NOTIFICATION

The draft of the following rules further to amend the Karnataka Land Grant Rules, 1969, which the Government of Karnataka proposes to make in exercise of the powers conferred by Section 197 of the Karnataka Land Revenue Act 1964 (Karnataka Act 12 of 1964) is hereby published as required by sub-section (1) of the said section for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after expiry of thirty days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections or suggestions may be addressed to the Principal Secretary to Government, Revenue Department, V floor, III Stage, Multi-storied Building, Dr. B.R. Ambedkar Veedhi, Banglaore – 560 001.

DRAFT RULES

1. Title and Commencement.- (1) These rules may be called the Karnataka Land Grant (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 23.- In the Karnataka Land Grant Rules, 1969, after rule 23 the following shall be inserted, namely:-

"23-A: Grant of leased lands to persons to whom the lands have been leased for the purpose of cashew cultivation:-

(1) Notwithstanding anything contained in these rules, or any directions or orders by the Government, the lands which were leased before the commencement of the Karnataka Land Grants (Amendment) Rules, 2012 (hereinafter referred to as these rules), for cashew cultivation and if the Lessee has complied with all the conditions of lease, and continued to be in possession, the Assistant Commissioner of the Sub-Division shall grant the leased land to the Lessee after obtaining an application in writing, with necessary details within six months from the date of commencement of these rules, on collection of an amount equivalent to the market value of the land as specified under rule 17 of the Karnataka Land Grant Rules, 1969 subject to the following conditions namely:-

a) Where the period of lease has expired by efflux of time and the leased land has not been granted to the Lessee, the lease shall be continued;

b) In cases, where the Lessee has expired, his legal heirs shall be entitled to get the land granted.

c) The trees other than cashew trees shall be disposed of in accordance with rule 11 of the Karnataka Land Grant Rules, 1969.

d) entire land leased to the Lessee shall be granted to him, however the total land so granted and the land already held by the grantee shall not exceed the ceiling area specified in section 63 of the Karnataka Land Reforms Act, 1961."

The draft of the following rules further to amend the Karnataka General Service (Pre-University Education Department) (Recruitment to the cadre of Lecturers of Government Pre-University Colleges) (Special) Rules, 2011 which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of Section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) is hereby published as required by clause (a) of sub-section (2) of section 3 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to said draft before the expiry of the period specified above will be considered by the State Government. In exercise of the powers conferred by section 28 of the legal services Authorities Act 1987 (Central Act 39 of 1987) and in consultation with the Chief Justice of the High Court of Karnataka, the Government of Karnataka hereby makes the following rules, to amend the Karnataka State Legal Services Authorities Rules, 1996 namely.

1. Title and Commencement. (1) These rules may be called the Karnataka State Legal Services Authorities (Amendment) Rules 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment to Rule 7.- In the Karnataka State Legal Services Authority's Rules, 1996 (hereinafter referred to as the said rules), in rule 7, Sub-Rule (1).

(i) After serial number (1) and entries relating thereto the following shall be inserted, namely:-

"1A. Chief judge of the small -Ex officio member"

1.Title and Commencement –(1)These rules may be called the Karnataka Urban Development Authorities (Allotment of Civic Amenity Sites (Amendment )Rules, 2012

(2) They shall come into force from the date of their publication in the official Gazette

2.Amendment of rule 8-In the Karnataka Urban Development Authorities (Allotment of Civic Amenity Sites)Rules, 1991, in rule 8, after sub-rule (1), the following shall be inserted, namely -:

"Provided that in case of renewal of lease of Civic amenity sites allotted to educational and such other institutions engaged in Charitable activities, the lease amount shall be fixed at fifty percent more than the original value fixed at the time of allotment of the site on lease basis, for a further period of lease as per sub-rule (14) of rule. 10."
