1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ (1966ರ ಕರ್ನಾಟಕ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ವಿಧಿ 28(1)ರ ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ, ದಿನಾಂಕ: 07.08.2006ರ ಅಧಿಸೂಚನೆ, ಕರ್ನಾಟಕ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರ ಭಾಗ-3ರ ವಿಶೇಷ ಪತ್ರಿಕೆ ಪುಟ ಸಂಖ್ಯೆ: 1 ರಿಂದ 51ರಲ್ಲಿ ಪ್ರಕಟವಾಗಿರುವ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 247 ಎಸ್‌ಪಿಕ್ಯೂ 2006, ದಿನಾಂಕ: 07.08.2006ರ ಭೂಸ್ವಾಧೀನಕ್ಕೆ ಒಳಪಟ್ಟ ಪ್ರದೇಶದ ಪ್ರಕಾರ ಸರ್ಕಾರ ಸದರಿ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಕೈಗಾರಿಕಾ ಪ್ರದೇಶದ ಸ್ಥಾಪನೆಗಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಇಚ್ಛೆಪಟ್ಟಿದೆ.

ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಭೂಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕೆ.ಐ.ಎ.ಡಿ. ಕಾಯ್ದೆ ಕಲಂ ವಿಧಿ 28(3)ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

ಆದುದರಿಂದ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 28(4)ರ (1966ರ ಕರ್ನಾಟಕ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18)ರ ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಭೂಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಿದೆ.

ಈ ಮುಂದಿನ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳಲ್ಲಿ ಕೈಗಾರಿಕೆಗಳ ಸ್ಥಾಪನೆಗಾಗಿ ಅಂದರೆ ಬಳ್ಳಾರಿ ಜಿಲ್ಲೆ ಹಗರಿಬೊಮ್ಮನಹಳ್ಳಿ ತಾಲೂಕಿನ ಹಂಪಾಪಟ್ಟಣ, ವ್ಯಾಸಪುರ ಹಾಗೂ ವರದಾಪುರ ಗ್ರಾಮಗಳಲ್ಲಿ ಮೆ|| ಆರ್.ಬಿ.ಎಸ್.ಎಸ್.ಎನ್. ಫೇರೋಸ್ ಪ್ರೈ. ಲಿ. ರವರಿಗಾಗಿ ಕೈಗಾರಿಕಾ ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಅಭಿವೃದ್ಧಿಗೊಳಿಸಲು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಗೆ ಅವಶ್ಯವಿರುತ್ತದೆಯೆಂದು ಕರ್ನಾಟಕ ಸರಕಾರವು ಉದ್ದೇಶಿಸಿದೆ.

ಆದ್ದರಿಂದ 1966 ನೇ ಸಾಲಿನ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966) ರ ಕಲಂ 28ರ ಉಪಕಲಂ (1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರಕಾರವು ಪ್ರಸ್ತುತ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಿ ಈ ಮೂಲಕ ಸೂಚನೆ ಕೊಡಲಾಗಿದೆ.

ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಕಲಂ 35 ರ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಂಥ ಜಮೀನುಗಳಲ್ಲಿ ಪ್ರವೇಶಿಸುವ ವ್ಯಕ್ತಿಗಳೊಡನೆ ಮಧ್ಯೆ ಪ್ರವೇಶಿಸುವದಾಗಲಿ ಆಥವಾ ಅವರನ್ನು ತಡೆಯುವುದಾಗಲಿ ಮಾಡಬಾರದು ಅಂತಾ ಪ್ರಸ್ತುತ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಇರುವವರಿಗೆಲ್ಲಾ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನಿನ ಮಾರಾಟ, ವಿಲೇವಾರಿ, ಗುತ್ತಿಗೆ ಅಡಮಾನ, ಹಸ್ತಾಂತರಣ ವಿನಿಮಯ ಅಥವಾ ಇನ್ನಾವುದೇ ರೀತಿಯ ಒಪ್ಪಂದಗಳನ್ನು ಅಥವಾ ಯಾವೊಂದು ವೆಚ್ಚ ಭೂ ಅಭಿವೃದ್ಧಿಗಳನ್ನು ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದ ನಂತರ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಆಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, ಧಾರವಾಡ ಇವರ ಮಂಜೂರಾತಿಯನ್ನು ಪಡೆಯದೇ ಮಾಡಿದ ಪಕ್ಷದಲ್ಲಿ ಕೇಂದ್ರಿಯ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆ 1894 ರ ಕಲಂ 24(7) ಮೇರೆಗೆ ಪರಿಹಾರಧನ ಕೊಡಲು ಪರಿಗಣಿೆಸುವುದಿಲ್ಲವೆಂಬ ಹಾಗೂ ಅಧಿಕೃತವಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ತಿಳಿಯಪಡಿಸಲಾಗಿದೆ.

ಸದರಿ ಜಮೀನಿನ ಒಂದು ಕರಡು ನಕ್ಷೆಯನ್ನು ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, 33/ಎ ಲಕಮನಹಳ್ಳಿ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶ, ಪಿ.ಬಿ. ರಸ್ತೆ ಧಾರವಾಡ-580004 ಇವರ ಕಾರ್ಯಾಲಯದಲ್ಲಿ ಪರಿಶೀಲನೆಗಾಗಿ ಇಡಲಾಗಿದೆ.

ಈ ಮುಂದಿನ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳಲ್ಲಿ ಕೈಗಾರಿಕೆಗಳ ಸ್ಥಾಪನೆಗಾಗಿ ಅಂದರೆ ಗುಲಬರ್ಗಾ ಜಿಲ್ಲೆ ಗುಲಬರ್ಗಾ ತಾಲೂಕಿನ ಫರತಾಬಾದ್ ಹೋಬಳಿ ಫಿರೋಜಾಬಾದ್, ಸೋಮನಾತಹಳ್ಳಿ, ಹಾಗೂ ಕೀರಣಗಿ ಗ್ರಾಮಗಳಲ್ಲ್ಲಿ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶವನ್ನು ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಅಭಿವೃದ್ಧಿಗೊಳಿಸಲು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಗೆ ಅವಶ್ಯವಿರುತ್ತದೆಯೆಂದು ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಉದ್ದೇಶಿಸಿದೆ.

ಆದ್ದರಿಂದ 1966 ನೇ ಸಾಲಿನ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966) ರ ಕಲಂ 28 ರ ಉಪಕಲಂ (1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಪ್ರಸ್ತುತ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಿ ಈ ಮೂಲಕ ಸೂಚನೆ ಕೊಡಲಾಗಿದೆ.

ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಕಲಂ 35 ರ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಂಥ ಜಮೀನುಗಳಲ್ಲಿ ಪ್ರವೇಶಿಸುವ ವ್ಯಕ್ತಿಗಳೊಡನೆ ಮಧ್ಯೆ ಪ್ರವೇಶಿಸುವುದಾಗಲಿ ಅಥವಾ ಅವರನ್ನು ತಡೆಯುವುದಾಗಲಿ ಮಾಡಬಾರದು ಅಂತಾ ಪ್ರಸ್ತುತ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಇರುವವರಿಗೆಲ್ಲಾ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನಿನ ಮಾರಾಟ. ವಿಲೇವಾರಿ, ಗುತ್ತಿಗೆ ಅಡಮಾನ, ಹಸ್ತಾಂತರಣ ವಿನಿಮಯ ಅಥವಾ ಇನ್ನಾವುದೇ ರೀತಿಯ ಒಪ್ಪಂದಗಳನ್ನು ಅಥವಾ ಯಾವೊಂದು ವೆಚ್ಚ ಭೂ ಅಭಿವೃದ್ಧಿಗಳನ್ನು ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದ ನಂತರ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, ಗುಲಬರ್ಗಾ ಇವರ ಮಂಜೂರಾತಿಯನ್ನು ಪಡೆಯದೇ ಮಾಡಿದ ಪಕ್ಷದಲ್ಲಿ ಕೇಂದ್ರಿಯ ಭೂಸ್ದಾಧೀನ ಕಾಯ್ದೆ 1894 ರ ಕಲಂ 24(7) ಮೇರೆಗೆ ಪರಿಹಾರಧನ ಕೊಡಲು ಪರಿಗಣಿಸುವುದಿಲ್ಲವೆಂಬ ಹಾಗೂ ಅಧಿಕೃತವಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ತಿಳಿಯಪಡಿಸಲಾಗಿದೆ.

The State Government by virtue of the powers conferred under Section 22(1) of the Haj Committee Act 2002 re- constitute the Karnataka State Haj Committee as follows. This new Committee shall hold the office as members of the State Haj Committee for a period of 3 years with effect from 16.08.2012.

Whereas, the draft of the Karnataka Municipal Corporations (Absorption of Junior Engineer appointed on deputation basis in Bruhath Bangalore Mahanagara Palike (Special) Rules, 2011 which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of section 91 read with Section 421 of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977) was published in Notification No. UDD 911 MNY 2011, dated 28.02.2012 in Part IV-A of the Karnataka Gazette, Extra-ordinary, dated 28.02.2012 inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date of its publication in the Official Gazette.

Whereas, the said Gazette was made available to the public on 28.02.2012.

And whereas, the objections and suggestions received in respect of the said Draft Rules have been examined by the Government.

Now, therefore, in exercise of the powers conferred by Section 421 of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977), the Government of Karnataka hereby makes the following rules, namely.-

RULES

1. Title and commencement.-(1) These Rules may be called the Karnataka Municipal Corporations (Absorption of Junior Engineer appointed on deputation basis in Bruhath Bangalore Mahanagara Palike (Special) Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions.- (1) In these rules, unless the context otherwise requires.-

(a) "Deputation Junior Engineer" means a Junior Engineer (Electrical) appointed in the Bruhath Bangalore Mahanagara Palike on deputation basis from Mysore Lamps Works Limited.

(b) "Schedule" means schedule appended to these Rules.

(c) Other words and expressions used in these rules but not defined shall have the same meaning respectively assigned to them in the Karnataka Municipal Corporations Rules, 1977.

3. Absorption of Deputation Junior Engineer in the Bruhath Bangalore Mahanagara Palike.-

Notwithstanding anything contained in the Karnataka Municipal Corporation Rules, 1977 or any other rules made or deemed to have been made under the provisions of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977), governing the method of recruitment of the employees of the Bruhath Bangalore Mahanagara Palike the Deputation Junior Engineer as specified in Column (2) of the Schedule and continues as such in the Bruhath Bangalore Mahanagara Palike on the date of commencement of these rules, be absorbed in the corresponding category of post and scale of pay specified in columns (5) and (6) respectively, in the Bruhath Bangalore Mahanagara Palike Services.

Provided that no such person shall be absorbed.-3624 (i) if he was disqualified for appointment under the Karnataka Municipal Corporations Rules, 1977 on the date of appointment as Junior Engineer in the Mysore Lamps Works Limited,

(ii) if he does not possess the minimum academic qualification, if any, specified in the rules of recruitment applicable for the recruitment to the post, in which he is absorbed,

(iii) in any post reserved for the persons belonging to the category of Schedule Castes or Scheduled Tribes or other backward classes to which he was appointed as deputation Junior Engineer if he is found to be not belonging to such category. Otherwise such post shall be treated as backlog to be filled by process of Special recruitment from among these classes.

4. Pay, Pension, Leave and Seniority of person absorbed under these rules.- Notwithstanding anything contained in the Karnataka Municipal Corporations Rules, 1977.

(i) The initial basic pay of deputation Junior Engineer absorbed under these rules shall be fixed at the minimum of the pay scale applicable to the category of post to which he is absorbed under rule 3.

(ii) The services rendered by a person on deputation Junior Engineer prior to the date of absorption shall count for the purpose of leave, pension, but not for pay and seniority and grant of selection time scale of pay under Karnataka Civil Services (Time Bound Advancement) Rules, 1983 or for grant of selection time scale of pay under the Karnataka Civil Services (Automatic grant of special promotion to the senior scale of pay) Rules, 1991 and additional increment for having completed twenty years of service in the single cadre.

(iii) As regards pension and other retirement benefits, he shall be governed by terms and conditions as stipulated in Government order No. FD (Spl) 04 PET 2005, dated 31.03.2006, i.e., New Defined contributory pension scheme introduced w.e.f. 01.04.2006 and/or pension policy of the Bruhath Bangalore Mahanagara Palike.

(iv) The deputationist so absorbed shall not receive any ex-gratia amount from his parent organization under the Voluntary Retirement Scheme and would be deemed to have resigned in the parent organization.

at the following places, among others, and for exercising jurisdiction over the Revenue Districts mentioned against them.

Applications in the prescribed format appended hereto are invited from the persons willing to be appointed as Chairman of Permanent Lok Adalat at the above 5 places.

(I) Qualifications for the Post of Chairman of Permanent Lok Adalat: Every Permanent Lok Adalat established for an area notified under sub section (I) of Section 22B of Legal Services Authorities Act, 1987, shall consist of a person who is, or has been, a District Judge or Additional District Judge or has held Judicial Office higher in rank than that of a District Judge who shall be the Chairman of the Permanent Lok Adalat.

(II) Allowances of Chairman of Permanent Lok Adalat:

(1) The Chairman shall be entitled to last drawn salary less the amount of pension received.

(2) The Chairman shall be entitled to such travelling and daily allowances on official tour as are admissible to Group 'A' officers of the Central Government.

(3) For the purpose of attending the sitting of Permanent Lok Adalat, the Chairman shall be entitled to conveyance allowance of Rs. 3000/- per month.

(III) Terms and Conditions of service of Chairman of Permanent Lok Adalat :

(1) Before appointment, the Chairman shall have to take an undertaking that he does not and will not have any such financial or other interest as is likely to affect prejudicially his functions, as such, as Chairman of PLA.

(2) The Chairman shall hold office for a term of five years and shall not be eligible for re-appointment.

(3) Notwithstanding anything contained in sub-rule (2) of Rule 4 of PLA (Other Terms & Conditions of Appointment of Chairman & Other Persons) Rules, 2003, Chairman may -

(a) by writing under his hand and addressed to Karnataka State Legal Services Authority, Bangalore, resign his office at any time;

(b) be removed from his office in accordance with the provisions of sub clause 5 of Rule 4 of the above Rules.

Karnataka State Legal Services Authority may remove a Chairman of PLA who –

(a) has been adjudged as insolvent ; or

(b) has been convicted of an offence which, in the opinion of the Authority, involves moral turpitude; or (c) has become physically or mentally incapable of acting as such as a member; or

(d) has acquired such financial or other interest as is likely to affect prejudicially his functions as a member of PLA; or

(e) has or so abused his position as to render his continuance in office prejudicial to the public interest;

Provided that a Chairman of PLA shall not be removed from his office on the ground specified in clause (d) & (e) of sub rule 5 of Rule 4 of the above Rules, except, on enquiry held in accordance with the procedure prescribed in Rule 6 of the above Rules.

(4) When the Chairman of PLA is unable to discharge his functions owing to absence, illness, or any other cause, the senior-most (in the order of appointment) member of Permanent Lok Adalat holding office for3627 the time being, shall discharge the functions of the Chairman until the day on which the Chairman resumes the charge of his functions.

(5) The Chairman of PLA ceasing to hold office, as such, shall not hold any appointment in, or be connected with, the management or administration of organization which has been the subject of the proceedings under the Act during his tenure, for a period of five years from the date on which he ceases to hold such office.

(IV) Such of the in service Judicial Officers and retired Judicial Officers who have already applied for the post of Chairman of PLA, Mangalore, in pursuance of Notification of KSLSA dated 4-11-2011 need not apply once again for the post of Chairman of PLA at Mangalore, which is also called for, as per the present Notification dated 19-07-2012.

The applications complete in all respects accompanied by self attested copies of relevant academic records, testimonials etc., shall reach the Member Secretary, Karnataka State Legal Services Authority, "NyayaDegula", 1st Floor, H. Siddaiah Road, Bangalore – 560 027, on or before 4.00 pm of 21/08/2012.

Applications sent through post shall be superscribed as "APPLICATION FOR APPOINTMENT AS CHAIRMAN OF PLA".

Applications received beyond the date so fixed will be rejected.

In service persons shall submit their application through proper channel so as to reach the Member Secretary, Karnataka State Legal Services Authority, Bangalore, not later than the date fixed for receipt of applications.

The draft of the following rules further to amend the Karnataka Educational Institutions (Recruitment and terms and conditions of service of employees in Private Aided Primary and Secondary Educational Institutions) Rules, 1999, which the Government of Karnataka proposes to make in exercise of the powers conferred by sub/section (1) of section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995) for the information of the persons likely to be affected thereby and notice in hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect of said draft before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Secretary to the Government (Primary and Secondary Education), Education Department, M.S. Building, Bangalore-560001.

DRAFT RULES

1. Title and Commencement – (1) These rules may be called the Karnataka Educational Institutions (Recruitment and terms and conditions of employees in Private Aided Primary and Secondary Educational Institutions) (Amendment) Rules, 2012.

(2) They shall come in to force from the date of their publication in the Official Gazette.

2. Amendment of Annexure IV : In the Karnataka Educational Institutions (Recruitment and terms and conditions of Service of employees in Private Aided Primary and Secondary Educational Institutions) Rules, 1999-in Annexure IV, the words and figures "6. Teacher (Craft or Drawing or Music: 1 (one)" shall be omitted.

ಈಗ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978ರ (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣವನ್ನು 8ನೇ ಪ್ರಕರಣದೊಡನೆ ಓದಿಕೊಂಡಂತೆ ಇದರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಈ ಮೂಲಕ ಈ ಕೆಳಗಿನಂತೆ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ:-

ನಿಯಮಗಳು

1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ಸಚಿವಾಲಯ ಸೇವೆಗಳು (ನೇಮಕಾತಿ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಈ ನಿಯಮಗಳು ಅವು ಸರ್ಕಾರಿ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಅನುಸೂಚಿಯ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ಸಚಿವಾಲಯ ಸೇವೆಗಳು (ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1992ರ ಅನುಸೂಚಿಯಲ್ಲಿ "ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆ" ಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿ,-

(i) ಕ್ರಮ ಸಂಖ್ಯೆ: 4ರಲ್ಲಿಯ `ಸಹಾಯಕ ಪ್ರಾರೂಪಕಾರ ಮತ್ತು ಪದನಿಮಿತ್ತ ಅಧೀನ ಕಾರ್ಯದರ್ಶಿ, ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆ (ರೂ.15200-25650)' ಎಂಬ ಹುದ್ದೆಯ ಪ್ರವರ್ಗಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಲ್ಲಿ (3)ನೇ ಅಂಕಣದಲ್ಲಿ ಈ ಮುಂದಿನ ಪರಂತುಕವನ್ನು ಕೊನೆಯಲ್ಲಿ ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"ಪರಂತು ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ಸಚಿವಾಲಯದ ಸೇವೆಗಳು (ನೇಮಕಾತಿ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಪ್ರಾರಂಭವಾದ ದಿನಾಂಕದಿಂದ ಒಂದು ವರ್ಷದ ಅವಧಿಯವರೆಗೆ ಸಹಾಯಕ ಪ್ರಾರೂಪಕಾರ ಮತ್ತು ಪದನಿಮಿತ್ತ ಅಧೀನ ಕಾರ್ಯದರ್ಶಿ, ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆ ಇಲ್ಲಿ ಸಿವಿಲ್ ಜಡ್ಜ್ (ಜೂನಿಯರ್ ಡಿವಿಷನ್) ಇವರಿಂದ ನಿಯೋಜನೆಯ ಮೂಲಕ ಭರ್ತಿ ಮಾಡಲು ಮೀಸಲಿಡಲಾದ ಎರಡು ಹುದ್ದೆಗಳನ್ನು ಶಾಖಾಧಿಕಾರಿ (ಪ್ರಾರೂಪಣೆ) ಇವರಿಗೆ ಬಡ್ತಿ ನೀಡುವ ಮೂಲಕ ತುಂಬಬಹುದು."

(ii) ಕ್ರಮ ಸಂಖ್ಯೆ 5ರಲ್ಲಿಯ `ಅಪರ ನಿರ್ದೇಶಕರು (ಭಾಷಾಂತರ) (ರೂ.20025-28275)' ಹುದ್ದೆಯ ಪ್ರವರ್ಗಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಲ್ಲಿ,-

(ಎ) (3)ನೇ ಅಂಕಣದಲ್ಲಿನ ನಮೂದುಗಳಿಗೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"ಸಹಾಯಕ ನಿರ್ದೇಶಕರು (ಕನ್ನಡ) ವೃಂದದಿಂದ ಬಡ್ತಿಯ ಮೂಲಕ.

ಪರಂತು, ಬಡ್ತಿಗೆ ಸೂಕ್ತ ವ್ಯಕ್ತಿಯು ಲಭ್ಯವಿಲ್ಲದಿದ್ದಲ್ಲಿ, ಭಾಷಾಂತರ ನಿರ್ದೇಶನಾಲಯದಿಂದ ತನ್ನ ಸ್ವಂತ ವೇತನದ ಮೇಲೆ ಉಪನಿರ್ದೇಶಕರ ಪ್ರತಿನಿಯೋಜನೆಯ ಮೂಲಕ.

(ಬಿ) (4)ನೇ ಅಂಕಣದಲ್ಲಿ ಈ ಮುಂದಿನದನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"ಬಡ್ತಿಗಾಗಿ.- ಸಹಾಯಕ ನಿರ್ದೇಶಕರು (ಕನ್ನಡ), ವೃಂದದಲ್ಲಿ ಮೂರು ವರ್ಷಗಳಿಗೆ ಕಡಿಮೆ ಇಲ್ಲದಷ್ಟು ಅವಧಿಯ ಸೇವೆಯನ್ನು ಸಲ್ಲಿಸಿರತಕ್ಕದ್ದು."

(iii) ಕ್ರಮ ಸಂಖ್ಯೆ 6ರಲ್ಲಿಯ `ಸಹಾಯಕ ನಿರ್ದೇಶಕರು (ಕನ್ನಡ) ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆ (ರೂ. 14050-25050)' ಹುದ್ದೆಯ ಪ್ರವರ್ಗಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಲ್ಲಿ (4)ನೇ ಅಂಕಣದಲ್ಲಿ ಈ ಮುಂದಿನದನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"ಬಡ್ತಿಗಾಗಿ.-ಸಂಶೋಧನಾಧಿಕಾರಿ (ಕನ್ನಡ) ವೃಂದದಲ್ಲಿ ಮೂರು ವರ್ಷಗಳಿಗೆ ಕಡಿಮೆ ಇಲ್ಲದಷ್ಟು ಅವಧಿಯ ಸೇವೆಯನ್ನು ಸಲ್ಲಿಸಿರತಕ್ಕದ್ದು."

Whereas, the draft of the Karnataka Government Secretariat Services (Recruitment) (Amendment) Rules, 2012 was published as required by clause (a) of sub-section (2) of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. DPAR 37 SRD 2012, dated 20th June, 2012 in Part IV-A of the Karnataka Gazette dated 21st June 2012 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of publication in the official Gazette.

And whereas, the said Gazette was made available to public on 21-06-2012.

And whereas, no objections and suggestions have been received in this behalf by the State Government; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely:-

RULES

1. Title and Commencement.- (1) These rules may be called the Karnataka Government Secretariat Services (Recruitment) (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of Schedule.- In the Schedule to the Karnataka Government Secretariat Services (Recruitment) Rules, 1992, under the heading "Department of Parliamentary Affairs & Legislation",-

(i) in the entries relating to the category of post of 'Assistant Draftsman and Ex-officio Under Secretaries, Department of Parliamentary Affairs & Legislation (15200-25650)' at Sl.No. 4, in column (3), the following proviso shall be inserted at the end, namely:-

"Provided that for a period of one year from the date of commencement of the Karnataka Government Secretariat Services (Recruitment) (Amendment) Rules, 2012, the two posts of Assistant Draftsman and Ex-officio Under Secretaries, Department of Parliamentary Affairs and Legislation earmarked to be filled by deputation from the cadre of Civil Judge (Junior), may be filled by promotion of Section Officer (Drafting)".

(ii) in the entries relating to the category of post of 'Additional Director (Translation) (Rs.20025-28275)' at Sl.No. 5,-

(a) for the entries in column (3), the following shall be substituted, namely:-

"By promotion from the cadre of Assistant Director (Kannada):

Provided that, if no suitable person is available for promotion, then by deputation of a Deputy Director from the Directorate of Translation on his own pay scale.

Note: In case the post is filled by deputation of a Deputy Director, the post shall be deemed to be of the scale of pay of deputy Director."

(b) in column (4), the following shall be inserted, namely:-

"For promotion.- Must have put in a service of not less than three years in the cadre of Assistant Director (Kannada)."3636 (iii) in the entries relating to the category of post of 'Assistant Director (Kannada), Department of Parliamentary Affairs and Legislation (Rs. 14050-25050)' at Sl.No. 6, in column (4), the following shall be inserted, namely:-

"For promotion.- Must have put in a service of not less than three years in the cadre of Research Officer (Kannada)."
