ರಾಜೀವ್ ಗಾಂಧಿ ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ವಿಶ್ವವಿದ್ಯಾಲಯ (ತಿದ್ದುಪಡಿ) ವಿಧೇಯಕ, 2013ಕ್ಕೆ 2013ರ ಡಿಸೆಂಬರ್ ತಿಂಗಳ ಮೂವತ್ತೊಂದನೇ ದಿನಾಂಕದಂದು ರಾಜ್ಯಪಾಲರ ಒಪ್ಪಿಗೆ ದೊರೆತಿದ್ದು, ಸಾಮಾನ್ಯ ತಿಳುವಳಿಕೆಗಾಗಿ ಇದನ್ನು 2014ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ: 01 ಎಂಬುದಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಬೇಕೆಂದು ಆದೇಶಿಸಲಾಗಿದೆ.

2014ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ ಸಂಖ್ಯೆ: 01

(2014ರ ಜನವರಿ ತಿಂಗಳ ಒಂದನೇ ದಿನಾಂಕದಂದು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದ ವಿಶೇಷ ಸಂಚಿಕೆಯಲ್ಲಿ ಮೊದಲು ಪ್ರಕಟವಾಗಿದೆ) ರಾಜೀವ್ ಗಾಂಧಿ ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ವಿಶ್ವವಿದ್ಯಾಲಯ (ತಿದ್ದುಪಡಿ) ಅಧಿನಿಯಮ, 2013

(2013ರ ಡಿಸೆಂಬರ್ ತಿಂಗಳ ಮೂವತ್ತೊಂದನೇ ದಿನಾಂಕದಂದು ರಾಜ್ಯಪಾಲರಿಂದ ಅನುಮತಿಯನ್ನು ಪಡೆಯಲಾಗಿದೆ) ರಾಜೀವ್ ಗಾಂಧಿ ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ವಿಶ್ವವಿದ್ಯಾಲಯ ಅಧಿನಿಯಮ, 1994ಕ್ಕೆ ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡಲು ಒಂದು ಅಧಿನಿಯಮ.

ಇಲ್ಲಿ ಇನ್ನು ಮುಂದೆ ಕಂಡು ಬರುವ ಉದ್ದೇಶಗಳಿಗಾಗಿ, ರಾಜೀವ್ ಗಾಂಧಿ ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ವಿಶ್ವವಿದ್ಯಾಲಯ ಅಧಿನಿಯಮ, 1994ನ್ನು (1994ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 44) ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವುದು ಯುಕ್ತವಾಗಿರುವುದರಿಂದ;

ಇದು ಭಾರತ ಗಣರಾಜ್ಯದ ಅರವತ್ನಾಲ್ಕನೇ ವರ್ಷದಲ್ಲಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ವಿಧಾನಮಂಡಲದಿಂದ ಈ ಮುಂದಿನಂತೆ ಅಧಿನಿಯಮಿತವಾಗತಕ್ಕದ್ದು:-

1. ಸಂಕ್ಷಿಪ್ತ ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ಅಧಿನಿಯಮವನ್ನು ರಾಜೀವ್ ಗಾಂಧಿ ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ವಿಶ್ವವಿದ್ಯಾಲಯ (ತಿದ್ದುಪಡಿ) ಅಧಿನಿಯಮ, 2013 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇದು ಈ ಕೂಡಲೇ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. 12ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ರಾಜೀವ್ ಗಾಂಧಿ ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ವಿಶ್ವವಿದ್ಯಾಲಯ ಅಧಿನಿಯಮ, 1994ರಲ್ಲಿ (1994ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 44) (ಇಲ್ಲಿ ಇನ್ನು ಮುಂದೆ ಮೂಲ ಅಧಿನಿಯಮವೆಂದು ಉಲ್ಲೇಖಿಸಲಾಗಿದೆ) 12ನೇ ಪ್ರಕರಣದಲ್ಲಿ,-

(i) (3)ನೇ ಉಪಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

``(3) (2)ನೇ ಉಪಪ್ರಕರಣದಲ್ಲಿ ಉಲ್ಲೇಖಿಸಲಾದ ಸಮಿತಿಯು, ಕುಲಪತಿಯು ನಾಮನಿರ್ದೇಶಿಸಿದ ಒಬ್ಬರು, ರಾಜ್ಯ ಸರ್ಕಾರವು ನಾಮನಿರ್ದೇಶಿಸಿದ ಒಬ್ಬರು ಮತ್ತು ಸಿಂಡಿಕೇಟ್ ನಾಮನಿರ್ದೇಶಿಸಿದ ಒಬ್ಬರು-ಹೀಗೆ ಈ ಮೂವರು ವ್ಯಕ್ತಿಗಳನ್ನು ಒಳಗೊಂಡ, ರಾಜ್ಯ ಸರ್ಕಾರವು ರಚಿಸಿದ ಒಂದು ಶೋಧನಾ ಸಮಿತಿಯಾಗಿರತಕ್ಕದ್ದು. ರಾಜ್ಯ ಸರ್ಕಾರವು, ಸದಸ್ಯರಲ್ಲಿ ಒಬ್ಬನನ್ನು ಸಮಿತಿಯ ಅಧ್ಯಕ್ಷನನ್ನಾಗಿ ನೇಮಕ ಮಾಡತಕ್ಕದ್ದು. ವೈದ್ಯಕೀಯ ಶಿಕ್ಷಣದ ಪ್ರಭಾರದಲ್ಲಿರುವ ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಯು ಅಥವಾ ಸರ್ಕಾರದ ಉಪಕಾರ್ಯದರ್ಶಿ ದರ್ಜೆಗೆ ಕಡಿಮೆಯಲ್ಲದ ದರ್ಜೆಯ ಆತನ ನಾಮನಿರ್ದೇಶಿತನು ಶೋಧನಾ ಸಮಿತಿಯ ಸಂಚಾಲಕನಾಗಿರತಕ್ಕದ್ದು.''

(ii) (4)ನೇ ಉಪಪ್ರಕರಣದಲ್ಲಿ,-

(ಎ) ``ಆದರೆ ಅವನು ಮರುನೇಮಕಾತಿ ಹೊಂದಲು ಅರ್ಹನಾಗಿರತಕ್ಕದ್ದು.'' ಎಂಬ ಪದಗಳಿಗೆ ``ಎರಡನೇ ಅವಧಿಗೆ ಮರುನೇಮಕಕ್ಕಾಗಿ ಅವನು ಅರ್ಹನಾಗಿರತಕ್ಕದ್ದಲ್ಲ.'' ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು.

(ಬಿ) ಮೊದಲನೇ ಪರಂತುಕವನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

(ಸಿ) ಎರಡನೇ ಪರಂತುಕದಲ್ಲಿ ``ಅಷ್ಟೇ ಅಲ್ಲದೆ'' ಎಂಬ ಪದಗಳಿಗೆ ``ಪರಂತು" ಎಂಬ ಪದವನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು.

3. 15ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 15ನೇ ಪ್ರಕರಣದಲ್ಲಿ (1)ನೇ ಉಪಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

``(1) ರಿಜಿಸ್ಟ್ರಾರ್‌ನು ವಿಶ್ವವಿದ್ಯಾಲಯದ ಪೂರ್ಣಕಾಲಿಕ ಅಧಿಕಾರಿಯಾಗಿರತಕ್ಕದ್ದು. ರಾಜ್ಯ ಸರ್ಕಾರವು, ಭಾರತೀಯ ಆಡಳಿತ ಸೇವೆಗೆ ಸೇರಿದ ಹಿರಿಯ ಶ್ರೇಣಿಯಲ್ಲಿನ ಒಬ್ಬ ಅಧಿಕಾರಿಯನ್ನು ಅಥವಾ ಕರ್ನಾಟಕ ಆಡಳಿತ ಸೇವೆಗೆ ಸೇರಿದ, ಸೂಪರ್‌ಟೈಮ್ ವೇತನ ಶ್ರೇಣಿಯ ದರ್ಜೆಗೆ ಕಡಿಮೆಯಲ್ಲದ ದರ್ಜೆಯ ಒಬ್ಬ ಅಧಿಕಾರಿಯನ್ನು, ವಿಶ್ವವಿದ್ಯಾಲಯದ ರಿಜಿಸ್ಟ್ರಾರ್ ಆಗಿ ನೇಮಕ ಮಾಡತಕ್ಕದ್ದು.''

4. 16ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 16ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

``(1) ರಿಜಿಸ್ಟ್ರಾರನು (ಮೌಲ್ಯಮಾಪನ) ವಿಶ್ವವಿದ್ಯಾಲಯದ ಪೂರ್ಣಕಾಲಿಕ ಅಧಿಕಾರಿಯಾಗಿರತಕ್ಕದ್ದು. ರಾಜ್ಯ ಸರ್ಕಾರವು, ಸಮೂಹ ಎ ದರ್ಜೆ ಹಿರಿಯ ವೇತನ ಶ್ರೇಣಿಗೆ ಕಡಿಮೆಯಿರದ ಕರ್ನಾಟಕ ಆಡಳಿತ ಸೇವೆಗೆ ಸೇರಿದ ಒಬ್ಬ ಅಧಿಕಾರಿಯನ್ನಾಗಲಿ ಅಥವಾ ಪ್ರಾಧ್ಯಾಪಕ ಹುದ್ದೆಯಲ್ಲಿ ಕನಿಷ್ಟಪಕ್ಷ ಐದು ವರ್ಷಗಳ ನಿರಂತರ ಸೇವೆ ಸಲ್ಲಿಸಿದ ಸ್ವಾಯತ್ತ ಸರ್ಕಾರಿ ವೈದ್ಯಕೀಯ ಸಂಸ್ಥೆಯ ಒಬ್ಬ ಪ್ರಾಧ್ಯಾಪಕರನ್ನಾಗಲಿ ರಿಜಿಸ್ಟ್ರಾರ್ (ಮೌಲ್ಯಮಾಪನ) ಆಗಿ ನೇಮಿಸತಕ್ಕದ್ದು.''

5. 17ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 17ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

``(1) ಹಣಕಾಸು ಅಧಿಕಾರಿಯು ವಿಶ್ವವಿದ್ಯಾಲಯದ ಪೂರ್ಣಕಾಲಿಕ ಅಧಿಕಾರಿಯಾಗಿರತಕ್ಕದ್ದು. ರಾಜ್ಯ ಸರ್ಕಾರವು, ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರಗಳ ಇಲಾಖೆಯಲ್ಲಿ ಜಂಟಿ ನಿಯಂತ್ರಕರ ವೃಂದಕ್ಕೆ ಸೇರಿದ ಒಬ್ಬ ಅಧಿಕಾರಿಯನ್ನು ವಿಶ್ವವಿದ್ಯಾಲಯದ ಹಣಕಾಸು ಅಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸತಕ್ಕದ್ದು.'' 6. 18ನೇ ಪ್ರಕರಣದ ಪ್ರತಿಯೋಜನೆ.- ಮೂಲ ಅಧಿನಿಯಮದ 18ನೇ ಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"18 ಇತರ ಅಧಿಕಾರಿಗಳು.- 9ನೇ ಪ್ರಕರಣದ (viii)ನೇ ಖಂಡದಲ್ಲಿ ಉಲ್ಲೇಖಿಸಿದ ವಿಶ್ವವಿದ್ಯಾಲಯದ ಇತರ ಅಧಿಕಾರಿಗಳ ನೇಮಕಾತಿ ವಿಧಾನ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು ಶಾಸನಗಳ ಮೂಲಕ ನಿಯಮಿಸಬಹುದಾದಂತೆ ಇರತಕ್ಕದ್ದು ಅಥವಾ ರಾಜ್ಯ ಸರ್ಕಾರದ ಅಧಿಕಾರಿಗಳನ್ನು ಅಥವಾ ಸರ್ಕಾರಿ ಸ್ವಾಯತ್ತ ವೈದ್ಯಕೀಯ ಸಂಸ್ಥೆಗಳ ಅಧಿಕಾರಿಗಳನ್ನು ಮೂರು ವರ್ಷಗಳನ್ನು ಮೀರದಂಥ ಅವಧಿಗೆ ಪ್ರತಿನಿಯೋಜಿಸತಕ್ಕದ್ದು, ಆದರೆ ಅಂಥ ಯಾರೇ ಅಧಿಕಾರಿಗಳನ್ನು ವಿಶ್ವವಿದ್ಯಾಲಯದಲ್ಲಿನ ಯಾವುದೇ ಆಡಳಿತಾತ್ಮಕ ಹುದ್ದೆಗಳಿಗೆ ಯಾವುದೇ ಅನುದಾನಿತ ಅಥವಾ ಅನುದಾನ ರಹಿತ ಖಾಸಗಿ ಕಾಲೇಜುಗಳಿಂದ ಅಥವಾ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳಿಂದ ಪ್ರತಿನಿಯೋಜನೆ ಮಾಡಿಕೊಳ್ಳತಕ್ಕದ್ದಲ್ಲ. ಅಂಥ ಅಧಿಕಾರಿಗಳ ಅಧಿಕಾರಗಳು ಮತ್ತು ಕರ್ತವ್ಯಗಳು ಹಾಗೂ ಸೇವಾ ಷರತ್ತುಗಳು ಶಾಸನಗಳ ಮೂಲಕ ನಿಯಮಿಸಬಹುದಾದಂತಿರತಕ್ಕದ್ದು."

7. 21ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 21ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪಪ್ರಕರಣದಲ್ಲಿ,-

(i) (iii)ನೇ ಖಂಡಕ್ಕೆ ಈ ಮುಂದಿನ ಖಂಡವನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"(iii) ವೈದ್ಯಕೀಯ ಶಿಕ್ಷಣದ ಪ್ರಭಾರದಲ್ಲಿರುವ ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿ ಅಥವಾ ಅವನಿಂದ ನಾಮನಿರ್ದೇಶಿತನಾದ ಸರ್ಕಾರದ ಉಪ ಕಾರ್ಯದರ್ಶಿಯ ದರ್ಜೆಗಿಂತ ಕಡಿಮೆಯಲ್ಲದ ದರ್ಜೆಯ ವ್ಯಕ್ತಿ."

(ii) (xiii)ನೇ ಖಂಡಕ್ಕೆ ಬದಲಾಗಿ ಈ ಕೆಳಕಂಡ ಖಂಡವನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"(xiii) ಭಾರತ ವೈದ್ಯಕೀಯ ಪರಿಷತ್ತು, ಭಾರತ ದಂತ ವೈದ್ಯಕೀಯ ಪರಿಷತ್ತು,

ಭಾರತ ಔಷಧ ಪರಿಷತ್ತು, ಇಂಡಿಯನ್ ನರ್ಸಿಂಗ್ ಕೌನ್ಸಿಲ್, ಸೆಂಟ್ರಲ್ ಕೌನ್ಸಿಲ್ ಆಫ್ ಇಂಡಿಯನ್ ಮೆಡಿಸಿನ್ ಮತ್ತು ಸೆಂಟ್ರಲ್ ಕೌನ್ಸಿಲ್ ಆಫ್ ಹೋಮಿಯೋಪತಿ- ಇವುಗಳಿಗೆ ತಲಾ ಒಬ್ಬರಂತೆ ಕರ್ನಾಟಕ ವಿಭಾಗದಿಂದ ಚುನಾಯಿತರಾಗಿರುವ ಒಟ್ಟು ಆರು ಜನ ಸದಸ್ಯರು;"

8. 24ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 24ನೇ ಪ್ರಕರಣದಲ್ಲಿ, (1)ನೇ ಉಪಪ್ರಕರಣದಲ್ಲಿ,-

(ಎ) (i)ನೇ ಖಂಡದ ತರುವಾಯ ಈ ಕೆಳಕಂಡ ಖಂಡಗಳನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"(i-ಎ) ಆರೋಗ್ಯ ಮತ್ತು ಕುಟುಂಬ ಕಲ್ಯಾಣದ ಪ್ರಭಾರದಲ್ಲಿರುವ ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿ ಅಥವಾ ಅವನಿಂದ ನಾಮನಿರ್ದೇಶಿತನಾದ ಸರ್ಕಾರದ ಉಪ ಕಾರ್ಯದರ್ಶಿ ದರ್ಜೆಗಿಂತ ಕಡಿಮೆಯಲ್ಲದ ದರ್ಜೆಯ ವ್ಯಕ್ತಿ;

ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರಿಕೆ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜನವರಿ ೧೬, ೨೦೧೪ ೨೨೭

(i-ಬಿ) ವೈದ್ಯಕೀಯ ಶಿಕ್ಷಣದ ಪ್ರಭಾರದಲ್ಲಿರುವ ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿ ಅಥವಾ ಅವನಿಂದ ನಾಮನಿರ್ದೇಶಿತನಾದ ಸರ್ಕಾರದ ಉಪ ಕಾರ್ಯದರ್ಶಿಯ ದರ್ಜೆಗಿಂತ ಕಡಿಮೆಯಲ್ಲದ ದರ್ಜೆಯ ವ್ಯಕ್ತಿ." (ಬಿ) (x)ನೇ ಖಂಡಕ್ಕೆ ಈ ಕೆಳಕಂಡ ಖಂಡವನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"(x) ಸ್ವಾಯತ್ತ ಸರ್ಕಾರಿ ವೈದ್ಯಕೀಯ ಸಂಸ್ಥೆಯಿಂದ ಸರ್ಕಾರವು ವಾರ್ಷಿಕ

ಸುತ್ತು ಸರದಿಯಂತೆ ನಾಮನಿರ್ದೇಶಿಸುವ ಒಬ್ಬ ನಾಮನಿರ್ದೇಶಿತ."

(ಸಿ) (xi) ನೇ ಖಂಡದ ತರುವಾಯ ಈ ಕೆಳಕಂಡ ಖಂಡವನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"(xii) ಆರೋಗ್ಯ ವಿಜ್ಞಾನಗಳ ಕ್ಷೇತ್ರದಲ್ಲಿನ ಪರಿಣಿತ ವ್ಯಕ್ತಿಗಳಿಂದ ರಾಜ್ಯ

ಸರ್ಕಾರವು ನಾಮನಿರ್ದೇಶಿಸಿದ ಆರು ವ್ಯಕ್ತಿಗಳು, ಅವರಲ್ಲಿ,-

(i) ಪರಿಶಿಷ್ಟ ಜಾತಿಗಳು ಅಥವಾ ಪರಿಶಿಷ್ಟ ಪಂಗಡಗಳಿಗೆ ಸೇರಿದ ಒಬ್ಬ ವ್ಯಕ್ತಿ;

(ii) ಇತರೆ ಹಿಂದುಳಿದ ವರ್ಗಗಳಿಗೆ ಸೇರಿದ ಒಬ್ಬ ವ್ಯಕ್ತಿ;

(iii) ಒಬ್ಬ ಮಹಿಳೆ;

(iv) ಭಾಷಾ ಅಲ್ಪಸಂಖ್ಯಾತ ವರ್ಗಕ್ಕೆ ಸೇರಿದ ಒಬ್ಬ ವ್ಯಕ್ತಿ; ಮತ್ತು

(v) ಇಬ್ಬರು ಇತರರು,

-ಇರತಕ್ಕದ್ದು:

ಪರಂತು, ಸಂಯೋಜಿತ ಕಾಲೇಜಿನಲ್ಲಿ ಅಥವಾ ವಿಶ್ವವಿದ್ಯಾಲಯದಲ್ಲಿ ಯಾವುದೇ ಸ್ಥಾನದಲ್ಲಿ ನಿಯೋಜಿತನಾಗಿರುವ ಯಾರೇ ವ್ಯಕ್ತಿಯು ನಾಮನಿರ್ದೇಶನಕ್ಕೆ ಅರ್ಹನಾಗಿರತಕ್ಕದ್ದಲ್ಲ.''

9. 40ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 40ನೇ ಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"40. ನಿಧಿಗಳ ನಿರ್ವಹಣೆ.- ವಿಶ್ವವಿದ್ಯಾಲಯದ ಎಲ್ಲಾ ನಿಧಿಗಳನ್ನು ಶಾಸನಗಳ ಮೂಲಕ ನಿಯಮಿಸಬಹುದಾದಂಥ ರೀತಿಯಲ್ಲಿ ನಿರ್ವಹಿಸತಕ್ಕದ್ದು:

ಪರಂತು, ರಾಜ್ಯ ಸರ್ಕಾರವು ನಿಧಿಗಳ ನಿರ್ವಹಣೆಗೆ ಮತ್ತು ಬಳಕೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಕಾಲಕಾಲಕ್ಕೆ ನಿರ್ದೇಶನಗಳನ್ನು ಹೊರಡಿಸಬಹುದು.

ರಾಜ್ಯ ಸರ್ಕಾರದ ನಿರ್ದೇಶನಗಳು ಅಂತಿಮವಾಗಿರತಕ್ಕದ್ದು."

10. 43ನೇ ಪ್ರಕರಣದ ಪ್ರತಿಯೋಜನೆ.- ಮೂಲ ಅಧಿನಿಯಮದ 43ನೇ ಪ್ರಕರಣಕ್ಕೆ, ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"43. ವಾರ್ಷಿಕ ಲೆಕ್ಕಪತ್ರಗಳು ಮತ್ತು ಲೆಕ್ಕ ಪರಿಶೋಧನೆ.- (1) ವಿಶ್ವವಿದ್ಯಾಲಯದ ವಾರ್ಷಿಕ ಲೆಕ್ಕಪತ್ರಗಳನ್ನು, ಸಿಂಡಿಕೇಟ್‌ನ ನಿರ್ದೇಶನಗಳ ಮೇರೆಗೆ ಸಿದ್ಧಪಡಿಸತಕ್ಕದ್ದು.

(2) ಹಾಗೆ ತಯಾರಿಸಲಾದ ವಾರ್ಷಿಕ ಲೆಕ್ಕಪತ್ರಗಳನ್ನು ಸೆನೆಟ್ಟು ತನ್ನ ಮುಂದಿನ ಸಭೆಯಲ್ಲೇ ಪರಿಶೀಲಿಸತಕ್ಕದ್ದು. ಸೆನೆಟ್ಟು ಅದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಿರ್ಣಯವನ್ನು ಅಂಗೀಕರಿಸಬಹುದು ಮತ್ತು ಅದನ್ನು ಸಿಂಡಿಕೇಟ್‌ಗೆ ತಿಳಿಸತಕ್ಕದ್ದು. ಸಿಂಡಿಕೇಟು, ಸೆನೆಟ್ ನೀಡಿದ ಸಲಹೆ ಸೂಚನೆಗಳನ್ನು ಪರಿಗಣಿಸತಕ್ಕದ್ದು ಮತ್ತು ಅದರ ಮೇಲೆ ತಾನು ಸೂಕ್ತವೆಂದು ಭಾವಿಸಬಹುದಾದಂಥ ಕ್ರಮಗಳನ್ನು ಕೈಗೊಳ್ಳತಕ್ಕದ್ದು ಮತ್ತು ತಾನು ಕೈಗೊಂಡ ಕ್ರಮವನ್ನು ಅಥವಾ ಕ್ರಮವನ್ನು ಕೈಗೊಳ್ಳದಿರುವುದಕ್ಕೆ ಕಾರಣಗಳನ್ನು ತನ್ನ ಮುಂದಿನ ಸಭೆಯಲ್ಲಿ ಸೆನೆಟ್‌ಗೆ ತಿಳಿಸತಕ್ಕದ್ದು.

(3) ವಿಶ್ವವಿದ್ಯಾಲಯದ ಲೆಕ್ಕಪತ್ರಗಳನ್ನು, ವರ್ಷಕ್ಕೊಮ್ಮೆ, ಏಪ್ರಿಲ್ ತಿಂಗಳಿನಲ್ಲಿ ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರಗಳ ನಿಯಂತ್ರಕರು ಲೆಕ್ಕ ಪರಿಶೋಧನೆ ಮಾಡತಕ್ಕದ್ದು.

(4) ಹಾಗೆ ಲೆಕ್ಕ ಪರಿಶೋಧನೆ ಮಾಡಲಾದ ಲೆಕ್ಕಪತ್ರಗಳನ್ನು ಸಿಂಡಿಕೇಟ್ ಮತ್ತು ಸೆನೆಟ್‌ನ ಮುಂದಿಡತಕ್ಕದ್ದು ಮತ್ತು ಆ ತರುವಾಯ ಸೆನೆಟ್ಟಿನ ನಿರ್ಣಯದೊಂದಿಗೆ ಅಭಿಪ್ರಾಯಗಳನ್ನು ಪ್ರತೀ ವರ್ಷದ ಸೆಪ್ಟಂಬರ್ 30ರೊಳಗೆ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಕಳುಹಿಸತಕ್ಕದ್ದು. ರಾಜ್ಯ ಸರ್ಕಾರವು, ತನ್ನ ಮುಂದಿನ ನಿಕಟ ಅಧಿವೇಶನದಲ್ಲಿ ರಾಜ್ಯ ವಿಧಾನಮಂಡಲದ ಎರಡೂ ಸದನಗಳ ಮುಂದೆ ಅದನ್ನು ಮಂಡಿಸತಕ್ಕದ್ದು."

11. 44ನೇ ಪ್ರಕರಣದ ತಿದ್ದುಪಡಿ.- ಮೂಲ ಅಧಿನಿಯಮದ 44ನೇ ಪ್ರಕರಣದ (2)ನೇ ಉಪಪ್ರಕರಣಕ್ಕೆ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತಿಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

"(2) ವಾರ್ಷಿಕ ವರದಿ ಮೇಲೆ ಸೆನೆಟ್ ಮಾಡಿರುವ ನಿರ್ಣಯದ ಜೊತೆಗೆ ವಾರ್ಷಿಕ ವರದಿಯ ಪ್ರತಿಗಳನ್ನು, ಪ್ರತಿವರ್ಷದ ಸೆಪ್ಟಂಬರ್ 30ರೊಳಗೆ ಸರ್ಕಾರಕ್ಕೆ ಕಳುಹಿಸತಕ್ಕದ್ದು. ರಾಜ್ಯ ಸರ್ಕಾರವು ತನ್ನ ಮುಂದಿನ ನಿಕಟ ಅಧಿವೇಶನದಲ್ಲಿ ರಾಜ್ಯ ವಿಧಾನ ಮಂಡಲದ ಎರಡೂ ಸದನಗಳ ಮುಂದೆ ಅದನ್ನು ಮಂಡಿಸತಕ್ಕದ್ದು."

(AMENDMENT) ACT, 2013

(Received the assent of the Governor on the Twenty eighth day of December, 2013)

An Act further to amend the Karnataka Slum Areas (Improvement and Clearance) Act, 1973.

Whereas it is expedient further to amend the Karnataka Slum Areas(Improvement and Clearance) Act, 1973 (Karnataka Act 33 of 1974) for the purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the sixty fourth year of the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the Karnataka Slum Areas(Improvement and Clearance) (Amendment) Act, 2013.

(2) It shall come into force at once.

2. Amendment of Title.-In the Karnataka Slum Areas(Improvement and Clearance) Act, 1973 (Karnataka Act 33 of 1974) (hereinafter referred to as the principal Act), in the title and in the long title for the words "Improvement and clearance" the words " development " shall respectively be substituted.

3. Amendment of section 1.- In sub-section(1) of section 1 of the principal Act, for the words " Improvement and clearance" the words "development" shall be substituted.

4. Amendment of section 2.- In the principal Act, in section 2, in clause(a), for the words " Karnataka Slum Clearance Board" the words "Karnataka Slum Development Board" shall be substituted.

5. Amendment of section 33.- In section 33 of the Principal Act,-

(a) in the heading, for the words "Karnataka Slum Clearance Board", the words "Karnataka Slum Development Board" shall be substituted.

(b) in sub-section(1), for the words, "Karnataka Slum Clearance Board", the words "Karnataka Slum Development Board" shall be substituted.

ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) ಅಧಿನಿಯಮ, 1966 ರ ಕಲಂ 10(2) ರಲ್ಲಿನ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಮೇಲಿನಂತೆ ನಾಮ ನಿರ್ದೇಶನಗೊಂಡಿರುವ ಸದಸ್ಯರುಗಳ ಪೈಕಿ, "ಶ್ರೀ ಬಿ.ಎಸ್.ಕವಲಗಿ, ಅಗರಖೇಡ, ಇಂಡಿ ತಾಲ್ಲೂಕು" ಇವರನ್ನು ಅಧ್ಯಕ್ಷರನ್ನಾಗಿ ಸದರಿ ಸಮಿತಿಗೆ ನಾಮಕರಣ ಮಾಡಿದೆ.

ದಕ್ಷಿಣ ಕನ್ನಡ ಜಿಲ್ಲೆಯ ಮುಲ್ಕಿ ಪಟ್ಟಣ ಪಂಚಾಯತಿಯ 17 ವಾರ್ಡ್‌ಗಳಿಗೆ ದಿನಾಂಕ: 27.01.2014ರ ಸೋಮವಾರದಂದು ಚುನಾವಣೆ ನಡೆಯಲ್ಲಿದ್ದು, ಈ ಕ್ಷೇತ್ರದ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಎಲ್ಲಾ ರಾಜ್ಯ ಸರ್ಕಾರಿ ಕಚೇರಿಗಳಿಗೆ, ಕೇಂದ್ರ ಸರ್ಕಾರದ ಕಚೇರಿಗಳಿಗೆ, ಕೇಂದ್ರ ಹಾಗೂ ರಾಜ್ಯ ಸರ್ಕಾರಿ ಕಾರ್ಖಾನೆ, ಕೈಗಾರಿಕಾ ಸಂಸ್ಥೆಗಳಿಗೆ, ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳಿಗೆ, ಶಾಲಾ ಕಾಲೇಜುಗಳಿಗೆ (ಅನುದಾನಿತ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳೂ ಸೇರಿದಂತೆ) ಸೀಮಿತಗೊಳಿಸಿ ಸಾರ್ವತ್ರಿಕ ರಜೆಯನ್ನು ಘೋಷಿಸಿದೆ. ಈ ರಜೆಯು ತುರ್ತು ಸೇವೆಗಳಿಗೆ ಅನ್ವಯಿಸುವುದಿಲ್ಲ.

ಈ ಚುನಾವಣಾ ಕಾರ್ಯಕ್ಕೆ ನಿಯೋಜಿಸಲ್ಪಟ್ಟ ಎಲ್ಲಾ ಸರ್ಕಾರಿ ನೌಕರರು ಸದರಿ ದಿನಾಂಕದಂದು ಚುನಾವಣಾ ಕಾರ್ಯದಲ್ಲಿ ಹಾಜರಾಗತಕ್ಕದ್ದು.

ಸದರಿ ಕ್ಷೇತ್ರಗಳಲ್ಲಿ ಮತದಾನವು ಸುಸೂತ್ರವಾಗಿ ನಡೆಯಲು ಅನುಕೂಲವಾಗುವಂತೆ ಮತದಾನ ನಡೆಯುವ ಮತಗಟ್ಟೆಗಳನ್ನು ಸರ್ಕಾರಿ ಕಚೇರಿಗಳಲ್ಲಿ ಹಾಗೂ ಸರ್ಕಾರಿ ಶಾಲೆಗಳಲ್ಲಿ ಸ್ಥಾಪಿಸಿದಲ್ಲಿ ಅಂತಹ ಕಚೇರಿ ಹಾಗೂ ಶಾಲೆಗಳಿಗೆ ದಿನಾಂಕ 26.01.2014 ರಂದು ಭಾನುವಾರ (ಪೂರ್ವ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರಿಕೆ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜನವರಿ ೧೬, ೨೦೧೪ ೨೩೧ ತಯಾರಿಗಾಗಿ) ಮತ್ತು ಮತ ಎಣಿಕೆಯ ದಿನದಂದು ಮತದಾನ ಎಣಿಕೆ ನಡೆಯುವ ಕೇಂದ್ರ ಸ್ಥಾನದಲ್ಲಿ ಮಾತ್ರ ರಜಾ ಘೋಷಿಸಲು ಅವಶ್ಯಕತೆ ಇದ್ದಲ್ಲಿ ಸಂಬಂಧಪಟ್ಟ ಚುನಾವಣಾಧಿಕಾರಿಗಳು ಕ್ರಮ ತೆಗೆದುಕೊಳ್ಳತಕ್ಕದ್ದು.

ಮೇಲೆ(1) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಅಪರ ನಿವಂಧಕರು, ಕರ್ನಾಟಕ ಉಪ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ಇವರ ಪತ್ರದಲ್ಲಿ ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ಸಹಾಯಕ ನಿರ್ದೇಶಕರು, ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇಲ್ಲಿ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸುತ್ತಿದ್ದ ಅವಧಿಯಲ್ಲಿ ಅಂದಿನ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯ ಅಧ್ಯಕ್ಷರಾಗಿದ್ದ ಶ್ರೀ ಹೆಚ್.ಎಸ್. ಜಕ್ಕಣ್ಣಗೌಡರ್ ಇವರೊಂದಿಗೆ ಶಾಮಿಲಾಗಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇದಕ್ಕೆ ಸೇರಿದ ಕೆಸನೂರು ಗ್ರಾಮದ 30 ಎಕರೆ ಜಮೀನನ್ನು ನಿಯಮಾನುಸಾರ ಟೆಂಡರ್ ಕರೆಯದೆ ವಸ್ತುಸ್ಥಿತಿಯನ್ನು ಮರೆಮಾಚಿ ಎಕರೆ ಒಂದಕ್ಕೆ ರೂ.50,000/- ರಂತೆ ಒಟ್ಟು 30 ಎಕರೆ ಜಮೀನನ್ನು ರೂ.15.00 ಲಕ್ಷದ ಮೊತ್ತಕ್ಕೆ ಶ್ರೀ ತಿರುಪತಿ ಹಡಗಲಿಯವರಿಗೆ ಮಾರಾಟ ಮಾಡಿ ಅಕ್ರಮವೆಸಗಿದ್ದಾರೆಂದು ಶ್ರೀ ಸಿದ್ದರಾಮಪ್ಪ ಲಕ್ಕಪ್ಪ ಜಕ್ಕಣ್ಣನವರ, ಗದ್ದನಕೇರಿ, ಬಾಗಲಕೋಟೆ ಜಿಲ್ಲೆ, ಇವರು ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತಕ್ಕೆ ದೂರು ನೀಡಿದ್ದ ಬಗ್ಗೆ ವಿಚಾರಣೆ ನಡೆಸಿ ತನಿಖಾ ವರದಿಯೊಂದಿಗೆ ದಾಖಲೆಗಳನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿದ್ದರು.

ಉಪಲೋಕಾಯುಕ್ತರ ವರದಿಯಲ್ಲಿ ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ಸಹಾಯಕ ನಿರ್ದೇಶಕರು, (ಅಪಾದಿತ ಸರ್ಕಾರಿ ಅಧಿಕಾರಿ) ಇವರು ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇಲ್ಲಿ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸುತ್ತಿದ್ದಾಗ ಅಂದಿನ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ ಅಧ್ಯಕ್ಷರೊಂದಿಗೆ ಶಾಮೀಲಾಗಿ ಬಾಗಲಕೋಟೆ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಗೆ ಸೇರಿದ ಕೆಸನೂರು ಗ್ರಾಮದ 30 ಎಕರೆ ಜಮೀನಿನ ಮಾರುಕಟ್ಟೆ ಬೆಲೆ ರೂ. 3,13,63,200/-ಗಳು ಇದ್ದು, ಖರೀದಿದಾರರು ರೂ. 34,34,303/- ಗಳ ಮೊತ್ತವನ್ನು ಸ್ವಾಂಪ್‌ಡ್ಯೂಟಿ ಮತ್ತು ರೂ.5.27,380/- ಗಳಷ್ಟು ಮೊತ್ತವನ್ನು ನೊಂದಣಿ ಶುಲ್ಕವನ್ನಾಗಿ ಪಾವತಿಸಲು ಜಿಲ್ಲಾ ನೊಂದಣಾಧಿಕಾರಿಗಳು, ತಿಳಿಸಿದ್ದರೂ ಸಹ ಖರೀದಿದಾರರು ಸದರಿ ಮೊತ್ತವನ್ನು ಪಾವತಿಸಿಲ್ಲವೆಂದು ಹಾಗೂ ವಸೂಲಿ ಮಾಡಲು ಯಾವ ಕ್ರಮ ತೆಗೆದುಕೊಳ್ಳಲಿಲ್ಲವೆಂದು, ಇದರಿಂದಾಗಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇದರ ಅಧ್ಯಕ್ಷರು ಮತ್ತು ಕಾರ್ಯದರ್ಶಿಯವರು ಸದರಿ ಸಮಿತಿಗೆ ಸೇರಿದ ಜಮೀನನ್ನು ಕಡಿಮೆ ದರಕ್ಕೆ ಮಾರಾಟ ಮಾಡಿ ಸಮಿತಿಗೆ ಹಾಗೂ ಸರ್ಕಾರಕ್ಕೆ ತುಂಬಾ ಆರ್ಥಿಕ ನಷ್ಟ ಉಂಟು ಮಾಡಿರುವುದಾಗಿ ತಿಳಿಸಿ ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್ ಹಿರೇಮನಿ, ಸಹಾಯಕ ನಿರ್ದೇಶಕರು, ಕೃಷಿ ಮಾರಾಟ ಇಲಾಖೆ, ಹಾಗೂ ಹಿಂದಿನಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜನವರಿ ೧೬, ೨೦೧೪ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರಿಕೆ ೨೩೨ ಕಾರ್ಯದರ್ಶಿ, ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ, ರವರ ವಿರುದ್ಧ ದುರ್ನಡತೆಗಾಗಿ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವೆ(ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳನ್ವಯ ಶಿಸ್ತು ಕ್ರಮ ಕೈಗೊಳ್ಳುವಂತೆ ಸರ್ಕಾರಕ್ಕೆ ಶಿಫಾರಸ್ಸು ಮಾಡಿರುತ್ತಾರೆ.

ಸದರಿ ತನಿಖಾ ವರದಿ ಹಾಗೂ ದಾಖಲೆಗಳನ್ನು ಸರ್ಕಾರವು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಈ ಪ್ರಕರಣದಲ್ಲಿ ಆಪಾದಿತ ಅಧಿಕಾರಿಯವರಾದ ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ಸಹಾಯಕ ನಿರ್ದೇಶಕರು(ಅಂದಿನ ಕಾರ್ಯದರ್ಶಿ, ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ) ಇವರ ವಿರುದ್ಧ ಇಲಾಖಾ ವಿಚಾರಣೆ ಕೈಗೊಳ್ಳಲು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ(ವರ್ಗಿಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 14(ಎ) ರನ್ವಯ ಪ್ರಕರಣವನ್ನು ಕರ್ನಾಟಕ ಉಪಲೋಕಾಯುಕ್ತ ರವರಿಗೆ ವಹಿಸಲು ಮೇಲೆ ಕ್ರ.ಸಂ.(2)ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಮಂಜೂರಾತಿಯನ್ನು ನೀಡಲಾಗಿತ್ತು.

ಉಪ ಲೋಕಾಯುಕ್ತರವರು ಇಲಾಖಾ ವಿಚಾರಣೆಯನ್ನು ನಡೆಸಿ ದಿನಾಂಕ: 13.02.2009 ರಂದು ಸರ್ಕಾರಕ್ಕೆ ವಿಚಾರಣಾ ವರದಿಯನ್ನು ಸಲ್ಲಿಸಿ, ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ಇವರು ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇಲ್ಲಿ ಕಾರ್ಯದರ್ಶಿಯಾಗಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿದ್ದ ಅವಧಿಯಲ್ಲಿ ಅಂದಿನ ಸಮಿತಿಯ ಅಧ್ಯಕ್ಷರಾಗಿದ್ದ ಶ್ರೀ ಹೆಚ್.ಎಸ್. ಜಕ್ಕಣ್ಣಗೌಡರ್ ಇವರೊಂದಿಗೆ ಶಾಮೀಲಾಗಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇದಕ್ಕೆ ಸೇರಿದ ಕೆಸನೂರು ಗ್ರಾಮದ ಸರ್ವೇ ನಂ 29/4+5/A/2/30/2, 30/2, 30/3 34, 37 38 ಹಾಗೂ ಇತರೆ ಸರ್ವೇ ನಂಬರಿನ ಒಟ್ಟು 30 ಎಕರೆ ಜಮೀನನ್ನು ಶ್ರೀ ತಿರುಪತಿ ಹಡಗಲಿಯವರಿಗೆ ರೂ. 15.00 ಲಕ್ಷಗಳಿಗೆ ಮಾರಾಟ ಮಾಡಿದ್ದು, ಈ ಜಮೀನಿನ ಮಾರುಕಟ್ಟೆ ಬೆಲೆಯು ರೂ.3,13,63,200/-ಗಳು ಇದ್ದು, ಇದರಿಂದ ಸರ್ಕಾರಕ್ಕೆ ಹೆಚ್ಚಿನ ಆರ್ಥಿಕ ನಷ್ಟವನ್ನು ಉಂಟುಮಾಡಿ ಸದರಿಯವರು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ನಡತೆ) ನಿಯಮಗಳು, 1966ರ ನಿಯಮ 3(1)(i) ರಿಂದ (iii) ನ್ನು ಉಲ್ಲಂಘಿಸಿರುತ್ತಾರೆ. ಆದ್ದರಿಂದ ಸದರಿಯವರಿಗೆ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ(ವರ್ಗಿಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 8(vi) ರನ್ವಯ ದಂಡನೆಯನ್ನು ವಿಧಿಸುವಂತೆ ಮೇಲೆ ಕ್ರ.ಸಂ.(3) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಶಿಫಾರಸ್ಸು ಮಾಡಿರುತ್ತಾರೆ.

ಉಪಲೋಕಾಯುಕ್ತರ ಶಿಫಾರಸ್ಸಿನಂತೆ ಅಪಾದಿತ ಅಧಿಕಾರಿಣಿಯಾದ ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ರವರಿಗೆ ಉಪಲೋಕಾಯುಕ್ತರ ವಿಚಾರಣಾ ವರದಿಯ ಪ್ರತಿಯನ್ನು ಲಗತ್ತಿಸಿ ನೋಟೀಸು ಜಾರಿ ಮಾಡಿ ವಿವರಣೆಯನ್ನು ಸಲ್ಲಿಸುವಂತೆ ತಿಳಿಸಲಾಗಿತ್ತು. ಅದರಂತೆ ಸದರಿಯವರು ದಿನಾಂಕ:

15.04.2009 ಮತ್ತು 19.05.2009 ರಂದು ವಿವರಣೆಯನ್ನು ಸಲ್ಲಿಸಿರುತ್ತಾರೆ. ಸದರಿ ವಿವರಣೆಯಲ್ಲಿ ಉಪ ಲೋಕಾಯುಕ್ತರವರ ವಿಚಾರಣಾ ವರದಿಯ ತೀರ್ಮಾನವನ್ನು ಸಂಪೂರ್ಣವಾಗಿ ಅಲ್ಲಗಳೆದು ವಿಚಾರಣಾ ವರದಿಯ ಶಿಫಾರಸ್ಸನ್ನು ತಿರಸ್ಕರಿಸಿ ದೋಷಮುಕ್ತರನ್ನಾಗಿ ಮಾಡುವಂತೆ ಮೇಲೆ ಓದಲಾದ (5) ರ ಮನವಿಯಲ್ಲಿ ಕೋರಿರುತ್ತಾರೆ.

ಪ್ರಸ್ತುತ ಪ್ರಕರಣದಲ್ಲಿ ವಿಚಾರಣಾಧಿಕಾರಿಗಳು ಹಾಗೂ ಉಪಲೋಕಾಯುಕ್ತರು ಮಾಡಿರುವ ಶಿಫಾರಸ್ಸು ಮತ್ತು ಅಪಾದಿತ ಅಧಿಕಾರಿಣಿಯವರು ವಿಚಾರಣಾ ವರದಿಯ ಮೇಲೆ ನೀಡಿರುವ ಸಮಜಾಯಿಷಿಯನ್ನು ತುಲನಾತ್ಮಕವಾಗಿ ಪರಿಶೀಲಿಸಲಾಗಿದ್ದು, ಅಪಾದಿತ ಅಧಿಕಾರಿಯವರ ಸಮಜಾಯಿಷಿಯನ್ನು ಒಪ್ಪಲು ಬರುವುದಿಲ್ಲ. ಸದರಿಯವರು ಈ ಪ್ರಕರಣದಲ್ಲಿ ಅಂತಿಮ ಘಟ್ಟದಲ್ಲಿ ಹಾಗೂ ಪ್ರಮುಖ ತೀರ್ಮಾನ ತೆಗೆದುಕೊಳ್ಳುವ ವೇಳೆಯಲ್ಲಿ ಸಮಿತಿಯ ಕಾರ್ಯದರ್ಶಿಯಾಗಿ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸಿದ್ದಾರೆ. ಈ ಪ್ರಕರಣದ ಹಿಂದಿನ ತೀರ್ಮಾನಗಳು ತಪ್ಪಾಗಿದ್ದಲ್ಲಿ ಅದನ್ನು ಸಮಿತಿಯ ಗಮನಕ್ಕೆ ತಂದು ಸರಿಪಡಿಸುವ ಕಾರ್ಯ ಮಾಡದೇ ಆ ತಪ್ಪನ್ನು ಮುಂದುವರೆಸಿ ಸರ್ಕಾರಕ್ಕೆ ಬಹುಕೋಟಿ ಹಣ ನಷ್ಟ ಉಂಟಾಗಲು ಜವಬ್ದಾರರಾಗಿರುವುದು ಕಂಡುಬರುತ್ತದೆ. ಆದ್ದರಿಂದ ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ಸಹಾಯಕ ನಿರ್ದೇಶಕರು, ಹಿಂದಿನ ಕಾರ್ಯದರ್ಶಿ, ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇವರನ್ನು ಸರ್ಕಾರಿ ಸೇವೆಯಲ್ಲಿ ಮುಂದುವರೆಸುವುದು ಸೂಕ್ತವಲ್ಲವೆಂದು ತೀರ್ಮಾನಿಸಿ, ಸದರಿಯವರಿಗೆ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ(ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957 ರ ನಿಯಮ 8 ರಡಿಯಲ್ಲಿ ಕpಣ ದಂಡನೆಯನ್ನು ವಿಧಿಸಲು ತೀರ್ಮಾನಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಶ್ರೀಮತಿ ಸುಧಾತಾಯಿ ಎನ್. ಹಿರೇಮನಿ, ಸಹಾಯಕ ನಿರ್ದೇಶಕರು, ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಶಿರಸಿ, ಹಿಂದಿನ ಕಾರ್ಯದರ್ಶಿ, ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿ, ಬಾಗಲಕೋಟೆ ಇವರನ್ನು ಸರ್ಕಾರಿ ಸೇವೆಯಲ್ಲಿ ಮುಂದುವರೆಸುವುದು ಸೂಕ್ತವಲ್ಲವೆಂದು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿ ಇವರನ್ನು ಈ ಕೂಡಲೇ ಜಾರಿಗೆ ಬರುವಂತೆ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವೆಗಳು (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957 ರ ನಿಯಮ 8(viii) ರನ್ವಯ ಸರ್ಕಾರಿ ಸೇವೆಯಿಂದ ವಜಾಗೊಳಿಸುವ ದಂಡನೆಯನ್ನು ವಿಧಿಸಿ ಆದೇಶಿಸಲಾಗಿದೆ.

Whereas the draft of the "Bangalore Metropolitan Planning Committee Rules, 2013" which the Government of Karnataka proposes to make in exercise of the powers conferred by section 503B read with section 421 of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977), was published as required by sub-section (1) of section 421 of the said Act, vide notification No. UDD 356 MNJ 2005(P) Dated: 07-11-2013 in part IV-A No. 1258 of the Karnataka Gazette Dated: 07-11-2013 inviting objections or suggestions from all the persons likely to be affected within fifteen days from the date of its publication in the official Gazette. However in order to give wide publication and more opportunities for any objections and suggestions, the State Government extended the period specified above by another 15 days vide Notification No. UDD 356 MNJ 2005(P) Dated: 22-11-2013 published in the official Gazette Dated: 22.11.2013.

And whereas, the said Gazette was made available to the public on 07.11.2013.

And whereas, objections and suggestions received in this behalf have been considered by the State Government. Now, therefore, in exercise of the powers conferred by section 503B read with section 421 of the Karnataka Municipal Corporation Act 1976(Karnataka Act 14 of 1977), the Govt. of Karnataka hereby make the following rules, namely

RULES

1. Title, Extent and commencement.- (1) These rules may be called the Bangalore Metropolitan Planning Committee Rules, 2013.

(2) These rules extends to the Bangalore Metropolitan Area.

(3) These rules shall come into force from the date of their publication in the official Gazette.

2. Definitions.- In these rules, unless the context otherwise requires,-

(a) 'Act' means the Karnataka Municipal corporations Act, 1976 (Karnataka Act 14 of 1977);

(b) "Committee" means the Bangalore Metropolitan Planning Committee constituted under rule 3 of these rules for the Bangalore Metropolitan area.

3. Constitution of the Metropolitan Planning Committee.-(1) As soon as may after the declaration of the Bangalore metropolitan area, the Government may by notification constitute a Bangalore Metropolitan Planning Committee for Bangalore metropolitan area.

(2) The committee so established under sub-rule (1) shall consists of the following thirty members, namely:-

(a) Ten members nominated by the State Government, namely:-

(i) The Chief Minister,

- Member (ii) The Minister for Urban Development

- Member (iii) The Principal Secretary to Government, Urban Development - Member

- Member (iv) One Representative of Government of India (Chief Town Planer,

Town and Country Planning Organization).

- Member (v) Commissioner, Bangalore Metropolitan Region Development

Authority, (B.M.R.D.A)

(vi) Commissioner, Bruhat Bangalore Mahanagara Palike (B.B.M.P) - Member (vii) Chairman, Bangalore Water Supply and Sewerage Board - Member (viii) Director, Town and Country Planning Department.

- Member (x) Commissioner, Bangalore Development Authority

- Member Secretaryಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜನವರಿ ೧೬, ೨೦೧೪ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರಿಕೆ ೨೩೪ (b) Eighteen members of the committee shall be elected by and from amongst the elected members of the Urban Local Authorities Bruhat Bangalore Mahanagara Palike and Municipalities and 2 members elected by and from amongst the Adyakshas and Upadyakshas of Zilla Panchayat, Taluk Panchayat and Grama Panchyats within the metropolitan area. The election shall be held by the Karnataka State Election Commission.

(c) Special Invitees.- Two persons out of eminent Economists and professional having experience in Town Planning nominated by the State Government shall be special invitees.

(d) Permanent Invitees.- All the members of the House of the people and the State Legislative Assembly whose constituencies lie within the Bangalore Metropolitan area and members of the Council of States and the State Legislative council who are registered as electors in such area shall be permanent invitees.

(e) Chairperson of the committee shall be chosen among the members.

(3) The Commissioner of Bangalore Development Authority (BDA) shall convene the meetings of the committee.

4. Terms of office of members of the Committee.- (1) The tenure of the elected member of Committee shall run concurrently with that of Bruhat Bangalore Mahanagara Palike or Municipality or Panchayat of which he is a member as the case may be;

(2) Casual vacancy in the Committee arising out of death, resignation removal or otherwise, shall be filled in by election or nomination within a period of six months from the date of occurrence of vacancy, as the case may be, and any member elected or nominated to fill such a vacancy shall hold office for the remainder period:

Provided that when the remainder period is less than six months, it shall not be necessary to hold any election.

(3) An elected member may resign from a Committee by writing under Resignation of the member his hand addressed to hold any election.

5. Meetings of the Committee.- (1) The committee shall meet as and when necessary and at least once in three months or at such times and places as the Chairperson may determine in this behalf and shall observe such procedure to the transaction of its business at such meetings.

(2) If Chairperson of the Committee for any reason is unable to act, members shall elect from amongst the other members a chairperson who shall act as Chairperson for that meeting.

(3) The quorum necessary for the transaction of business at a meeting shall be two third of the total members.

(4) All questions at any sitting of the committee shall be determined by a majority of votes of the members present and voting. In case of equality of votes on any question, the Chairperson shall have casting vote.

6. Removal of members.- The State Government may, by notification in the Official Gazette, remove from office a non- official member of the Committee:-

(a) If he has any pecuniary interest in the schemes or works included in the plans and schemes prepared by the urban local authorities or rural local authorities in the Metropolitan area;

(b) If he is convicted for an offence involving moral turpitude punishable under the provisions of any law for the time being in force; or if he, upon the trial of election petition, is found guilty of corrupt practice.

7. Staff of the Metropolitan planning committee.- The Bangalore Development Authority shall provide Secretariat Assistance to the Committee. The Bangalore Development Authority may appoint such number of other officers and employees including experts for technical, work as may be necessary, for the efficient performance of its functions and may determine their designations and grades.

8. Constitution of Sub-committee.- The committee may constitute the sub-committees for such purpose as it may think fit, sub committees consisting wholly of members of the committee or wholly of other persons or partly of members of the committee and partly of other persons as it may consider necessary or expedient.

9. Functions of the Metropolitan Planning Committee.- (1) The committee shall perform such functions relating to planning and co-ordination for the Bangalore Metropolitan area as the Government may, by notification, assign to it.

(2) The committee shall, in preparing the draft development plan,-

(a) have regard to,-

(i) the plans prepared by the local Authorities in the Metropolitan area;

(ii) matters of common interest between the urban local authorities and the rural local authorities, including co-ordinated spatial planning of the area, sharing of water and other physical natural resources, the integrated development of infrastructure and environmental conservation;

(iii) the overall objectives and priorities set by the Government of India and the State Government; (iv) the extent and nature of investments likely to be made in the Metropolitan area by agencies of the Government of India and of the State Government and other available resources, whether financial or otherwise;

(v) Consult such Institutions and Organizations as the Government may specify by, Order.

(b) Also indicate policies, strategies and priorities and major projects for a plan period of five years having due regard to,-

(i) Physical and natural resource potentials and their utilization;

(ii) Natural Hazard prone areas;

(iii) Poverty alleviation and employment in both formal and informal sectors;

(iv) Development of trade, commerce and industry;

(v) Rural development;

(vi) Metropolitan area level transportation system including mass transport;

(vii) Integrated infrastructure development covering water, energy, sanitation, education, health, recreation, communication and other utilities facilities and Services;

(viii) Housing and Shelter development programme;

(ix) Population assignment and settlement pattern of rural service centres as well as small, medium and large urban centres and their functional specialisation;

(x) Protection of environmentally and ecologically sensitive areas and conservation of heritage;

(xi) Generalised Land use;

(xii) Fiscal resource requirements and its mobilisation including the extent and nature of investments likely to be made in the metropolitan area by agencies of the Government of India and the State Government;

(xiii) Development of special areas, if any, such as new towns, industrial townships, etc;

(xiv) Phasing of the metropolitan area perspective plan in periods of five years preferably co-terminus with the state five year plan; and

(xv) Any other particulars and details as may be considered necessary by the committee and as may be directed by the Government.

10. Preparing draft Development plan.-1. (a) Formulate metropolitan area draft development plan within one year from the date of constitution of the committee having regard or under preparation under sub-rule (2) of rule 9 and development goals, objectives and priorities for the plan period as well as the fiscal resources and central and state Government investment policies and programmes incorporating,-

(i) all or any matters mentioned in sub-rule (2) of rule 9;

(ii) phasing of the metropolitan area development plan into five annual plans by sectoral programmes, projects and schemes indicating physical targets and fiscal requirements; and

(iii) any other particulars and details as may be considered necessary by the committee or as may be directed by the Government.

(b) Prepare metropolitan area annual plan within the framework of approved metropolitan area development plan having regard to findings of review of fiscal and physical performance of the previous annual plan.

(c) Consult such institutions and organizations as the Chamber of Commerce and Industry, non-Governmental organizations' including professional bodies as, Institute of Town Planners of India in the formulation of metropolitan area plans as the Government may determine in this behalf;

(d) Monitor the physical achievements of the investments made by the various planning and development authorities on annual basis and submission of report thereon to the Government;

(e) Resolve conflicts arising out of overlapping functions of planning and development authorities and rural local bodies:

(f) Advise the local authorities on their up-gradation of status and alteration of boundaries;

(g) Sort-out matters relating to sharing of water and other physical and natural resources;

(h) Formulate policies and identify projects for integrated development of metropolitan area level infrastructure and facilitate their implementation through public or private agencies;

(i) Serve as a nodal agency for disbursement of such funds as the Government may determine, to the local planning and development authorities; and

(j) Perform any other incidental, supplemental and consequential function or as prescribed or as may be directed by the Government or as may be necessary and required for the purposes of carrying out its functions under these rules.

(2) The Chairman of the Committee shall forward the draft development plan, as recommended by the committee, to the Government.

(3) The Committee shall have powers to formulate guidelines for preparation of draft plan, which shall be followed by the local authorities while formulating their own plans.

(4) The accounts of all receipts and expenditure of the Committee for the purpose of conduct of meetings and discharge of their function shall be governed by Financial Code and other related Rules.

11. Preparation and Approval of Metropolitan Area draft Development Plan.- (1) The committee shall prepare a metropolitan area draft development plan for a period of five years preferably coterminous with the State Five Year Plan, and a report thereon and shall publish the same by a notice in at least one local newspaper indicating the place or places where the metropolitan area development plan shall be available for inspection by the public inviting objections and suggestions in writing from any person in respect of the said plan within a period of thirty days from the date of publication of the aforesaid notice.

(2) Simultaneously with the publication of notice under sub-rule (1), the committee shall appoint a Hearing Committee consisting of not more than five of its members including the metropolitan planning member, who will give hearing to all such persons who have made a request in writing for being so heard and submit their report to the metropolitan planning committee within a period of sixty days from the date of expiry of notice under sub-rule (1).

(3) The committee shall, within thirty days from the date of receipt of the report of the Hearing Committee under sub- rule (2) resolve to effect such modifications, as may be considered necessary, and thereafter the Metropolitan Area draft Development Plan together with the objectives received under sub-rule (2) and the report of the Hearing Committee under sub- rule (2) shall be submitted to the Director of Town and Country Planning, Bangalore Metropolitan Region Development Authority and the Government.

(4) The Government shall, within sixty days of the receipt of the Metropolitan Area draft Development Plan under sub-rule (3) in consultation with the Director of Town and Country Planning approve the same with or without modifications.

(5) As soon as may be, but not later than thirty days, after the draft development plan of the metropolitan area has been approved by the Government, the committee shall publish a notification in Official Gazette and in atleast two local newspapers, stating that the Development Plan of the metropolitan area has been approved and mentioning the place or places where a copy of the metropolitan area development plan may be inspected at reasonable hours and that copies thereof or an extract there from certified to be correct shall be available for sale to the public at a reasonable price.

(6) The metropolitan area development plan shall come into operation from the date of its publication in the Official Gazette. Simultaneously with the publication of metropolitan area development plan in the Official Gazette under sub-rule (5), the committee shall forward a copy thereof to each of the concerned planning and development authorities and the local authorities at the district level falling within the metropolitan area, who shall take necessary steps to obtain such sums of money as allocated to them under Central or state sector through the process of formulation of annual plans, schemes and projects within the framework of the approved metropolitan area development plan

12. Review and revision of the metropolitan area development plan.- Immediately after the expiry of three years from the date of approval of the metropolitan area, development plan under sub-rule (4) of rule 11, but not later than one year the metropolitan planning committee shall review such plan and prepare a fresh metropolitan area development plan for the next five years commencing from the date of expiry of such plan in force after incorporating such modifications and amendments, as may be considered necessary and submit it for approval as laid down in rule-11.

13. Modifications to development plan of metropolitan area.- (1) Notwithstanding anything contained in rule 12 development plan of a metropolitan area may be modified at any time and for this propose, the committee shall publish a draft of the proposed modifications by a notice in at least one local newspaper inviting objections and suggestions from the public within thirty days from the date of the aforesaid publication of the notice, and after giving an opportunity of hearing to such persons who have made request of being heard and after considering such objections and suggestions finalise the modifications and submit the modifications together with the objection and report of the hearing committee to the Board or the Government, as the case may be.

(2) The Government, as the case may be, may approve the modifications with or without variations or refuse to approve the modifications by a notification in the Official Gazette and publish in atleast one local newspaper.

Provided that no such modifications shall, as proposed be approved by the board or the Government as the case may be, unless they are in public interest and are notified to the public.

14. Directions by the State Government.- (1) The Government may, from time to time issue such directions to the committee as it may deem fit, for giving effect to the provisions of this rules and it shall be the duty of the committee to comply with such directions.

(2) If any doubt arises on any point of procedure or otherwise the Chairperson may, if he thinks fit refer the point to the State Government whose decision shall be final.

The final Gradation list of Tahsildar Grade-2 (Group-B) cadre for the period from 01-01-2002 to 31-12-2008 has been published in the Notification No. RD 253 ASD 2008 dated 31-05-2011.

Now it is expedient to publish the Gradation list of Tahsildar Grade-2 (Group-B) as on 01-01-2014 (for the period from 01-01-2009 to 31-12-2013).

On a review of the vacancies which have occurred in Tahsildar Grade-2 (Group-B) cadre due to promotion of Officers to Tahsildar Grade-1, retirement, death while in service and voluntary retirement etc. This gradation list for the period from 01-01-2009 to 31-12-2013 is prepared.

After consideration of the above facts and officers found surplus in the gradation list published as on 31-12- 2008, a provision gradation list in the cadre of Tahsildar Grade-2 as on 01-01-2014 for the period from 01-01-2009 to 31-12-2013 is prepared and published herewith as Annexure-1 and the officers who promoted to Tahsildar Grade-2 but not covered within the quota upto 31-12-2013 and found in excess of the quota as Annexure-2 to this Notification .

The block periods for the purpose of computation of vacancies that have been utilized in the present provisional gradation list have been given in the statement appended to this Notification as Annexure-3.

Aggrieved persons, if any, may submit their objections/suggestions against the provisional gradation list to the Principal Secretary to Government, Revenue Department, Karnataka Government Secretariat, 5th floor, Multi Storeyed Building , Dr. BR Ambedkar Veedhi, Bangalore-560 001, within 15 days from the date of publication of this Provisional Gradation list in the Gazettee along with documentary evidence. Objections received beyond the stipulated time will not be considered.

Principles adopted for preparing the Provisional Gradation List of Tahsildar Grade-2 and details regarding the sanctioned cadre strength and the quota rule adopted as per the cadre and recruitment rules.

I Principles adopted :-

(a) While fixing the quota between promotees and direct recruits as prescribed in the C & R Rules at the relevant point of time, substantive vacancies which occurred within the sanctioned cadre strength alone have been considered.

(b) The substantive vacancies occurred during the subsequent period within the sanctioned cadre strength have been classified as promotional and direct recruitment vacancies in accordance with the quota prescribed in the Recruitment rules existed at the relevant point of time.

(c) While assigning positions to the officers in the provisional gradation list against substantive vacancies, the date entry into the cadre has been considered for determining the seniority.

(d) Positions have been assigned to the promotees in the provisional list within the available vacancies as per their quota.

(e) The excess promotee officers appeared in the final gradation list of Tahsildar Grade-2 published in Notification No. RD 253 ASD 2008 dt. 31-5-2011 have been assigned eligibility date in this provisional gradation list.

(f) Since there is no direct recruitment candidates from 2007 to 2013, the substantive vacancies reserved for direct recruitment in each block period have been carried forward wherever there cannot be utilized for non-availability of direct recruit officers.

II Fixation of Cadre Strength :-

In the following orders Tahsildar Grade-2 posts are created and the cadre strength refixed to 474.

ಅಧಿಸೂಚನೆ

ಸಂಖ್ಯೆ: ಗ್ರಾಅಪ 83 ಗ್ರಾಪಂಅ 2013 (ಭಾ-6), ಬೆಂಗಳೂರು, ದಿನಾಂಕ: 01.01.2014.

ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅದಿನಿಯಮ, 1993 (1993 ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ 14) ರ ಪ್ರಕರಣ 311 ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಪ್ರಕರಣ 243(1) ಹಾಗೂ 244 ನ್ನು ಓದಿಕೊಂಡಂತೆ ಪ್ರಕರಣ 311 (1) ರಲ್ಲಿ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಆಯವ್ಯಯ ಮತ್ತು ಲೆಕ್ಕಪತ್ರಗಳು) ನಿಯಮಗಳು, 2006 ನ್ನು ತಿದ್ದುಪಡಿ ಮಾಡಲು ಉದ್ದೇಶಿಸಿರುವಂತೆ ಈ ಕೆಳಕಂಡ ನಿಯಮಗಳ ಕರಡನ್ನು ಈ ಮೂಲಕ ಪ್ರಕಟಿಸಿ, ಸದರಿ ಕರಡು ನಿಯಮಗಳಿಂದ ಭಾದಿತರಾಗಲ್ಪಡುವ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡನ್ನು ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಲಾದ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳ ನಂತರ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ಸೂಚಿಸಲಾಗಿದೆ.

ಸದರಿ ಕರಡು ನಿಯಮಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಮೇಲೆ ನಿಗದಿಪಡಿಸಿದ ಅವಧಿಯು ಅಂತ್ಯಗೊಳ್ಳುವ ಮುನ್ನ ಸರ್ಕಾರದಲ್ಲಿ ಯಾವುದೇ ವ್ಯಕ್ತಿಗಳಿಂದ ಸ್ವೀಕರಿಸಬಹುದಾದ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸಲಹೆಗಳನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ, ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್ ರಾಜ್ ಇಲಾಖೆ, 3ನೇ ಮಹಡಿ, ಬಹುಮಹಡಿ ಕಟ್ಟಡ, ಡಾ: ಬಿ.ಆರ್ ಅಂಬೇಡ್ಕರ್ ವೀಧಿ, ಬೆಂಗಳೂರು-560 001. ಈ ವಿಳಾಸಕ್ಕೆ ಕಳುಹಿಸಬಹುದಾಗಿದೆ.

ಕರಡು ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಆರಂಭ:- (i) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಆಯವ್ಯಯ ಮತ್ತು ಲೆಕ್ಕಪತ್ರಗಳು) (ಎರಡನೇ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2013 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(ii) ಈ ನಿಯಮಗಳು ಅಧಿಕೃತ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ನಿಯಮ 30 ಕ್ಕೆ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಗ್ರಾಮ ಪಂಚಾಯತಿಗಳ ಆಯವ್ಯಯ ಮತ್ತು ಲೆಕ್ಕ ಪತ್ರಗಳು) ನಿಯಮಗಳು, 2006 ರಲ್ಲಿ (ಇನ್ನು ಮುಂದೆ ಸದರಿ ನಿಯಮಗಳು ಎಂದು ಉಲ್ಲೇಖಿಸಲಾಗಿದೆ) ನಿಯಮ 30 ರಲ್ಲಿ

(i) ಉಪ ನಿಯಮ (1) ರಲ್ಲಿ ಪದ ಮತ್ತು ಅಂಕಿಗಳಿಗೆ "ನಮೂನೆ 11" ಕ್ಕೆ "ನಮೂನೆ 11ಎ" ಎಂಬುದನ್ನು ಸೇರಿಸಬೇಕು; ಮತ್ತು

(ii) ಉಪ ನಿಯಮ (6) ರ ನಂತರ ಕೆಳಗಿನದನ್ನು ಸೇರಿಸುವುದು, ಅಂದರೆ:-

"(7) ಸರ್ಕಾರಿ ಜಮೀನಿನಲ್ಲಿ, ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳ ಸ್ವತ್ತಿನಲ್ಲಿ, ಸರ್ಕಾರಿ ಸ್ವಾಮದ್ಯದ ಶಾಸನಬದ್ಧ ನಿಕಾಯ ಅಥವಾ ಸಂಸ್ಥೆಗಳ ಸ್ವತ್ತಿನಲ್ಲಿ ಹೊರತುಪಡಿಸಿ, ಇನ್ನುಳಿದ ಖಾಲಿ ಜಮೀನುಗಳು, ಕಟ್ಟಡಗಳು, ಕಟ್ಟಡಗಳ ಮತ್ತು ಸ್ಥಳವನ್ನು ಒಳಗೊಂಡಂತೆ ಕಟ್ಟಡ ನಿಯಮಗಳನ್ನು ಉಲ್ಲಂಘಿಸಿ ನಿರ್ಮಿತವಾಗಿರುವ ಕಟ್ಟಡಗಳಿಗೆ ಅಥವಾ ಅನಧಿಕೃತ ಬಡಾವಣೆಗಳ ಅಥವಾ ಕಂದಾಯ ಜಮೀನುಗಳ ಅಥವಾ ಕಟ್ಟಡಗಳು ಪೂರ್ಣಗೊಂಡಿರುವ ಬಗ್ಗೆ ದಾಖಲೆಗಳಿಲ್ಲದೆ ಅನುಭವಿಸುತ್ತಿರುವ ಕಟ್ಟಡಗಳ ಮೇಲಿನ ತೆರಿಗೆಗಳನ್ನು ನಿರ್ಧರಿಸಲು ಪ್ರತ್ಯೇಕ ನಿಗದಿತ ನಮೂನೆ 11ಬಿ ಅನ್ನು ಗ್ರಾಮ ಪಂಚಾಯಿತಿಗಳು ನಿರ್ವಹಿಸತಕ್ಕದ್ದು.

3. ನಮೂನೆ 11ಕ್ಕೆ ತಿದ್ದುಪಡಿ.- ಉಲ್ಲೇಖಿತ ನಿಯಮಗಳ ನಮೂನೆ 11 ರಲ್ಲಿ, ಶಿರ್ಷೀಕೆ ಮತ್ತು ನಿಯಮಗಳಲ್ಲಿ ಎಲ್ಲೆಲ್ಲಿ ಉಲ್ಲೇಖೀತವಾಗಿದೆಯೋ ಅಲ್ಲಿ ಪದ ಮತ್ತು ಅಂಕಿ "ನಮೂನೆ 11" ಕ್ಕೆ ಬದಲಾಗಿ "ನಮೂನೆ 11ಎ" ಅನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು.

4. ನಮೂನೆ 11ಬಿ ರ ಸೇರ್ಪಡೆ.- ಉಲ್ಲೇಖಿತ ನಿಯಮಗಳ ನಮೂನೆ 11ಎ ನಂತರ, ಕೆಳಗಿನದನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಅಂದರೆ:-

20…....20…... ನೇ ಸಾಲಿಗೆ ತೆರಿಗೆಗೆ ಒಳಪಟ್ಟ ಕ್ರಮಬದ್ಧವಲ್ಲದ ಆಸ್ತಿಗಳ (ನಿವೇಶನ ಮತ್ತು ಕಟ್ಟಡಗಳಿಗೆ) ಸಂಬಂಧಿಸಿದ ತೆರಿಗೆ ನಿರ್ಧರಣಾ ಪಟ್ಟಿ

NOTIFICATION

No: RDP 83 GPA 2013(P-6), Bangalore, dated: 01.01.2014.

The draft of the following rules further to amend the Karnataka Panchayat Raj (Grama Panchayats Budgeting and Accounting) Rules, 2006 which the Government of Karnataka proposes to make, in exercise of the powers conferred by Section 311 read with sub-section (1) of Section 243 and 244 of the Karnataka Panchayat Raj Act, 1993 (Karnataka Act 14 of 1993), is hereby published as required by sub-section (1) of Section 311 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the official Gazette.

Any objection and suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above will be considered by the State Government. Objections and suggestions may be addressed to the Secretary to Government, Department of Rural Development and Panchayat Raj, M.S. Building, 3rd Floor, Dr. B.R.Ambedkar Veedhi, Bangalroe-560 001.

DRAFT RULES

1. Title and commencement.- (1)These rules may be called the Karnataka Panchayat Raj (Grama Panchayats Budgeting and Accounting) (Second Amendment) Rules, 2013.

(2) They shall come into force from the date of their publication in the official gazette.

2. Amendment of rule 30.- In the Karnataka Panchayat Raj (Grama Panchayats Budgeting and Accounting) Rules, 2006 (hereinafter referred to as the said rules) in rule 30,-

(i) in sub-rule(1), for the word and figures `` Form 11`` the word and figures ``Form 11A`` shall be substituted;

and

(ii) after sub-rule (6), the following shall be inserted, namely:-

``(7) The Gram Panchayat shall maintain in a separate register in form 11B, regarding assessment of taxes for building or vacant land or both including a building constructed in violation of the provisions of taxes for building rules or in an unauthorized layout or in a revenue land or a building occupied without issuance of occupancy or completion certificate except the building constructed illegally in Government land, and belonging to any local body, any statutory body or organization owned or controlled by the Government.``

3. Amendment of Form 11.- In Form-11 of the said rules, in the heading and wherever it occurs for the word and figures "Form – 11" the word and figure "Form – 11A" shall be substituted.

4. Insertion of Form 11B.- After Form-11A of the said rules the following shall be inserted, namely:-
