The Karnataka Homoeopathic Practitioners (Amendment) Bill, ²⁰¹²ರ ಆಗಸ್ಟ್ ಮಾಹೆಯ 27ನೇ ದಿನಾಂಕದಂದು ರಾಜ್ಯಪಾಲರ ಒಪ್ಪಿಗೆ ದೊರೆತಿದ್ದು, ಸಾಮಾನ್ಯ ತಿಳುವಳಿಕೆಗಾಗಿ ಇದನ್ನು 2012ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ: 33 ಎಂಬುದಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಬೇಕೆಂದು ಆದೇಶಿಸಲಾಗಿದೆ.

KARNATAKA ACT NO. 33 OF 2012

(First published in the Karnataka Gazette Extra-ordinary on the Thirtieth day of August, 2012) THE KARNATAKA HOMOEOPATHIC PRACTITIONERS (AMENDMENT) ACT, 2012

(Received the assent of the Governor on the Twenty Seventh day of August, 2012)

An Act further to amend the Karnataka Homoeopathic Practitioners Act, 1961.

Whereas it is expedient further to amend the Karnataka Homoeopathic Practitioners Act, 1961 (Karnataka Act 35 of 1961), for the purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the Sixty-Third Year of the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the Karnataka Homoeopathic Practitioners (Amendment) Act, 2012.

(2) It shall come into force at once.

2. Amendment of section 20.- In the Karnataka Homoeopathic Practitioners Act, 1961 (Karnataka Act 35 of 1961) (hereinafter referred to as the principal Act), in section 20, for the words "thirty rupees", the words "such fee as may be prescribed for life time membership" shall be deemed to have been substituted with effect from 1st January, 1996.

3. Amendment of section 24.- In section 24 of the principal Act, for sub-section (1), the following shall be deemed to have been substituted with effect from 1st January, 1996, namely:-

(4161)4162 "(1) Notwithstanding anything contained in section 18 or 20, each Homoeopathic Practitioner other than a Homoeopathic Practitioner whose name is entered in the register under section 18 or continued in the register shall pay to the Board on or before the thirty first day of December of every year and in succeeding year in which his name is entered in the register and every year thereafter a prescribed renewal fee for the continuance of his name on the register:

Provided that a Homoeopathic Practitioner registered under this Act, before the commencement of the life time registration may pay such amount as renewal fee, as may be prescribed, for the continuance of his name on the register for life time."

4. Amendment of section 35.- In section 35 of the principal Act, in sub-section (1), after the words "make rules", the words "prospectively or retrospectively" shall be inserted.

5. Validation.- Notwithstanding anything contained in any judgment, decree or order of any Court, Tribunal or other Authority to the contrary, anything done or any action taken or purporting to have been done or taken under any rules, notifications, notices or order issued and all proceedings held for levy of life time fee or any renewal fee by the State Government or the Board from any person for the purpose of membership shall be deemed to have been validly levied or collected and effective as if such levy and collection of enhanced rate of fee has been collected or action or thing had been done or taken under the principal Act, as amended by this Act in accordance with the law and accordingly,-

(a) no suit or other proceedings shall be maintained or continued in any court or Tribunal or before any Authority for the refund of any such fee, additional fee; and

(b) no court shall enforce any decree or order directing the refund of any such fee, additional fee.

Ordered that the translation of the ಕರ್ನಾಟಕ ಮೌಲ್ಯವದಿರ್ತ ತೆರಿಗೆ (ಎರಡನೇ ತಿದ್ದುಪಡಿ) ಅದಿನಿಯಮ, 2012 (2012ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ: 27) in the English language, be published as authorised by the Governor of Karnataka under clause (3) of Article 348 of the constitution of India in the Karnataka Gazette for general information.

The following translation of the ಕರ್ನಾಟಕ ಮೌಲ್ಯವದಿರ್ತ ತೆರಿಗೆ (ಎರಡನೇ ತಿದ್ದುಪಡಿ) ಅದಿನಿಯಮ, 2012 (2012ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ: 27) in the English language is published in the Official Gazette under the authority of the Governor of Karnataka under clause (3) of Article 348 of the Constitution of India.

KARNATAKA ACT NO. 27 OF 2O12

(First published in the Karnataka Gazette Extra-Ordinary on the Thirty first day of July, 2012) THE KARNATAKA VALUE ADDED TAX (SECOND AMENDMENT) ACT, 2012

(Received the assent of the Governor on the thirtieth day of July, 2012)

An Act further to amend the Karnataka Value Added Tax Act, 2003.

Whereas it is expedient further to amend the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004) for the purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the Sixty third year of the Republic of India, as follows.- 1. Short title and commencement.- (1) This Act may be called the Karnataka Value Added Tax (Second Amendment) Act, 2012.

(2) It shall come into force with effect from the First day of August, 2012.

2. Amendment of section 4.-In the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004) (hereinafter referred to as the principal Act), in section 4, in sub-section (1),

(i) in clause (a), in sub-clause (ii), for the words "five per cent", the words "five and one half per cent" shall be substituted; and

(ii) in clause (b), in sub-clause (iii), for the words "fourteen per cent", the words "fourteen and one half per cent" shall be substituted.

3. Amendment of Sixth Schedule.-In the Sixth Schedule to the principal Act, in column 3,-

(i) in the entries relating to serial numbers 1 to 11 and 13 to 22, for the words "Five per cent" wherever they occur, the words "Five and one half per cent" shall be substituted; and

(ii) in the entries relating to serial number 23, for the words "Fourteen per cent", the words "Fourteen and one half per cent" shall be substituted.

ಮೇಲೆ ಓದಲಾದ (1) ರ ಆಯೋಗದ ಆದೇಶದಲ್ಲಿ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ರ ಪ್ರಕರಣ 44(2) ರ ಪ್ರಕಾರ ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು ರಾಜ್ಯ ಚುನಾವಣಾ ಆಯೋಗದ ಸಾಮಾನ್ಯ ಹಾಗೂ ವಿಶೇಷ ಆದೇಶಕ್ಕೆ ಒಳಪಟ್ಟು ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಅಧ್ಯಕ್ಷ ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿಯನ್ನು ನಿಗದಿಪಡಿಸಲು ಆದೇಶಿಸಿದೆ.

2) ಅದರಂತೆ ಮೇಲೆ ಓದಲಾದ (2) ರ ಆದೇಶದಲ್ಲಿ ರಾಜ್ಯ ಚುನಾವಣಾ ಆಯೋಗವು ರಾಜ್ಯದಲ್ಲಿನ ಎಲ್ಲಾ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ವರ್ಗವಾರು ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಗಳನ್ನು ನಿಗದಿಪಡಿಸಿ ಆದೇಶ ಹೊರಡಿಸಿರುವಂತೆ ಸದರಿ ಆದೇಶದ ಅನುಬಂಧದಲ್ಲಿ ತಾಲ್ಲೂಕುವಾರು ವರ್ಗವಾರು ನಿಗದಿಪಡಿಸಲಾಗಿರುವ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಗಳನ್ನು ಆಯಾ ತಾಲ್ಲೂಕಿನ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು ಮೊದಲ 30 ತಿಂಗಳ ಅವಧಿಗೆ ಮೀಸಲಿರಿಸಿ ಚುನಾವಣೆ ನಡೆಸಿರುತ್ತಾರೆ. ಈಗ ಎರಡನೇ ಅವಧಿಗೆ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸಬೇಕಾಗಿರುತ್ತದೆ.

3) ಪ್ರಸ್ತುತ ಮೇಲೆ ಓದಲಾದ (3) ರ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಂವ್ಯಶಾಇ/03/ಶಾಸನ/2010, ಬೆಂಗಳೂರು ದಿನಾಂಕ: 23-07- 2010 ರಂತೆ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ರ ಪ್ರಕರಣ 44(2)(ಸಿ) ಗೆ ತಿದ್ದುಪಡಿ ತಂದು ಅನುಸೂಚಿತ ಜಾತಿ, ಅನುಸೂಚಿತ ಪಂಗಡ, ಹಿಂದುಳಿದ ವರ್ಗ ಮತ್ತು ಸಾಮಾನ್ಯ ವರ್ಗ ಹೀಗೆ ಪ್ರತಿಯೊಂದು ಪ್ರವರ್ಗಕ್ಕೂ ಮೀಸಲಿಟ್ಟಿರುವ ಹುದ್ದೆಗಳಲ್ಲಿ ಮೂರನೇ ಒಂದರಷ್ಟಕ್ಕೆ ಕಡಿಮೆ ಇಲ್ಲದಷ್ಟು (1/3 ರಷ್ಟು) ಹುದ್ದೆಗಳನ್ನು ಮಹಿಳೆಯರಿಗಾಗಿ ಮೀಸಲಿಡುವ ಬದಲು ಶೇಕಡ 50 ಕ್ಕೆ ಕಡಿಮೆ ಇಲ್ಲದಷ್ಟು ಹುದ್ದೆಗಳನ್ನು ಮಹಿಳೆಯರಿಗಾಗಿ ಮೀಸಲಿಡತಕ್ಕದ್ದು ಎಂದು ಜಾರಿಗೆ ಬಂದಿರುತ್ತದೆ.

4) ಮಾನ್ಯ ಸರ್ವೋಚ್ಛ ನ್ಯಾಯಾಲಯವು ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ: 356/1994 ರಲ್ಲಿ ದಿನಾಂಕ: 11-05-2010 ರಂದು ನೀಡಿರುವ ತೀರ್ಪಿನಂತೆ ಸರ್ಕಾರವು ಮೇಲೆ ಓದಲಾದ (4) ರ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಂವ್ಯಶಾಇ/40/ ಶಾಸನ/2010, ಬೆಂಗಳೂರು ದಿನಾಂಕ: 16-07-2011 ರಂತೆ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್‌ರಾಜ್ ಅಧಿನಿಯಮ 1993 ರ 44ನೇ ಪ್ರಕರಣದ 2ನೇ ಉಪ ಪ್ರಕರಣದ (ಬಿ) ಖಂಡದ ಕೊನೆಯಲ್ಲಿ "ಆದರೆ ಈ ಖಂಡದ ಅಡಿಯಲ್ಲಿ ಹಿಂದುಳಿದ ವರ್ಗಗಳಿಗಾಗಿ ಹಾಗೆ ನಿರ್ಧರಿಸಿ ಮೀಸಲಿರಿಸಿದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಒಟ್ಟು ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಯು, (ಎ) ಖಂಡದ ಅಡಿಯಲ್ಲಿ ಅನುಸೂಚಿತ ಜಾತಿಗಳು ಹಾಗೂ ಅನುಸೂಚಿತ ಪಂಗಡಗಳಿಗಾಗಿ ಮತ್ತು ಈ ಖಂಡದ ಅಡಿಯಲ್ಲಿ ಹಿಂದುಳಿದ ವರ್ಗಗಳಿಗಾಗಿ ಮೀಸಲಿರಿಸಿದ ಸ್ಥಾನಗಳ ಒಟ್ಟು ಸಂಖ್ಯೆಯು ರಾಜ್ಯದಲ್ಲಿ ಆ ಗ್ರಾಮ ಪಂಚಾಯತಿಯ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳ ಒಟ್ಟು ಸಂಖ್ಯೆಯ ಶೇಕಡ ಐವತ್ತನ್ನು ಮೀರತಕ್ಕದ್ದಲ್ಲ" ಎಂಬುದನ್ನು ಸೇರ್ಪಡೆ ಮಾಡಿ ಜಾರಿಗೆ ಬಂದಿರುತ್ತದೆ.

5) ಮೇಲ್ಕಂಡ ತಿದ್ದುಪಡಿ ಅನುಸಾರ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸುವ ಸಂದರ್ಭದಲ್ಲಿ ಒಂದು ವೇಳೆ ಅನುಸೂಚಿತ ಜಾತಿ, ಅನುಸೂಚಿತ ಪಂಗಡ ಮತ್ತು ಹಿಂದುಳಿದ ವರ್ಗದವರಿಗಾಗಿ ಮೀಸಲಿರಿಸಬೇಕಾದ ಹುದ್ದೆಗಳ ಒಟ್ಟು ಸಂಖ್ಯೆಯು ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಒಟ್ಟು ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಯ ಶೇಕಡ 50 ನ್ನು ಮೀರುವ ಸಂದರ್ಭದಲ್ಲಿ ಅನುಸೂಚಿತ ಜಾತಿ ಮತ್ತು ಅನುಸೂಚಿತ ಪಂಗಡಗಳಿಗೆ ನಿಗದಿಪಡಿಸಿದ ಹುದ್ದೆಗಳಲ್ಲಿ ಯಾವುದೇ ಬದಲಾವಣೆ ಮಾಡದೆ ಹಿಂದುಳಿದ ವರ್ಗಕ್ಕೆ ನಿಗದಿಪಡಿಸಿದ ಹುದ್ದೆಗಳಲ್ಲಿ ಕಡಿತಗೊಳಿಸಿ ಒಟ್ಟು ಮೂರು ಪ್ರವರ್ಗದ ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಗಳನ್ನು ಶೇಕಡ 50 ಕ್ಕೆ ಮಿತಿಗೊಳಿಸಬೇಕಾಗುತ್ತದೆ.

6) ಬೆಳಗಾವಿ ಜಿಲ್ಲೆಯ ರಾಯಭಾಗ ತಾಲ್ಲೂಕಿನಲ್ಲಿ ಜಲಾಲಪುರ ಒಂದು ಗ್ರಾಮ ಪಂಚಾಯತಿ ಹೊಸದಾಗಿ ರಚನೆಯಾಗಿರುತ್ತದೆ.

7) ಈ ಮೇಲ್ಕಂಡ ಕಂಡಿಕೆ 3 ರಿಂದ 6 ರಲ್ಲಿ ವಿವರಿಸಿದ ಕಾರಣಗಳಿಂದ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ರ ಪ್ರಕರಣ 44 ರ ಉಪ ಪ್ರಕರಣ (2) ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ರಾಜ್ಯ ಚುನಾವಣಾ ಆಯೋಗವು ಕಂಡಿಕೆ (6) ರಂತೆ ಹೊಸದಾಗಿ ರಚನೆಯಾದ ಒಂದು ಗ್ರಾಮ ಪಂಚಾಯತಿ ಸೇರಿಕೊಂಡಂತೆ ರಾಜ್ಯದ ಒಟ್ಟು 5628 ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ತಾಲ್ಲೂಕುವಾರು ವರ್ಗವಾರು ಎರಡನೇ ಅವಧಿಯ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಗಳನ್ನು ನಿರ್ದಿಷ್ಟಪಡಿಸಿ ಈ ಕೆಳಗಿನಂತೆ ಆದೇಶ ಹೊರಡಿಸಿದೆ.

ಮೇಲೆ ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿದ ಕಾರಣಗಳಿಂದ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ಪ್ರಕರಣ 44ರ ಉಪಪ್ರಕರಣ (2) ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ರಾಜ್ಯ ಚುನಾವಣಾ ಆಯೋಗವು ಪ್ರಸ್ತುತ ರಾಜ್ಯದಲ್ಲಿ ಇರುವ 5628 ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಅನುಸೂಚಿತ ಜಾತಿ, ಅನುಸೂಚಿತ ಪಂಗಡ, ಹಿಂದುಳಿದ ವರ್ಗ (ಅ), ಹಿಂದುಳಿದ (ಬ) ಮತ್ತು ಸಾಮಾನ್ಯ ವರ್ಗಗಳಿಗೆ ಹಾಗೂ ಈ ಪ್ರವರ್ಗಗಳಲ್ಲಿ ಮಹಿಳೆಯರಿಗೆ ಮೀಸಲಿರಿಸಿದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಈ ಆದೇಶಕ್ಕೆ ಲಗತ್ತಿಸಿರುವ ಅನುಬಂಧದಲ್ಲಿ ನಮೂದಿಸಿದಂತೆ ರಾಜ್ಯದಲ್ಲಿರುವ ಎಲ್ಲಾ ತಾಲ್ಲೂಕುಗಳಿಗೆ ನಿರ್ದಿಷ್ಟಪಡಿಸಲಾಗಿದೆ. ಅನುಸೂಚಿತ ಜಾತಿ ಮತ್ತು ಅನುಸೂಚಿತ ಪಂಗಡಗಳ ಹುದ್ದೆಗಳನ್ನು ಆಯಾಯ ತಾಲ್ಲೂಕಿನ ಜನಸಂಖ್ಯೆಯ ಆಧಾರದ ಮೇಲೆ ನಿಗದಿಪಡಿಸಿದೆ.

2) ಆಯಾ ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು ತಾಲ್ಲೂಕುವಾರು ವಿವಿಧ ವರ್ಗಗಳಿಗೆ ಮತ್ತು ಮಹಿಳೆಯರಿಗೆ ಹಾಗೂ ಸಾಮಾನ್ಯ ವರ್ಗಕ್ಕೆ ನಿಗದಿಪಡಿಸಲಾಗಿರುವ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಈ ಕೆಳಗೆ ವಿವರಿಸಿರುವ ಪ್ರಕಾರ ತಾಲ್ಲೂಕಿನ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು.

3) ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಅನುಸೂಚಿತ ಜಾತಿ, ಅನುಸೂಚಿತ ಪಂಗಡ, ಹಿಂದುಳಿದ ವರ್ಗ (ಅ) ಹಿಂದುಳಿದ ವರ್ಗ (ಬ), ಸಾಮಾನ್ಯ (ಮಹಿಳೆ) ಮತ್ತು ಸಾಮಾನ್ಯ ಈ ಕ್ರಮದಲ್ಲಿಯೇ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು. ಅಂದರೆ ಮೊದಲು ಅನುಸೂಚಿತ ಜಾತಿ ಅಧ್ಯಕ್ಷ ಹುದ್ದೆಯನ್ನು ಪಡೆಯುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ನಿಗದಿಪಡಿಸಿದ ನಂತರ ಅನುಸೂಚಿತ ಪಂಗಡ ಅಧ್ಯಕ್ಷ ಹುದ್ದೆ, ಹಿಂದುಳಿದ ವರ್ಗ (ಅ) ಅಧ್ಯಕ್ಷ ಹುದ್ದೆ, ಹಿಂದುಳಿದ ವರ್ಗ (ಬ) ಅಧ್ಯಕ್ಷ ಹುದ್ದೆ ಹೀಗೆ ಒಂದಾದ ನಂತರ ಒಂದನ್ನು ತಾಲ್ಲೂಕಿನಲ್ಲಿರುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು. ಉಪಾಧ್ಯಕ್ಷರ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸುವಾಗಲೂ ಮೇಲೆ ವಿವರಿಸಿದ ಕ್ರಮವನ್ನೇ ಅನುಸರಿಸತಕ್ಕದ್ದು.

4) ಅನುಸೂಚಿತ ಜಾತಿ ಅಧ್ಯಕ್ಷ ಹುದ್ದೆಯನ್ನು ನಿಗದಿಪಡಿಸುವಾಗ ಆ ಜನಾಂಗದ ಸದಸ್ಯರುಗಳ ಸಂಖ್ಯೆ ಅತ್ಯಂತ ಹೆಚ್ಚು ಇರುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಯನ್ನು ಗುರುತಿಸಿ ಆ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಅನುಸೂಚಿತ ಜಾತಿ ಅಧ್ಯಕ್ಷರ ಹುದ್ದೆಯನ್ನು ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು. ಹೀಗೆ ಮಾಡುವಾಗ ತಾಲ್ಲೂಕಿನ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಲ್ಲಿ ಅನುಸೂಚಿತ ಜಾತಿ ಸದಸ್ಯ ಸ್ಥಾನಗಳ ಆಧಾರದ ಮೇಲೆ ಅವರೋಹ ಕ್ರಮದಲ್ಲಿ (Descending Order) ಗ್ರಾಮ ಪಂಚಾಯತಿಯನ್ನು/ ಗಳನ್ನು ಬರೆದುಕೊಂಡು ನಂತರ ನಿರ್ಧರಿಸತಕ್ಕದ್ದು. ಈ ರೀತಿ ಮಾಡುವಾಗ ಸರದಿಯಂತೆ (ರೊಟೇಷನ್) ಅಂದರೆ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ಪ್ರಕರಣ 44 ರ ವಿವರಣೆಯಂತೆ "ಈ ಪ್ರಕರಣದಡಿಯಲ್ಲಿ ಹುದ್ದೆಯ ಮೀಸಲಾತಿಯ ಸರದಿ ಸೂತ್ರವು 1993 ರ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮವು ಪ್ರಾರಂಭವಾದ ನಂತರ ನಡೆಸುವ ಪ್ರಥಮ ಚುನಾವಣೆಯಿಂದ ಪ್ರಾರಂಭವಾಗತಕ್ಕದ್ದೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ". ಅದರಂತೆ ಕ್ರಮವಹಿಸಿ ಅನುಸೂಚಿತ ಜಾತಿ ಅಧ್ಯಕ್ಷ ಹುದ್ದೆಯನ್ನು ಮೀಸಲಿರಿಸಲಾಗಿದ್ದ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ಹೊರತುಪಡಿಸತಕ್ಕದ್ದು. ಅನುಸೂಚಿತ ಜಾತಿಗೆ ಮೀಸಲಿರಿಸಲಾದ ಉಪಾಧ್ಯಕ್ಷರುಗಳ ಹುದ್ದೆಯನ್ನು ನಿಗದಿಪಡಿಸುವಾಗಲೂ ಇದೇ ಕ್ರಮವನ್ನು ಅನುಸರಿಸತಕ್ಕದ್ದು. ಅನುಸೂಚಿತ ಪಂಗಡದ ಅಧ್ಯಕ್ಷ / ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಇದೇ ಕ್ರಮವನ್ನು ಅನುಸರಿಸಿ ಮೀಸಲಿರಿಸತಕ್ಕದ್ದು.

5) ಹಿಂದುಳಿದ ವರ್ಗ (ಅ) ಮತ್ತು ಹಿಂದುಳಿದ ವರ್ಗ (ಬ) ಪ್ರವರ್ಗಗಳಿಗೆ ಮೀಸಲಿರಿಸಲಾದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಈ ಪ್ರವರ್ಗದ ಅತಿ ಹೆಚ್ಚು ಸದಸ್ಯ ಸಂಖ್ಯೆಯಿರುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಕಂಡಿಕೆ 4ರಲ್ಲಿ ಸೂಚಿಸಿರುವ ಕ್ರಮವನ್ನು ಅನುಸರಿಸಿ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು.

6) ಮೀಸಲಿರಿಸಿದ ಪ್ರವರ್ಗಗಳ ಮಹಿಳಾ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಯನ್ನು ನಿಗದಿಪಡಿಸುವಾಗ ಮೊದಲು ಆ ಪ್ರವರ್ಗಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಯನ್ನು ಪಡೆಯುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ಗುರುತಿಸಿ ಅವುಗಳನ್ನು ಮೀಸಲಿರಿಸಿದ ಆ ಪ್ರವರ್ಗಕ್ಕೆ ಸೇರಿದ ಮಹಿಳಾ ಸದಸ್ಯ ಸಂಖ್ಯೆಗೆ ಅನುಗುಣವಾಗಿ ಅವರೋಹ ಕ್ರಮದಲ್ಲಿ (Descending Order) ಬರೆದುಕೊಂಡು ನಂತರ ಅಂತಹ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಲ್ಲಿ ಆ ಮಹಿಳಾ ಸದಸ್ಯ ಸಂಖ್ಯೆಯನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಂಡು ಅತಿ ಹೆಚ್ಚು ಮಹಿಳಾ ಸದಸ್ಯರಿರುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಮಹಿಳಾ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು. ಹೀಗೆ ಮಾಡುವಾಗ ಸಾಧ್ಯವಾದಷ್ಟು ಮಟ್ಟಿಗೆ ಹಿಂದಿನ ಅವಧಿಯಲ್ಲಿ ಮಹಿಳಾ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಪಡೆದಿದ್ದ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ಹೊರತುಪಡಿಸತಕ್ಕದ್ದು.

7) ಸಾಮಾನ್ಯ (ಮಹಿಳೆ) ವರ್ಗಕ್ಕೆ ಮೀಸಲಿರಿಸಲಾದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಆ ವರ್ಗದ ಅತಿ ಹೆಚ್ಚು ಸದಸ್ಯ ಸಂಖ್ಯೆಯಿರುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ಗುರುತಿಸಿ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು. ಹೀಗೆ ನಿಗದಿಪಡಿಸುವಾಗ ಸಾಧ್ಯವಾದಷ್ಟು ಮಟ್ಟಿಗೆ ಹಿಂದಿನ ಅವಧಿ / ಅವಧಿಗಳಲ್ಲಿ ಈ ವರ್ಗಕ್ಕೆ ಮೀಸಲಿರಿಸಲಾದ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ಹೊರತುಪಡಿಸತಕ್ಕದ್ದು.

8) ಯಾವುದೇ ಮೀಸಲಿರಿಸಿದ ವರ್ಗದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸುವಾಗ ಒಂದು ವೇಳೆ ಸದಸ್ಯರ ಸಂಖ್ಯೆಗಳು ಸಮವಾಗಿರುವ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳು ಹಲವು ಇದ್ದು ಮೀಸಲಿರಿಸಬೇಕಾದ ಹುದ್ದೆಗಳು ಇಂತಹ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಸಂಖ್ಯೆಗಿಂತ ಕಡಿಮೆಯಿದ್ದಲ್ಲಿ ಅಂತಹ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿಯನ್ನು ಸಂಬಂಧಪಟ್ಟ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಚುನಾಯಿತ ಸದಸ್ಯರುಗಳ ಸಮ್ಮುಖದಲ್ಲಿ ಆದೇಶ ಸಂಖ್ಯೆ: ರಾಚುಆ.155.ಇಜಿಪಿ.2010 ದಿನಾಂಕ: 14-05-2010 ರನ್ವಯ ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು ಲಾಟರಿ ಎತ್ತುವ ಮೂಲಕ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು.

9) ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸುವಾಗ ಒಂದೇ ಗ್ರಾಮ ಪಂಚಾಯತಿಯಲ್ಲಿ ಈ ಕೆಳಕಂಡ ವರ್ಗಗಳನ್ನು ಏಕ ಕಾಲದಲ್ಲಿ ಸಾಧ್ಯವಾದಷ್ಟು ಮಟ್ಟಿಗೆ ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದಲ್ಲ.

10) ತಾಲ್ಲೂಕುವಾರು ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸುವಾಗ ಮೊದಲು ಎಲ್ಲಾ ಅಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ನಿಗದಿಪಡಿಸಿ ನಂತರ ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಯನ್ನು ನಿಗದಿಪಡಿಸತಕ್ಕದ್ದು.

11) ಆಯೋಗವು ರಾಜ್ಯದಲ್ಲಿ ಅಸ್ತಿತ್ವದಲ್ಲಿರುವ 5628 ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಂಡು ತಾಲ್ಲೂಕುವಾರು, ವರ್ಗವಾರು ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆಗಳನ್ನು ಅನುಬಂಧದಲ್ಲಿ ನಿಗದಿಪಡಿಸಿದೆ. ಆದ್ದರಿಂದ ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು ತಾಲ್ಲೂಕಿನಲ್ಲಿರುವ ಎಲ್ಲಾ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳನ್ನು (ಚುನಾವಣೆ ನಡೆದಿರುವ ಮತ್ತು ಅವಧಿ ಮುಗಿಯದ) ಗಣನೆಗೆ ತೆಗೆದುಕೊಂಡು ಆಯೋಗವು ವರ್ಗವಾರು ನಿಗದಿಪಡಿಸಿರುವ ಎಲ್ಲಾ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳನ್ನು ಹಂಚಿಕೆ ಮಾಡಲು ಕ್ರಮ ಕೈಗೊಳ್ಳತಕ್ಕದ್ದು.

12) ಈ ಆದೇಶದ ರೀತ್ಯಾ ಬೆಳಗಾಂ ಜಿಲ್ಲೆಯ ರಾಯಭಾಗ ತಾಲ್ಲೂಕಿನಲ್ಲಿ ಹೊಸದಾಗಿ ರಚನೆಗೊಂಡ ಜಲಾಲಪುರ ಗ್ರಾಮ ಪಂಚಾಯತಿಗೆ ನಿಗದಿಪಡಿಸಿದ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಯ ಮೀಸಲಾತಿಯು ಮೊದಲನೇ ಅವಧಿಯದಾಗಿರುತ್ತದೆ.

13) ರಾಜ್ಯದಲ್ಲಿ ಇನ್ನು ಮುಂದೆ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮದ ಪ್ರಕರಣ 4ರನ್ವಯ ಹೊಸದಾಗಿ ರಚಿತವಾಗುವ ಯಾವುದೇ ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳಿಗೆ ಅಧ್ಯಕ್ಷ ಮತ್ತು ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳ ಮೀಸಲಾತಿಯನ್ನು ರಾಜ್ಯ ಚುನಾವಣಾ ಆಯೋಗದ ಪೂರ್ವಾನುಮತಿಯನ್ನು ಪಡೆದು ನಿರ್ಧರಿಸತಕ್ಕದ್ದು.

THE KARNATAKA MOTOR VEHICLES TAXATION (AMENDMENT) ORDINANCE, 2012

An Ordinance further to amend the Karnataka Motor Vehicles Taxation (Second Amendment) Act, 2012.

Whereas both the Houses of the state legislature are not in session and His Excellency the Governor of Karnataka is satisfied that the circumstances exist which render it necessary for him to take immediate action, further to amend the Karnataka Motor Vehicles Taxation (Second Amendment) Act, 2012 (Karnataka Act 29 of 2012) for the purposes hereinafter appearing;

Now, therefore in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, His Excellency the Governor of Karnataka is pleased to promulgate the following Ordinance, namely:-

1. Short title and commencement.- (1) This Ordinance may be called the Karnataka Motor Vehicles Taxation (Amendment) Ordinance, 2012.

(2) It shall be deemed to have come into force with effect from First day of April, 2012.

2. Amendment of Section 5.- In the Karnataka Motor Vehicles Taxation (Second Amendment) Act, 2012 (Karnataka Act 29 of 2012) in section 5, clause (c) shall be omitted.

In exercise of the powers conferred by Section 19A of the Karnataka State Highways Act, 1964 (Karnataka Act 44 of 1964) and in supersession of the Karnataka Private Investment Project (Road toll or user fee determination of rates and collection notification-2009 and subsequent amendment there upon, the State Government hereby make notified rate of Toll to be determined and collected as Toll or user fee for using a section of Wagdhari (from Maharastra Border) - Ribbanapalli (to Andhra Pradesh Border) State Highway-10 developed under "Public Private Partnership – BOT – VGF (Toll) ", namely: -

1. Short title and commencement :

1.1 This Notification may be called the Karnataka Public Private Partnership Project - Wagdhari - Ribbanapalli State Highway 10 - Collection of Road Toll or user Fee determination of Rate and Collection Notification - 2012

1.2 This Notification shall come into force from the date of it's publication in the Official Gazette.

2. Definitions :

2.1 In this Notification, unless the context otherwise requires:-

(a) "Act" means the State Highway Act 1964; (Karnataka Act 44 of 1964);

(b) "Notification" means a notification published in the official Gazette;

(c) "Government" means the PWP & IWTD, Government of Karnataka;

(d) "KRDCL" means Karnataka Road Development Corporation;

(e) "Base Year" means the period from 01-04-2009 to 31-03-2010;

(f) "Financial Year" means the year commencing on the 1st day of April of a year and ending on 31st day of March of the succeeding year;

(g) Executing Authority" means an officer or authority notified by the State Government Act; (h) "Concession agreement" means an agreement entered into between the GOVERNMENT / KRDCL and any person or persons for construction, operation and/or maintenance of a Project Road, bypass and/or bridge at its cost and expense;

(i) "Concessionaire" means a person who has entered into a concession agreement with the GOVERNMENT / KRDCL;

(j) "Project Road" or "Highway" shall mean any road, bypass and/or bridge that is constructed, operated and/or maintained under a concession agreement;

(k) "Lane" means a lane forming part of the main carriageway and having a minimum width of 3.5 m (three meters and fifty centimeters);

(l) "Bridge" means and includes any bridge, road overbridge or underbridge which is constructed, operated and/or maintained under a concession agreement;

(m) "road over bridge / under bridge" or "ROB/RUB" means and includes a road over bridge/under bridge that crosses above/under a railway track and which is constructed, operated or maintained under a concession agreement;

(n) "Bypass" means and includes a bypass on a Project Road which is constructed, operated or maintained under a concession agreement;

(o) "Mechanical Vehicle" means any vehicle driven under its power including a motor vehicle as defined under the Motor Vehicle Act, 1988 (59 of 1988);

(p) "Gross Vehicle Weight" in respect of any vehicle means the total weight of the vehicle and load certified and registered by the registering authority as permissible for that vehicle under the Motor Vehicles Act, 1988;

(q) "Private investment project" means a project relating to section of State highway, ferment bridge, bypass and/or tunnel as the case may be, for which an agreement is entered into with a concessionaire who has invested in the project;

(r) "Public fund project" means a project which is not a private investment project, as defined in Para (q) above and includes a private investment project in respect of which the agreement has expired;

(s) "Toll" means the toll charge per kilometer or meter, as the case may be, payable by the user of a Project Road, bypass, bridge or road over bridge / under bridge under this Notification;

(t) "Toll Plaza" means any building, structure or booth made for collection of Fee; and

(u) "WPI" means the Wholesale Price Index as published by the Ministry of Industry, Government of India.

2.2 Words and expressions used herein and not defined in the State Highway Act,1964 shall have the meaning respectively assigned to them in the Act.

3. Levy and collection of toll :

There shall be levied and paid to the concessionaire a toll for every vehicle using a Project Road, bypass, bridge, ROB and RUB, as the case may be, which is constructed, operated or maintained by such concessionaire.

4. Base rate of Fee :

4.1 Base rate of Fee for use of section of the SH, stand alone bridge, bypass or tunnel constructed through public funded project or private investment project shall be as specified in Column (3) below:

4.2 The rate of Fee for use of a section of SH of two or more lane shall, for the base year 2012-13, be the product of the length of such section multiplied by the following rates, namely:-

For the purpose of this Para refer to the latest Notifications of the Department of Road Transport and Highway.

(a) "Car or Jeep or Van or omni bus" or "light motor vehicles" means any mechanical vehicle the gross vehicle weight of which does not exceeding 7.50 tonnes (seven thousand five hundred kilograms), or the registered passenger carrying capability as specified in the certificate of registration issued under the Motor Vehicle Act, 1988 does not exceed 12 (twelve) excluding the driver, but does not include a three-wheeled motor vehicle, motor cycle, tractor or tractor with trailer;

(b) "Tractor" means a motor vehicle which is not itself constructed to carry any load other than the equipment used for the purpose of propulsion, but does not include a road roller;

(c) "Light Commercial Vehicle" or "Light Goods Vehicle" or "mini bus" means any mechanical vehicle with a gross vehicle weight exceeding 7.50 tonnes (seven thousand five hundred kilograms) but less than 12.00 tonnes ( twelve thousand kilograms) or the registered passenger carrying capability as specified in the certificate of registration issued under the Motor Vehicle Act, 1988 does not exceed 32 (thirty two) excluding the driver,

(d) "Commercial Vehicle – Bus or Truck with two axles" means any mechanical vehicle having two axles with a gross vehicle weight exceeding 12.00 tonnes (twelve thousand kilograms) but less than 20.00 tonnes (twenty thousand kilograms ) or the registered passenger carrying capability as specified in the certificate of registration issued under the Motor Vehicle Act, 1988 does not exceed 56 (fifty six) excluding the driver, and includes a road roller;

(e) "Heavy Construction Machinery" or Earth Moving Equipments" or " multi axle vehicles" means Heavy Construction Machinery or Earth Moving Equipments or any mechanical vehicle including a multi axle vehicles with three to six axles or vehicle a gross vehicle weight exceeding 20.00 tonnes (twenty thousand kilograms) but less than 60.00 tonnes (sixty thousand kilograms) and includes a truck with three to six axles and earth moving equipment;

(f) "oversized vehicle" means any mechanical vehicle having seven or more axles or vehicle with a gross vehicle weight exceeding 60.00 tonnes (sixty thousand kilograms) ;

(g) "local traffic" means the traffic on account of commuting by a private car between a rural area and its nearest city or town by means of the Project Road; provided (i) such private car is owned by a person who resides in such rural area, (ii) such rural area is situated within a distance of 10 (ten) km from the toll plaza, and (iii) such rural area has no alternative road connecting such city or town. For the avoidance of doubt, a road that connects such rural area to its nearest city or town shall not be deemed to be an alternative road for purposes hereof if it increases the travel distance by more than 20% (twenty per cent) of the corresponding distance on the Project Road;

(h) "Local Commercial Traffic" means the traffic on account of commuting by a car, LCV, bus or truck, as the case may be, between the toll plaza and any point situated within 20 (twenty) kilometers on either side of the toll plaza but does not include local traffic;

5. Annual revision of Rate of Fee :

5.1 The basic toll rates referred to in Para 4 shall be increased annually by 3% (three percent) thereof for a period of 15 (fifteen) successive years commencing from April 1, 2010. The first increase of 3 % (three percent) hereunder shall take effect on April 1, 2010, and the last and fifteenth such increase shall be effected on April 1, 2024.

Illustration:

For a Project Road that is commissioned on April 1, 2009 the basic toll rate shall be Rs.0.580 per car per km and for the following years it is computed as follows:

2010-11 0.58 0+ 0.58X3% = 0.5974

2011-12 0.597 + 0.59X3% = 0.6148

2012-13 0.614 + 0.614X3% = 0.6322

5.2 In addition to the annual revision effected under Para 5 (1), the applicable basic toll rates shall be adjusted and revised annually on April 1 of each year to reflect the variation in WPI occurring between January 1, 2009 and January 1 of the year in which such revision is undertaken. The revision for this Project shall be undertaken as follows:

(a) On the 1st April immediately preceding the completion of the Project the "date of revision", the basic toll rates, as applicable under Para 5(1) shall be adjusted and revised for the Project to reflect the variation in WPI occurring between January 1, 2009 and January 1 immediately preceding the date of revision hereunder. The formula for determining the basic toll charge payable by a user of the Project shall be as follows:

Where,

Basic toll rate is the applicable basic toll rate on the date of revision specified in this sub-Para (a); WPI*A is the WPI on January 1 immediately preceding the date of revision specified in this sub-Para; and WPI*B is the WPI as on January 1, 2009

Illustration :-

For a Project Road that is commissioned on April 1, 2009, the toll charge shall, assuming an inflation of 5% (five percent) annually between January I, 2012 and January 1, 2009, be the product of the basic toll rate as on April 1, 2012 i.e. Rs. 0.632 and inflation of 5% (five percent) for preceding 3 years. Thus, the toll charge per car per km as on April 1, 2012 shall be as follows.

0.632 X (1.05) ^3 = 0.732

(b) For the period subsequent to the date of revision under sub-rule 5(a) above, the annual revision on account of inflation shall be restricted to 40 percent (forty per cent) of the rate of inflation occurring after the revision under sub-rule 5(a) above and such revision shall be effected on April 1 every year. The formula for determining the toll charge under this sub-rule 5(b) shall be as follows:

b is the Basic toll charge determined for the respective Project Road, bypass, bridge, ROB or RUB, as the case maybe, as per sub-rule (a) above;

c is the Basic toll rate as on April 1 of the year of revision;

d is the Basic toll rate that formed part of the basic toll charge computed under sub-rule 5(a) above;

WPI*C is the WPI as on January 1 of the year of revision; and WPI*A is the WPI computed as such under sub- rule 5(a) above.

Annual revision of rate of fee under this rule shall be effective from first of April every year.

(c) In the event that a concession agreement stipulates two distinct phases of construction and the second phase thereof includes (i) construction of a bypass, and/ or (ii) widening of the carriageway of Project Road by 6 (six) metres or more (the "augmentation"), the toll charges to be levied and collected for such second phase shall be determined as follows:

(i) Upon completion of augmentation and commissioning thereof for use of traffic, the toll charges shall be determined in accordance with the formula specified in sub-Para 5(a) above as if the date of revision thereunder is the 1st April that immediately precedes the date of such commissioning.

(ii) Subsequent annual revisions hereunder shall be determined in accordance with sub-Para 5.2(b) as if the Basic Toll Charge thereunder is the amount determined under sub-Para 5.2(c)(i) hereinabove.

5.3 Notwithstanding anything to the contrary contained herein, if revision of toll charges shall fall due before completion of 6 (six) months from the date on which such toll charges were levied and collected, such revision shall be kept in abeyance until the completion of the aforesaid 6 (six) months.

6. Combined toll Fee collection for Project Roads and bridges :

Notwithstanding anything to the contrary contained in Para 4 and 5, where any bridge, bypass, ROB or RUB, as the case may be, forms part of a Project Road on which toll charges are being levied and collected pursuant hereto, the applicable toll charges for such bridge, bypass, ROB or RUB shall be reduced by 20 percent (twenty per cent) and added to the toll charges levied and collected for such Project Road. A similar reduction shall be effected where a bridge, ROB or RUB, as the case may be, forms part of a bypass: Provided, however, that no minimum toll charges shall be levied on a bridge, ROB or RUB that is combined with a Project Road or bypass hereunder.

7. Peak and off-peak toll Fee :

7.1 Every concessionaire may, at any time April 1, 2010, but after obtaining prior written approval of the GOVERNMENT / KRDCL, which approval the GOVERNMENT / KRDCL may in its discretion deny, levy and collect a higher and discounted toll charge (the "differential toll charge") for use of the Project Road, bypass, bridge, ROB or RUB, as the case may be, during peak and off-peak hours respectively in accordance with this Para.

Provided, however, that such differential toll charge shall not apply to local traffic and to frequent users availing of a lower toll charge under Para 11 &12.

7.2 Each such concessionaire shall for this purpose designate not more than six hours in a day as peak hours and a period equal to twice the peak hours as off-peak hours. During peak hours, a concessionaire may levy and collect a premium of upto 25 % (twenty-five percent) on the applicable Toll Charges or such higher premium as the State GOVERNMENT / KRDCL may by order permit. Simultaneously, with levy of such premium for peak hours, such concessionaire shall offer a discount during off-peak hours at a rate equal to twice the premium for peak hours. For the avoidance of doubt, the determination of differential fee shall be with reference to the time of entry of a user at the toll plaza of the Project Road or the bridge, as the case may be.

7.3 If the determination and collection of differential toll charges results in an increase in the toll revenues of the concessionaire, then 80 % (eighty per cent) of the additional revenue in each year resulting from the differential toll charges shall be deposited in a separate fund to be specified by the GOVERNMENT / KRDCL and deployed for providing such additional facilities for users of the Project Road, bypass, bridge, ROB or RUB, as the case may be, as the GOVERNMENT / KRDCL may specify under the respective concession agreement. For the purposes of this Sub Para 7.3, additional revenue from differential toll charges shall mean the gross amount collected at differential toll charges pursuant to this Para 7, less gross revenues which would have been collected at the applicable toll charges on footing that the option to levy and collect differential toll charges pursuant to this Para 7 has not been exercised by the concessionaire.

8. Toll collection points (toll plazas) :

8.1 For collection of toll charges under these Para, the concessionaire shall establish and operate toll collection points (the "toll plazas") in accordance with the provisions of the respective concession agreement:

Provided, however, that the distance between two toll plazas located in the same direction on a Project Road, not being a toll plaza on a bypass, bridge, ROB or RUB, shall not be less than 40 (forty) Km:

Provided further that a toll plaza set up for collection of toll charges on a Project Road shall, as far as possible, be located beyond 10 (ten) km, from the municipal boundaries of a city or town situated on such Project Road.

8.2 The concessionaire may in its discretion set up additional toll collection points and entry barriers on the Project Road for the purpose of checking vehicles that may be using approach roads to the Project Road for evasion of toll charges payable under these Para:

Provided that no such additional toll collection points or entry barriers shall be set up beyond a distance of about 10 (ten) km on either side of a toll plaza.

9. Exempted Vehicles

The following categories of vehicle shall be exempted from payment of Toll Charges:-

(a) All vehicles belonging to the Government of India, Government of Karnataka, and Government of Karnataka under takings including Private Vehicles engaged on Government duty with valid pass (Yellow Board Vehicles).

(b) Official vehicles transporting and accompanying the President of India, Vice President of India, Prime Minister of India, Chief Justice of the Supreme Court, Union Ministers, Governors, Lt. Governors, Chief Ministers, Presiding Officers and Leaders of Opposition of the Central and the State legislatures, Judges of the Supreme Court, Chief Justices of the High Courts, Ministers of the State Government, Judges of the Supreme Court and High Court, Hon'ble Member of Parliament and Member of Legislative Assembly having jurisdiction and foreign dignitaries on state visit;

(c) Official vehicles of Central and State armed forces in uniform including Para-military forces and police, and of Executive Magistrates.

(d) All vehicles belonging to Defense department, Government of India.

(e) Ambulances, fire tenders and Hearse (funeral) vans;

(f) The awardee of prestigious International/ National awards, if a such awardee produces his/her photo identity card duly authorised by the authorized by the appropriate or competent authority for such award.

(g) Vehicles belonging to the Indian Posts and Telegraph Department.

(h) Tractor-Trolleys used for agriculture purpose and bullock carts.

(i) Auto Rickshaws, Two Wheeler and Horse driven carts.

(j) Vehicles of persons using the highway for inspection, survey, construction, or operation and maintenance thereof.

* Note: The driver of the vehicle/van so exempted from payment of toll shall state his name and name of duty on which he is engaged.

10. Exemption for Local Traffic

10.1 No toll charges shall be levied or collected from a vehicle that uses part of the Project Road and does not cross a toll plaza.

10.2 Local traffic shall be entitled to ply on the Project Road, bypass or bridge, as the case may be, and cross the toll plaza on production of a monthly pass to be issued by the concessionaire on payment of a monthly fee of Rs. 100 (Rs. one hundred only); provided that the monthly fee shall be revised annually to reflect the variation in WPI as compared to January 1, 2007 and then rounded off to the nearest ten rupees.

10.3 The concessionaire shall issue a monthly pass for local traffic on written request to be made by a local user and accompanied by (a) proof of residence such as a certificate from the Tahsildhar/ NaibTahsildhar / Block Development and Panchayat Officer or a ration card or voter identification card, and (b) the registration papers of the personal car for which such pass is required. Only a car registered in the name of the local user and bearing the address as specified in the aforesaid proof of residence shall be eligible for a monthly pass.

Upon presentation of the proof of residence and the registration papers, the concessionaire shall retain a photocopy thereof and return the original documents forthwith.

10.4 Notwithstanding anything contained in these Para, in the event of construction of service lanes for free use by local traffic, motorcycles and tractors, such traffic/ vehicles shall be liable to pay toll for use of the main carriageway.

11. Discounted rates for local commercial traffic :

Local commercial traffic shall be entitled to ply on the Project Road, bypass or bridge, as the case may be, and cross the toll plaza on production of a monthly pass to be issued by the concessionaire on payment of a monthly fee equal to 30 (thirty) one-way trips per calendar month for the respective vehicle calculated as if the length of the Project Road were equal to the distance between the originating point of the Project Road before the toll plaza and the point 20 (twenty) kilometers from the toll plaza.

12. Discounted rates for frequent users :

12.1 A frequent user, who shall purchase coupons / tickets for 50 (fifty) or more one-way trips to be undertaken by the same vehicle within the calendar month of the date of such purchase, shall be entitled to a discount of 33.3 percent (thirty three point three per cent) i.e. one-third on the toll charges payable for such vehicle.

12.2 Upon request from any person, the concessionaire shall issue a return coupon / ticket on payment of a sum equal to 150 percent (one hundred and fifty per cent) of the toll charges payable for the respective vehicle if it were to undertake a single one-way trip on the Project Road, bypass, bridge or ROB/RUB, as the case may be.

Such return pass shall entitle the specified vehicle to undertake a return journey on the same day as the outward journey.

13. Additional charge for evasion of toll charges :

The concessionaire shall be entitled to levy and collect an additional sum equal to the applicable toll charges form a person found to be evading payment thereof. Such additional sum shall be deemed to be predetermined liquidated damages for attempt to make unauthorized use of a Project Road, bypass, bridge or ROB/RUB, as the case may be, without payment of toll charges due and payable under this Notification.

14. Additional toll charges for overloading :

14.1 Without prejudice to the liability of the vehicle owner / operator under any law for the time being in force, the concessionaire shall be entitled to levy an additional toll charge (the "additional toll charge") on overloaded vehicles which have used whole or part of the Project Road. Such additional toll charge shall not exceed 50% (fifty per cent) of the applicable toll charges in case the overloading is between 10% (ten percent) and 20%4183 (twenty percent) of the permissible load of the vehicle. The additional toll charge for overloading beyond such 20% (twenty percent) shall not exceed 100% (one hundred percent) of the applicable toll charges.

14.2 The additional toll charge levied hereunder shall be deemed to be a toll within the meaning of this Notification;

provided that payment of such charge will not be deemed to compound the offence of overloading; provided further that upon detection of overloading, the concessionaire shall prevent the vehicle from using the Project Road, until the excess load has been removed from the vehicle.

14.3 The weight of a vehicle as recorded at a weighbridge installed at the toll plaza shall be the basis for levying the additional toll charge under this Para

Provided, however, where no weighbridge has been installed at the toll plaza, no additional toll charge on over loaded vehicles shall be levied and collected.

15. Rounding off of toll charges :

Toll charges to be collected from each vehicle under this Notification shall be rounded off to the nearest Five Rupees.

16. Commencement of tolling :

Levy and collection of toll shall commence upon completion/ provisional completion of construction of the Project Road, bypass, bridge or ROB/RUB, as the case may be, in accordance with the provisions of the respective concession agreement.

17. Display of toll charges :

17.1 The concessionaire shall, near the entry point of the Project Road or bypass, as the case may be, and near the toll plaza, prominently display the applicable toll charges for information of users approaching from either side of the Project Road, bypass, bridge or ROB/RUB, as the case may be.

17.2 The concessionaire shall from time to time, by written notice, inform GOVERNMENT / KRDCL of the applicable toll charges and the detailed calculation thereof. Such information shall be communicated at least 30 days prior to the date of levy of toll charges or revision thereof, as they case may be.

18. Unauthorised collection :

18.1 In the event that a concessionaire collects from any person a sum of money not due and payable hereunder, the concessionaire shall be liable to refund to such person forthwith the amount so collected along with a sum computed @ 3% (three per cent) of the amount so collected, for each day from the date of collection till the date of refund, by way of damages. In the event that such amount together with damages computed in the manner as aforesaid is not paid to such person for any reason whatsoever, the same shall be deposited with the GOVERNMENT / KRDCL within a period of 15 (fifteen) days from the date of such collection.

18.2 Any dispute relating to amounts payable by the concessionaire under Para 18(1) shall be settled by the Executive Engineer KRDCL having jurisdiction over the Project Road, bypass, bridge, ROB or RUB, as the case may be, by an order in writing and appeal, if any, against such order shall lie with the Superintending Engineer KRDCL having jurisdiction over the Project Road, bypass, bridge, ROB or RUB, as the case may be.

18.3 Any person aggrieved in connection with the collection of toll may lodge a complaint to the Executive Engineer having jurisdiction over the Project Road, bypass, bridge, ROB or RUB, as the case may be. The Executive Engineer KRDCL shall pass orders on such complaint within a period of 15 (fifteen) days and appeal, if any, against such order shall lie with the Superintending Engineer KRDCL having jurisdiction over the Project Road, bypass, bridge, ROB or RUB, as the case may be.

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966 (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 1966) (ಈ ಮುಂದೆ ಪ್ರಸ್ತುತ ಕಾಯ್ದೆ ಎಂದು ಹೇಳಲಾಗಿದೆ) ಕಲಂ 28(1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದಡಿ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ : ಸಿಐ 574 ಎಸ್‌ಪಿಕ್ಯೂ 2009 ದಿನಾಂಕ: 16-01-2010 (ಈ ಮುಂದೆ ಅಧಿಸೂಚನೆ ಎಂದು ಹೇಳಲಾಗಿದೆ) ರಂದು ಹೊರಡಿಸಿ ದಿನಾಂಕ : 16-01-2010 ರಂದು ಪ್ರಕಟವಾದ ರಾಜ್ಯ ಪತ್ರದ ಪುಟ 1 ರಿಂದ 163 ರವರೆಗೆ (ಭಾಗ-3) ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸರಕಾರವು ಪ್ರಸ್ತುತ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಕೈಗಾರಿಕಾ ಅಭಿವೃದ್ಧಿಗೋಸ್ಕರ ಅಂದರೆ, ಕೈಗಾರಿಕಾ ಪ್ರದೇಶ ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ತನ್ನ ಉದ್ದೇಶವನ್ನು ಪ್ರಕಟಿಸಿತ್ತು.

ಅದರಂತೆ ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯನ್ವಯ 28ರ ಉಪ ಕಲಂ (3)ರನ್ವಯ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ ಮತ್ತು ಈ ಕೆಳಗೆ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳು ಪ್ರಸ್ತುತ ಅಧಿಸೂಚನೆಯಲ್ಲಿಯೂ ಕಾಣಿಸಲ್ಪಟ್ಟಿವೆ ಹಾಗೂ ಪ್ರಸ್ತುತ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕೆಂದು ಕರ್ನಾಟಕ ಸರಕಾರಕ್ಕೆ ಮನವರಿಕೆಯಾಗಿದೆ.

ಆದುದರಿಂದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966 (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966)ರ ಕಲಂ 28 ರ ಉಪ ಕಲಂ (4) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಈ ಕೆಳಗೆ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕೆಂದು ಈ ಮೂಲಕ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಘೋಷಿಸಿದೆ.

ಈ ಮುಂದಿನ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳಲ್ಲಿ ಕೈಗಾರಿಕೆಗಳ ಸ್ಥಾಪನೆಗಾಗಿ ಅಂದರೆ ಬಿಜಾಪೂರ ಜಿಲ್ಲೆ ಬಸವನ ಬಾಗೇವಾಡಿ ತಾಲೂಕ ಮುಳವಾಡ ಗ್ರಾಮದಲ್ಲಿ ಕೈಗಾರಿಕೆ ಪ್ರದೇಶ ಸ್ಥಾಪಿಸುವ ಸಲುವಾಗಿ ಅಭಿವೃದ್ಧಿಗೊಳಿಸಲು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಗೆ ಅವಶ್ಯವಿರುತ್ತದೆಯೆಂದು ಕರ್ನಾಟಕ ಸರಕಾರವು ಉದ್ದೇಶಿಸಿದೆ.

ಆದ್ದರಿಂದ 1966 ನೇ ಸಾಲಿನ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966) ರ ಕಲಂ 28ರ ಉಪಕಲಂ (1) ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರಕಾರವು ಪ್ರಸ್ತುತ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಿ ಈ ಮೂಲಕ ಸೂಚನೆ ಕೊಡಲಾಗಿದೆ.

ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯ ಕಲಂ 35 ರ ಉದ್ದೇಶಕ್ಕಾಗಿ ಅಂಥ ಜಮೀನುಗಳಲ್ಲಿ ಪ್ರವೇಶಿಸುವ ವ್ಯಕ್ತಿಗಳೊಡನೆ ಮಧ್ಯೆ ಪ್ರವೇಶಿಸುವದಾಗಲಿ ಅಥವಾ ಅವರನ್ನು ತಡೆಯುವುದಾಗಲಿ ಮಾಡಬಾರದು ಅಂತಾ ಪ್ರಸ್ತುತ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಇರುವವರಿಗೆಲ್ಲಾ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ. ಸದರಿ ಜಮೀನಿನ ಮಾರಾಟ, ವಿಲೇವಾರಿ, ಗುತ್ತಿಗೆ ಅಡಮಾನ, ಹಸ್ತಾಂತರಣ ವಿನಿಮಯ ಅಥವಾ ಇನ್ನಾವುದೇ ರೀತಿಯ ಒಪ್ಪಂದಗಳನ್ನು ಅಥವಾ ಯಾವೊಂದು ವೆಚ್ಚ ಭೂ ಅಭಿವೃದ್ಧಿಗಳನ್ನು ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದ ನಂತರ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, ಧಾರವಾಡ ಇವರ ಮಂಜೂರಾತಿಯನ್ನು ಪಡೆಯದೇ ಮಾಡಿದ ಪಕ್ಷದಲ್ಲಿ ಕೇಂದ್ರಿಯ ಭೂಸ್ವಾಧೀನ ಕಾಯ್ದೆ 1894 ರ ಕಲಂ 24(7) ಮೇರೆಗೆ ಪರಿಹಾರಧನ ಕೊಡಲು ಪರಿಗಣಿೆಸುವುದಿಲ್ಲವೆಂಬ ಹಾಗೂ ಅಧಿಕೃತವಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ತಿಳಿಯಪಡಿಸಲಾಗಿದೆ.

ಸದರಿ ಜಮೀನಿನ ಒಂದು ಕರಡು ನಕ್ಷೆಯನ್ನು ವಿಶೇಷ ಭೂಸ್ವಾಧೀನ ಅಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ, 33/ಎ ಲಕಮನಹಳ್ಳಿ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶ, ಪಿ.ಬಿ. ರಸ್ತೆ ಧಾರವಾಡ-580004 ಇವರ ಕಾರ್ಯಾಲಯದಲ್ಲಿ ಪರಿಶೀಲನೆಗಾಗಿ ಇಡಲಾಗಿದೆ.
