Scheme Implementation of Social Audit Rules 2011 in Karnataka

Whereas Government of India enacted the National Rural Employment Guarantee Act 2005 dated 07.09.2005 and framed Audit of Schemes Rules 2011 on 30.06.2011, in exercise of powers conferred in sub-section(1) of section 24 of MGNREGA 2005.

Whereas the rule 3 of the said notification makes it compulsory to State Governments to notify the Social Audit Scheme Rules 2011, in exercise of the powers conferred under section 32 of MGNREGA 2005, the Government of Karnataka hereby make and notify the following Scheme implementation of Social Audit in Karnataka.

I. Short-title and commencement:-

1. These rules may be called the MGNREGA Scheme Implementation of Social Audit rules 2011 in Karnataka.

2. For the purpose of these rules, audit of schemes shall include social audit.

3. They shall come into force on the date of their publication in the official Gazette.

II. Constitution of Social Audit unit:-

For the implementation of Social Audit by Gram Sabhas an independent society would be formed consisting of such facilitators on such terms and conditions as it deems fit. The entire Social Audit Directorate will function under the bye-law provisions of the society to be registered under the Societies Registration act 1960 and also the directions and guidelines issued by Government of India and Government of Karnataka from time to time.

6. Gram Panchayat resource 2 to 5 resource persons for each Gram

Panchayat depending on number of Works, the

number of persons will be notified by the

Director.

A retired all India Service Person/a retired selection grade civil servant of State Service shall be the head of the social audit.

III. Duties and Responsibilities of Officers and staff of Social Audit Unit:-

1. DIRECTOR

• To manage day to day functioning of the society. • To ensure that all policy level decisions related to the society are implemented. • Undertake all activities necessary to fulfill the objective and vision of the society. • Undertake all activities necessary to fulfill the Provisions of MGNREGS Audit of Schemes Rules, 2011. • To frame an annual calendar to conduct at least one Social Audit in each Gram Panchayat every six months at the beginning of the year and a copy of the calendar will be sent to all DPC for making necessary arrangements.

• To oversee and responsible for every aspects of Social Audit of the NGREA in the entire State. • To recruit Staff, award consulting contracts and incur necessary expenditures to manage the day to day affairs of the Directorate.

• To take disciplinary action over staff as per the contract rules or any other rules applicable. • Responsible to take follow up action based on the findings of the Social Audit. • To create resource base for conducting social audits. • To assist the State Employment Council to monitor the action taken on Social Audit and prepare action taken report to incorporate in the annual report to be placed before the State Legislative.

• To prepare a summary of findings of social audits conducted during financial year to be submitted from the State Government to CAG of India.

2. JOINT DIRECTOR

To assist the Director in discharge of his duties.

3. STATE RESOURCE PERSONS.

• To assist the Director / Joint Director in discharge of their duties. • To oversee and responsible for every aspects of the Social Audit process from developing the Social Audit schedule to monitoring the follow up of issues identified through the social audit in their respective regions.

• To monitor District and Taluk Resource persons work in their respective regions. • To develop and submit reports on the social audit in their respective regions. • To report and conduct investigations in case of any lapses in the social audit process their respective regions. • To liaise with officials on different aspects of the Social audit process in their respective regions. • To prepare a summary of finding of Social audits conducted during financial year of the respective regions. • To monitor the action taken on the social audit and prepare social audit report of the respective regions. • To undertake any other relevant administrative functions.

4. DISTRICT RESOURCE PERSONS.

• To assist the State Resource persons in discharge of their duties. • To facilitate and conduct social audits in the allotted districts. • To oversee and responsible for every aspect of social audit process from developing the social audit schedule to monitoring to follow up of issues identified through the social audit in the allotted districts.

• To monitor Taluk Resource persons work in allotted Districts. • To prepare a summary of findings of social audits conducted during financial year of the respective District. • To monitor the action taken on the social audit and prepare action taken report of the respective District. • To develop and submit reports on Social Audit in the allotted District. • Host the social audit reports including action taken report in the public domain. • Any other administrative responsibilities entrusted by superiors.

5. TALUK RESOURCE PERSONS

• To assist the District Resource Person in discharge of his duties. • To facilitate and conduct social audit in GP including raising awareness on NREGA at the village level. • To facilitate presenting the Social Audit findings in Grama Sabha and public hearings. • Writing social audit reports and ensuring follow up on findings from the Social audit reports. • Facilitating the works of GP resource persons and consolidating their findings and placing it before Grama Sabha. • Facilitating training of GP Resource persons. • To prepare a summary of finding of social audits conducted during financial year of the respective taluk. • To monitor the action taken on the social audit and prepare action taken report of the respective taluk. • To mobilize the people to come for the social audit Grama Sabha. • Any other administrative responsibilities entrusted by the superiors.

6. GRAMA PANCHAYATH RESOURCE PERSONS.

• Mobilization of wage seekers and the village community for social Audit process using slogans, songs etc raising awareness on NREGA at village level.

• Along with primary stakeholders shall verify-

a) The Muster Roll, Entry and Payments made in the specified time period, by contacting the wage seekers whose names are entered in such muster roll.

b) The worksite and access the quantity with reference to records and also quality of work done.

c) The cash book, bank statement and other financial record to verify the quality of work done.

d) The invoice, bills, vouchers and other related records used for procurement of materials to testify such procurement as per the estimate, as per procurement laid down and was economical fulfilment of the Rights and Entitlements of Labourers and proper utilization of funds.

e) Any other payments made by implementing agency.

• Collecting evidence and filling up the Social audit format. • Presenting the finding of Social audit in the Grama Sabha. • Creating awareness among Labourers about their rights and entitlements under the Act.

7. ROLE & RESPONSIBILITY OF DISTRICT PROGRAMME CO-ORDINATOR AND EX-OFFICIO CHIEF EXECUTIVE OFFICER

AT DISTRICT LEVEL:

a) To make necessary arrangements to conduct at least one social audit in each GP every month on receipt of copy of annual calendar to conduct social audit by the Director of MGNREGA.

b) The DPC shall attend the Grama Sabha meeting or nominate an official of appropriate level for smooth conduct of Grama Sabha.

c) Ensure that all records for conduct of social audit are furnished to the social auditors by implementing agencies through the PO.

d) Ensure that corrective action is taken on the social audit report

e) To take steps to recover the amount embezzled or improperly utlilised and issue receipts or acknowledgment for amount so recovered.

f) Maintain a separate account for amounts recovered during the social audit process.

g) To facilitate the smooth conduct of Social Audit.

h) To submit action taken report on Social Audit to the Directorate.

i) Ensure that all record for conducting Social Audit are furnished to the Resource Persons by implementing agencies through the PO.

j) Ensure that the appropriate action (including criminal case/civil case or termination of services) is initiated against the persons who misutilised or embezzled the amount meant for the schemes under the Act.

k) To monitor the action taken on the social audit and prepare action taken report of the respective District.

l) To notify the officer to preside over the Social Audit Grama Sabha/Public hearing.

8. ROLE & RESPONSIBILITY OF PROGRAMME OFFICER AND EX-OFFICIO EXECUTIVE OFFICER.

a) The Programme Officer shall ensure that all required information and records of all Implementing Agencies such as, Job card Register, Employment Register, Work Register, Grama Sabha Resolution, Copies of sanctions (Administrative or Technical or Financial), Work Estimates, Work commencement Order, Muster Roll issue and Receipt register, Muster Roll, wage Payment Acquaintance and order, materials –bills and vouchers (for each work) Measurement Books, Asset Register, Action Taken Reports on previous Social Audits, Grievances or Complaints Register, any other documents that the social audit unit requires to conduct the social audit process are properly collated in the requisite formats and provided, along with photocopies, to the social Audit Unit by facilitating conduct of social audit at least fifteen days, in advance of the scheduled date of meeting of the Grama Sabha conducting social audit.

b) To prepare a summary of findings of social audits conducted during financial year of the respective Taluk

c) To monitor the Action taken on Social audit and prepare Action Taken Reports of the respective Taluk.

d) Ensure that corrective action is taken on the Audit Report.

9. ROLE & RESPONSIBILITY OF PANCHAYAT DEVELOPMENT OFFICER/SECRETARY (HE WILL ACT AS IMPLEMENTING

OFFICER)

a) The Panchayat Development officer shall furnish that all required information and records of all Implementing Agencies such as, job card Register, Employment Register, work Register, Grama Sabha Resolution, Copies of sanction (Administrative or Technical or financial), Work Estimates, Work Commencement Order, Muster Roll Issue And receipt register, Muster Roll, Wages Payment Acquaintance and order materials –bills and vouchers (for each work ) Measurement Books, Asset Register, Action Taken Report on previous Social Audits, Grievances or Complaints Register, any other documents that the social audit unit requires to conduct the social audit process are properly collated in the requisite formats and providing, along with photocopies, to the Social Audit Unit of facilitating conduct of social audit at least fifteen days in advance of the scheduled date of meeting of the Grama Sabha conducting social audit.

b) To prepare a summary of findings of audit conducted during financial year of the GP.

c) To Prepare Action Taken Report of the Grama Panchayat

d) To take corrective action on the Social Audit Report.

e) Creating enabling atmosphere for smooth conduct of audit.

f) Obligation on PDO/SECRETARY to present during Social audit and public hearing.

g) Ensure full, free and fair participation of labourers in the social audit Grama Sabha.

10. ROLE of NGO

1) The Directorate should explore the possibilities of engaging the NGO on the following issues.

a) Capacity building.

b) Facilitating the Grama Sabha and Public hearing.

c) As Independent observers.

d) Identifying training needs of stake holders.

e) Publicity.

2) The Directorate shall also bring out general guidelines in identifying and engaging the NGO's.

IV Duration of Social Audit:-

Social Audit shall facilitate conduct of the works taken into under the Act in every Gram Panchayat at least once in six months in the manner prescribed under these rules.

1. The expenditure incurred during the financial year for the period commencing from April to September, be subjected to the social audit to be conducted in the period commencing from October to March.

2. The expenditure incurred during the financial year for the period commencing from October to March be subjected to the social audit to be conducted in the period commencing from April to September.

3. Accordingly Director has to prepare a calendar for the social audit to be under taken in the beginning of the financial year.

V Social Audit Facilitation.

Social Audit unit is responsible for the following namely:-

(a) Build capacities of Gram Sabhas for conducting social audit; and towards this purpose, identify, train and deploy suitable resource persons at village, block, district and State level, drawing from primary stakeholders and other civil society organizations having knowledge and experience of working for the rights of the people.

(b) Prepare social audit reporting formats , resource material, guidelines and manuals for the social audit process;

(c) Create awareness amongst the labourers about their rights and entitlements under the Act;

(d) Facilitate verification of records with primary stakeholders and work sites;

(e) Facilitate smooth conduct of social audit Gram Sabhas for reading out and finalizing decisions after due discussions;

(f) Host the social audit reports including action taken reports in the public domain.

VI Process of conducting social audit:-

1) The Social Audit Unit shall, at the beginning of the year, frame an annual calendar to conduct at least one social audit in each Gram Panchayath every six months and a copy of the calendar shall be sent to all the District Programme Coordinators of making necessary arrangements.

2) For facilitating conduct of social audit by Gram Sabha, the resource persons deployed by Social Audit Unit, along with primary stakeholders shall veify-

i) The muster rolls, entry and payments made in the specified time period, by contacting the wage seekers whose names are entered in such muster rolls;

ii) The work site and assess the quantity with reference to records and also quality of work done;

iii) The cash book, bank statements and other financial records to verify the correctness and reliability of financial reporting;

iv) The invoices, bills vouchers of other related records used for procurement of materials to testify such procurement was as per the estimate, as per procedure laid down and was economical;

v) Any other payment made by the implementing agency from the funds of the scheme.

3) The labourers and the village community shall be informed about the Gram Sabha conducting social audit by the resource persons as well as the programme Officer to ensure full participation.

4) To conduct social audit process, a Gram Sabha shall be convened to discuss the findings of the verification exercise and also the review the compliance on transparency and accountability, fulfillment of the rights and entitlements of labourers and proper utilization of funds.

5) The information shall be collected and read over in Grama Sabha in the prescribed format.

VII Social Audit Grama Sabha

(cid:1) Social Audit in a Gram Panchayat takes place for 6 days.

Day ONE: Training of GP Resource persons by Taluk Resource Persons.

Day TWO: Grampanchayat Resource Persons to conduct door to door survey and verify the details & payment as per Job Card and gathering other information.

DayTHREE & FOUR: Physically visiting the works and observing the quality, Work Site Facilities.

Day FIVE: Preparation of Report.

Day SIX: Grama Sabha and Public Hearing.

(cid:2)(cid:2)(cid:2)(cid:2) At the end of the Social Audit finding of the Social Audit should be presented to the Grama Sabha for discussion. Public hearings shall be conducted in Grama Sabha.

(cid:2)(cid:2)(cid:2)(cid:2) The process of Grama Sabha should be video recorded.

(cid:2)(cid:2)(cid:2)(cid:2) Social Audit Grama Sabha is entirely different from the Grama Sabha defined under KPR Act 1993 and it shall be presided over by the officer notified by DPC. Provided the same officer shall not be notified to the same Panchayat for successive Social Audit Grama Sabha.

(cid:2)(cid:2)(cid:2)(cid:2) Person presiding with the consent of Grama Sabha may refer the primafacie cases & fraud/embezzlement to Ombudsmen.

Ombudsmen shall dispose these cases as per law.

VIII Obligation of certain persons in relation to social Audit.

1) The programme Officer shall ensure that all the required information and records of all implementing agencies such as, Job card register, Employment register, Work Register, Gram Sabha Resolution, Copies of the sanctions (Administrative or Technical or Financial), Work Estimates, Work Commencement Order, muster-roll issue and receipt register, muster Rolls, Wage payment Acquaintance & order, Materials –Bills and vouchers (for each work), Measurement Books (for each work), Asset Register, Action Taken Report on previous social audits, grievance or complaints register, any other documents that the Social Audit Unit requires to conduct the social audit process are properly collated in the requisite formats; and provided, along with photocopies, to the Social Audit Unit for facilitating conduct of social audit at least fifteen days in advance of the scheduled date of meeting of the Gram Sabha conducting Social audit.

2) The information referred to in sub-rule (1) shall be publically available at the same time and the photocopies shall be available at nominal cost.

3) Every District programme coordinator or any official on his behalf, shall-

a) Ensure that all records for conduct of social audit are furnished to the Social Audit Unit by implementing agencies through the Programme Officer;

b) Ensure that corrective action is taken on the social audit report;

c) Take steps to recover the amount embezzled or improperly utilized; and issue receipts or acknowledgement for amount so recovered.

d) Pay wages found to be misappropriated within seven days of the recovery of such amount to the wage seekers.

e) Maintain a separate account for amounts recovered during the social audit process.

f) Ensure that the appropriate action (including initiating criminal and Civil proceedings or termination of services) is initiated against individual or class of individuals or persons who misutilised or embezzled the amount meant for the schemes under the Act.

IX Post Social Audit Processes:-

The DPC & PO are responsible to take follow up action on the findings of Social Audit Gram Sabha vide Prakarana No:14(3)(E) & 15(5)(D) of MGNREGA.

1) Social audit reports shall be updated in MIS by Taluk Social Audit Resource person.

2) Taluk Resource person to submit social Audit reports to Programme officer, DPC, Resource Persons District/State.

3) Follow up action about Social Audit.

4) Action taken report shall be placed before in next social audit.

5) The Directorate shall post the decision of the Grama Sabha and Public hearing of each Grama Sabha on the official Website in the prescribed format.

6) Action taken report shall be uploaded to the Website by the appropriate authority.

FOREST, ECOLOGY AND ENVIRONMENT SECRETARIATE

NOTIFICATION

No: FEE 302 FWL 2011-(II), Bangalore, dated: 27 -12-2011.

Whereas the Government of Karnataka has declared the area, situation and limits of which are specified in the Schedule I below, to be a sanctuary as it is of adequate ecological, faunal, floral, geomorphological, natural or zoological significance for the purpose of protecting, propagating or developing Wildlife or its environment. In exercise of powers conferred under subsection (1) of section 35 of the Wildlife (Protection) Act, 1972, it has been declared as Bannerghatta National Park vide Notification No. AFD 61 FWL 74 dated: 06-25/09-1974 published in the Karnataka Gazette dated: 09-01-1975 and the same has been confirmed as per the provision conferred under sub section (4) of section 35 of Wildlife (Protection) Act, 1972 (Central Act of 53 of 1972) as per the Notification No. FEE 19 FWL 98 dated: 05.03.2004.

And now, the Government of Karnataka consider it's necessary to alter the limits and boundaries of the said National Park in view of the following aspects:

i) during the meeting of State Board for Wildlife of Karnataka chaired by the Hon'ble Chief Minister of Karnataka held on 26-07-2011, it has been unanimously resolved to approve the proposal for re-organisation of Bannerghatta National Park comprising of reserve forests only;

ii) subsequently, during the meeting of Standing Committee of National Board for Wildlife held on 14-10-2011 has given its approval for rationalization of boundaries of Bannerghatta National Park vide letter dated 14-11-2011 of Ministry of Environment and Forests, New Delhi;

iii) since additional Reserve Forest also has better wildlife habitat and it is corridor for wildlife movements and the areas have adequate ecological, faunal, floral, geomorphological, natural or zoological significance for the purpose of protecting, propagating or developing Wildlife or its environment and by protecting these reserve forest will act as barriers to core area and help in better management of wildlife habitats;

iv) the proposed area is quite unique from wildlife point of view as the area is rich in Elephants, Tiger, Leopards, Gaur, Deer, Sambar etc. and also known for reptiles like Python, Vipers, Monitor Lizards etc., as well as the area known for innumerable birds and other flora; and

v) also, the proposed area acts as a critical wildlife corridor connecting reserved forests of Tamilnadu, Bengaluru Urban Division and Ramanagara Divisions.

The Bannerghatta National Park shall not include any of the Revenue Villages, Patta Lands, Revenue Lands, Gomala Lands and such other areas which do not form any part of State Forests and Reserve Forests. The encroached area ordered for regularization under Government Order No. FEE 5 FGL 90 dated: 05.05.1997 falling under Bannerghatta National Park is also excluded from the Bannerghatta National Park. The various rights of way and rights of water as notified in 'C' statements of the respective Reserve Forests shall continue and are already vested with the State Government.

Now, therefore, in exercise of the powers conferred under section 35 of the Wildlife (Protection) Act, 1972 (Central Act, 53 of 1972) the Government of Karnataka hereby declares the area, situation, limits which are specified in the Schedules (Including Schedule I and II) shall be comprised within the "Bannerghatta National Park" and the said area described in Annexure – I shall be called as "Bannerghatta National Park" with effect from the date of publication of this Notification.

SCHEDULE

Situation – A tract of jungle on the South – East border of the ankanhalliTaluk, situated between the Ramadevarabetta proposed State Forest and the Madras frontier.

East along the Madras frontier to the North – West corner of Survey No. 43 of Kolgondahalli; then South – East following the same boundary, meets the North – East corner of Survey No. 44 of the same village.

East – Thence south along the Madras frontier boundary then South – West along the western boundary of the same survey number to Cairn No. 1 at a point about 40 chains South – West from the northern most corner of Survey No. 10 of Ganganahalli.

South – Thence North – West along the halla through Survey Nos. 83 and 82 of Ganganahalli for a distance of about 48 Cairn No. 2 at a point where two streams meet then in the same direction through Survey No. 82 of Ganganhalli for a distance of about 45 chains to Cairn No. 8 at a point about 20 chaine north, from the North – East corner of Survey No. 109 of Hunsanhalli; thence Survey No. 108 of the same village for a distance of about 48 chains to Cairn No. 4 at a point about 57 chains east, from the North – East corner of Survey 107 of the same village; then North – West straight through Survey No. 106 of Husanhalli village for a distance of about 58 chains to Cairn No. 5 at a point about 5 chains east, from the South – East corner of Survey No. 105 of the said village.

then North – East straight through Survey No. 153 of Kolgondanhalli for a distance of about 58 chains to Cairn No. 12 at a point about 5 chains South – East from the South – East corner of Survey No. 80 of the same village, thence in the same direction through point about 5 chains east, from the South – East corner of Survey No. 52 of the same village (where it meets the East – track leading from Kolgondanhalli to Byalal); then North – East through Survey No. 45 of Kolgoandanhalli for a distance of about 78 chains to Cairn No. 14 at a point about 10 chains east from the North – East corner of Survey No. 38 of the same about 22 chains to Cairn No. 15 a point about 22 chains North – East from the North – East corner of Survey No. 33 of the same village; then the line turns West and goes straight; through Survey No. 43 and 42 of Kolgondanhalli for a distance of about 90 chains to the starting point.

North – Starting from the South – West gadibandh of Kolagondanahalli village, the line runs East in a straight line along the southern boundary of Kolagondanahlli village to a point about 41 chains West from the North – West corner of Survey No. 4 of Bilidale village.

East – Then South – West through Survey No. 32 and 15 of Bilidale in a straight line for about 74 chains and meets the western boundary of Manjunatha State Forest.

South – Western boundary of Manjunatha State Forest

West – Eastern boundary of Ramadevarabetta State Forest

Whereas the Government of Karnataka has declared the area, situation and limits which are specified in the Schedule-I below, to be a sanctuary as it is of adequate ecological, faunal, floral, geomorphological, natural or zoological significance for the purpose of protecting, propagating or developing Wildlife or its environment. In exercise to the powers conferred under Section 18 of the Wildlife (Protection) Act, 1972, it has been declared as Mookambika Wildlife Sanctuary vide Notification No. AFD 48 FWL 74, dated: 17-06-1974 and the same has been confirmed as per the provision conferred under Section 26(A) of Wildlife (Protection) Act, 1972 as per the Notification No. AFD 48 FWL 74 dated: 22-05-1978.

And now, the Government of Karnataka consider it's necessary to alter the limits and boundaries of the said Wildlife Sanctuary in view of the following aspects:

i) during the meeting of State Board for Wildlife of Karnataka chaired by the Hon'ble Chief Minister of Karnataka held on 26-07-2011, it has been unanimously resolved to approve the proposal for re-organisation of Mookambika Wildlife Sanctuary comprising of reserve forests only;

given its approval for rationalization of boundries of the Mookambika Wildlife Sanctuary vide letter dated: 14-11- 2011 of Ministry of Environment & Forests, New Delhi; and

iii) since additional reserve forest also has better wildlife habitat and it is corridor for wildlife movements and the areas have adequate ecological, faunal, floral, geomorphological, natural or zoological significance for the purpose of protecting, propagating or developing Wildlife or its environment and by protecting these reserve forest will act as barriers to core area and help in better management of wildlife habitats.

The Mookambika Wildlife Sanctuary shall not include any of the revenue villages, patta lands, revenue lands, gomal lands and such other areas which do not form any part of the above mentioned State Forests and Reserve Forests. The encroached area ordered for regularization under Government Order No.FEE 5 FGL 90 dated 05.05.1997 falling under Mookambika Wildlife Sanctuary is also excluded from the Mookambika Wildlife Sanctuary. The various rights of way and rights of water as notified in 'C' statements of the respective Reserve Forests shall continue.

Now, therefore, in exercise of the powers conferred under section 26 (A) of the Wildlife (Protection) Act, 1972 (Central Act, 53 of 1972),the Government of Karnataka hereby declares the area, the situation and limits which are specified in the Schedules (Including schedule I and II) shall be comprised within the "Mookambika Wildlife Sanctuary" and the said area described in Annexure–I shall be called as "Mookambika Wildlife Sanctuary" with effect from the date of publication of this notification.

Whereas the Government of Karnataka has declared the area, situation and limits which are specified in the Schedule I below, to be a sanctuary as it is of adequate ecological, faunal, floral, geomorphological, natural or zoological significance for the purpose of protecting, propagating or developing Wildlife or its environment. Further a corrigendum order was issued as per the Order No. FEE 166 FWL 94 dated: 03-08-1994 declaring an extent of 526.95 Sq. Kms as "Cauvery Wildlife Sanctuary".

EAST: From the above point the line runs along Palar river upto the point where Kokkarehalla joins Palar river, then it continues along the said halla at the point where Tulakkambihalla joins, then along Tulakkambihalla upto the point which is the South-East corner of Indiganatha enclosure, then along the eastern boundary of the said enclosure and then northern boundary upto the point where one of the tributary upto Yelekattuhalla, crosses the boundary, then along the said tributary upto Yelekattuhalla, then the line runs along the river said halla upto the point where Gopinatham, M. Malai road crosses the river, then the line continues from the said point along Bejjalani foot path where it crosses Gukkadahalla, then along the said halla upto the point where Jenukalluhalla joins Gukkadahalla, then the line continues along Jenukahalla upto the South-East corner of Panchallani enclosure boundary, then the line continues along the eastern boundary of the said enclosure upto the South-East corner crosses said enclosure then the artificial line runs straight to the point which is the peak of Ponnachibetta, then the line continues from the said betta along one of the tributary of Mamadavuhalla and joins Mamadavuhalla upto the point where Panchalkerehalla joins, then along Panchalkerehalla and crossing the ridge in the same direction and joins Thondehalla, then along Thondehalla in South-West direction and then the artificial line crossing the Belthalgumma ridge and joins Mantudukahalla, then along the said halla with Gundihalla, then along Gundihalla upto Changadi enclosures, then the line continues in an artificial line upto one of the tributary of Naduttalhalla upto Elethhotadahalla, then Elethotadahalla upto the point where the line 'D' between M.Malai and Cowdally touches. Then the line continues along said 'D' line crossing the river Uduthorahalla and reaches the boundary of private lands. Then the line continues along the forest boundary upto the point of Shaggyam Ganigamangala road, then along the said road upto Ganigamangala enclosure then along the eastern and northern boundary of the said enclosure up to Agasagittihalla, then along the said halla in the South-West direction upto the forest boundary. Then the line continues along the effort boundary crossing. Doddahalla upto point where the Koralaseatte - Kothanur road crosses the boundary, then along the road upto river Cauvery. Then the line continues crossing river Cauvery along Kesarkkihalla upto starting point.

SOUTH: Now Cowdalli reserve forest joins Sanctuary from M.M.Hills Wildlife Range Boundary ends at Mamadavuhalla upto the point where Panchalkerehalla joins Cowdalli Wildlife Range Starts, then along Panchalkerehalla and crossing the ridge in the same direction and joins Thondehalla, then along Thondehalla in South-West direction and then the artificial line crossing the Belthalgumma ridge and joins Mantudukahalla, then along the said halla with Gundihalla, then along Gundihalla upto Changadi enclosures, then the line continues in an artificial line upto one of the tributary of Naduttalhalla upto Elethhotadahalla, then Elethotadahalla upto boundary of Mahadeshwara Malai Reserve Forest ending at Kuratti Bavi. In exercise to the powers conferred under Section 18 of the Wildlife (Protection) Act, 1972, it has been declared as Someshwara Wildlife Sanctuary (A and B Blocks) vide Notification No. AFD 51 FWL 74 dated 05-06-1974 and the same has been confirmed as per the provision conferred under Section 26(A) of Wildlife (Protection) Act, 1972 as per the Notification No. AFD 51 FWL 76, dated: 12.10.1979.

And now, the Government of Karnataka consider it's necessary to alter the limits and boundaries of the said Wildlife Sanctuary in view of the following aspects:

Dandeli Wildlife Sanctuary vide notification No. FEE 58 FWL 96 dated: 09-03-1998 and order no FEE 16 FWL 2008 dated:

11.09.2008.

And now, the government of Karnataka consider its necessary to increase the area and limits of Dandeli Wildlife Division in view of following factors:

i) during the meeting of State Board for Wildlife of Karnataka chaired by the Hon'ble Chief Minister of Karnataka held on 26-07-2011, it has been unanimously resolved to approve the proposal for re organisation of Dandeli Wildlife Sanctuary comprising of reserve forests only;

ii) subsequently, during the meeting of Standing Committee of National Board for Wildlife held on 14-10-2011, has given its approval for rationalization of boundries of the Dandeli Wildlife Sanctuary vide letter dated:

14-11-2011 of Ministry of Environment & Forests, New Delhi;

iii) the area proposed to be added to sanctuary consists of the semi ever green and ever-green forest patches of the forest in the Western Ghats. All along the inter-state border adjoining this area is a continuous tract of protected areas of Goa;

iv) the area is a link between Dandeli Wildlife Sanctuary and Bhimgad Wildlife Sanctuary;

v) the area is part of Sharavathi Khanapur landscape tiger population and has rich bio-diversity; and vi) the area is part of the area which the Government of India while giving environmental clearance to Kalinadi stage II hydro electric project opined to be included in the existing wildlife sanctuary (No.3/24/78 HCT/ENV dated: 16-08-1979).

Dandeli wildlife sanctuary shall not include any of the revenue villages, patta land, land already released by Government for non-forestry purpose, hakkal and betta land on the date of publication of this Notification. The various rights of waters and other rights as notified in the VFR statements of the respective reserved forests shall continue.

The detailed description of the reserve forests constituting the area is as contained in the enclosed Annexure Nos. II, III and IV.

Now, therefore, in exercise of the powers conferred under section 26A of Wildlife Protection Act, 1972(central act, 53 of 1972) the Government of Karnataka hereby declares that the area, situation and limits which are specified in the Schedule (Including Annexures-II, III and IV) shall be comprised within the Dandeli Wildlife Sanctuary and further declares that the said area described in Annexure – I shall be called as "Dandeli Wildlife Sanctuary" with effect from the date of publication of this Notification.

South : The boundary then runs along the downstream of right bank of Kali river upto a point where Thattihalla nala joins Kali river and then runs downstream along Kali river upto the point where Vakaihalla joins Kali river near Suligeri village.

West : From the point where Vakaihalla joins Kali river the boundary runs along the upstream of Vakaihalla up to a point where Kodathalli village road crosses the Vakaihalla and runs along the village road of Suligeri -Kodathalli upto Ulvi village. Then the boundary runs along Ulvi Kumbarwada road up to a point where it meets Kaneri River and then runs along the upstream of Kaneri River till it meets Kumbarwada Karwar road and further follows Kundal village road upto Goa state boundary. It then runs along the interstate boundary of Goa and Karnataka northward till it touches the South-Western corner of Bhimgad Wildlife Sanctuary at GPS location 15° 31' 26.28"N and 74° 16' 44.87" E .

North : Then runs along the southern boundary of Bhimgad Wildlife Sanctuary till it reaches the starting point at GPS location 15º28' 50.91" N and 74º22' 31.04"E.

NOTIFICATION

Whereas the Government of Karnataka in exercise of the powers conferred under Section 26A(b) of the Wildlife (Protection) Act, 1972 (Amendment in 2006) (Central Act, 532 of 1972) has considered the area, situation and limits which are specified in the schedule below, notification of Bombay and Karnataka Governments vide notification Nos.7F of 01-03-1879, A-Misc-1042 of 29-3-1921, 5618 of 2-7-1894, 6008 of 24-6-1911, AFD-2650 FAF 59 of 24-11-1959, an extent of 19042.58 Ha. to declare as "Bhimgad Wildlife Sanctuary" as it is of adequate ecological, faunal, floral, geomorphological, zoological association or importance for the purpose of protecting propogating and developing wildlife or its environment.

And now, the Government of Karnataka consider its necessary to declare the area as Wildlife Sanctuary in view of the following aspects:

i) the area is in the core zone of Western Ghats comprising of semi evergreen and evergreen dense forests with steep slopes. The region is having rich floral and faunal diversity;

ii) this region is having lot of wildlife significance. It is habitat for endangered and endemic wroughton's free tailed bats (Otomops wroughtoni) and Theobald's tomb bats (Taphozus theobaldi). Barapede caves are known to be the only roosting and breeding place for wroughton's free tailed bats;

iii) the forests with beautiful mosaic of woodlands and grass lands are the habitat for Tigers, Leopards, Indian Gaur (Bisons), Sloth Bear, Sambar, Barking deer, Chital, Wild dogs, King Cobra and a variety of other mammals and reptiles;

iv) this region with richest reservoirs of bio-diversity is located in the north east of Mahaveer Wildlife Sanctuary of Goa and in the north of Dandeli Wildlife Sanctuary. This entire stretch acts as natural corridor for tigers and elephants between Anshi National Park, Dandeli wildlife Sanctuary, Mahaveer and Madei Sanctuaries;

v) this area is the place of origin and Catchment basin for many important rivers like Mahadayi, Malaprabha, Pandri, Markandeya, Tillari, Bailnadi etc., apart from number of streams;

vi) the area encompasses several Geomorphological lime stone formations with lots of caves, which support wide fauna and flora endemic to this location;

vii) apart from above, the Sanctuary covers historical Bhimgad fort ruins, which needs to be protected;

viii) the entire forest lands included in the Annexure –II to this Notification have been part of the Reserve Forests issued in various notifications after settling and accruing the rights. As such, as on the date of the Notification, no claims under Forest Right Act, 2006 have been received;

ix) a draft notification was issued by Government of Karnataka vide notification No.FEE 10 FWL 2009 dated: 03- 02-2010 declaring an area of 13167.10 ha. Reserve Forest as Bhimagad Wildlife Sanctuary. However after ground verification of the area by Chief Conservator of Forests (Working Plan) and Principal Secretary, Forest, Ecology and Environment Department the area was modified and increased to 19042.58 ha. keeping in view ecological importance and management angle by correcting latitude and longitudes and also survey numbers.

And whereas the Government of Karnataka has got the recommendation of Wildlife Advisory Board in its meeting held on 19-07-2007.

And whereas all the rights in respect of the Reserved Forests to be constituted as Bhimgad Wildlife Sanctuary are already vested with the State Government.

The Bhimgad Wildlife Sanctuary shall not include any of the Revenue villages, patta lands, revenue lands on the date of publication of this notification. The various rights of waters and other rights as notified in the VFR statements of the respective Reserved forests shall continue.

Boundary Description

The area proposed to be declared as "Bhimgad Wildlife Sanctuary"

The boundary of the proposed Bhimgad Wildlife Sanctuary includes the Forest areas in and around Villages of Talewadi, Krishnapur, Tenali Bhimgad, Mendil, Holda, Degaon, Gavali, Pastoli, Chikale Jamagaon, Abanali, Kongala, Hemmadaga and Amagaon in Khanapur taluk of Belgaum District. The total area is 19042.58 Ha. excluding the Revenue and other lands.

The boundary of the proposed Bhimgad Wildlife Sanctuary forest area starts at a point in South West side of Chikale village. The northern boundary runs towards east along the Bailnadi and southern boundary of Chapoli village upto a point at co- ordinate °15 35' 52.74"N and 74° 19' 40.88"E. Ther e after it runs towards south up to a point near confluence of Bailnadi and Mahadayi river. Further it runs south up to 700 contour on Gavali to Amagon footpath. Thereafter the boundary runs towards north east and ends at a point on co-ordinates °15 37' 2 4.24"N and 74° 20'42.54" E on Mahadayi River. Ther eafter the boundary runs on 660m countour below Mahadayi river and ends at point with co-ordinates 15° 36' 45.87"N and 74° 23' 16 .28"E on Kongla- Kabanali footpath. Thereafter the eastern boundary runs towards south, along the 660 contour on left bank of mahadayi river and ends at co- ordinates 15° 34' 47.70"N and 74° 22' 16.63"E. Ther e after the boundary runs towards east along and up to the northern village boundary of Jamagaon. Thereafter the boundary runs south along the village boundary of Abnali ending at Co-ordinates 15° 31' 40.08"N and 74° 24' 29.4"E., From here it runs al ong the Southern village boundaries of Abnali, Jamagon, Hemmadaga, Degaon and ends at southern village boundary of Mendil. Then onwards the southern boundary runs towards west, along the southern village boundary of Mendil and ends at Goa state boundary. From there the western boundary runs towards north, along the Goa state boundary adjoining the Bhagwan Mahaveer and Madei Wildlife Sanctuary passing through Pokara Gunda, Kumbhar Mati, Tavache sada, Katilachi Mali and ends at the starting point near Chikale village.

Whereas the Government of Karnataka in exercise of the powers conferred under Section 26A (b) of the Wildlife (Protection) Act, 1972 (Amendment in 2006) (Central Act, 532 of 1972) has considered the Area, situation, limits and extent of Forest Areas೧೬೪ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಫೆಬ್ರವರಿ ೨, ೨೦೧೨ ಭಾಗ - ೪ಎ which are specified in Schedule-I to declare as "Chincholi Wildlife Sanctuary", comprising of Government of Karnataka notified reserved forest blocks as shown in Schedule-II, as it is of adequate ecological, faunal, floral and geomorphological importance, and for the purpose of protecting, propagating and developing wildlife or its environment.

And now, the Government of Karnataka consider its necessary to declare the area as a Wildlife Sanctuary in view of the following aspects:

i) Chincholi Forests are the areas where the natural environment can easily be affected or harmed which needs the special protection. The unique features of this forest deserve to define it as "ECOLOGICALLY SENSITIVE AREA". Further, as the area is also having growth of economically important tree species, and vulnerable even to mild disturbances, and the area demands careful management. Thus, the Chincholi Forest area is considered to be an ÉCOLOGICALLY AND ECONOMICALLY IMPORTANT". The list of flora and fauna of the area suggests that, this area is ecologically 'rich', 'Valuable' and 'Unique' irreplaceable if destroyed;

ii) further, by virtue of their biological richness, they are potentially of high value to human societies, help in maintaining the ecological stability of the area, and be significant in conserving biological diversity. The uniqueness of the services they offer to human society is precious;

iii) as explained in the above paras, the area need to be conserved taking the local context into account, on the basis of graduated or layered regulations as well as positive incentives depending upon their intrinsic value and extent of resilience;

iv) Chincholi Forest area is an area having rich natural forest cover having canopy cover about 0.40. This is the only area in the Hyderabad Karnataka Region comprising many of the features that of Western Ghats;

v) due to biotic and climatic intervention, there is a threat of degradation of rich natural forest and thereby may cause threat to the Wildlife of the Area. Hence, there is a need and also it is our bounden duty to conserve this precious and irreplaceable unique wealth given by our nature.

And whereas the State Board for Wildlife in its meeting held on 11.08.2010 and 26.07.2011 has taken a decision to declare the Chincholi Forests as "Wildlife Sanctuary" which comprises of notified and reserve forests only.

And whereas all the rights in respect of the Notified forests and Reserved forests to be constituted as "Chincholi Wildlife Sanctuary" are already vested with the State Government. The Chincholi Wildlife Sanctuary shall not include any of the Revenue villages, patta lands, Revenue lands on the date of publication of this notification.

ಹುಬ್ಬಳ್ಳಿ ವಿದ್ಯುಚ್ಛಕ್ತಿ ಸರಬರಾಜು ಕಂಪನಿ, ಬೆಂಗಳೂರು ವಿದ್ಯುಚ್ಛಕ್ತಿ ಸರಬರಾಜು ಕಂಪನಿ ಮತ್ತು ಗುಲಬರ್ಗಾ ವಿದ್ಯುಚ್ಛಕ್ತಿ ಸರಬರಾಜು ಕಂಪನಿಗಳು ಸರ್ಕಾರದ ಅಂಗ ಸಂಸ್ಥೆಗಳಾಗಿರುವುದರಿಂದ, ಸದರಿ ಕಂಪನಿಗಳಿಗೆ ಸರ್ಕಾರವು ನೀಡುವ ಬಂಡವಾಳವನ್ನು ಷೇರುಗಳಾಗಿ ಪರಿವರ್ತಿಸಿ ವಿತರಿಸುವ ಷೇರುಗಳಿಗೆ ವಿಧಿಸುವ ಮುದ್ರಾಂಕ ಶುಲ್ಕದಿಂದ ಶೇ. 50ರಷ್ಟು ವಿನಾಯಿತಿಯನ್ನು ಕರ್ನಾಟಕ ಮುದ್ರಾಂಕ ಕಾಯ್ದೆ 1957ರ ಕಲಂ 9(1)ರಡಿ ನೀಡಿ ಸರ್ಕಾರವು ಆದೇಶಿಸಿದೆ.

ಈ ಆದೇಶವನ್ನು ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಅ.ಟಿ.ಸಂಖ್ಯೆ : ಆಇ 878 ವೆಚ್ಚ-7/2011 ದಿನಾಂಕ : 04-11-2011ರಲ್ಲಿ ನೀಡಿರುವ ಸಹಮತಿ ಮೇರೆಗೆ ಹೊರಡಿಸಲಾಗಿದೆ.

Whereas the draft of the Karnataka Pre-University Education (Academic, Registration, Administration and Grant-in-aid etc.,) Amendment) Rules, 2011 was published as required by section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995) in Notification No. ED 40 TPU 2010 dated 4th November 2011 in part-IV-A of the Karnataka Gazette dated 8th November 2011 inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date of its publication in the official Gazette.

And whereas said Gazette was made available to the public on 8th November 2011.

And whereas no objection and suggestion have been received to the said draft rules.

Now therefore in exercise of the powers conferred by section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995), the Government of Karnataka hereby makes the following rules, namely :-

RULES

1. Title and Commencement .- (1) These rules may be called the Karnataka Pre-University Education (Academic, Registration, Administration and Grant-in-aid etc.,) (Amendment) Rules, 2011.

(2) They shall be come in to force from the date of their publication in the official Gazette.

2. Amendment of Schedule I. – In the Schedule-I to the Karnataka Pre-University (Academic, Registration, Administration and Grant-in aid etc.,) Rules, 2006,-

(a) under the heading ``SCIENCE COMBINATIONS", after the entry relating to serial number 6, the following shall be inserted, namely :-

``6A, Chemistry, Biology, Psychology, Home Science,"

(b) under the heading ``HUMANITIES COMBINATIONS'', after the entries relating to serial number 32, the following shall be inserted, namely :-

``32A. History, Economics, Sociology, Karnataka Music.

32B. History, Economics Sociology, Hindustani Music.

32C. History, Economics Political Science, Karnataka Music.

32D. History, Economics Political Science, Hindustani Music.

ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ : ನಅಇ 63 ಬೆಮಪ್ರಾ 2009 ದಿನಾಂಕ : 13-02-2009ರಲ್ಲಿ ಶ್ರೀ ಶ್ರೀಕಾಂತ ಕೆ. ಖಟವಟೆ, ಗದಗ ಇವರನ್ನು ಗದಗ-ಬೆಟಗೇರಿ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರದ ಅಧ್ಯಕ್ಷರನ್ನಾಗಿ ಸರ್ಕಾರದ ಇಚ್ಛಾನುಸಾರ ಅಥವಾ ಮೂರು ವರ್ಷಗಳ ಅವಧಿಯವರೆಗೆ ಇವುಗಳಲ್ಲಿ ಯಾವುದು ಮೊದಲೋ ಅಲ್ಲಿಯವರೆಗೆ ನಾಮನಿರ್ದೇಶನ ಮಾಡಿ ಆದೇಶಿಸಲಾಗಿತ್ತು. ಸದರಿ ಆದೇಶವನ್ನು ಕರ್ನಾಟಕ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರ ಕಾಯ್ದೆ 1987ರ ಕಲಂ 3(3) (i) ಮತ್ತು 5ರಲ್ಲಿ ಕಲ್ಪಿಸಿರುವ ಅವಕಾಶದನ್ವಯ ರದ್ದುಪಡಿಸಿ. ಶ್ರೀ ಕೃಷ್ಣ ಪದ್ಮನಾಭಾಚಾರ್ಯ ಹೊಂಬಾಳಿ, ನ್ಯೂ೧೮೨ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಫೆಬ್ರವರಿ ೨, ೨೦೧೨ ಭಾಗ - ೪ಎ ಗದಗ ಪ್ರಿಂಟರಿ ಸ್ಟೇಷನ್ ರೋಡ, ಗದಗ ಇವರನ್ನು ಕರ್ನಾಟಕ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರ ಕಾಯ್ದೆ 1987ರ ಕಲಂ 3(3)(ಎ) ಮತ್ತು 3(4)ರಡಿ ಹಾಗೂ ಕಲಂ (5)ರನ್ವಯ ತಕ್ಷಣದಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಗದಗ-ಬೆಟಗೇರಿ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರದ ಅಧ್ಯಕ್ಷರನ್ನಾಗಿ ಸರ್ಕಾರದ ಇಚ್ಛಾನುಸಾರ ಅಥವಾ 3 ವರ್ಷದ ಅವಧಿಯವರೆಗೆ ಇವುಗಳಲ್ಲಿ ಯಾವುದು ಮೊದಲು ಅಲ್ಲಿಯವರೆಗೆ ನಾಮ ನಿರ್ದೇಶನ ಮಾಡಿ ಆದೇಶಿಸಲಾಗಿದೆ.

ಅಧಿಸೂಚನೆ

ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಪರಿವಿಡಿಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಬೆಳಗಾವಿ ಜಿಲ್ಲೆ, ಬೈಲಹೊಂಗಲ ತಾಲ್ಲೂಕಿನ ದೇಗುಲವಳ್ಳಿಲ್ಲಿರುವ ಶ್ರೀ ಈಶ್ವರ ದೇವಾಲಯವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವೆಂದು ಘೋಷಿಸುವ ಬಗ್ಗೆ. ಕರ್ನಾಟಕ ಪ್ರಾಚೀನ ಮತ್ತು ಐತಿಹಾಸಿಕ ಸ್ಮಾರಕಗಳು ಮತ್ತು ಪುರಾತತ್ವ ನಿವೇಶನಗಳು ಮತ್ತು ಅವಶೇಷಗಳು ಅಧಿನಿಯಮ, 1961ರ ಕಲಂ 4(1)ರ (ಕರ್ನಾಟಕ ಆಕ್ಟ್ ಆಫ್ 1962) ಅಡಿಯಲ್ಲಿ ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವನ್ನಾಗಿ ಘೋಷಿಸಲು ಅಭಿಪ್ರಾಯಪಟ್ಟಿದೆ. ಈ ಉದ್ದೇಶದಿಂದ ಸದರಿ ದೇವಸ್ಥಾನವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವನ್ನಾಗಿ ಘೋಷಿಸಲು 60 ದಿನಗಳ ಅವಧಿಯೊಳಗೆ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಆಹ್ವಾನಿಸಲಾಗಿದೆ. ಈ ಸಂಬಂಧ ಕುರಿತಾದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಕನ್ನಡ, ಸಂಸ್ಕøತಿ ಮತ್ತು ವಾರ್ತಾ ಇಲಾಖೆ (ಆಡಳಿತ ಕನ್ನಡ) ವಿಕಾಸ ಸೌಧ, ಬೆಂಗಳೂರು-560 001 ಇವರಿಗೆ ಸಲ್ಲಿಸಬಹುದು.

ಅಧಿಸೂಚನೆ

ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಪರಿವಿಡಿಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಶಿವಮೊಗ್ಗ ಜಿಲ್ಲೆ, ಶಿವಮೊಗ್ಗ ತಾಲ್ಲೂಕು, ಕುಸ್ಕೂರ್ ಗ್ರಾಮದಲ್ಲಿರುವ ಪುರಾತನ ಸ್ಮಾರಕವಾದ ಶ್ರೀ ಭೀಮೇಶ್ವರ ದೇವಾಲಯವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವೆಂದು ಘೋಷಿಸುವ ಬಗ್ಗೆ. ಕರ್ನಾಟಕ ಪ್ರಾಚೀನ ಮತ್ತು ಐತಿಹಾಸಿಕ ಸ್ಮಾರಕಗಳು ಮತ್ತು ಪುರಾತತ್ವ ನಿವೇಶನಗಳು ಮತ್ತು ಅವಶೇಷಗಳು ಅಧಿನಿಯಮ, 1961ರ ಕಲಂ 4(1)ರ (ಕರ್ನಾಟಕ ಆಕ್ಟ್ ಆಫ್ 1962) ಅಡಿಯಲ್ಲಿ ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವನ್ನಾಗಿ ಘೋಷಿಸಲು ಅಭಿಪ್ರಾಯಪಟ್ಟಿದೆ. ಈ ಉದ್ದೇಶದಿಂದ ಸದರಿ ದೇವಸ್ಥಾನವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವನ್ನಾಗಿ ಘೋಷಿಸಲು 60 ದಿನಗಳ ಅವಧಿಯೊಳಗೆ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಆಹ್ವಾನಿಸಲಾಗಿದೆ. ಈ ಸಂಬಂಧ ಕುರಿತಾದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಕನ್ನಡ, ಸಂಸ್ಕøತಿ ಮತ್ತು ವಾರ್ತಾ ಇಲಾಖೆ (ಆಡಳಿತ ಕನ್ನಡ) ವಿಕಾಸ ಸೌಧ, ಬೆಂಗಳೂರು-560 001 ಇವರಿಗೆ ಸಲ್ಲಿಸಬಹುದು.

ಈ ಸ್ಮಾರಕವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವೆಂದು ಘೋಷಿಸುವ ಬಗ್ಗೆ ಯಾವುದೇ ರೀತಿಯ ಆಕ್ಷೇಪಣೆಗಳು ಬಾದಿತದಾರರಿಂದ ಮೇಲ್ಕಾಣಿಸಿದ ಅವಧಿಯೊಳಗೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಸ್ವೀಕರಿಸಿದಲ್ಲಿ ಸರ್ಕಾರವು ಅದನ್ನು ಪರಿಶೀಲಿಸಿ ಮುಂದಿನ ಕ್ರಮ ಕೈಗೊಳ್ಳುವುದು. ತಡವಾಗಿ ಸ್ವೀಕರಿಸಲಾಗುವ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಪರಿಗಣಿಸಲಾಗುವುದಿಲ್ಲ.
