PLANNING, PROGRAMME MONITORING AND STATISTICS SECRETARIAT

NOTIFICATION

G.O. No. DES/IND/1/IUN/2013-14, Bangalore, Dated 4th June 2013

1. In exercise of the powers conferred under sections 3 and 4 of the Collection of Statistics Act, 2008 (7 of 2009) read with rules 5 and 7 of the Collection of Statistics Rules, 2011, the Planning, Programme Monitoring and Statistics Department, Government of Karnataka, hereby directs collection of statistics on manufacturing and related activities through a Statistical Survey, hereinafter referred to as "the Annual Survey of Industries 2011-12" (Residual State Sample Units) as per the details mentioned in the schedule-I.

2. The Department further appoints the persons as also their assignees in office, mentioned in Schedule -II, as Statistics Officers in respect of the geographical units mentioned thereof with reference to the aforesaid direction.

3. The persons authorized by the concerned Statistics Officer would be engaged in the jurisdiction of the Statistics Officer for verification of information furnished by each informant, for inspecting relevant records, and for seeking clarifications, as may be necessary. Each person would carry a photo identity card or a letter of authorisation issued by the concerned Statistics Officer.

4. The statistics collected in Part-I in respect of the Annual Survey of Industries 2011-12 (Residual State Sample Units) furnished by the informants, after due verification and scrutiny, will be processed by officials working at the Office of the Directorate of Economic and Statistics, Industries section of SIP Division, Bangalore.

5. All the persons engaged in any activity in respect of the Annual Survey of Industries 2011-12 (Residual State Sample Units) are governed by the provisions under the Collection of Statistics Act, 2008 (7 of 2009) and the Collection of Statistics Rules, 2011. No power has been delegated to any Statistics Officer under sub-sections (4) or (6) of section 4 the Act.

SCHEDULE-I

Subject and Purpose for Collection of Statistics

1. Statistics relating to growth, composition and structure of organized manufacturing sector comprising activities related to manufacturing processes, repair services, gas and water supply and cold storage collected through Annual Survey of Industries 2011-12 (Residual State Sample Units).

Geographical area for collection of Statistics

2. The Annual Survey of Industries 2011-12 (Residual State Sample Units) is conducted in the State of Karnataka under the Collection of Statistics Act, 2008 and Collection of Statistics Rules, 2011.

Method of data collection

3. A notice will be issued by each Statistics Officer to informant under his jurisdiction, indicating therein the date by which, the officer or office to whom, the unit or units for which, and the formats in which information is required to be furnished.

A Statistics Officer may permit an informant to file the prescribed information in electronic form, subject to such other conditions that he may specify in the notice.

Nature of Informants from whom data may be collected

4. The owner or occupier of a unit [i.e., a factory or an electricity or gas water supply undertaking or an establishment registered under the Beedi & Cigar workers (Conditions of Employment) Act, 1966], who would be issued notice by Statistics Officer shall furnish information about the unit.

5.· In case two or more units are under a single management the information pertaining to the individual unit under consideration shall be provided to the Statistics Officer.

Period during which collection of Statistics may be completed

6. The date for submission of information by each informant would be mentioned in the notice and it would generally fall during August 2013 to January 2014.

Reference Period

7. Information is required to be furnished for the financial year commencing from 1st April 2011 and ending on 31st March 2012 or for the accounting year of a unit on any date between 1st April 2011 and on 31st March 2012.

Nature of information to be collected

8. The schedule has two parts. Part-I relates to information on assets and liabilities, employment and labour cost, receipts, expenses, input items - indigenous and imported, products and by-products, distributive expenses etc. which have to be collected from the unit.

9. An informant shall furnish information in the prescribed formats in English.

Obligation of informant

10. A owner or occupier of a unit shall furnish information in the manner and by the date mentioned in the notice received by him from the concerned Statistics Officer. He shall also furnish relevant records for inspection, and answer questions in relation to the information sought, as may be required by the Statistics Officer or a person authorised by him.

Nature of business records and other records which may be inspected;

11. Business records of a unit, such as balance sheet,profit & loss account, muster rolls, attendance register, labour register, pay rolls, Director's report or. any other legal document in support of the information furnished by the unit may be inspected by the District Statistical Officer or a person authorised by him.

The manner of inspection :

12. The concerned Statistics Officer or a person authorised by him may verify the information furnished by a unit on the basis of business records and other records of the unit and seek clarifications from the concerned owner or occupier or a person authorised by the management of the unit.

Sub : Handing over of Immigration functions at Mangalore Airport to Bureau of Immigration-regarding

Read : ¹) Notification dated : ¹⁶-⁰⁴-²⁰¹³ (No. ²⁵⁰²²/¹⁰²/²⁰¹²-Imm) of Ministry of Home Affairs, Government of India.

2) Letter No. 38/Immg/MNG/2013 dated : 30-01-2013 of The Joint Director Subsidiary Intelligence Bureau, Ministry of Home Affairs, Government of India.

3) Letter No. CB/44/COP/MNG/2013, dated : 18-05-2013 of the Commissioner of Police, Mangalore City, Mangalore.

4) Letter No. 1/FRRO/ICP/2013, dated : 29-05-2013M of the FRRO Bureau of Immigration, MHA, Government of India.

PREAMBLE :

Government of India vide Notification read at (1) above has appointed the Chief Immigration Officer, Mangalore, as the "Civil Authority" for the jurisdiction of the Mangalore International Airport with effect from 30-04-2013.

The Joint Director, Subsidiary Intelligence Bureau, Ministry of Home Affairs, vide his letter referred to at (2) above, has requested that the Commissioner of Police, Mangalore who is at present the Foreigners Registration Officer, may kindly be advised to hand over the available infrastructure at the Mangalore Airport to Bureau of Immigration staff led by Shri G.P.D. Silva who has been designated as the Assistant Director, Bureau of Immigration, Mangalore. IB Hqrs has provided skeletal staff for the present to supervise the Immigration functions at Mangalore Airport. He has also stated that the Ministry of Home Affairs has been requested to expedite sanction of posts to the Bureau of Immigration, Mangalore.

The Commissioner of Police, Mangalore City, Mangalore, vide his letter read at (3) above, has stated that Immigration functions at Mangalore International Airport Immigration Check post (ICP) were being performed by Dakshina Kannada District Police from October 2006 to 14 August 2011 and thereafter by Mangalore city police Commissionarate even though there are no specific order in this regard. Further he has requested that in view of the Government of India, Notification dated 16-04-2013 the Managalore International Airport Immigration Check Post (ICP) may be handed over to the Bureasu of Immigration officially and in this regard a Notification be issued.

The Foreigners Regional Registration Officer vide letter referred to at (4) above, has requested the State Government to issue a corresponding Notification by the State regarding take over of Immigration Check post (ICP), Mangalore consequent to the issue of Government of India Gazette Notification No 8821 dated 18-04-2013. Hence, this order.

GOVERNMENT ORDER NO. HD 293 PMS 2013, BANGALORE, DATED : 07-06-2013.

In the circumstances explained in the preamble, Government of Karnataka hereby accords permission to the Foreigners Registration Officer, Mangalore to handover the charge of Mangalore International Airport Immigration Check post (ICP) to the Chief Immigration Officer, Bureau of Immigration, Mangalore, with immediate effect and until further orders.

Further pending sanction of posts by Ministry of Home Affairs to the Bureau of Immigration, Mangalore the Police staff who are currently posted at the Mangalore Airport may continue to be on the pay roll of the Karnataka State Police and they would be under the operational control of the Bureau of Immigration from 31-01-2013 onwards till their deputation to the Bureau of Immigration subject to their suitability and fulfilling the prescribed criteria or otherwise.

The concerned Police Authorities are also requested to provide necessary assistance to the Immigration staff at the Bureau of Immigration, Mangalore to ensure that relevant duties are carried out in the interest of national security.

ವಿಷಯ : ಮಂಡ್ಯ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ಮಂಜೂರಾಗಿರುವ ಬೆರಳಚ್ಚುಗಾರರ ಹುದ್ದೆಯನ್ನು ಕಂಪ್ಯೂಟರ್ ಆಪರೇಟರ್ ಹುದ್ದೆಯನ್ನಾಗಿ ಪರಿವರ್ತಿಸಲು ಮಂಜೂರಾತಿ ನೀಡುವ ಬಗ್ಗೆ.

ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (1)ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಮಂಡ್ಯ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳನ್ನು ರೂಪಿಸಿ ಸರ್ಕಾರವು ಆದೇಶಿಸಿದ್ದು. ಸದರಿ ಆದೇಶವನ್ನು 19-6-2003ರ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದ ಭಾಗ 6(ಎ) ರಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿದ್ದು. ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (2)ರ ಪತ್ರದಲ್ಲಿ ಆಯುಕ್ತರು, ಮಂಡ್ಯ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರ ಇವರು ದಿನಾಂಕ : 20-11-2012 ರಂದು ನಡೆದ ಪ್ರಾಧಿಕಾರದ ಸಭೆಯಲ್ಲಿ ನಿರ್ಣಯಿಸಿದಂತೆ ಹಾಲಿ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಮಂಜೂರಾಗಿರುವ ಬೆರಳಚ್ಚುಗಾರರ ಹುದ್ದೆಯು ನಗಣ್ಯವಾಗಿರುವುದರಿಂದ ಬೆರಳಚ್ಚುಗಾರರ ಹುದ್ದೆಯನ್ನು ಕಂಪ್ಯೂಟರ್ ಆಪರೇಟರ್ ಹುದ್ದೆಯನ್ನಾಗಿ ಪರಿವರ್ತಿಸಿ, ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಕ್ಕೆ ತಿದ್ದುಪಡಿ ಮಾಡಿಕೊಡಬೇಕೆಂದು ಕೋರಿ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

ಆಯುಕ್ತರ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸರ್ಕಾರವು ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಮೇಲ್ಕಂಡ ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಮಂಡ್ಯ ನಗರಾಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರದ ಅನುಮೋದಿತ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಮಂಜೂರಾದ ಒಂದು ಬೆರಳಚ್ಚುಗಾರರ ಹುದ್ದೆಯನ್ನು (ವೇತನ ಶ್ರೇಣಿ 3000-5450 ಪ್ರಸ್ತುತ ವೇತನ ಶ್ರೇಣಿ 11600-21000) ಕಂಪ್ಯೂಟರ್ ಆಪರೇಟರ್ ಹುದ್ದೆಯನ್ನಾಗಿ ಪರಿವರ್ತಿಸಲು ಈ ಕೆಳಕಂಡ ಷರತ್ತಿಗೊಳಪಡಿಸಿ ಸರ್ಕಾರದ ಮಂಜೂರಾತಿ ನೀಡಲಾಗಿದೆ.

1. ಬೆರಳಚ್ಚುಗಾರರ ಹುದ್ದೆಗೆ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿರುವ ವೇತನ ಶ್ರೇಣಿಯಲ್ಲೇ ಪರಿವರ್ತಿತ ಕಂಪ್ಯೂಟರ್ ಆಪರೇಟರ್ ಹುದ್ದೆಯ ವೇತನ ಶ್ರೇಣಿಯನ್ನು ಸಹ ನಿಗಧಿಪಡಿಸತಕ್ಕದ್ದು ;

2. ಪರಿವರ್ತಿತ ಹುದ್ದಯನ್ನು ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಅಳವಡಿಸಿಕೊಳ್ಳಲು ಸೂಕ್ತ ತಿದ್ದುಪಡಿಯನ್ನು ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದು. 3. ಕಂಪ್ಯೂಟರ್ ಆಪರೇಟರ್ ಹುದ್ದೆಗೆ ನೇಮಕಾತಿ ಮಾಡಲು ಅಗತ್ಯ ವಿದ್ಯಾರ್ಹತೆ, ತರಬೇತಿ, ಸಂಬಂಧಪಟ್ಟ ಪ್ರಮಾಣ ಪತ್ರಗಳನ್ನು ಸಲ್ಲಿಸಬೇಕಾಗಿರುವ ಕುರಿತು ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಸ್ಪಷ್ಟವಾಗಿ ನಮೂದಿಸತಕ್ಕದ್ದು.

4. ಕಂಪ್ಯೂಟರ್ ಆಪರೇಟರ್ ಹುದ್ದೆಗೆ ನೇಮಕಾತಿ ಮಾಡುವ ಮುನ್ನ ನೇಮಕಾತಿ ನಿಯಮಗಳನ್ವಯ ಕ್ರಮವಹಿಸಿ, ಸರ್ಕಾರದ ಪೂರ್ವಾನುಮತಿ ಪಡೆಯತಕ್ಕದ್ದು.

ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (1) ರಲ್ಲಿ ಸಹಾಯಕ ನಿಬಂಧಕರು, ಲೀಗಲ್ ಓಪೀನಿಯನ್-1, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ಇವರು ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (2)ರಲ್ಲಿ ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತರು, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ಇವರ ವರದಿ ದಿನಾಂಕ : 11-01-2013ನ್ನು ಲಗತ್ತಿಸಿ ಕಳುಹಿಸುತ್ತಾ, ಸದರಿ ವರದಿಯ ಅನುಸಾರ ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ ಕಾಯ್ದೆ ಕಲಂ 12(3)ರ ಅನುಸಾರ ಪರಿಶೀಲಿಸಿ ಅದೇ ಕಾಯ್ಕೆಯ ಕಲಂ 12(4) ರ ಅನುಸಾರ ಮೂರು ತಿಂಗಳೊಳಗೆ ಲೋಕಾಯುಕ್ತಕ್ಕೆ ವರದಿಯನ್ನು ನೀಡುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

ಮಾನ್ಯ ಉಪಲೋಕಾಯುಕ್ತ ವರದಿಯಲ್ಲಿ ಶ್ರೀಮತಿ ಎಂ. ಸಾವಿತ್ರಿ ಹಿಂದಿನ ಹಿರಿಯ ಸಹಾಯಕ ಸರ್ಕಾರಿ ಅಭಿಯೋಜಕರು ಚೀಪ್ ಜ್ಯುಡಿಷಿಯಲ್ ನ್ಯಾಯಾಲಯ, ಶಿವಮೊಗ್ಗ ಇಲ್ಲಿ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸುತ್ತಿದ್ದಾಗ ಸದರಿಯವರು ಶ್ರೀ ಎಂ. ಲೋಕೇಶ್ ಇಸೂರು ತಂದೆ ಮಸಿಯಪ್ಪ, ವಕೀಲರು, ಚೆನ್ನಪ್ಪ ಲೇಔಟ್, ಶಿವಮೊಗ್ಗ ಇವರು ಅವರಿಗೆ ಸಂಬಂಧಿಸಿದ ವ್ಯಕ್ತಿ ಶ್ರೀ ವಿಜಯಕುಮಾರ್ ಇವರು ನ್ಯಾಯಾಲಯ ಬಂಧನದಲ್ಲಿದ್ದು, ಇವರನ್ನು ಬಂಧನದಿಂದಬಿಡಿಸಲು ಸದರಿಯವರ ಪರವಾಗಿ ಶ್ರೀಮತಿ ಎಂ. ಸಾವಿತ್ರಿ, ಹಿರಿಯ ಸಹಾಯಕ ಸರ್ಕಾರಿ ಅಭಿಯೋಜಕರು ಇವರನ್ನು ನ್ಯಾಯಾಲಯದ ಬಂಧನದಲ್ಲಿದ್ದ ವ್ಯಕ್ತಿಯನ್ನು ಬಿಡುಗಡೆಗೊಳಿಸುವ ಬಗ್ಗೆ ಸಂಪರ್ಕಿಸಿದಾಗ ದಿನಾಂಕ : 04-07-2009 ರಂದು ರೂ. 500-00ಗಳ ಲಂಚದ ಹಣವನ್ನು ಕೇಳಿ ಪಡೆಯುತ್ತಿದ್ದಾಗ ಲೋಕಾಯುಕ್ತರು ಬೀಸಿದ ಬಲೆಗೆ ಸಿಕ್ಕಿ ಬಿದ್ದಿದ್ದು, ಪ್ರಕರಣವನ್ನು ಲೋಕಾಯುಕ್ತ ಠಾಣೆ, ಶಿವಮೊಗ್ಗ ಇಲ್ಲಿ ಕ್ರಿ.ನಂ. 7/2009 ಅನ್ನು ದಾಖಲಿಸಿಕೊಳ್ಳಲಾಗಿದೆ ಎಂದು ತಿಳಿಸಿ, ಸದರಿಯವರ ವಿರುದ್ಧದ ಆರೋಪವು ಮೇಲ್ನೋಟಕ್ಕೆ ಸಾಬೀತಾಗಿರುವುದು ಕಂಡುಬರುವುದರಿಂದ ಮತ್ತು ಶ್ರೀಮತಿ ಎಂ.ಸಾವಿತ್ರಿ ಇವರು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ನಡತೆ) ನಿಯಮಾವಳಿಯ ನಿಯಮ 3(1)ನ್ನು ಉಲ್ಲಂಘಿಸಿರುವುದರಿಂದ ಸದರಿಯವರ ವಿರುದ್ಧ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 14-ಎ ಅನುಸಾರ ಇಲಾಖಾ ವಿಚಾರಣೆಯನ್ನು ಪ್ರಾರಂಭಿಸಲು ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತರಿಗೆ ಪ್ರಕರಣವನ್ನು ವಹಿಸಲು ಕೋರಿರುತ್ತಾರೆ.

ಸರ್ಕಾರವು ಮಾನ್ಯ ಉಪಲೋಕಾಯುಕ್ತರು ಇವರ ವರದಿಯನ್ನು ಪರಿಶೀಲಿಸಿ ಶ್ರೀ ಎಂ. ಸಾವಿತ್ರಿ ಇವರು ಲಂಚ ಪ್ರಕರಣದಲ್ಲಿ ಒಳಗೊಂಡಿರುವುದು ಸ್ಪಷ್ಟವಾಗಿ ಗೋಚರಿಸುವುದರಿಂದ ಸದರಿಯವರ ಪ್ರಕರಣವನ್ನು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಾವಳಿಯ, ನಿಯಮ 14-ಎ ಅನುಸಾರ ಉಪಲೋಕಾಯುಕ್ತರಿಗೆ ವಹಿಸಲು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿ, ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.
