(h) "Form" means a form appended to these rules;

."Fund" means the Karnataka Electricity Regulatory Commission Fund as provided under Section' 103 the Act. (i) "Government" means the Government of Karnataka;

(J) "Member" means the member of the State Commission;

(k) "Officer" means Officer of the State Commission;

(I) "Regulation" means regulation specified by the State Commission, in exercise of the power under Section 181 of the Act; (m) "Remuneration" means remuneration Payable to the Chairman, Members, Secretary, Officers and employees of the State Commission;

(o) "Salary" means salary to be paid to the Chairman, Member Secretary, Officers and employees of the State Commission;

(p) "Secretary" means secretary of the State Commission;

(q) "Section" means section of the Act;

(r) "State Act" means the Karnataka Electricity Reforms Act, 1999 (Karnataka Act 25 of 2003)

(s) "State Commission" means the Karnataka Electricity Regulatory Commission;

(t) "Treasury" means any Treasury of the State.

3. Insertion of new rule 3A, 3B, 3C, 3D and 3E :- After rule 3 of the said rules, the following new rules shall be inserted, namely:-

"3A. Establishment of the Karnataka Electricity Regulatory Commission Fund :- (1) There shall be a fund called "the Karnataka Electricity Regulatory Commission Fund" as required under sub-section (1) of section 103 of the Act. '

(2) The Commission shall maintain the Fund with any nationalized bank(s) or in P.D. Account in the Treasury.

(3) All amount received by the State Commission by cash, cheques or drafts, as the case may be, shall be deposited into the Fund Account.

3B. Application of Fund :-

(1) The Fund shall be utilized for the purpose specified in the rules and shall meet the expenses of the Commission namely:-

(a) The Salary, allowances and other remuneration of Chairperson, Members, Secretary, Officers and other Employees of the Commission including Retirement benefits, Pension and provident fund as provided in clause (a) of sub-section (2) of section 103 of the Act.

(b) the expenses of the Commission in discharge of its functions under section 86 of the Act as provided in clause(b) of sub- section(2) of section 103 of the Act.

(c) The expenses on objects and for purposes authorized by the Act as provided in clause(c) of sub-section 103 of the Electricity Act.

2) Every Officer incurring or sanctioning expenditure shall be guided by the following principles of financial propriety :-

(a) Every officer of the Commission shall exercise the same vigilance in respect of expenditure incurred out of the fund, as a person of ordinary prudence would generally exercise in respect of expenditure of his own money.

(b) The expenditure shall not prima facie more than the occasion demands.

(c) No Authority shall exercise its power of sanctioning expenditure or pass an order, which will be directly or indirectly to its own advantage.

(d) The amount of allowances, remuneration and concession granted for meeting expenses of a particular type shall be so regulated that they shall not be a source of profit to the recipient.

3) No money shall be drawn from the Fund Account unless the same are immediately required for disbursement.

4) Under no circumstances, any private fund(s) shall be mixed with Fund of the Commission kept in the cash Chest of Bank.

3C. Operation of the Fund :-

1) The Fund Account shall be operated by the Secretary of the State Commission and the Drawing and Disbursing Officer (DDO) to be designated by the Secretary to the Commission in this regard.

2) All moneys, which become due to be paid to the Commission, shall be directly paid into the Fund Account of the Commission at Bangalore. Payment in to the Fund may be by cheque/Bank Draft in favour of DDO of the Commission. Bank Charges, if any, shall be-borne by the depositor. The depositor shall also submit proof of payment of amount directly into the bank to the DDO on the same day.

3) All Petty payments made to the Commission in cash shall be duly numbered and signed, receipts shall be issued to the depositor. An entry of receipt, both in bank and in cash, shall be made in the cashbook on the same day. The amount so received in cash shall be credited to the Fund Account of the Commission at the earliest.

4) As far as practical, all payments from the Funds Account shall be made through cheques payable at Bangalore.

5). At the close of each month, the DDO shall arrange to secure a statement of receipts or payments into the Fund of the Commission from the Bank where the Fund Account of the Commission is maintained. The DDO shall ensure that the figures of receipt and payment made shown in the bank statement, tally with the entries made in the cashbook and other connected records. In case of any discrepancy, reasons thereof shall be arranged to be investigated by the DDO.

6) All cases of mis-classification, incorrect entries or omissions of entries shall be immediately set right. Cases of loss of revenue or embezzlement, if any, noticed during reconciliation, shall immediately be brought to the notice of the Commission.

7) At the close of each month, a monthly trial balance shall be prepared by the DDO.

3D. Budget :- The Commission shall prepare in Form-3 its budget for the next financial year showing the estimated receipts and expenditure of the State Commission and forward the same to the Government.

3E. Investment of Surplus Fund :- Investment of surplus fund shall be made in the Nationalized Bank or Financial Institutions of the State Government or Government of India. The drawing and disbursing Officer shall invest the surplus Funds of the Commission in gainful Short Term or Long Term Deposits to ensure suitable returns on surplus Fund. The income earned on the investment shall be deposited in the Fund of the State Commission."

District and Sessions Judge, Bellary and re-fixes the local limits of the jurisdiction of the court of III Addl. District and Sessions Judge, Bellary (to sit at Hospet), to be the area within the local limits of the entire revenue taluks of Hospet, Hagaribommanahalli, Huvinahadagali and Kudligi in Bellary District.

ಭಾರತ ಸಂವಿಧಾನದ ಅನುಚ್ಛೇದ 371(ಜೆ)ಯ ಅನುಷ್ಠಾನಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಹೊರಡಿಸಿರುವ ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್ ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) ಆದೇಶ 2013ರಡಿಯಲ್ಲಿ ಕಂಡಿಕೆ 13(i)ರನ್ವಯ ಮುಖ್ಯ ವಿದ್ಯುತ್ ಪರಿವೀಕ್ಷಣಾ ಇಲಾಖೆಯ ಕೇಂದ್ರ ಕಛೇರಿಗೆ ಮಂಜೂರಾಗಿರುವ ಹುದ್ದೆಗಳಲ್ಲಿ ವೃಂದಗಳವಾರು ಹೈದ್ರಾಬಾದ ಕರ್ನಾಟಕ ಪ್ರದೇಶದ ವ್ಯಾಪ್ತಿಯ ಸ್ಥಳೀಯ ವ್ಯಕ್ತಿಗಳಿಗೆ ಲಭ್ಯವಿರುವ ಶೇ.8ರಷ್ಟು ಹುದ್ದೆಗಳನ್ನು ಕೆಳಕಂಡಂತೆ ಮೀಸಲಿರಿಸಿ ಅನುಸೂಚಿ-1ರಲ್ಲಿರುವಂತೆ ಈ ಮೂಲಕ ಅಧಿಸೂಚಿಸಲಾಗಿದೆ.

ಭಾರತ ಸಂವಿಧಾನದ ಅನುಚ್ಛೇದ 371(ಜೆ)ಯ ಅನುಷ್ಠಾನಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಹೊರಡಿಸಿರುವ ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್ ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) ಆದೇಶ 2013ರ ಕಂಡಿಕೆ 3 ರನ್ವಯ ಹೈದ್ರಾಬಾದ್ ಕರ್ನಾಟಕ ಪ್ರದೇಶದ ವ್ಯಾಪ್ತಿಯ ಜಿಲ್ಲೆಗಳಲ್ಲಿ ಬರುವ ಮುಖ್ಯ ವಿದ್ಯುತ್ ಪರಿವೀಕ್ಷಣಾ ಇಲಾಖೆಯ ಕಛೇರಿಗಳಿಗೆ ಮಂಜೂರಾಗಿರುವ ಹುದ್ದೆಗಳಲ್ಲಿ ವೃಂದಗಳವಾರು ಹೈದ್ರಾಬಾದ್ ಕರ್ನಾಟಕ ಪ್ರದೇಶದ ವ್ಯಾಪ್ತಿಯ ಸ್ಥಳೀಯ ವ್ಯಕ್ತಿಗಳಿಗೆ ಲಭ್ಯವಿರುವ ಹುದ್ದೆಗಳನ್ನು ಶೇಕಡಾವಾರು ಮೀಸಲಿರಿಸಿ ಕೆಳಕಂಡ ಅನುಸೂಚಿ-2ರಲ್ಲಿರುವಂತೆ ಈ ಮೂಲಕ ಅಧಿಸೂಚಿಸಲಾಗಿದೆ.

ಅನುಸೂಚಿ-1 ಮತ್ತು ಅನುಸೂಚಿ-2ರಲ್ಲಿ ನಮೂದಿಸಿರುವ ಹುದ್ದೆಗಳು ಸ್ಥಳೀಯ ವೃಂದದ (local cadre) ಹುದ್ದೆಗಳಾಗಿರುತ್ತವೆ.

ಗ್ರಾಮ ಪಂಚಾಯಿತಿ/ತಾಲ್ಲೂಕು/ಜಿಲ್ಲಾ ಪಂಚಾಯಿತಿ ಉಪ ಚುನಾವಣೆ 2014ರ ಸಂಬಂಧ ರಾಜ್ಯ ಚುನಾವಣಾ ಆಯೋಗದ ವೇಳಾಪಟ್ಟಿಯಂತೆ ದಿನಾಂಕ: 02-03-2014ರಂದು ದೇವದುರ್ಗ ತಾಲ್ಲೂಕಿನ 4-ಜಾಲಹಳ್ಳಿ ಜಿಲ್ಲಾ ಪಂಚಾಯಿತಿ ಕ್ಷೇತ್ರ ಮತ್ತು 6-ಮದರಕಲ್ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಕ್ಷೇತ್ರಕ್ಕೆ ಜರುಗಲಿರುವ ಉಪ ಚುನಾವಣೆ ನಿಮಿತ್ತ ಕಾನೂನು & ಸುವ್ಯವಸ್ಥೆ, ಶಾಂತಿ ಕಾಪಾಡುವ ಹಿನ್ನಲೆಯಲ್ಲಿ ಹಾಗೂ ಯಾವುದೇ ಕೋಮು ಸೌಹಾರ್ದತೆಯುಂಟಾಗದಂತೆ ನೋಡಿಕೊಳ್ಳುವುದು ಅತಿ ಅವಶ್ಯಕವಾಗಿರುತ್ತದೆ. ಆದುದರಿಂದ 1973ರ ಭಾರತೀಯ ದಂಡ ಪ್ರಕ್ರಿಯೆ ಸಂಹಿತೆಯ (ಕೇಂದ್ರ ಅಧಿನಿಯಮ 2/1974) ಸೆಕ್ಷನ್ 21ರಡಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ರಾಯಚೂರು ಜಿಲ್ಲೆಯ ದೇವದುರ್ಗ ತಾಲ್ಲೂಕಿನ 4-ಜಾಲಹಳ್ಳಿ ಜಿಲ್ಲಾ ಪಂಚಾಯಿತಿ ಕ್ಷೇತ್ರ & 6-ಮದರಕಲ್ ಗ್ರಾಮಪಂಚಾಯಿತಿ ಕ್ಷೇತ್ರದ ವ್ಯಾಪ್ತಿಗೆ ಈ ಕೆಳಕಂಡ ಅಧಿಕಾರಿಯನ್ನು ದಿನಾಂಕ:02-03-2014ರಂದು ವಿಶೇಷ ದಂಡಾಧಿಕಾರಿ (ಸೆಕ್ಟರಲ್ ಮ್ಯಾಜಿಸ್ಟ್ರೇಟ್) ಎಂದು ನೇಮಿಸಲಾಗಿದೆ.

NOTIFICATION NO. UDD 356 MNJ 2005(P), BANGALORE, DATED: 04.03.2014

The draft of the following Rules to amend the Bangalore Metropolitan Planning Committee Rules, 2013 which the Government of Karnataka proposes to make in exercise of the powers conferred by section 503B read with section 421 of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977), is hereby published as required by section 421 of the said act. For the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the Official Gazette.

Any objection or suggestion, which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Additional Chief Secretary to Government, Urban Development Department, Vikasa Soudha, Bangalore- 560 001.

DRAFT RULES

1. Title, commencement and application.-(1) These rules may be called "The Bangalore Metropolitan Planning Committee (Amendment) Rules, 2014".

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of Rule 3.- In rule 3 of the Bangalore Metropolitan Planning Committee Rules, 2013 (hereinafter referred to as the said rules), in sub-rule (2), in clause (b), after the words "shall be held by", the words "the Regional Commissioner in consultation with" shall be inserted.

3. Insertion of new Rule 3A - After rule 3 of the said rules, the following shall be inserted, namely:

"3A. Election Procedure.- (1) Meeting for Election of 18 members of the Committee to be elected from amongst the elected members of the Bruhat Bangalore Mahanagara Palike and for election of 2 members of the Committee to be elected from amongst the Adhykshas & Upadhykshas of Zilla Panchayat, Taluk Panchayat, Grama Panchayat within the jurisdiction of Bangalore Metropolitan Area shall be convened by the Regional Commissioner, Bangalore Division with the co-ordination of the Deputy Commissioner, Bangalore District, the Commissioner of Bruhat Bangalore Mahanagara Palike and the Chief Executive Officer of the Zilla panchayat.

(2) The meeting under sub-rule (1) shall be held and presided over by the Regional Commissioner, Bangalore Division.

(3) Notices of the meeting under sub-rule (1) shall be sent by the Regional Commissioner, Bangalore Division to all the elected members of the Bruhat Bangalore Mahanagara Palike and the Adhyaksha and Upaadhyaksha of Zilla Panchayat, Taluk Panchyat and Grama Panchayats.

(4) Manner of voting at the election, time, place and counting of votes and declaration of results shall be as specified by the Regional Commissioner, Bangalore Division.

(5) Voters lists of the Bruhat Bangalore Mahanagara Palike elected members and Adhyaksha and Upaadhyaksha of Zilla Panchayat, Taluk Panchyat and Grama Panchayat shall be prepared by the Regional Commissioner.

(6) The procedure set out in the Karnataka Municipal Corporation (Election) Rules, 1979 for election of members of the Standing Committees may be adopted by the Regional Commissioner with such modifications as may be necessary for conduct the elections to the Bangalore Metropolitan Planning Committee.

Provided, that the method of voting by secret ballot shall be followed at the Election. Each voter shall have as many votes as the number of seats in the block and no voter shall cast more than one vote in respect of any one candidate.

(7) The Regional Commissioner shall declare the election of the members of the Committee and Grant Certificate of Election and record certificate of election under intimation to the State Election Commission and State Government.

(8) In case of any doubt or ambiguity arising in the process of conducting the elections, the State Government may upon reference to it, issue directions and clarifications as may be considered appropriate.
