Sub: Assumption of Anjuman-e-Islam, Bankapur, Shiggoan Taluk, Haveri District, under the direct management of the Board-Regarding.

PREAMBLE:

Anjuman-e-Islam, Bankapur, Shiggoan Taluk, Haveri District, is a Wakf Institution, the same is managed by a Managing Committee constituted by the Board vide Order No.KTW/CMC/35/HVR/09-10, Dated:25.05.2010 to function for a period of three (3) years.

Dated:20.09.2010 & 23.09.2010 of resident of the locality has reported that management is managing the said Wakf institution against the interest of the Wakf and functioning as per their own whims and fancies which likelihood of land and order problems, and it will damage the image of Wakf institution, and requested to take the institution under the direct management of the Board, and appoint Wakf Officer, DWAC, Haveri, as its Administrator.

The matter was placed before the Administrator, Karnataka State Board of Wakfs, Bangalore. The Administrator has accorded approval on 13.10.2010 for the appointment of Wakf Officer, DWAC, Haveri, as Administrator for the Management of the above said institution. Hence this Order.

ORDER NO. KTW/CMC/35/HVR/2009-10, DATED; 13TH OCTOBER, 2010

In view of the facts mentioned in the Preamble and in exercise of the powers conferred Under Section 65 of the Wakf Act 1995, the Karnataka State Board of Wakfs, Bangalore, hereby assumed the Anjuman-e-Islam, Bankapur, Shiggoan Taluk, Haveri District, under the direct Management of the Board. The Wakf Officer, DWAC, Haveri, hereby appoint as its Administrator to function until further orders.

PROCEEDINGS OF THE ADMINISTRATOR, KARNATAKA STATE BOARD OF WAKFS, BANGALORE

Sub: Approval of Byelaws in respect of Tippu Sultan Shaheed Wakf Estate Ganjam, S.R. Patna, Mandya District.

PREAMBLE:

The Tippu Sultan Shaheed Wakf Estate, Ganjam S.R. Patna and its immovable properties are notified vide Notification No.MWB 19(7) 64 Dated:31st October 1964 and published in Official Gazette on 22.11.1964 (2) Addl. Properties notified in Gazette Dated:07.04.1983 (3) & Corrigendum issued and published in Gazette Dated:16.12.1982.

Whereas, the proposal for framing of Byelaws was received. The draft Byelaws was published vide Public Notice of even No. Dated:18.06.2010 calling for objections and suggestions from the general public of the locality. In turn objections were received, one from the Srirangapatna Taluk Muslim Welfare Association ®, S.R. Patna and another from the residents of Srirangapatna. The subject was placed before the Administrator, Karnataka State Board of Wakfs, Bangalore. After careful examination of these objections, the following order is issued.

ORDER NO. KBW/BLS/01/MYA/10-11, DATED:13TH OCTOBER, 2010

In view of the facts mentioned in the preamble and in exercise of the powers conferred under Section 69 of the Wakf Act, 1995, the approval of Karnataka State Board of Wakfs is hereby accorded for the approval of Byelaws of the Tippu Sultan Shaheed Wakf Estate, Ganjam, S.R. Patna, Mandya District.

TIPPU SULTAN SHAHEED WAKF ESTATE DEVELOPMENT COMMITTEE BYELAWS

1. Title and Commencement: (1) These Bye-laws be called the TIPPU SULTAN SHAHEED WAKF ESTATE DEVELOPMENT COMMITTEE Bye-laws.

(2) They shall come into force on the date of its publication in the Official Gazette.

2. Definitions: In these Bye-laws, unless the context otherwise Requires:-

a. 'Act' means the Wakf Act, 1995 (Central Act 43 of 1995).

b. 'Board' means the Karnataka State Wakf Board.

c. 'Committee' means the TIPPU SULTAN SHAHEED WAKF ESTATE DEVELOPMENT COMMITTEE;

d. 'Core Committee' means a Sub-Committee of the main Committee;

e. 'Estate' means Tippu Sultan Wakf Estate and properties situated in and around Srirangapatna and also properties dedicated in the name of wakf in the State. They shall also mean and include the Wakf and properties and included in Notification No.MWB 19(7) 64 Dated:31st October 1964 and published in Official Gazette onಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ನವೆಂಬರ್ ೧೧, ೨೦೧೦ ಭಾಗ - ೫ ೩೩೫೪ 22.11.1964 (2) Addl. Properties notified in Gazette Dated:07.04.1983 (3) & Corrigendum issued and published in Gazette Dated:16.12.1982, details of which are given in Annexure A, B & C.

f. 'Funds' means all money belonging to connected with or secured for the wakf either realized or to be realized by way of rents/ licence fee from the immovable properties, auction oproceeds of right to collect fruits, flowers, parking fee, security of footwear and other articles of visitors to the Gumbad or sums received by way of subscriptions, donation or otherwise, from what so ever legitimate source and for any purpose connected with the Wakf or affairs of the Wakf and its Institutions.

g. 'Institutions' include School, College, Hospital, Home for the old, Maktab, Madrasa or other educational Institutions, Musafirkhana, Community Hall, Library, Khabrastan, Dargah and the like, which are already included as comprised in Gumbad-e-Shahi or may hereafter be established, attached to the wakf.

h. 'Properties' means and include all movable and immovable properties of the Wakf Gumbad-e-Shahi and allied Institutions and shall include all those properties which may hereafter be acquired received as gift, grants, allotted or purchased by the wakf. Properties shall also mean and include the Wakf and properties and included in Notification No.MWB 19(7) 64 Dated:31st October 1964 and published in Official Gazette on 22.11.1964 (2) Addl. Properties notified in Gazette Dated:07.04.1983 (3) & Corrigendum issued and published in Gazette Dated:16.12.1982, details of which are given in Annexure A, B & C.

i. 'Secretary' means the Secretary of the Committee.

j. 'Executive Officer' means Executive Officer appointed by the Board under the provisions of the Wakf Act, 1995.

k. 'The Rules' means the Karnataka Wakf Rules, 1997 or such Rules framed by the Government to Karnataka under powers conferred on it by the Wakf Act in force.

i. 'The Regulations' means the Regulation made by the Board from time to time under powers vested in it by the Act.

m. 'Wakf' means the TIPPU SULTAN SHAHEED WAKF ESTATE.

3. Constitution of Committee:

1. There shall be a Committee for the State which shall consist of not less than (11) elven Members and not more than (15) Members will be nominated by the Wakf Board out of which there shall be atleast three (3) Women Members.

2. The Committee shall have a Chairman & a Vice Chairman.

3. No person who is below the age of (21) Twenty one years of age shall be nominated as a Member of Chairman or Vice Chairman of the Committee.

4. No Non-Muslim shall be nominated to the Committee.

5. As far as possible, there shall be representation as follows".

6. Any one of the Member of the Committee shall be the ex-officio Secretary of the Committee.

4. Term of the Committee:

(1) Subject to the pleasure of the Board the Chairman and the Vice Chairman and other Members of the Committee shall ordinarily hold office for a period of three years or for the residuary period as the case may be.

(2) No Member including the Chairman and the Vice Chairman shall hold office for more than two Terms in all.

(3) No Member who is removed for disqualification or disqualified under the Act shall be eligible to hold office once again.

6. Functions of the Committee:

i. The Committee shall be responsible and accountable for the executions of the works assigned by the Board or the Government.

ii. The Committee shall ensure the safety and development of the Estate Property.

iii. The Committee shall get involved in monitoring and evalution of the development works.

iv. The Executive Officer if posted from Board, as per the provisions of the Wakf Act shall extend co-operation and assistance to the Committee.

v. The Committee shall discharge not only religious and pious duties, but also secular duties and functions as assigned by the Board and the Government.

vi. The Committee shall discharge such other duties and functions as assigned by the board or the State Government from time to time.

vii. The Committee shall take steps for maintenance of accounts of the Estate.

viii. Proceedings of all Meetings of the Committee, action taken on the instructions of State Government or the Board shall be recorded and signed by the Chairman and the Secretary and copies shall be communicated to the Board and the Government.

ix. The Committee shall strictly follow instructions and the guidelines of the Board as well as the State Government.

7. Duties and Responsibilities of the Secretary:

(1) The Secretary shall be the Chief Executive and Admnistrative Officer of the Wakf.

(2) The Secretary, in addition to performing such functions as Conferred on him by or under the Bye-laws or under any law for the time being in force shall carry out/ execute:

(a) Resolutions of the Committee.

(b) Conduct the business of the Committee and keep the Correspondence regarding Meetings, resolutions etc. (c) Carry out and execute such schemes and work as the State Government may direct and incur necessary expenditure thereof.

(d) Be responsible for implementing the schemes of the Committee.

(e) Operate the Bank Accounts of the Committee. The Account will be opened in joint Account in the name of the Secretary and President/ Treasurer.

8. Core Committee:

(1) There shall be a core-Committee consisting of the Chairman, the Vice Chairman, the Secretary and two Members of whom atleast one shall be women to deal with day to day matters.

(2) The Core-Committee shall keep vigilance on the security and development of the Estate Properties and report the matter to the Board at the earliest, if there is any problem.

(3) The Core-Committee will take all important decisions which will also include measures to popularize the historical importance of Hazrath Tippu Sultan Shaheed and boost the tourist potential of the place.

9. Audit:

1) The Audit of the account of the wakf Institutions coming under it shall be done within one month of the completion of the financial year of the wakf and audited by the Auditors appointed by the Wakf Board.

2) The audited Statement together with the observations of the Auditors shall be examined by the Managing Committee who shall append its own observations and submit it to the Wakf Board within one month thereafter.
