Whereas sub-section (1) of section 357 of Code of Criminal Procedure, 1973 mandates for the State Government to prepare a scheme in co-ordination with the Central Government for providing funds for the purpose of compensation to the victims or his dependents who have suffered loss or injury as a result of the crime and who require rehabilitation.

Now, therefore, in exercise of the powers conferred by section 357-A of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974). The Government of Karnataka hereby frames the following scheme for providing funds for the purpose of compensation to the victims or their dependents who have suffered loss or injury as a result of the crime and who require rehabilitation, namely:-

1. Title and Commencement.- (1) This scheme may be called the Karnataka Victim Compensation Scheme, 2011.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. Definitions.- In this scheme, unless the context otherwise requires:-

(a) " Act'' means the Code of Criminal Procedure, 1973 (Central Act 2 of 1974);

(b) "District Authority'' and "State Authority'' means the District Legal Service Authority and State Legal Service Authority as defined under the Legal Services Authorities Act, 1987 (Central Act 39 of 1987);

(c) "Schedule'' means schedule appended to this scheme;

(d) "State'' means the State of Karnataka.

(e) "Victim '' means a person who himself has suffered loss or injury as a result of crime and require rehabilitation and includes his dependents who had suffered loss or injury as a result of the crime and who require rehabilitation.

3. Victims Compensation Fund.- (1) There shall be a Fund called the Victims Compensation Fund.

(2) There shall be credited to the said fund, -2404 (i) all grants, subventions, donations and gifts made by the Central Government, State Government, any local authority or anybody, whether incorporated or not or any person;

(ii) all other sums received by or on behalf of the victims compensation from any source whatsoever.

(3) Except as otherwise directed by the State Government all moneys credited to the Fund shall be invested in any Scheduled Bank or in the State Government Treasury.

4. Application of the Victims Compensation Fund.- The fund shall be applied for carrying out the purposes of this Scheme.

5. Grant by the State Government.- The State Government may every year make a grant to the fund of a sum equivalent to the expenses of the previous year or the probable expenditure requested by the State Legal Service Authority.

6. Eligibility for Compensation.- A victim shall be eligible for the grant of compensation if, -

(1) the offender is not traced or identified, but the victim is identified, and where no trial takes place, such victim may also apply for grant of compensation under sub-section (4) of section 357-A of the Act.

(2) the victim/claimant report the crime to the officer-in-charge of the police station within 48 hours of the occurrence or any senior police officer or Executive Magistrate or Judicial Magistrate of the area;

Provided that the District Legal Service Authority, if satisfied, for reasons to be recorded in writing , may condone the delay in reporting.

(3) the victim/claimant shall co-operate with the police and prosecution during the investigation and trail of the case .

7. Procedure for grant of compensation.- (1) Whenever a recommendation is made by the Court or an application is made by any victim or his dependent under sub section (2) of section 357-A of the Act to the District Legal Service Authority, the District Legal Service Authority shall examine the case and verify the contents of the claim with regard to the loss or injury caused to the victim and arising out of the reported criminal activity and the District Legal Service Authority may call for any other relevant information necessary in order to determine genuineness of the claims. After verifying the claim, the District Legal Service Authority shall after due enquiry award compensation within two months, in accordance with the provisions of this scheme.

(2) Compensation under this Scheme shall be paid subject to the condition that if the trial court while passing judgement at a later date, orders the accused persons to pay any amount by way of compensation under sub-section (3) of section 357 of the Act , is paid or recovered and paid to the victim/claimant shall remit an amount ordered equal to the amount of compensation, or the amount ordered to be paid under the said sub section (3) of section 357 of the Act, whichever is less. An undertaking to this effect shall be given by the victim/claimant before the disbursal of the compensation amount.

(3) The District Legal Service Authority shall decide the quantum of compensation to be awarded to the victim or his dependents on the basis of loss caused to the victim, medical expenses to be incurred on treatment, minimum sustenance amount required for rehabilitation including such incidental charges as funeral expenses etc. The compensation may vary from case to case depending on fact of each case.

(4) The quantum compensation to be awarded to the victim or his dependents shall not exceed the maximum limit specified in Schedule 1.

(5) The amount of compensation decided under the Scheme shall be disbursed to the victim or his dependents as the case may, be from the Fund through cheque.

(6) Compensation received by the victim from the State in relation to the crime in question, namely insurance, ex- gratia and /or payment received under any other Act or State run scheme that includes compensation awarded by State/National Human Rights Commissions or any Court/Commission shall be considered as part of the compensation amount under this scheme and if the eligible compensation amount exceeds the payments received by the victim from collateral sources mentioned above, the balance amount only shall be paid out of Fund.

(7)The Cases covered under Motor Vehicle Act, 1988, (59 of 1988) wherein compensation is to be awarded by the Motor Accident Claims Tribunal, shall not be covered under the Scheme.

(8) The District Legal Services Authority, to alleviate the suffering of the victims , may order for immediate first- aid facility or medical benefits to be made available free of cost on the Certificate of the Police Officer not below the rank of the Officer-in-charge of the police station or Magistrate of the area concerned or any other interim relief as it may deems fit.

(9) The District Legal Service Authority shall not allow any participation or representation by a legal practitioner or any other person or institution or Non-Governmental Organisation on behalf of the victim/claimant.

(10) If a victim or his dependents have obtained an order sanctioning compensation under this scheme based on false/vexatious/fabricated complaint which is so held by the trial Court, the compensation awarded shall be recovered with 15% interest per annum.

8. Order to be placed on record.- Copy of the order of compensation passed under this Scheme shall be mandatorily placed on record of the trail Court to pass order of compensation under sub-section (3) of section 357 of the Act.

9. Limitation.- No claim made by the victim or his dependents under sub-section (4) of section 357-A of the Act shall be entertained after a period of twelve months from the date of the crime.

Provided that the District Legal Authority, if satisfied for the reasons to be recorded in writing, may condone the delay in filing the claim.

10. Appeal.- Any victim aggrieved of the denial of compensation by the District Legal Service Authority may file an appeal before the State Legal Service Authority within a period of ninety days:

Whereas, the draft of the following rules further to amend the Karnataka Education Department Services (Department of Public Instructions) (Recruitment) Rules 1967, was published as required by clause (a) of sub-section (2) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), in Notification No. ED 251 DPI 2009 (P), Dated: 27/01/2012 in Part IVA, in No: 66 of the Karnataka Gazette (Extraordinary) Dated: 30/01/2012, inviting objections and suggestions from all persons likely to be affected thereby, within fifteen days from the date of its publication in the Official Gazette.

Whereas, no objections / suggestions has been received in this behalf by the State Government. Now, therefore, in exercise of the powers conferred by sub-section (I) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely:-

1. Title and commencement.- (1) These rules may be called the Karnataka Education Department Services (Department of Public Instructions) (Recruitment) (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of Schedule.- In the Karnataka Education Department Services (Department of Public Instructions) (Recruitment) Rules 1967, in the schedule, after serial number 35 and the entries relating there to, the following shall be deemed to have been inserted with effect from 30th day of August 2007 namely:-

ಆದ್ದರಿಂದ, ರಾಯಚೂರು ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರವನ್ನು ವಿಭಜಿಸಿ ದೇವದುರ್ಗ ತಾಲ್ಲೂಕಿಗೆ ಪ್ರತ್ಯೇಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ ಸ್ಥಾಪಿಸಲು ಸರ್ಕಾರ ತೀರ್ಮಾನಿಸಿದೆ.

ಆದ್ದರಿಂದ, ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) ಅಧಿನಿಯಮ 1966 ರ ಕಲಂ 3 ಮತ್ತು 145 (1)

ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ರಾಯಚೂರು ಮತ್ತು ದೇವದುರ್ಗ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರವನ್ನು ಈ ಕೆಳಗಿನ ಅನುಸೂಚಿ 4ನೇ ಅಂಕಣದಲ್ಲಿ ನಮೂದಿಸಿದ ಕೃಷಿ ಉತ್ಪನ್ನಗಳ ಮಾರಾಟ ನಿಯಂತ್ರಣಕ್ಕಾಗಿ 3ನೇ ಅಂಕಣದಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರದ ಪರಿಮಿತಿಯನ್ನೊಳಗೊಂಡಂತೆ 2ನೇ ಅಂಕಣದಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವಂತೆ ಪ್ರತ್ಯೇಕ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರಗಳನ್ನಾಗಿ ವಿಭಜಿಸಿದೆ :

The draft of the following rules further to amend the Karnataka Excise (Distillery and Warehouse) Rules, 1967, was published as required by sub-section (1) of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966) in Notification No FD 07 PES 2011 dated 19-01-2012 in the Karnataka Gazette (Extra ordinary) dated :19-01-20122415 inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date of its publication in the official Gazette.

And whereas the said Gazette was made available to the public on 19-01-2012

And whereas no objections and suggestions have been received in respect of the said draft by the State Government.

Now therefore, in exercise of the powers conferred by section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966), the Government of Karnataka hereby makes the following rules namely,-

RULES

1. Title and commencement:- (1) These rules may be called the Karnataka Excise (Distillery and Warehouse) (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of rule 7.- In the Karnataka Excise (Distillery and Warehouse) Rules, 1967, in rule 7, in sub- rule(1),-

(i) in clause (i), after the words "any grains". the words "topioca, sweet potato, sugar beet" shall be inserted;

(ii) clause (ii) shall be omitted;

(iii) in clause (v), after the words "sweet potato", the words "sugar beet" shall be inserted.

ಅ) ಶೀರ್ಷಿಕೆ "1. ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆಯ ಉಪ ಶೀರ್ಷಿಕೆ ಸ್ಥಳೀಯ ಪ್ರಾಧಿಕಾರ - ಬೆಂಗಳೂರು ನೀರು ಸರಬರಾಜು ಮತ್ತು ಒಳಚರಂಡಿ

ಮಂಡಳಿ"ಯಲ್ಲಿನ ಕ್ರಮ ಸಂಖ್ಯೆ 2 ರ ಅಂಕಣ 4ರಲ್ಲಿನ ಪದಗಳು ``7 ಕೆಲಸದ ದಿನಗಳು" ಬದಲಾಗಿ "21 ಕೆಲಸದ ದಿನಗಳು" ಎಂದು ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು.

ಇ) ಶೀರ್ಷಿಕೆ 4ರಡಿಯಲ್ಲಿ, "ಕಂದಾಯ ಇಲಾಖೆ" ಯಲ್ಲಿ

(i) ಕ್ರಮ ಸಂಖ್ಯೆ 10 ರಲ್ಲಿನ ಅಂಕಣ 2ರಲ್ಲಿನ ನಮೂದು "Residence Certificate" ರ ಬದಲಾಗಿ ನಮೂದು "Domicile Certificate" ಎಂದು ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು.

(ii) ಕ್ರಮ ಸಂಖ್ಯೆ 23 ರಲ್ಲಿನ ಅಂಕಣ 2ರಲ್ಲಿನ ನಮೂದು "Domicile Certificate" ರ ಬದಲಾಗಿ ನಮೂದು "Residence Certificate" ಎಂದು ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು.

(iii) ಕನ್ನಡ ಭಾಷೆಯಲ್ಲಿನ ಆವೃತ್ತಿಯಲ್ಲಿ ಹೆಸರಿಸಲಾದ ಅಧಿಕಾರಿ, ಸಕ್ಷಮ ಅಧಿಕಾರಿ ಹಾಗೂ ಮೇಲ್ಮನವಿ ಪ್ರಾಧಿಕಾರಗಳ ನಮೂದುಗಳಲ್ಲಿ "ಉಪ ಆಯುಕ್ತರು"ರ ಬದಲಾಗಿ "ಜಿಲ್ಲಾಧಿಕಾರಿ" ಎಂದು ಮತ್ತು ನಮೂದು "ಸಹಾಯಕ ಆಯುಕ್ತರು" ಬದಲಾಗಿ "ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ" ಎಂದು ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು.

(iv) ಕ್ರಮ ಸಂಖ್ಯೆ (7) ಮತ್ತು ಕ್ರಮ ಸಂಖ್ಯೆ (8) ರಲ್ಲಿನ ನಮೂದುಗಳ ಬದಲಿಗೆ ಕೆಳಕಂಡ ನಮೂದುಗಳನ್ನು ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು:

ಈ) ಶೀರ್ಷಿಕೆ 7ರಡಿಯಲ್ಲಿ, "ಆರೋಗ್ಯ ಮತ್ತು ಕುಟುಂಬ ಕಲ್ಯಾಣ ಇಲಾಖೆ"ಯ ಉಪಶೀರ್ಷಿಕೆ-1, ಆರೋಗ್ಯ ಮತ್ತು ಕುಟುಂಬ ಸೇವೆಗಳ ಇಲಾಖೆಯಡಿಯಲ್ಲಿ,

(i) ಕ್ರಮಸಂಖ್ಯೆ 2 ರ ಅಂಕಣ 2 ರಲ್ಲಿನ ನಮೂದು "ಗಾಯದ ಪ್ರಮಾಣಪತ್ರವನ್ನು ನೀಡುವುದು"ರ ನಂತರ ಚಿಹ್ನೆ ಮತ್ತು ನಮೂದು "ಸಣ್ಣ ಪ್ರಮಾಣದ ಗಾಯ" ಎಂದು ಸೇರ್ಪಡೆ ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದು.

(ii) ಕ್ರಮಸಂಖ್ಯೆ 4 ರ ನಮೂದು 2 "ವಯೋ ಪ್ರಮಾಣಪತ್ರವನ್ನು ನೀಡುವುದು" ನಂತರ "ತಜ್ಞರ ಅಭಿಪ್ರಾಯ ಅವಶ್ಯಕತೆ ಇಲ್ಲದ" ಎಂದು ಸೇರ್ಪಡೆ ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದು.

(iii) ಸಕ್ಷಮ ಅಧಿಕಾರಿ ಮತ್ತು ಮೇಲ್ಮನವಿ ಪ್ರಾಧಿಕಾರದ ನಮೂದುಗಳಲ್ಲಿ "ಉಪ ಆಯುಕ್ತರು" ಎಂಬುದರ ಬದಲಾಗಿ "ಜಿಲ್ಲಾಧಿಕಾರಿ" ಎಂದು ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು.

ಉ) ಶೀರ್ಷಿಕೆ 8ರಡಿಯಲ್ಲಿ, "ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್ ರಾಜ್ ಇಲಾಖೆ"ಯ ಕ್ರಮ ಸಂಖ್ಯೆ 4ರ ಅಂಕಣ 2ರಲ್ಲಿನ ನಮೂದು "ಕುಡಿಯುವ ನೀರಿನ ನಿರ್ವಹಣೆ" ಎಂಬುದಕ್ಕೆ ಬದಲಾಗಿ "ಕುಡಿಯುವ ನೀರಿನ ನಿರ್ವಹಣೆ- ಸಣ್ಣ ಪ್ರಮಾಣದ ರಿಪೇರಿಗಳು" ಎಂಬುದಾಗಿ ಓದಿಕೊಳ್ಳತಕ್ಕದ್ದು.

In exercise of the powers conferred by Section 4 of the Karnataka Guarantee of Services to Citizens Act, 2011 (Karnataka Act 1 of 2012), the Government of Karnataka, hereby amends the Schedule to the said Act as follows, namely:-

In the Schedule to the said Act,

I. Under the Heading "1.URBAN DEVELOPMENT DEPARTMENT", under the Sub-Heading "II- Local Authority- Bangalore Water Supply & Sewerage Board", in the entries relating to Sl. No. 2, in Column 4 for the words "7 working days", the words "21 working days" shall be substituted.

II. Under the Heading "3, FOOD AND CIVIL SUPPLIES DEPARTMENT", in the entries relating to Sl. No. 1, Column No.2 the symbol and the word "/renewal" shall be omitted.

III. Under the Heading "4.REVENUE DEPARTMENT ",-

(a) in the entries relating to Sl.No.10, in column No. 2, for the words "Residence Certificate", the words "Domicile Certificate" shall be substituted;

(b) in the entries relating to Sl.No.23, in column No.2, for the words "Domicile Certificate", the words "Residence Certificate" shall be substituted;

a. In the entries relating to Sl.No.2, in column No.2, after the words "issue of wound certificate" the symbol and the words "- minor wound" shall be inserted.

KARNATAKA ACT NO 17 OF 2012

(First Published in the Karnataka Gazette Extra-ordinary on the thirty-first day of March, 2012) THE KARNATAKA VALUE ADDED TAX (AMENDMENT) ACT, 2012

(Received the assent of the Governor on the thirty-first day of March, 2012)

An Act further to amend the Karnataka Value Added Tax Act, 2003.

Whereas it is expedient further to amend the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004) for the purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the Sixty third year of the Republic of India, as follows.- 1. Short title and commencement.- (1) This Act may be called the Karnataka Value Added Tax (Amendment) Act, 2012.

(2) It shall come into force with effect from the First day of April, 2012.

2. Amendment of section 4.- In the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004) (hereinafter referred to as the principal Act), in section 4, in sub-section (1),

(i) in clause (b), in sub-clause (ii), for the words "fifteen per cent", the words "seventeen per cent" shall be substituted;

(ii) at the end, the following proviso shall be and shall always be deemed to have been inserted, namely:-

"Provided that the rate of tax in respect of declared goods as specified in section 14 of the Central Sales Tax Act, 1956 (Central Act 74 of 1956) shall be four per cent from Eighth day of April, 2011 to Eleventh day of April, 2011."2420 3. Amendment of section 11.- In section 11 of the principal Act, for sub-section (c), the following shall be substituted, namely:-

"(c) Input tax shall not be deducted by any dealer executing a works contract,

(i) in respect of the amount paid or payable to any sub-contractor as the consideration for execution of part or whole of such works contract for him, that is claimed as deduction; and

(ii) in respect of the amount actually expended towards labour and other like charges not involving any transfer of property in goods in connection with the execution of works contract, that is claimed as deduction."

4. Omission of section 18-A.- Section 18-A of the principal Act shall be omitted.

5. Omission of section 30.- Section 30 of the principal Act shall be omitted.

6. Amendment of section 35.- In section 35 of the principal Act, for sub-section (4), the following shall be substituted, namely:-

"(4) If any dealer having furnished a return under this Act, other than a return furnished under sub-

section (3) of Section 38, discovers any omission or incorrect statement therein, other than as a result of an

inspection or receipt of any other information or evidence by the prescribed authority,

(a) he shall furnish a revised return within the time prescribed for filing the return for the

succeeding tax period; and

(b) he shall furnish a revised return any time thereafter but within six months from the end of the

relevant tax period, if so permitted by the prescribed authority."

7. Amendment of section 40.- In section 40 of the principal Act, for sub-sections (1) and (2), the following shall be substituted, namely:-

"(1) An assessment under section 38 or re-assessment under Section 39 of an amount of tax due for any prescribed tax period shall not be made after five years after the end of the prescribed tax period.

Provided that an assessment or reassessment relating to any tax period upto the period ending 31st day of March, 2007 shall be made within a period of eight years after the end of the prescribed tax period.

Provided further that an assessment or reassessment relating to any tax period commencing from the 1st day of April, 2007 upto the period ending 31st day of March, 2012 shall be made within a period of seven years after the end of the prescribed tax period.

(2) Notwithstanding anything contained in sub-section (1), if any tax is, not paid by a dealer who has failed to get registered though liable to do so or fraudulently evaded attracting punishment under Section 79, an assessment or reassessment may be made within eight years from the end of the prescribed tax period.

Provided that an assessment or reassessment relating to any tax period upto the period ending 31st day of March, 2007 shall be made under this sub-section within a period of ten years after the end of the prescribed tax period."

8. Amendment of section 53.- In section 53 of the principal Act, in sub-section (2), before the Explanation, the following proviso shall be inserted, namely:-

"Provided that the Commissioner may notify the website in which the particulars prescribed to be contained in the declaration specified under clause (d) shall be entered in respect of any specified class of goods or any specified class of dealers or as a result of any specified class of transactions as may be notified by him. Where the Commissioner has so notified the website, the owner or the person in charge of the goods vehicle or a boat or a ship or similar vessel shall enter the above particulars in the notified website and shall produce proof of entering the particulars in such website, before the officer-in-charge of the checkpost or barrier or any other empowered officer."2421 9. Amendment of section 54.- In section 54 of the principal Act,- (i) in sub-section (1),

(a) for the words "Where a vehicle carrying goods taxable under this Act", the words "Where a vehicle carrying goods as may be notified by the Government or the Commissioner" shall be substituted; and (b) for the proviso, the following shall be substituted, namely:-

"Provided that the Commissioner may notify the website in which the necessary information shall be furnished by the driver or any other person-in-charge of the vehicle after entry of such vehicle into the State or after its movement has commenced from the State, for issue of a transit pass. Where the Commissioner has so notified the website, the driver or any other person in charge of the vehicle after entry of the vehicle into the State or after movement has commenced from the State, shall enter the above information in the notified website for issue of a transit pass."

(ii) in sub-section (2), the following proviso shall be inserted, namely:-

"Provided that the Commissioner may notify the website in which the driver or the person in charge of the vehicle shall enter the particulars of the transit pass obtained under sub-section (1), before his exit from the State on a route where no checkpost or barrier is situated. Where the Commissioner has so notified the website, the driver or the other person in charge of the vehicle shall enter the particulars of the transit pass obtained under sub-section (1) in the notified website before his exit from the State."

10. Amendment of section 62.- In section 62 of the principal Act, in sub-section (4),

(i) in clause (a), for the words "payment of tax and penalty", the words "payment of tax and other amount" shall be substituted.

(ii) in clause (c),

(a) for sub-clause(i), the following shall be substituted, namely:-

"(i) The appellate authority may, in its discretion, stay payment of one half of tax and other amount, if the appellant makes payment of the other half of the tax and other amount along with prescribed form of appeal." (b) in sub-clause (ii), for the words "subject to payment of one half of the tax disputed", the words "subject to payment of one half of the tax and other amount disputed" shall be substituted.

(iii) clause (e) shall be omitted.

11. Amendment of section 69.- In section 69 of the principal Act, sub-section (2-A) shall be omitted.

12. Amendment of section 72.- In section 72 of the principal Act, after sub-section (6), the following shall be inserted, namely:-

"(7) Any dealer who fails to submit returns as required by the provisions of the Act continuously for three months or two quarters, as a case may be, shall on conviction, in addition to recovery of any tax or penalty or interest or other amount that may be due from him or levied on him, be punishable with simple imprisonment which may extend to six months or with a fine which shall not be less than five thousand rupees but which may extend to twenty five thousand rupees or with both and when the offence is a continuing one, with a daily fine not exceeding two hundred rupees during the period of continuance of the offence."

13. Amendment of section 74.- In section 74 of the principal Act, in sub-section (1),

(i) for the words "two thousand rupees", the words "five thousand rupees" shall be substituted;

(ii) for the words "five thousand rupees", the words "ten thousand rupees" shall be substituted.

14. Amendment of section 75.- In section 75 of the principal Act, for the words "five thousand rupees", the words "ten thousand rupees" shall be substituted.

15. Amendment of section 80.- In section 80 of the principal Act, for the words and figures "under Section 79" in the two places they occur, the words "under section 72 or 79" shall be substituted.

16. Amendment of First Schedule.- In the First Schedule to the principal Act,

(i) for the entry relating to serial number 4, the following shall be substituted, namely:-

"4. All varieties of textiles and fabrics but excluding those specified elsewhere in Third Schedule or notified by the Government."

(ii) for the entries relating to serial number 47, the following shall be and shall be deemed to have been substituted from Eighth day of April, 2011, namely:-

"47. Sugar other than sugar candy, confectionery and the like."

17. Amendment of Third Schedule.- In the Third Schedule to the principal Act, after the entries relating to serial number 29, the following shall be inserted, namely:-

"30. HDPE and other plastic woven fabrics."

18. Amendment of Sixth Schedule.- In the Sixth Schedule to the principal Act, after the entries relating to serial number 6, the following shall be inserted, namely:-

"7. Manufacture and supply of readymade garments, Five per cent clothing accessories and other made up textile

articles including dyeing, printing, stitching,

embroidery work and the like.

Whereas the draft of the Karnataka Health and Family Welfare Services [Recruitment to Group-D Posts] [Special] Rules, 2012 was published as required by sub-section (2) of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No: HFW 6 HSM 2012 dated: 29-03-2012 in Part–IV-A of the Karnataka Gazette extraordinary dated: 29-03-2012 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the official Gazette.

And whereas the said Gazette was made available to the public on 29-03-2012.

And whereas the objections and suggestions received have been considered by the State Government.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules namely:-

RULES

1. Title, commencement and application.- (1) These rules may be called the Karnataka Health and Family Welfare Services [Recruitment to Group-D Posts] [Special] Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

(3) Notwithstanding anything contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or in the Karnataka Health and Family Welfare Department Services (Recruitment) Rules, 1965 or any other rules of recruitment relating to the category of posts specified in the Schedule made or deemed to have been made under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the provision of these rules, shall apply to the 2323 direct recruitment vacancies for the category of posts of Group-D in the Karnataka Department of Health and Family Welfare Services as specified in the Schedule:

Provided that nothing in these rules shall apply to more than one recruitment.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) "Schedule" means the Schedule appended to these rules;

(b) "Special Recruitment Committee" means the Committee Constituted under rule 3;

(c) "Vacancies" means the posts to be filled up as specified in column (1) and (2) of the Schedule.

(2) Other words and expressions used but not defined in these rules shall have the same meaning assigned to them in the Karnataka Civil Services (General Recruitment) Rules, 1977, as amended from time to time.

3. Constitution of Special Recruitment Committee,- There shall be constituted a Special Recruitment Committee at the State level for selecting candidates for recruitment to fill up the vacancies specified in the Schedule,

4. Qualification and age.- (1) The qualification for direct recruitment to the vacancies of posts specified in column (1) and (2) of the schedule under these rules, shall be as specified in column (3) there of and the maximum age limit shall be in accordance with the Karnataka State Civil Services (General Recruitment) Rules, 1977.

(2) No candidate shall be eligible for direct recruitment under these rules unless he has studied in Karnataka for not less than ten years, i.e., from 1st Standard to 10th Standard.

5. Applications for recruitment.- The Special Recruitment Committee shall advertise category of posts and the number of vacancies in the Official Gazette specifying the conditions of eligibility, the nature of selection, the2424 classification of posts in accordance with the reservations of posts provided by or under any law or order for the time being in force and invite applications from all eligible intending candidates. Abstract of such advertisement shall also be published in at least two leading newspapers having wide circulation in the State, of which one shall be in Kannada language.

6. Mode of recruitment and list of selected candidates.- (1) The Special Recruitment Committee shall, from among the candidates who have applied in pursuance to the advertisements under rule 5, prepare a list of candidates eligible for appointment under these rules in respect of the category of post in the order of merit determined on the basis of marks obtained in the qualifying examination as specified in column (3) of the Schedule. The percentage of total marks obtained in the qualifying examination in which he has obtained highest percentage of total marks shall be taken into consideration, subject to the reservation of posts provided by or under any law or any rules for the time being in force.

(2) If two or more candidates have secured equal percentage of total marks in the qualifying examination, the order of merit in respect of such candidates shall be fixed on the basis of their age, the older in age being placed above in the order of merit. The Special Recruitment Committee shall prepare a final selection list on the above basis.

(3) The number of candidates to be selected under sub rule(1), shall be equal to the number of vacancies notified.

(4) The Special Recruitment Committee shall also prepare an additional list of candidates not included in the main list prepared under sub-rule (1) in which the number of candidates to be included shall not exceed ten percent of the total number of vacancies notified in each of the reserved categories (horizontal and vertical). There shall be atleast one candidate in the additional list belonging to each of the reserved categories (horizontal and vertical) represented in the list under sub-rule(1). If the candidate whose name is included in the list under sub-rule (1) fails to report for duty within the prescribed period then a candidate belonging to same reservation category as for the candidate who failed to report for duty shall be appointed from additional list.

(5) The list prepared under sub-rule (1) and (2) shall be published in the Official Gazette and shall be valid till all the vacancies specified under these rules are filled up or until the expiry of a period of one year from the date of issue of appointment order to the selected candidates, whichever is earlier.

7. Appointment of candidate.- (1) The Special Recruitment Committee shall send the list of candidates selected under rule 6 to the Appointing Authority. The candidates, whose names are included in the select list sent by the Special Recruitment Committee, shall be appointed through counseling by the Appointing Authority in the vacancies in the order in which their names are found in the select list after satisfying itself and after such enquiry as may be considered necessary, that each of such candidate is suitable in all respect for such appointment.

(2) The inclusion of the names of the candidates in the list published under sub-rule (2) of rule 6, shall not confer any right of appointment. The candidates in the additional list may be appointed in the post, not exceeding the extent of unfilled vacancies in the main list.

8. General.- The cost of application and bond fee shall be as fixed by the Special Recruitment Committee from time to time. The amount so collected shall be deposited in any of the nationalized banks by opening an account in the name of the Special Recruitment Committee. The Member-Secretary shall be authorized to operate such account on behalf of the Committee to meet the expenses incurred in connection with the selection of the candidates such as paid publication in news papers, verification of documents, computerizing and counseling procedure etc., with the prior approval of the Chairman of the Special Recruitment Committee.

9. Application of other rules.- The Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957, the Karnataka Civil Services (Conduct) Rules, 1966 and Karnataka Civil Services (Probation) Rules, 1977 and all other rules for the time being in force regulating the recruitment and conditions of service of Government servants made or deemed to have been made under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in2425 so far as such rules are not inconsistent with the provisions of these rules shall be applicable to the selection made and to the persons appointed under these rules.

The draft of the following rules further to amend the Karnataka Sericultural Services (Recruitment) Rules, 1984, which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) is hereby published as required by clause (a) of sub-section (2) of section 3 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the official Gazette.

Any objection or suggestion, which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Principal Secretary to Government, Horticulture Department, Multistoried Building, Bangalore-560 001.

DRAFT RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Sericultural Service (Recruitment) (Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of Schedule: In the Karnataka Sericultural Services (Recruitment) Rules, 1984 in the schedule,- (1) In the entries relating to the category of post of Executive Engineer (Civil)"

(a) in column No.(1), Post of Executive Engineer (Civil) shall be inserted;

(b) in column (2), the following shall be inserted, namely:-

"By promotion from the cadre of Assistant Executive Engineer (Civil)".

(c) in column (3), the following shall be inserted, namely:-

"For promotion.- Must have put in a service of not less than seven years in the cadre of Assistant Executive Engineer (Civil), if no suitable person is available for promotion, by deputation of an officer in equivalent cadre from the Public Works Department".

(a) in column No.(1) in the entries relating to the category of post of "Assistant Executive Engineer (Civil)",- (b) in column (2), the following shall be inserted, namely:-

"By promotion from the cadre of Assistant Engineer (Civil)"

(c) In column (3), the following shall be inserted, namely:-

"For promotion.- Must have put in a service of not less than ten years in the cadre of Assistant Engineer (Civil). If no suitable person is available for promotion, by deputation of an officer in equivalent cadre from the Public Works Department".

(3) in the entries relating to the category of post of "Assistant Engineer (Civil)",-

(a) for the entries in column (2), the following shall be substituted namely,-

"By direct recruitment – in Karnataka Public Works Engineering Department Service (Recruitment) Rules, 1988.

"Fifty percent by direct recruitment and fifty percent by promotion from the cadre of Senior Sericulture Inspector / Sericulture Inspector.

Provided that if no suitable persons are available for promotion from the cadre of Senior Sericulture Inspector, by promotion from the cadre of Sericulture Inspector."

(b) for the entries in column (3), the entries relating for promotion the following shall be substituted, namely:-

For promotion.- Must have put in a service of not less than five years in the cadre of Senior Sericulture Inspector or Sericulture Inspectors.

Provided that if persons who have put in a service of not less than five years are not available, persons who have put in a service of not less than three years may be considered for promotion."

In exercise of the powers conferred by sub-section (1) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Central Act 35 of 2009), the Government of Karnataka hereby makes the following rules, namely:-

RULES

PART - I

PRELIMINARY

1. Title, extent, commencement and application. (1) These rules may be called the Karnataka Right of Children to Free and Compulsory Education Rules, 2012.

(2) They shall extend to the whole of the State of Karnataka.

(3) They shall come into force from the date of their publication in the Official Gazette.

(4) The provisions of these rules shall apply to all schools and shall have overriding effect over the provisions of rules made under the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995) to the extent of their repugnancy.

Where no provisions are made in these rules, the provisions of other rules made under any other law shall continue to apply.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) "Act" means the Right of Children to Free and Compulsory Education Act, 2009 (Central Act 35 of 2009);

(b) "Academic Authority" means the Department of State Educational Research and Training (DSERT) for schools affiliated to the State Board;

(c) "BEO" means the Block Education Officer of the education block;

(d) "CEO" means the Chief Executive Officer of the Zilla Panchayat of the district, appointed under the Karnataka Panchayat Raj Act, 1993;

(e) "Child belonging to disadvantaged group" means a child belonging to the Scheduled Caste, the Scheduled Tribe, the Backward Class as specified by the Government of Karnataka., by notification under clause(d) of Section 2 of the Act; It also includes orphan, migrant and street child, child with special needs and HIV affected/infected child;

(f) "Child belonging to weaker section" means a child belonging to such parent or guardian whose annual income is lower than the minimum limit as notified by the State under clause(e) of Section 2 of the Act.

(g) "Commissioner" means the Commissioner for Public Instruction, which includes Additional Commissioners for Public Instruction, Dharwad and Gulbarga ;

(h) DDPI means the Deputy Director of Public Instruction (Administration) of the educational district; (i) DIET means the District Institute of Education and Training, which is set up in the district as an institution for providing academic support for education and training of teachers;

(j) "Government" means the State Government;

(k) "Governing Council" means any person or body of persons permitted or deemed to be permitted under this Act to establish or maintain a private educational institution, and includes the governing body, by whatever name called, to which the management of affairs of the said educational institution are entrusted;

(l) "NCTE" means the National Council for Teacher Education;

(m) "School Development and Monitoring Committee" (SDMC) means School Management Committee (SMC) constituted under section 21 of the Act;

(n) "School mapping" means planning school location to overcome social barriers and geographical distance.

(2) All other words and expressions used herein and not defined shall have the same meaning assigned to them in the Act.

PART - II

RIGHT OF CHILDREN TO FREE AND COMPULSORY EDUCATION

Special Training for the purpose of first provision to Section 4

3. Right of children to free and compulsory education.-(1) The School Development and Monitoring Committee under local authority shall identify children requiring special training and organise such training in the following manner, namely:-

(a) The special training shall be based on specially designed, age appropriate learning material, approved by DSERT, the academic authority;

(b) It shall be provided in classes held on the premises of the school, or through classes organised in safe residential facilities;

(c) It shall be provided by teachers working in the school, or by teachers specially appointed for the purpose;

(d) The duration shall be for a minimum period of three months which may be extended, based on periodical assessment of learning progress, for a maximum period not exceeding two years.

(2) The child shall, upon induction into the age appropriate class, after special training, continue to receive special attention by the teacher to enable him to successfully integrate with the rest of the class, academically and emotionally.

PART - III

DUTIES OF STATE GOVERNMENT, LOCAL AUTHORITY

4. Areas or limits for the purposes of section 6.- (1) The areas or limits of neighbourhood throughout the state except the city corporations within which a school has to be established by the State Government and the local Authority shall be as under, namely:-

(a) In respect of children in classes I - V, a school shall be established normally within a walking distance of one km of the neighbourhood;

(b) In respect of children in classes VI - VII, a school shall be established normally within a walking distance of 3 km of the neighbourhood; and

(c) In respect of children in class VIII, a school shall be established within a distance of 5 km of the neighbourhood.

Provided that, in case of urban areas where local authorities are City Corporations, the area of neighbourhood shall be the area of ward notified for the purpose of governance of local authority.

(2) The State Government shall endeavour within the limits of its economic capacity and development to add VIII to schools with classes up to VII in a phased manner.

(3) Wherever required, the State Government shall upgrade existing schools with classes I - V to include classes VI – VIII. In respect of schools which start from class VI onwards, the State Government shall endeavour to add classes I – V, wherever required.

(4) In areas with difficult terrain, risk of landslides, floods, lack of roads and in general, danger for young children in the approach from their homes to the school, B.E.O or Local Authority shall locate the school in such a manner as to avoid such dangers, by reducing the limits specified under sub-rule (1).

(5) For children from small hamlets, as identified by the DDPI or Local Authority, where no school exists within the area or limits of neighbourhood specified under sub-rule (1) above, suitable arrangements such as free transportation, residential facilities and/or other facilities shall be arranged. The cost for these alternative arrangements shall be fixed by C.P.I or the Local Authority as per local conditions. Expenditures on alternative arrangements shall be met by State Government /Local Authority.

(6) In areas with high population density, the C.P.I or local authority may consider establishment of more than one neighbourhood school, having regard to the number of children in the age group of 6-14 years in such areas.

(7) The Local Authority shall identify the neighbourhood school where children can be admitted and make such information public for each habitation within its jurisdiction.

(8) In respect of children with disability which prevent them from accessing the school, the C.P.I or Local Authority shall endeavour to make appropriate and safe transportation arrangements for them to attend school and complete elementary education.

(9) The C.P.I or Local Authority shall ensure that access of children to the school is not hindered on account of social and cultural factors.

5. Duties of Government and Local Authority towards disadvantaged group of children for the purpose

of Sec. 8 and 9.- (1) A child attending a school of the State Government or local authority referred to in sub- clause (i) of clause (n) of section 2, a child attending a school referred to in sub-clause (ii) of clause (n) of section 2 in pursuance to clause (b) of sub section (1) of section 12, and a child attending a school referred to in sub-clause (iii) and (iv) of clause (n) of section 2 in pursuance to clause (c ) of sub section (1) of section 12 shall be entitled only to free text books, writing materials and uniforms.

Provided that a child with Disability shall also be provided free special learning and support material.

Explanation: In respect of the child admitted in pursuance of clause (b) of sub-section (1) of section 12 and a child admitted in pursuance clause (c) of sub-section (1) of section 12, the responsibility of providing the free entitlement shall be of the school referred to in sub- clause (ii) of clause (n) of section 2 and of sub-clauses (iii) and (iv) of clause (n) of section 2, respectively.

(2) For the purpose of determining and for establishing neighbourhood schools, the C.P.I or the local authority shall undertake school mapping, and identify all children, including children in remote areas, children with Disabilities children belonging to disadvantaged groups, children belonging to weaker sections and children referred to in section 4, within a period of one year from the appointed date, and every year thereafter.

(3) The D.D.P.I or local authority shall ensure within their jurisdiction that no child is subjected to caste, class, religious or gender discrimination in the school.

(4) For the purposes of clause (c) of section 8 and clause (c) of section 9, the C.P.I and the local authority shall ensure that a child belonging to a weaker section and a child belonging to disadvantaged group is not segregated or discriminated against in the classroom, during mid day meals, in the play grounds, in the use of common drinking water and toilet facilities, and in the cleaning of toilets or classrooms.

6. Maintenance of records of children by local authority for the purposes of clause (d) of section 9:-(1)

The Local Authority shall maintain a record of all children, in its jurisdiction, through a household survey, from their birth till they attain 14 years.

(2) The record, referred to in sub-rule (1), shall be updated each year.

(3) The record, referred to in sub-rule (1), shall be maintained transparently, in the public domain, and used for the purposes of clause (e) of section 9

(4) The record, referred to in sub-rule (1) shall, in respect of every child, include,-

(a) name, sex, date of birth, (Birth Certificate Number), place of birth;

(b) parents or guardians' names, address, occupation;

(c) pre-primary school or Anganwadi centre that the child attends (up to age 6);

(d) elementary school where the child is admitted;

(e) present address of the child;

(f) class in which the child is studying (for children between age 6-14), and if education is discontinued in the territorial jurisdiction of the Local Authority, the cause of such discontinuance;

(g) Whether the child belongs to a disadvantaged group within the meaning of clause (d) of section 2 of the Act;

(h) whether the child belongs to the weaker section within the meaning of clause (e) of section 2 of the Act;

(i) details of children requiring special facilities or residential facilities on account of migration and sparse population; age appropriate admission; disability.

(5) The Local authority shall ensure that the names of all children enrolled in the schools and out of school children under its jurisdiction are publicly displayed in each school.

PART- IV

RESPONSIBILITIES OF SCHOOLS AND TEACHERS

Admission of children belonging to weaker section and disadvantaged group for the purposes of clause

(c) of section 12 (1).-(1) The school referred to in clauses (iii) and (iv) of clause (n) of section 2 shall ensure that children admitted in pursuance of clause (c) of section 12 (1) shall not be segregated from the other children in the classrooms nor shall their classes be held at places and timings different from the classes held for the other children.

(2) The school referred to in clauses (iii) and (iv) of clause (n) of section 2 shall ensure that children admitted in pursuance of clause (c) of section 12 (1) shall not be discriminated from the rest of the children in any manner in respect of entitlements and facilities such as text books, uniforms, library and ICT facilities, co-curricular programme and sports.

(3) The areas or limits of neighborhood specified in rule 4 (1) shall apply to admissions made in pursuance of clause (c) of section 12 (1), provided that the school may, for the purposes of filling up the requisite percentage of seats for children referred to in clause (c) of section 12 (1), extend these limits with the prior approval of the State Government.

(4) The percentage of allocation across various categories shall be notified by the Government.

8. Reimbursement of per child expenditure by the Government for the purpose of Section 12(2).-(1) The

total annual recurring expenditure incurred by the State on elementary education in respect of all schools established or owned by it or by the local authority, divided by the total number of children enrolled in all such schools, shall be the per-child expenditure incurred by the Government. For this purpose the expenditure on grant-in-aid schools and students enrolled in such schools shall not be included. The Government shall notify per-child expenditure every year before commencement of academic year, which shall be reimbursed in respect of admission of eligible children to private unaided schools. The children admitted under the quota of disadvantaged group and weaker section shall not be levied any other fee, charges or expenses by such school.

(2) Every school which receives reimbursement per child expenditure shall maintain a separate bank account and is subject to audit by the government. In respect of a child admitted to a private unaided school over and above the quota for the disadvantaged group and weaker section, there shall not be any claim on reimbursement of such expenditure incurred on child's education in any such school. In respect of the child admitted in pursuance of clause (b) of sub-section (1) of section 12 and a child admitted in pursuance clause (c) of sub-section (1) of section 12, the responsibility of providing the free entitlements shall be of the school referred to in sub-clause (ii) of clause (n) of section 2 and of sub-clauses (iii) and (iv) of clause (n) of section 2, respectively.

(3) Any aided school with un-aided sections shall be treated as an aided school as per sec 2(n)(ii). The rule under section 12(1)(b) of the Act shall be applied for these schools.

(4) The reimbursement shall be made directly, by way of Electronic Fund Transfer in the separate bank account maintained by the school in two instalments during the academic year. First instalment of 50% shall be reimbursed in the month of September and second instalment shall be reimbursed in the month of January after receiving compliance report in FORM III from the school .

(5) Every school shall furnish a Report to the DDPI through the Block Education Officer during July and January of the year, in Form III giving status report of the school.

9. Documents as age proof of child for the purpose of Section 14.- Wherever a birth certificate under the provisions of the Registration of Births and Deaths Act, 1969, is not available, any one of the following documents deemed to be the proof of age of the child for the purpose of admission in schools, namely:-

(a) Hospital/Auxiliary Nurse and Midwife (ANM) register record.

(b) Anganwadi record.

(c) Self Declaration for the age of the child by the parent or guardian.

10. Extended period for admission of child for the purpose of Section 15.- (1) Extended period of admission shall be three months from the date of commencement of the academic year of a school.

Provided that no child shall be denied admission if such admission is sought subsequent to the extended period:

(2) Where a child is admitted in a school after the extended period, he shall be eligible to complete studies with the help of special training, as assessed and determined by the head of the school.

11. Recognition of Schools for the purpose of Section 18.-(1) Without prejudice to these rules the rules for the recognition of schools made under the Karnataka Education Act, 1983 shall muttaties muttandies apply for recognition of schools under there rules.

(2) Every Governing council of a school other than a school established, owned or controlled by the Government or local authority established before the commencement of the Act, shall make a Self Declaration in FORM I within six months from the date of commencement of these rules to the concerned Block Education Officer regarding2434 its compliance or otherwise with the norms and standards prescribed in the Schedule along with the following conditions, namely:-

(a) The school is run by a society registered under the Societies Registration Act, 1860 (21 of 1860) or the Karnataka Societies Registration Act, 1960 or a public trust constituted under any law for the time being in force;

(b) The school is not run for profit to any individual, group or association of persons;

(c) The school conforms to the values enshrined in the Constitution;

(d) The school premises shall not be used for any other purposes other than school related activities.

(e) The school is open to inspection by any officer authorised by the state government or any local authority;

(f) The school furnishes such reports and information as required by the State government or any authorised officer of the state government from time to time and complies with such instructions of the state government or local authority as may be issued to secure the continued fulfilment of the conditions of recognition or the removal of deficiencies in the working of the school;

(3) The Local Authority shall identify the neighbourhood school where children can be admitted and make such information public for each habitation within its jurisdiction.

(4) The BEO concerned shall conduct inspection of such schools which claim in FORM I to fulfil the norms ,standards and the conditions mentioned in sub-rule (1) within three months of the receipt of the self-declaration.

(5) After the inspection under sub-rule (3) is carried out, the inspection report shall be placed by the BEO in public domain and the BEO shall forward the list of schools conforming to the norms, standards and the conditions for granting/renewal of recognition by the DDPI in FORM II within a period of 15 days from the date of inspection.

(6) The DDPI of the district shall grant recognition to such schools under the Act within a period of 15 days and notify in the public domain. Validity of such recognition shall be for five years, which may be considered for renewal on application by the concerned.

(7) Schools which do not conform to the norms, standards and conditions mentioned in sub-rule (1), shall be listed by the BEO. He/She shall issue an order to this effect, and shall give time of three years to set right the deficiencies.

(8) Schools which are in existence prior to notification of rules and which do not conform to the norms, standards and conditions mentioned in sub-rule (1), shall cease to function after three years from the date of notification.

(9) Every school, other than a school established, owned or controlled by the Government or local authority, established after the commencement of this Act or seeking renewal of recognition shall conform to the norms, standards and conditions mentioned in sub-rule (1) in order to qualify for recognition and shall apply for grant or renewal of recognition to the DDPI concerned along with the declaration along with such fee as may be determined by the Government.

(10) Every application for grant or renewal of recognition shall be processed in the same manner specified in sub-rules (2) to (7).

12. Withdrawal of Recognition of Schools for the purpose of Section 18(3) and 12(3).- Where DDPI of the

district on his own volition or on any representation received from any person, has reason to believe, to be recorded in writing, that a school recognised under these rules, has violated one or more conditions of grant of recognition or failed to fulfil the norms, standards and conditions mentioned as per the Act or in these rules, it shall act in the following manner, namely:-

(a) Issue a notice to the school specifying the violations of the conditions of grant of recognition and seek its explanation within one month. This notice shall also be placed in the public domain.

(b) In case the explanation is not found to be satisfactory or no explanation is received within the stipulated time, the DDPI may cause inspection of the school to be conducted by a committee constituted by him consisting of three members comprising of an educationist, representative of civil society and a government representative, which shall make due enquiry and submit its report along with its recommendations for continuing recognition or its withdrawal, to the DDPI.

(c) The DDPI shall take decision based on the report of the committee within a period of 15 days from the date of receipt of the report. Such decision shall be placed in the public domain.

(d) In case the DDPI issues an order of withdrawal of recognition, the order shall be operative from the succeeding academic year and the BEO concerned shall ensure arrangements for admitting the children of such school to any of the schools in the neighbourhood.

(e) Appeal against the order issued by the DDPI under this rule may be filed before the Director of Public instruction within 30 days from the date of the order. The Director of Public Instruction shall, at first, decide admissibility of the appeal and once the appeal has been admitted for hearing, the order under appeal shall remain suspended till the final decision of the appeal. The Director of Public Instruction, after giving opportunity of hearing to both the parties, shall pass order within two months from the date of filing of appeal. Such order shall be final.

PART - V

SCHOOL DEVELOPMENT AND MONITORING COMMITTEE (SDMC)

13. Composition and functions of the School Development and Monitoring Committee.- (1) There shall

be a School Development and Monitoring Committee (SDMC) for every school other than an unaided school. Such Committee shall be constituted within six months of the coming into force of these rules, and reconstituted for every three years. School Development and Monitoring Committees shall have sixteen elected members. Head Teacher or senior most teachers as the case may be shall be ex-officio Member Secretary, Health worker and an Anganwadi worker in the area where the school is located shall be ex-officio members of the School Development and Monitoring Committee.

(2) Thirteen members of the School Development and Monitoring Committee shall be elected from amongst parents or guardians of children. The remaining three members of the School Development and Monitoring Committee shall be nomited from amongst the following persons, namely:-

(3) (a) One member amongst the elected members of the local authority, to be decided by the local authority.

One member from amongst teachers of the school, to be decided by the B.E.O. The remaining one member from amongst educationists, philanthropic persons from the locality and children in the school to be nominated by the B.E.O.

(b) The School Development and Monitory Committee shall have 50 per cent of its members from amongst women. The Chairman and Vice Chairman of the School Development and Monitory Committee shall be elected from amongst the parent or guardian members.

(c) The BEO is the competent authority to ensure the functioning of the School Development and Monitory Committees of all schools in his/her jurisdiction. He shall also facilitate resolution of dispute by arranging or overseeing deliberations and by involving local authority therein.

(4) The School Development and Monitoring Committee shall meet at least once in a month and the minutes of the meetings shall be recorded and made available to the public.

(5) The School Development and Monitoring Committee shall, in addition to the functions specified in clauses (a) to (d) of section 21 (2), perform the following functions, namely:-

(a) communicate in simple and creative ways to the people in the neighbourhood of the school, the rights of the child as enunciated in the Act; as also the duties of the local authority, school, parent and guardian;

(b) Ensure the implementation of clauses (a) and (e) of section 24 and section 28 of the Act,

(c) Monitor that teachers are not burdened with non academic duties other than those specified in section 27.

It shall also hear grievances of teachers as the first level of local authority.

(d) Ensure the enrolment of all non school going children in the neighbourhood irrespective of religion, race caste, sex, language and place of birth and continued attendance of all the children from the neighbourhood in the school. Towards this SDMC may conduct enrolment drives, bridge courses and special campaigns for girl children, children with special needs and child labour; Monitor facilities, enrolment and education of children with special needs.

(e) Monitor the maintenance of the norms and standards prescribed in the Schedule;

(f) Bring to the notice of the local authority any deviation from the rights of the child, in particular mental and physical harassment of children, denial of admission, and timely provision of free entitlements..

(g) Identify the needs of the school and prepare the School Development Plan and monitor the implementation of the provisions of section 4.

(h) Ensure non-discrimination against and provision of special facilities such as hearing aids, Braille etc to children in the neighbourhood who are physically or mentally challenged, to enable them to attend school. Monitor the identification and enrolment of, and facilities for learning of disabled children, and also to ensure their participation in, and completion of elementary education

(i) Monitor Periodically drop-out rates and ensure attendance and retention of all children in the school.

Monitor the implementation of the distribution of free textbooks, mid-day meal programme, uniforms and scholarships and any other incentives given by the government from time to time.

(j) Prepare an annual account of receipts and expenditure of the school for the period ending 31st March of the year, before end of June of the year and shall be approved by the School Development and Monitoring Committee and signed by the Chairperson and Secretary of the School Development and Monitoring Committee. This shall be placed before the local authority and put in the public domain.

(k) The School Development and Monitoring Committee shall prepare School Development Plan for the financial year after identifying the needs of the school. It shall be the duty of School Development and Monitoring Committee to oversee infrastructure facilities like playground, compound walls, classrooms, toilet, furniture, provision for drinking water etc., for the school. It shall also arrange construction and maintenance of any works as per Annual Work Plan/School Development Plan. It may acquire, purchase or hire immovable or movable property as may be required for proper functioning of the school. It shall protect school premises against encroachment and nuisance. It shall ensure that the school has the Child Helpline Number displayed prominently. It shall also oversee hygiene, upkeep and maintenance of the school, in addition, monitor the school health programmes and facilitate regular health camps for the children in the school.

(l) It shall also conduct meetings of the Parents Council once in three months and discuss with the parents to send their children to the school who do not send their children to the school regularly. It shall also arrange enrolment of all the children to the school by undertaking enrolment drives, bridge courses and special campaigns for girl children. It shall also conduct parents' day celebrations periodically to involve all parents in the activities of the school.

(m) The School Development and Monitoring Committee may also involve all parents in the activities of the school and to motivate them to offer constructive suggestions to the local authority and School Development and Monitoring Committee for improving the school. It shall also address grievances or complaints made by students, parents, teachers and non-teaching staff of the school.

(n) The School Development and Monitoring Committee may hear grievances of teachers as the first level of grievances redressal body and monitor and take appropriate action in the event of harassment of teachers in general and also complaints of women teachers in particular.

(o) It shall be the duty of School Development and Monitoring Committee to ensure a minimum of two hundred and twenty working days in a year and also to decide on local holidays not more than four days in a year.

(p) It may hire the services of local persons as teachers or instructors, as the case may be, where there is a need, on a voluntary basis or on payment of fixed honorarium, meeting the cost from its funds. Provided that no regular post is filled on a permanent basis in this manner.

(q) It shall be the duty of School Development and Monitoring Committee to periodically review the performance of teachers and facilitate compliance with the minimum quality standards as prescribed in the Schedule of the Act and any programme of the Central Government or State Government from time to time. It shall also facilitate provision of need-based trainings to teachers, depending upon the demand of the teachers and the Head Teacher.

(6) It shall be the duty of School Development and Monitoring Committee to ensure any money received by it for the discharge of its functions under the Act, shall be kept in a separate account, to be made available for audit every year. It shall also supervise all properties, funds and finances of the school. It may issue appeals and applications for money and funds in furtherance of its functions to receive, collect, and accept any gifts or donations, either in cash or in kind or of any property, either movable or immovable; and spend the same in fulfilment of all or any of its functions. It shall not be interpreted as authorizing collection of donation from parents.

14. Preparation of School Development Plan.- (1) School Development Plan will be a three year perspective plan and shall contain the following details, namely:-

(a) Estimates of class-wise enrolments each year.

(b) Requirement of additional teachers over a three year period, separately for classes I to V and VI to VIII calculated as per norms specified in the schedule of the Act.

(c) Physical requirement of additional infrastructure and equipments over the three year period, calculated, on the basis of norms and standards, specified in the Act.

(d) Additional financial requirement over the three years period, year-wise, in respect of (b) and (c) above, including additional requirement needed for bridge courses, special training of teachers, all entitlements of children, and any other financial requirement for fulfilling the responsibilities of the school under the Act.

(2) The School Development and Monitoring Committee shall prepare a School Development Plan three months before the end of the financial year. This plan will include the needs of disabled children as well.

(3) School Development Plan shall also relate to academic improvement of the school. It shall detail the academic improvement activities of the school including Periodical review of performance of children in both curricular and co-curricular activities

(4) School Development Plan to be signed by the Chairman and the Secretary of the School Development and Monitoring Committee and submitted to the BEO through local authority, before the end of the financial year. School Development Plan shall be consolidated at the cluster and block levels and shall form the basis for planning resource allocation to such schools in each educational block.

PART - VI

TEACHERS

15. Minimum qualification for teachers.- (1) The Government on the recommendation of the appropriate academic authority notified by the Central Government and for the purposes of sub-section (1) of section 23, shall lay down the minimum qualifications for the persons to be eligible for appointment as teachers in an elementary school.

(2) The minimum qualification laid down under the above sub-rule shall be applicable for every school referred to in clause (n) of section 2 of the Act.

16. Duties of Teachers.- (1) In performance of the functions specified in sub-section (1) of section 24 and in order to fulfil the requirements of clause (h) of sub-section (2) of section 29, the teacher shall maintain a record containing the pupil cumulative record for every child which shall be the basis for monitoring children's progress, awarding the completion certificate specified in sub-section (2) of section 30.

(2) The teacher shall assess the performance of every child periodically as per the prescribed curriculum and take up special training for the children who do not reach expected learning levels in each subject. Apart from periodic evaluation of the child, the evaluation study reports shall also form the basis for devising and implementing special teaching programme by the teacher.

(3) It shall be the responsibility of the school in the neighbourhood and teachers therein to identify out of school children and mainstream such children by providing special training to them to attain expected levels of learning by converging the hostel facilities of government departments such as Social Welfare, Backward Classes and Women and Child Welfare.

(4) The teacher shall also participate in the regular training programmes, preparation of curriculum, textbooks, training modules and Teaching Learning Materials (TLM) development organized by the Cluster Resource Centre, Block Resource Centre and District Institute of Education and Training and other academic agencies.

17. Grievance Redressal Authority for Teachers.- The School Development and Monitoring Committee constituted under section 21 shall be the Grievance Redressal Authority for teachers of government and local authority schools and aided schools. In all Grievance Redressal Authority proceedings by SDMC, BEO shall be present. For private un-aided schools, Section 96 of Chapter 14 of Karnataka Education Act 1983 shall apply for Grievance Redressal.

18. Maintaining Pupil-Teacher Ratio in each school as per section 26.- (1) For school established, owned, controlled or substantially finanaced by funds provided directly or indirectly State Govt. or Local authority the BEO of every educational block shall assess the Pupil-Teacher Ratio(PTR), school wise as specified in the schedule of the Act. (2) The BEO shall every year do or cause to do rational deployment of teachers in the block to maintain the Pupil Teacher Ratio as per schedule of the Act and subsequently report to the DDPI, the resultant excess or shortage school wise. Every year on receipt of this information from the BEO, the DDPI shall do or cause to do rational deployment of the teachers among the teachers of the district and shall take the sanctions from the Govt. to fill the vacancy of teacher so that the vacancy does not exceed 10 percent of the total sanctioned strength.

(3) In respect of private schools, the managements shall maintain the Pupil Teachers Ratio (PTR) as specified in the schedule of the Act and take steps to fill up the vacancies of teachers. Management of such schools shall report to the BEO informing them on steps taken to fill up the vacancies. BEO shall review the status of such managements from time to time and report through proper channel to the Govt. regarding status of PTR in private schools.

PART - VII

CURRICULUM AND COMPLETION OF ELEMENTARY EDUCATION

19. Academic Authority.- (1) The Department of State Educational Research & Training (DSERT) is the Academic Authority in the state for all schools adopting the state curriculum for the purposes of section 29 of the Act. However, the Government may also recognize additional academic authorities under these rules.

(2) The Department of State Educational Research & Training shall be responsible for,-

(a) Formulating the curriculum including a flexible curriculum for children with special needs as per the guidelines contained in the National and State Curriculum Framework;

(b) For preparing class-wise and age appropriate syllabus which shall include vocational exposure as an alternative programme for all children including children with special needs . It shall also define the expected learning outcomes at the end of each grade and for every subject.

(c) For periodical revision of pre-service elementary teacher training curriculum, designing appropriate in-service teacher training programmes, integrating components of inclusive education and for preparation of suitable guidelines for implementation of Continuous and Comprehensive Evaluation for all classes from classes I to VIII.

20. Award of Certificate.- (1) The school shall issue the Certificate of completion of elementary education to the child who has completed 8 years of elementary education before the last working day of the academic year.

(2) The certificate shall contain details of academic progress of the child and specify its achievement in curricular and co-curricular activities. Academic Authority/ the DSERT shall design a model format and notify in the public domain.

PART- VIII

PROTECTION OF RIGHTS OF CHILDREN

21. State Commission for Protection of Child Rights. (1) The Karnataka State Commission for Protection of Child Rights set up under the provisions the Commission for Protection of Child Rights Act 2005, shall be the Commission for the purpose of section 31 of the Act and shall protect the rights of child under the Act. (2) Karnataka State Commission for Protection of Child Rights shall monitor and inquire into grievances or complaints of violation of child rights and initiate action as deemed fit.

22. Constitution and Functions of the State Advisory Council.- (1) The Karnataka State Advisory Council for Elementary Education shall have a Chairperson and fourteen members.

(2) The Minister-in-charge of Primary and Secondary Education in Karnataka shall be the ex-officio Chairperson of the Council and the Secretary to Government, Primary and Secondary Education, shall be the Vice- Chairman of the State Advisory Council. The Commissioner for Public Instruction shall be the Member Secretary of the Council.

(3) Members of the Council shall be appointed by the Government from amongst persons who have done outstanding work in the field of elementary education in the state, as under,-

(a) At least four members should be from amongst persons belonging to Scheduled Castes, Scheduled Tribes and Minorities, At least one person from amongst those persons having specialised knowledge and practical experience of education of children with special needs. One member from amongst persons who have worked in the field of pre-primary education. Two members shall be from amongst persons who have worked in the field of elementary teacher education. The other members from amongst persons who have worked in the field of elementary education. Fifty percent of the members amongst the 14 shall be women.

(b) The Commissioner for Public Instruction, the Additional Commissioners for Public Instruction, State Project Director Sarva Shiksha Abhiyana, Rashtriya Madhyamika Shiksha Abhiyana, and Directors of Primary, Secondary Education, Urdu and other Minorities and DSERT shall be the ex-officio members.

(c) The Council shall meet regularly at least twice in a year and review the status of elementary education in the state. The Council shall also monitor implementation of the Act and these rules and make recommendation to the Government from time to time.

(d) The Council shall be reconstituted every three years and no member shall be appointed for more than two terms.

(e) The non-official members of the Council are entitled to sitting fees, travel and other allowances, at a rate specified in Annexure A to the Karnataka Civil Service Rules.

PART - IX

MISCELLANEOUS

23. Prescribed Authorities and Procedure for taking action for Violation of the Provisions of the Act.-

Section 35(1) The prescribed authority for previous sanctions for procedure under sections 13(2), 18(5), 19(5), of the Act is the Chief Executive Officer of the Zilla Panchayat of the district. It is the responsibility of the BEO of the block and DDPI of the district to report such cases to the CEO of the Zilla Panchayat of the district, who after satisfying himself may accord such sanction for procecution under the said section.

(2) At the first level, the BEO on noticing violation of the Act or on receipt of a complaint about any violation of the Act by any person, shall issue a notice to the concerned school, management, School Development and Monitoring Committee and seek an explanation within fifteen days from the date of notice. If the reply is not satisfactory or fails to respond to the notice, he shall bring the violation to the notice of the DDPI and the CEO of the Zilla Panchayat.

(3) The DDPI shall cause a visit to the institution and enquire into the alleged violation and make a report to the CEO of the Zilla Panchayat, who shall give reasonable opportunity for such person who has violated and shall pass orders as deem fit. CEO of Zilla Panchayat shall pass such orders within one month under these rules.

(4) The CEO of Zilla Panchayat shall be vested with the powers to take action for any violation of sections 14, 15, 16, 17, 25, 28, 30, of the Act and also any violation under these rules. Detailed guidelines for taking action for such violation shall be issued by the Government.

1. This is a provisional grant of recognition under the RTE Act and rules and is not extendable beyond Class VIII.

2. The school shall abide by all the provisions of the RTE Act 2009 and the RTE Rules 2010 referred here in.

3. The school shall admit in Class I, to the extent of 25% of the strength of the class, children belonging to weaker sections and disadvantaged groups in the neighbourhood and provide free and compulsory education till completion of elementary education. Provided that if the school admits children in pre-primary classes also, the school shall follow these norms. The children so admitted shall not be discriminated from the rest of the children or segregated or treated separately in any manner.

4. For the children referred in paragraph 3, the school shall be reimbursed as per section 12(2) of the Act. In order to receive such reimbursements, the school shall open and maintain a separate bank account which is subject to audit by the department.

5. The Society/School shall not collect any capitation fee or voluntary donations from the parents of children at any time either during admission or during the course of the academic year. The school shall collect only tuition and other fee as approved by the department. The scale of fee shall be notified by the school and displayed prominently in the school premises.

6. The school shall not subject the child or the parents to any screening procedure including any test and interview.

7. Admissions shall be made only during the period notified by the department.

8. The school shall not deny admission to any child

(i) for lack of age proof.

(ii) On grounds of caste, religion, race or place of birth, language.

(iii) If admission is sought subsequent to the extended period of admission

9. The school shall ensure:

(i) No child admitted shall be held back in any class or expelled from school till completion of elementary education in a school.

(ii) No child shall be subjected to physical punishment or mental harassment.

(iii) No child is required to pass any Board examination till the completion of elementary education.

(iv) Every child completing elementary education shall be awarded a certificate as laid down under Rule 21.

(v) The school shall also admit children with special needs/special children as per provisions of the Act. (vi) The teachers recruited have minimum qualifications as is prescribed for elementary school teachers in the RTE Rules.

(vii) The salary and allowances payable to and the terms and conditions of service of teachers shall be as prescribed by the state government and the salaries are paid to teachers only through bank .

(viii) The teachers perform the duties prescribed under section 24(1) of the Act and Rule 17 of the RTE Rules and shall not engage themselves in private tuitions for monitory considerations.

10. The school shall follow the curriculum and text books of the academic authority to which it is affiliated.

11. The school shall admit students in proportion to the facilities available in the school as prescribed in the section 19 of the Act.

12. The school shall maintain the norms and standards as specified in section 19 of the Act. The deficiencies noticed by the departmental staff are given in the annexure.

13. The school shall not run any unauthorised classes/sections either with in the school premises or outside.

14. The school buildings another infrastructure facilities should not be used either during day or night for any commercial activities or for political and non-educational activities.

15. The school shall not be run for profit to any individual or group or association of persons.

16. The accounts of the school are audited by a Charted Accountant and a copy of such audited statements is sent to the DDPI/BEO by end of June every year.

ಮೇಲೆ ಓದಲಾದ ದಿನಾಂಕ: 22.11.2001ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಸರ್ಕಾರಿ ನೌಕರರ ವರ್ಗಾವಣೆ ಕುರಿತಂತೆ ವಿಸ್ತøತ ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ನೀಡಲಾಗಿದೆ. ಈ ಮಾರ್ಗಸೂಚಿಗಳ ಪ್ರಕಾರ ಸರ್ಕಾರಿ ನೌಕರರ ವರ್ಗಾವಣೆಗಳನ್ನು ಪ್ರತಿ ವರ್ಷ ಏಪ್ರಿಲ್ ಮತ್ತು ಮೇ ತಿಂಗಳಲ್ಲಿ ಮಾತ್ರ ಕೆಲವು ಷರತ್ತುಗಳಿಗೊಳಪಟ್ಟು ಮಾಡಬಹುದಾಗಿದೆ.

ಮೇಲೆ ಓದಲಾದ ದಿನಾಂಕ: 27.4.2011 ಹಾಗೂ 31.5.2011ರ ಆದೇಶಗಳಲ್ಲಿ ದಿನಾಂಕ: 22.11.2001ರ ಮಾರ್ಗಸೂಚಿಗಳನ್ನೇ ಅನುಸರಿಸಿ 2011-12ನೇ ಸಾಲಿನ ವರ್ಗಾವಣಾ ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಹೊರಡಿಸಲಾಗಿತ್ತು.

ಪ್ರಸ್ತುತ 2012-13ನೇ ಸಾಲಿನಲ್ಲಿ ಸರ್ಕಾರಿ ನೌಕರರ ವರ್ಗಾವಣೆಗಳ ಬಗ್ಗೆ ದಿನಾಂಕ: 22.11.2001ರ ಸರ್ಕಾರದ ಆದೇಶದ ಮಾರ್ಗಸೂಚಿಗಳನ್ನೇ ಅನುಸರಿಸಿ, ವರ್ಗಾವಣೆಗಳನ್ನು ಮಾಡುವ ಬಗ್ಗೆ ತೀರ್ಮಾನಿಸಿ, ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಆದೇಶ

2012-13ನೇ ಸಾಲಿನಲ್ಲಿ ಪೊಲೀಸು ಸಿಬ್ಬಂದಿ ಮಂಡಳಿ (Police Establishment Board)ಯ ವ್ಯಾಪ್ತಿಗೊಳಪಡುವ ಪೊಲೀಸು ಸಿಬ್ಬಂದಿಯನ್ನು ಮತ್ತು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳು (ಶಿಕ್ಷಕರ ವರ್ಗಾವಣೆ ನಿಯಂತ್ರಣ) ಅದಿನಿಯಮ, 2007ರ ವ್ಯಾಪ್ತಿಗೊಳಪಡುವ ಶಿಕ್ಷಕರನ್ನು ಹಾಗೂ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳು (ವೈದ್ಯಕೀಯ ಅದಿಕಾರಿಗಳು ಮತ್ತು ಇತರ ಸಿಬ್ಬಂದಿ ವರ್ಗಾವಣೆ ನಿಯಂತ್ರಣ) ಅದಿನಿಯಮ, 2011ರ ವ್ಯಾಪ್ತಿಗೊಳಪಡುವ ವೈದ್ಯಕೀಯ ಅದಿಕಾರಿಗಳು ಮತ್ತು ಸಿಬ್ಬಂದಿಗಳನ್ನು ಹೊರತುಪಡಿಸಿ, ಇತರ ಸರ್ಕಾರಿ ನೌಕರರನ್ನು ಈ ಕೆಳಕಂಡ ಸಂದರ್ಭಗಳಲ್ಲಿ ಮಾತ್ರ ವರ್ಗಾವಣೆ ಮಾಡಬಹುದು:-

1. ಖಾಲಿ ಇರುವ ಆಡಳಿತಾತ್ಮಕ ಹಿತದೃಷ್ಟಿಯಿಂದ ಅತ್ಯಾವಶ್ಯಕವಾಗಿ ತುಂಬಬೇಕಾದ ಹುದ್ದೆಗಳ ಪ್ರಕರಣಗಳು, ತತ್ಪರಿಣಾಮವಾಗಿ ಖಾಲಿಯಾಗುವ ಹುದ್ದೆಗಳನ್ನು ಭರ್ತಿ ಮಾಡುವ ಪ್ರಕರಣಗಳು;

2. ಪತಿ-ಪತ್ನಿ ಪ್ರಕರಣಗಳು;

3. ಪರಸ್ಪರ ವರ್ಗಾವಣೆಗಳು - ಸಂಬಂದಿಸಿದ ಸಿಬ್ಬಂದಿಯ ಒಪ್ಪಿಗೆ ಪತ್ರದೊಂದಿಗೆ;

4. ತೀವ್ರತರವಾದ ಖಾಯಿಲೆಯಿಂದ ಬಳಲುತ್ತಿರುವ ನೌಕರರ / ನೌಕರರ ಅವಲಂಬಿತರ / ತಂದೆ ತಾಯಿಯವರ ವೈದ್ಯಕೀಯ ಚಿಕಿತ್ಸೆ / ಆರೋಗ್ಯದ ಹಿತದೃಷ್ಟಿಯಿಂದ ಮಾಡಬೇಕಾದ ವರ್ಗಾವಣೆಗಳು;

5. ಸಾರ್ವಜನಿಕರಿಂದ ಸ್ವೀಕೃತವಾದ ದೂರುಗಳ ಮೇರೆಗೆ ಇಲಾಖಾ ವಿಚಾರಣೆಗೊಳಪಟ್ಟ ಪ್ರಕರಣಗಳು;

6. ಮುಂಬಡ್ತಿಯಿಂದ ತುಂಬಬೇಕಾದ ಖಾಲಿ ಹುದ್ದೆಗಳಿಗೆ ಮಾತ್ರ;

7. ಮುಂದಿನ ಎರಡು ವರ್ಷಗಳಲ್ಲಿ ನಿವೃತ್ತಿ ಹೊಂದಲಿರುವ ಸಿಬ್ಬಂದಿಯ ಕೋರಿಕೆಗಳು.

2. ಒಂದು ಇಲಾಖೆಯಿಂದ ಇನ್ನೊಂದು ಇಲಾಖೆಗೆ ಅದಿಕಾರಿ / ನೌಕರರ ನಿಯೋಜನೆಯನ್ನು ವರ್ಗಾವಣೆ ಅವದಿಯಲ್ಲಿ ಮಾತ್ರ ಮಾಡತಕ್ಕದ್ದು.

ಸಂಬಂದಿತ ಇಲಾಖೆಯ ಸ್ಪಷ್ಟ ಕೋರಿಕೆಯಿಲ್ಲದೇ ನಿಯೋಜನೆ ಮೇಲೆ ನೇಮಕ ಮಾಡತಕ್ಕದ್ದಲ್ಲ.

3. ಯಾವುದೇ ಅದಿಕಾರಿ / ನೌಕರರು ಕಡ್ಡಾಯ ನಿರೀಕ್ಷಣೆ ಸಂದರ್ಭಗಳು ಉದ್ಭವವಾಗದ ರೀತಿಯಲ್ಲಿ ವರ್ಗಾವಣೆಗಳನ್ನು ಮಾಡತಕ್ಕದ್ದು.

4. ಗ್ರೂಪ್-ಎ, ಗ್ರೂಪ್-ಬಿ, ಗ್ರೂಪ್-ಸಿ ಮತ್ತು ಗ್ರೂಪ್-ಡಿ ನೌಕರರ ವರ್ಗಾವಣೆಯನ್ನು ದಿನಾಂಕ 22.11.2001ರ ಸರ್ಕಾರಿ ಆದೇಶ ಸಂಖ್ಯೆ: ಡಿಪಿಎಆರ್ 4 ಎಸ್‌ಟಿಆರ್ 2001ರಲ್ಲಿ ನಿಗದಿಪಡಿಸಿರುವ ಸಂಬಂದಿತ ವೃಂದ ನಿರ್ವಹಣಾ ಪ್ರಾದಿಕಾರಗಳು ಮಾಡತಕ್ಕದ್ದು.

5. ಈ ರೀತಿ ಮಾಡಲಾಗುವ ಒಟ್ಟು ವರ್ಗಾವಣೆಗಳು ಗ್ರೂಪ್ - ಎ ಮತ್ತು ಗ್ರೂಪ್ - ಬಿ ವೃಂದಕ್ಕೆ ಸಂಬಂದಿಸಿದಂತೆ ಕಾರ್ಯಕಾರಿ ವೃಂದಬಲ (Working strength) ಶೇಕಡ 3 ಹಾಗೂ ಗ್ರೂಪ್-ಸಿ ಮತ್ತು ಗ್ರೂಪ್-ಡಿ ವೃಂದಕ್ಕೆ ಸಂಬಂದಿಸಿದಂತೆ ಶೇಕಡ 4.5 ಮೀರುವಂತಿಲ್ಲ.

ರಾಜ್ಯದಲ್ಲಿನ ಬರದ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಅತಿ ಅವಶ್ಯಕವಾದ ಹಾಗೂ ನಿಯಮಾವಳಿಗಳಂತೆ ಅರ್ಹವಿರುವ ಪ್ರಕರಣಗಳಲ್ಲಿ ಮಾತ್ರ ವರ್ಗಾವಣೆಯನ್ನು

ಪರಿಗಣಿಸತಕ್ಕದ್ದು.

6. ಮೇಲ್ಕಂಡಂತೆ ವರ್ಗಾವಣೆ ಪ್ರಕ್ರಿಯೆಗಳನ್ನು ವೃಂದ ನಿರ್ವಹಣಾ ಪ್ರಾದಿಕಾರದ ಶಿಫಾರಸ್ಸುಗಳ ಮೇಲೆ ಈ ಆದೇಶದ ದಿನಾಂಕದಿಂದ ದಿನಾಂಕ:

25.5.2012ರ ಅವದಿಯಲ್ಲಿ ಮಾಡತಕ್ಕದ್ದು. ಈ ಅವದಿಯ ನಂತರ ಯಾವುದೇ ವರ್ಗಾವಣೆ ಮಾಡಬೇಕಾದಲ್ಲಿ ಸಂಬಂದಿತ ವೃಂದ ನಿರ್ವಹಣಾ ಪ್ರಾದಿಕಾರದ ಶಿಫಾರಸ್ಸಿನೊಂದಿಗೆ ಮಾನ್ಯ ಮುಖ್ಯಮಂತ್ರಿಯವರ ಪೂರ್ವಾನುಮೋದನೆಯನ್ನು ಕಡತದಲ್ಲಿ ಪಡೆದ ನಂತರವೇ ಮಾಡತಕ್ಕದ್ದು.

7. ಉಳಿದಂತೆ ದಿನಾಂಕ: 22.11.2001ರ ಆದೇಶದಲ್ಲಿನ ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಪಾಲಿಸತಕ್ಕದ್ದು.

ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳು (cid:19)µ±|| m°g¯ N®w¬š®ó£®w¬ yµäȶ(cid:19)µ°g¬ +(cid:28)±gµl¬ Š®(cid:19)®Š® EuµÛ°Lq® ‡µ²°cwµS¯T ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಬೇಕಾಗಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ.ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿ0ದ ಈ ನೋಟೀಸು ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಪ್ರವೇಶಿಸುವ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆ0ದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊ0ದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾಗಿರುವ ತಾರೀಖಿನ ನಂತರ ಬೆ0ಗಳೂರು ವಿಭಾಗದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಮಂಡಳಿಯ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿಯವರ ಅನುಮತಿಯಿಲ್ಲದೆ ಸದರಿ ಜಮೀನುಗಳನ್ನು ವಿಲೆ ಮಾಡಲು ಒಪ್ಪಂದ ಕ್ರಯ, ಭೋಗ್ಯ, ಲೀಸ್, ಅದಲು-ಬದಲು ವಗೈರೆ ಮಾಡುವಂತಿಲ್ಲ ಮತ್ತು ಸದರಿ ಜಮೀನುಗಳಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆ ನಂತರ ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಮತ್ತಿತರ ಅಭಿವೃಧ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡುವ0ತಿಲ್ಲ.

ಒಂದು ವೇಳೆ ಮಾಡಿದರೂ 1894ರ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆ ವಿಧಿ 24 (ನಿಯಮ 7) ಕರ್ನಾಟಕ ತಿದ್ದುಪಡಿ ಮಾಡಿರುವ ಕಾಯ್ದೆ 17:1961 ಮತ್ತು 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 30ನ್ನು ಓದಿಕೊಳ್ಳುವ ಮೇರೆಗೆ ಪರಿಹಾರಧನ ನಿಗಧಿ ಮಾಡುವಾಗ ಈ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದಿಲ್ಲ ಮತ್ತು ಅಂತಿಮವಾಗಿ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನ ಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದು.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1)ರ ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ದಿನಾಂಕ: 01.12.2009ರ ಕರ್ನಾಟಕ ವಿಶೇಷ ರಾಜ್ಯಪತ್ರದ ಭಾಗ-3ರ ಪುಟ ಸಂಖ್ಯೆ 1 ರಿಂದ 12ರಲ್ಲಿ ಪ್ರಕಟವಾಗಿರುವ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 392 ಎಸ್.ಪಿ.ಕ್ಯೂ. 2009, ದಿ: 1.12.2009ರ ಪ್ರಕಾರ ಸರ್ಕಾರವು ಸದರಿ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಮಂಡಳಿ ವತಿಯಿಂದ ಕೈಗಾರಿಕೆ ಸ್ಥಾಪಿಸುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಇಚ್ಛೆಪಟ್ಟಿದೆ.

ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಅನುಸೂಚಿಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ದಿಶೆಯಲ್ಲಿ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 28(3)ರಡಿ ಕೆಐಎಡಿಬಿ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿಗಳು ತಮಗೆ ನಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಆದೇಶ ಹೊರಡಿಸಿದ್ದಾರೆ.

ಆದುದರಿಂದ, 1966ರ ಕೆಐಎಡಿ ಕಾಯ್ದೆ ವಿಧಿ 28(4)ರಡಿಯಲ್ಲಿ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಂಡಿದೆಯೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.

ಕರ್ನಾಟಕ ಹೆದ್ದಾರಿ ಕಾಯ್ದೆ 1964 ಕಲಂ 15ರ ಮೇರೆಗೆ ಈ ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳು ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಸಂಖ್ಯೆ 84 (ಲಿಂಕ್ ಸಂಖ್ಯೆ 57B ಯಡಿಯೂರಿನಿಂದ ಕೌಡ್ಲೆವರೆಗೆ)(2ನೇ ಮೈಲ್ ಸ್ಟೋನ್) ರಸ್ತೆ ಅಬಿವೃದ್ದಿಪಡಿಸುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಯೋಜನಾ ನಿರ್ದೇಶಕರು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಬಿವೃದ್ದಿ ಯೋಜನೆ, ಬೆಂಗಳೂರು ರವರು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿರುವ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಪರಿಶೀಲಿಸಿ ಸದರಿ ಜಮೀನುಗಳು ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಸಂಖ್ಯೆ 84ನ್ನು ಅಬಿವೃದ್ದಿಪಡಿಸಲು ಅವಶ್ಯವಾಗಿದೆ ಎಂದು ಸರ್ಕಾರವು ಮನಗಂಡಿದೆ. ಆದುದರಿಂದ ಈ ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ವಿವರಿಸಿರುವ ಜಮೀನುಗಳು ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಸಂಖ್ಯೆ 84ರ ರಸ್ತೆ ಅಬಿವೃದ್ದಿಗೆ ಅವಶ್ಯಕವಾಗಿದೆ ಎಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ. ಕರ್ನಾಟಕ ಹೆದ್ದಾರಿ ಕಾಯ್ದೆ 1964ರ ಅಡಿಯಲ್ಲಿ ಈ ಕೆಳಕಂಡ ಜಮೀನುಗಳಲ್ಲಿ ಕೆಲಸ ನಿರ್ವಹಿಸುವ ಅದಿಕಾರಿ, ಸಿಬ್ಬಂದಿ ಅಥವಾ ಯೋಜನಾ ನಿರ್ದೇಶಕರ ಪರವಾಗಿ ಪ್ರತಿನಿದಿಸುವವರನ್ನು ತಡೆಯುವುದಾಗಲಿ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲಿ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೆ ಈ ಮೂಲಕ ಸೂಚಿಸಲಾಗಿದೆ

ಈ ಅದಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾದ ನಂತರ ಯೋಜನಾ ನಿರ್ದೇಶಕರು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಬಿವೃದ್ದಿ ಯೋಜನೆ, ಬೆಂಗಳೂರು ರವರ ಅನುಮತಿಯಿಲ್ಲದೆ ಸದರಿ ಜಮೀನುಗಳನ್ನು ವಿಲೆ ಮಾಡುವ ಒಪ್ಪಂದದ ಕ್ರಯ, ಕರಾರು, ಬೋಗ್ಯ, ಲೀಜ್, ಅದಲು-ಬದಲು ವಗೈರೆ ಮಾಡುವಂತಿಲ್ಲ. ಸದರಿ ಜಮೀನುಗಳಲ್ಲಿ ಈ ಅದಿಸೂಚನೆ ಪ್ರಕಟಣೆಯ ನಂತರ ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಮತ್ತಿತರ ಅಬಿವೃದ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡುವಂತಿಲ್ಲ. ಒಂದು ವೇಳೆ ಮಾಡಿದ್ದರೂ ಪರಿಹಾರ ಹಣ ನಿಗದಿ ಮಾಡುವಾಗ ಅಂತಹ ವ್ಯವಹಾರದ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದಿಲ್ಲ.

ಸದರಿ ಜಮೀನುಗಳ ವಿವರಗಳನ್ನು ಪರಿಶೀಲನೆಗಾಗಿ ವಿಶೇಷ ಜಿಲ್ಲಾದಿಕಾರಿಗಳು (ಭೂಸ್ವಾದೀನ), ಕರ್ನಾಟಕ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಬಿವೃದ್ದಿ ಯೋಜನೆ, ಬೆಂಗಳೂರು, ಸಹಾಯಕ ಆಯುಕ್ತರು (ಭೂಸ್ವಾದೀನ), ಕರ್ನಾಟಕ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಬಿವೃದ್ದಿ ಯೋಜನೆ, ಬೆಂಗಳೂರು ಮತ್ತು ಸಂಬಂಧಪಟ್ಟ ತಹಸೀಲ್ದಾರ್‌ರವರ ಕಛೇರಿಯಲ್ಲಿ ಇಡಲಾಗಿದೆ.
