ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966ರ ವಿಧಿ 3(1) ರಡಿ ದತ್ತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಅನುಸೂಚಿಯಲ್ಲ್ಲಿ ಕಾಣಿಸಿರುವ ಪ್ರದೇಶವನ್ನು ಕೈಗಾರಿಕಾ ಪ್ರದೇಶವೆಂದು ಈ ಮೂಲಕ ಷೋಷಿಸಿದೆ.

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966ರ ವಿಧಿ 1(3) ರಡಿ ದತ್ತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಅನುಸೂಚಿಯಲ್ಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳಿಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಅಧ್ಯಾಯ 7ರ ವಿಧಿಗಳು ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಅನ್ವಯವಾಗುವುವೆಂದು ಷೋಷಿಸಿದೆ.

ಈ ಕೆಳಕಂಡ ಅನುಸೂಚಿಯಲ್ಲಿ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಗೆ ನರಸಾಪುರ 2ನೇ ಹಂತದ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಉದ್ದೇಶಕ್ಕಾಗಿ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಬೇಕಾಗಿದೆ. 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1)ರ ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನ ಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ನೋಟೀಸು ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಪ್ರವೇಶಿಸುವ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿ ಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾದ ತಾರೀಖಿನ ನಂತರ ಬೆಂಗಳೂರು ವಿಭಾಗದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಯ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿಯವರ ಅನುಮತಿಯಿಲ್ಲದೆ ಸದರಿ ಜಮೀನುಗಳನ್ನು ವಿಲೆ ಮಾಡುವ ಒಪ್ಪಂದ ಕ್ರಯ, ಭೋಗ್ಯ, ಲೀಸ್, ಅದಲು-ಬದಲು ವಗೈರೆ ಮಾಡುವಂತಿಲ್ಲ ಮತ್ತು ಸದರಿ ಜಮೀನುಗಳಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆ ನಂತರ ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಮತ್ತಿತರ ಅಭಿವೃದ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡುವಂತಿಲ್ಲ.

ಒಂದು ವೇಳೆ ಮಾಡಿದ್ದರೂ 1894ರ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆಯಡಿ ತಿದ್ದುಪಡಿಯಾಗಿರುವ ಭೂಸ್ವಾಧೀನ (ಕರ್ನಾಟಕ ವಿಸ್ತರಣೆ ಮತ್ತು ತಿದ್ದುಪಡಿ) ಕಾಯ್ದೆ 1961 ಮತ್ತು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966ರ ವಿಧಿ 30ನ್ನು ಓದಿಕೊಳ್ಳುವ ಮೇರೆಗೆ ಪರಿಹಾರಧನ ನಿಗದಿ ಮಾಡುವಾಗ ಈ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳುವುದಿಲ್ಲ ಮತ್ತು ಅಂತಿಮವಾಗಿ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದು.

Subject: Constitution of a Committee to deal with all training needs of the faculty of PPP - ITIs.

Read: Letter No. GIZ-IS/PPP/ITI/TRG/2012/18 dt: 18/05/2012 from the Team Leader GIZ-IS ITI upgradation Project-Karnataka, Bangalore.

Preamble:

Team Leader, GIZ-IS ITI upgradation Project-Karnataka in his letter read above has informed that German International Cooperation-International Services (GIZ-IS) has been mandated to provide technical support for upgradation of ITIs under PPP mode in the state of Karnataka. The project agreement extends coverage of national and international trainings to the faculty and staff of beneficiary institutions on a continual basis during the project period and therefore, it is necessary to put in place a proper and transparent mechanism in the selection of the candidates for various training programmes organised by GIZ-IS.

In the light of the above, it has been decided in the meeting held on 03 April, 2012 under the Chairmanship of the Chief Secretary to constitute a committee of three members for this purpose. Hence, the following order.

Government Order No: LD177 ETI 2012, Bangalore, Dated: 04-07-2012.

In the wake of the above a Committee comprising of the following members is constituted:-

1. Commissioner/Director, Employment and Training Department.

2. Additional Director (Training), Directorate of Employment and Training.

3. Team Leader-GIZ-IS, ITI upgradation Project-Karnataka.

The Committee shall prepare criteria and procedures suitable for selection of candidates examine the proposals of training and make its recommendation for further needful.

The Committee's other areas of function include its dealing with all training needs of Public Private Partnership - ITIs.

ಕರಡು ಅಧಿಸೂಚನೆಯ ಮೇಲೆ ಆಕ್ಷೇಪಣೆಗಳು /ಸಲಹೆಗಳು ಸ್ವೀಕೃತವಾಗಿದ್ದವು. ಸ್ವೀಕೃತಿಯಾದ ಆಕ್ಷೇಪಣೆ /ಸಲಹೆಗಳನ್ನು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಕನಿಷ್ಠ ವೇತನ ಸಲಹಾ ಮಂಡಳಿಯಲ್ಲಿ ಚರ್ಚಿಸಿ, ಶಿಫಾರಸ್ಸುಗಳನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿದ್ದು, ಸದರಿ ಶಿಫಾರಸ್ಸುಗಳನ್ನು ಸರ್ಕಾರವು ಪರಿಶೀಲಿಸಿದೆ.

ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ, 1948ರ ಕಲಂ (1948 ರ ಕೇಂದ್ರ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ: 11) 5 (1) (ಬಿ) ಮತ್ತು ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ 1948ರ ಕಲಂ 3(1)(ಬಿ) ಅಡಿಯಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಮತ್ತು ಈ ಹಿಂದಿನ ಎಲ್ಲಾ ಅಧಿಸೂಚನೆಗಳನ್ನು ರದ್ದುಪಡಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಅನುಸೂಚಿಯಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿರುವಂತೆ, ಕರ್ನಾಟಕ ರಾಜ್ಯದಾದ್ಯಂತ ಯಾವುದೇ "ಗೋಡಂಬಿ" ಉದ್ದಿಮೆಯ ಕೆಲಸದಲ್ಲಿ ತೊಡಗಿರುವ ವಿವಿಧ ವರ್ಗದ ಕಾರ್ಮಿಕರಿಗೆ ವೇತನವನ್ನು ದಿನಾಂಕ: 01-04-2012 ರಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಪರಿಷ್ಕರಿಸಿದೆ.

ಅನುಸೂಚಿ

ತುಟ್ಟಿಭತ್ಯೆ:-

ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವ ದರಗಳು ರಾಜ್ಯ ಸರಾಸರಿ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕ (1960-100) 4284 ಅಂಶಗಳಿಗೆ ವಿಲೀನಗೊಳಿಸಲಾಗಿದೆ. ರಾಜ್ಯ ಸರಾಸರಿ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕ 4284 ಅಂಶಗಳಿಗಿಂತ ಹೆಚ್ಚಾಗುವ ಪ್ರತಿ ಅಂಶಕ್ಕೆ ಎಲ್ಲಾ ವರ್ಗದ ಕಾರ್ಮಿಕರಿಗೆ ದಿನ ಒಂದಕ್ಕೆ 4.0 ಪೈಸೆಯಂತೆ ತುಟ್ಟಿ ಭತ್ಯೆ ನೀಡತಕ್ಕದ್ದು.

ತುಟ್ಟಿಭತ್ಯೆ ಲೆಕ್ಕಾಚಾರವನ್ನು ವರ್ಷಕ್ಕೊಮ್ಮೆ ಮಾಡಲಾಗುತ್ತದೆ. ಹಿಂದಿನ ಕ್ಯಾಲೆಂಡರ್ ವರ್ಷದ 12 ತಿಂಗಳುಗಳ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕಗಳ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ ಏಪ್ರಿಲ್ ಮೊದಲನೇ ದಿನಾಂಕದಂದು ಪ್ರತಿ ವರ್ಷ ಲೆಕ್ಕಾಚಾರ ಮಾಡತಕ್ಕದ್ದು. ಅಲ್ಲದೇ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಂಕಗಳ ಸಂಖ್ಯೆಯ ವಾರ್ಷಿಕ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ ಹೆಚ್ಚುವರಿಯಾದ ಅಥವಾ ಕಡಿಮೆಯಾದ ಪ್ರಮಾಣವನ್ನು ಆಧರಿಸಿ ಲೆಕ್ಕ ಹಾಕಲಾಗುತ್ತದೆ. ಆದ್ದರಿಂದ ಮೊದಲ ಲೆಕ್ಕಾಚಾರವು ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕದ (ಜನವರಿ 2011 ರಿಂದ ಡಿಸೆಂಬರ್ 2011)ರ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ 2012 ಏಪ್ರಿಲ್ 1 ನೇ ತಾರೀಖಿನಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ.

1. ದಿನಗೂಲಿ ಗಳಿಕೆದಾರರ ಸಂದರ್ಭದಲ್ಲಿ ಮಾಸಿಕ ವೇತನ ದರಗಳನ್ನು 26 ದಿನಗಳಿಂದ ವಿಭಾಗಿಸಿ, 4 ರಜಾ ದಿನಗಳಿಗೆ ವೇತನವನ್ನು ನೀಡುವುದೂ ಸೇರಿದಂತೆ ಲೆಕ್ಕ ಹಾಕತಕ್ಕದ್ದು.

ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಲೆಕ್ಕಾಚಾರ ಮಾಡುವ ವಿಧಾನ

ಅ) ಮಾಸಿಕ ವೇತನವನ್ನು ಪಡೆಯುವವರು:- ಪ್ರತಿ ವರ್ಷ ಹೆಚ್ಚಾಗುವ ಸಿ ಪಿ ಐ ಅಂಶಗಳು x ತುಟ್ಟಿಭತ್ಯೆಯ ದರ x 30 ದಿನಗಳು= ತಿಂಗಳ ತುಟ್ಟಿಭತ್ಯೆ

ಆ) ದಿನಗೂಲಿ ವೇತನವನ್ನು ಪಡೆಯುವವರು:-

ಪ್ರತಿ ವರ್ಷ ಹೆಚ್ಚಾಗುವ ಸಿ ಪಿ ಐ ಅಂಶಗಳು x ತುಟ್ಟಿಭತ್ಯೆಯ ದರ x 30 = ದಿನದ ತುಟ್ಟಿಭತ್ಯೆ

2. ಮಹಿಳೆಯರು ಮತ್ತು ಪುರುಷರು ಒಂದೆ ರೀತಿಯ ಕೆಲಸವನ್ನು ನಿರ್ವಹಿಸಿದ ಸಂದರ್ಭಗಳಲ್ಲಿ ಉಭಯತ್ರರಿಗೂ ಸಮಾನ ದರದ ವೇತನಗಳನ್ನು ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು

3. ಪ್ರಸ್ತುತ ಪಾವತಿಸುತ್ತಿರುವ ವೇತನ ದರವು ಹೆಚ್ಚಾಗಿದ್ದಲ್ಲಿ ಆ ದರಗಳ ವೇತನವನ್ನು ಸಂದಾಯ ಮಾಡುವುದನ್ನು ಮುಂದುವರೆಸತಕ್ಕದ್ದು.

ಹಾಗೂ ಕಡ್ಡಾಯವಾಗಿ ಪ್ರತಿವರ್ಷ ಹೆಚ್ಚಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಸಹ ಪಾವತಿಸತಕ್ಕದ್ದು.

4. ಅಧಿಸೂಚನೆಯಲ್ಲಿ ವರ್ಗವನ್ನು ನಮೂದಿಸದೆ ಇರುವ ವರ್ಗಗಳ ಕಾರ್ಮಿಕರಿಗೆ ಅದೇ ಸ್ವರೂಪದ ಕೆಲಸ ನಿರ್ವಹಿಸುತ್ತಿರುವ ಇತರೆ ವರ್ಗದ ನೌಕರರಿಗೆ ಪಾವತಿ ಮಾಡುತ್ತಿರುವ ವೇತನವನ್ನು ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು.

5. ತುಂಡು ಆಧಾರದ ಮೇಲೆ ಕೆಲಸ ಮಾಡುವ ಕಾರ್ಮಿಕರ 8 ಗಂಟೆಗಳ ಕೆಲಸದ ವೇತನವು ಅದೇ ತರಹದ ಕೆಲಸಮಾಡುವ ಕಾರ್ಮಿಕರ ಒಂದು ದಿನದ ವೇತನಕ್ಕಿಂತ ಕಡಿಮೆ ಇರಕೂಡದು. ಒಂದು ದಿನದ ಕೆಲಸ ಎಂದರೆ 8 ಗಂಟೆಗಳ ಕೆಲಸ ಎಂದು ತಿಳಿಯತಕ್ಕದ್ದು.

ಕಾರ್ಮಿಕರನ್ನು 8 ಗಂಟೆಗಳಿಗಿಂತ ಕಡಿಮೆ ಅವಧಿಯ ಕೆಲಸಕ್ಕೆ ನೇಮಿಸಿಕೊಂಡರೆ ವೇತನದ ಪ್ರಮಾಣವನ್ನು ಆ ವರ್ಗದ ದಿನದ ಅಥವಾ ತಿಂಗಳ ವೇತನದ ಆಧಾರದ ಮೇಲೆ ಲೆಕ್ಕ ಹಾಕುವುದು.

6. ದಿನಗೂಲಿ ನೌಕರರಿಗೆ ಅವರ ದಿನದ ವೇತನ ದರಗಳನ್ನು ಕಂಡು ಹಿಡಿಯಬೇಕಾದಲ್ಲಿ ತಿಂಗಳ ವೇತನ ದರವನ್ನು 26 ದಿನಗಳಿಂದ ಭಾಗಿಸಬೇಕು, ಭಾಗಿಸಿದಾಗ ಬಂದ ದರವು ಭಿನ್ನಾಂಕವಾಗಿದ್ದಲ್ಲಿ ಅದನ್ನು ಸಮೀಪದ ರೂಪಾಯಿಗೆ ಪೂರ್ಣಗೊಳಿಸುವುದು.

7. ಸಂಸ್ಥೆಯಲ್ಲಿ ನಿಗದಿಪಡಿಸಿರುವ ವಾರದ ಅಥವಾ ಹಬ್ಬದ ದಿನಗಳಲ್ಲಿ ಕೆಲಸ ಮಾಡುವ ಕಾರ್ಮಿಕರಿಗೆ ಕನಿಷ್ಟ ವೇತನ ಕಾಯ್ದೆ ಮತ್ತು ನಿಯಮಗಳಿಗೆ ಒಳಪಟ್ಟು ಸಾಮಾನ್ಯ ವೇತನದ ಎರಡುಪಟ್ಟು ವೇತನವನ್ನು ಪಾವತಿ ಮಾಡತಕ್ಕದ್ದು.

8. ಕೆಲಸಗಾರರು ದಿನದ ನಿಗದಿತ ಅವಧಿಗಿಂತ ಹೆಚ್ಚು ಸಮಯ ಕೆಲಸ ನಿರ್ವಹಿಸಿದಲ್ಲಿ ಅಂತಹ ಹೆಚ್ಚುವರಿ ಅವಧಿ ಕೆಲಸಕ್ಕೆ ಆತನ ವೇತನದ ಎರಡುಪಟ್ಟು ವೇತನವನ್ನು ಪಾವತಿಸತಕ್ಕದ್ದು.

9. ವೇತನ ಲೆಕ್ಕಾಚಾರದಲ್ಲಿ ಚಿಲ್ಲರೆ ಬಂದ ಪಕ್ಷದಲ್ಲಿ ಅದನ್ನು ಸಮೀಪದ 50 ಪೈಸೆಗೆ ಪೂರ್ಣಗೊಳಿಸುವುದು.

10. ಟ್ರೈನಿಗಳಿಗೆ ಆ ವರ್ಗದ ನೌಕರರು ಪಡೆಯುತ್ತಿರುವ ವೇತನದ ಪ್ರತಿಶತ 75 ರಷ್ಟು ವೇತನವನ್ನು ಶಿಷ್ಯ ವೇತನವನ್ನಾಗಿ ಪಾವತಿಸತಕ್ಕದ್ದು.

11. ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿರುವ ವೇತನ ದರಗಳನ್ನು ಮತ್ತು ಕಾಲಕಾಲಕ್ಕೆ ಹೆಚ್ಚಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಆಯಾ ಅಂಕಣಗಳಲ್ಲಿಯೇ ನಮೂದಿಸಿ ಪಾವತಿ ಮಾಡತಕ್ಕದ್ದು.

ಕರ್ನಾಟಕ ರಾಜ್ಯಾದಂತ "ಅಂಗಡಿ ಮತ್ತು ವಾಣಿಜ್ಯ ಸಂಸ್ಥೆಗಳ" ಉದ್ದಿಮೆಯಲ್ಲಿನ ಯಾವುದೇ ಕೆಲಸದಲ್ಲಿ ತೊಡಗಿರುವ ಕಾರ್ಮಿಕರಿಗೆ ಕನಿಷ್ಠ ವೇತನವನ್ನು ಪರಿಷ್ಕರಿಸಲು ಸರ್ಕಾರ ಕರಡು ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ 1948ರ (1948ರ ಕೇಂದ್ರ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ: 11) ಕಲಂ 5(1)(ಬಿ) ರನ್ವಯ ಅಧಿಸೂಚನೆಯ ಸಂಖ್ಯೆ: ಕಾಇ 89 ಎಲ್ಎಂಡಬ್ಲ್ಯೂ 2008 ದಿನಾಂಕ: 28-10-2011 ಅನ್ನು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದ ವಿಶೇಷ ಪತ್ರಿಕೆಯ ಭಾಗ 4(ಎ) ರಲ್ಲಿ ದಿನಾಂಕ: 28-10-2011 ರಂದು ಪ್ರಕಟಿಸಿ, ಅದರಿಂದ ಭಾದಿತರಾಗುವ ವ್ಯಕ್ತಿಗಳಿಂದ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳನ್ನು ಲಿಖಿತ ರೂಪದಲ್ಲಿ 2 ತಿಂಗಳ ಒಳಗಾಗಿ ಸಲ್ಲಿಸುವಂತೆ ಕೋರಲಾಗಿತ್ತು. ಕರಡು ಅಧಿಸೂಚನೆಯ ಮೇಲೆ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳು ಸ್ವೀಕೃತವಾಗಿರುವುದಿಲ್ಲ, ಕರಡು ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಕನಿಷ್ಠ ವೇತನ ಸಲಹಾ ಮಂಡಳಿಯ ಮುಂದೆ ಮಂಡಿಸಲಾಗಿತ್ತು. ಸರ್ಕಾರದ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸುಧೀರ್ಘವಾಗಿ ಸಮಾಲೋಚಿಸಿ ಅಂತಿಮ ಅಧಿಸೂಚನೆಯನ್ನು ಹೊರಡಿಸಲು ಮಂಡಳಿಯು ಸರ್ಕಾರಕ್ಕೆ ತನ್ನ ಶಿಫಾರಸ್ಸನ್ನು ನೀಡಿರುತ್ತದೆ.

ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ 1948ರ ಕಲಂ (1948ರ ಕೇಂದ್ರ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ: 11) 5(1)(ಬಿ) ಮತ್ತು ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ 1948ರ 3(1)(ಬಿ) ಅಡಿಯಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಮತ್ತು ಈ ಹಿಂದಿನ ಎಲ್ಲಾ ಅಧಿಸೂಚನೆಗಳನ್ನು ರದ್ದುಪಡಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಅನುಸೂಚಿಯಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವಂತೆ, ಕರ್ನಾಟಕ ರಾಜ್ಯದಾದ್ಯಂತ ಯಾವುದೇ "ಅಂಗಡಿ ಮತ್ತು ವಾಣಿಜ್ಯ ಸಂಸ್ಥೆಗಳ" ಉದ್ದಿಮೆಯ ಕೆಲಸದಲ್ಲಿ ತೊಡಗಿರುವ ವಿವಿಧ ಕಾರ್ಮಿಕ ವರ್ಗದವರಿಗೆ ವೇತನವನ್ನು ದಿನಾಂಕ: 01-04-2012 ರಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಪರಿಷ್ಕರಿಸಿದೆ.

ಅನುಸೂಚಿ

ತುಟ್ಟಿಭತ್ಯೆ:-

ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವ ದರಗಳು ರಾಜ್ಯ ಸರಾಸರಿ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕ (1960-100) 4284 ಅಂಶಗಳಿಗೆ ವಿಲೀನಗೊಳಿಸಲಾಗಿದೆ. ರಾಜ್ಯ ಸರಾಸರಿ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕ 4284 ಅಂಶಗಳಿಗಿಂತ ಹೆಚ್ಚಾಗುವ ಪ್ರತಿ ಅಂಶಕ್ಕೆ ಎಲ್ಲಾ ವರ್ಗದ ಕಾರ್ಮಿಕರಿಗೆ ದಿನ ಒಂದಕ್ಕೆ 4.0 ಪೈಸೆಯಂತೆ ತುಟ್ಟಿ ಭತ್ಯೆ ನೀಡತಕ್ಕದ್ದು.

ತುಟ್ಟಿಭತ್ಯೆ ಲೆಕ್ಕಾಚಾರವನ್ನು ವರ್ಷಕ್ಕೊಮ್ಮೆ ಮಾಡಲಾಗುತ್ತದೆ. ಹಿಂದಿನ ಕ್ಯಾಲೆಂಡರ್ ವರ್ಷದ 12 ತಿಂಗಳುಗಳ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕಗಳ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ ಏಪ್ರಿಲ್ ಮೊದಲನೇ ದಿನಾಂಕದಂದು ಪ್ರತಿ ವರ್ಷ ಲೆಕ್ಕಾಚಾರ ಮಾಡತಕ್ಕದ್ದು. ಅಲ್ಲದೇ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಂಕಗಳ ಸಂಖ್ಯೆಯ ವಾರ್ಷಿಕ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ ಹೆಚ್ಚುವರಿಯಾದ ಅಥವಾ ಕಡಿಮೆಯಾದ ಪ್ರಮಾಣವನ್ನು ಆಧರಿಸಿ ಲೆಕ್ಕ ಹಾಕಲಾಗುತ್ತದೆ. ಆದ್ದರಿಂದ ಮೊದಲ ಲೆಕ್ಕಾಚಾರವು ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕದ (ಜನವರಿ 2011 ರಿಂದ ಡಿಸೆಂಬರ್ 2011)ರ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ 2012 ಏಪ್ರಿಲ್ 1 ನೇ ತಾರೀಖಿನಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ.

1. ದಿನಗೂಲಿ ಗಳಿಕೆದಾರರ ಸಂದರ್ಭದಲ್ಲಿ ಮಾಸಿಕ ವೇತನ ದರಗಳನ್ನು 26 ದಿನಗಳಿಂದ ವಿಭಾಗಿಸಿ, 4 ರಜಾ ದಿನಗಳಿಗೆ ವೇತನವನ್ನು ನೀಡುವುದೂ ಸೇರಿದಂತೆ ಲೆಕ್ಕ ಹಾಕತಕ್ಕದ್ದು.

ಆ) ದಿನಗೂಲಿ ವೇತನವನ್ನು ಪಡೆಯುವವರು:-

ಪ್ರತಿ ವರ್ಷ ಹೆಚ್ಚಾಗುವ ಸಿ ಪಿ ಐ ಅಂಶಗಳು x ತುಟ್ಟಿಭತ್ಯೆಯ ದರ x 30 = ದಿನದ ತುಟ್ಟಿಭತ್ಯೆ

2. ಮಹಿಳೆಯರು ಮತ್ತು ಪುರುಷರು ಒಂದೆ ರೀತಿಯ ಕೆಲಸವನ್ನು ನಿರ್ವಹಿಸಿದ ಸಂದರ್ಭಗಳಲ್ಲಿ ಉಭಯತ್ರರಿಗೂ ಸಮಾನ ದರದ ವೇತನಗಳನ್ನು ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು

3. ಪ್ರಸ್ತುತ ಪಾವತಿಸುತ್ತಿರುವ ವೇತನ ದರವು ಹೆಚ್ಚಾಗಿದ್ದಲ್ಲಿ ಆ ಹೆಚ್ಚಾಗಿರುವ ದರಗಳ ವೇತನವನ್ನು ಸಂದಾಯ ಮಾಡುವುದನ್ನು ಮುಂದುವರೆಸತಕ್ಕದ್ದು ಹಾಗೂ ಕಡ್ಡಾಯವಾಗಿ ಪ್ರತಿ ವರ್ಷ ಹೆಚ್ಚಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಸಹ ಪಾವತಿಸತಕ್ಕದ್ದು.

4. ಅಧಿಸೂಚನೆಯಲ್ಲಿ ವರ್ಗವನ್ನು ನಮೂದಿಸದೆ ಇರುವ ವರ್ಗಗಳ ಕಾರ್ಮಿಕರಿಗೆ ಅದೇ ಸ್ವರೂಪದ ಕೆಲಸ ನಿರ್ವಹಿಸುತ್ತಿರುವ ಇತರೆ ವರ್ಗದ ನೌಕರರಿಗೆ ಪಾವತಿ ಮಾಡುತ್ತಿರುವ ವೇತನವನ್ನು ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು.

5. ತುಂಡು ಆಧಾರದ ಮೇಲೆ ಕೆಲಸ ಮಾಡುವ ಕಾರ್ಮಿಕರ 8 ಗಂಟೆಗಳ ಕೆಲಸದ ವೇತನವು ಅದೇ ತರಹದ ಕೆಲಸಮಾಡುವ ಕಾರ್ಮಿಕರ ಒಂದು ದಿನದ ವೇತನಕ್ಕಿಂತ ಕಡಿಮೆ ಇರಕೂಡದು. ಒಂದು ದಿನದ ಕೆಲಸ ಎಂದರೆ 8 ಗಂಟೆಗಳ ಕೆಲಸ ಎಂದು ತಿಳಿಯತಕ್ಕದ್ದು.

ಕಾರ್ಮಿಕರನ್ನು 8 ಗಂಟೆಗಳಿಗಿಂತ ಕಡಿಮೆ ಅವಧಿಯ ಕೆಲಸಕ್ಕೆ ನೇಮಿಸಿಕೊಂಡರೆ ವೇತನದ ಪ್ರಮಾಣವನ್ನು ಆ ವರ್ಗದ ದಿನದ ಅಥವಾ ತಿಂಗಳ ವೇತನದ ಆಧಾರದ ಮೇಲೆ ಲೆಕ್ಕ ಹಾಕುವುದು.

6. ದಿನಗೂಲಿ ನೌಕರರಿಗೆ ಅವರ ದಿನದ ವೇತನ ದರಗಳನ್ನು ಕಂಡು ಹಿಡಿಯಬೇಕಾದಲ್ಲಿ ತಿಂಗಳ ದರವನ್ನು 26 ರಿಂದ ಭಾಗಿಸಬೇಕು, ಹಾಗೂ ಒಂದು ವೇಳೆ ಭಾಗಿಸಿದಾಗ ಬಂದ ದರವು ಭಿನ್ನಾಂಕವಾಗಿದ್ದಲ್ಲಿ ಅದನ್ನು ಸಮೀಪದ ರೂಪಾಯಿಗೆ ಪೂರ್ಣಗೊಳಿಸಬೇಕು.

7. ಸಂಸ್ಥೆಯಲ್ಲಿ ನಿಗದಿಪಡಿಸಿರುವ ವಾರದ ಅಥವಾ ಹಬ್ಬದ ರಜಾ ದಿನಗಳಲ್ಲಿ ಕೆಲಸ ಮಾಡಿದ ಸಂದರ್ಭಗಳಲ್ಲಿ ಅಂತಹ ಕಾರ್ಮಿಕರಿಗೆ ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ ಮತ್ತು ನಿಯಮಗಳಿಗೆ ಒಳಪಟ್ಟು ಸಾಮಾನ್ಯ ವೇತನದ ಎರಡುಪಟ್ಟು ವೇತನವನ್ನು ಪಾವತಿ ಮಾಡತಕ್ಕದ್ದು.

8. ಕೆಲಸಗಾರರು ದಿನದ ನಿಗದಿತ ಅವಧಿಗಿಂತ ಹೆಚ್ಚು ಸಮಯ ಕೆಲಸ ನಿರ್ವಹಿಸಿದಲ್ಲಿ ಅಂತಹ ಹೆಚ್ಚುವರಿ ಅವಧಿ ಕೆಲಸಕ್ಕೆ ಆತನ ವೇತನದ ಎರಡುಪಟ್ಟು ವೇತನವನ್ನು ಪಾವತಿಸತಕ್ಕದ್ದು.

9. ವೇತನ ಲೆಕ್ಕಾಚಾರದಲ್ಲಿ ಚಿಲ್ಲರೆ ಬಂದ ಪಕ್ಷದಲ್ಲಿ ಅದನ್ನು ಸಮೀಪದ 50 ಪೈಸೆಗೆ ಪೂರ್ಣಗೊಳಿಸುವುದು.

10. ಟ್ರೈನಿಗಳಿಗೆ ಆ ವರ್ಗದ ನೌಕರರು ಪಡೆಯುತ್ತಿರುವ ವೇತನದ ಪ್ರತಿಶತ 75 ರಷ್ಟು ವೇತನವನ್ನು ಶಿಷ್ಯ ವೇತನವನ್ನಾಗಿ ಪಾವತಿಸತಕ್ಕದ್ದು.

11. ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿರುವ ವೇತನ ದರಗಳನ್ನು ಮತ್ತು ಕಾಲಕಾಲಕ್ಕೆ ಹೆಚ್ಚಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಆಯಾ ಅಂಕಣಗಳಲ್ಲಿಯೇ ನಮೂದಿಸಿ ಪಾವತಿ ಮಾಡತಕ್ಕದ್ದು.

ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಅನುಕಂಪದ ಆಧಾರದ ಮೇಲೆ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1996, ಇದನ್ನು ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವುದಕ್ಕೆ ದಿನಾಂಕ: 20.06.2012ರ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಆಸುಇ 55 ಸೇಅನೇ 2012 ರಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವ ಈ ಮುಂದಿನ ನಿಯಮಗಳ ಕರಡನ್ನು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಇದರ ಪ್ರಕಟಣೆಯ ದಿನಾಂಕದಿಂದ 15 ದಿನಗಳೊಳಗಾಗಿ ಅದರಿಂದ ಬಾಧಿತರಾಗುವ ಸಂಭವವಿರುವ ಎಲ್ಲ ವ್ಯಕ್ತಿಗಳಿಂದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ದಿನಾಂಕ: 21.06.2012ರ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದ ಭಾಗ-iv ಎ (ಸಂ: 413) ರಲ್ಲಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14)ರ 3ನೇ ಪ್ರಕರಣದ (2) ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ ಪ್ರಕಟಿಸಲಾಗಿರುವುದರಿಂದ;

ಸದರಿ ರಾಜ್ಯಪತ್ರವನ್ನು 21.06.2012 ರಂದು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಿರುವುದರಿಂದ;

ಮತ್ತು, ಸದರಿ ಕರಡಿನ ಬಗ್ಗೆ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳು ಸ್ವೀಕೃತವಾಗದಿರುವುದರಿಂದ;

ಈಗ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ, 14)ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಿಕೊಂಡ 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಮೂಲಕ ಈ ಕೆಳಕಂಡ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ:-

ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಅನುಕಂಪದ ಆಧಾರದ ಮೇಲೆ ನೇಮಕಾತಿ) (ಏಳನೇ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಈ ನಿಯಮಗಳು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ನಿಯಮ 2ಕ್ಕೆ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಅನುಕಂಪದ ಆಧಾರದ ಮೇಲೆ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1996 (ಇನ್ನು ಮುಂದೆ ಸದರಿ ನಿಯಮಗಳೆಂದು ಉಲ್ಲೇಖಿಸಲಾಗುವುದು)ರ ನಿಯಮ 2ರ ಉಪ ನಿಯಮ (1)ರ (i) ಖಂಡ (ಎ)ರಲ್ಲಿ ಅಂಶ (ii)ರ ನಂತರ ಕೆಳಕಂಡವುಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು. ಅಂದರೆ:-

(iii) ಅವಿವಾಹಿತ ಪುರುಷ ಮೃತ ಸರ್ಕಾರಿ ನೌಕರನ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಆತನ ಮೇಲೆ

ಅವಲಂಬಿತರಾಗಿದ್ದ ಹಾಗೂ ಆತನೊಂದಿಗೆ ವಾಸಿಸುತ್ತಿದ್ದ ಆತನ ಅವಿವಾಹಿತ ಸಹೋದರ, ಅವಿವಾಹಿತ

ಅಥವಾ ವಿಧವಾ ಸಹೋದರಿ, ಮತ್ತು

(iv) ಅವಿವಾಹಿತ ಮೃತ ಮಹಿಳಾ ಸರ್ಕಾರಿ ನೌಕರಳ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಆಕೆಯ ಮೇಲೆ

ಅವಲಂಬಿತರಾಗಿದ್ದ ಹಾಗೂ ಆಕೆಯೊಂದಿಗೆ ವಾಸಿಸುತ್ತಿದ್ದ ಆಕೆಯ ಅವಿವಾಹಿತ ಸಹೋದರ, ಅವಿವಾಹಿತ

ಅಥವಾ ವಿಧವಾ ಸಹೋದರಿ''

(ii) ಖಂಡ (ಬಿ) ರಲ್ಲಿ "ವಿಧವಾ ಮಗಳು" ಪದಗಳ ನಂತರ "ಅವಿವಾಹಿತ ಸಹೋದರ, ಅವಿವಾಹಿತ ಅಥವಾ ವಿಧವಾ ಸಹೋದರಿ'' ಎಂಬ ಪದಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು.

3. ನಿಯಮ 3ಕ್ಕೆ ತಿದ್ದುಪಡಿ:- ನಿಯಮ 3ರ ಉಪನಿಯಮ (2)ರಲ್ಲಿ ಖಂಡ (i)ರ ನಂತರ ಈ ಕೆಳಕಂಡವುಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಅಂದರೆ:-

"(iಎ) ಅವಿವಾಹಿತ ಮೃತ ಪುರುಷ ಸರ್ಕಾರಿ ನೌಕರರಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ:-

ಆತನ ಮೇಲೆ ಅವಲಂಬಿತರಾಗಿದ್ದ ಹಾಗೂ ಆತನೊಂದಿಗೆ ವಾಸಿಸುತ್ತಿದ್ದ ಆತನ

(ಎ) ಅವಿವಾಹಿತ ಸಹೋದರ

(ಬಿ) ಅವಿವಾಹಿತ ಅಥವಾ ವಿಧವಾ ಸಹೋದರಿ

(ii) ಖಂಡ (ii)ರ ನಂತರ ಈ ಕೆಳಕಂಡವುಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಅಂದರೆ:-

Whereas the draft of the following rules further to amend the Karnataka Civil Services (Appointment on Compassionate Grounds) Rules, 1996, was published as required by clause (a), sub-section (2) of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. DPAR 55 SCA 2012 dated 20.06.2012 in part IV-A (P.R. No. 413) of the Karnataka Gazette dated 21.06.2012 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.

Whereas, the said Gazette was made available to the public on 21.06.2012.

And Whereas, no objections and suggestions have been received in this behalf by the State Government.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) the Government of Karnataka hereby makes the following rules, namely:-

RULES

1. Short Title and Commencement:- (1) These rules may be called the Karnataka Civil Services (Appointment on Compassionate Grounds) (Seventh Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 2:- In rule 2 of the Karnataka Civil Services (Appointment on Compassionate Grounds) Rules, 1996 (hereinafter referred to as the said rules). in sub-rule(1),-

(i) in clause (a),after item (ii), the following shall be inserted, namely:-

(iii) in the case of deceased male unmarried Government Servant, his unmarried brother, unmarried or widowed sister who were dependent upon him and were living with him; and

(iv) in the case of deceased female unmarried Government Servant, her unmarried brother, unmarried or widowed sister who were dependent upon her and were living with her.''

(ii) in clause (b), after the words "widowed daughter,'' the words "unmarried brother, unmarried or widowed sister'' shall be inserted.

3. Amendment of rule 3,- In rule 3 of the said rules, in sub-rule (2), after clause (i), the following shall be inserted, namely:-

"(ia) in the case of the deceased male unmarried Government Servant,-

(a) unmarried brother;

(b) unmarried or widowed sister

who were dependent upon him and were living with him.

(ii) after clause (ii), the following shall be inserted, namely:-

(iia) in the case of the deceased female unmarried Government Servant,

(a) unmarried brother,

(b) unmarried or widowed sister

who were dependent upon her and were living with her.

In exercise of the powers conferred by sub-section (1) of section 14 of the Karnataka Educational Institutions (Prohibition of Capitation Fee) Act, 1984 (Karnataka Act 37 of 1984), the Government of Karnataka hereby makes the following rules further to amend the Karnataka Selection of Candidates for Admission to Government seats in Professional Educational Institutions Rules, 2006, namely:-

1. Title and Commencement.- These rules may be called the Karnataka Selection of Candidates for Admission to Government seats in Professional Educational Institutions (Amendment) Rules, 2012.

(2) They shall come into force from the date of their Publication in the Official Gazette.

2. Amendment of rule 2.- In the Karnataka Selection of Candidates for Admission to Government seats in Professional Educational Institution Rules, 2006 (herein after referred to as the said rules) in rule 2,-

(i) for clause (a), the following shall be substituted, namely:-

"(a) 'Admission Centre' means a center, called the Karnataka Examinations Authority,

where allotment of seats to Professional Courses is done by centralised counseling

through on line on the basis of merit subject to reservation policy of the Government

after obtaining the priority options from the candidates to the Government seats as

may be notified by the Government from time to time."

(ii) after clause (a), the following shall be inserted, namely:-

"(aa) 'Application Form' means the application form issued by the Karnataka Examination

Authority along with brochure in which the candidate may apply for Common

Entrance Test alongwith other details of his study from

1st to 12th Standard.

(iii) in clause (c), after the words "as per their academic eligibility", the words " and other conditions specified in these rules" shall be inserted.

(iv) in clause (l), after the words "and includes seats surrendered by private management notified by the Government as Government seats", the words "includes any other seats as may be notified by the Government from time to time" shall be inserted.

(v) after clause (l), the following shall be inserted, namely:-

(ll) 'Helpline Centre' means regional centers of the Karnataka Examination Authority at such places as may be authorized and notified by the Karnataka Examination Authority where the candidate may come for document verification, online keying of options, counseling and allotment of seats, payment of fees and issue of admission order."

(vi) after clause (r), the following shall be inserted, namely:-

(rr)'Pool' means pool of Government seats and includes seats cancelled, forfeited, newly added, and seats surrendered by private management and students".

3. Amendment of rule 3.- In rule 3 of the said rules,-

(i) In sub-rule (4), in second proviso to sub clause (c), for the words "Urban Agglomeration of the city", the words "15 KM from the Bruhat Bangalore Mahanagara Palike Limits in respect of city of Bangalore or limits of the City Corporation in case of other City corporations" shall be substituted.

4. Amendment of rule 5.- In rule 5 of the said rules, in sub- rule (1),-

(i) In sub-clause (iii) and sub clause (iv), after the words "read and write Kannada", the following shall be inserted, namely:-

"and must have secured not less than 12 marks out of 50 marks prescribed for Kannada Language Test of 4th Standard ".

(ii) In sub-clause (vi), for the words "Record Office of the Defence Unit of Army / Air force / Navy where the Parent's service record are maintained ", the following shall be substituted, namely:-

"respective branch of integrated HQ of Ministry of Defence for officers and respective Record Offices for JCOs / OR"

(iii) After clause (xiv), the following shall be inserted, namely:-

"(xv) whose parent is serving in Central Armed Police Force service, who at the time of joining the CAPF service had declared the hometown as a place in the State of Karnataka, proof of such domicile having been produced by obtaining the extract from the Record Office of the CAPF Unit where the Parent's service record are maintained".

5. Amendment of rule 7.- In rule 7 of the said rules, in sub- rule (4), after the words "alongwith the application", the following shall be inserted, namely:-

"All information mentioned by the candidate in the application form on the date of application including annual income or caste and category shall be final and no change shall be allowed at any stage under any circumstances thereafter".

6. Amendment of rule 10.- For rule 10 of the said rules, the following shall be substituted, namely:-

"10. Verification of documents and exercising of options for allotment of Government seats.-

(1) Verification of Documents.- (i) After the publication of results, the Karnataka Examination Authority shall notify helpline centres at District Head quarters or any other places as it deems necessary and shall establish the same for verification of documents online keying of options, councelling and allotment of seats, payment of fee and issue of admission order of eligible candidates.

(ii) The candidate shall produce the specified original documents alongwith photocopies thereof. The Executive Director shall cause verification of documents at each helpline centres as per the time schedule notified for verification of documents based on the rank of the candidates. The candidates shall appear at the helpline center as per time schedule on the notified dates with all originals alongwith two set of photocopies of required documents. One set of photocopies of the required documents shall be retained with respective helpline centers and the originals shall be returned to the candidate and enter all the details of the candidate's data online into the system which is linked to the Karnataka Examination Authority server. Verification of documents for all the disciplines shall be carried out at once by the Karnataka Examination Authority and candidate shall be issued with verification slip signed by the Verification Officer by mentioning all the details of the candidates including merit, rank, course of discipline, category, special category, if any, to which the candidate is eligible.

(iii) The candidate seeking allotment of Reserved Category Seat under sub-clause (2) of rule 9 shall not be considered for allotment of seats unless the candidate produces a Caste Certificate in Form 'D' in case of candidate belonging to Scheduled Castes and Scheduled Tribes and in Form 'E' in case of candidates belonging to Category-I and a Caste Income Certificate in Form 'F' for other backward classes like IIA, IIB, IIIA and IIIB, issued by the jurisdictional Tahasildar, in accordance with the Government Order No. Sa Ka E 225 BCA 2002, dated 30th March 2002 and Notification No. Sa Ka E 104 BCA 2011, dated 06.02.2012 as amended from time to time.

Provided that the candidate belonging to Scheduled Castes and Scheduled Tribes and Category-I shall also produce separate Income certificate issued by the jurisdictional Tahasildar for verification, for purpose of claiming Government of India scholarship.

(2) Entry of Options by Candidates.- (i) After the receipt of seat matrix from the Government, the Executive Director shall publish the same on the Karnataka Examination Authority website alongwith available seats college- wise, course-wise and category-wise and shall issue notification in the newspapers fixing the time schedule for entry of options by the candidates who become eligible after verification of documents.

(ii) The Executive Director shall also issue a bulletin of availability of seats college-wise, course-wise and category-wise before obtaining the options from the candidates in each round in all the helpline centres.

(iii) The candidate may exercise his option of entering the course or college of his choice from among the seat matrix notified which is displayed at the time of entry of options i.e., college-wise, category-wise and course-wise. The Executive Director may obtain priority options from the candidates for all the disciplines at once to which the candidate is eligible. The candidate shall have the choice to enter the options in the discipline to which he is eligible at once. The candidate may also enter the course and the institution of his choice in the order of his priority as per the seat matrix notified by the Executive Director.

(iv) The candidate who becomes eligible after verification of documents shall enter through Online (Internet) any number of priority options of his choice of College and courses either in the helpline centres or on his own arrangement as per the time schedule notified from time to time by the Executive Director. The candidate may change the options exercised by him as many times as he may desire before the last date and time notified for entry of options in each round. Options recorded in the server on the last day and time of the notified schedule in each round shall be frozen3544 and only be considered for allotment of seats. The candidate also has the option of taking a print out in each round after the last date and time for entry of options. Every candidate shall be given high security user ID and Password, which the candidate then has to login and change Password as per his choice.

(3) Procedure followed for allotment of seats.- (i) After the last date and time fixed for entering the options, the Executive Director shall take action to allot the seats in the order of merit based on the priority of the options entered by the candidates and by following the reservation policy of the Government.

(ii) The candidate belonging to Reserved Category, Special Category shall be considered first against General Merit category as per their merit order.

(iii) The candidate claiming Reserved Category seat under sub-clause (1) of rule 9, except those claiming reservation under Scouts and Guides and Physical Disability, shall produce the specified original documents in support of the claim, to the Executive Director who may refer the same to the respective authorities for scrutiny and confirmation, namely:-

(a) NCC: To the Directorate of NCC in Karnataka.

(b) Sports: To the Commissioner for Youth Services and Sports in Karnataka.

(c) Defence: The Officiating Education Officer, (HQ), Karnataka, Kerala and Goa sub-Area, Bangalore.

(d) Ex-Serviceman: To the Director, Department of Sainik Welfare and Resettlement in Karnataka.

(e) Anglo-Indian: Nominated Anglo-Indian MLA of State of Karnataka.

(f) Central Armed Police Force: To the Competent Authority.

(iv) The candidate suffering from less than forty percent of disability shall not be eligible for allotment of a seat under the persons with disability, Mental Illness (Including Dyslexia). The candidate claiming a seat under the persons with disability category shall appear on the date notified by the Executive Director, before the Medical Board constituted by the Director of Medical Education, consisting of the Executive Director, three specialists, one each from the Department of Orthopedics, Ophthalmology and ENT. The Medical Board shall examine the candidate and certify regarding the percentage of disability. A nominee of the Commissioner for Persons with Disabilities in Karnataka shall be present in the Karnataka Examination Authority on the notified day of seat selection. The decision of the Medical Board shall be final, depending upon which the candidate's eligibility for the allotment of seat shall be determined by the Executive Director.

Explanation.- For the purpose of this clause, persons with disability shall have the same meaning assigned to it, in the Persons with Disabilities (Equal Opportunities, Protection of Rights and Participation) Act 1995 (Central Act 1, 1995).

(4) Allotment of seats.- (i) The allotment of seat for Candidates with Physical Disability, candidates under NCC quota and Sports quota, shall be conducted by obtaining the priority options from the eligible candidates for allotment of seats in the first instance for the courses referred to in sub-rule (3) of rule 1 in the order of merit and preference as determined under rule 9.

(ii) Allotment of seats shall be held in respect of Medical and Dental courses in the first instance, where all the eligible candidates and also those who have already been allotted seats under clause (i) shall be considered for allotment of seats in the order of merit and priority of options in the respective discipline. The seat held by a candidate allotted under clause (i) shall automatically stand cancelled if such candidate is allotted a seat in Medical and Dental Courses.

(iii) The allotment of Indian Systems of Medicine and Homoeopathy courses seat shall be held after the completion of allotment under clauses (i) and (ii) where all the eligible candidates and also those who have already been allotted seats under clauses (i) and (ii) shall be considered for allotment of seat as per their merit order and priority of options, to allot a seat in the Indian Systems of Medicine and Homoeopathy courses. The candidates who have been allotted seats under clauses (i) and (ii) if satisfied with the allotted seat need not exercise their option for allotment of Indian3545 System of Medicine and Homoeopathy seats. If the candidate who has been allotted a seat under clauses (i) and (ii) is allotted an Indian System of Medicine and Homoeopathy seat, the seat allotted earlier shall automatically stand cancelled.

(iv) The allotment of Engineering, Technology seat shall be held after completion of the seat allotment under clauses (i) to (iii) where all the eligible candidates and also those who have already been allotted seats under clauses (i) to (iii) shall be considered for allotment of an engineering seats in the order of merit, priority of the options. If the candidates, who have been allotted seats under clauses (i) to (iii) is allotted with Engineering, Technology seat, the seat allotted earlier shall automatically stand cancelled.

(v) The allotment of Architecture seat shall be held after completion of the seat allotment under clauses (i) to (iv), where all the eligible candidates and also those who have been already allotted seats under clauses (i) to (iv) shall be considered for allotment in the order of merit and priority of options. If the candidate, who has been allotted a seat under clauses (i) to (iv), is allotted with an Architecture seat, the seat allotted earlier shall automatically stand cancelled.

Provided that while allotting the seats under sub-clauses (i) to (v), the fee paid by the candidates earlier if any, shall be adjusted to the newly allotted seats and the balance amount if any, shall be refunded to the candidate or if the candidate required to pay the balance fee if any, shall be paid by such candidate in the designated bank.

(vi) After the allotment of seats, the merit-wise allotted list of seats shall be hosted by the Executive Director on the KEA website and also on the notice boards of the helpline centres. The candidate shall have the following three choices after the seat allotted to them.

Choice 1.- If the candidates satisfied with the allotted seat and candidate is willing to report to the allotted college, then the candidate shall not be considered for further allotment of seats in any subsequent round for any discipline. Such candidates shall pay the prescribed fees by downloading the allotted details in the helpline centers, obtain the admission order and report to the college.

Provided that the candidate who has paid the fees and obtained the Admission Order and fails to report to the College on or before the last date and time specified by the Karnataka Examination Authority in the Admission Order, no extension of time shall be given and the allotment made in favour of such candidate shall be treated as Cancelled and he shall has no claim further on such allotment and he shall not be considered for allotment of seats in the subsequent round. Such seats shall revert back to the pool and fee paid by them shall be forfeited.

Choice 2.- Satisfied with the allotted seat but wishes to participate in the next round with fresh options. If fresh options gets allotted then earlier allotted seat get cancelled automatically or if fresh options seats are not allotted then earlier allotted seat shall remain in candidates favour.

Choice 3.- Not satisfied with allotted seat but wishes to consider in the next round with fresh options by surrendering the allotted seat.

(vii) If the candidate is satisfied with the allotted seat, he can download the allotted details along with challan and has to pay notified fee in the form of crossed demand draft drawn in favour of "The Executive Director, Karnataka Examinations Authority" payable at the respective designated bank established at helpline centres. On production of bank challan for having paid the fees the Executive Director or an officer authorized by him as Coordinator of the Helpline centre shall issue Admission Order. The candidate has to report to the allotted college on or before the date mentioned in the Admission Order. Upon reporting in the College the candidate at his end shall update the status of his reporting. The Principal of the College shall also enter the details of the reported candidate in the backend software provided by Karnataka Examination Authority as and when the candidate takes the Admission before the last date.

(viii) The candidate who has paid the fees and obtained the Admission Order and fails to report to the College on or before the last date and time specified by the authority in the Admission Order the allotment made in his favour shall be treated as cancelled and he has no claim further on such allotment. Such seats shall revert back to the pool.

Note.- (i) All the stages taken together as detailed above shall form one round the stages mentioned above, are known as iteration stage. The iteration stage in each round shall go on as long as the choice of the candidates is not fulfilled or the availability seats are not exhausted. In this way each candidate shall get either a Medical seat or an Engineering seat or ISMH seat as per his rank and priority in the respective disciplines.

(ii) The iteration stage starts with Medical or Dental seats, and goes on till the Medical seats is exhausted or choice of candidate is exhausted. Similarly, in the 2nd iteration stage the choice of the candidates in ISMH discipline is considered and in the 3rd iteration stage the choice of candidates in Engineering is considered and finally the 4th iteration stage the choice of the candidate for Architecture discipline is considered.

(5) Procedure followed in Conversion of Seats.- After completion of the allotment of seats under sub-clauses (i) to (v), the seats that remain un-allotted, surrendered, cancelled, forfeited and newly added seats as sanctioned by AICTE / MCI/DCI /CCIM/CCH shall be treated as CASUAL VACANCIES. In the first instance, such reserved seats that remain under Rural and Kannada medium categories under reserved categories or under General Merit, as the case may be, shall be transferred to the respective general categories. Casual Vacancy seat allotment shall be held for reserved categories like SC, ST, Category – 1, IIA, IIB, IIIA and IIIB in the first instance in the manner in which the allotment of seats done in the Admission Round. The seats that remain unfilled thereafter shall be transferred to General merit category and shall be considered for allotment to all the eligible candidates including reserved category candidates. The consequential vacancies arising in any category shall be retained in the same category and shall be allotted to candidates belonging to the respective category only.

(6) Procedure followed in Casual Vacancy Round.- (i) The Executive Director by notification may conduct Casual Vacancy Round of allotment of seats in the order specified in sub-rules (4) (i) to (v).

(ii) The Casual Vacancy Round allotment shall be held first for Medical or Dental courses then followed by Indian System of Medicine and Homoeopathy courses, which is followed by Engineering and Architecture course.

(iii) In the Casual Vacancy Round candidates who have been allotted with seat in one discipline shall not be considered for allotment of seats in the subsequent Casual Vacancy Round for other discipline.

Provided that the candidates who have been allotted Medical or Dental or Indian Systems of Medicine or Homoeopathy seats in the earlier rounds and who wants to opt for an Engineering or Technology or Architecture seat in the Casual Vacancy Round, shall invariably surrender the Medical or Dental or Indian Systems of Medicine or Homoeopathy seat atleast one day before the commencement of respective Casual Vacancy Round for Medical, Dental, Indian System of Medicine and Homoeopathy courses. This proviso is applicable to Engineering or Technology or Architecture seats also.

(iv) Candidates who have been allotted Medical or Dental or Indian Systems of Medicine or Homoeopathy or Engineering or Technology or Architecture seat and also candidates who have not been allotted any seat in any of the earlier rounds are eligible to consider for allotment of seats in the Casual Vacancy Round.

(7) Allotment of seats in Casual Vacancy Round.- (i) The seat allotment for Candidates with Physical Disability, Candidates under NCC quota and Sports quota, shall be conducted in the order of merit and preference as determined by the concerned authority in the first instance for the courses referred to in sub-rule (3) of rule 1 before conducting the Casual Vacancy Round under clauses (ii) to (v). Upon allotment of seat candidates have to pay the notified fee in the designated bank established at helpline centres and the Executive Director or the Officer authorized by him in this behalf shall issue an Admission Order to that effect.

(ii) Seat already allotted shall automatically stand cancelled when such candidate is allotted with a seat in Medical and Dental in Casual Vacancy Round. The candidate, who has been allotted with the Medical or Dental seat for the first time, shall deposit the specified admission fee in the designated bank. On production of the bank Challan for having paid the notified fee established at helpline centres the Executive Director shall cause issue of Admission Order.

The candidate after obtaining the admission order shall report to the respective college for admission on or before the date mentioned in the Admission Order along with a copy of the Bank challan.

Upon reporting in the College the candidate at his end shall update the status of his reporting. The Principal of the College shall also enter the details of the reported candidate in the backend software provided by Karnataka Examination Authority as and when the candidate takes the Admission before the last date.

The candidate who has paid the fees and obtained the Admission Order and fails to report to the College on or before the last date and time specified by the authority in the Admission Order the allotment made in his favour shall be treated as Cancelled and he has no claim further on such allotment. Such seats shall revert back to the pool.

(iii) The Casual Vacancy Round for Indian System of Medicine and Homoeopathy courses shall be held after completion of the casual Vacancy Round under clause (ii). The candidate who is allotted with Indian System of Medicine and Homoeopathy seats shall deposit the specified admission fee in the designated bank established at helpline centres. On production of the Bank Challan for having paid the notified fee the Executive Director shall cause issue of Admission Order. The candidate after obtaining the Admission Order shall report to the respective College for Admission on or before the date mentioned in the Admission Order along with a copy of the challan.

Upon reporting in the College the candidate at his end shall update the status of his reporting. The Principal of the College shall also enter the details of the reported candidate in the backend software provided by Karnataka Examination Authority as and when the candidate takes the Admission before the last date.

The candidate who has paid the fees and obtained the Admission Order and fails to report to the College on or before the last date and time specified by the authority in the Admission Order the allotment made in his favour shall be treated as Cancelled and he has no claim further on such allotment. Such seats shall revert back to the pool.

(iv) The Casual Vacancy Round for Engineering, Technology courses shall be held after completion of the Casual Vacancy Round under clauses (ii) and (iii). The candidate allotted with such seats shall deposit the specified admission fee in the designated bank at helpline centres. On production of the Bank Challan for having paid the notified fee the Executive Director shall cause issue of Admission Order. The candidate after obtaining the admission order shall report to the respective college for admission on or before the date mentioned in the admission order along with a copy of the challan.

Upon reporting in the College the candidate at his end shall update the status of his reporting. The Principal of the College shall also enter the details of the reported candidate in the backend software provided by Karnataka Examination Authority as and when the candidate takes the Admission before the last date.

The candidate who has paid the fees and obtained the Admission Order and fails to report to the College on or before the last date and time specified by the authority in the Admission Order the allotment made in his favour shall be treated as Cancelled and he has no claim further on such allotment. Such seats shall revert back to the pool.

(v) The Casual Vacancy Round for allotment for Architecture seat shall be held after completion of the Casual Vacancy Round under clauses (i) to (iv). The candidates selecting such seats shall deposit the specified Admission Fee in the designated bank established at helpline centres. On production of the bank Challan for having paid the notified fee the Executive Director shall cause issue of Admission Order. The candidate after obtaining the admission order shall report to the respective college for admission on or before the date mentioned in the admission order along with a copy of the challan.

Upon reporting in the College the candidate at his end shall update the status of his reporting. The Principal of the College shall also enter the details of the reported candidate in the backend software provided by Karnataka Examination Authority as and when the candidate takes the Admission before the last date.

The candidate who has paid the fees and obtained the Admission Order and fails to report to the College on or before the last date and time specified by the authority in the Admission Order the allotment made in his favour shall be treated as Cancelled and he has no claim further on such allotment. Such seats shall revert back to the pool.

(vi) A candidate who has been allotted with a seat in one discipline, course during Casual Vacancy round shall not be eligible to consider in further Casual Vacancy Seat allotment round for other courses.

(8) The procedure followed for allotment of seats as applicable under these rules shall apply mutatis-mutandis to Jammu and Kashmiri Migrant quota seats also.

(9) Reconciliation.- The Executive Director after completion of the last round of allotment within 24 hours shall handover the final allotted list of Government quota seats, college wise, course wise and category wise to the appropriate authority i.e., Medical or Dental to Director of Medical Education, Engineering or Architecture to Director of Technical Education and Indian Systems of Medicine to Director, AYUSH. The appropriate authorities shall reconfirm to the Executive Director within seven working days the status of allotment of Government quota seats in all courses.

The appropriate authorities at their level as per their mandated power as defined by the MCI, DCI, AICTE, CCIM, CCH shall cause verification with the Principals of the respective colleges and write back within seven working days. While doing so care must be taken not to change the Karnataka Examination Authority allotted list. The details of not reported seats found, if any, shall also be brought to the notice of the Executive Director.

Provided that in respect of Engineering seats the unfilled seats after reconciliation shall be allowed to be filled by managements.

(10) The Government may by order cancel any seat selection made under these Rules, for the reasons specified therein.

8. Amendment of rule 12.- For rule 12 of the said rules, the following shall be substituted, namely:-

"12. Forfeiture and Refund of fee.-(1) The candidate who has been allotted a seat in any discipline under sub- rule (4) of rule 10 surrenders the seat before the last date notified for the commencement of the respective Spot Casual Vacancy Round, the Executive Director, shall deduct Rs.5000/- as processing fee and refund the remaining fee paid.

(2) The candidate who has been allotted a seat in any discipline under sub-rule (4) of rule 10 surrenders the seat after the completion of respective Casual Vacancy Round, the Executive Director, shall forfeit the entire fee paid.

(3) The candidate who surrenders the seat allotted as per sub-rule (7) of rule 10 i.e., in the Casual Vacancy Round, the Executive Director, shall forfeit the entire fee paid.

(4) No surrender or cancellation of seat shall be accepted, unless the candidate surrenders the original admission order issued by the Karnataka Examination Authority and the original Bank Challan.

(5) If a candidate does not surrender or cancel or fail to join the allotted college even after the completion of the Casual Vacancy Round the Executive Director, Karnataka Examinations Authority shall forfeit the entire fee amount paid by the candidates."

1. Title and commencement.- (1) These rules may be called the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Karnataka (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment to rule.27 :- In clause (a) of rule 27 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Karnataka Rules, 2006, for the words "an officer not below the rank of Additional Labour Commissioner", the words "Labour Commissioner" shall be substituted.

1. 1964ರ ಕರ್ನಾಟಕ ಪೌರಸಭೆಗಳ ಅಧಿನಿಯಮದ ಉಪಬಂಧಗಳ ಮೇರೆಗೆ ಸ್ಥಾಪಿತವಾದ ನಗರ ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಹೊಸದುರ್ಗ ಪುರಸಭೆಯ 8ನೇ ವಾರ್ಡ್‌ನಿಂದ ಅನುಸೂಚಿತ ಜಾತಿ ವರ್ಗದಿಂದ ಚುನಾಯಿತ ಸದಸ್ಯ ಸ್ಥಾನವನ್ನು ತುಂಬಿದ ಶ್ರೀ ಈರಪ್ಪ ಹೆಚ್ ಇವರ ಮರಣದಿಂದಾಗಿ ಸದರಿ 8ನೇ ವಾರ್ಡಿನ ಅನುಸೂಚಿತ ಜಾತಿ ವರ್ಗದ ಸದಸ್ಯ ಸ್ಥಾನವು ಖಾಲಿಯಾಗಿದೆ ಎಂದು ಘೋಷಿಸಿರುವುದರಿಂದ ಉಂಟಾದ ಖಾಲಿ ಸ್ಥಾನವನ್ನು ತುಂಬಲು ಚುನಾವಣೆಗಳನ್ನು ನಡೆಸಬೇಕಾಗಿರುತ್ತದೆ.

2. ಆದುದರಿಂದ ಕರ್ನಾಟಕ ಪೌರಸಭಾ(ಸದಸ್ಯರುಗಳ ಚುನಾವಣೆ) ನಿಯಮಗಳು 1977ರ 8(1)ನೇ ನಿಯಮಕ್ಕೆ ಅನುಸಾರವಾಗಿ ಚಿತ್ರದುರ್ಗ ಜಿಲ್ಲೆಯ ಜಿಲ್ಲಾಧಿಕಾರಿಯಾದ ವಿಪುಲ್ ಬನ್ಸಲ್ ಎಂಬ ಹೆಸರಿನ ನಾನು ಸದರಿ ಚುನಾವಣೆಗೆ ಸಂಬಂಧಿಸಿದ ಈ ಕೆಳಕಂಡ ಕಾರ್ಯಕ್ರಮ ವೇಳಾ ಪಟ್ಟಿಯನ್ನು ಈ ಮೂಲಕ ನಿಗಧಿಪಡಿಸಿದ್ದೇನೆ.

(1) 1964 ನೇ ಕರ್ನಾಟಕ ಪುರಸಭೆಗಳ ಅಧಿನಿಯಮದ ಉಪಬಂಧಗಳ ಅಡಿಯಲ್ಲಿ ಸ್ಥಾಪಿತವಾದ ಮಾಲೂರು ಪುರಸಭೆಯ ವಾರ್ಡ್ ನಂಬರ್ 4 ರಲ್ಲಿ ತೆರವಾಗಿರುವ ಸದಸ್ಯರ ಸ್ಥಾನವನ್ನು (ಹಿಂದುಳಿದ ವರ್ಗ 'ಅ'(ಮಹಿಳೆ)) ತುಂಬಲು ಈ ಅಧಿಸೂಚನೆಗೆ ಲಗತ್ತಿಸಿರುವ ಅನುಬಂಧದಲ್ಲಿ ನೀಡಲಾಗಿರುವ ವಿವರಗಳಂತೆ ಮೇಲ್ಕಂಡ ಪುರಸಭೆಯಲ್ಲಿ ತೆರವಾಗಿರುವ ಸದಸ್ಯರ ಸ್ಥಾನವನ್ನು ತುಂಬಲು,

(2) ಮಾಲೂರು ಪುರಸಭೆಯ ವಾರ್ಡ್ ನಂಬರ್ 4 ರ ಸದಸ್ಯರಾಗಿದ್ದ ಶ್ರೀಮತಿ.ಎಂ.ರಾಮಕ್ಕ ಕೋಂ ಲಕ್ಷ್ಮಯ್ಯ ರವರ ಮರಣದಿಂದಾಗಿ ಖಾಲಿಯಾಗಿರುವುದಾಗಿ ಘೋಷಿಸಿರುವುದರಿಂದ ಉಂಟಾದ ಖಾಲಿ ಸದಸ್ಯ ಸ್ಥಾನವನ್ನು ತುಂಬಲು ಚುನಾವಣೆಯನ್ನು ನಡೆಸಬೇಕಾಗಿರುವುದರಿಂದ, ಆದುದರಿಂದ, ಕರ್ನಾಟಕ ಪುರಸಭೆಗಳ (ಕೌನ್ಸಿಲರುಗಳ ಚುನಾವಣೆ) ನಿಯಮಗಳು 1977 ರ ನಿಯಮ 8 ರ ಅನುಸಾರವಾಗಿ ಕೋಲಾರ ಜಿಲ್ಲೆಯ ಡೆಪ್ಯುಟಿ ಕಮೀಷನರ್‌ರಾದ ಡಾ: ಡಿ.ಎಸ್.ವಿಶ್ವನಾಥ್, ಭಾ.ಆ.ಸೇ. ಆದ ನಾನು, ಸದರಿ ಚುನಾವಣೆಗೆ ಸಂಬಂಧಿಸಿದ ಈ ಕೆಳಕಂಡ ಕಾರ್ಯಕ್ರಮ ವೇಳಾ ಪಟ್ಟಿಯನ್ನು ಈ ಮೂಲಕ ನಿಗಧಿಪಡಿಸಿರುತ್ತೇನೆ.

(ಎ) ನಾಮಪತ್ರಗಳನ್ನು ಸಲ್ಲಿಸಲು ಕೊನೆಯ ದಿನಾಂಕ : 23-07-2012 (ಸೋಮವಾರ)

ಮತ್ತು ದಿನ

(ಬಿ) ನಾಮಪತ್ರಗಳನ್ನು ಪರಿಶೀಲಿಸುವ ದಿನಾಂಕ ಮತ್ತು ದಿನ : 24-07-2012 (ಮಂಗಳವಾರ)

(ಸಿ) ಉಮೇದುವಾರಿಕೆಗಳನ್ನು ಹಿಂತೆಗೆದುಕೊಳ್ಳುವ ಕೊನೆಯ : 26-07-2012 (ಗುರುವಾರ)
