NOTIFICATION
No: FD 146 CSE 2011 Bangalore, dated:12th December 2013.
Whereas the draft of the Karnataka Commercial Taxes Department (Recruitment) (Amendment Rules 1990 was published as required by clause (a) of sub section(2) of section 3 –A of the Karnataka State Civil Services Act 1978(Karnataka Act 14 of 1990) in Notification No: FD 180 CSF 2007 dated:28th May 2009 in Part IV-A of the Karnataka Gazette (extraordinary) dated:29th May 2009 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of publication in the official Gazette.
And whereas the said gazette was made available to public on 29th May 2009.
And whereas the objection and suggestions received have been examined and considered by the Government. In the meantime the Hon'ble High Court of Karnataka in W.P.No.7994-8003/2010 and W.P No.11899-902/2010 delivered the judgement on 26th April 2013, observing that, freezing of vacancies done in favour of promotes by issuance of notification in 2002 is illegal and directed the Government to take immediate steps for de-freezing of the vacancies as proposed in 2009 notification. Keeping in view the observations of the Hon'ble High Court of Karnataka and considering the objections received, the draft notification issued earlier is now finalized.
Now therefore in exercise of powers conferred by sub section(1) of section 3 read with section 8 of the Karnataka State Civil Services Act 1978(Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely:
Rules
1. Title and commencement:- (1) Theses rules may be called Karnataka Commercial Taxes Department (Recruitment)(Amendment) Rules, 2013.
(2) They shall come into force on the date of their publication in the official Gazette
2. Amendment of Schedule:- In the Schedule to the Karnataka Commercial Taxes Department (Recruitment) Rules, 1990.
(i) In the entries relating to the category of post of " Assistant Commissioner of Commercial Taxes" at serial number 5, in column (3) the proviso shall be deemed to have been omitted with effect from 6th day of May 2002.
(ii) In the entries relating to the category of post of " Commercial Tax Officer " at serial number 8, in column (3) the proviso shall be deemed to have been omitted with effect from 6th day of May 2002.
(iii) In the entries relating to the category of post of " Commercial Tax Inspector " at serial number 11, in column (3) the proviso, shall be deemed to have been omitted with effect from 6th day of May 2002.
(iv) In the entries relating to the category of post of " First Division Assistant " at serial number 15, for the entries in column (3), third proviso, shall be deemed to have been omitted with effect from the 6th day of May 2002.

Whereas the draft of the following rules further to amend the Karnataka Panchayat Raj Engineering Services (Cadre and Recruitment) Rules, 2008, was published as required by clause (a) of sub-section (2) of Section 3 read with Section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. RDP 106 ZPA 2013 dated 12.09.2013 in Part IV-A in the Karnataka Gazette Extra-ordinary No.1135 dated 12th September 2013 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.
Whereas the said Gazette was made available to the public on 12th September 2013.
And whereas the objections and suggestions received have been considered.
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 3 read with Section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely :-
RULES
1. Title and commencement: - (1) These rules may be called the Karnataka Panchayat Raj Engineering Services (Cadre and Recruitment) (Amendment) Rules, 2013.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of Schedule-II:- In Karnataka Panchayat Raj Engineering Services (Cadre and Recruitment) Rules, 2008 in schedule-II:-
(1) in the entries relating to the category of post of "Superintendents cadre" at Serial No.10:-
(a) Clause (ii) and entries relating there to shall be omitted;
(b) Clause (iii) shall be renumbered as clause (ii); and
(2) After the category of post of "Superintendents cadre" at Serial No.10 and entries relating thereto, the following shall be inserted, namely:-
| 10A. Accounts Superintendents | Fifty percent by deputation in the equivalent cadre from the State Accounts Department; and forty five percent by promotion from the cadre of First Division Accounts Assistant; and five percent by transfer from the cadre of Office Superintendent on the basis of Seniority. | For Promotion and Transfer:- (1) Must have put in a service of not less than five years in the cadre of First Division Accounts Assistant or Office Superintendent as the case may be, If no suitable person with not less than five years of service is available, a person with not less than three years of service may be considered for promotion / transfer. (2) Must have passed S.A.S. Examination (3) A person with computer knowledge be preferred. |
(a) Clause (ii) and entries relating thereto shall be omitted;
(b) Clause (iii) shall be renumbered as clause (ii) and clause (iv) shall be renumbered as clause (iii); and
(4) after the category of post of "First Division Assistant" at Serial No. 17, and entries relating thereto, the following shall be
| 17A. First Division Accounts Assistant | Fifty percent by deputation in the equivalent cadre from the State Accounts Department; and thirty percent by transfer from the cadre of First Division Assistant. An irrevocable option from the First Division Assistant shall be obtained before such transfer to the effect that the candidate will continue to remain in the cadres of Accounts Division and twenty percent by promotion from the cadre of Second Division Accounts Assistants on the basis of seniority. | For Promotion and Transfer :- (1) Must have passed S.A.S. Examination. (2) Must have put in a service of not less than five years in the cadre of First Division Assistant or Second Division Accounts Assistant as the case may be, If no person who has put in a service of not less than five years of service is available, the persons who have put in a service of not less than three years may be considered for promotion / transfer. |
(5) in the entries relating to the category of post of "Second Division Assistant" at Serial No. 21:-
(a) Clause (ii) shall be omitted; and
(b) Clause (iii) shall be renumbered as clause (ii); and
(6) after the category of post of "Second Division Assistant" at Serial No. 21 and entries relating thereto, the following
| 21A. Second Division Accounts Assistant | Fifty percent by deputation of an official in equivalent cadre from the State Accounts Department; and fifty percent by transfer from the cadre of Second Division Assistant on the basis of seniority. An irrevocable option from the Second Division Assistant shall be obtained before transfer to the post of Second Division Accounts Assistant to the effect that the candidate shall continue in the cadres of Accounts Division. | For Transfer :- (1) Must have passed S.S.L.C. or equivalent examination. (2) Must have obtained a 'O' level certificate in the Course on Computer Concepts issued by any of the recognized Societies of DOEACC, an Autonomous body of the Department of Information Technology, Ministry of Communications and Information Technology, Government of India. |

NOTIFICATION
In exercise of the powers conferred by section 71 of the Karnataka Urban Development Authorities Act 1987, the State Government hereby makes the following amendment to form III of the Karnataka Urban Development Authorities (Allotment of Civic Amenity sites) rules 1991.
In FORM 3 Lease Agreement of the Karnataka Urban Development Authorities (Allotment of Civic Amenity Sites) rules 1991 clause 2 and 7 of the form shall be submitted as follows:-
"(2) That the lessee applied for the lease of civic amenity site to the lessor for the benefit and use of the said site for the construction of……………for the specific purpose mentioned here under the lessor having agreed to for lease of the scheduled land to the lessee subject to the terms and conditions mentioned hereafter. That the lease property which is more fully described in the schedule to this agreement has been leased for a period of thirty years (30 years) commencing from the date of Registration of the lease agreement"
"(7) That the lessee shall obtain licence and start construction of the …….. building as per plan approved and mentioned by the lessor within six months from the date of issue of the possession certificate and will complete the same within three years from the date of registration of the lease agreement OR such extended period, provided the total period does not exceed 10 years, as the Authority may, in any specified case, by written order, permit"
