ಕಾರ್ಮಿಕರ (ಉದ್ಯೋಗದ ಕ್ರಮೀಕರಣ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ಕರ್ನಾಟಕ ನಿಯಮಗಳು, 2006 ರ ನಿಯಮ 50 ರಿಂದ 251 ಇವುಗಳನ್ನು ಕಾರ್ಮಿಕರ (ಉದ್ಯೋಗದ ಕ್ರಮೀಕರಣ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ಕರ್ನಾಟಕ ನಿಯಮಗಳು, 2006 ರ ನಿಯಮ 50 ರಿಂದ 251 ಇವುಗಳನ ಕಾರ್ಮಿಕರ (ಉದ್ಯೋಗದ ಕ್ರಮೀಕರಣ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ಕರ್ನಾಟಕ ನಿಯಮಗಳು, 2006 ರ ನಿಯಮ 50 ರಿಂದ 251 ಇವುಗಳನ ಓದಿಕೊಂಡಂತೆ ಮತ್ತು ಇವುಗಳ ಪ್ರಾವಧಾನಗಳಿಗೆ ಮಾತ್ರ ಸಂಬಂಧಿಸಿದಂತೆ, ಕಾರ್ಖಾನೆಗಳು, ಬಾಯ್ಲರುಗಳು, ಕೈಗಾರಿಕಾ ಸುರಕ್ಷತೆ ಮತ್ತು ಸ್ವಾಸ್ಥ್ಯ ಓದಿಕೊಂಡಂತೆ ಮತ್ತು ಇವುಗಳ ಪ್ರಾವಧಾನಗಳಿಗೆ ಮಾತ್ರ ಸಂಬಂಧಿಸಿದಂತೆ, ಕಾರ್ಖಾನೆಗಳು, ಬಾಯ್ಲರುಗಳು, ಕೈ ಓದಿಕೊಂಡಂತೆ ಮತ್ತು ಇವುಗಳ ಪ್ರಾವಧಾನಗಳಿಗೆ ಮಾತ್ರ ಸಂಬಂಧಿಸಿದಂತೆ, ಕಾರ್ಖಾನೆಗಳು, ಬಾಯ್ಲರುಗಳು, ಕೈ

ಇಲಾಖೆಯ ನಿರ್ದೇಶಕರನ್ನು ಕಟ್ಟಡ ಮತ್ತು ಇತರೆ ನಿರ್ಮಾಣ ಕಾಮಗಾರಿ ಅಥವಾ ಯೋಜನೆಗೆ ತಗಲುವ ಎಲ್ಲಾ ರೀತಿಯ ಅಂದಾಜು ವೆಚ್ಚ ಇಲಾಖೆಯ ನಿರ್ದೇಶಕರನ್ನು ಕಟ್ಟಡ ಮತ್ತು ಇತರೆ ನಿರ್ಮಾಣ ಕಾಮಗಾರಿ ಅಥವಾ ಯೋಜನೆಗೆ ತಗಲುವ ಎಲ್ಲಾ ರೀತಿಯ ಅಂದಾಜು ವೆಚ್ಚ ಇಲಾಖೆಯ ನಿರ್ದೇಶಕರನ್ನು ಕಟ್ಟಡ ಮತ್ತು ಇತರೆ ನಿರ್ಮಾಣ ಕಾಮಗಾರಿ ಅಥವಾ ಯೋಜನೆಗೆ ತಗಲುವ ಎಲ್ಲಾ ರೀತಿಯ ಅಂದಾಜು ವೆಚ್ಚ ಸೇರಿದಂತೆ `25ಕೋಟಿ ಮತ್ತು ಅದಕ್ಕೆ ಮೀರಿದ ಕಾಮಗಾರಿ ಅಥವಾ ಯೋಜನೆಗಳಿಗೆ

ಎಂದು ನೇಮಿಸಿದೆ. ಇವರ ಕಾರ್ಯ 25ಕೋಟಿ ಮತ್ತು ಅದಕ್ಕೆ ಮೀರಿದ ಕಾಮಗಾರಿ ಅಥವಾ ಯೋಜನೆಗಳಿಗೆ "ಮುಖ್ಯ ಪರಿವೀಕ್ಷಕರು" ಎಂದು ನೇಮಿಸಿದ

ವ್ಯಾಪ್ತಿಯು ಕರ್ನಾಟಕ ರಾಜ್ಯಾದ್ಯಂತ ಇರುತ್ತದೆ. ವ್ಯಾಪ್ತಿಯು ಕರ್ನಾಟಕ ರಾಜ್ಯಾದ್ಯಂತ ಇರುತ್ತದೆ.

No.100/CS-KT/1/2010 (1) :- WHEREAS, the seat of Shri. M.Rajasekara Murthy in the Council of States elected by the elected members of the Legislative Assembly of the State of Karnataka, has become vacant on 5th December, 2010 by the reason of his death, before the expiration of his term of office which was up to and including the 2nd April 2012; and

WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;

NOW, THEREFORE, in pursuance of section 147, sub-section (1) of section 39 and section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby –

(A) calls upon the elected members of the Legislative Assembly of the State of Karnataka to elect, before 5th March 2011 (Saturday) and in accordance with the provisions of the said Act and of the Rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Council of States :

(B) appoints, with respect to the said election;,

(a) the 21st February, 2011 (Monday), as the last date for making nominations;

(b) the 22nd February, 2011 (Tuesday), as the date for the scrutiny of the nominations;

(c) the 24th February, 2011 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 3rd March, 2011 (Thursday), as the date on which a poll shall, if necessary, be taken; and (e) the 5th March, 2011 (Saturday), as the date before which the election shall be completed; and (C) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.

ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವಾ ಅದಿನಿಯಮ 1978 (1990 ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ 14) ರ 8 ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಲಾದ, 3ನೇ ಪ್ರಕರಣದ (1) ನೇ ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅದಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು 1957 ನ್ನು ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವ ಈ ಮುಂದಿನ ನಿಯಮಗಳ ಕರಡನ್ನು, ಸದರಿ ಅದಿನಿಯಮದ 3 ನೇ ಪ್ರಕರಣದ (2) ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ, ಅದರಿಂದ ಬಾದಿತರಾಗಬಹುದಾದ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡನ್ನು ಅದು ಅದಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳ ತರುವಾಯ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ತಿಳಿಸಲಾಗಿದೆ.

ಸದರಿ ಕರಡು ನಿಯಮಗಳಿಗೆ ಸಂಬಂದಿಸಿದಂತೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಮೇಲೆ ನಿಗದಿಪಡಿಸಿದ ಅವದಿಯು ಮುಕ್ತಾಯವಾಗುವುದಕ್ಕೆ ಮೊದಲು ಯಾರೇ ವ್ಯಕ್ತಿಯಿಂದ ಸ್ವೀಕರಿಸಬಹುದಾದ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸಲಹೆಯನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿ, ಸಿಬ್ಬಂದಿ ಮತ್ತು ಆಡಳಿತ ಸುಧಾರಣೆ ಇಲಾಖೆ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು-560001 ಇವರಿಗೆ ಸಲ್ಲಿಸಬಹುದು.

ಕರಡು ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ

:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2011 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇವು ಅದಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಅನುಸೂಚಿ II ಕ್ಕೆ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು 1957 ರ ಅನುಸೂಚಿ II ರಲ್ಲಿ, ``ಅಬಿವೃದ್ಧಿ ಇಲಾಖೆ'' ಶೀರ್ಷಿಕೆಯಡಿ ``ಪ್ಲಾಟ್ ಯೋಜನಾದಿಕಾರಿ (ಕೈಗಾರಿಕೆಗಳು)'' ಉಪ ಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿನ ಗ್ರಾಮ ಪಂಚಾಯತ್ ಕಾರ್ಯದರ್ಶಿಗಳು ಮತ್ತು ಗ್ರಾಮೀಣಾಬಿವೃದ್ಧಿ ಸಹಾಯಕರು (ಶ್ರೇಣಿ-I) ಮತ್ತು (ಶ್ರೇಣಿ-II) ವೃಂದಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟ ನಮೂದುಗಳ ಬದಲಾಗಿ ಈ ಕೆಳಗಿನವುಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

The draft of the following rules further to amend the Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957, which the Government of Karnataka proposes to make in exercise of the powers conferred by sub- section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) is hereby published as required by clause (a) of sub-section (2) of section 3 of the said Act for the information of persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in Official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above will be considered by the State Government. Objections and suggestions may be addressed to the Secretary to Government, Department of Personnel and Administrative Reforms, Vidhana Soudha, Bangalore-560 001.

DRAFT RULES

The draft of the following rules further to amend the Karnataka Municipal Corporations (Election) Rules, 1979, which the Government of Karnataka proposes to make in exercise of the powers conferred by section 421 of the Karnataka Municipal Corporation Act, 1976 (Karnataka Act 14 of 1977), is hereby published as required by sub- section (1) of section 421 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the Official Gazette;

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Secretary to Government, Urban Development Department, Vikasa Soudha, Bangalore – 560 001.

DRAFT RULES

1. Title and commencement and application.- (1) These rules may be called the Karnataka Municipal Corporations (Election) (Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of rule 71.- In the Karnataka Municipal Corporations (Election) Rules, 1979, in rule 71, for the words " election of Mayor and Deputy Mayor " the words "election of Mayor, Deputy Mayor and members of the Standing Committees " shall be substituted.

Whereas the draft rules further to amend the Karnataka Municipalities (Election of Councillors) Rules, 1977 which the Government of Karnataka proposes to make, in exercise of the powers conferred by sections 38 and read with section 323 of the Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964), was published as required by sub-section (1) of section 323 of the said Act vide Notification No. UDD 122 MLR 2010, dated 24th September 2010 in part-IVA, No. 1010 of the Karnataka Extraordinary Gazetted dated 25th September 2010 inviting objections and suggestions from all persons likely to be affected within fifteen days from the date of publication of the said notification in the Official Gazette.

And whereas the said gazette was made available to the public on 25th September, 2010.

And whereas no objections and suggestions were received within the stipulated period.

Now, therefore, in exercise of the powers conferred by sections 38 and read with section 323 of the Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964), the Governor of Karnataka hereby makes the following rules namely

RULES

1. Title and Commencement.- (1) These rules may be called the Karnataka Municipalities (Election of Councillors) (Amendment) Rules, 2010.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Insertion of new rules 22A, 22B, 22C, and 22D,- In the Municipalities (Election of Councillors) Rules, 1977 (hereinafter referred to as the said rules) after rule 22, the following shall be inserted, namely:-

"22A.Particulars of account of election expenses under section 16A.- (1) The candidate or his election agent shall maintain the account of election expenses under section 16A in Form 11A, which shall ordinarily contain the following particulars in respect of each item of expenditure on day to day basis, namely:-

(a) date on which the expenditure was incurred or authorised;

(b) the nature of expenditure (as for example, traveling, postage or printing and the like);

(c) the amount of the expenditure with break up of,-

(i) the amount paid;

(ii) the amount outstanding; and

(iii) date of payment;

(d) the name and address of the payee;

(e) the serial number of vouchers, in case of amount paid;

(f) the serial number of bills, if any, in case of amount outstanding;

(g) the name and address of the person to whom the amount outstanding is payable.

(2) A voucher shall be obtained for every item of expenditure unless from the nature of the case, such as postage, travel by rail and the like, it is not practicable to obtain a voucher.

(3) All vouchers shall be lodged along with the account of election expenses, arranged according to the date of payment and serially numbered by the candidate or his election agent and such serial numbers shall be entered in the account under item (e) of sub rule (1).

(4) It shall not be necessary to give particulars mentioned in item (e) of sub-rule (1) in regard to items of expenditure for which vouchers have not been obtained under sub-rule (2).

(5) Every Candidate shall make a declaration in Form 11B, while lodging his Statement of expenditure before the Returning officer and the Returning officer shall acknowledge the same in Form 11C.

22B. Notice by Returning officers.- The Returning officer, shall within two days from the date on which the account of elections has been lodged by a candidate under section 16-B of the Act, cause a notice to be affixed on the notice board of the office, specifying,-

(a) the date on which the account has been lodged;

(b) the name of candidate; and

(c) the time and place at which such account can be inspected.

22C. Report by the returning officer as to the lodging of the account of election expenses and the decision

of the State Election Commission thereon.- (1) As soon as may be after the expiration of the time specified in section 16-B of the Act for lodging of the accounts of election expenses at any election, the returning officer shall report to the Election Commission,-

(a) the name of each contesting candidate;

(b) whether such candidate has lodged his account of election expenses and if so, the date on which such account has been lodged; and

(c) whether in his opinion such account has been lodged within the time and in the manner required by the Act and these rules.

(2) Where the returning officer is of the opinion, that the account of election expenses of any candidate has not been lodged in the manner required by the Act under these rules, he shall with every such report forward to the State Election Commission the account of election expenses of that candidate and the vouchers lodged along with it.

(3) Immediately after the submission of the report referred to in sub-rule (2), the Returning officer shall publish a copy thereof by affixing the same on the notice board.

(4) As soon as may be after the receipt of the report referred to in sub-rule (2), the State Election Commission shall consider the same and decide whether any contesting candidate has failed to lodge the account of election expenses within the time and in the manner required by the Act and these rules.

(5) Where the State Election Commission decides that a contesting candidate has failed to lodge his account of expenses within the time and in the manner required by the Act under these rules, it shall by notice in writing call upon the candidate to show cause why he should not be disqualified under section 16C of the Act for such failure.

(6) Any contesting candidate who has been called upon to show cause under sub-rule (5) may within twenty days of the receipt of such notice submit in respect of the matter, a representation in writing to the State Election Commission, and shall at the same time send to the returning officer a copy of his representation together with a complete account of his election expenses if he had not already furnished such an account.

(7) The Returning officer shall, within five days of the receipt thereof, forward to the State Election Commission a copy of the representation and the account (if any) with such comments as he deems fit, to make thereon.

22D. Maximum limit of election expenses under section 16A.- (1) The maximum limit of the expenditure that may be incurred by each candidate or his election agent, in connection with the election, shall not exceed,- (a) in respect of City Municipal Councils rupees 2.00 lakhs:

(b) in respect of Town Municipal Councils rupees 1.50 lakhs; and

(c) in respect of Town Panchayaths rupees 1.00 lakhs"

3. Insertion of new Forms 11A, 11B and 11C.- In the said rules, after Form 11, the following new Forms shall be inserted, namely:-

DETAILS OF DAILY EXPENSES

Instructions:

(1) This register should be entered every day and the same should be produced to any officer for inspection authorised by the State Election Commission at any time.

(2) Extract of entries of these registers after the election should be submitted along with an affidavit to the returning officer within thirty days from the date of announcement of the result.

(3) Vouchers should be prescribed under sub rule (2), (3) and (4) of Rule 16B shall be produced without fail.

(4) Details of expenses shall be signed by the candidate himself/herself.

(5) It is not necessary to include the details of travel expenses made by the leaders of political parties campaigning for the candidate as the same cannot be construed as expenditure of the candidate.

(6) Apart from details of expenditure incurred by the candidate himself or herself or by his or her election agent, the details of expenditure by any individual/society/organisation for the election of the candidate shall be provided in the register.

The draft of the following rules further to amend the Karnataka Municipal Corporations Rules, 1977, which the Government of Karnataka proposes to make in exercise of the powers conferred by Section 421 read with Section 91 of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977), is hereby published as required by sub-section (1) of Section 421 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft, before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Additional Chief Secretary to Government, Urban Development Department, 4th Floor, Vikasa Soudha, Dr.B.R. Ambedkar Veedhi, Bangalore – 560 001.

DRAFT RULES

1. Title and commencement:- (1) These rules may be called the Karnataka Municipal Corporations (Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of rule 6.- In rule 6 of the Karnataka Municipal Corporations Rules 1977 (hereinafter referred to as the said rules), in sub rule (1).-

(i) in clause (i) for the words and figures "not exceed 300 lakhs" the words and figures "not exceed 50 lakhs", shall be substituted.

(ii) in clause (ii) for the words and figures "Rupees 300 lakhs, but not exceed Rupees 400 lakhs" the words and figures "exceeding Rupees 50 lakhs, but not exceeding Rupees 200 lakhs," shall be substituted.

(iii) In clause (iii) for the words and figures "Rupees 400 lakhs but does not exceed Rupees 500 lakhs" the words and figures "exceeding to Rupees 200 lakhs but not exceeding Rupees 500 lakhs" shall be substituted.

3. Amendment of rule 6A.- In the said rules, in rule 6A, in sub rule (1), in clause (iii),-

(a) for the words and figures "rupees 400 lakhs" the words and figures "rupees 250 lakhs" shall be substituted;

and

(b) in the proviso, for the words and figures "rupees 300 lakhs", the words and figures "rupees 60 lakhs" shall be substituted.

Whereas the Mysore State Transport Undertaking (now Karnataka State Road Transport Corporation) published various schemes in the Mysore Gazette under Clause (c) of section 68 of the Motor Vehicles Act, 1939 and752 after considering the said schemes, the State Government published the schemes approved under section 68-D(2) of the said Act in the following Notifications, namely:-

(1) No. HTD/III/TMP/59, dated: 11.07.1959 relating to Dharwad, North Canara – District and part of Belgaum and Bijapur District (known as Hubli – Dharwad Schemes)

(2) No. HD/17/TMP/59, dated: 22.12.1959 relating to Hassan District and also portions of other neighbouring district in so far as only the inter district routes thereto are concerned (known as Hassan Scheme)

(3) No. HD/56/TMP/59, dated: 19.01.1960 relating to Belgaum District and also part of North Canara Dharwad and Bijapur Districts (known as Belgaum Scheme)

(4) No. HD/26/TMP/59, dated: 18.02.1960 relating to Bijapur District and also part of Belgaum, Dharwad, Raichur and Gulbarga Districts (known as Bijapur Scheme)

(5) No. HD/57/TMP/59, dated: 18.02.1960 relating to Bidar, Gulbarga and Raichur Districts and also part of Bellary and Bijapur Districts (known as Gulbarga Scheme)

(8) No. HD/200/TMP/59, dated: 17.11.1960 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Mysore Scheme)

(9) No. HD/22/TMP/64, dated: 18.04.1964 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as BellaryScheme)

(10) No. HD/44/TMP/64, dated: 30.04.1964 relating to Gulbarga to Sedam via Jagat, Kalnoor Cross, Saragati Cross, Madbul Village, Mupta Gundgurthi, Malkhed and Neelahalli and back (known as Gulbarga - Sedam Scheme)

(11) No. HD/43/TMP/64, dated: 02.07.1964 relating to Yadgir to Naryanapet via : Ramasamudram, Gunjanur Jalalpur and back (known as Narayanpet Scheme)

(12) No. HD/63 (2)/TMP/64, dated: 18.03.1967 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Mangalore Scheme)

(13) No. HD/71 (2)/TMP/64, dated: 18.03.1967 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Shimoga Scheme)

(14) No. HD/56/TMP/64, dated: 19.01.1960 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Kolar Scheme)

(15) No. FTD/161/TMI/82, dated: 06.11.1985 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Gulbarga Bidar Scheme)

(16) No. FTD/57/TMI/85, dated: 23.09.1987 relating to the routes in relation to which the scheme is approved is the route Chitradurga to Davangere via: Guttinadu, Katralu, Sireigere Cross, Bharamasagaram Anagodu and back (on NH-4 Road) (known as Chitradurga Scheme)

(17) No. FTD/140/TMI/82, dated: 03.11.1987 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended) (known as Raichur Scheme)

And whereas, the aforesaid approved schemes provided for operation of services by the State road Transport Corporation only on the routes or the areas, as the case may be indicated in the respective scheme.

And whereas, considering the need of traveling public, the Government of Karnataka amended certain schemes either by way of modification of the original scheme or by way of insertion or by way of issuing corrigendum through the notifications mentioned here below from time to time in accordance with the provisions contained in sub- section (3) of section 68-D of the Motor Vehicles Act, 1939 or sub-section (1) of section 102 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) as the case may be, namely:-

(1) Notification No. HD/III/TMP/59 dated 11.07.1950 relating to Dharwad, North Canara District and part of Belgaum and Bijapur Districts (known as Hubli-Dharwad Districts) was modified vide Notification No. FD/107/TMA/91, dated 13.07.1992 and HTD/243/TMA/99, dated 14.06.2001.

(2) Notification No.HD/172(2)/TMP/60 dated 07-06-1960 relating to portions of Bangalore, Kolar, Tumkur, Mysore, Mandya, Chitradurga, Hassan, Coorg, South Canara, Bellary and Chickmangalore District, where the routes as in statement appended are operated by the Mysore Government Road Transport Department (known as Bangalore scheme) was modified vide Notification No.HTD/60/TMA/95 dated 17-01-1996.

(3) Notification No.HD/200/TMP/60 dated 17-11-1960 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Mysore Scheme) was modified vide Notification No.HD/07/TMI/86 dated : 28-11-1987.

(4) Notification No.HD/22/TMP/64 dated 18-04-1964 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Bellary Scheme) was modified vide Notification No.HD/15/TMI/76 dated 10-01-1980 and No.HTD/122/ TMA/97 dated 31-03-2000.

(5) Notification No.HD/63(2)/TMP/64 dated 18-03-1967 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Mangalore Scheme) was modified vide Notification No.HTD/113/TMA/94 dated 27-02-1997.

(6) Notification No.HD/70(2)/TMP/64 dated 10-01-1967 relating to the routes in relation to which the scheme is approved are as indicated in the statement appended (known as Kolar Scheme) was modified vide Notification No.HD/45/TMI/76 dated 10-01-1980.

Whereas, in Notification No.HTD/134/TMA/2003 dated 30-12-2003 published in the Karnataka Gazette part IV-A Extra-ordinary No.1732 dated 31-12-2003 a provision is made for "notwithstanding anything contained in the above schemes, the private operators are allowed to operate their services as city services as per the conditions of the permit granted by the respective Transport Authorities up to radius 20 kms from the city of the Revenue District Head quarters excluding Bangalore City";

Whereas, the state Government have withdrawn the said scheme vide Notification No.TRD/247/SAEPA/2004 dated 01-06-2006 by way of the following modification, namely,-

"Notwithstanding anything contained in the above schemes, the private operators are allowed to operate their services as city services as per the conditions of the permit granted by the respective Transport Authorities up to radius of 20 kms from the City of the Revenue District Head quarters excluding Bangalore City published in Notification No.HTD/134/TMA/2003 dated 31-12-203 in Karnataka Gazette Extraordinary Part- IVA No 1732 dated 31-12-2003 is hereby withdrawn. However, the permits and the number of trips already granted and issued as per the said notification are saved".

Whereas, the Government has noticed the wordings of the Notification No.HTD/134/TMA/2003 dated 31-12- 2003 and the Notification No. TRD 247 SAEPA 2004 dated 01-06-2006 and taking note of proceeding No. TRD 247 SAEPA 2004 dated 15-05-2005 when the objections and suggestions considered, to clarify the same and keeping in view of the interest of the traveling public, the Government has decided to further modify Notification No. HTD 134 TMA 2003 dated 31-12-2003 and the Notification No. TRD 247 SAEPA 2004 dated 01-06-2006.

Therefore, in exercise of the powers conferred by sub-section (1) of section 102 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) the state Government having considered it necessary in the public interest so to do intend to modify the above approved schemes and the proposed modification is hereby published as required by sub-section (2) of the said section for information of the State Transport Undertaking and any other person who is likely to be affected by the proposed modification inviting objections and suggestions in respect of the proposed modification on or before 28th March 2011.

Objections or suggestions received by the State Government on or before the date specified above, will be considered by the Principal Secretary to Government, Transport department at 11.00 a.m on 5th April 2011 in room No 230, 2nd Floor, M.S. Building, Dr. Ambedkar Veedhi, Bangalore-560 001. Objections and suggestions may be addressed to the Principal Secretary to Government, Transport department, M.S.Building, Bangalore-560001.

DRAFT MODIFICATION TO THE APPROVED SCHEMES MENTIONED ABOVE

In view of the circumstances stated above, the Government of Karnataka hereby makes the following modification to Notification No. TRD 247 SAEPA 2004 dated 01-06-2006 published in the Karnataka Gazette Extraordinary, Part IV A, No. 606 dated 01-06-2006, namely,-

In the said notification the following shall be and shall be deemed to have been substituted, namely,- "Notwithstanding anything contained in the above schemes, the private operators are allowed to operate their services as city services as per the conditions of the permit granted by the respective Transport Authorities up to the radius of 20 kms from the city of the Revenue District Head quarters excluding Bangalore City published in Notification No. HTD 134 TMA 2003 in Karnataka Gazette Extraordinary Part-IVA No 1732 Dated 31-12-2003 and the Notification No.TRD 247 SAEPA 2004 published in Karnataka Gazette Extraordinary Part-IV A, No 606 dated 01-06-2006 are hereby modified for barring the grant of fresh permits. However, the permits already granted and issued as per the Notification No. HTD 134 TMA 2003 dated 31-12-2003 are saved with periodical renewals from time to time".

The draft of the following rules further to amend the Karnataka Value Added Tax Rules, 2005 which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of section 88 of the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004) is hereby published as required by the said sub- section for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the Official Gazette.

Any objection or suggestion, which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections or suggestions may be addressed to the Principal Secretary to Government, Finance Department, Vidhana Soudha, Bangalore - 560 001.

DRAFT RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Value Added Tax (Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of rule 130.- In the Karnataka Value Added Tax Rules, 2005 in rule 130, in sub-rule (1), in the proviso, for the words "the Head of Mission or Post of British High Commission" the words "the Head of Mission or post other than those purchased in respect of receptions hosted by the British High Commission and Deputy High Commission in India" shall be substituted.

ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ (ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ನಿಯಮಗಳು 2003ನ್ನು ಇನ್ನಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವ ಈ ಮುಂದಿನ ನಿಯಮಗಳ ಕರಡನ್ನು, ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯದ ವಿಶೇಷ ಮಂಡಳಿಯು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ ಸಂ:14)ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಲಾದ 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣದಿಂದ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ ರಚಿಸಲು ಉದ್ದೇಶಿಸಿದ್ದು, ಇದರಿಂದ ಬಾಧಿತರಾಗಬಹುದಾದ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ, ಸದರಿ ಅಧಿನಿಯಮದ ಸದರಿ 3ನೇ ಪ್ರಕರಣದ (2)ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದಲ್ಲಿ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಇವು ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಣೆಯಾದ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳ ತರುವಾಯ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ನೋಟೀಸು ನೀಡಲಾಗಿದೆ.

ಮೇಲೆ ಸೂಚಿಸಲಾದ ಅವಧಿಯು ಮುಕ್ತಾಯವಾಗುವುದಕ್ಕೆ ಮೊದಲು ಸದರಿ ಕರಡು ಸಂಬಂಧದಲ್ಲಿ ಯಾರೇ ವ್ಯಕ್ತಿಯಿಂದ ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯವು ಸ್ವೀಕರಿಸಬಹುದಾದಂತಹ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ ಅಥವಾ ಸಲಹೆಯನ್ನು ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯದ ವಿಶೇಷ ಮಂಡಳಿಯು ಪರಿಗಣಿಸುತ್ತದೆ. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಕಾರ್ಯದರ್ಶಿ, ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು-560001 ಇವರಿಗೆ ಕಳುಹಿಸಬಹುದು.

ಕರಡು ನಿಯಮಗಳು

01. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ

:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ (ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) (ನಾಲ್ಕನೇ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2010 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು, (2) ಇವು ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

02. 06ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ (ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ನಿಯಮಗಳು, 2003ರ (ಇನ್ನುಮುಂದೆ ಸದರಿ ನಿಯಮಗಳು ಎಂದು ಉಲ್ಲೇಖಿಸಲಾಗಿದೆ) 06ನೇ ನಿಯಮದಲ್ಲಿ, ಖಂಡ (iv) ಮತ್ತು (v)ಕ್ಕೆ ಪ್ರತಿಯಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(iv) ಕಾರ್ಯದರ್ಶಿಯು, ವಿಧಾನ ಪರಿಷತ್ತಿನ ಅಧಿವೇಶನದ ಸಂದರ್ಭದಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಣೆಗೆ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸದಸ್ಯರುಗಳಿಗೆ ಸಚಿವಾಲಯದ ನೆರವನ್ನು ಒದಗಿಸಲು ಬೇಸಿಕ್ ಕಂಪ್ಯೂಟರ್ ಡಿಪ್ಲಮೊ ಇರುವ ಹಾಗೂ ಈ ನಿಯಮಗಳ ಮೇರೆಗೆ ಶೀಘ್ರಲಿಪಿಗಾರರ ನೇಮಕಾತಿಗೆ ವಿದ್ಯಾರ್ಹತೆ ಹೊಂದಿರುವ ಮೂರು ತಾತ್ಕಾಲಿಕ ಶೀಘ್ರಲಿಪಿಗಾರರು, ಮೂರು ತಾತ್ಕಾಲಿಕ ಬೆರಳಚ್ಚುಗಾರರು ಮತ್ತು ಎರಡು ಸೈಕಲ್ ಪರಿಚಾರಕರನ್ನು ನೇಮಕ ಮಾಡಬಹುದು. ಇವರನ್ನು ಅಧಿವೇಶನವು ಪ್ರಾರಂಭವಾಗುವ 15 ದಿನಗಳಿಗೆ ಮೊದಲು ಕೆಲಸಕ್ಕೆ ನೇಮಕ ಮಾಡಿಕೊಳ್ಳಬಹುದು ಹಾಗೂ ಸದರಿ ಅಧಿವೇಶನವು ಮುಕ್ತಾಯಗೊಂಡ ಎರಡು ದಿನಗಳ ತರುವಾಯ ಸಂಚಿತ ವೇತನದೊಂದಿಗೆ ಇವರ ಸೇವೆಗಳನ್ನು ಮುಕ್ತಾಯಗೊಳಿಸತಕ್ಕದ್ದು.

(v) ಕಾರ್ಯದರ್ಶಿಯು, ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸದಸ್ಯರ ಕೆಲಸ-ಕಾರ್ಯಗಳನ್ನು ನೋಡಿಕೊಳ್ಳಲು ಆರು ತಾತ್ಕಾಲಿಕ ದಲಾಯಿತರನ್ನು ಅಧಿವೇಶನವು ಪ್ರಾರಂಭವಾಗುವ ಎರಡು ದಿನಗಳ ಮೊದಲು ಹಾಗೂ ಅಧಿವೇಶನ ಮುಕ್ತಾಯವಾದ ಎರಡು ದಿನಗಳ ನಂತರ ಸಂಚಿತ ವೇತನದೊಂದಿಗೆ ನೇಮಕ ಮಾಡಿಕೊಳ್ಳಬಹುದು.

03. 9ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- 9ನೇ ನಿಯಮದಲ್ಲಿ (ಜೆ) ಖಂಡಕ್ಕೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು:- "ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವೆಗಳ (ಕಾರ್ಯನಿರ್ವಹಣಾ ವರದಿ) ನಿಯಮಗಳು 2000" 04. 1ನೇ ಅನುಸೂಚಿಯ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ 1ನೇ ಅನುಸೂಚಿಯಲ್ಲಿ ಕ್ರಮ ಸಂಖ್ಯೆ: 08ರ ತರುವಾಯ ಈ ಮುಂದಿನದನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

ಸದರಿ ನಿಯಮಗಳ 1ನೇ ಅನುಸೂಚಿಯಲ್ಲಿ ಕ್ರಮ ಸಂಖ್ಯೆ: 12, 14, 17, 18 ಮತ್ತು 26ರ ತರುವಾಯ ಕ್ರಮವಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು:-

ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳ ನಿಯಮಗಳು, 2008ರ ಅನುಸೂಚಿ-1ರ ಕ್ರಮಸಂಖ್ಯೆ: 18ರಲ್ಲಿ, ಶೀಘ್ರಲಿಪಿಗಾರ ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಅಂಕಣ (vi)ರಲ್ಲಿ ಅದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟಂತೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು.

ನೇರ ನೇಮಕಾತಿಗಾಗಿ:-

ಎ) ಎಸ್.ಎಸ್.ಎಲ್.ಸಿ., ಅಥವಾ ತತ್ಸಮಾನ ಪರೀಕ್ಷೆಯಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿರಬೇಕು.

ಬಿ) ಕೆ.ಎಸ್.ಇ.ಇ.ಬಿ.ಯು ನಡೆಸುವ ಇಂಗ್ಲೀಷ್ ಮತ್ತು ಕನ್ನಡ ಎರಡರಲ್ಲೂ ಹಿರಿಯ ಶ್ರೇಣಿ ಬೆರಳಚ್ಚು ಮತ್ತು ಹಿರಿಯ ಶ್ರೇಣಿ ಶೀಘ್ರಲಿಪಿ ಅಥವಾ ತತ್ಸಮಾನ ಪರೀಕ್ಷೆಯಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿರಬೇಕು ಮತ್ತು ಬಡ್ತಿಗಾಗಿ:-

ಎ) ಎಸ್.ಎಸ್.ಎಲ್.ಸಿ., ಅಥವಾ ತತ್ಸಮಾನ ಪರೀಕ್ಷೆಯಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿರಬೇಕು

ಬಿ) ಕೆ.ಎಸ್.ಇ.ಇ.ಬಿ.ಯು ನಡೆಸುವ ಇಂಗ್ಲೀಷ್ ಭಾಷೆಯಲ್ಲಾಗಲಿ ಅಥವಾ ಕನ್ನಡ ಭಾಷೆಯಲ್ಲಾಗಲಿ ಹಿರಿಯ ಶ್ರೇಣಿ ಶೀಘ್ರಲಿಪಿ ಅಥವಾ ತತ್ಸಮಾನ ಪರೀಕ್ಷೆಯಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿರಬೇಕು.

ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳ ನಿಯಮಗಳು, 2003ರ ಅನುಸೂಚಿ-1ರ ಕ್ರಮಸಂಖ್ಯೆ: 19ರಲ್ಲಿ ಕಿರಿಯ ಸಹಾಯಕ ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಅಂಕಣ ಸಂಖ್ಯೆ: (v) ಮತ್ತು (vi)ರಲ್ಲಿ ಅದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟಂತೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು:-

ಅಂಕಣ (v)ಕ್ಕೆ:-

ಎ) ನೇರ ನೇಮಕಾತಿಯ ಮೂಲಕ ಶೇಕಡ 50.

ಬಿ) ಸಮೂಹ "ಡಿ" ನೌಕರರ ವೃಂದದಿಂದ ಬಡ್ತಿ ಮೂಲಕ ಶೇಕಡ 50.

ಅಂಕಣ (vi)ರ ನೇರ ನೇಮಕಾತಿಗಾಗಿ:-

ಎ) ಮೂಲ ಕಂಪ್ಯೂಟರ್ ಜ್ಞಾನದೊಂದಿಗೆ ಅಧಿಕೃತ ವಿಶ್ವವಿದ್ಯಾನಿಲಯದಿಂದ ಪದವಿ ಪಡೆದಿರಬೇಕು.

ಬಡ್ತಿಗಾಗಿ:-

ಎ) ಸಮೂಹ "ಡಿ" ವೃಂದದಲ್ಲಿ 03 ವರ್ಷಗಳಿಗೆ ಕಡಿಮೆಯಿಲ್ಲದಂತೆ ಸೇವೆ ಸಲ್ಲಿಸಿರಬೇಕು. ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳ ನಿಯಮಗಳು 2003ರ ಅನುಸೂಚಿ-1ರ ಕ್ರಮ ಸಂಖ್ಯೆ: 21ರ ಅಂಕಣ (iv)ರಲ್ಲಿ, ಹಿರಿಯ ವಾಹನ ಚಾಲಕರ ಹುದ್ದೆ ಸಂಬಂಧದಲ್ಲಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು:- "7"

ಕರ್ನಾಟಕ ವಿಧಾನ ಪರಿಷತ್ತಿನ ಸಚಿವಾಲಯ ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳ ನಿಯಮಗಳು, 2003ರ ಅನುಸೂಚಿ-1ರಲ್ಲಿ ಕ್ರಮ ಸಂಖ್ಯೆ: 26ರಲ್ಲಿ ದಲಾಯತ್/ಕಾವಲುಗಾರ/ಸೈಕಲ್ ಪರಿಚಾರಕ/ಕ್ಲೀನರ್ ಹುದ್ದೆಗೆ ಪ್ರವರ್ಗ ಮತ್ತು ಅಂಕಣ (vi)ರಲ್ಲಿ ಅದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟಂತೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು:- "7ನೇ ತರಗತಿಯಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿರಬೇಕು"

The draft of the following rules further to amend the Karnataka Legislative Council Secretariat (Recruitment and Conditions of Service) Rules, 2003, which the Special Board of Karnataka Legislative Council Secretariat proposes to make in exercise of the powers conferred by Sub-section (1) of Section 3 read with Section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act No. 14 of 1990) is here by published as required by clause (a) of sub-section (2) of the said section 3 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after Fifteen days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received by Karnataka Legislative Council Secretariat from any person with respect to the said draft before the expiry of the period specified above will be considered by the Special Board of the Karnataka Legislative Council Secretariat. Objections and Suggestions may be addressed to the Secretary, Karnataka Legislative Council Secretariat, Vidhana Soudha, Bangalore – 560 001.

Draft Rules

1. Title and Commencement: (1) These rules may be called the Karnataka Legislative Council Secretariat (Recruitments and Conditions of Service)(Fourth)(Amendment) Rules, 2010.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule- 6:- In rule 6 of the Karnataka Legislative Council Secretariat (Recruitments and Conditions of service) Rules 2003, (herein after referred to as the said rules), for clause (iv) and (v) following shall be substituted namely:-

(iv) The Secretary may appoint three Temporary Stenographers having the qualification for appointment of Stenographers under these rules along with Diploma in Basic Computers to provide Secretariat Assistance to the Members of Legislative Council, three temporary Typists & Two Cycle orderly to work during the Sessions of the Legislative Council. They could be appointed to work fifteen days before the date of commencement of the Session and their services shall be terminated two days after the closure of the said Session, with consolidated pay.

(v) The Secretary may appoint Six Temporary Dalayats during the Session two days before the commencement and two days after the closure of the said session, with consolidated pay, to attend to the works of Members of Legislative Council"

3. Amendment of Rule – 9:- In rule 9 for clause (j) the following shall be substituted: "The Karnataka Civil Services (Performance Report) Rules 2000".

4. Amendment of Schedule-1: In Schedule 1 of the said rules after serial number 8 the following shall be inserted namely:-

Serial No.18 and the entries relating there to at column No. (vi) the following shall be substituted:

FOR DIRECT RECRUITMENT:-

(a) Must have passed SSLC or equivalent examination.

(b) Must have passed Senior grade Typewriting and Senior grade Shorthand Examination both in English and Kannada conducted by KSEEB or equivalent examination.

FOR PROMOTION:-

(a) Must have passed SSLC or equivalent examination

(b) Must have passed Senior Grade Shorthand either in Kannada or English Language conducted by K.S.E.E.B. or equivalent examination.

In schedule-1 to the Karnataka Legislative Council Secretariat Recruitment and Conditions of service Rules 2003 in respect of the category of the post of JUNIOR ASSISTANT at Serial No. 19 and the entries relating there to at column No. (v) and (vi) the following shall be substituted:-

For Column No. (v) (a) 50% by Direct Recruitment: (b) 50% by Promotion from the cadre of group 'D' officials.

For Column No. (vi) Direct Recruitment;-

(a) Must be holder of a degree from a recognised University with basic knowledge of Computer.

For Promotion:-

(a) Must have put in a service not less than 3 years in the cadre of group 'D'

In schedule-1 to the Karnataka Legislative Council Secretariat Recruitment and Conditions of service Rules 2003 in respect of the category of the post of SENIOR DRIVER at Serial No. 21 in column No. (iv) the following shall be substituted:- "7".

In schedule-1 to the Karnataka Legislative Council Secretariat Recruitment and Conditions of service Rules 2003 in respect of the category of the post of DALAYAT/WATCHMAN/CYCLE ORDERLY/CLEANER at Serial No. 26 and the entries relating there to at column No. (vi) the following shall be substituted: "Must have passed 7th Standard".

ಇದರಡಿ ಅನುಸೂಚಿಯಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಭೂಮಿಗಳು ಸಾರ್ವಜನಿಕ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಂದರೆ ರೈಲ್ವೆ ಇಲಾಖೆಗೆ ಅಂದರೆ ಬೆಂಗಳೂರು - ಹಾಸನ ಹೊಸ ರೈಲ್ವೆ ಮಾರ್ಗ ನಿರ್ಮಾಣ ಮಾಡುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಗತ್ಯವೆಂದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಕಂಡು ಬಂದಿರುವುದರಿಂದ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ 33 ರ ಮೂಲಕ ತಿದ್ದುಪಡಿಯಾದ ಭೂ ಸ್ವಾಧೀನ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ 1894ರ (ಕೇಂದ್ರ ಅಧಿನಿಯಮ 1894(1)ರ ಅನ್ವಯ) 1ನೇ ಪ್ರಕರಣದ ಮೇರೆಗೆ ಮೇಲೆ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸದರಿ ಜಮೀನುಗಳು ಅಗತ್ಯವಾಗಿ ಬೇಕಾಗಿದೆ ಎಂದು ಈ ಮೂಲಕ ಅನುಸೂಚಿಸಲಾಗಿದೆ. ಹಾಗೂ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಸದರಿ ಅಧಿನಿಯಮದ 4 ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಕಾರ್ಯಗಳನ್ನು ನಿರ್ವಹಿಸಲು ವಿಶೇಷ ಭೂ ಸ್ವಾಧೀನಾಧಿಕಾರಿ, ಪೋಡಿಯಂ ಬ್ಲಾಕ್, 3ನೇ ಮಹಡಿ, ವಿಶ್ವೇಶ್ವರಯ್ಯ ಕೇಂದ್ರ, ಬೆಂಗಳೂರು ಇವರನ್ನು ಅಧಿಕೃತಗೊಳಿಸಲಾಗಿದೆ.

ಸದರಿ ಅಧಿನಿಯಮದ 17ನೇ ಪ್ರಕರಣದ (4) ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಪ್ರಕರಣದ ತುರ್ತಿನ ದೃಷ್ಟಿಯಿಂದ ಅಧಿನಿಯಮದ 5-(ಎ) ಕೆಳಗೆ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಜಮೀನುಗಳು ಭೂ ಸ್ವಾಧೀನಕ್ಕೆ ಅನ್ವಯವಾಗತಕ್ಕದ್ದಲ್ಲವೆಂಬುದಾಗಿ ನಿರ್ದೇಶಿಸಿದೆ.

ಸದರಿ ಭೂ ಸ್ವಾಧೀನ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸದರಿ ಜಮೀನುಗಳು ಮೇಲೆ ನಿಯೋಜಿಸಲಾದ ಯಾವೊಬ್ಬ ಮೋಜಿಣಿದಾರರು ಇತರೆ ಅಧಿಕಾರಿಗಳಿಗೆ ಅಡ್ಡಿಯನ್ನುಂಟು ಮಾಡಬಾರದೆಂದು ಸದರಿ ಜಮೀನುಗಳ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೆ ಈ ಮೂಲಕ ಎಚ್ಚರಿಕೆ ನೀಡಲಾಗಿದೆ. ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟವಾದ ದಿನಾಂಕದ ನಂತರ ಜಿಲ್ಲಾಧಿಕಾರಿ, ಬೆಂಗಳೂರು ಗ್ರಾಮಾಂತರ ಜಿಲ್ಲೆ ರವರ ಅನುಮೋದನೆ ಇಲ್ಲದೆ ಮಾರಾಟ, ಗುತ್ತಿಗೆ, ಅಡಮಾನ ಮೂಲಕ ಅಥವಾ761 ಬೇರೆ ರೀತಿಯ ಮೂಲಕ ಸದರಿ ಜಮೀನುಗಳ ವಿಲೇವಾರಿಗಾಗಿ ಮಾಡಿಕೊಂಡ ಯಾವುದೇ ಕರಾರುಗಳನ್ನು ಅಥವಾ ಅದರಲ್ಲಿ ಮಾಡಲಾದ ವೆಚ್ಚ ಅಥವಾ ಅಭಿವೃದ್ಧಿಗಳನ್ನು ಅಂತಿಮವಾಗಿ ಭೂ ಸ್ವಾಧೀನವಾಗುವ ಸದರಿ ಜಮೀನುಗಳ ಅಂತಹ ಭಾಗಗಳ ಪರಿಹಾರವನ್ನು ನಿರ್ಧರಣೆ ಮಾಡುವ ಅಧಿಕಾರಿಯು ಸದರಿ ಅಧಿನಿಯಮ 7ನೇ ಖಂಡದ 24ನೇ ಪ್ರಕರಣದ ಮೇಲೆ ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದು.

ಸದರಿ ಜಮೀನುಗಳ ಒಂದು ನಕ್ಷೆಯನ್ನು ವಿಶೇಷ ಭೂ ಸ್ವಾಧೀನಾಧಿಕಾರಿಗಳು, ವಿಶ್ವೇಶ್ವರಯ್ಯ ಕೇಂದ್ರ, 3ನೇ ಮಹಡಿ, ಪೋಡಿಯಂ ಬ್ಲಾಕ್, ಬೆಂಗಳೂರು-1 ಇವರ ಕಾರ್ಯಾಲಯದಲ್ಲಿ ಅವಗಾಹನೆಗಾಗಿ ಇಡಲಾಗಿದೆ.

ಈ ಮುಂದಿನ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳಲ್ಲಿ ಕೈಗಾರಿಕೆಗಳ ಸ್ಥಾಪನೆಗಾಗಿ ಅಂದರೆ ಬಳ್ಳಾರಿ ಜಿಲ್ಲೆ ಸಂಡೂರ ತಾಲೂಕ ಭ ುಜಂಗನಗರ, ಕೃಷ್ಣಾನಗರ, ದೌಲತಪುರ, ಸುಶೀಲನಗರ, ಧ ರೋಜಿ ಹಾಗೂ ತೋರಣಗಲ್ಲು ಗ್ರಾಮಗಳಲ್ಲಿ ರೈಲ್ವೆ ಲೈನ್ (ಸೈಡಿಂಗ್) ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಅಭಿವೃದ್ಧಿಗೊಳಿಸಲು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಗೆ ಅವಶ್ಯವಿರುತ್ತದೆಯೆಂದು ಕರ್ನಾಟಕ ಸರಕಾರವು ಉದ್ದೇಶಿಸಿದೆ.

ಆದ್ದರಿಂದ 1966 ನೇ ಸಾಲಿನ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966) ರ ಕಲಂ 28ರ ಉಪಕಲಂ (1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರಕಾರವು ಪ್ರಸ್ತುತ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಿ ಈ ಮೂಲಕ ಸೂಚನೆ ಕೊಡಲಾಗಿದೆ.

ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಕಲಂ 35 ರ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಂಥ ಜಮೀನುಗಳಲ್ಲಿ ಪ್ರವೇಶಿಸುವ ವ್ಯಕ್ತಿಗಳೊಡನೆ ಮಧ್ಯೆ ಪ್ರವೇಶಿಸುವುದಾಗಲಿ ಅಥವಾ ಅವರನ್ನು ತಡೆಯುವುದಾಗಲಿ ಮಾಡಬಾರದು ಅಂತಾ ಪ್ರಸ್ತುತ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಇರುವವರಿಗೆಲ್ಲಾ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನಿನ ಮಾರಾಟ, ವಿಲೇವಾರಿ, ಗುತ್ತಿಗೆ ಅಡಮಾನ, ಹಸ್ತಾಂತರಣ ವಿನಿಮಯ ಅಥವಾ ಇನ್ನಾವುದೇ ರೀತಿಯ ಒಪ್ಪಂದಗಳನ್ನು ಅಥವಾ ಯಾವೊಂದು ವೆಚ್ಚ ಭೂ ಅಭಿವೃದ್ಧಿಗಳನ್ನು ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದ ನಂತರ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, ಧಾರವಾಡ ಇವರ ಮಂಜೂರಾತಿಯನ್ನು ಪಡೆಯದೇ ಮಾಡಿದ ಪಕ್ಷದಲ್ಲಿ ಕೇಂದ್ರಿಯ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆ 1894 ರ ಕಲಂ 24(7) ಮೇರೆಗೆ ಪರಿಹಾರಧನ ಕೊಡಲು ಪರಿಗಣಿೆಸುವುದಿಲ್ಲವೆಂಬ ಹಾಗೂ ಅಧಿಕೃತವಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ತಿಳಿಯಪಡಿಸಲಾಗಿದೆ.

ಸದರಿ ಜಮೀನಿನ ಒಂದು ಕರಡು ನಕ್ಷೆಯನ್ನು ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, 33/ಎ ಲಕಮನಹಳ್ಳಿ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶ, ಪಿ.ಬಿ. ರಸ್ತೆ ಧಾರವಾಡ-580004 ಇವರ ಕಾರ್ಯಾಲಯದಲ್ಲಿ ಪರಿಶೀಲನೆಗಾಗಿ ಇಡಲಾಗಿದೆ.
