, some of the non-Graduate Engineers filed Application Nos.2094-2181/98 before the Hon'ble Karnataka Administrative Tribunal (KAT) praying to quash order partially so for as it relates to the provisions contained in item (d) in the impugned Government Order No.PWD 385 SeSaKi 95(P) dated 29-01-1998 and consequently to issue necessary directions to the respondents to fix their pay and salary on the basis of the pay drawn by them up to 08-01-1974 in the pay scale applicable to the amalgamated cadre of Junior Engineers and to protect their pay benefit accrued to them in the common cadre before 09-01-1974 and to treat them for such benefits of protection of pay and pensionary benefits on par with those of their counterparts retiring or4892 promoted prior to 08-01-1974 etc. The Hon`ble Tribunal in its order dated 03-12-2002 in the aforesaid applications passed the following orders:-

"12. In the instant case, admittedly, the duties and responsibilities of non-Graduate Junior Engineers did not get varied and there was no change in the status of the post. Thus, it is clear that the non-Graduate Junior Engineers were entitled to the protection of the pay drawn by them up to 09.01.1974 even though they were to receive a lesser pay under a reduced scale of pay which became operative after 09.01.1974. Obviously, the salary drawn by the non-Graduate Junior Engineers on 9.1.1974 would be protected even though they are to be fixed in the lower scale of pay which became operative after 9.1.1974. The manner in which the definition of a "personal pay" extracted above comes into operation and salary in excess of what is payable under the lower scale of pay would have to be treated as "Personal Pay" till such time as the salary drawn by them as on 9.1.1974 merges into the pay and other allowances payable under the lower scale of pay. In the event of any pay revision subsequent to 9.1.1974, the non-Graduate Junior Engineers would be entitled to the benefit of such scale of pay as is equated with the scale of pay that became operative on and after 9.1.1974 subject to such adjustment against Personal Pay. In the event of non-Graduate Junior Engineers being entitled to any pay in excess of Pay and Personal Pay as aforesaid, it is needless to state that they would be entitled to the benefit of the higher salary worked out as aforesaid. This method of adjustment of the salary drawn as on 9.1.1974 against the lower scale of pay is what is actually provided for. The Act of 1975 does not stipulate the manner in which the transition has to be provided for from the scale of pay drawn by them as on 9.1.1974 to the lower scale of pay with effect from 9.1.1974. In the event the Act of 1975 had regulated the manner in which the transition had to be provided for, there is no way by which it could have been regulated otherwise, subject of course to an attack under Article 14 of the Constitution of India. Otherwise the provisions of the KCSRs which regulate the transition from a higher scale of pay to a lower scale of pay would have to be honoured. As already observed, all the rules which relate to such transition from a higher scale of pay to a lower scale of pay protect the salary drawn by the Government servant and treat the excess as Personal Pay against future increments and future pay revisions. Even the Pay Rules issued periodically, whenever the pay revisions take place, stipulate that wherever pay drawn by a Government servant cannot be exactly equated with the new scale of pay, the excess of such pay which cannot be equated is treated as Personal Pay to the Government servant subject to absorption against future increments.

13. What is sought to be done by Annexure A6 as per clause (d) is to re-consider the pay scale of non-Graduate Junior Engineers with effect from 01.01.1957 till 08.01.1974 as if they had not been granted the benefit of Graduate Junior Engineers' scale of pay at all during the period 1.1.1957 and 8.1.1974. In effect, the manner of regulation of pay of non-Graduate Junior Engineers under clause (d) of Annexure A6 is to give retrospective effect to the scale of pay granted under the Act of 1975 in the teeth of voiding such an effort by the decision of the Supreme Court referred to above. Apparently, the Government cannot give retrospective effect to its decision in violation of the decision of the Supreme Court which declares that even the non-Graduate Junior Engineers are entitled to the same scale of pay as Graduate Junior Engineers till 8.1.1974. Having regard to the fact that neither the Act of 1975 nor the KCSRs seek to provide for sanction of lower scale of pay in total disregard of the pay drawn by them as on 9.1.1974, the operation of the Order referred to above would have to be declared as being in contravention of the rules of KCSRs which provide for the manner in which the transition from a higher scale of pay to a lower scale of pay is regulated. The operative portion of the Order Annexure- A6 clause (d) is declared as ultra vires and unenforceable. The pay of the non-Graduate Junior Engineers in the lower scale of pay with effect from 9.1.1974 will have to be regulated on the basis of the salary drawn by them as on 8.1.1974 by treating the salary in excess of the pay and allowances under the lower scale of pay as Personal Pay to them and by adjusting the Personal Pay against future increments and future pay revisions till such time as Personal Pay gets merged in the regular scale of pay and allowances under the lower scale of pay of non-Graduate Junior Engineers.

14. Having regard to the fact that the non-Graduate Junior Engineers sought fixation of their pay after 9.1.1974 and having regard to the fact that the fixation of pay sought for by non-Graduate Junior Engineers after 9.1.1974 was not decided on merits on the ground that they have not exhausted their remedy in accordance with law and having regard to the fact that in Annexure-A-5 the Supreme Court directed that the cases of the Applicants be examined and decision taken on or before 15.01.1998 and also having regard to the fact that Annexure-A6 came to be made on 29.01.1998, none of the non- Graduate Junior Engineers can be denied the benefit of re-fixation of pay in terms of this order on the ground that they had not moved this Tribunal earlier. The cause of action for4893 seeking re-fixation of pay and challenging the re-fixation arose for the first time on 29.1.1998 when the criterion for re-fixation was decided by the Government. Therefore, apparently, the question of limitation for settlement of any of the claims for re-fixation pursuant to Annexure-A6 as now modified would not apply to any class of non-Graduate Junior Engineers. The order Annexure`A-6` seeking to regulate the pay of only the Applicants referred to in Annexure-A6 cannot be sustained in the light of the decision of the Supreme Court in INDRA PAL v/s. UNION OF INDIA reported in 1985(2) SCC 648 where the Supreme Court has observed that all similarly situated persons need not approach the Tribunal or the High Court for a direction to grant relief already granted to persons who have approached the High Court or the tribunal for identical relief. Indeed a similar contention was raised in MRUTHYUNJAYA`S CASE confining the relief to the Applicants and it has already been negatived. In these circumstances, the Respondents cannot confine the relief only to non-Graduate Junior Engineers who move this Tribunal, High Court and the Supreme Court for grant of the benefit that has been granted in these Applications. The relief shall have to be granted to all the non-Graduate Junior Engineers who are similarly placed as the applicants in these cases.

15. Having regard to the decisions of the Supreme Court in Sahib Ram Vs. State of Haryana reported in 1995 (Suppl) (3) SCC 600 and Shyam Babu Verma vs. Union of India reported in 1994 (2) SCC 521, there would be no question of recovery of whatever pay and allowances that has been granted to the non-Graduate Junior Engineers, especially having regard to the clauses (a), (b) and (c) of Annexure-A6. The pay and pension of the non-Graduate Junior Engineers shall have to be regulated in terms of this decision.

16. In these circumstances, part of Government Order bearing No. PWD 385 SeSaKi 95(P) dated 29.01.1998 (Annexure- A6) namely clause (d), which reads as follows, stands quashed:

". . . and with effect from that date, their pay shall be fixed in the scale of pay of non- Graduate Junior Engineer, not on the basis of the pay drawn by them in the scale of pay of Graduate Junior Engineer but at the stage at which they would have drawn their pay, had they not been extended the benefit of graduate Junior Engineers' scale of pay, during the period from 01.01.1957 to 08.01.1974"

Six months time is granted for compliance of the directions issued in para 12 to 14 of this order"

Subsequently, Application Nos.7738-7752/2003 and other connected cases filed by some more non-Graduate Junior Engineers also came to be allowed by the Hon`ble Tribunal in its judgment dated 23-09-2003 in terms of its earlier order dated 03-12-2002 passed in Application Nos.2094-2181/98.

In view of the above, Government of Karnataka filed Writ Petition Nos. 43978-44070/2003 and c/w similar cases against the orders of the Hon`ble Tribunal dated 03-12-2002 passed in Application Nos.2094-2181/98 and orders dated 23-09-2003 passed in Application Nos.7738-7752/2003. The Division Bench of the Hon`ble High Court of Karnataka in its order dated 18-12-2004 dismissed all the Writ Petitions filed by the State Government in this matter. Subsequently, the Review Petition No.314/2005 filed by the State Government against the orders of the High Court dated 18-12-2004 also came to be dismissed by the Division Bench of the Hon`ble High Court vide its order dated 02-09-2005.

In pursuance of the above judgments, the State Government had filed SLP No.16890/2006 (converted as Civil Appeal No.3412/07) against the orders of the Hon`ble High Court dated 18-12-2004 passed in W.P. No.43978-44070/03 along with the order of the Hon`ble High Court dated 02-09-2005 passed in Review Petition No.314/2005. Further, in a similar matter, the State had filed one more SLP No.1006/2007(converted as Civil Appeal No.4515/07) against orders of the Hon`ble High Court dated 29- 6-2006 passed in W.P. No.3734/2004. The Hon'ble Supreme Court in its judgement dated 19-01-2010 in the said SLPs/Civil Appeals has passed the orders as follows:-

"1. The only controversy involved in these appeals filed by the state of Karnataka is as to whether the non-graduate Junior Engineers who were in service up to 9.1.1974 and whose pay-scales were identical with the graduate Junior Engineers till that date can retain their pay though the State of Karnataka has brought in lesser pay-scale for the non-graduate Junior Engineers.

2. It so happened that prior to 9.1.1974, admittedly by reason of the judgment of this Court, the pay-scales of both the graduate Junior Engineers and non-graduate Junior Engineers were identical. This Court in K.Ravindranath Pai & another Vs. State of Karnataka & another 1995 Suppl.(2) SCC 246 unequivocally held that the non-graduate Junior Engineers would get the identical pay-scales as applicable to the graduate Junior4894 Engineers up to 9.1.1974. The Karnataka Government thereafter created two cadres, one of the graduate Junior Engineers naming it to be Junior Engineers (Division-I) and non- graduate Junior Engineers naming it to be Junior Engineers (Division-II) providing separate pay-scales for the two cadres. Needless to mention here the pay-scales provided for Junior Engineers (Division-I) were better while the pay-scales provided for Junior Engineers Division-II) were inferior. Then the question arose as to how to equate and what pay-scales and in what manner the pay of those Junior Engineers (Division II) who were going to continue to be regulated. The Government of Karnataka tried to slash the pay which the Junior Engineers (Division-II) were drawing on 9.1.1974 for fixing them into the inferior pay scales.

3. This was challenged before the Karnataka Administrative Tribunal (for short "the Tribunal"). The Tribunal held on the basis of Rules 42 and 43 the Karnataka Civil Services Rules that it was not possible to slash the pay in order to fix them in a new pay scale. The Tribunal also held and, in our opinion absolutely correctly, that if the initial pay in the new pay scale of the Junior Engineer (Division-II) was lesser than the one which was being drawn by that Junior Engineer (Division-II) on 9.1.1974, the pay should be treated as personal pay till such time as that pay comes in line with the new pay- scales.

4. We have heard learned counsel appearing for the parties and gone through the record.

5. Mr.Sanjay R.Hegde, learned counsel appearing for the State of Karnataka tried to argue that since a totally new pay-scale was applicable to Junior Engineer (Division II), then the two results should normally follow. Firstly; that no right would accrues to the non- graduate junior Engineer (Division-II) to the pay-scale of graduate Junior Engineer. Insofar as this first contention of Mr. Hegde is concerned, it is undoubtedly correct. After 9.1.1974, there would undoubtedly be two pay-scales and the Junior Engineers (Division- II) will not be entitled to claim the pay-scales granted to the Junior Engineers (Division-I) only on the basis of the parity of their pay-scales prior to 9.1.1974. Mr. Hegde goes further and canvasses that such persons cannot claim protection of their pay in the said scales for the period subsequent to 9.1.1974. This is certainly not possible, particularly, in view of Rules 42 and 43 as also the definition of "personal pay" in Karnataka Civil Service Rules.

6. In our opinion, of the judgment the Tribunal is correct and the Tribunal has rightly relied upon the judgment of this Court in K. Ravindranath Pai (Supra). The High Court has also rightly affirmed the judgment of the Tribunal.

7. It will indeed be the travesty if by fixing the new pay-scales, the available pay, which has been rightfully drawn by Junior Engineer (Division-II), should be slashed. In doing so, the Government would unnecessarily be touching upon the area which it could not do namely; bringing in the parity in the pay-scales of Junior Engineers (Division-I) and Junior Engineers (Divison-II) up to 9.1.1974. That was not permissible.

8. In that view, we do not find any merit in these appeals which are, accordingly, dismissed. No costs.

9. The State of Karnataka would be well-advised in fixing the pay-scales of the respondents protecting their pay as on 9.1.1974 and taking necessary steps as per the order of the Tribunal within three months from today".

In the light of the aforesaid orders of the Hon`ble Supreme Court and also having regard to the orders of the Hon`ble Tribunal dated 03-12-2002 passed in Application No.2094-2181/1998, the Government have examined the proposal in detail and has passed following orders.

GOVERNMENT ORDER No. PWD 104 SE SA KI 2005, Bangalore, dated 22-04-2010 In the circumstances explained in the preamble and after careful consideration of all aspects of the matter, Government are pleased to order as follows:-

(i) The instructions contained in clause (d) of the Government Order No.PWD 385 SeSaKi 95 (P) dated 29-01-1998 shall stand modified as indicated below:-

"(d) The pay of the non-Graduate Junior Engineers in the lower scale of pay with effect from 09- 01-1974 shall be regulated on the basis of the pay drawn by them in the Graduate Junior Engineers' scale of pay as on 08-01-1974 by treating the pay drawn by them in excess of pay under the lower scale of pay as "personal pay" to them subject to adjusting the "personal pay" against future increments and future pay revisions till such time as personal pay gets merged in the regular scale of pay applicable to non-Graduate Junior Engineers"4895 (ii) The benefit of the Graduate Junior Engineers' pay scale extended to the non-Graduate Junior Engineers who were applicants/petitioners in these cases is also extended to all the non- Graduate Junior Engineers who are similarly placed as the applicants/petitioners in these cases and their pay with effect from 01-01-1957 to 08-01-1974 in the Graduate Engineers' scale of pay shall be regulated in accordance with the instructions contained in clauses (a) to (c) of the Government Order No.PWD 385 SeSaKi 95 (P) dated 29-01-1998 and their pay with effect from 09-01-1974 in the non-Graduate Junior Engineers' scale of pay shall be regulated in accordance with the instructions contained in clause (d) of the said order, as modified by this order as aforesaid.

The Chief Engineer, Communication and Buildings (South), Bangalore shall, after causing proper verification of the Service Registers and other connected service records of the non-Graduate Junior Engineers in each case meticulously and after satisfying himself that they are entitled to the benefit and the said benefit had not been extended to them at any time earlier, take immediate necessary steps to fix their pay in the appropriate scale of pay and draw and disburse the arrears of salary to them on account of such fixation.

This order issues with concurrence of the Finance Department vide its U O Note No. FD 348 Services-I/2010 dated 29-03-2010.

2. Method of Recruitment: Selection of candidates will be made in accordance with the High Court of Karnataka Service (Conditions of Service and Recruitment) (I Amendment) Rules, 2009 and the High Court of Karnataka Service (Direct Recruitment by Selection) Rules, 1984 as amended from time to time.

3. Minimum Qualification:

1) Must possess Degree from a recognised University or equivalent examination.

NOTE: Preference will be given to the Law Graduates.

2) i) Senior Grade examination in English Shorthand in First Class; or the Proficiency Grade Examination in English Shorthand; and

ii) Senior Grade examination in Typewriting in English conducted by the Department of Public Instruction of Karnataka Secondary Education Board or equivalent examination.

3) Certificate in Computer Word Processing or equivalent.

Note:1) Preference will be given to those candidates who possess the qualification of Senior Grade examination in Typewriting and Shorthand in Kannada language.

(c) Persons claiming the benefit of reservations under SC/ST shall produce a certificate in the form prescribed by the Government issued by the competent authority.

(d) SSLC or any other equivalent examination certificate showing the date of birth.

(e) Persons claiming the benefit of reservations under Category-I/II-A/II-B/III-A/III-B shall produce a certificate in the form prescribed by the Government issued by the competent authority.

(f) Persons claiming reservation under rural quota / Physically Handicapped quota shall produce certificates issued by competent authority.

(g) A passport size photo be affixed at the place provided on the application.

The draft of the following rules further to amend the Karnataka Value Added Tax Rules, 2005 which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of section 88 of the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004) is hereby published as required by the said sub-section for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the Official Gazette.

Any objection or suggestion, which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections or suggestions may be addressed to the Principal Secretary to Government, Finance Department, Vidhana Soudha, Bangalore - 560 001.

DRAFT RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Value Added Tax (Amendment) Rules, 2010.

(2) They shall come into force from the first day of April, 2010.

2. Amendment of rule 3.- In the Karnataka Value Added Tax Rules, 2005 (hereinafter referred to as the said rules), after sub-rule (3), the following shall be inserted, namely:-

"(4) (a) Notwithstanding anything contained in clause (b) of sub-rule (1) and sub-rule (2), the total turnover in respect of a dealer liable to pay tax on sale of manufactured tobacco under sub-section (5) of Section 4, where the sale has taken place inside the State, shall be the aggregate of maximum retail prices of the goods sold and the taxable turnover in respect of such sales shall be determined by allowing deductions specified in clauses (d), (h) and (i) of sub-rule (2) from the total turnover.

(b) The tax invoice issued by such dealer shall contain the details of maximum retail price of the goods in addition to details specified in rule 29."

3. Amendment of rule 4.- In rule 4 of the said rules, in clause (iv), for the word, letters and figure "Form VAT 2", the word, letters and figure "Form VAT 1" shall be substituted.

4. Amendment of rule 9.- In rule 9 of the said rules, after sub-rule (2), the following shall be inserted, namely:-

"(3) The Commissioner shall, authorize any Local VAT Officer or VAT Sub-officer to assign a Tax Deducting Authority Identification Number (DIN) to the Central Government or any State Government or others specified under sub-section (1) of Section 9-A for the purposes of deduction and remittance of tax." 5. Amendment of rule 15.- In rule 15 of the said rules, after sub-rule (3), the following shall be inserted, namely:-

"(4) The legal heir or heirs of a deceased individual dealer requiring for transfer of registration under the proviso to sub-section (1) of section 27 shall make an application in form VAT 1 along with,- (a) the death certificate issued by the competent authority;

(b) a sucessation certificate obtained from the competent court;

(c) a sworn affidavit of the legal heirs who do not opt for inclusion of their name in the registration or consenting for inclusion of the name or names of other legal heir or heirs;

(d) a sworn affidavit undertaking to pay any tax or other amount due under the Act by the deceased individual.

(5) The Registering Authority may, after such enquiry as he may deem fit, permit transfer of registration to the applicant or applicants."

6. Amendment of rule 33.- In rule 33 of the said rule, for sub-rule (3), the following shall be substituted, namely:-

"(3) Every dealer shall maintain a VAT account containing details of input and output tax, together with credit and debit notes issued during any tax period."

7. Amendment of rule 37.- In rule 37 of the said rules, in clause (1), for the words "turnover in a period of four consecutive quarters does not exceed fifteen lakhs rupees", the words "total turnover in a year does not exceed twenty five lakh rupees" shall be substituted.

8. Amendment of rule 38.- In rule 38 of the said rules,

(1) for sub-rule (1) including the proviso, the following shall be substituted, namely:-

"(1) Every registered dealer shall submit a monthly or quarterly return as the case may be, containing net values of sales, purchases and other transactions, input and output tax claimed or collected and net tax relating to all of his places of business, and accompanied by proof of full payment of any tax due including any certificate of deduction of tax at source and a statement containing the details of purchases made within the State from other registered dealers in respect of which he is eligible to claim deduction of input tax and sales made to other registered dealers in the State to the jurisdictional Local VAT Officer or VAT Sub-Officer in Form VAT 100 within twenty days after the end of the relevant month where the tax period is a calendar month or fifteen days after the end of the relevant quarter where the tax period is a quarter:

Provided that any registered dealer unable to furnish any certificate of deduction of tax at source along with the return in Form VAT 100 shall furnish such certificate within a period of ten days from the last day for submitting the return.

Provided further that the form of monthly or quarterly return in respect of dealers liable to pay tax under sub-sections (4) and (5) of Section 4 including any tax liability under sub-section (1) of Section 4, shall be in Form VAT 105.

Provided also that the return in Form VAT 100 for any month commencing from the first day of April, 2010 shall be in the form as substituted in the Karnataka Value Added Tax (Amendment) Rules, 2010."

(2) Sub-rules (8) and (9) shall be omitted.

9. Amendment of rule 43.- In rule 43 of the said rules, in sub-rule (2), for the word, letters and figures "Form VAT 100", the word, letters and figures "Form VAT 110" shall be substituted.

10. Amendment of rule 47.- In rule 47 of the said rules,-

(1) in sub-rule (1),-

(a) for the words "to be assessed separately by", the words "to file a separate return to", shall be substituted;

(b) after the words "as a separate business", the words "and to be assessed or reassessed separately but by the same officer as authorised by the Commissioner", shall be inserted;

(2) in sub-rule (2), for the words and letters "Section 10", the word and the letters "Section 22" shall be substituted.

11. Amendment of rule 50.- In rule 50 of the said rules,-

(1) in sub-rule (1), in clause (a), the following proviso shall be inserted, namely:-

"Provided that the specified class of dealers as may be notified by the Commissioner shall pay tax or any other amount due under the Act or these Rules, by electronic remittance through internet in the manner specified in the notification ."

(2) sub-rule (2) shall be omitted.

12. Amendment of rule 125.- In rule 125 of the said rules, in sub-rule (4), for the words "notice on of", the words "notice of " shall be deemed to have been substituted from the first day of April, 2005.

13. Amendment of rule 130.- In rule 130 of the said rules, for sub-rule(1), the following shall be substituted, namely;-

"(1) Reimbursement of tax under Section 21 shall be subject to the conditions that,

(a) the goods are purchased from a registered dealer who has not opted for composition of tax under Section 15;

(b) the value of the goods purchased excluding the amount of tax charged in any single tax invoice is not less than two thousand five hundred rupees; and

(c) the person claiming reimbursement of tax makes an application in Form VAT 165 to the Commissioner within one hundred and eighty days from the date of purchase, together with copies of the corresponding invoices."

14. Insertion of new rule 130-B.- After rule 130-A of the said rules, the following new rule shall be inserted, namely:-

"130-B.- 1) Any person claiming refund of tax under clause (b) of sub-section (6) of Section 4 shall make an application in Form VAT 166 to the jurisdictional Local VAT Officer or VAT Sub-Officer within sixty days from the date of purchase, together with the copy of the tax invoice.

(2) On receipt of the application, if the Local VAT Officer or VAT Sub-Officer is satisfied, after causing such inquiry as he considers necessary, that the claim for refund is valid and admissible, he shall pass order for refund of the amount or any part thereof and issue to the applicant a refund payment order in Form VAT 255 within sixty days from the date of application."

15. Amendment of rule 138.- In rule 138 of the said rules, in clause (5), the words "and a statement relating to his registration in Form VAT 6 along with the quarterly return submitted in respect of the last quarter of that year in which there is a change in the details of his registration" shall be omitted.

16. Amendment of rule 139.- In rule 139 of the said rules,

(1) in clause (5), the words "and a statement relating to his registration in Form VAT 6 along with the monthly return submitted in respect of the last month of that year in which there is a change in the details of his registration" shall be omitted;

(2) after clause (7), the following shall be inserted, namely:-

"(8) where he is also liable to pay tax under Section 4, shall submit returns in Form VAT 100 and Form VAT 120 within the time prescribed."

(3) the following proviso shall be inserted, namely:-

"Provided that any registered dealer unable to furnish any certificate of deduction of tax at source along with the return in Form VAT 120 shall furnish such certificate within a period of ten days from the last day for submitting the return."

17. Amendment of rule 140.- In rule 140 of the said rules,

(1) in clause (5), the words, letters and figure "and a statement relating to his registration in Form VAT 6 along with the quarterly return submitted in respect of the last quarter of that year in which there is a change in the details of his registration" shall be omitted;

"(8) where he is also liable to pay tax under Section 4, shall submit returns in Form VAT 100 and Form VAT 120 within the time prescribed."

18. Amendment of rule 153.- In rule 153 of the said rules, for sub-rule (4), the following shall be substituted, namely:-

"(4) Every appeal under sub-section (1) of Section 66 against an order passed by the Authority under Section 60 shall be in Form VAT 486 and shall be verified in the manner specified therein and shall be accompanied by the original order or a certified copy of the order of the Authority appealed against." 19. Amendment of rule 159.- In rule 159 of the said rules,

(1) in sub-rule (3), after the words "accompanies the goods vehicle", the words, brackets, figures and letters "and any proof of entering in the website, particulars of goods carried as specified in clause (a) of sub-section (2-A) of Section 53" shall be inserted;

(2) in sub-rule (4), in clause (a), after the words, brackets and figure "sub-section (2) or", the words, brackets, figure and letter "sub-section (2-A) or" shall be inserted.

20. Insertion of new rule 164.- After rule 163 of the said rules, the following rules shall be inserted, namely:-

"164 Definitions.- In this part, unless the context otherwise requires.-

(1) "Advance Ruling" means a determination by the Authority in relation to a transaction which has been undertaken by a dealer registered under the Act;

(2) "Applicant" means any dealer who is registered under the Act;

(3) "Application" means an application made to the Authority under sub-section (2) of Section 60;

(4) "Authorised representative".-

(i) in relation to an applicant shall have the meaning assigned to it under Section 86;

(ii) in relation to the Commissioner, means any officer authorized by the Commissioner in writing to appear, plead and act for the Commissioner in any proceedings before the Authority;

(5) "Authority" means the Authority for Clarification and Advance Rulings constituted under Section 60;

(6) "Case" means any proceedings under Section 60 in respect of an applicant;

(7) "Chairman" means the Chairman of the Authority;

(8) "Member" means a member of the authority and includes the Chairman;

(9) "Order" includes any order, direction or ruling of the authority;

(10) "Secretary" means any officer designated as the Secretary of the authority.

Words and expressions used and not defined herein but defined in the Act, shall have the meanings respectively assigned to them in the Act.

165.- (1) The Commissioner may authorize any officer to act as the Secretary of the Authority that he may constitute.

(2) An application under sub-section (2) of Section 60 shall be made in Form VAT 540 and shall be verified in the manner indicated therein by the Secretary, and every such application shall be accompanied by a fee of one thousand rupees.

(3) The fees specified in sub-rule (1) above shall be paid by way of crossed demand draft in favour of the Commissioner of Commercial Taxes in Karnataka, Bangalore.

(4) An applicant may withdraw an application made under sub-section (1) of Section 60 within thirty days from the date of application.

(5) On receipt of an application, the Secretary shall cause a copy thereof to be forwarded to the Joint Commissioner within whose administrative jurisdiction the applicant is registered and call for his finding on the clarification sought or question raised and also production of any information or records.

(6) The Commissioner may constitute an Authority consisting of at least three Additional Commissioners as members in respect of any application filed and authorise the senior most member to act as the Chairman.

(7) The Authority may, after examining the application and any records called for, by order, either, admit or reject the application on recording reasons for any rejection.

(8) The Authority shall not admit the application where the question raised in the application, (a) is already pending before any officer or authority of the Department or any other Authority constituted under sub-rule (6) or Appellate Tribunal or any Court in any proceedings before them; or

(b) relates to a transaction or issue which is designed apparently for the avoidance of tax.

(9) No application shall be rejected under sub-rule (7) unless an opportunity has been given to the applicant to show cause in writing against such rejection, and where the application is rejected, reasons for such rejection shall be given in the order.

(10) The Authority shall hear and determine an application made under sub-section (2) of Section 60 and such other applications, petitions and representations of an interlocutory, incidental or ancillary nature as may be necessary for a complete and effective disposal of the application.

(11) Where an application is admitted under sub-rule (7), the Authority shall, after examining such further material as may be placed before it by the applicant or obtained by the Authority, pass such order as deemed fit on the questions specified in the application, after giving an opportunity of being heard to the applicant, if he so desires and also the Local VAT Officer or VAT sub-officer or Registering Authority or any other officer connected with the case.

(12) The authority shall pass an order within three months of the receipt of any application, and a copy of every order made under Section 60 shall be sent to the applicant and the officer concerned.

(13) The Secretary shall have the custody of the records of the Authority and shall exercise such other functions as are assigned to him under these rules or by the Commissioner by a separate order.

(14) The official seal of the Authority shall be kept in custody of the Secretary.

(15) The Secretary shall also have the following powers and duties namely.-

(a) to receive all applications filed before the Authority;

(b) to scrutinize the applications to find out whether they are in conformity with the Act, the rules and the procedure;

(c) to point out defects in such application to the parties and grant time to remove the defects and where, within the time granted, the defects are not removed, to obtain necessary orders of the Authority;

(d) to fix the date of hearing for the applications in consultation with the members of the Authority and direct the issue of notices there for;

(e) to issue notices or other processes and to ensure that the parties are properly served with notices or orders;

(f) to requisition records from the custody of any person including any authority;

(g) to allow inspection of records of the Authority;

(h) to direct any formal amendment of the records of the Authority;

(i) to grant certified copies of the orders of the Authority to the parties; and

(j) to grant certified copies of documents filed in the proceedings to the parties in accordance with the rules.

(16) (a) Any requisition, direction, letter, authorization or written notice to be issued by the Authority, shall be signed by the Secretary.

(b) Nothing in clause (a) shall apply to any requisition or direction which the Authority may, in the course of the hearing, issue to an applicant or any authority or an authorized representative.

(17) (a) The Authority may at its discretion permit or require the applicant to submit such additional facts as may be necessary to enable it to pronounce its clarification or advance ruling.

(b) Where in the course of the proceedings before the Authority a fact is alleged which cannot be borne out by, or is contrary to, the record, it shall be stated clearly and concisely and supported by a duly sworn affidavit.

(18) The applicant shall not, except by leave of the Authority be heard in support of any additional question not set-forth in the application, but in deciding the application, the Authority shall at its discretion consider all aspects of the questions set-forth as may be necessary to pronounce a ruling on the substance of the questions posed for its consideration.

(19) An authorized representative appearing for the applicant at the hearing shall file, before the commencement of the hearing a document authorizing him to appear for the applicant and, if he is a relative of the applicant, the document shall state the nature of his relationship with the applicant or, if he is a person regularly employed by the applicant, the capacity in which he is at the time employed.

(20) Where the applicant dies or is wound up or dissolved or disrupted or amalgamated or succeeded to by any other person or otherwise comes to an end, the application shall not abate and may be permitted by the Authority, where it considers that the circumstances justify it, to be continued by the executor, administrator of other legal representative of the applicant or by the liquidator, receiver of assignee, as the case may be, on the application made in this behalf.

(21) (a) Where, on the date fixed for hearing or any other day to which the hearing may be adjourned, the applicant or the officer concerned does not appear in person or through an authorized representative when called on for hearing, the Authority may dispose of the application ex-parte on merits.

(b) Where an application has been disposed of under clause (a) above and the applicant or the officer concerned applies within fifteen days of receipt of the order and satisfies the Authority that there was sufficient cause for his non-appearance when the application was called upon for hearing, the Authority may, after allowing the opposite party a reasonable opportunity of being heard, make an order setting aside the ex parte order and restore the application for fresh hearing.

(22) Where the Authority finds on its own motion or on a representation made to it by the applicant or the officer concerned, but before the clarification or ruling pronounced by the Authority has been given effect to by the officer concerned, that there is a change in law or facts on the basis of which the clarification or ruling was pronounced, it may by order modify such ruling in such respects as it considers appropriate, after allowing the applicant and the officer a reasonable opportunity of being heard.

(23) (a) The Authority may within ninety days of passing of any clarification or advance ruling, with a view to rectifying any mistake apparent from the record, amend such order passed by it before the clarification or advance ruling pronounced by the Authority has been given effect to by the officer concerned.

(b) An amendment under clause (a) may be made on the Authority's own motion or when the mistake is brought to its notice by the applicant or the officer concerned within sixty days from the date of passing of the order or advance ruling, but only after allowing the applicant and the officer, reasonable opportunities of being heard.

(24) If at any stage of the proceedings before the Authority it appears that there is any factual or material error in the records, the same shall be amended after hearing the applicant and the officer concerned.

(25) (a) The applicant or the officer concerned or an authorized representative may be allowed to inspect the records of the case on making an application in writing to the Secretary.

Provided that only those documents shall be allowed to be inspected which have been relied upon in the proceedings before the Authority.

(b) The inspection shall be allowed only in the presence of an officer of the Authority and the applicant may be permitted to make notes of inspection but not to take copies of any document.

(c) Fees for inspecting records of the Authority shall be charged from the applicant as follows.- (i) One hundred rupees for the first hour or part thereof, and

(ii) Fifty rupees for every additional hour or part thereof.

(d) Fees for inspection shall be paid in advance in cash.

(26) (a) Every order of the Authority under Section 60 shall be duly signed by the members and bear the official seal of the Authority.

(b) One certified copy of such order of the Authority shall be communicated to the applicant and the officer concerned under the signature of the Secretary and bear the official seal of the Authority.

(27) The provisions contained in these rules for the hearing and disposal of an application under sub- section (2) of Section 60 shall apply mutatis mutandis to the hearing and disposal of all other applications, petitions and representations before the Authority.

ಆದುದರಿಂದ ಈ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ. 18) ರ ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆ0ದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.
