ಪ್ರಸ್ತಾವನೆ:-

ಶ್ರೀ ಕೆ.ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ ರಾಮನಗರ ಇವರು ಈ ಹಿಂದೆ ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ ಚಾಮರಾಜನಗರ ಜಿಲ್ಲೆ, ಚಾಮರಾಜನಗರ ಈ ಹುದ್ದೆಯಲ್ಲಿ ಕಾರ್ಯ ನಿರ್ವಹಿಸುತ್ತಿದ್ದಾಗ ಶ್ರೀ ನಜೀರ್ ಅಹಮ್ಮದ್, ಮಾಲೀಕರು, ಎ.ಎನ್.ಎಫ್.ಗ್ರಾನೈಟ್ಸ್ ಕಂಪನಿ, ಚಾಮರಾಜನಗರ ರವರಿಗೆ ಸಂಬಂದಿಸಿದ ಚಾಮರಾಜನಗರ ತಾಲ್ಲೂಕು ಕೊತ್ತಲವಾಡಿ ಗ್ರಾಮದ ಸರ್ವೆ ನಂ. 247 ರಲ್ಲಿ ಗಣಿ ಗುತ್ತಿಗೆ ಪ್ರದೇಶದಿಂದ ಖನಿಜ ಸಾಗಾಣಿಕೆ ಮಾಡಲು ಇವರಿಂದ ಅಕ್ರಮ ಸಂಬಾವನೆ ರೂ.20,000/- ಗಳನ್ನು ಪಡೆಯುವಾಗ ದಿನಾಂಕ:13.09.2005 ರಂದು ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತರ ಬಲೆಗೆ ಸಿಕ್ಕಿದ್ದು ಈ ಬಗ್ಗೆ ಮೈಸೂರು ಲೋಕಾಯುಕ್ತ ಠಾಣೆಯಲ್ಲಿ ಮೊಕದ್ದಮೆ ಸಂಖ್ಯೆ:06/2055 ರಲ್ಲಿ ಲಂಚ ನಿರೋಧ ಕಾಯ್ದೆ 1988ರ ಕಲಂ 7,13(1)(ಡಿ) ರೆ/ವಿ 13(2) ರಡಿ ಪ್ರಕರಣ ದಾಖಲಿಸಿ ಅವರನ್ನು ದಸ್ತಗಿರಿ ಮಾಡಿ ದಿನಾಂಕ:14.09.2005 ರಂದು ಜಾಮೀನು ಮೆಲೆ ಬಿಡುಗಡೆ ಮಾಡಿ ತನಿಖೆ ಕೈಗೊಂಡಿರುವುದಾಗಿ ಇವರ ವಿರುದ್ಧ ವಿಚಾರಣೆಯನ್ನು ಕಾಯ್ದಿರಿಸಿ ಸೇವೆಯಿಂದ ಅಮಾನತ್ತುಗೊಳಿಸುವಂತೆ ಮೇಲೆ(1) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಆಯುಕ್ತರು ಮತ್ತು ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ, ಬೆಂಗಳೂರು ಇವರು ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ, ಚಾಮರಾಜನಗರ ಇವರ ವಿರುದ್ಧ ಮೇಲಿನ ಭ್ರಷ್ಟಾಚಾರದ ಆರೋಪನೆ ಮೇಲ್ನೋಟಕ್ಕೆ ಸಾಬೀತಾಗಿರುವುದರಿಂದ ಪ್ರಕರಣದ ಸುಗಮ ತನಿಖೆಗೆ ಹಸ್ತಕ್ಷೇಪ ಮಾಡುವ ಸಾಧ್ಯತೆಗಳಿರುವುದರಿಂದ ಅವರನ್ನು ಸೇವೆಯಿಂದ ಅಮಾನತ್ತಿನಲ್ಲಿಡುವಂತೆ ಮೇಲೆ(2) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಅಪರ ಪೊಲೀಸ್ ಮಹಾ ನಿರ್ದೇಶಕರು, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಇವರು ಸರ್ಕಾರಕ್ಕೆ ಶೀಫಾರಸ್ಸು ಮಾಡಿರುತ್ತಾರೆ. ಅದರಂತೆ ಮೇಲೆ(3) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸದರಿ ಅದಿಕಾರಿಯವನ್ನು ಸರ್ಕಾರಿ ಸೇವೆಯಿಂದ ಅಮಾನತ್ತುಗೊಳಿಸಲಾಗಿತ್ತು. ತದನಂತರ ಮೇಲೆ (4)ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಅಮಾನತ್ತು ತೆರವುಗೊಳಿಸಿ ಸೇವೆಗೆ ಪುನರ್ ಸ್ಥಾಪಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ (5)ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ ಉಪ ನಿರ್ದೇಶಕರು ಇವರ ವಿರುದ್ಧ ದಾಖಲಾಗಿರುವ ಟ್ರ್ಯಾಪ್ ಪ್ರಕರಣದಲ್ಲಿ ಅಬಿಯೋಜನೆ ಮಂಜೂರಾತಿ ನೀಡುವಂತೆ ಕೋರಿದ್ದು, ಅದರಂತೆ ಮೇಲೆ(6) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸದರಿಯವರು ಎಸಗಿರುವ ಶಿಕ್ಷಾರ್ಹ ಅಪರಾಧಕ್ಕಾಗಿ ಸಕ್ಷಮ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಅಬಿಯೋಜನೆಗೊಳಿಸಲು ಮಂಜೂರಾತಿ ನೀಡಲಾಗಿತ್ತು.

ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು ಇವರ ವಿರುದ್ಧ ಪ್ರಧಾನ ಜಿಲ್ಲಾ ಮತ್ತು ಸತ್ರ ನ್ಯಾಯಾದೀಶರ ನ್ಯಾಯಾಲಯ, ಮೈಸೂರು ಇಲ್ಲಿ ವಿಶೇಷ ಪ್ರಕರಣ ಸಂಖ್ಯೆ:20/2007 ರಲ್ಲಿ ಮಾನ್ಯ ನ್ಯಾಯಾಲಯವು ದಿನಾಂಕ:25.11.2011 ರಂದು ಲಂಚ ನಿರೋಧಕ ಕಾಯ್ದೆ 1988ರ ಕಲಂ 7 ರಡಿ ಒಂದು ವರ್ಷ ಸಾದಾ ಸಜೆ ಹಾಗೂ ರೂ. 10000.00 ದಂಡ ಮತ್ತು ದಂಡ ಕಟ್ಟಲು ತಪ್ಪಿದಲ್ಲಿ 3 ತಿಂಗಳ ಸಾದಾ ಸಜೆ ಹಾಗೂ ಕಲಂ 13 (1)(ಡಿ) ಸಹವಚನ 13(2) ರಡಿ 3 ವರ್ಷ ಸಾದಾ ಸಜೆ ಮತ್ತು ರೂ. 15,000-00 ದಂಡ, ದಂಡ ಕಟ್ಟಲು ತಪ್ಪಿದಲ್ಲಿ 6 ತಿಂಗಳ ಸಾದಾ ಸೆರೆಮನೆ ಶಿಕ್ಷೆ ಅನುಭವಿಸುವಂತೆ ತೀರ್ಪು ನೀಡಿರುವುದಾಗಿ ಅಪರ ಪೊಲೀಸ್ ಮಹಾ ನಿರ್ದೇಶಕರು, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ಇವರು ಮೇಲೆ (7) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಸರ್ಕಾರಕ್ಕೆ ವರದಿ ಮಾಡಿರುತ್ತಾರೆ.

ಈ ಮಧ್ಯೆ ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಇವರು ಮಾನ್ಯ ಲೋಕಾಯುಕ್ತ ಪ್ರಧಾನ ಸೆಷನ್ಸ್ ನ್ಯಾಯಾಲಯ ಇಲ್ಲಿ ದಾಖಲಾದ ವಿಶೇಷ ಪ್ರಕರಣ ಸಂಖ್ಯೆ:20/2007 ರಲ್ಲಿ ದಿನಾಂಕ:21.11.2011 ರಂದು ನೀಡಲಾದ ತೀರ್ಪನ್ನು ಪ್ರಶ್ನಿಸಿ ರಾಜ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಕ್ರಿಮಿನಲ್ ಅಪೀಲು ಸಂಖ್ಯೆ:1184/2011 ನ್ನು ದಾಖಲಿಸಿರುತ್ತಾರೆ. ಈ ಸಂಬಂಧ ಮಾನ್ಯ ರಾಜ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯವು ದಿನಾಂಕ:24.11.2011 ರಂದು ನೀಡಿದ ತೀರ್ಪಿನಲ್ಲಿ ಕೆಳ ನ್ಯಾಯಾಲಯವು ದಿನಾಂಕ:21.11.2011 ರಂದು ನೀಡಿದ ತೀರ್ಪಿನ ಶಿಕ್ಷೆಯನ್ನು ಅಮಾನತ್ತಿನಲ್ಲಿಟ್ಟು ಆದೇಶಿಸಿದೆ.

ಉಪ ನಿಬಂಧಕರು, ವಿಚಾರಣೆಗಳು-4 ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ ಇವರು ಮೇಲೆ (8) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಶ್ರೀ ಕೆ.ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ, ಚಾಮರಾಜನಗರ ಇವರ ವಿರುದ್ದ ಶ್ರೀ ನಸೀಬ್ ಅಹ್ಮದ್ ಇವರು ಸಲ್ಲಿಸಿದ ದೂರು ಆದಾರದ ಮೇರೆಗೆ ಲೋಕಾಯುಕ್ತರು ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ ಕಾಯ್ದೆ ಸೆಕ್ಷನ್ 7(2)ರ ಅಡಿ ಸ್ವಯಂ ವಿಚಾರಣೆ ನಡೆಸಿ ತನಿಖಾ ವರದಿಯನ್ನು ಸದರಿ ಕಾಯ್ದೆಯ ಸೆಕ್ಷನ್ 12(3) ರಡಿ ಸೆಕ್ಷಮ ಪ್ರಾದಿಕಾರಕ್ಕೆ ವರದಿ ಮಾಡಿದ್ದು, ಇವರ ವಿರುದ್ದ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು 1957ರ ನಿಯಮ-14ಎ ರಡಿ ಕpಣ ದಂಡನೆ ವಿದಿಸಲು ಮುಂದಿನ ವಿಚಾರಣೆಗಾಗಿ ಲೋಕಾಯುಕ್ತಕ್ಕೆ ವಹಿಸುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

ಕ್ರಿಮಿನಲ್ ಪ್ರಕರಣಗಳಿಗೆ ಸಮಾನಾಂತರವಾಗಿ ಇಲಾಖಾ ಶಿಸ್ತು ಕ್ರಮ ಜರುಗಿಸಲು ಸರ್ಕಾರಕ್ಕೆ ಅವಕಾಶವಿರುವುದರಿಂದ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು 1957ರ ನಿಯಮ-14ಎ ರಡಿ ಈ ಪ್ರಸ್ತಾವನೆ ಪರಿಶೀಲಿಸಿ ಸದರಿ ನಿಯಮಗಳಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅದಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕೆ. ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ,ಇವರ ವಿರುದ್ಧದ ಆರೋಪಗಳ ಬಗ್ಗೆ ಸತ್ಯಾಸತ್ಯತೆ ಕಂಡುಕೊಳ್ಳಲು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ(ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 14(ಎ) ರಡಿ ಮೇಲೆ(9)ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಮಾನ್ಯ ಲೋಕಾಯುಕ್ತಕ್ಕೆ ವಹಿಸಲಾಗಿತ್ತು.

ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತರು, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ, ಬೆಂಗಳೂರು ಇವರು ಮೇಲೆ(10) ರಲ್ಲಿ ಸಲ್ಲಿಸಲಾದ ವರದಿಯಲ್ಲಿ ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ ಉಪ ನಿರ್ದೇಶಕರು, ಇವರ ವಿರುದ್ಧ ಇಲಾಖಾ ವಿಚಾರಣಾದಿಕಾರಿಗಳಾದ ಅಪರ ನಿಬಂಧಕರು, ವಿಚಾರಣೆಗಳು-3, ಕರ್ನಾಟಕ ಲೋಕಾಯುಕ್ತ ಇವರು ಸಲ್ಲಿಸಿದ ಇಲಾಖಾ ವಿಚಾರಣಾ ವರದಿಯಲ್ಲಿ ಆರೋಪಗಳು ದೃಡಪಟ್ಟಿರುವುದರಿಂದ ಈ ಕೆಳಗಿನಂತೆ ಶೀಫಾರಸ್ಸು ಮಾಡಿರುತ್ತಾರೆ.

I am of the opinion that, the penalty provided under Rule 8(Viii) of K.C.S(CC&A) Rules 1957, I.e. dismissal of the DGO Sri. K. Thimmappa from service would be an appropriate penalty. Accordingly I recommend for imposition of the said penalty on the DGO Sri. K. Thimmappa, by Dy. Director, Mines and Geology Department, Chamarajanagar. This punishment in my view would meet the ends of justice.

ಈ ಬಗ್ಗೆ ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತರ ಶಿಫಾರಸ್ಸಿನ ಪ್ರತಿ ಹಾಗೂ ಇಲಾಖಾ ವಿಚಾರಣೆ ವರದಿಯನ್ನು 2ನೇ ಕಾರಣ ಕೇಳುವ ನೋಟೀಸಿನ ಮೂಲಕ ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ ಉಪ ನಿರ್ದೇಶಕರು, ಇವರಿಗೆ ಮೇಲೆ(11) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಜಾರಿ ಮಾಡಿ ಅವರ ಲಿಖಿತ ಸಮಜಾಯಿಷಿ ಹೇಳಿಕೆಗಳನ್ನುವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರಿಕೆ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಮೇ 1, 2014 1541 ಸಲ್ಲಿಸುವಂತೆ ಸೂಚಿಸಲಾಗಿತ್ತು. ಅದಂತೆ ಸದರಿಯವರು ಮೇಲೆ (12) ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ:22.06.2013ರ ಪತ್ರದಲ್ಲಿ ತಮ್ಮ ಲಿಖಿತ ಸಮಜಾಯಿಷಿ ಹೇಳಿಕೆಗಳನ್ನು ನೀಡಿ ಸಾಕ್ಷಿಗಳು ನೀಡುವ ಹೇಳಿಕೆಗಳು ತನಿಖಾದಿಕಾರಿಯ ವರದಿಯು ಒಂದಕ್ಕೊಂದು ತಾಳೆಯಾಗುವುದಿಲ್ಲವೆಂದು ಈ ಟ್ರ್ಯಾಪ್ ಪ್ರಕರಣವು ಕಾನೂನು ಬಾಹಿರವಾಗಿ ದುರುದ್ದೇಶದಿಂದ ಕೂಡಿರುವುದಾಗಿ ಹಾಗೂ ಆರೋಪಗಳನ್ನು ತನಿಖಾದಿಕಾರಿಗಳು ರುಜುವಾತುಪಡಿಸಿಲ್ಲವೆಂದು ಹಾಗೂ ಪ್ರಥಮ ವರ್ತಮಾನ ವರದಿಯನ್ನು ಸಲ್ಲಿಸುವುದಕ್ಕೆ ಮುಂಚೆಯೇ ಟ್ರ್ಯಾಪ್ ಮಾಡಿರುವುದು ಕಾನೂನು ಬಾಹಿರವೆಂದು ಸ್ಥಳ ಪಂಚನಾಮೆ ಮಾಡಿಲ್ಲವೆಂದು ಆರೋಪಗಳಿಂದ ಮುಕ್ತಗೊಳಿಸುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

ಅಪಾದಿತ ಅದಿಕಾರಿಯವರ ಮೇಲೆ ಆಗಿರುವ ಇಲಾಖಾ ವಿಚಾರಣೆ ವರದಿಯ ಮೇರೆಗೆ ಅಪಾದಿತ ಅದಿಕಾರಿಯವರು ನೀಡಿರುವ ಲಿಖಿತ ಸಮಜಾಯಿಷಿಯಲ್ಲಿನ ಅಂಶಗಳನ್ನು ಒಪ್ಪಲು ಸಾಧ್ಯವಿಲ್ಲದ ಕಾರಣ ಹಾಗೂ ಶ್ರೀ ಕೆ. ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು ಇವರ ವಿರುದ್ಧ ಇರುವ ಆರೋಪಗಳು ಗಂಬೀರ ಸ್ವರೂಪದಿಂದ ಕೂಡಿದ್ದು ಹಾಗೂ ಆರೋಪಗಳು ಸಾಬೀತಾಗಿರುವುದರಿಂದ ಸರ್ಕಾರವು ಸದರಿ ಅದಿಕಾರಿಯವರಿಗೆ ಕpಣ ಶಿಕ್ಷೆಯನ್ನು ವಿದಿಸಲು ತೀರ್ಮಾನಿಸಿದೆ.

ಮೇಲೆ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತರು ನೀಡಿರುವ ಶಿಫಾರಸ್ಸನ್ನು ಒಪ್ಪಿ ಅಪಾದಿತ ಅದಿಕಾರಿಯಾದ ಶ್ರೀ ಕೆ.

ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ, ರಾಮನಗರ ಇವರನ್ನು ಸರ್ಕಾರಿ ಸೇವೆಯಿಂದ ವಜಾ ಮಾಡಲು ತೀರ್ಮಾನಿಸಿ ಈ ಆದೇಶವನ್ನು ಹೊರಡಿಸಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಕಾರಣಗಳಿಂದಾಗಿ ಶ್ರೀ ಕೆ.ತಿಮ್ಮಪ್ಪ, ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ, ರಾಮನಗರ ಇವರು ಈ ಹಿಂದೆ ಉಪ ನಿರ್ದೇಶಕರು, ಗಣಿ ಮತ್ತು ಭೂವಿಜ್ಞಾನ ಇಲಾಖೆ ಚಾಮರಾಜನಗರ ಜಿಲ್ಲೆ, ಚಾಮರಾಜನಗರ ಈ ಹುದ್ದೆಯಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿದ್ದಾಗ ಶ್ರೀ ನಜೀರ್ ಅಹಮ್ಮದ್ ಮಾಲೀಕರು, ಎ.ಎನ್.ಎಫ್.ಗ್ರಾನೈಟ್ಸ್ ಕಂಪನಿ, ಚಾಮರಾಜನಗರ ರವರಿಗೆ ಸಂಬಂದಿಸಿದ ಚಾಮರಾಜನಗರ ತಾಲ್ಲೂಕು ಕೊತ್ತಲವಾಡಿ ಗ್ರಾಮದ ಸರ್ವೆ ನಂ. 247 ರಲ್ಲಿ ಗಣಿ ಗುತ್ತಿಗೆ ಪ್ರದೇಶದಿಂದ ಖನಿಜ ಸಾಗಾಣಿಕೆ ಮಾಡಲು ಇವರಿಂದ ಅಕ್ರಮ ಸಂಬಾವನೆ ರೂ.20,000/- ಗಳನ್ನು ಪಡೆಯುವಾಗ ಮಾನ್ಯ ಲೋಕಾಯುಕ್ತಕ್ಕೆ ಸಿಕ್ಕಿಬಿದ್ದಿದ್ದು ಇವರ ವಿರುದ್ಧ ಆರೋಪಗಳು ಇಲಾಖಾ ವಿಚಾರಣೆಯಲ್ಲಿ ದೃಡಪಟ್ಟಿರುವುದರಿಂದ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 8(Viii) ರನ್ವಯ ಸದರಿಯವರನ್ನು ತಕ್ಷಣದಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಸರ್ಕಾರಿ ಸೇವೆಯಿಂದ ವಜಾ ಮಾಡಿದೆ.

Subject: Balancing of roster points and operation of roster consequent to the formation of local cadre, allotment and transfer of local persons to the local cadre in implementing Article 371(J) of the Constitution of India – regarding.

The Karnataka Public Employment (Reservation in Appointments for Hyderabad-Karnataka Region) Order, 2013, provides for the formation of local cadre, allotment and transfer of persons from parent cadre to the local cadre. Detailed operational guidelines are issued in the Karnataka Public Employment (Reservation in Appointments for Hyderabad- Karnataka Region) (Organization of Local Cadre, Allotment and Transfer of Persons) Rules, 2013 as regards the procedure to be followed in this regard.

Consequent to the formation of local cadre, the appointing/cadre controlling authorities are required to identify the local persons from among the incumbents working in the parent cadre. In doing so, the entry in the service register before 01.01.2013 as to their home town or place falling within the local area shall be considered to be the conclusive proof of their domicile. Such of those who qualify for being classified as local persons shall be given an opportunity to opt for being allotted to the local cadre and the lien of such of the incumbents opting for the local cadre, shall be fixed in the local cadre and as such, they move to the local cadre along with their seniority and roster points. This would automatically result in imbalance in reservation, both in the local and residual parent cadres. There would be some representation of roster points in the local cadre, as also some representation of roster points in the residual parent cadres. Hence, there is a dire need to balance the roster points in the immediate process of filling up of the vacant posts either by direct recruitment or by way of promotion in both the cadres. A question arises as to whether to start the rosterಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಮೇ 1, 2014 ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರಿಕೆ 1542 cycle in both the cadres commencing from the first roster point or otherwise in view of the fact that, the local cadre and the residual parent cadre are to be considered as two separate units for the purpose of direct recruitment, promotion, seniority and operation of roster points. In view of the fact, that, there would be some representation of roster points consequent to the allotment of local persons opting for the local cadre from among the incumbents, if the roster commencing from first point is operated, there would be duplication of some of the roster points resulting in over representation. As such, there is a felt need to balance the roster before it is operated on continuous basis. The missing roster points falling in the roster cycle commencing from the first point till the roster point of the last incumbent allotted to the local cadre shall be identified and action would be initiated by the appointing authorities to fill up such of the missing roster points on the same priority in their immediate attempt to fill up the vacant posts, either by way of direct recruitment or by way of promotions. While identifying the missing roster points, the appointing/cadre controlling authorities shall separately identify the missing roster points in respect of direct recruitment and promotional categories.

A typical example of identifying the missing roster points, roster points replacing the missing points in the roster cycle figuring in the local cadre consequent upon the allotment of incumbents to the local cadre is as per the attached annexure.

The appointing/cadre controlling authorities shall operate the roster commencing and ending with 1-100 in respect of direct recruitment posts, in accordance with the details contained in G.O. No. ಸಿಆಸುಇ 08 ಸೆಹಿಮ 95, dated 20.06.1995 and G.O. No. ಸಿಆಸುಇ 97 ಸೆನೆನಿ 2002, dated 22.11.2002 while in respect of promotional posts, the roster commencing and ending with 1-33 shall be operated as detailed in G.O. No. DPAR 22 SBC 79, dated 30.08.1979. The roster points represented consequent to the allotment of the incumbents to the local cadre would comprise of the roster points of both direct recruitment cycle as also the promotional cycles giving the break up of further reservations as detailed in G.O. No. ಸಿಆಸುಇ 97 ಸೆನೆನಿ 2002, dated 22.11.2002 and as such, the missing roster points in both the cycles need to be taken into consideration by segregating direct recruitment category and promotional categories from among the allotment made to the local cadre to arrive at the consolidated missing roster points. The missing roster points so arrived at shall be filled in the immediate appointment to balance the roster. In addition, the roster points not figuring in the roster cycle represented in the local cadre consequent to the allotment shall be setoff/adjusted against the respective roster points while operating the roster subsequently.

The appointing/cadre controlling authorities while taking a view on the option exercised by the incumbents opting for the local cadre, shall accept the option based on the seniority so as to enable to fix the lien in the respective cadres. In the event of the number of local persons opting for the local cadre exceeding the available number of posts/vacancies in the local cadre, the options so exercised shall be accepted based on the seniority to the extent of the available number of posts and the options in respect of other employees shall either be rejected on the grounds that the local cadre is full or the second priority indicated therein be considered (in the case of district, region and State level local cadres) wherever applicable. The option once exercised opting for the local cadre or otherwise is final and is irrevocable.

In the event of local persons not exercising their options within the time frame indicated by the appointing/cadre controlling authorities, it would be presumed that the local person is not interested to join the local cadre and as such would be allotted to residual parent cadre.

It is further clarified that in the event of persons belonging to reserved category, after having selected under the general category on the basis of merit, they would continue to carry the unreserved (General Merit) roster point and in the event of their promotion to the next higher cadre, they would be considered against the reserved roster point applicable to them.

The appointing/cadre controlling authorities shall ensure to fill in the available vacancies in the process of immediate filling up of vacancies by such of the local persons falling under the same missing roster points. In the event of non availability of qualified persons from the feeding cadres falling under the respective categories with in the local cadre, such of the unfilled vacancies are carried forward as backlog vacancies till the next appointment, after which it would be treated as unreserved and filled accordingly from among the residual parent cadre of the local cadre itself. Consequent to the filling up of the missing roster points, the roster in the local cadre as also in the residual parent cadres would be balanced and the appointing/cadre controlling authorities shall operate the roster from the next point immediately falling below the last roster point of the last person allotted to the local cadre as figuring in the roster cycle. The appointing/cadre controlling authorities shall follow the instructions contained in the G.O's issued by DPAR (Service Rules) from time to time as regards the classification of the posts under vertical and horizontal reservations.

The appointing authorities shall comply to the instruction as above while allotting the local persons to the local or residual parent cadres based on their options, initiate action to balance the roster in the next immediate appointment and operate the standard applicable roster cycle thereon continuously.

ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಕಂಇ 253 ಎಎಸ್‌ಡಿ 2008 ದಿನಾಂಕ: 31-05-2011 ರಲ್ಲಿ ಪ್ರಕಟಿಸಲಾದ ತಹಶೀಲ್ದಾರ್ ಗ್ರೇಡ್-2 ವೃಂದದ ಅಂತಿಮ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿ 37 ಅಧಿಕಾರಿಗಳಿಗೆ ಬಡ್ತಿ ಕೋಟಾದಲ್ಲಿ ಅರ್ಹತಾ ದಿನಾಂಕವನ್ನು ನಿಗದಿಪಡಿಸಲು ಅವಕಾಶವಿಲ್ಲದೇ ಹೆಚ್ಚುವರಿಯಲ್ಲಿಡಲಾಗಿದ್ದು, ಈ ಅಧಿಕಾರಿಗಳಲ್ಲಿ ಬಡ್ತಿ ಕೋಟಾದ ಹುದ್ದೆ ಲಭ್ಯವಾದ ದಿನಾಂಕದಂದು ಸೇವೆಯಲ್ಲಿದ್ದ ಅಧಿಕಾರಿಗಳಿಗೆ ಅರ್ಹತಾ ದಿನಾಂಕವನ್ನು ಈ ಜೇಷ್ಠತಾ ಪಟ್ಟಿಯಲ್ಲಿ ನೀಡಲಾಗಿದೆ.

Principles adopted for preparing the Final List of Tahsildar Grade-2 and details regarding the sanctioned cadre strength and the quota rule adopted as per the cadre and recruitment rules.

I Principles adopted :-

(a) While fixing the quota between promotees and direct recruits as prescribed in the C & R Rules at the relevant point of time, substantive vacancies which occurred within the sanctioned cadre strength alone have been considered.

(b) The substantive vacancies occurred during the subsequent period within the sanctioned cadre strength have been classified as promotional and direct recruitment vacancies in accordance with the quota prescribed in the Recruitment rules existed at the relevant point of time.

(c) While assigning positions to the officers in the provisional gradation list against substantive vacancies, the date entry into the cadre has been considered for determining the seniority.

(d) Positions have been assigned to the promotees in the provisional list within the available vacancies as per their quota.

(e) The excess promotee officers appeared in the final gradation list of Tahsildar Grade-2 published in Notification No. RD 253 ASD 2008 dt. 31-5-2011 have been assigned eligibility date in this provisional gradation list.

(f) Since there is no direct recruitment candidates from 2007 to 2013, the substantive vacancies reserved for direct recruitment in each block period have been carried forward wherever there cannot be utilized for non-availability of direct recruit officers.

II Fixation of Cadre Strength :-

In the following orders Tahsildar Grade-2 posts are created and the cadre strength refixed to 474.
