NOTIFICATION

No. FD 10 CET 2010, Bangalore, Dated: 18th December, 2010

In exercise of the powers conferred by section 11-A of the Karnataka Tax on Entry of Goods Act, 1979 (Karnataka Act 27 of 1979), the Government of Karnataka, being of the opinion, that it is necessary in the public interest so to do, with effect from the nineteenth day of January, 2010 hereby exempts the tax payable under the said Act,-

(i) On the entry of plant and machinery and capital goods including those brought for the purpose of establishing captive power generation plant, into a local area caused by an enterprenuer for use in setting up a renewable energy project including a cogeneration project in terms of Government Order No. EN 354 NCE 2008, dated 19th January 2010, for a period of three years from the date of commencement of the project implementation; and

(ii) On the entry of any goods into a local area caused by an entrepreneur for use as inputs, component parts and consumables (excluding petroleum products) in the renewable energy project including a cogeneration project set up in terms of Government Order No. EN 354 NCE 2008, dated 19th January, 2010, for a period of five years from the date of commencement of commercial generation of electricity in such project.

2. Procedure,- Every enterprenuer setting up a renewable energy project including a cogeneration project and claiming tax exemption under this notification shall produce the following documents at the time of filing his first monthly or quarterly statement under the Karnataka Tax on Entry of Goods Rules, 1979:-

(a) A certificate in original issued by the Department of Energy, Government of Karnataka certifying:-

(i) that it is a project registered as such;

(ii) the date of commencement of project implementation;

(iii) the date of commencement of commercial generation of electricity; and

(iv) that it is eligible for exemption from payment of entry tax as per the Government Order No. EN 354 NCE 2008, dated 19th January, 2010.

(b) In each of the subsequent years for which tax exemption is claimed under this notification, the entrepreneur shall produce a certificate from the Department of Energy, Government of Karnataka within sixty days of the commencement of the year certifying that the registration of his project is valid for the year.

ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993, (1993ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ 14)ರ ಪ್ರಕರಣ 311 ರೊಂದಿಗೆ ಓದಲಾದಂತೆ, ಪ್ರಕರಣ 138ರ ಉಪ-ಪ್ರಕರಣ (2)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಈ ಕೆಳಗಿನಂತಿರುವ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ತಾಲ್ಲೂಕು ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) ನಿಯಮಗಳು 2005ನ್ನು ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡಲು, ಪ್ರಸ್ತಾಪಿಸಿ ಕರಡು ತಿದ್ದುಪಡಿಯನ್ನು ಸದರಿ ಅಧಿನಿಯಮದ ಪ್ರಕರಣ 311ರ ಉಪ-ಪ್ರಕರಣ (1)ರಲ್ಲಿ ಅಪೇಕ್ಷಿಸುವಂತೆ, ಸದರಿ ಕರಡು ತಿದ್ದುಪಡಿ ನಿಯಮದಿಂದ ಬಾಧಿತರಾಗಲ್ಪಡುವ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡು ನಿಯಮಗಳನ್ನು ಅಂತಿಮಗೊಳಿಸಲು ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಳಿಸಲಾದ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳ ನಂತರ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಸೂಚಿಸಲಾಗಿದೆ.

ಸದರಿ ಕರಡು ನಿಯಮಗಳಿಗೆ ಮೇಲೆ ತಿಳಿಸಲಾದ ಅವಧಿಯೊಳಗಾಗಿ ಯಾವುದೇ ವ್ಯಕ್ತಿಯಿಂದ ಸ್ವೀಕೃತವಾದ ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸಲಹೆಗಳನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್ ರಾಜ್ ಇಲಾಖೆ, ಬಹುಮಹಡಿ ಕಟ್ಟಡ, 3ನೇ ಮಹಡಿ, ಬೆಂಗಳೂರು-560 001 ಇವರಿಗೆ ಮೇಲ್ಕಂಡ ಅವಧಿಯೊಳಗಾಗಿ ಕಳುಹಿಸತಕ್ಕದ್ದು.

ಕರಡು ನಿಯಮಗಳು

(1) ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ತಾಲ್ಲೂಕು ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) (ಎರಡನೇ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2010 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು;

(2) ಇದು ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

(2) ನಿಯಮ 5 ಕ್ಕೆ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ತಾಲ್ಲೂಕು ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) ನಿಯಮಗಳು 2005ರ ನಿಯಮ 5ರ,-

(i) ಉಪ ನಿಯಮ (ಈ) ರಲ್ಲಿರುವ ಪರಂತುಕದಲ್ಲಿ "ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳು ಎರಡನ್ನು" ಎಂಬ ಪದಗಳ ತರುವಾಯ "ಸಾಧ್ಯವಿದ್ದಷ್ಟು ಮಟ್ಟಿಗೆ" ಎಂಬ ಪದಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು.

(ii) ಉಪ ನಿಯಮ (ಉ) ಇದರ ಪರಂತುಕದ ಬದಲಾಗಿ, ಈ ಕೆಳಗಿನ ಪರಂತುಕಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದು, ಎಂದರೆ.-

"ಪರಂತು, ಒಂದು ನಿರ್ದಿಷ್ಟ ವರ್ಗಕ್ಕೆ ಮೀಸಲಾದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳನ್ನು ಮುಂದಿನ ಅವಧಿಯಲ್ಲಿ ಅದೇ ವರ್ಗಕ್ಕೆ ಹಂಚಿಕೆ ಮಾಡತಕ್ಕದ್ದಲ್ಲ. ಆದರೆ ಕಾಯ್ದಿರಿಸದೇ ಇರುವ ಪ್ರವರ್ಗದ ಹುದ್ದೆಯನ್ನು ಮತ್ತೆ ಮುಂದುವರಿಸಲು ಯಾವುದೇ ನಿರ್ಬಂಧವಿರುವುದಿಲ್ಲ.

ಮತ್ತು, ಪರಂತು ಮಹಿಳೆಯರಿಗೆ ಮೀಸಲಾದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳನ್ನು ಮುಂದಿನ ಅವಧಿಯಲ್ಲಿ ಸಾಧ್ಯವಾದಷ್ಟು ಮಟ್ಟಿಗೆ ಮಹಿಳೆಯರಿಗೆ ಹಂಚಿಕೆ ಮಾಡತಕ್ಕದ್ದಲ್ಲ."

ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993, (1993ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ 14)ರ ಪ್ರಕರಣ 311 ರೊಂದಿಗೆ ಓದಲಾದಂತೆ, ಪ್ರಕರಣ 177ರ ಉಪ-ಪ್ರಕರಣ (2)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಈ ಕೆಳಗಿನಂತಿರುವ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಜಿಲ್ಲಾ ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) ನಿಯಮಗಳು 2005ನ್ನು ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡಲು, ಕರಡು ತಿದ್ದುಪಡಿಯನ್ನು ಸದರಿ ಅಧಿನಿಯಮದ ಪ್ರಕರಣ 311ರ ಉಪ-ಪ್ರಕರಣ (1)ರಲ್ಲಿ ಅಪೇಕ್ಷಿಸುವಂತೆ, ಸದರಿ ಕರಡು ತಿದ್ದುಪಡಿ ನಿಯಮದಿಂದ ಬಾಧಿತರಾಗಲ್ಪಡುವ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡು ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಳಿಸಲಾದ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳ ನಂತರ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಸೂಚಿಸಲಾಗಿದೆ.

ಸದರಿ ಕರಡು ನಿಯಮಗಳಿಗೆ ಮೇಲೆ ತಿಳಿಸಲಾದ ಅವಧಿಯೊಳಗಾಗಿ ಯಾವುದೇ ವ್ಯಕ್ತಿಯಿಂದ ಸ್ವೀಕೃತವಾದ ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸಲಹೆಗಳನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್ ರಾಜ್ ಇಲಾಖೆ, ಬಹುಮಹಡಿ ಕಟ್ಟಡ, 3ನೇ ಮಹಡಿ, ಬೆಂಗಳೂರು-560 001 ಇವರಿಗೆ ಮೇಲ್ಕಂಡ ಅವಧಿಯೊಳಗಾಗಿ ಕಳುಹಿಸತಕ್ಕದ್ದು.

ಕರಡು ನಿಯಮಗಳು

(1) ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಜಿಲ್ಲಾ ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) (ಎರಡನೇ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2010 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು;

(2) ಇದು ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

(2) ನಿಯಮ 4 ಕ್ಕೆ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಜಿಲ್ಲಾ ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) ನಿಯಮಗಳು 2005ರ ನಿಯಮ 4ರ,-

(i) ಉಪ ನಿಯಮ (ಈ) ರಲ್ಲಿರುವ ಪರಂತುಕದಲ್ಲಿ "ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳು ಎರಡನ್ನು" ಎಂಬ ಪದಗಳ ತರುವಾಯ "ಸಾಧ್ಯವಿದ್ದಷ್ಟು ಮಟ್ಟಿಗೆ" ಎಂಬ ಪದಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು.

(ii) ಉಪ ನಿಯಮ (ಉ) ಇದರ ಪರಂತುಕದ ಬದಲಾಗಿ, ಈ ಕೆಳಗಿನ ಪರಂತುಕಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದು, ಎಂದರೆ.-

"ಪರಂತು, ಒಂದು ನಿರ್ದಿಷ್ಟ ವರ್ಗಕ್ಕೆ ಮೀಸಲಾದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳನ್ನು ಮುಂದಿನ ಅವಧಿಯಲ್ಲಿ ಅದೇ ವರ್ಗಕ್ಕೆ ಹಂಚಿಕೆ ಮಾಡತಕ್ಕದ್ದಲ್ಲ. ಆದರೆ ಕಾಯ್ದಿರಿಸದೇ ಇರುವ ಪ್ರವರ್ಗದ ಹುದ್ದೆಯನ್ನು ಮತ್ತೆ ಮುಂದುವರಿಸಲು ಯಾವುದೇ ನಿರ್ಬಂಧವಿರುವುದಿಲ್ಲ.

ಮತ್ತು, ಪರಂತು ಮಹಿಳೆಯರಿಗೆ ಮೀಸಲಾದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳನ್ನು ಮುಂದಿನ ಅವಧಿಯಲ್ಲಿ ಸಾಧ್ಯವಾದಷ್ಟು ಮಟ್ಟಿಗೆ ಮಹಿಳೆಯರಿಗೆ ಹಂಚಿಕೆ ಮಾಡತಕ್ಕದ್ದಲ್ಲ."

ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅದಿನಿಯಮ 1993, (1993 ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ 14)ರ ಪ್ರಕರಣ 311 ರೊಂದಿಗೆ ಓದಲಾದ, ಪ್ರಕರಣ 138ರ ಉಪ ಪ್ರಕರಣ (2) ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅದಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಈ ಕೆಳಕಂಡ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ತಾಲ್ಲೂಕು ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) ನಿಯಮಗಳು 2005 ನ್ನು ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡಲು, ಪ್ರಸ್ತಾಪಿಸಿ ಕರಡು ಅದಿಸೂಚನೆಯನ್ನು ಸಂಖ್ಯೆ:ಗ್ರಾಅಪ:203:ಜಿಪಸ:2010 ರಲ್ಲಿ ದಿ:02-12-2010 ರಂದು ಕರ್ನಾಟಕ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಿದ್ದು, ಆ ಮೂಲಕ ಬಾದಿತರಾಗುವ ಸಂಭವವಿರುವ ವ್ಯಕ್ತಿಗಳಿಂದ 15 ದಿನಗಳೊಳಗಾಗಿ ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ಪ್ರಕಟಿಸಿರುವುದರಿಂದ; ಮತ್ತು ದಿನಾಂಕ:02-12-2010 ರ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರವನ್ನು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಿರುವುದರಿಂದ; ಸದರಿ ಕರಡು ನಿಯಮದ ಬಗ್ಗೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಯಾವುದೇ ಸಲಹೆಗಳನ್ನು ಮತ್ತು ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಸ್ವೀಕರಿಸಿರುವುದಿಲ್ಲ;

ಈಗ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅದಿನಿಯಮ 1993ರ (1993 ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ-14) ರ 311ನೇ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅದಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡಂತೆ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ.

ನಿಯಮಗಳು

1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ:- (i) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ತಾಲ್ಲೂಕು ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2010 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(ii) ಇದು ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ನಿಯಮ 3ಕ್ಕೆ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ತಾಲ್ಲೂಕು ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) ನಿಯಮಗಳು-2005ರ (ಇದರಲ್ಲಿ ಇನ್ನು ಮುಂದೆ ಸದರಿ ನಿಯಮಗಳೆಂದು ಉಲ್ಲೇಖಿಸಲಾಗಿದೆ.) ನಿಯಮ 3ರ ಉಪ ನಿಯಮ (1)ರಲ್ಲಿರುವ ಕೋಷ್ಟಕ-1ರ ಬದಲಾಗಿ ಈ ಕೆಳಗಿನ ಕೋಷ್ಟಕವನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಅಂದರೆ:-

3. ನಿಯಮ 4ಕ್ಕೆ ತಿದ್ದುಪಡಿ - ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 4ನ್ನು ಹಾಗೂ ಟಿಪ್ಪಣಿ ಸೇರಿದಂತೆ ಕೋಷ್ಟಕ್-2ನ್ನು, ಬಿಟ್ಟು ಬಿಡತಕ್ಕದ್ದು. 4. ನಿಯಮ 5ಕ್ಕೆ ತಿದ್ದುಪಡಿ - ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 5ರ-,

(i) (ಅ) ಖಂಡದಲ್ಲಿ ``ಜಿಲ್ಲೆಯ ಒಟ್ಟು ಜನಸಂಖ್ಯೆಯ`` ಎಂಬ ಪದಗಳ ಬದಲಿಗೆ ``ರಾಜ್ಯದ ಒಟ್ಟು ಜನಸಂಖ್ಯೆಯ`` ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು..

(ii) (ಆ) ಖಂಡದಲ್ಲಿ ``ಜಿಲ್ಲೆಗಳಲ್ಲಿನ`` ಎಂಬ ಪದವನ್ನು ಬಿಟ್ಟು ಬಿಡತಕ್ಕದ್ದು

ಈಗ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅದಿನಿಯಮ 1993ರ (1993 ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ-14) ರ 311ನೇ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅದಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡಂತೆ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ.

ನಿಯಮಗಳು

1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಜಿಲ್ಲಾ ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2010 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇದು ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

Whereas the term of the office of the elected president and vice president of the City Municipal Council of Madikeri is expired on 23rd December 2010 and the scheduled date of election to the post of president and vice president was postponed and election to the post of President and Vice-President to the said Municipality is to be conducted in due course.

And whereas, having regard to the above circumstances, election to the office of president and vice president cannot be held and completed before the expiry of the term of office of president and vice president of Madikeri City Municipal Council and as such it has become necessary to appoint an administrator to the Madikeri City Municipal Council for the continued exercise of powers and performance or discharge of duties of functions conferred or imposed on it under the said act.

Now, therefore, in exercise of the powers conferred by the section 42(5) of the Karnataka Municipalities Act, 1964, (Karnataka Act 22 of 1964) the Government of Karnataka hereby appoints the Assistant Commissioner of Madikeri sub division, Madikeri, Kodagu district as the Administrator in respect of the Madikeri City Municipal Council from 23.12.2010 till the president and vice president of Madikeri City Municipal is duly elected.

ಆದುದರಿಂದ, ಕರ್ನಾಟಕ ಪಂಚಾಯತ್‌ರಾಜ್ (ಚುನಾವಣೆಗಳನ್ನು ನಡೆಸುವ) ನಿಯಮಗಳು 1993ರ 12ನೇ ನಿಯಮಕ್ಕನುಸಾರವಾಗಿ ಬೆಂಗಳೂರು ಗ್ರಾಮಾಂತರ ಜಿಲ್ಲೆಯ ಜಿಲ್ಲಾಧಿಕಾರಿಯಾದ ಆರ್.ಕೆ.ರಾಜು, ಐ.ಎ.ಎಸ್, ಎಂಬ ಹೆಸರಿನ ನಾನು ಸದರಿ ಚುನಾವಣೆಗೆ ಸಂಬಂಧಿಸಿದ ಈ ಕೆಳಕಾಣಿಸಿದ ಕಾರ್ಯಕ್ರಮ ವೇಳಾಪಟ್ಟಿಯನ್ನು ಈ ಮೂಲಕ ನಿಗದಿಪಡಿಸುತ್ತೇನೆ.

In exercise of the powers conferred by the proviso to the Article 229(1) and (2) of the Constitution of India and Rule 6 of the High Court of Karnataka Service (Conditions of Service and Recruitment)Rules, 1973, Hon'ble the Chief Justice with the previous approval of His Excellency the Governor of Karnataka makes the following amendments to the High Court of Karnataka Service (Conditions of Service and Recruitment) Rules, 1973 (hereinafter referred to as Principal Rules):-

1. Title and commencement:- These Rules may be called as the High Court of Karnataka Service(Conditions of Service and Recruitment)(I Amendment) Rules, 2010 and shall come into force with immediate effect.

2. Amendment to Schedule–II:- Schedule-II to the Principal Rules shall be amended as follows:-

The draft of the following rules which the Government of Karnataka proposes to make in exercise of the powers conferred by section 311 read with sub-section (3) of section 267 of the Karnataka Panchayat Raj Act, 1993 (Karnataka Act 14 of 1993) is hereby published as required by sub-section (1) of section 311 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the official Gazette.

And whereas, the said Gazette was made available to the public on 1st December 2010.

And whereas, no objections or suggestions have been received by the State Government in respect of the said draft.

Now, therefore, in exercise of the powers conferred by Section 311(1)of the Karnataka Panchayath Raj Act, 1993 (Karntaka Act 14 of 1993), the Government of Karnataka hereby makes the following rules, namely:-

RULES

1. Title and commencement:- (1) These rules may be called the Karnataka State Finance Commission (qualification for appointment of Chairman and Members) Rules,2010

(2) They shall come into force from the date of publication in the Official Gazette.

2. Qualification and manner of appointment – (1) The Governor, on the recommendation of the Government, shall appoint a person to be the Chairman or a member of the Finance Commission, who shall posses any one of the qualifications specified in sub-rule(2).

(2) The qualification for the appointment as Chairman or member of the Finance Commission shall be the following namely.:

(i) must have a special knowledge and wide experience in financial matters and in administration; or

(ii) Special knowledge of finance and accounts of the State Government and Local Bodies; or

(iii) Special knowledge of economics; or

(iv) Specialization and experience in panchayats or in Municipal affairs``

The draft of the following rules further to amend the Karnataka Co-operative Societies (Amendment) Rules, 2008 which the Government of Karnataka proposes to make in exercise of the powers conferred by Section 129 of the Karnataka Cooperative Societies Act, 1959 (Karnataka Act 11 of 1959) is hereby published as required by sub-section (1) of the said section for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the Official Gazette;

Any objection or suggestion which may be received by the State Government from any person in respect of the said draft before the expiry of the period specified above will be considered by the State Government. The objections or suggestions may be addressed to the Principal Secretary to Government, Co-operation Department, M.S. Building, Bengaluru-560001.

DRAFT RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Co-operative Societies (Amendment) Rules, 2010.

(2) They shall come into force on the date of their publication in the official Gazette.

2. Amendment of Rule 1.- In rule 1 of the Karnataka Co-operative Societies (Amendment) Rules, 2008 for sub-rule(2), the following shall be substituted, namely:- "(2) These rules shall be deemed to have come into force with effect from 17th day of July, 2008."

The extent of area notified as 50-00 acres in the Government Notification No. CI.102:MMM.2009, Dated: 26.10.2010, which has been published in the Gazette Extra-ordinary dated 28.10.2010, may be read as 31-00 acres.

The period to submit mining lease application has been extended by 30 days from the date of publication of this Corrigendum in the Official Gazette. If the last date for filing mining lease application happens to be a Public Holiday or General Holiday, applications will be received on the next working day.

The other conditions mentioned in Notification dated 26.10.2010 remains unchanged.

Whereas, the Commissioner, Hubli-Dharwad City Corporation had prepared a complete list of all the parks, play-fields and open spaces falling in the limits of the Hubli-Dharwad City Corporation, Hubli as detailed in Annexure and submitted for approval of the Government as required under sub-section (1) of section 3 of the Karnataka Parks, Play-fields and Open Spaces (Preservation and Regulation) Act, 1985 (Karnataka Act 16 of 1985).

2. Whereas the said draft list was published in Part IV-A No. 506 of the Karnataka Gazette (Extra-ordinary) dated 13/5/2010 as required by sub-section (2) of the said section for information of the persons likely to be affected thereby and notice was given that any representations or objections relating to the said list may be submitted to the Government on or before three months from the date of the Notification published in the Official Gazette.

3. Whereas Plans and the other documents was made available for inspection to the public during the office hours in the Office of the Commissioner Hubli-Dharwad City Corporation, Hubli.

4. And whereas, the said Gazette was made available to the public on 14th May, 2010.

5. And whereas no objections and suggestions were received in the stipulated time by the Government.

6. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Karnataka Parks, Play-fields and Open Spaces (Preservation and Regulation) Act, 1984 (Karnataka Act 16 of 1985) the Government of Karnataka hereby make the publication of the list of all the parks, play-fields and open spaces falling in the limits of the Hubli-Dharwad City Corporation, Hubli as detailed in Annexure.
