NOTIFICATION

No. RD 15 BHUDAPU 2009, Dated:23.01.2012

In exercise of the powers conferred by Section 5 of the Karnataka Land Revenue Act, 1964 (Karnataka Act 12 of 1964) and taking into consideration the factors specified in clauses (i) to (iv) of rule 3 of the Karnataka Land Revenue Rules 1966 such as the population, area under land revenue and having regard to the administrative convenience, the Government of Karnataka proposes to issue a notification to alter the limits of village of Chilamoor with its hamlet of Peeranagudi, Mudakavi Hobli, Ramdurg Taluk, Belgaum District and to constitute a new village called Peeranagudi as specified in the schedule.

Now, therefore, in exercise of the powers conferred by Section 6 of the said Act, notice is hereby given for the information of all the persons likely to be affected thereby that the proposal will be taken into consideration after thirty days from the date of publication of the notification in the official gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said proposal before the expiry of the period specified above will be considered by the State Government. Objections or suggestions may be addressed to the Deputy Commissioner, Belgaum District.

The draft of the following rules further to amend the karnataka Law Reports Rules, 1983, which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section(1) of section 3 read with section 8 of the Karantaka State Civil Service Act, 1978 (Karnataka Act 14 of 1990) is hereby published as required by clause(a) of sub-section (2) of section 3 of the said Act, for the information of persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in Official Gazette.

Any objection or suggestion, which may be received by the State Goverment from any person with respect to the said draft before the expiry of the period specified above will be considered by the State Government. Objections and suggestions may be addressed to the Principal Secretary to Government, Department of Personnel and Administrative Reforms, Vidhana Soudha, Bangalore-560 001.

DRAFT RULES

1. Title and Commencement:- (1) These rules may be called the Karnataka Law Reports (Amendment)Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 4:- In rule 4 of the Karnataka Law Reports Rules, 1983, in the table:-

(i) For the category of post of Proof Readers(Kannada) at Serial No.7 and entries relating thereto in column 2,3,4,5 and 6 the following shall be substituted, namely:-

In pursuance of Sub-section 2 of Section 8 of the Mines and Minerals (Development and Regulation) Act, 1957, the Government of Karnataka accorded sanction for First renewal of Mining Lease No.1744 for a period of 20 years (Twenty years only) w.e.f. 15.04.2001, in favour of Smt.V.Susheelamma(Legal heir of Late Shri D.S.Rajappa) for Manganese ore, over an area of 104-16 acres (One hundred and four point one six acres only) in Sy.No.99 of Chikkabyaladakere village and Sy.No.59 of Doddabyaladakere village of Hosadurga taluk, Chitradurga District, vide Government Notification No.CI.312:MMM.2008 dated 16.01.2010.

Subsequently, the iron ore was included in the existing mining lease of 104-16 acres with prior approval of Government of India vide Government Notification No.CI.312:MMM.2008 dated 22.05.2010.

Now, the Government of Karnataka hereby accords sanction of first renewal of mining lease No.1744 over remaining area of 12-20 acres for a period of 20 years (Twenty years only) w.e.f. 15.04.2001, in favour of Smt.V.Susheelamma(Legal heir of Late Shri D.S.Rajappa) for Manganese ore only, as per the sketch furnished by the Director, Department of Mines and Geology, Bangalore, subject to compliance of the provisions of the Mines and Minerals (Development and Regulation) Act, 1957 and Mineral Concession Rules, 1960 as amended from time to time and other applicable Acts and Rules including Forest (Conservation) Act, 1980, Environmental Protection Act, 1986, EIA Notification 2006 etc., as amended from time to time and Rules made there under.

Sanction of this Mining lease is also subject to the terms and conditions appended hereto and also subject to Court proceedings if any.

The Department of Mines of Geology is directed to take necessary action to measure the area scientifically through GPS and to publish the digitized map in the official Website.

The renewal of Mining lease should be executed only after submission of all the statutory documents/clearances, by the applicant.

TERMS AND CONDITIONS OF THE FIRST RENEWAL OF MINING LEASE NO.1744(12-20 ACRES)

SANCTIONED IN GOVERNMENT NOTIFICATION NO.CI.312:MMM.2008 Dated 21.03.2012.

a) Mining lease should be in respect of Manganese ore, only. If other minerals are found in association with Manganese ore, they should be brought to the notice of Government and if the lessee desires to mine these minerals along with Manganese ore, he/she/it should do so only after the consent of Government is obtained in writing.

b) If beryl or any other substance prescribed U/S 3 of the Atomic Energy Act, XXIX of 1948 is found to occur in the property under the lease, the lessee shall make available such mineral to the Government of India.

c) The lease shall also be subject to the provisions of Rules in Chapter IV of the Minerals Concession Rules, 1960.

d) The lease shall also be subject to the Rules, issued U/S 18 of the Mines & Minerals (D&R) Act, 1957.

e) The lessee shall pay to the Director of Mines and Geology in Karnataka, Bangalore, necessary Security Deposit for due observance of the terms and conditions of the lease in accordance with Rule 32 of the lease issued to him.

f) The lessee shall be governed by all conditions that may be incorporated in the lease deed, to be executed.

g) The lessee shall abide by the rules contained in the Karnataka State Forest Manual, if the lease area covers any forestland.

h) Government shall have the right of purchasing the ore at current market rates.

i) The lease would be determined if the lessee fails to commence execution of the lease deed.

j) The area mentioned above is subject to verification after actual survey and demarcation.

k) The lease shall be for a period of Twenty Years w.e.f. 15.04.2001.

l) The lessee/s shall pay Royalty, Cesses and Dead rent as prescribed vide Government of India's Notification published in the Gazette of India, Extraordinary, Part II-Section 3-Sub-sectio(i) vide G.S.R.574(E) dated 13th August 2009 and G.S.R. 575(E) dated 13th August, 2009, respectively.

Local & other Cesses: As prevalent in Chitradurga District.

Royalty : At the rate prescribed in Second Schedule to the Mines & Minerals (D&R) Act, 1957 and as amended from time to time.

m) The total area held by the applicant/s under mining lease including the present one, shall not exceed 10 Sq.Km. n) Mining operations shall not be commenced/conducted unless a qualified manager and other supervisory staff are appointed as required under the Matalliferous Mines Regulations, 1961 and relevant notices are sent to the Director- General of Mines Safety, Dhanbad with a copy of the same to the concerned Director of Mines Safety.

Substitution of rule 4: In the Karnataka Civil Services (Absorption of persons appointed on contract basis in the category of posts of Craft Instructors/Junior Instructors (redesignated as Junior Training Officers) in the Department of Employment and Training (Training Wing) into State Civil Services (special) Rules, 1996 for Rule 4, the following shall be substituted namely:-

4. Pay, Pension Leave and Seniority of Person absorbed under these rules:- Not withstanding anything contained in the

Karnataka Civil Services Rules:-

1) The initial basic pay of the contract Junior Training Officer shall be fixed at the minimum of the pay scale applicable to the category of post to which he is absorbed under rule 3.

2) The Services rendered by a person as Junior Training Officer/Craft Instructor/Junior Instructor prior to the date of absorption shall not count for the purposes of leave pension pay, seniority and grant of selection time scale of pay under the KCS (Time Bound Advancement) Rules, 1983 and Karnataka Civil Services (Automatic grant of special promotion to senior scale of pay) Rules, 1991.
