ಕರ್ನಾಟಕ ವಿದ್ಯುತ್ ಪ್ರಸರಣ ನಿಗಮ ನಿಯಮಿತವು (ಕೆಪಿಟಿಸಿಎಲ್) ಒಂದು ಸರ್ಕಾರಿ ಸ್ವಾಮ್ಯದ ಸಂಸ್ಥೆಯಾಗಿರುವುದರಿಂದ, ಈ ಸಂಸ್ಥೆಯು ರವರು ಸರ್ಕಾರದ ಇಂಧನ ಇಲಾಖೆ ಇವರಿಗೆ ವಿತರಿಸಲಿರುವ ರೂ.432.94 ಕೋಟಿಗಳ ಷೇರು ಸರ್ಟಿಫಿಕೇಟುಗಳಿಗೆ ಕರ್ನಾಟಕ ಮುದ್ರಾಂಕ ಕಾಯ್ದೆ 1957ರ ಕಲಂ 9(ii) (ಎ) ರನ್ವಯ ಶೇ.50ರಷ್ಟು ಮುದ್ರಾಂಕ ಶುಲ್ಕದಿಂದ ರಿಯಾಯಿತಿಯನ್ನು ನೀಡಲಾಗಿದೆ.

ಈ ಆದೇಶವನ್ನು ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಅ.ಟಿ. ಸಂಖ್ಯೆ: ಆಇ 4 ವೆಚ್ಚ-7/2011 ದಿನಾಂಕ:18.02.2011ರಲ್ಲಿ ನೀಡಿರುವ ಸಹಮತಿ ಮೇರೆಗೆ ಹೊರಡಿಸಲಾಗಿದೆ.

In exercise of the provisions contained under Rule 29(b) of the Karnataka Transparency in Public Procurements Rules, 2000, the Secretary to Government, Water Resources Department, Government of Karnataka, Vikasa Soudha, Bangalore-560001 has been appointed as Appellate Authority in respect of the orders passed by the Tender Accepting Authorities viz., Krishna Bhagya Jala Nigam Limited, Karnataka Neeravari Nigam Limited & Cauvery Neeravari Nigam Limited and also against orders passed by the Chief Engineers of Non-nigams i.e., Chief Engineer, Water Resources Development Organisation, Bangalore; Chief Engineer, Hydrology and Central Mechanical Organisation, Bangalore; Chief Engineer, Irrigation Central Zone, Munirabad; Chief Engineer, Irrigation Project Zone, Gulbarga and Chief Engineer, Upper Tunga Project.

NOTIFICATION

In exercise of the powers conferred by section 62 of the Administrators General's Act, 1963 (Central Act 45 of 1963), the Government of Karnataka hereby makes the following rules namely:-

1.Title and commencement: - (1) These rules may be called the Administrator-General (Karnataka) Rules, 2001.

(2) It shall come into force at once.

2. Definitations:- In these rules, unless the context, otherwise requires.

(1) 'Act' means the Administrator's General Act, 1963;

(2) "Administrator-General" means the Administrator General Appointed under Section 3;

(3) "Section" means a section of the Act.

3) Notice to interested persons: - (1) If the Administrator-General has notice of the existence of a person or persons who would be entitled to grant of probate or letters of Administration in preference to the Administrator-General and if the intentions of such person or persons as to applying for probate or letters of administration have not been ascertained, the Administrator- General shall, before applying for grant of letters of administration to himself, give notice in writing to such person or persons of his intention so to apply in default of such person or persons applying for grant of probate or letters of administration to himself or themselves within a reasonable time to be specified in such notice.

(2) The Administrator-General shall, in all cases, without prejudicial to his duty to do everything necessary to protect the interests of creditors and other persons having superior claims to the assets of an estate, use his best endeavors to ascertain the wishes of relatives and others interested in the disposal of the assets of every estate under his administration and shall have regard to such wishes especially in respect of specific assets to which sentimental or personal association attach, unless he considers such a course would be prejudicial to the due administration of the estate.

Provided that nothing in this rule shall prevent the immediate disposal of live-stock or other assets subject to speedy or natural decay.

4) Application under section 29 or 30: - (1) Every application made to the Administrator-General for a Certificate under section 29 or under section 30, as the case may be shall be in Form 1 accompanied by, -

(a) In the case of an applicant who is a widow or other next-of kin of the deceased: -

(i) An affidavit in Form 2

(ii) Original death-certificate

(iii) Records showing the particulars and value of assets left by the deceased; and

(iv) An affidavit on non-judicial stamp paper or letters of authority given by the other next-of-kin of the deceased, having prior or equal right as the applicant, expressing their consent to the grant of the certificate to the applicant.

(b) In the case of an applicant who is the executor of the will of the deceased: -

(i) Documents mentioned in sub-clauses (i), (ii) And (iii) of clause (a) above; and

(ii) Names and addresses of the next-of-kin of the Deceased as far as may be known;

(iii) The will in original with an English translation if it is not in English or Kannada; and

(iv) An affidavit in proper form by one of the witnesses

(c) In the case of an applicant who is a creditor of the deceased:-

(i) Documents mentioned in sub-clauses (i), (ii) and (iii) of clause (a) and clause (ii) of clause (b), and (ii) Records to prove the nature and extent of his dues from the estate of the deceased; and

(iii) an undertaking to furnish security for the administration of the estate, if and when called for

(2) Every Certificate issued by the Administrator General under section 29 or under section 30, as the case may be, shall be in Form 3,a counterfoil of which shall be kept by the Administrator General.

5. Notice on grant of Probate etc:- (1) On the grant to the Administrator-General, of probate or letters of administration to any estate or in the case of any administration under section 30 without such grant or in case of a transfer of administration to the Administrator General under section 22, the Administrator-General shall publish a notice in two consecutive issues of the Karnataka Gazette, in Form 4.

(2) The period allowed to claimants to prefer their claims to the Administrator-General shall in no case be less than one month from the date of the publication of the said notice, and in cases in which the Administrator-General has reason to believe that claimants may be residing out of India, the period shall not be less than two months from the date of such publication.

(3) The expenses of publishing such notices shall be charged on the estate concerned.

6. Notice of rejection etc:- Notice of rejection or disallowance in part, by the Administrator-General of any claim shall contain the following particulars;

(a) Name of the Estate.

(b) Name and address of the claimant

(c) Particulars of the claim rejected or of the part disallowed and the reasons for such rejection or disallowance.

(d) Date on which notice of the claim in question was received by the Administrator-General.

(e) Date of the final decision of the Administrator-

General rejecting the claim or disallowing it in part.

7. Fee Chargeable by the Administrator-General:-(1) When the administrator-General collects and takes possession of the assets under an order by the High Court under Section 10 or with a view to obtain letters of administration under section 9 or to administer without letters of administration under section 30, he shall be entitled to a commission upon the amount or value of the assets which he so collects or takes possession of, according to the following scale, subject to a minimum of rupees fifteen.

(2) If letters of administration in respect of such estate are afterwards granted to the Administrator-General or such estate are afterwards administered by him without letters of administration, the commission collected under this sub-rule be deemed to be a part payment of the commission payable to the Administrator-General under clause (a) of sub-rule (4).

(3) For every certificates granted under sections 29 and 30, the Administrator-General shall be entitled to charge a fee calculated at the rate of three per centum on the amount mentioned in the certificate, subject to a minimum of rupees six.

(4) (a) The Administrator-General shall, in respect of every estate administered by him under any letters of administration granted to him in his official character, or under any probate granted to him of a will wherein he is named as executor by virtue of his office, or under any probate or letters of administration vested in him by section 25, or under section 22 without a grant of letter of administration, he is entitled to receive a commission upon the amount or value of the assets which he collects, or take possession of in due course of administration according to the following scales:

(i) In the case of an estate the

five per centum

total value of which does not exceed Rs.50,000.

(ii) In the case of an estate the

five per centum up to Rs.50,000 and

total value of which exceeds

four per centum on the balance.

Rs.50,000 but does not exceed Rs. 1 lakh (iii) In the case of an estate the as in item (ii) up to Rs.1 lakhs and three.

Provided that the aforesaid scales shall be subject:

To a minimum of Rs.15 in the case of assets realized as Capital, and

(ii) To the following minimum scale in the case of assets

realized as income.

Where the income does not Rs.1 per half year.

Exceed Rs.20 per half year.

Where the income exceeds Rs.2.50 per half year.

Rs.20 but does not exceed.

Rs.50 per half year.

Where the income exceeds Rs.3.75 per half year.

Rs.50 but does not exceed

Rs.75 per half year.

Where the income exceeds Rs.5 per half year.

Rs.75 but does not exceed

Rs.100 per half year.

(b) The provisions of Sub-rule (4) shall not apply to cases in which the property of an officer or soldier die on service comes into the hands of the Administrator-General under the provisions of the Army and Air Force (Disposal of Private property) Act, 1950.

(c) The Administrator-General shall charge three percent on gross amount of such property coming into or remaining in his hands after payment of the regiomental and other debts in camp or quarters.

(d) Notwithstanding anything here in before contained, when the Administrator-General obtains probate or letters of administration operating in another State he shall be entitled to the same rate of commission in respect of the collection of assets collected in such State as the Administrator-General of such State would have been entitled to if such assets had been collected and distributed by him and to no higher rate.

(5) The Capital value of immovable properties, for purposes of levying commission, shall be fifteen times the annual gross rentals derived from the said properties on the date when the Administrator-General takes possession of the properties (6) For purposes of levying commission, the movables shall be valued by the Administrator-General as per the market value at the time he takes possession of them.

(7) Commission on interest realized from securities shall be levied on the net amount collected by the Administrator-General in the course of administration.

8) Notice to creditors etc., on transfer of administration under section 22: - (1) On the grant of probate or letters of administration to the Administrator-General of any estate or in case of an assumption of administration under Section 30 or in case of transfer of assets to the Administrator-General under Section 22, the Administrator-General shall publish a notice in two consecutive issues of the Karnataka Gazette in the following form.

"The Administrator-General of Karnataka hereby gives notice that he is administering from………………………….the estate of deceased, late……………………………….under the provisions of section 30 without any grant of administration or under a deed of transfer executed on ………………………….under the provisions of section 22 or under the grant of probate or letter of administration, made to him on the ……………………..by the High Court of Karnataka and that all persons having claims against the said estate as creditors, next-of kin, legatees or in any other manner whatsoever should prefer their claims to the said Administrator-General on or before the……………..………after which date he will proceed to make a distribution of the assets of the said estate and will recognize in such distribution on such claims as shall have previously been established to his satisfaction." (1) The period allowed to claimants to prefer their claims to the Administrator-General shall, in no case, be less than one month from the date on which the said notice was published, and in any case in which the Administrator- General has reason to believe that claimants may be residing out of India, the period shall not be less than two months from the date of such publication.

(2) The expenses of publishing such notices shall be charged to the estate concerned.

9) Investment of Cash balance: - (1) Whenever the cash balance to the credit of any individual estate shall amount to Rs.500 after providing for ascertained current demands, the Administrator-General shall invest or retain invested such balance in: - (a) Government Securities; or,

(b) Any of the securities authorised by the instrument under which the Administrator-General holds the estate and in which he is requested so to invest or to retain invested such cash balance by the person or persons beneficially interested in the same; or,

(c) Unless expressly forbidden by the instrument under which the Administrator-General holds the estate, in any of the securities in which trustees are authorized to invest by the provisions of the Indian Trusts Act, 1882 (II of 1882), save and except that no investment on mortgage of immovable property shall be made by the Administrator-General without the previous sanction of the High Court.

(2) All moneys coming into the hands of the Administrator-General, except those invested under sub/rule (1) and those retained for current petty expenditure by the Administrator-General, shall be deposited by the Administrator-General in the personal deposit account of the Administrator-General in the state Huzur Treasury, and shall form his current balance.

(3) The Administrator-General shall not hold imprest amount more than Rs.500/-

(4) All Government securities, bank, railway or other shares and debentures coming into the possession of the Administrator-General shall forthwith be lodged by him in the District Treasury, Bangalore, for safe custody except in cases in which it may be necessary for him to retain them temporarily for any purpose.

(5) All jewellery, trinkets and other valuable articles coming into the possession of the Administrator-General shall forthwith be lodged for a safe custody in the State Huzur Treasury, Bangalore, except in cases in which it may be necessary for the Administrator-General to retain them temporarily for any purpose.

10) Remittances to foreign countries: - All sums of money payable or belonging to persons resident in foreign countries shall be made by purchasing bills of exchange payable on demand, drawn by the State Bank of Mysore, Bangalore.

11) Schedules and Statements: - (1) Administrator-General shall, on or before the first day in August every year, deliver to the Government in quadruplicate:-

(a) a schedule showing the gross amount of all sums of money and all bonds or other securities for money received or issued by him on account of each estate in his charge, and the balances, during the year ending on the thirty-first day of March next before the day of delivering such schedule:

(b) a schedule of all administrations whereof the final balance have been paid over to the persons entitled to the same, during the same period, specifying the amount of such balances and the persons to whom paid

2) The aforesaid schedules shall, within fourteen days afterwards be published in the Karnataka Gazette by the Administrator-General.

3) The accounts of the Administrator-General shall be closed once a year on 31st March for the Schedules which under sub-rule (1) above is required to be delivered to the Government on or before the 1st August next succeeding that date.

4) The Administrator-General shall be entitled to such fees as the Government may specify from time to time for the preparation of the schedules for every year in addition to the costs of printing and publishing the same.

12) Audit of Accounts: - (1) The accounts and schedules of the Administrator-General shall be audited every year and the controller, State Accounts Department, Bangalore shall from time to time appoint an auditor or auditors for this purpose.

(2) The auditor or auditors shall submit to Government, together with the audit report, a statement of the accounts in the forms specified below:-

(i) Abstract of cash and Government or other securities received and paid during the year (Statement- A) (ii) Administrator-General 's balance for the year (Statement-B)

(iii) Abstract of commission account of the Administrator-General for the year (Statement-C)

(iv) Statement showing particulars of assets remaining in the hands of the Administrator-General for twelve years or upwards which have to be finally credited to Government (Statement-D)

(v) Statement of remittances to foreign countries during the year for which acknowledgments have not been received (Statement-E).

(vi) Statement showing sums below Rs.10 in amount at credit of different estates and trusts for which There are no claimants (Statement-F).

(vii) Statement showing sums below Rs.10 in amount at debit of different estates the recovery of which is hopeless (Statement-G)

(viii) Statement showing sums above Rs.10 in amount at debit of estates the recovery of which is hopeless (Statement-H)

(ix) Memorandum of law costs for the year(Statement-I)

(x) Statement showing balances of Rs.500 and upwards on the last day of the year with reasons for non-investment (Statement-K).

(3) The Controller, State Accounts Department, Bangalore, shall be entitled to remuneration for his services in connection with each yearly audit, at such rates as may be fixed by the Government from time to time. The said remuneration shall be defrayed by all the estates.

(4) (a) The fee due to the Administrator-General under sub-rule (4) of rule 11 for the preparation of the yearly schedules, together with the costs and expenses of printing and publishing the said schedules and the copies thereof, shall be defrayed by all the estates, to which such schedules relate, in proportion to the value of the transactions in each of the said estates, provided that the mere conversion of securities into cash and vice versa or a mere change of security shall not be deemed to be a transaction for the purposes of this clause.

the fee of the Administrator-General under clause (a) of this sub-rule shall be ascertained and settled by the auditor or auditors and shall be paid out of the estates accordingly by the Administrator-General.

(5) When an estate is about to be closed, the Administrator-General may call upon the auditor or auditors to ascertain and fix a definite sum to be retained by the Administrator-General to defray the costs and expenses referred to in sub-rule (4) in respect of the estate in question. The sum thus fixed by the auditor or auditors shall be treated as the proportion of the above charges to be contributed by the estate in question. The sum so fixed shall be immediately transferred to a separate account called " The closed estates audit, etc., charges, accounts" and appropriated towards the audit charges, fees for the preparation of the schedules and charges for printing and publication of the same when they become payable.

13) Notice on Completion of Account of the estate: - (1) when the administration of an estate is completed and the accounts of the estate have been closed and audited and no claim thereto has Ben put forward, the fact of such completion and closure shall be notified in the Karnataka Gazette, with the particulars of the amounts remaining unclaimed and, if ascertainable, the names of the person or persons prima facie entitled to the same. The notice shall further state that the amounts will be transferred to the Government if they are not claimed within a period of twelve years from the date of the Notification. The period of twelve years specified in section 51,shall be reckoned from the date of such Notification.

(2) All unclaimed assets transferable to the credit of Government under Section 51 shall be remitted to the State Huzur Treasury.

(3) Any person claiming payment of the same under section 52 shall establish his claim to the satisfaction of the Government. 14) Procedure to be followed after closing an administration of an estate: - The Administrator General may, after closing the administration of any estate in his hands destroy any private papers, bills, receipts, memoranda and other similar documents of no value which he has received along with the estate and which are not claimed by the beneficiaries, next of kin or any other persons entitled thereto within three months after such closing has taken place.

15) Litigation in connection with an estate: -Without the sanction of the Government the Administrator General shall not enter upon any litigation in connection with an estate in his charge, the expenses of which are likely to exceed the assets of the estate already in his hands, unless he is properly and sufficiently indemnified against such expenses.

Explanation:-By "proper and sufficient indemnity" means indemnity sufficient to cover all probable costs and consisting in the deposit of Government securities, cash or jewels to an amount to be determined by the Administrator-General.

16) Remittance of fee: - If, in any case, it appears to the Administrator-General that the circumstances of an estate proposed to be administered by him or probably will be such as to render his duties in relating thereto exceptionally simply or otherwise of an exceptional character, justifying this course, he may with the previous sanction of Government, remit any part, not exceeding one- half of any specified fee.

17) Sanction of the Government for expenditure in certain case: - (1) If any expenditure has to be incurred by the Administrator-General in connection with the administration of estates and it cannot be met out of the funds held by him in his personal deposit account (which he is permitted to open under sub-rule (2) of rule 9), sanction of the Government in each case shall be obtained and the amounts sanctioned by Government drawn in ordinary contingent, Bill forms.

(2) If the Government orders recovery of such expenditure from a private party, the recovery shall be made by the Administrator-General and accounted for by him either as an abatement of charge or as revenue under "0070 Other Administrative Services-01-Administration of justice-101- Services and Service Fees" according to the recovery is made before or after the close of the year in which the expenditure is incurred.

18) Record of Cases:- The Administrator-General shall maintain a record of all cases in which the properties of estates are kept under the care and custody of the Administrator-General or left in the custody of a beneficiary or any other person for his use or occupation with or without an undertaking to produce whenever necessary. A register in Form 24 shall be kept for the purpose.

Such properties shall be checked at least once in a year either by the Administrator-general or by the Deputy Administrator-General with the inventory thereof and a certificate to that effect shall be entered in the said register.

19) Recouping of debt:-The Administrator-General may recoup from out of the contingent grant made to his office, sums below Rs.10 at debit of any estate, the recovery of which is doubtful or impossible.

20) Registers etc., to be maintained by the Administrator-General:- (a) The Administrator General shall maintain the following Registers etc.,

entered all the out standings due to an estate

in the shape of book debts, promissory notes,

mortgages, pledge, etc.,

7. stock book of jewellery, trinkets and other 11

valuables belonging to each estate.

8. Register of Government and other 12

securities belonging to each estate.

9. Register of rent and lease amounts 13

collected from immovable properties.

10. Register of suits and proceedings to which 14

the Administrator General is a party.

11. Register of Commission and fees collected 15

and credited to Government monthly.

12. Receipt book. 16

13. Income Tax refund register in which shall be 17

entered all particulars regarding application

made to Income Tax Officers concerned for refund

of Income tax deducted and the particulars

of all refunds realized.

14. Assessment register in which shall be entered 18

particulars of all taxes, quit rents, kists, etc.,

paid in respect of immovable properties.

15. Periodical payment register in which 19

shall be entered particulars of all

payments made to beneficiaries, etc.,

periodically.

16. Register of buildings and fixtures in 20

which shall be entered particulars of

all house properties, particulars of fix-

tures and movable belonging to each

building, repairs and improvements

effected to each building, and the value

thereof.

17. Register of claims in which shall be 21

recorded all claims made against the

various estates, whether admitted or

rejected.

18. Register of certificates issued 22

under sections 29 and 30 of

the Administrators General Act.

19. Register of amounts to be , 23

transferred to Government.

20. Register of properties locked 24

and sealed or left in the custody

of the beneficiaries.

(b) Every payment charged in the Administrator General's Cash amount shall be supported by a corresponding voucher, which shall be passed for payment under the initials of the Administrator General.

21) Repeal and Savings: - The Administrator General (Mysore) Rules, 1952, are hereby repealed.

Provided that the repeal shall not affect:-

(a) the previous operation of the rule so repealed or anything duly done or suffered there under; or

(b)any right, privilege, obligation or liability acquired, accrued or incurred under the rule so repealed:

Provided further that subject to the preceding provision, anything done or any action taken (including any notification, order, instruction or direction issued), under any such rule shall be deemed to have been done or taken under the corresponding provisions of these rules, and shall continue to be in force accordingly, unless and until superseded by anything done or any action taken under the Act or these rules, as the case may be.

IMPORTANT INSTRUCTIONS

1. The holder of the certificate has, in respect of the assets specified herein, the same powers and duties and is subject to the same liabilities as if letters of Administration had been granted to him, except that he need not file accounts or inventories or assets in a Court of Law or other authority or execute any bond for the due administration of the estate unless he is a creditor of the estate. Administrator-General creditor may have to give reasonable security, if so required by the Administrator-General .

2. All persons making payments to the certificate holder in good faith, of their debts or the dues to the deceased's estate, will stand legally discharged of their liabilities to the estate, to the extent of such payments.

3. The Administrator General may revoke the certificate if it is afterwards found that the certificate was obtained by fraud or misrepresentation made to him or by moans of an untrue allegation of a fact essential in law to justify the grant, though such allegation was made in ignorance or inadvertently.

4. When notice of revocation of the certificate is received, the certificate holder should deliver up the certificate to the Administrator General. He will not be entitled to the refund of the fee paid, THERE ON.

5. If the certificate holder willfully or without reasonable cause omits to surrender the certificate on revocation, he SHALL be punishable with imprisonment which may extent to three months or with fine which may extend to one thousand rupees or with both.

ಆದ್ದರಿಂದ, ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ನಿಯಮಾವಳಿ, 1966 ನಿಯಮ 147 (ಸಿ) ರೊಡನೆ ಓದಲಾದ ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ಅಧಿನಿಯಮ, 1964ರ 194ನೆಯ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣದ (ii)ನೇ ಬಾಬ್ತಿನಿಂದ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಪೂರ್ಣ ಭೂ ಕಂದಾಯ ಮೊತ್ತ ರೂ.4,58,903 ಹಾಗೂ ಅರ್ಧದಷ್ಟು ಭೂ ಕಂದಾಯ ರೂ.57,760.51 ಹೀಗೆ ಒಟ್ಟು ಭೂ ಕಂದಾಯ ರೂ.05.16,664.36 (ರೂಪಾಯಿ ಐದು ಲಕ್ಷದ ಹದಿನಾರು ಸಾವಿರದ ಆರು ನೂರ ಅರವತ್ತಾ ನಾಲ್ಕು ಮತ್ತು ಪೈಸೆ ಮೂವತ್ತಾರು ಮಾತ್ರ) ಗಳನ್ನು ಸರ್ಕಾರವು ಈ

ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಸ್ಪರ್ಧಾತ್ಮಕ ಪರೀಕ್ಷೆ ಮೂಲಕ ನೇರ ನೇಮಕಾತಿ ಮತ್ತು ಆಯ್ಕೆ) (ಸಾಮಾನ್ಯ) ನಿಯಮಗಳು, 2006, ಇದನ್ನು ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವುದಕ್ಕೆ ದಿನಾಂಕ:02.02.2011ರ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಆಸುಇ 50 ಸೇವನೆ 2010ರಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವ ಈ ಮುಂದಿನ ನಿಯಮಗಳ ಕರಡನ್ನು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಇದರ ಪ್ರಕಟಣೆಯ ದಿನಾಂಕದಿಂದ 15 ದಿನಗಳೊಳಗಾಗಿ ಅದರಿಂದ ಭಾದಿತರಾಗುವ ಸಂಭವವಿರುವ ಎಲ್ಲ ವ್ಯಕ್ತಿಗಳಿಂದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ದಿನಾಂಕ:03.03.2011ರ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದ ಭಾಗ-IVಎ ರಲ್ಲಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವಾ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14)ರ 3ನೇ ಪ್ರಕರಣದ (2)ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯ ಪಡಿಸಲಾದಂತೆ ಪ್ರಕಟಿಸಲಾಗಿರುವುದರಿಂದ;

ಸದರಿ ರಾಜ್ಯಪತ್ರವನ್ನು 03.03.2011ರಂದು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಿರುವುದರಿಂದ;

ಮತ್ತು ಸದರಿ ಕರಡಿನ ಬಗ್ಗೆ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ/ ಸಲಹೆಗಳು ರಾಜ್ಯ ಸರ್ಕಾರದಲ್ಲಿ ಸ್ವೀಕೃತವಾಗಿರುವುದಿಲ್ಲ.

ಆದ್ದರಿಂದ, ಈಗ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ, 14)ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಿಕೊಂಡ 3ನೆ ಪ್ರಕರಣದ (1)ನೆ ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ;-ಭಾಗ - ೪ಎ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಆಗಸ್ಟ್ ೧೮, ೨೦೧೧ ೧೫೪೫

ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಸ್ಪರ್ಧಾತ್ಮಕ ಪರೀಕ್ಷೆ ಮೂಲಕ ನೇರ ನೇಮಕಾತಿ ಮತ್ತು ಆಯ್ಕೆ) (ಸಾಮಾನ್ಯ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2011 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಈ ನಿಯಮಗಳು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ನಿಯಮ 6ಕ್ಕೆ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಸ್ಪರ್ಧಾತ್ಮಕ ಪರೀಕ್ಷೆ ಮೂಲಕ ನೇರ ನೇಮಕಾತಿ ಮತ್ತು ಆಯ್ಕೆ) (ಸಾಮಾನ್ಯ) ನಿಯಮಗಳು, 2006ರ ನಿಯಮ 6ರ ಖಂಡ ಬಿ, ಉಪಖಂಡ (i)ರಲ್ಲಿನ ಅಂಶ (ಎ) ಯಲ್ಲಿನ ಶೀರ್ಷಿಕೆ ``ಪತ್ರಿಕೆ-1'' ಮತ್ತು ಅದಕ್ಕೆ ಸಂಬಂಧಪಟ್ಟ ನಮೂದುಗಳನ್ನು ಕೆಳಕಂಡಂತೆ ಪ್ರತಿಸ್ಥಾಪಿಸಲಾಗಿದೆ. ಅಂದರೆ:

``ಪತ್ರಿಕೆ-1- ನಿಗದಿಪಡಿಸಿದ ಅರ್ಹತಾ ಪರೀಕ್ಷೆಯಲ್ಲಿ ಉತ್ತೀರ್ಣನಾದ ಒಬ್ಬ ವ್ಯಕ್ತಿಯಿಂದ ನಿರೀಕ್ಷಿಸಬಹುದಾದ ಸಾಮಾನ್ಯ ಜ್ಞಾನಕ್ಕೆ ಸಂಬಂಧಪಟ್ಟ ವಿಷಯಗಳಾದ ಪ್ರಚಲಿತ ವಿದ್ಯಮಾನಗಳು, ಸಾಮಾನ್ಯ ವಿಜ್ಞಾನಗಳು, ಭಾರತದ ಇತಿಹಾಸ, ಭಾರತದ ಭೂಗೋಳ, ಸಮಾಜ ವಿಜ್ಞಾನ, ಪ್ರತಿದಿನ ಗಮನಿಸುವ ವಿಷಯಗಳು, ಪ್ರಾಯೋಗಿಕ ಜ್ಞಾನ ಮತ್ತು ಸಾಮಾನ್ಯ ಬೌದ್ಧಿಕ ಸಾಮರ್ಥ್ಯಗಳನ್ನು ಒಳಗೊಂಡಿರುವ ಸಾಮಾನ್ಯ ಪತ್ರಿಕೆ.''

Whereas the draft of the Karnataka Civil Services (Direct Recruitment by competitive examinations and selection) (General) Rules, 2006, was published as required by clause (a) of sub-section (2) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No.DPAR 50 SCR 2010, Dated:02.02.2011 in Part IV-A of the Karnataka Gazette Extraordinary No.2515 Dated:3rd March, 2011 inviting objections and suggestions from all persons likely to be affected thereby within 15 days from the date of its publication in the official gazette.

Whereas the said gazette was made available to the public on 3rd March 2011.

And whereas no objections and suggestions have been received in this behalf by the State Government.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) the Government of Karnataka hereby makes the following rules,namely:

RULES

1. Title and Commencement: (1) These rules may be called the Karnataka Civil Services (Direct Recruitment by Competitive Examinations and Selection) (General) (..................Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 6.- In the Karnataka Civil Services (Direct Recruitment by Competitive Examinations and Selection) (General) Rules, 2006 in rule 6 in clause (B), in sub-clause (i), in item (a), for the heading "Paper-I" and entries relating thereto the following shall be substituted, namely:-

"Paper-1-General Paper covering General Knowledge of topics relating to current events, General Sciences, Indian History, Indian Geography, Social Science, matters of every day observation, practical knowledge and general Mental ability as may be expected of a person who has passed the prescribed qualifying examination."

1. As per the announcement made in the Budget Speech 2011-12, the Department of Rural Development and Panchayat Raj has issued a Government order No. ಗ್ರಾಅಪ 46 ಆರ್ಆರ್‌ಸಿ 2011, ದಿನಾಂಕ:11.03.2011 with Cabinet's approval for rejuvenation of tanks in the state. In view of time constraint, it has been decided by the Cabinet that 4(g) exemption may be given for preparation of estimates and DPRs. Finalisation of agencies has to be done by the Empowered Committee headed by the Chief Secretary.

Proposals from the District level committees have been obtained and on the basis of their recommendation the Empowered Committee has resolved to give exemption under 4(g) of the KTPP Act, to the Department of RD & PR in respect of the following agencies.

3. Fee for individual estimate/ DPR will be decided by the District Committee, based on the technical features of the work, subject to an upper limit of 0.7% of the value of estimate.

4. This is further subject to the condition that the estimate and DPR so prepared will be technically scrutinized and sanctioned by the competent authority after giving administrative approval. The Final Instalment of the fee should be paid only after technical sanction.

5. The District Committee must ensure that the estimates/ DPRs are of good quality and reasonable fee is paid for that.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಭದ್ರಾವತಿ ವಿಭಾಗ, ಭದ್ರಾವತಿ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

4) ಮೇಲ್ಕಂಡ ಅಧಿನಿಯಮ 15ನೇ ಪ್ರಕರಣದ ಪ್ರಕಾರ ಬಾಧಿತವಾದ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸದರಿ ಅಧಿನಿಯಮದ ಕಲಂ 16(2)ನೇ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಜಿಲ್ಲಾ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಬಹುದು.

2) ಮೇಲಿನ ಅನುಸೂಚಿತ ಪ್ರದೇಶಗಳ ಸಂಕ್ಷಿಪ್ತ ಸರಹದ್ದುಗಳು ಈ ಕೆಳಗಿನಂತಿವೆ.

ಇವರು ಮೇಲಿನ ಪ್ರದೇಶದ ಮೇಲೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಗೆ ಇರಬಹುದೆನ್ನಲಾದ ಹಕ್ಕುಬಾದ್ಧತೆಗಳನ್ನು ತೀರ್ಮಾನಿಸುವರು. ಭದ್ರಾವತಿ ಅರಣ್ಯ ವಿಭಾಗದ ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಯವರು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಸರ್ಕಾರವನ್ನು ಪ್ರತಿಪಾಧಿಸುವರು.

4) ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಯವರ ತೀರ್ಮಾನದ ಮೇಲಿನ ಅಹವಾಲುಗಳನ್ನು ಕರ್ನಾಟಕ ಅರಣ್ಯ ಕಾಯ್ದೆ (16) ರಂತೆ ಇತ್ಯರ್ಥ ಮಾಡಿಕೊಳ್ಳಬಹುದಾಗಿದೆ.

ಅಧಿಸೂಚನೆ

1) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(1)(ಸಿ) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ, ಬೆಳಗಾವಿ ಉಪ ವಿಭಾಗ, ಬೆಳಗಾವಿ ಇವರನ್ನು ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳನ್ನಾಗಿ ನೇಮಿಸಲಾಗಿದೆ. ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು ಮೇಲೆ ನಮೂದಿಸಿರುವ ಪ್ರದೇಶದ ಮೇಲೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಗೆ ಇರಬಹುದಾಗಿರುವ ಹಕ್ಕು ಬಾದ್ಯತೆಗಳನ್ನು ಇತ್ಯರ್ಥಗೊಳಿಸಿ, ನಿರ್ಧರಿಸಿ ವಿಚಾರಣೆ ಮಾಡಿ ತೀರ್ಮಾನಿಸುವುದು.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಬೆಳಗಾವಿ ವಿಭಾಗ, ಬೆಳಗಾವಿ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

1) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(1)(ಸಿ) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ, ಚಿಕ್ಕಮಗಳೂರು ಉಪ ವಿಭಾಗ, ಚಿಕ್ಕಮಗಳೂರು ಇವರನ್ನು ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳನ್ನಾಗಿ ನೇಮಿಸಲಾಗಿದೆ. ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು ಮೇಲೆ ನಮೂದಿಸಿರುವ ಪ್ರದೇಶದ ಮೇಲೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಗೆ ಇರಬಹುದಾಗಿರುವ ಹಕ್ಕು ಬಾದ್ಯತೆಗಳನ್ನು ಇತ್ಯರ್ಥಗೊಳಿಸಿ, ನಿರ್ಧರಿಸಿ ವಿಚಾರಣೆ ಮಾಡಿ ತೀರ್ಮಾನಿಸುವುದು.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಕೊಪ್ಪ ವಿಭಾಗ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

4) ಮೇಲ್ಕಂಡ ಅಧಿನಿಯಮ 15ನೇ ಪ್ರಕರಣದ ಪ್ರಕಾರ ಬಾಧಿತವಾದ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸದರಿ ಅಧಿನಿಯಮದ ಕಲಂ 16(2)ನೇ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಜಿಲ್ಲಾ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಬಹುದು.

5) ಇತರೆ ಸವಲತ್ತುಗಳು: ಉದ್ದೇಶಿತ "ಮೀಸಲು ಅರಣ್ಯ" ಪ್ರದೇಶದಲ್ಲಿ ಸ್ಥಳೀಯ ನಿವಾಸಿಗಳಿಗೆ ಎಳೆಯ ನೆಡುತೋಪು ಪ್ರದೇಶಗಳನ್ನು ಹೊರತುಪಡಿಸಿ ಉಳಿದ ಪ್ರದೇಶಗಳಲ್ಲಿ ತಮ್ಮ ಜಾನುವಾರು ಗಳಿಗೆ ಉಚಿತವಾಗಿ ಹುಲ್ಲು ಮೇಯಿಸಲು ಹಾಗೂ ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ಉಚಿತವಾಗಿ ಒಣ ಎಲೆ ಮತ್ತು ಒಣ ಸೌದೆಯನ್ನು ಸಂಗ್ರಹಿಸಲು ಅವಕಾಶವಿರುತ್ತದೆ.

6) ಉದ್ದೇಶಿತ "ಮೀಸಲು ಅರಣ್ಯ" ಪ್ರದೇಶದ ಪ್ರತಿ ಬ್ಲಾಕ್‌ಗೆ ಸಂಬಂಧಿಸಿದ ಸಂಕ್ಷಿಪ್ತ ಸರಹದ್ದು ವಿವರಣೆ ಮತ್ತು ಸವಿವರವಾದ ಸರಹದ್ದು ವಿವರಗಳನ್ನು ಮುಂದೆ ವಿವರಿಸಿದೆ.

1) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(1)(ಸಿ) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ, ಚಿಕ್ಕಮಗಳೂರು ಉಪ ವಿಭಾಗ, ಚಿಕ್ಕಮಗಳೂರು ಇವರನ್ನು ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳನ್ನಾಗಿ ನೇಮಿಸಲಾಗಿದೆ. ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು ಮೇಲೆ ನಮೂದಿಸಿರುವ ಪ್ರದೇಶದ ಮೇಲೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಗೆ ಇರಬಹುದಾಗಿರುವ ಹಕ್ಕು ಬಾದ್ಯತೆಗಳನ್ನು ಇತ್ಯರ್ಥಗೊಳಿಸಿ, ನಿರ್ಧರಿಸಿ ವಿಚಾರಣೆ ಮಾಡಿ ತೀರ್ಮಾನಿಸುವುದು.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಕೊಪ್ಪ ವಿಭಾಗ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

4) ಮೇಲ್ಕಂಡ ಅಧಿನಿಯಮ 15ನೇ ಪ್ರಕರಣದ ಪ್ರಕಾರ ಬಾಧಿತವಾದ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸದರಿ ಅಧಿನಿಯಮದ ಕಲಂ 16(2)ನೇ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಜಿಲ್ಲಾ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಬಹುದು.

5) ಇತರೆ ಸವಲತ್ತುಗಳು:- ಉದ್ದೇಶಿತ "ಮೀಸಲು ಅರಣ್ಯ" ಪ್ರದೇಶದಲ್ಲಿ ಸ್ಥಳೀಯ ನಿವಾಸಿಗಳಿಗೆ ಎಳೆಯ ನೆಡುತೋಪು ಪ್ರದೇಶಗಳನ್ನು ಹೊರತುಪಡಿಸಿ ಉಳಿದ ಪ್ರದೇಶಗಳಲ್ಲಿ ತಮ್ಮ ಜಾನುವಾರು ಗಳಿಗೆ ಉಚಿತವಾಗಿ ಹುಲ್ಲು ಮೇಯಿಸಲು ಹಾಗೂ ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ಉಚಿತವಾಗಿ ಒಣ ಎಲೆ ಮತ್ತು ಒಣ ಸೌದೆಯನ್ನು ಸಂಗ್ರಹಿಸಲು ಅವಕಾಶವಿರುತ್ತದೆ. ಎನ್‌ಕ್ಲೋಷರ್‌ಗಳಲ್ಲಿರುವ ನಿವಾಸಿಗಳು ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ರಸ್ತೆಯ ಹಕ್ಕನ್ನು ಹೊಂದಿರುತ್ತಾರೆ. ಕಂದಾಯ ಇಲಾಖೆಯಿಂದ ದಿನಾಂಕ:05-06-2002 ರ ವರೆಗೆ ನೀಡಿರುವ ಸೊಪ್ಪಿನಬೆಟ್ಟ ಹಕ್ಕನ್ನು ಹಾಗೆಯೇ ಮುಂದುವರೆಸಲಾಗಿದೆ.

1) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(1)(ಸಿ) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ, ತರೀಕೆರೆ ಉಪ ವಿಭಾಗ, ತರೀಕೆರೆ ಇವರನ್ನು ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳನ್ನಾಗಿ ನೇಮಿಸಲಾಗಿದೆ. ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು ಮೇಲೆ ನಮೂದಿಸಿರುವ ಪ್ರದೇಶದ ಮೇಲೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಗೆ ಇರಬಹುದಾಗಿರುವ ಹಕ್ಕು ಬಾದ್ಯತೆಗಳನ್ನು ಇತ್ಯರ್ಥಗೊಳಿಸಿ, ನಿರ್ಧರಿಸಿ ವಿಚಾರಣೆ ಮಾಡಿ ತೀರ್ಮಾನಿಸುವುದು.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಕೊಪ್ಪ ವಿಭಾಗ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

4) ಮೇಲ್ಕಂಡ ಅಧಿನಿಯಮ 15ನೇ ಪ್ರಕರಣದ ಪ್ರಕಾರ ಬಾಧಿತವಾದ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸದರಿ ಅಧಿನಿಯಮದ ಕಲಂ 16(2)ನೇ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಜಿಲ್ಲಾ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಬಹುದು.

ದಕ್ಷಿಣ: ಸೀಮಾರೇಖೆಯು ಸ್ಥಾನ ಸಂಖ್ಯೆ 26 ರಿಂದ 1⁸70 ಕೋನ 2-70 ಸರಪಳಿ ಚಲಿಸಿ ಸರ್ವೆ ನಂಬರ್ 57 ರ ಆಗ್ನೇಯ ಮೂಕುಪ್ಪೆ ಬಾಂದಿನಲ್ಲಿ ಸ್ಥಿರವಾಗಿರುವ ಸ್ಥಾನ ಸಂಖ್ಯೆ 27 ನ್ನು ಸೇರಿ ನಂತರ ಸರ್ವೆ ನಂಬರ್ 57 ಹಾಗೂ ಹೊನ್ನೆಕೊಡಿಗೆ ಗ್ರಾಮದ ಸಾಲೂರು ಕಿರು ಅರಣ್ಯದ ಸಾಮಾನ್ಯ ಗಡಿಯಲ್ಲಿ 29-45 ಸರಪಳಿ ಚಲಿಸಿ ಹಂದೂರು, ವರ್ಕಾಟೆ ಹಾಗೂ ಹೊನ್ನೆಕೂಡಿಗೆ ಗ್ರಾಮಗಳ ಗಡಿಯಲ್ಲಿ ದ್ವಿಕುಪ್ಪೆ ಬಾಂದುವಿನಲ್ಲಿ ಸ್ಥಿರವಾಗಿರುವ ಸ್ಥಾನ ಸಂಖ್ಯೆ:28 ನ್ನು ಸೇರುತ್ತದೆ.

ಅಧಿಸೂಚನೆ

1) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(1)(ಸಿ) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ, ತರೀಕೆರೆ ಉಪ ವಿಭಾಗ, ತರೀಕೆರೆ ಇವರನ್ನು ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳನ್ನಾಗಿ ನೇಮಿಸಲಾಗಿದೆ. ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು ಮೇಲೆ ನಮೂದಿಸಿರುವ ಪ್ರದೇಶದ ಮೇಲೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಗೆ ಇರಬಹುದಾಗಿರುವ ಹಕ್ಕು ಬಾದ್ಯತೆಗಳನ್ನು ಇತ್ಯರ್ಥಗೊಳಿಸಿ, ನಿರ್ಧರಿಸಿ ವಿಚಾರಣೆ ಮಾಡಿ ತೀರ್ಮಾನಿಸುವುದು.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಕೊಪ್ಪ ವಿಭಾಗ, ಕೊಪ್ಪ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

4) ಮೇಲ್ಕಂಡ ಅಧಿನಿಯಮ 15ನೇ ಪ್ರಕರಣದ ಪ್ರಕಾರ ಬಾಧಿತವಾದ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸದರಿ ಅಧಿನಿಯಮದ ಕಲಂ 16(2)ನೇ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಜಿಲ್ಲಾ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಬಹುದು.

5) ಇತರೆ ಸವಲತ್ತುಗಳು:- ಉದ್ದೇಶಿತ "ಮೀಸಲು ಅರಣ್ಯ" ಪ್ರದೇಶದಲ್ಲಿ ಸ್ಥಳೀಯ ನಿವಾಸಿಗಳಿಗೆ ಎಳೆಯ ನೆಡುತೋಪು ಪ್ರದೇಶಗಳನ್ನು ಹೊರತುಪಡಿಸಿ ಉಳಿದ ಪ್ರದೇಶಗಳಲ್ಲಿ ತಮ್ಮ ಜಾನುವಾರುಗಳಿಗೆ ಉಚಿತವಾಗಿ ಹುಲ್ಲು ಮೇಯಿಸಲು ಹಾಗೂ ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ಉಚಿತವಾಗಿ ಒಣ ಎಲೆ ಮತ್ತು ಒಣ ಸೌದೆಯನ್ನು ಸಂಗ್ರಹಿಸಲು ಅವಕಾಶವಿರುತ್ತದೆ. ಎನ್‌ಕ್ಲೋಷರ್‌ಗಳಲ್ಲಿರುವ ನಿವಾಸಿಗಳು ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ರಸ್ತೆಯ ಹಕ್ಕನ್ನು ಹೊಂದಿರುತ್ತಾರೆ. ಕಂದಾಯ ಇಲಾಖೆೆಯಿಂದ ದಿನಾಂಕ:05-06-2002 ರ ವರೆಗೆ ನೀಡಿರುವ ಸೊಪ್ಪಿನಬೆಟ್ಟ ಹಕ್ಕನ್ನು ಹಾಗೆಯೇ ಮುಂದುವರೆಸಲಾಗಿದೆ.

6) ಉದ್ದೇಶಿತ "ಮೀಸಲು ಅರಣ್ಯ" ಪ್ರದೇಶದ ಪ್ರತಿ ಬ್ಲಾಕ್‌ಗೆ ಸಂಬಂಧಿಸಿದ ಸಂಕ್ಷಿಪ್ತ ಸರಹದ್ದು ವಿವರಣೆ ಮತ್ತು ಸವಿವರವಾದ ಸರಹದ್ದು ವಿವರಗಳನ್ನು ಮುಂದೆ ವಿವರಿಸಿದೆ.

2) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 4(2) ಪ್ರಕಾರ ಸರ್ಕಾರವು ಉಪ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು, ಕೊಪ್ಪ ವಿಭಾಗ, ಕೊಪ್ಪ ಇವರನ್ನು ಈ ವಿಚಾರಣೆಯಲ್ಲಿ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳಿಗೆ ಸಹಕರಿಸಲು ಹಾಗೂ ಅರಣ್ಯ ಇಲಾಖೆಯನ್ನು ಪ್ರತಿನಿಧಿಸಲು ನೇಮಿಸಿದೆ.

3) ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಕಲಂ 11, 12 ಮತ್ತು 14ನೇ ಪ್ರಕರಣಗಳ ಪ್ರಕಾರ ಅರಣ್ಯ ವ್ಯವಸ್ಥಾಪನಾಧಿಕಾರಿಗಳು, ಈ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಬಾಧಿತ ವ್ಯಕ್ತಿಗಳು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಲು ಸದರಿ ಅಧಿನಿಯಮ ಕಲಂ 16(1)ನೇ ಪ್ರಕಾರ ಕರ್ನಾಟಕ ಕಂದಾಯ ಮೇಲ್ಮನವಿ ನ್ಯಾಯ ಮಂಡಳಿಗೆ ಅಧಿಕಾರವಿರುತ್ತದೆ.

4) ಮೇಲ್ಕಂಡ ಅಧಿನಿಯಮ 15ನೇ ಪ್ರಕರಣದ ಪ್ರಕಾರ ಬಾಧಿತವಾದ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸದರಿ ಅಧಿನಿಯಮದ ಕಲಂ 16(2)ನೇ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ 3 ತಿಂಗಳೊಳಗೆ ಜಿಲ್ಲಾ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಬಹುದು.

5) ಇತರೆ ಸವಲತ್ತುಗಳು:- ಉದ್ದೇಶಿತ "ಮೀಸಲು ಅರಣ್ಯ" ಪ್ರದೇಶದಲ್ಲಿ ಸ್ಥಳೀಯ ನಿವಾಸಿಗಳಿಗೆ ಎಳೆಯ ನೆಡುತೋಪು ಪ್ರದೇಶಗಳನ್ನು ಹೊರತುಪಡಿಸಿ ಉಳಿದ ಪ್ರದೇಶಗಳಲ್ಲಿ ತಮ್ಮ ಜಾನುವಾರು ಗಳಿಗೆ ಉಚಿತವಾಗಿ ಹುಲ್ಲು ಮೇಯಿಸಲು ಹಾಗೂ ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ಉಚಿತವಾಗಿ ಒಣ ಎಲೆ ಮತ್ತು ಒಣ ಸೌದೆಯನ್ನು ಸಂಗ್ರಹಿಸಲು ಅವಕಾಶವಿರುತ್ತದೆ. ಎನ್‌ಕ್ಲೋಷರ್‌ಗಳಲ್ಲಿರುವ ನಿವಾಸಿಗಳು ತಮ್ಮ ಸ್ವಂತ ಉಪಯೋಗಕ್ಕಾಗಿ ರಸ್ತೆಯ ಹಕ್ಕನ್ನು ಹೊಂದಿರುತ್ತಾರೆ. ಕಂದಾಯ ಇಲಾಖೆಯಿಂದ ದಿನಾಂಕ:05-06-2002 ರ ವರೆಗೆ ನೀಡಿರುವ ಸೊಪ್ಪಿನಬೆಟ್ಟ ಹಕ್ಕನ್ನು ಹಾಗೆಯೇ ಮುಂದುವರೆಸಲಾಗಿದೆ.
