ಚನ್ನಗಿರಿ ತಾಲ್ಲೂಕು ಉಪನೋಂದಣಾಧಿಕಾರಿಗಳ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಸ್ಥಿರಾಸ್ತಿಗಳ ಮೌಲ್ಯಮಾಪನ ಪಟ್ಟಿಯನ್ನು 2008-09ನೇ ಸಾಲಿನ ನಿಗಧಿಗೊಳಿಸಿದ್ದು ತದ ನಂತರ ದಿನಾಂಕ:19-07-2010 ರಂದು ಮಾನ್ಯಅಧ್ಯಕ್ಷರು ಹಾಗೂ ತಹಶೀಲ್ದಾರ್ ರವರು ಮಾರುಕಟ್ಟೆ ಮೌಲ್ಯಮಾಪನ ಸಮಿತಿ ಚನ್ನಗಿರಿ ರವರು ಪರಿಷ್ಕರಿಸಿದ ಚನ್ನಗಿರಿ ತಾಲ್ಲೂಕು ಉಪನೋಂದಣಾಧಿಕಾರಿಗಳ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಸ್ಥಿರಾಸ್ತಿಗಳ ಮೌಲ್ಯಮಾಪನ ಪಟ್ಟಿಯನ್ನು ತಾಲ್ಲೂಕು ಉಪಸಮಿತಿಯಲ್ಲಿ ಅನುಮೋದಿಸಿ ಸಭೆಯಲ್ಲಿ ನೀಡಿದ ನಿರ್ದೇಶನದ ಮೇರೆಗೆ ಶೇಕಡ 30% ಮತ್ತು ಅದಕ್ಕಿಂತ ಹೆಚ್ಚಿಗೆ ಅಂದರೆ ಶೇ.70.ರಷ್ಟು ಬೆಲೆಯನ್ನು ನಿರ್ಧರಿಸಿ ನಂತರ ದಿನಾಂಕ:23-08-2010 ರಂದು ಮಾನ್ಯ ಅಧ್ಯಕ್ಷರು ಹಾಗೂ ತಹಶೀಲ್ದಾರ ರವರ ಮಾರುಕಟ್ಟೆ ಮೌಲ್ಯ ಮಾಪನಾಸಮಿತಿ ಚನ್ನಗಿರಿ ರವರು ಈಗಾಗಲೇ ತುಂಬಾ ಹೆಚ್ಚಿಸಿರುವ ಪ್ರಯುಕ್ತ ಚರ್ಚಿಸಿ ಸ್ಥೀರಾಸ್ತಿಗಳ ಮತ್ತು ಪಟ್ಟಣ ಪಂಚಾಯಿತಿಗೆ ಒಳಪಡುವ ನಿವೇಶನಗಳ ಬೆಲೆಗಳನ್ನು ಶೇಕಡಾ 30% ರಿಂದ 80% ಮತ್ತು ಅವಶ್ಯಕ್ಕಿಂತ ಹೆಚ್ಚಿಗೆ ಹೆಚ್ಚಿಸಲು ಹಾಗೂ ಗ್ರಾಮಪಂಚಾಯಿತಿಗಳಿಗೆ ಒಳಪಡುವ ನಿವೇಶನಗಳ ಬೆಲೆಗಳನ್ನು 25 ರಿಂದ 80% ಹೆಚ್ಚಿಸಲು ಸಮಿತಿಯಲ್ಲಿ ಚರ್ಚಿಸಿ ಅನುಮೋದಿಸಿ ಅಂಗೀಕರಿಸಲಾಯಿತು. ತದನಂತರ ದಿನಾಂಕ:

23-08-2010 ರಂತೆ ಸೂಚನಾ ಫಲಕದಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿ 15 ದಿನಗಳ ಒಳಗಾಗಿ ಯಾವುದೇ ಅಕ್ಷೇಪಣೆ ಬಂದಿರುವುದಿಲ್ಲದ ಪ್ರಯುಕ್ತ ಅಂಗೀಕರಿಸಿ ಪರಿಷ್ಕರಿಸಲಾದ ಮಾರುಕಟ್ಟೆ ದರಪಟ್ಟಿಯನ್ನು ತಯಾರಿಸಿ ಸೂಚಿಸಿರುವ ಮೇರೆಗೆ ಪರಿಷ್ಕರಿಸಲು ತಮ್ಮಗಳ ಮುಂದಿನ ಕ್ರಮಕ್ಕಾಗಿ ಈ ಮೂಲಕ ಗೌರವ ಪೂರ್ವಕವಾಗಿ ಸಲ್ಲಿಸಿದೆ.

ನೋಂದಣಿ ಮತ್ತು ಮುದ್ರಾಂಕ ಇಲಾಖೆ

ಕೇಂದ್ರ ಮೌಲ್ಯ ಮಾಪನ ಸಮಿತಿ ಮೌಲ್ಯ ಮಾಪನಕ್ಕೇ ರಾಜ್ಯದಂತೆ ಅನುಸರಿಬೇಕಾದ ಪ್ರಸ್ತಾವಿಕ ಕಟ್ಟಡಗಳ ದರಗಳು

1) ಕರ್ನಾಟಕ ಮುದ್ರಾಂಕ ಕಾಯ್ದೆ 1957 ರಕಲಂ 45ಎ ವ್ಯಾಪ್ತಿಗೆ ಒಳಪಡುವ ದಸ್ತಾವೇಜುಗಳಲ್ಲಿ ತೋರಿಸಿದ ಸ್ವತ್ತುಗಳ ಅಳತೆ 5 ಗುಂಟೆ ಮತ್ತು 5 ಗುಂಟೆ ಒಳಗೆ ಇದ್ದರೆ ನಿವೇಶನಕ್ಕೇ ನಿಗದಿಪಡಿಸಿರುವ ಚದುರ ಅಡಿ:

ಯಾಡ್ 9 ಮೀಟರ್‌ಗಳಿಗೆ ಇರುವ ದರವನ್ನು ಬೆಲೆಯನ್ನು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

2) ವ್ಯವಸಾಯೇತರ ಉಪಯೋಗ ಮಾಡುತಿದ್ದುದು : ಉದ್ದೇಶಿಸಿದ್ದು: ಪರಿವರ್ತನೆಯಾಗಿದ್ದು ಅಭಿವೃದ್ದಿ ಹೊಂದದೆ ಇದ್ದ ಹತ್ತು ಗುಂಟೆ ಮೇಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳ ಬೆಲೆಯನ್ನು ಚದರ ಅಡಿ ಲೆಕ್ಕದ ಮೇಲೆ ಆಗವ ಒಟ್ಟು ಬೆಲೆಯ ಶೇ.60 ರಷ್ಟು ಮೊತ್ತವನ್ನು ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯೆಂದು ನಿರ್ಧರಿಸಲಾಗಿದೆ.

3) ಮೇಲ್ಕಂಡ ವ್ಯವಸಾಯೇತರ ಉಪಯೋಗದ ಜಮೀನುಗಳನ್ನು:ಸೈಟ್‌ಗಳನ್ನು ಹೊರತುಪಡಿಸಿ ಕೈಗಾರಿಕೆ ಕೋಳಿ ಸಾಗಣಿಕೆ :ಹೈನುಗಾರಿಕೆ ಉದ್ದೇಶಕ್ಕಾಗಿ ಉಪಯೋಗಿಸಲ್ಪಡುತ್ತಿರುವ:ಉದ್ದೇಶಿತ:ಪರಿವರ್ತನೆಯ ಜಮೀನುಗಳ ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯನ್ನು ಸದ್ರಿ ಪ್ರದೇಶದಲ್ಲಿರುವ ವ್ಯವಸಾಯದ ಜಮೀನಿನ ಎರೆಡುಪಟ್ಟು ಎಂದು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

4) ಕೈಗಾರಿಕೆ ಕೋಳಿಸಾಗಣಿಕೆ ಹೈನುಗಾರಿಕೆ ಉದ್ದೇಶಕ್ಕಾಗಿ ಉಪಯೋಗಿಸಲ್ಪಡುತ್ತಿದ್ದು ಈಗಾಗಲೇ ಅಭಿವೃದ್ದಿಯಾಗಿರುವ ಅಂದರೆ ರಸ್ತೆ ವಿದ್ಯುತ್‌ಚ್ಚಕ್ತಿ ಒಳಚರಂಡಿ ಮುಂತಾದ ನಾಗಾರಿಕ ಸೌಲಭ್ಯಗಳನ್ನು ಹೊಂದಿರುವ ಪ್ರದೇಶದಲ್ಲಿ ಇರುವ ಜಮೀನುಗಳ ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯನ್ನು ಸದ್ರಿ ಪ್ರದೇಶದಲ್ಲಿಯ ನಿವೇಶನಕ್ಕಿರುವ ಚದರ ಅಡಿ ಮೇಲಿನ ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯ ಅರ್ಧದಷ್ಟು ಎಂದು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

5) ಪಹಣೆಯಲ್ಲಿ ಅಡಿಕೆ ಸಸಿ ಎಂದು ಬೆಳೆಕಾಲಂನಲ್ಲಿ ನಮೂದಿಸಲಾಗಿದ್ದಲ್ಲಿ ತೆಂಗಿನ ಬೆಲೆಯೆಂದು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

6) ಮೇಲ್ಕಂಡ ಎಲ್ಲಾ ಮಾರ್ಗ ಸೂಚಿಗಳು ಕರ್ನಾಟಕ ಮುದ್ರಾಂಕ ಕಾಯ್ದೆ 1957ರ ಕಲಂ 45ಎ ಮತ್ತು 45ಬಿ ಮತ್ತು ಇತರ ಸಂಬಂಧಿಸಿದ ನಿಯಮಗಳು ಸರ್ಕಾರದ ಸೂಚನೆಗಳಿಗೆ ಒಳಪಟ್ಟಿದೆ.

1) ಕರ್ನಾಟಕ ಮುದ್ರಾಂಕ ಕಾಯ್ದೆ 1957ರ ಕಲಂ 45ಎ ವ್ಯಾಪ್ತಿಗೆ ಒಳಪಡುವ ದಸ್ತಾವೇಜುಗಳಲ್ಲಿ ತೋರಿಸಿದ ಸ್ವತ್ತುಗಳ ಅಳತೆ 1 ಗುಂಟೆಯಿಂದ 10 ಗುಂಟೆ ಒಳಗೆ ಇದ್ದರೆ ಅನುಬಂಧ-1ರಲ್ಲಿ ತೋರಿಸಿರುವಂತೆ ದರದಂತೆ ಬೆಲೆಯನ್ನು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

2) ವ್ಯವಸಾಯೇತರ ಉಪಯೋಗ ಮಾಡುತ್ತಿದ್ದಿದ್ದು: ಉದ್ದೇಶಿಸಿದ್ದು: ಪರಿವರ್ತನೆಯಾಗಿದ್ದು ಅಭಿವೃದ್ಧಿ ಹೊಂದದೆ ಇದ್ದ 10 ಗುಂಟೆ ಒಳಗಿರುವ ಜಮೀನುಗಳ ಬೆಲೆಯನ್ನು ಚದರ ಅಡಿ ಲೆಕ್ಕದ ಮೇಲೆ ಆಗುವ ಒಟ್ಟು ಬೆಲೆಯ ಶೇಕಡಾ 60 ರಷ್ಟು ಮೊತ್ತವನ್ನು ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯೆಂದು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

3) ಮೇಲ್ಕಂಡ ವ್ಯವಸಾಯೇತರ ಉಪಯೋಗದ ಜಮೀನುಗಳನ್ನು: ಸೈಟುಗಳನ್ನು ಹೊರತುಪಡಿಸಿ ಕೈಗಾರಿಕೆ ಕೋಳಿ ಸಾಕಾಣಿಕೆ ಹೈನುಗಾರಿಕೆ ಉದ್ದೇಶಕ್ಕಾಗಿ ಉಪಯೋಗಿಸಲ್ಪಡುತ್ತಿರುವ: ಉದ್ದೇಶಿತ: ಪರಿವರ್ತನೆಯ ಜಮೀನುಗಳ ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯನ್ನು ಸದರಿ ಪ್ರದೇಶದಲ್ಲಿರುವ ವ್ಯವಸಾಯದ ಜಮೀನಿನ ಎರಡು ಪಟ್ಟು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

4) ಕೈಗಾರಿಕೆ, ಕೋಳಿ ಸಾಕಾಣಿಕೆ, ಹೈನುಗಾರಿಕೆ ಉದ್ದೇಶಕ್ಕಾಗಿ ಉಪಯೋಗಿಸಲ್ಪಟಡುತ್ತಿದ್ದ ಈಗಾಗಲೇ ಅಭಿವೃದ್ಧಿ ಆಗಿರುವ ಅಂದರೆ ರಸ್ತೆ, ವಿದ್ಯುತ್‌ಚಕ್ತಿ, ಒಳಚರಂಡಿ ಮುಂತಾದ ನಾಗರೀಕ ಸೌಲಭ್ಯಗಳನ್ನು ಹೊಂದಿರುವ ಪ್ರದೇಶದಲ್ಲಿ ಇರುವ ನಿವೇಶನಗಳಿಗೆ, ವಾಸೋಪಯೋಗಿ ನಿವೇಶನದ ದರದಲ್ಲಿ ಶೇಕಡಾ 50% ರಷ್ಟು ಕಡಿಮೆ ಮಾಡಿ ಬೆಲೆ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು.

5) ಮೇಲ್ಕಂಡ ವ್ಯವಸಾಯೇತರ ವಸತಿ ಉದ್ದೇಶಕ್ಕಾಗಿ ಪರಿವರ್ತನೆಯಾದ ಜಮೀನುಗಳು, ಅಂದರೆ ಸೈಟು, ರಸ್ತೆ, ಒಳಚರಂಡಿ ಮುಂತಾದ ನಾಗರೀಕ ಸೌಲಭ್ಯಗಳನ್ನು ಹೊಂದಿರದ ಜಮೀನುಗಳ ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯನ್ನು ಸದರಿ ಪ್ರದೇಶದಲ್ಲಿರುವ ವ್ಯವಸಾಯದ ಜಮೀನಿನ ಎರಡು ಪಟ್ಟು ಎಂದು ನಿರ್ಧರಿಸಲು ಸೂಚಿಸಲಾಗಿದೆ.

(ಸಿವಿಲ್) ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಪ್ರಕಟಿಸಲಾಗಿತ್ತು. ಸದರಿ ಅಧಿಸೂಚನೆಯ ವಿರುದ್ಧ ಶ್ರೀ ಬಿ.ಆರ್. ರವಿಕಾಂತೇಗೌಡ ಮತ್ತಿತರರು ಕೆ.ಎ.ಟಿ.ಯಲ್ಲಿ ಅರ್ಜಿ ಸಂಖ್ಯೆ: 149/2008ನ್ನು ಸಲ್ಲಿಸಿದ್ದು, ದಿನಾಂಕ:26-05-2009ರ ಆದೇಶದಲ್ಲಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿರುತ್ತದೆ.

" (i) Applications are allowed;

(ii) It is hereby declared that the impugned Rules, namely the "The Karnataka State Police Services including Ministerial Services (Recruitment) (Amendment) Rules, 2000" are prospective in nature and operate only from the date of their publication in the official gazette i.e., 12-6-2001.

(iii) The impugned seniority list pertaining to the cadre of DSP published by the Government by Notification-1 dated 20.12.2007 to the extent it relates to the Applicants and Respondents No.3 to 7 is set aside.

(iv) the Official Respondents shall re-draw the seniority list of DSP by placing the direct recruits above the promotees with reference to the date of their regular appointment / promotion to the cadre of DSP in the light of the observations made in this order;

(v) Time for re-drawing the seniority list : Three months."

(ಸಿವಿಲ್) ವೃಂದದ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಪ್ರಕಟಿಸಲಾಗಿದೆ. ಈ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿನ ಜೇಷ್ಠತೆಯಿಂದ ಬಾಧಿತರಾಗಬಹುದಾಂತಹ ಅಧಿಕಾರಿಗಳಿಂದ ಸಲಹೆ / ಆಕ್ಷೇಪಣೆಗಳಿದ್ದಲ್ಲಿ ಸರ್ಕಾರದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಗಳು, ಒಳಾಡಳಿತ ಇಲಾಖೆ, 2ನೇ ಮಹಡಿ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು, ಇವರಿಗೆ ಈ ಅಧಿಸೂಚನೆ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ 30 ದಿನಗಳೊಳಗಾಗಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದೆಂದೂ ಈ ಅವಧಿಯ ನಂತರ ಸ್ವೀಕರಿಸಿದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಪರಿಗಣಿಸಲಾಗುವುದಿಲ್ಲ ಎಂದೂ ಸೂಚಿಸಲಾಗಿತ್ತು.

ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯ ಬಗ್ಗೆ ಸ್ವೀಕೃತವಾದ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳನ್ನು ಕಡತದಲ್ಲಿ ಪರಿಶೀಲಿಸಲಾಗಿದೆ. ಆಕ್ಷೇಪಣೆಗಳಲ್ಲಿ ಪ್ರಮುಖವಾಗಿ i) ಬ್ಲಾಕ್‌ವೈಸ್ ವಿಂಗಡಣೆಯಾಗಿರುವ ರಿಕ್ತಸ್ಥಾನಗಳ ಲಭ್ಯತೆಗಳ ಬಗ್ಗೆ ii) ದಿನಾಂಕ:

21-7-2011ರಲ್ಲಿ 16-6-2011 ರಿಂದ ಬ್ಲಾಕ್ ಅವಧಿಯನ್ನು ನಮೂದಿಸಲಾಗಿದ್ದು, ಪ್ರಸ್ತುತ ತಾತ್ಕಾಲಿಕ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿಯೂ ಈ ಅವಧಿ ನಮೂದಾಗಿರುವುದರಿಂದ ಇವೆರಡನ್ನೂ ಒಟ್ಟುಗೂಡಿಸುವ ಬಗ್ಗೆ iii) ವೈಯುಕ್ತಿಕವಾಗಿ ಅಧಿಕಾರಿಗಳು ತಮ್ಮ ಹೆಸರು/ಜನ್ಮ ದಿನಾಂಕಗಳನ್ನು ಸರಿಪಡಿಸುವ ಬಗ್ಗೆ / ಪೂರ್ವಾನ್ವಯ ಮುಂಬಡ್ತಿಯ ದಿನಾಂಕಗಳನ್ನು ಸರಿಪಡಿಸುವ ಬಗ್ಗೆ ಇರುತ್ತದೆ. ಇದಲ್ಲದೆ ದಿ: 18-12-2009ರಲ್ಲಿ ಪ್ರಕಟಿಸಲಾದ ಡಿವೈ.ಎಸ್.ಪಿ. ವೃಂದದ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿನ ಜೇಷ್ಠತೆ ಬಗ್ಗೆ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳು ಸ್ವೀಕೃತವಾಗಿದೆ. ಆದರೆ ಈ ಬಗ್ಗೆ ಕರ್ನಾಟಕ ಆಡಳಿತ ನ್ಯಾಯ ಮಂಡಳಿಯ ಪೂರ್ಣಪೀಠವು ಅರ್ಜಿ ಸಂಖ್ಯೆ: 6628-6631/96 ದಿನಾಂಕ: 04-04-1997 ರಲ್ಲಿ ತೀರ್ಪು ನೀಡಿ ಅಂತಿಮಗೊಂಡ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಗಳು ಅರೆ ನ್ಯಾಯಾಲಿಕ ಪಟ್ಟಿಗಳಾಗುವುದರಿಂದ ಇದರಲ್ಲಿ ಯಾವುದೇ ಬದಲಾವಣೆ ಮಾಡಲು ಇಲಾಖೆಗೆ ಅಧಿಕಾರವಿರುವುದಿಲ್ಲವೆಂದು ನಿರ್ದೇಶನ ನೀಡಿದೆ.

ಮುಂಬಡ್ತಿ ಕೋಟಾದಡಿ ಲಭ್ಯವಾಗುವ ರಿಕ್ತಸ್ಥಾನಗಳನ್ವಯ Karnataka State Civil Services (Regulation of Promotion, Pay and Pension) Rules, 1973ರ ನಿಯಮ 4 ರಡಿಯಲ್ಲಿ ಪುನರ್ ಪರಿಶೀಲಿಸಲಾಗಿದ್ದು ಅರ್ಹತಾದಾಯಕ ದಿನಾಂಕವನ್ನು ನಿಗದಿಪಡಿಸಲಾಗಿದೆ. ಮುಂಬಡ್ತಿಗಳನ್ನು ಪುನರ್ ಪರಿಶೀಲಿಸಲಾಗಿದ್ದು ಮುಂಬಡ್ತಿ ನೀಡಲಾಗಿರುವ ಅಧಿಕಾರಿಗಳಿಗೆ ಮುಂಬಡ್ತಿ ಕೋಟಾದಡಿಯಲ್ಲಿ ಲಭ್ಯವಾಗುವ ಹುದ್ದೆಗಳ ಅನುಸಾರ, ಸರ್ಕಾರದ ಅಧಿಕೃತ ಜ್ಞಾಪನ ಸಂಖ್ಯೆ: ಡಿಪಿಎಆರ್ 48 ಎಸ್ಎಸ್ಆರ್ 75 ದಿನಾಂಕ: 05-7-1976 ಮತ್ತು ಸಿಆಸುಇ 43 ಸೇಸೇನಿ 87 ದಿನಾಂಕ:14-12-1987 ರನ್ವಯ ಅರ್ಹತಾ ದಿನಾಂಕಗಳನ್ನು ನಿಗದಿಪಡಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಅಂಶಗಳನ್ನು ಪರಿಗಣಿಸಿ ದಿನಾಂಕ: 13-6-2001 ರಿಂದ 31-12-2010ರ ವರೆಗಿನ ಅವಧಿಯ ರಿಕ್ತಸ್ಥಾನಗಳ ಬ್ಲಾಕ್‌ವೈಸ್ ವಿಂಗಡಣೆಯನ್ನು ಅನುಬಂಧ-1ರಲ್ಲಿ, ವಿವರಣಾತ್ಮಕ ಟಿಪ್ಪಣಿಗಳನ್ನು ಅನುಬಂಧ-2ರಲ್ಲಿ ಹಾಗೂ ದಿನಾಂಕ: 13-6-2001 ರಿಂದ 31-12-2010ರ ವರೆಗಿನ ಅವಧಿಯ ಡಿವೈ.ಎಸ್.ಪಿ. (ಸಿವಿಲ್) ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯನ್ನು ಅನುಬಂಧ-3ರಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಈ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿನ ಜೇಷ್ಠತೆಯು ಕರ್ನಾಟಕ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಬಾಕಿ ಇರುವ ರಿಟ್ ಅಪೀಲು ಸಂಖ್ಯೆ: 28578-591/2009 ಮತ್ತು 26731-42/2009, ಕರ್ನಾಟಕ ಆಡಳಿತ ನ್ಯಾಯಮಂಡಳಿಯಲ್ಲಿನ ಅರ್ಜಿ ಸಂಖ್ಯೆ: 148-151/2011 ಮತ್ತು 4382-4385/2011ರಲ್ಲಿ ಮತ್ತು ಈ ಸಂಬಂಧ ಮಾನ್ಯ ಸರ್ವೋಚ್ಚ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ದಾಖಲಾಗಿರುವ ಎಸ್.ಎಲ್.ಪಿ. ಗಳಲ್ಲಿ ನೀಡುವ ಅಂತಿಮ ತೀರ್ಪಿಗೆ ಒಳಪಟ್ಟಿರುತ್ತದೆ.

Explanatory Note regarding seniority

1. The final gradation list for the period from 01-11-1956 to 12-06-1991 has been published vide Official Memorandum No: HD 90 PEG 1994 dated 10-9-1994.

2. DG & IGP in letter No: CB(4)/8/1994-95 dated 09-02-2000, has stated that from 13-06-1991 to 31-12-1998 there were 274 posts; as per C & R Rules, 33 ⅓ & 66 ⅔ posts are meant for DRs and PRs quota respectively. Accordingly 91 vacancies were meant for direct recruitment. Since 10 officers were recruited under direct recruitment quota, the remaining 81 direct recruitment vacancies be freezed & converted into promotional vacancies. Accordingly 81 DR vacancies for the period between 13-06-1991 & 31-12-1998, were frozen and converted into promotional vacancies vide Notification No. DPAR 40 SRE 2000 dated 12-06-2001.

3. In Government Notification-1 No. OE192 POSIPA 2002 dated 25-02-2002, the provisional gradation list of Dy. SPs (Civil), upto 31-10-1998, has been published inviting objections/suggestions from the aggrieved officers within 30 days. After considering the objections / suggestions received within the stipulated time & in accordance with the service seniority of the officers, the final gradation list of Dy. SPs (Civil) cadre, pertaining to the period between 31-05-1991 to 31-10-1998, was published vide Notification No. OE 192 PoSiPa 2002 dated 20-12-2007.

4. Aggrieved by the seniority assigned in the aforementioned gradation list, Sri B.R.Ravikanthegowda and others filed application Nos. 149/2008 and others in the Karnataka Administrative Tribunal. In the above applications, c/w application Nos. 6997, 6999-7003/2001 & 4632/2002 filed by Sri B.R. Ravikanthegowda & others objecting to conversion of direct recruitment vacancies into promotional vacancies as per Notification No. DPAR 40 SRE 2000 dated 12-06-2001, Karnataka Administrative Tribunal in its judgment dated 26-05-2009 has ordered as under :

i. Applications are allowed

ii. It is hereby declared that the impugned Rules, namely the "the Karnataka State Police Services including Ministerial Services (Recruitment) (Amendment) Rules, 2000" are prospective in nature and operate only from the date of their publication in the official gazette i.e., 12-06-2001.

iii. The impugned gradation list pertaining to the cadre of DSP published by the Government by Notification-1 dated 20-12-2007 to the extent it relates to the Applicants & Respondents No. 3 to 7 is set aside.

iv. The Official Respondents shall re-draw the gradation list of DSP by placing the direct recruits above the promotees with reference to the date of their regular recruitment/promotion to the cadre of DSP in the light of the observation made in this order:

v. Time for redrawing the gradation list: Three months."

5. In pursuance of the above order of the Karnataka Administrative Tribunal it was decided that the final gradation list in the cadre of Dy.SPs published by the Government vide Notification no. OE192 PoSiPa 2002 dated 20-12-2007 was withdrawn. Thereafter the provisional list was revised based on the proposal dated: 09-02-2000 of the D.G. and I.G.P. and the revised provisional list was published on 30-11-2009 and the final gradation list was published on 18-12-2009.

6. For the block period, 'the period between one direct recruitment to another date of direct recruitment' or 'the date of recruitment to the date of amendment of recruitment rules' or 'the date of amendment to the date of direct recruitment' or 'the period between the date of amendment to another date of amendment' has been considered as one Block period.

7. The seniority of direct recruits has been determined in accordance with the select list. But the seniority of those who reported to duty after the time limit stipulated in the Karnataka Civil Services (General Recruitment) Rules has been fixed in accordance with rule 5(2) of Karnataka Government Servants (Seniority) Rules, 1957.

8. The seniority of the direct recruits has to be determined as per rule 5 of Karnataka Government Servants (Seniority) Rules, 1957 & seniority of promotees has to be determined as per Rule 4 of the said rules. According to the Karnataka Civil Services (Regulation of Pay, Promotion and Pension) Act, 1973, except under the circumstances indicated in Section 4(1), there is no provision for assigning the eligibility dates prior to the actual date of promotion.

9. According to the quota rule, the vacancies arising in one block period are categorized into direct recruitment vacancies and promotional vacancies and the vacancies remain unutilized, are carried forward to the next block period.

10. The Government Notification No. DPAR 40 SRE 2000 dated 12-06-2001 freezing direct recruitment vacancies of Deputy Superintendent of Police (civil) in Police Department was published in the extra-ordinary gazette dated 16-06-2001. The Karnataka Administrative Tribunal in its order dated 26-05-2009 in Application No.149/2008 has ordered that these rules are prospective in nature and operate only from the date of their publication in the official gazette. Keeping this in mind 87 Deputy Superintendent of Police have been accorded retrospective promotion from 16-06-2001 in accordance with KCS (RPPP) Act, 1973 and KCS (RPPP) Rules 1978, subject to the final decision of the Karnataka High court in Writ Petition No.28578-591/2009 and 26731-42/2009. Considering the retrospective promotion so accorded the final gradation list of Deputy Superintendent of Police in Notification No. HD 192 PoSiPa 2002 dated 18-12-2009 in so far as the 25th Block is concerned, has been modified and the final gradation list for this purpose has been published in Notification No. OE 319 PoSiPa 2010 dated 21-7-2011.

11. It has become necessary to withdraw the final gradation list of the Deputy Superintendent of Police (civil) published in Notification No. HD 192 POSIPA 2002 dated 08-12-2008 and republish the same. Accordingly vacancies which have been notified in the Notification dated 08-12-2008 for the period upto 02-03-2005 have been taken into consideration and based on the further vacancies available, vacancies have been allocated block wise from the "date of amendment to the direct recruitment date" as explained in Para-7 above. The DG & IGP in his letter dated 18-02-2011 has furnished the details of vacancies available for the period. Block wise allocation of vacancies which were notified in Notification dated 08-12-2008 and vacancies subsequently indicated by the DG & IGP have been taken into account and the quota for direct recruits and promotees, as per the C&R Rules existing during that period have been allocated.

12. In Government Notification No. HD 66 POSIPA 2010 dated 12-05-2011 a number of officers in the cadre of Deputy Superintendent of Police, have been accorded retrospective promotion against the promotional quota vacancies from the date they were placed in independent charge or occurrence of vacancies whichever is later, in accordance with rule 2(3) of Karnataka State Civil Services (Regulation of Promotion, Pay and Pension) Rules, 1978.

13. Accordingly, keeping the retrospective promotion accorded against the promotional quota vacancies, provisional gradation list of Dy.S.Ps for the period from 16-06-2001 to 26-06-2010 was published vide Notification No. OE 66 PoSiPa 2010 dated: 12-5-2011 in the extraordinary gazette dated: 12-5-2011 inviting objections/suggestions from the affected officers within 30 days.

Objections/suggestions received have been examined in detail.

14. Promotions have been reviewed with reference to actual occurrence of vacancies. Consequent upon review, promotees who were promoted against DR vacancies have been assigned dates of eligibility with reference to availability of vacancies in promotional quota in accordance with Section 4 of Karnataka State Civil Services (Regulation of Promotion, Pay and Pension) Act, 1973.

Accordingly eligibility dates have been assigned based on the availability of vacancies in promotional quota block-wise.

15. As per the interim order dated: 20-7-2011 of the Hon'ble Karnataka Administrative Tribunal in application No. 4382-4385/2011 and in pursuance of the orders dated: 08-12-2010 of the Hon'ble High Court of Karnataka in Writ Petition Nos. 10605-10620/2010 (S-KAT) and connected Writ Petitions, the seniority of these DRs of 2004 Notification under the K.C.S. (special recruitment of S.C. and S.T. candidates to certain group A and group B posts) Rules, 1985 and appointed on 02-3-2005 are fixed below the DRs of 1999 Notification appointed under Karnataka Recruitment of Gazettedಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ ಸೆಪ್ಟೆಂಬರ್ ೨೯, ೨೦೧೧ ಭಾಗ-೩ ೩೧೪೩ Probationers (appointment made by competitive examination) Rules, 1997 and appointed on 31-01-2006. This assignment of seniority is subject to final disposal of S.L.Ps before the Hon'ble Supreme Court of India.

16. The final seniority list as in Annexure-III to this Notification is subject to the final judgement of the Hon'ble High court in Writ Petition No.28578-591/2009 and 26731-42/2009 and subject to the final order of the Hon'ble KAT in Application No. 6486 & 6487/2010, No.148-151/2011 and No. 4382-4385/2011 and final disposal of S.L.Ps before the Hon'ble Supreme Court of India.
