ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966 (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966)ನೇದ್ದರ ಕಲಂ 3ರ ಉಪ ಕಲಂ (1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರಕಾರವು ಬೆಳಗಾಂವ ಜಿಲ್ಲೆ, ಸವದತ್ತಿ ತಾಲ್ಲೂಕು, ಮದ್ಲೂರ ಗ್ರಾಮದಲ್ಲಿ ಪರಿಷ್ಕøತ ಪ್ರಸ್ತಾವನೆಯ ಜಮೀನನ್ನು ಮೆ|| ಗೇಲ್ ಇಂಡಿಯಾ ಲಿ. ರವರ ಧಾಭೋಲ್-ಬೆಂಗಳೂರು ಗ್ಯಾಸ್ ಪೈಪ್‌ಲೈನ್ ಯೋಜನೆಗೆ ಐಪಿ, ಎಸ್‌ವಿ, ಟ್ಯಾಪ್ಆಫ್, ಸಿಎನ್‌ಜಿ ಮತ್ತು ಟರ್ಮಿನಲ್ ಸ್ಟೇಷನ್ ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಈ ಕೆಳಗಿನ ಅನುಸೂಚಿಯ ಅಂಕಣ (2) ರಲ್ಲಿ ಕಾಣಿಸಿರುವ ಸರ್ವೇ ನಂಬರ್ ಅಂಕಣ (3)ರಲ್ಲಿ ವಿವರಿಸಿದ ವಿಸ್ತೀರ್ಣ ಅಂಕಣ (4) ರಿಂದ (7)ರವರೆಗೆ ವಿವರಿಸಿದ ಚಕ್ಕಬಂದಿ (ಚತು:ಸೀಮೆ)ಯನ್ನು ಒಳಗೊಂಡಿರುವ ಪ್ರದೇಶವನ್ನು ಕೈಗಾರಿಕಾ ಪ್ರದೇಶವೆಂದು ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಉದ್ದೇಶದನ್ವಯ ಘೋಷಿಸುತ್ತದೆ.

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ದಿ ಕಾಯ್ದೆ 1966 (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966)ನೇದ್ದರ ಕಲಂ 1ರ ಉಪ ಕಲಂ (3) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರಕಾರವು ಬೆಳಗಾಂವ ಜಿಲ್ಲೆ, ಸವದತ್ತಿ ತಾಲ್ಲೂಕು, ಮದ್ಲೂರ ಗ್ರಾಮದಲ್ಲಿ ಪರಿಷ್ಕøತ ಪ್ರಸ್ತಾವನೆಯ ಜಮೀನನ್ನು ಮೆ|| ಗೇಲ್ ಇಂಡಿಯಾ ಲಿ. ರವರ ಧಾಭೋಲ್-ಬೆಂಗಳೂರು ಗ್ಯಾಸ್ ಪೈಪ್‌ಲೈನ್ ಯೋಜನೆಗೆ ಐಪಿ, ಎಸ್‌ವಿ, ಟ್ಯಾಪ್ಆಫ್, ಸಿಎನ್‌ಜಿ ಮತ್ತು ಟರ್ಮಿನಲ್ ಸ್ಟೇಷನ್ ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಈ ಕೆಳಗಿನ ಅನುಸೂಚಿಯ 2ನೇ ಅಂಕಣದಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನಿನ ಸರ್ವೇ ನಂಬರ್ 3ನೇ ಅಂಕಣದಲ್ಲಿ ಕಾಣಿಸಿರುವ ವಿಸ್ತೀರ್ಣ ಅಂಕಣ (4) ರಿಂದ (7)ರವರೆಗೆ ವಿವರಿಸಿದ ಚಕ್ಕಬಂದಿ (ಚತು:ಸೀಮೆ)ಯನ್ನು ಒಳಗೊಂಡಿರುವ ಪ್ರದೇಶವನ್ನು ಕೈಗಾರಿಕಾ ಪ್ರದೇಶವೆಂದು ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಅಧ್ಯಾಯ 7ರಲ್ಲಿಯ ಉಪ ಬಂಧಗಳನ್ನು ಈ ಅಧಿಸೂಚನೆಯ ದಿನಾಂಕದಿಂದ ಚಲಾಯಿಸಲಾಗುತ್ತದೆ ಅಂತಾ ಈ ಮೂಲಕ ನಿಗದಿಪಡಿಸಿದೆ.

ಸಂಖ್ಯೆ: ಸಿಐ 127 ಎಸ್.ಪಿ.ಕ್ಯೂ 2011, ಬೆಂಗಳೂರು, ದಿನಾಂಕ: 25ನೇ ಮಾರ್ಚ್, 2011 ಈ ಮುಂದಿನ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳಲ್ಲಿ ಕೈಗಾರಿಕೆಗಳ ಸ್ಥಾಪನೆಗಾಗಿ ಅಂದರೆ ಬೆಳಗಾಂವ ಜಿಲ್ಲೆ, ಸವದತ್ತಿ ತಾಲ್ಲೂಕು, ಮದ್ಲೂರ ಗ್ರಾಮದಲ್ಲಿ ಪರಿಷ್ಕøತ ಪ್ರಸ್ತಾವನೆಯ ಜಮೀನನ್ನು ಮೆ|| ಗೇಲ್ ಇಂಡಿಯಾ ಲಿ. ರವರ ಧಾಭೋಲ್ - ಬೆಂಗಳೂರು ಗ್ಯಾಸ್ ಪೈಪ್‌ಲೈನ್ ಯೋಜನೆಗೆ ಐಪಿ, ಎಸ್‌ವಿ, ಟ್ಯಾಪ್ಆಫ್, ಸಿಎನ್‌ಜಿ ಮತ್ತು ಟರ್ಮಿನಲ್ ಸ್ಟೇಷನ್ ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಗೆ ಅವಶ್ಯವಿರುತ್ತದೆಯೆಂದು ಕರ್ನಾಟಕ ಸರಕಾರವು ಉದ್ದೇಶಿಸಿದೆ. ಆದ್ದರಿಂದ 1966 ನೇ ಸಾಲಿನ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966) ರ ಕಲಂ 28ರ ಉಪಕಲಂ (1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರಕಾರವು ಪ್ರಸ್ತುತ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಿ ಈ ಮೂಲಕ ಸೂಚನೆ ಕೊಡಲಾಗಿದೆ. ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಕಲಂ 35 ರ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಂಥ ಜಮೀನುಗಳಲ್ಲಿ ಪ್ರವೇಶಿಸುವ ವ್ಯಕ್ತಿಗಳೊಡನೆ ಮಧ್ಯೆ ಪ್ರವೇಶಿಸುವದಾಗಲಿ ಆಥವಾ ಅವರನ್ನು ತಡೆಯುವುದಾಗಲಿ ಮಾಡಬಾರದು ಅಂತಾ ಪ್ರಸ್ತುತ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಇರುವವರಿಗೆಲ್ಲಾ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನಿನ ಮಾರಾಟ, ವಿಲೇವಾರಿ, ಗುತ್ತಿಗೆ ಅಡಮಾನ, ಹಸ್ತಾಂತರಣ ವಿನಿಮಯ ಅಥವಾ ಇನ್ನಾವುದೇ ರೀತಿಯ ಒಪ್ಪಂದಗಳನ್ನು ಅಥವಾ ಯಾವೊಂದು ವೆಚ್ಚ ಭೂ ಅಭಿವೃದ್ಧಿಗಳನ್ನು ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದ ನಂತರ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, ಧಾರವಾಡ ಇವರ ಮಂಜೂರಾತಿಯನ್ನು ಪಡೆಯದೇ ಮಾಡಿದ ಪಕ್ಷದಲ್ಲಿ ಕೇಂದ್ರಿಯ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆ 1894 ರ ಕಲಂ 24(7) ಮೇರೆಗೆ ಪರಿಹಾರಧನ ಕೊಡಲು ಪರಿಗಣಿೆಸುವುದಿಲ್ಲವೆಂಬ ಹಾಗೂ ಅಧಿಕೃತವಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ತಿಳಿಯಪಡಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನಿನ ಒಂದು ಕರಡು ನಕ್ಷೆಯನ್ನು ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, 33/ಎ ಲಕಮನಹಳ್ಳಿ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶ, ಪಿ.ಬಿ. ರಸ್ತೆ ಧಾರವಾಡ-580004 ಇವರ ಕಾರ್ಯಾಲಯದಲ್ಲಿ ಪರಿಶೀಲನೆಗಾಗಿ ಇಡಲಾಗಿದೆ.

ಅದರಂತೆ ಪ್ರಸ್ತುತ ಕಾಯಿದೆಯನ್ವಯ ಕಲಂ 28ರ ಉಪ ಕಲಂ (3)ರನ್ವಯ ಆಜ್ಞೆಯನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ ಮತ್ತು ಈ ಕೆಳಗೆ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳ ವಿವರವನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿಯೂ ಕಾಣಿಸಲ್ಪಟ್ಟಿದೆ ಹಾಗೂ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನ ಪಡಿಸಿಕೊಳ್ಳಬೇಕೆಂದು ಕರ್ನಾಟಕ ಸರಕಾರಕ್ಕೆ ಮನವರಿಕೆಯಾಗಿದೆ.

ಆದುದರಿಂದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯಿದೆ 1966 (ಕರ್ನಾಟಕ ಕಾಯಿದೆ 18:1966)ರ ಕಲಂ 28ರ ಉಪ ಕಲಂ (4) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಐ.ಟಿ.ಎಸ್.ಇ.ರhುಡ್ ರವರ ಪಂಪ್‌ಹೌಸ್ ನಿರ್ಮಾಣದ ಯೋಜನೆಯ ಉದ್ದೇಶಕ್ಕಾಗಿ ಈ ಕೆಳಗೆ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನ ಪಡಿಸಿಕೊಳ್ಳಬೇಕೆಂದು ಈ ಮೂಲಕ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಘೋಷಿಸಿದೆ.

ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಗಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಲಾಗಿರುವ ಬೃಹತ್ ಬೆಂಗಳೂರು ಮಹಾನಗರ ಪಾಲಿಕೆಯ ವ್ಯಾಪ್ತಿಯೊಳಗೆ ಬರುವ ಕೆಳಕಂಡ ಸ್ವತ್ತುಗಳಿರುವ ಪ್ರದೇಶಕ್ಕೆ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ-1966ರ 7ನೇ ಅಧ್ಯಾಯವು ಈ ಅಧಿಸೂಚನೆಯ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆಂದು ಘೋಷಿಸಿದೆ.

ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಸ್ವತ್ತುಗಳು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಯಿಂದ ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆ ಅಭಿವೃದ್ಧಿಪಡಿಸುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಬೇಕಾಗಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ. ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾದೀನ ಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ನೋಟೀಸು ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿ ಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾಗಿರುವ ತಾರೀಖಿನ ನಂತರ ಬೆಂಗಳೂರು ವಿಭಾಗದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಮಂಡಳಿಯ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿಯವರ ಅನುಮತಿಯಿಲ್ಲದೆ ಸದರಿ ಸ್ವತ್ತಿಗಳನ್ನು ವಿಲೆ ಮಾಡಲು ಒಪ್ಪಂದ ಕ್ರಯ, ಭೋಗ್ಯ, ಲೀಸ್, ಅದಲು-ಬದಲು ವಗೈರೆ ಮಾಡುವಂತಿಲ್ಲ ಮತ್ತು ಸದರಿ ಸ್ವತ್ತುಗಳಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆ ನಂತರ ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಮತ್ತಿತರ ಅಭಿವೃಧ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡುವಂತಿಲ್ಲ. ಒಂದು ವೇಳೆ ಮಾಡಿದರೂ 1894ರ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆ ವಿಧಿ (ನಿಯಮ 7) ಕರ್ನಾಟಕ ತಿದ್ದುಪಡಿ ಮಾಡಿರುವ ಕಾಯ್ದೆ 17:1961 ಮತ್ತು 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 30ನ್ನು ಓದಿಕೊಳ್ಳುವ ಮೇರೆಗೆ ಪರಿಹಾರಧನ ನಿಗಧಿ ಮಾಡುವಾಗ ಈ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳುವುದಿಲ್ಲ ಮತ್ತು ಅಂತಿಮವಾಗಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದು.

The Karnataka Administrative Service (Super time scale) cadre was created in G.O.No:DPAR 92 SKT 2001 dt:24-12-2002 by upgrading 20 posts in KAS (Selection Grade) out of the cadre strength in KAS Selection Grade. Further these posts were enhanced to 45 in G.O.NO:DPAR 13 SKT 2003 dt:28-01-2004.

The promotion made to the KAS (Super time scale) from the date of creation of Super time scale i.e. from 24-12-2002 to 31-12-2010 and promotion made during these period against the vacancies occurred are considered and have been taken into account for preparation of draft gradation list for the period from 24-12-2002 to 31-12-2010.

After consideration of vacancies mentioned supra, a provisional gradation list in the cadre of KAS Super time scale as on 01-01-2011 (for the period from 24-12-2002 to 31-12-2010) is prepared and published herewith as Annexure to this Notification.

Aggrieved persons, if any, may submit their objections/ suggestions against the provisional gradation list to the Chief Secretary to Government of Karnataka within 30 days from the date of publication of this provisional gradation list in the Karnataka Gazette along with documentary evidence. The final gradation list of KAS Group-A (Jr.Scale) cadre for the period from 01-11-1956 to 31-12-2003 has been published in the Notification No: DPAR 3 SKG 2000 dated:04-03-2006.

Now it is expedient to publish the gradation list of KAS Group-A Junior Scale as on 01-02-2010 (for the period from 01-01-2004 to 31-01-2010).

On a review of the vacancies which have occurred in KAS Group-A Junior Scale cadre due to promotion of officers to KAS (Sr.Scale), Retirement, death while in service and VRS etc., this gradation list for the period from 01-01-2004 to 31-01-2010 is prepared.

In the Notification No:DPAR 206 SKT 2005 dated: 01-02-2006 appointment orders are issued to the 1999 batch of applicants selected through the Karnataka Public Service Commission to the cadre of KAS (Jr.Scale). In the said Notification it was stipulated that they are junior to 1998 batch who are appointed to the cadre and reported for duty later on. Smt.R.Latha and others of 1999 batch of probationers have questioned the legality of conditions stipulated in the appointment orders in the Hon'ble Karnataka Administrative Tribunal by filing application Nos:7712 to 7716/2006. As per the judgment of the Hon'ble Tribunal dt:02-03-2010, the 1999 recruits are senior to 1998 batch based on the rules of recruitment. Aggrieved by the judgment of Hon'ble Tribunal, 1998 batch of KAS (Jr.Scale) Probationers filed the Writ Petitions No:10605 – 620/ 2010(S-KAT) before the Hon'ble High Court of Karnataka praying for quashing the order dt:2-3-2010. The Hon'ble High Court, in its judgment dated: 8-12-2010 has set aside the orders passed by the KAT and upheld the conditions laid down in the appointment orders issued to the candidates of 1999 batch of KAS Junior Scale.

Based on this judgment, seniority of 1998 batch of probationers placed above the 1999 batch of probationers in this gradation list, though the 1998 batch probationers joined duty in April 2006.

After consideration of the vacancies mentioned above, and the officers found surplus in the gradation list published as on 01-01-2004, a provisional gradation list in the cadre of KAS Group-A Junior Scale as on 01-02-2010 for the period from 01-01-2004 to 31-01-2010 is prepared and published herewith as Annexure-1 to this Notification.

The block periods for the purpose of computation of vacancies that have been utilized in the present provisional gradation list have been given in the statement appended to this Notification as Annexure-II

Aggrieved persons, if any, may submit their objections/ suggestions against the provisional gradation list to the Chief Secretary to Government of Karnataka with in 30 days from the date of publication of this provisional gradation list in the gazette along with documentary evidence. ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಹೆಚ್‌ಡಿ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 20-12-2007 ರಲ್ಲಿ ದಿನಾಂಕ 31-05-1991 ರಿಂದ 31-10-1998ರ ಅವಧಿಯವರೆಗೆ ಡಿವೈ.ಎಸ್.ಪಿ. (ಸಿವಿಲ್) ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಪ್ರಕಟಿಸಲಾಗಿತ್ತು. ಸದರಿ ಅಧಿಸೂಚನೆಯ ವಿರುದ್ಧ ಶ್ರೀ ಬಿ.ಆರ್.ರವಿಕಾಂತೇಗೌಡ ಮತ್ತಿತರರು ಕೆ.ಎ.ಟಿ.ಯಲ್ಲಿ ಅರ್ಜಿ ಸಂಖ್ಯೆ:149/2008 ನ್ನು ಸಲ್ಲಿಸಿದ್ದು, ದಿನಾಂಕ 26-05-2009ರ ಆದೇಶದಲ್ಲಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿರುತ್ತದೆ.

" (i) Applications are allowed;

(ii) It is hereby declared that the impugned Rules, namely the "The Karnataka State Police Services including Ministerial Services (Recruitment) (Amendment) Rules, 2000" are prospective in nature and operate only from the date of their publication in the official gazette i.e., 12-6-2001.

(iii) The impugned seniority list pertaining to the cadre of DSP published by the Government by Notification-1 dated 20.12.2007 to the extent it relates to the Applicants and Respondents No.3 to 7 is set aside.

(iv) the Official Respondents shall re-draw the seniority list of DSP by placing the direct recruits above the promotees with reference to the date of their regular appointment / promotion to the cadre of DSP in the light of the observations made in this order;

(v) Time for re-drawing the seniority list : Three months."

ಕೆ.ಎ.ಟಿ.ಯ ಆದೇಶದಂತೆ ದಿನಾಂಕ 20-12-2007 ರಂದು ಹೊರಡಿಸಲಾಗಿದ್ದ ಡಿವೈ.ಎಸ್.ಪಿ. (ಸಿವಿಲ್) ವೃಂದದ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಹಿಂಪಡೆದು ಡಿವೈ.ಎಸ್.ಪಿ. ವೃಂದದಲ್ಲಿ ಕ್ರಮಬದ್ಧ ನೇಮಕಾತಿ / ಮುಂಬಡ್ತಿ ನೀಡಿದ ದಿನಾಂಕವನ್ನು ಪರಿಗಣಿಸಿ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಹೆಚ್‌ಡಿ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 18-12-2009 ರಲ್ಲಿ ದಿನಾಂಕ 13-06-1991 ರಿಂದ 24-06-2002 ರ ಅವಧಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಡಿವೈ.ಎಸ್.ಪಿ.

(ಸಿವಿಲ್) ವೃಂದದ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಪ್ರಕಟಿಸಲಾಗಿದೆ. ಈ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯ ವಿರುದ್ಧ ಶ್ರೀ ಭಗವಾನ್ ದಾಸ್, ಶ್ರೀ ಮುತ್ತುರಾಯ, ಶ್ರೀ ರಂಗಸ್ವಾಮಿ ನಾಯಕ್ ಮತ್ತಿತರರು ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ:28578-590/2009 ಮತ್ತು 26731-42/2009 ನ್ನು ಸಲ್ಲಿಸಿದ್ದು, ಪ್ರಕರಣವು ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಬಾಕಿ ಇರುತ್ತದೆ.

ಕೆ.ಎ.ಟಿ. ಅರ್ಜಿ ಸಂಖ್ಯೆ:149/2008 ದಿನಾಂಕ 26-05-2009 ರ ಆದೇಶದಂತೆ ನೇರ ನೇಮಕಾತಿ ಹುದ್ದೆಗಳನ್ನು Freeze ಮಾಡಿ ದಿನಾಂಕ 12-06-2001 ರಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವ ಆದೇಶವು ಭವಿಷ್ಯವರ್ತಿಯಾಗಿ ಅಂದರೆ ವಿಶೇಷ ರಾಜ್ಯಪತ್ರ ಪ್ರಕಟಣೆ ದಿನಾಂಕ 16-06-2001 ರಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ ಎಂದು ಕೆ.ಎ.ಟಿ.ಯು ಆದೇಶಿಸಿದೆ. ಕೆ.ಎ.ಟಿ.ಯು ಆದೇಶಿಸಿದಂತೆ ದಿನಾಂಕ 16-06-2001 ರಿಂದ ಅನ್ವಯವಾಗುವಂತೆ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಹೆಚ್‌ಡಿ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 18-12-2009 ರಂದು ಪ್ರಕಟಿಸಿದ್ದ ಡಿವೈ.ಎಸ್.ಪಿ. (ಸಿವಿಲ್) ವೃಂದದ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿನ 25ನೇ ಬ್ಲಾಕ್‌ನಲ್ಲಿರುವ ಅಧಿಕಾರಿಗಳಿಗೆ ದಿನಾಂಕ 16-06-2001 ರಿಂದ ಪೂರ್ವಾನ್ವಯ ಮುಂಬಡ್ತಿ ನೀಡಿ ಈ ಅವಧಿಯ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಒಇ 319 ಪೊಸಿಪ 2010 ದಿನಾಂಕ 19-03-2011 ರಂದು ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಲಾಗಿದೆ ಮತ್ತು ಪೂರ್ವಾನ್ವಯ ಮುಂಬಡ್ತಿಯ ದಿನಾಂಕಗಳನ್ನು ಆಧರಿಸಿ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಹೆಚ್‌ಡಿ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 18-12-2009 ರಲ್ಲಿ ಪ್ರಕಟಿಸಿದ್ದ ಡಿವೈ.ಎಸ್.ಪಿ. (ಸಿವಿಲ್) ವೃಂದದ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿನ 25ನೇ ಬ್ಲಾಕ್‌ನಲ್ಲಿರುವ ಅಧಿಕಾರಿಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಕರಡು ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಒಇ 319 ಪೊಸಿಪ 2010 ದಿನಾಂಕ 28-03-2011 ರಂದು ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಒಇ 66 ಪೊಸಿಪ 2010 ದಿನಾಂಕ 12-05-2011 ರಲ್ಲಿ ದಿನಾಂಕ 16-06-2001 ರಿಂದ 26-06-2010 ರ ಅವಧಿಯಲ್ಲಿ ಮುಂಬಡ್ತಿ ಕೋಟಾದಲ್ಲಿ ಲಭ್ಯವಿರುವ ರಿಕ್ತಸ್ಥಾನಗಳಿಗೆ ಡಿವೈ.ಎಸ್.ಪಿ. ವೃಂದದ ಅಧಿಕಾರಿಗಳಿಗೆ ಪೂರ್ವಾನ್ವಯ ಮುಂಬಡ್ತಿ ನೀಡಲಾಗಿದೆ.

ಕರ್ನಾಟಕ ಆಡಳಿತ ನ್ಯಾಯ ಮಂಡಳಿಯು ನೀಡಿರುವ ಮೇಲಿನ ತೀರ್ಪಿನ ಅನ್ವಯ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಒಇ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 08-12-2008 ರಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವ ಅಧಿಸೂಚನೆಯನ್ನು ತಕ್ಷಣದಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಹಿಂಪಡೆಯಲಾಗಿದೆ. ಮುಂದುವರೆದು, ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಒಇ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 08-12-2008 ನ್ನು supercession ಮಾಡಿ, ಕರ್ನಾಟಕ ಆಡಳಿತ ನ್ಯಾಯ ಮಂಡಳಿಯು ಅರ್ಜಿ ಸಂಖ್ಯೆ:149/2008 ರಲ್ಲಿ ನೀಡಿರುವ ದಿನಾಂಕ 26-05-2009 ರ ತೀರ್ಪಿನ ಅನ್ವಯ, ಕರ್ನಾಟಕ ಸರ್ಕಾರಿ ನೌಕರರ (ಜೇಷ್ಠತಾ) ನಿಯಮಗಳು, 1958 ಮತ್ತು ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ:ಒಇ 192 ಪೊಸಿಪ 2002 ದಿನಾಂಕ 08-12-2008ರ Annexure-1 ರಲ್ಲಿನ ಖಾಲಿ ಹುದ್ದೆಗಳು ಮತ್ತು ತದನಂತರ ಲಭ್ಯವಾದ ಖಾಲಿ ಹುದ್ದೆಗಳು ಹಾಗೂ ಅವುಗಳ blockwise ಹಂಚಿಕೆಯನ್ನು Annexure-1 ರಲ್ಲಿದ್ದಂತೆ ಮತ್ತು Annexure-2 ರಲ್ಲಿರುವ ವಿವರಣಾತ್ಮಕ ಟಿಪ್ಪಣಿಯನ್ನು ಪರಿಗಣಿಸಿ ದಿನಾಂಕ 16-06-2001 ರಿಂದ 30-06-2010 ರವರೆಗಿನ ಡಿವೈ.ಎಸ್.ಪಿ. (ಸಿವಿಲ್) ವೃಂದದ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು Annexure-3 ರಲ್ಲಿರುವಂತೆ ಈ ಮೂಲಕ ಪ್ರಕಟಿಸಲಾಗಿದೆ. ಡಿವೈ.ಎಸ್.ಪಿ. ವೃಂದದಲ್ಲಿ ಸ್ವತಂತ್ರ ಪ್ರಭಾರದಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿರುವ ಅಧಿಕಾರಿಗಳ ಪಟ್ಟಿಯನ್ನು Annexure-4 ರಲ್ಲಿಡಲಾಗಿದೆ.

ಈ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿ ನೀಡಿರುವ ಜೇಷ್ಠತೆಯು ಕರ್ನಾಟಕ ಉಚ್ಛ ನ್ಯಾಯಾಲಯವು ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ:28578-591/2009 ಮತ್ತು 26731-42/2009 ರಲ್ಲಿ ನೀಡುವ ಅಂತಿಮ ತೀರ್ಪಿಗೆ, ಕೆ.ಎ.ಟಿ.ಯಲ್ಲಿನ ಅರ್ಜಿ ಸಂಖ್ಯೆ: 6486 ಮತ್ತು 6487/2010 ಹಾಗೂ ಅರ್ಜಿ ಸಂಖ್ಯೆ:148-151/2011 ರಲ್ಲಿ ನೀಡುವ ಅಂತಿಮ ತೀರ್ಪಿಗೆ ಒಳಪಟ್ಟಿರುತ್ತದೆ.

ಈ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿನ ಜೇಷ್ಠತೆಯಿಂದ ಬಾಧಿತರಾಗಬಹುದಾದಂತಹ ಅಧಿಕಾರಿಗಳಿಂದ ಸಲಹೆ / ಆಕ್ಷೇಪಣೆಗಳಿದ್ದಲ್ಲಿ ಸರ್ಕಾರದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಗಳು, ಒಳಾಡಳಿತ ಇಲಾಖೆ, 2ನೇ ಮಹಡಿ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು ಇವರಿಗೆ ಈ ಅಧಿಸೂಚನೆ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ 30 ದಿನಗಳೊಳಗಾಗಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು. ಈ ಅವಧಿಯ ನಂತರ ಸ್ವೀಕರಿಸಿದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಪರಿಗಣಿಸಲಾಗುವುದಿಲ್ಲ.

Details of the block wise distribution of vacancies in the gradation list for the period from 16-06-2001 to 26-06-2010

in the cadre of Dy.SPs (Civil)

ANNEXURE – 2

Explanatory Note regarding seniority

1. The final gradation list for the period from 01-11-1956 to 12-06-1991 has been published vide Official Memorandum No: HD 90 PEG 1994 dated 10-9-1994.

2. In the Government Notification No. DPAR 40 SRE 2000 dated 12-06-2001 available direct recruitment vacancies have been converted into promotional vacancies. DG & IGP in letter no. CB(4)/8/1994-95 dated 09-02-2000, has requested that from 13-06-1991 to 31-12-1998 there were 274 posts as per C & R Rules 33 ⅓ & 66 ⅔ posts are meant for direct recruitment & promotional quotas respectively accordingly 91 vacancies should be direct vacancies since 10 officers were recruited under direct recruitment quota, the remaining 81 direct recruitment vacancies be freezed & converted into promotion vacancies, according to which available direct recruitment vacancies for the period between 13-16-1991 & 31-12-1998, were converted into promotional vacancies vide Notification No. DPAR 40 SRE 2000 dated 12-06-2001.

3. In Government Notification-1 No. OE192 POSIPA 2002 dated 25-02-2002, the provisional gradation list of Dy. SPs (Civil), upto 31-10-1998, has been published. The officers aggrieved by the provisional list were to submit objections / suggestions within 30 days. After considering the objections / suggestions received within the stipulated time & in accordance with the service seniority of the officers, the final gradation list of Dy. SPs (Civil) cadre, pertaining to the period between 31-05-1991 & 31-10-1998, was published vide Notification no. OE192 POSIPA 2002 dated 20-12-2007.

Sri K.T.Balakrishna have filed applications bearing nos. 149/2008, 414/2008, 415/2008, 408/2008, 502/2008, 1171/2008 in the Karnataka Administrative Tribunal. In this case, apart from the State Government, DG & IGP, Sri B.S.Marthurkar, Sri Rangaswamy Naik, Sri Muthuraya & Sri B.Y.Malagathi are private respondents.

5. Apart from the above applications, considering the applications bearing the nos. 6997, 6999-7003/2001 & 4632/2002 filed by Sri B.R.Ravikanthegowda & others objecting to conversion of direct recruitment vacancies into promotional vacancies as per Notification No. DPAR 40 SRE 2000 dated 12-06-2001, also Karnataka Administrative Tribunal in its judgment dated 26-05-2009 has ordered as under :

i. Applications are allowed

ii. It is hereby declared that the impugned Rules, namely the "the Karnataka State Police Services including Ministerial Services (Recruitment) (Amendment) Rules, 2000" are prospective in nature and operate only from the date of their publication in the official gazette i.e., 12-06-2001.

iv. The Official Respondents shall re-draw the gradation list of DSP by placing the direct recruits above the promotees with reference to the date of their regular recruitment/promotion to the cadre of DSP in the light of the observation made in this order:

v. Time for redrawing the gradation list: Three months."

6. In pursuance of the above order of the Karnataka Administrative Tribunal it was decided that the final gradation list in the cadre of Dy.SPs published by the Government vide Notification no. OE192 POSIPA 2002 dated 20-12-2007 would be revised & published.

7. For the block period, 'the period between one direct recruitment to another direct recruitment' or 'the date of recruitment to the date of amendment of recruitment rules' or 'the date of amendment to the direct recruitment date' or 'the period between the date of amendment to another date of amendment' has been considered as one Block period.

8. DG & IGP in his proposal vide letter no. CB(4)/8/1994-95 dated 09-02-2000, has stated that from 13-06-1991 to 31-12-1998 there were 274 vacancies and according to Notification No. DPAR 40 SRE 2000 dated 12-06-2001 81 direct recruitment vacancies have been converted into promotional vacancies, based on which an Official Memorandum No. OE 192 POSIPA 2002 has published provisional gradation list draft on 25-06-2002 & later published final gradation list vide Notification No. OE 192 POSIPA 2002 on date 20-12-2007. The Karnataka Administrative Tribunal, having taken into consideration the above mentioned notifications & government file no. OE 192 POSIPA 2002 & DPAR 40 SRE 2000, has passed the judgement on 26-05-2009 and the vacancies published / utilised in the abovementioned lists are taken into consideration.

9. The seniority of direct recruits has been determined in accordance with the selection list. But the seniority of those who reported to duty after the time limit stipulated in the Karnataka Civil Services (General Recruitment) Rules has been fixed in accordance with rule 5(2) of Karnataka Government Servants (Seniority) Rules, 1957.

10. The seniority of the direct recruits has to be determined as per rule 5 of Karnataka Government Servants (Seniority) Rules, 1957 & seniority of promotees has to be determined as per Rule 4 of the said rules. According to the Karnataka Civil Services (Regulation of Pay, Promotion and Pension) Act, 1973, except under the circumstances indicated in Section 4(1), there is no provision for assigning the eligibility dates prior to the actual date of promotion. Accordingly, the regular promotion / retrospective promotion dates have been considered.

11. According to the quota rule, the vacancies arising in one block period are categorized into direct recruitment vacancies and promotional vacancies. And if some vacancies remain unutilised, even after considering for regular recruitment / promotion, then these vacancies are carried forward to the next block period.

12. The Government Notification No. DPAR 40 SRE 2000 dated 12-06-2001 freezing direct recruitment vacancies of Deputy Superintendent of Police (civil) in Police Department was published in the extra-ordinary gazette dated 16-06-2001. The Karnataka Administrative Tribunal in its order dated 26-05-2009 in Application No.149/2008 has ordered that these rules are prospective in nature and operate only from the date of their publication in the official gazette. Keeping this in mind 87 Deputy Superintendent of Police have been accorded retrospective promotion from 16-06-2001 in accordance with KCS (RPPP) Act, 1973 and KCS (RPPP) Rules 1978, subject to the final decision of the Karnataka High court in Writ Petition No.28578-591/2009 and 26731-42/2009. Taking into consideration the retrospective promotion so accorded the final gradation list of Deputy Superintendent of Police in Notification No. HD 192 POSIPA 2002 dated 18-12-2009 in so far as the 25th Block is concerned has been modified and the revised provisional gradation list has been published in Notification No. OE 319 POSIPA 2010 dated 28-03-2011.

13. In pursuance of the above, it has become necessary to withdraw the final gradation list of the Deputy Superintendent of Police (civil) published in Notification No. HD 192 POSIPA 2002 dated 08-12- 2008 and republish the same. Accordingly vacancies which have been notified in the Notification dated 08-12-2008 for the period upto 02-03-2005 have been taken into consideration and based on the further vacancies available, vacancies have been allocated block wise from the "date of amendment to the direct recruitment date" as explained in Para-7 above. The DG & IGP in his letter dated 18-02-2011 has given the details of vacancies available for the further period. Block wise allocation of vacancies which were notified in Notification dated 08-12-2008 and subsequent vacancies as indicated by the DG & IGP have been taken into account and the quota for direct recruits and promotes, as per the C&R Rules existing during that period have been allocated.

14. In Government Notification No. HD 66 POSIPA 2010 dated 12-05-2011 a no. of officers in the cadre of Deputy Superintendent of Police, have been accorded retrospective promotion against the promotional quota vacancies from the date they were placed in independent charge or occurrence of vacancies which ever is later.

15. Accordingly, keeping the retrospective promotion accorded against the promotional quota vacancies, this draft Notification for the period from 16-06-2001 to 26-06-2010 is published.

16. The seniority assigned in this Notification is subject to the final judgement of the Hon'ble High court in Writ Petition No.28578-591/2009 and 26731-42/2009 and subject to the final order of the Hon'ble KAT in Application No. 6486 & 6487/2010 and No.148-151/2011.
