ವಿಷಯ: ಮಾನ್ಯ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ಆದೇಶದನ್ವಯ, ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯಲ್ಲಿನ
ಲೆಕ್ಕಾಧೀಕ್ಷಕರು, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರು ಹಾಗೂ ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕ
ಹುದ್ದೆಗಳನ್ನು ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆ ಮತ್ತು ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರ ಇಲಾಖೆಯಿಂದ ಶೇಕಡ 50:50ರ
ಅನುಪಾತದಲ್ಲಿ ಭರ್ತಿ ಮಾಡುವ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ:
ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (1)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ 05-07-89ರ ಅಧಿಸೂಚನೆಯಲ್ಲಿ, ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳ ಪ್ರಕಾರ ಲೆಕ್ಕಾಧೀಕ್ಷಕರು, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಮತ್ತು ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಹುದ್ದೆಗಳನ್ನು ಪ್ರತಿಶತ 100 ರಷ್ಟು ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರ ಇಲಾಖೆಯ ನೌಕರರಿಂದ ನಿಯೋಜನೆ ಆಧಾರದ ಮೇಲೆ ಭರ್ತಿ ಮಾಡಲಾಗುತ್ತಿದ್ದು, ಈ ನಿಯಮಾವಳಿಗಳ ಪ್ರಕಾರ ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಗೆ ಸೇರಿದ ಯಾವುದೇ ನೌಕರರಿಗೆ ಲೆಕ್ಕ ಅಧೀಕ್ಷಕರ, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಮತ್ತು ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಹುದ್ದೆಗೆ ಬಡ್ತಿ/ವೃಂದ ಬದಲಾವಣೆ ಮೂಲಕ ಭರ್ತಿ ಮಾಡಲು ಅವಕಾಶವಿರುವುದಿಲ್ಲ. ಹಲವಾರು ವರ್ಷಗಳಿಂದ ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯಲ್ಲಿ ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸುತ್ತಿರುವ ನೌಕರರು, ಲೆಕ್ಕಾಧೀಕ್ಷಕರು/ ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕ ಹುದ್ದೆಗೆ ನಿಗದಿಪಡಿಸಲಾದ ಎಸ್.ಎ.ಎಸ್. ಮತ್ತು ಲೋಕಲ್ ಲಾಸ್ ಮತ್ತು ಕಮರ್ಷಿಯಲ್ ಬುಕ್ ಕೀಪಿಂಗ್ ಇಲಾಖಾ ಪರೀಕ್ಷೆಯಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿ ಅರ್ಹತೆ ಹೊಂದಿದ್ದಾಗ್ಯೂ, ಸಹ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳನ್ವಯ ಇಲಾಖೆಯ ನೌಕರರು ಲೆಕ್ಕಾಧೀಕ್ಷಕರು, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಮತ್ತು ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಹುದ್ದೆಗೆ ಬಡ್ತಿ/ವೃಂದ ಬದಲಾವಣೆ ಹೊಂದಲು ವಂಚಿತರಾಗಿರುವುದನ್ನು ಮನಗಂಡು, ನೊಂದ ನೌಕರರು ರಾಜ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ : 19567-571/2009 ನ್ನು ದಾಖಲಿಸಿದ್ದು, ಮಾನ್ಯ ಕರ್ನಾಟಕ ಉಚ್ಛ ನ್ಯಾಯಾಲಯವು ಸದರಿ ರಿಟ್ ಅರ್ಜಿ ಮೇಲೆ ದಿನಾಂಕ 12.09.2012 ರಂದು ನೀಡಿದ ನಿರ್ದೇಶನಗಳನ್ವಯ ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (2)ರ ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರದ ಆದೇಶ ದಿನಾಂಕ 30-10-2012 ರಲ್ಲಿ, ಸಂಬಂಧಪಟ್ಟ ಆಡಳಿತ ಇಲಾಖೆಗಳು ಅರ್ಹ ಲೆಕ್ಕಾಧೀಕ್ಷಕರು, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರು ಹಾಗೂ ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಶೇಕಡ 50ರಷ್ಟು ಬಡ್ತಿಯ ಮೂಲಕ ಭರ್ತಿ ಮಾಡಿಕೊಳ್ಳಲು ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಅಳವಡಿಸಿಕೊಳ್ಳಲು ಹುದ್ದೆಗಳನ್ನು ಗುರುತಿಸಿಕೊಳ್ಳಬಹುದಾಗಿದೆ ಎಂದು ಆದೇಶಿಸಿದೆ.
ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯ ನೌಕರರ ಸೇವಾ ಸಂಘವು, ಸರ್ಕಾರಕ್ಕೆ ಮನವಿ ಸಲ್ಲಿಸಿ ಮಾನ್ಯ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ಆದೇಶ ಹಾಗೂ ಸರ್ಕಾರದ ಆದೇಶ ದಿನಾಂಕ 30-10-2012 ರನ್ವಯ ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯ ಪ್ರಸ್ತುತ ಪರಿಷ್ಕರಿಸುತ್ತಿರುವ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಸದರಿ ಅಂಶಗಳನ್ನು ಅಳವಡಿಸಲು ಕೋರಿರುತ್ತದೆ. ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳನ್ನು ಪರಿಷ್ಕರಣೆ ಬಗ್ಗೆ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಗಳು, ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆ ಇವರ ಅಧ್ಯಕ್ಷತೆಯಲ್ಲಿ ದಿನಾಂಕ 08-12-2011 ರಂದು ನಡೆದ ವೃಂದ ಪುನರಾವಲೋಕನ ಉಪ ಸಮಿತಿ ಸಭೆಯಲ್ಲಿ ಹಾಗೂ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಲೆಕ್ಕಪತ್ರ ಹುದ್ದೆಗಳ ಅನುಪಾತವನ್ನು ಪರಿಷ್ಕರಿಸುವ ಬಗ್ಗೆ ಮಾನ್ಯ ಅಪರ (೭೦೯)ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಮೇ ೮, ೨೦೧೪ ಭಾಗ ೧ ೭೧೦ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿಯವರ ಅಧ್ಯಕ್ಷತೆಯಲ್ಲಿ ದಿನಾಂಕ 22-05-2013 ರಂದು ನಡೆದ ವೃಂದ ಪುನರಾವಲೋಕನ ಸಮಿತಿ ಸಭೆಯಲ್ಲಿ, ಲೆಕ್ಕಾಧೀಕ್ಷಕರು, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಮತ್ತು ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಹುದ್ದೆಗಳನ್ನು ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯಿಂದಲೇ ಬಡ್ತಿ ಮೂಲಕ/ವೃಂದ ಬದಲಾವಣೆ ಮೂಲಕ ಶೇಕಡ 50ರಷ್ಟು ಹುದ್ದೆಗಳನ್ನು ಭರ್ತಿ ಮಾಡಿಕೊಳ್ಳಲು ತೀರ್ಮಾನ ತೆಗೆದುಕೊಳ್ಳಲಾಗಿದೆ.
ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯಲ್ಲಿ 169 ಲೆಕ್ಕಾಧೀಕ್ಷಕರ ಹುದ್ದೆಗಳು, 272 ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರು ಮತ್ತು 255 ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಹುದ್ದೆಗಳೆಂದು ಗುರುತಿಸಲಾಗಿದೆ. ಆದರೆ ಕೆಲವು ವಿಭಾಗ ಹಾಗೂ ಉಪ ವಿಭಾಗಗಳ ಪುನರ್ ಸ್ಥಾಪನೆಯಿಂದ ಕೆಲವು ಹುದ್ದೆಗಳು ಹೆಚ್ಚುವರಿಯಾಗಿದ್ದು ಈ ಅಂಶಗಳನ್ನು ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳಲ್ಲಿ ಅಳವಡಿಸುವ ಬಗ್ಗೆ ಪರಿಶೀಲಿಸಬೇಕಾಗುತ್ತದೆ.
ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ (3)ರ ದಿನಾಂಕ 14-11-2013ರ ಪತ್ರದಲ್ಲಿ ಮುಖ್ಯ ಇಂಜಿನಿಯರ್, ಜಲಸಂಪನ್ಮೂಲ ಅಭಿವೃದ್ಧಿ ಸಂಸ್ಥೆ, ಬೆಂಗಳೂರು ಇವರು, ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆಯಲ್ಲಿ ಲೆಕ್ಕಾಧೀಕ್ಷಕರು, ಪ್ರಥಮ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ಮತ್ತು ದ್ವಿತೀಯ ದರ್ಜೆ ಲೆಕ್ಕ ಸಹಾಯಕರ ವೃಂದದ ಹುದ್ದೆಗಳನ್ನು ಜಲಸಂಪನ್ಮೂಲ ಇಲಾಖೆ ಮತ್ತು ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರ ಇಲಾಖೆಯ ಕಛೇರಿವಾರು ಹುದ್ದೆಗಳನ್ನು 50:50ರ ಅನುಪಾತದಲ್ಲಿ ಹುದ್ದೆಗಳ ಹಂಚಿಕೆ ಬಗ್ಗೆ ಕಛೇರಿವಾರು ಹುದ್ದೆಗಳನ್ನು ಗುರುತು ಮಾಡಿ ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ. ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಸರ್ಕಾರದ ಆದೇಶ ದಿನಾಂಕ 30-10-2012ರಲ್ಲಿನ ನಿರ್ದೇಶನಗಳು ಹಾಗೂ ಮುಖ್ಯ ಇಂಜಿನಿಯರ್, ಜಲಸಂಪನ್ಮೂಲ ಅಭಿವೃದ್ಧಿ ಸಂಸ್ಥೆ, ಬೆಂಗಳೂರು, ಇವರ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸರ್ಕಾರವು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶ ಹೊರಡಿಸಿದೆ.

Preamble:
The Proposal of M/s Saheli Exports Pvt. Ltd., to establish a "70 MW Gas Based Power Plant" at Dhummonsur Village, Humanabad Taluk, Bidar District with an investment of Rs. 350.00 crore, was approved 22nd SHLCC meeting held on 24.05.2010. The Government Order was issued vide Government Order dated: 02.06.2010 read at (2) above.
SubsequentIy, as per he request of the company Government has approved for change of location from Sy. No.49, Dhummonsur Village, Humanabad Taluk, Bidar District to Sy. No.s 66/1, 66/2, 67, 68/A, 69, 70, 72, 78-& 79/A of Sirkatnalli Village, Bidar Taluk & District. The Government Order was issued vide Government Order dated: 23.09.2010 read at (3) above.
Company in their email dated 05.11.2013 has mentioned that the required gas for the project will be allotted by Ministry of Petroleum and Natural Gas, Government of India after obtaining environmental clearance from concerned authorities. The gas pipeline of Reliance Gas Transportation Infrastructure Limited is passing through proposed 70 MW Combined Heat & Power Plant project land.
Now the company has requested extension of time to implement the project. Further, the company has also informed that following effective steps taken for the last two years.
1) The company has entered into the EPC (Engineering, Procurement & Construction) Services Agreement with M/s. SAS -EPC Solution Private Limited, Chennai on 19.07.2010- for civil works.
2) Furnished the copy of letter issued by Deputy Commissioner Bidar for having land is converted as non-agriculture land.
3) Applied with KPTCL for power evacuation for their proposed project.

In view of the above, company has requested for extension of time for further period of 2 years form the date of expiry to implement the project.

Preamble:
The Proposal of M/s MSPL Ltd., to establish "Iron Ore Processing Unit - 7.5 Million TAP, BHQ Beneficiation Plant – 4 Million TPA and Pellet Plant 4.8 Million TPA" with an investment of Rs. 2587.00 crores in 450 acres of land at different Sy. Nos. of Nandibande and 500 acres of land at different Sy. Nos. of Vaddarahalli Villages, Hospet Taluk, Bellary District was approved 17th SHLCC meeting held on 28.01.2009. The Government Order was issued vide Government Order No. CI 50 SPI 2009, dated: 11.08.2009 read at (2) above.
The company vide its letter dated: 02.11.2012 has stated that the mining operations in all mines in Bellary sector had been closed due to Hon'ble Supreme Court orders for the last one and half years and recently the Hon'ble Supreme Court has granted permission for starting mining operations in Bellary, Chitradurga & Tumkur District for certain category of Mines with conditions that the mining operations will be permitted after implementing of rehabilitation and reclamation programmes recommended by CEC. Further Hon'ble Supreme Court has instructed the mining companies to be operated after getting all the statutory permissions from all the concerned department. Because of sudden closer of mines for these period there was financial crunch in the company as the business came to stand still, in the mean time there is huge escalation in prices of land value. The "land owners are demanding exorbitant prices for their lands and the company is making efforts to get the lands at reasonable and justified rate which will make the project viable.
Inspite of adverse scenario and recession in mining companies, they were able to obtain 20% to 30% consent from the land owners by spending huge amount .
In view of the above reasons, the company has requested for some more time to get consent for the balance land and requested for grant of 3 years of time to implement the project.
In the 33rd State High Level Clearance Committee (SHLCC) Meeting held on 19.11 .2013, the proposal of the Company was discussed and approved.
Government has examined the recommendations made by the State High Level Clearance Committee in the 33rd Meeting held on 19.11.2013, in all aspects.

The Government Order was issued vide Government Order No. CI 283 SPI 2009~ dated: 16.11.2009 read at (2) above. The SHLC Committee resolved to recommend Deputy. Commissioner, Raichur to permit company to purchase 105 acres of land at various Sy. Nos. of Wadlur and Yagnur ·Village, Raichur U/s 109 of KLR. Act and conversion of the same thereafter.
The 23rd State High level Clearance Committee Meeting held on 19-06~2010 approved ·modification of land acquisition as suc by KIADB instead of land to be purchased U/s 109 of KLR Act. The company vide their letter dated: 25.10.2012 has requested to grant extension of time for another two years and stated the following steps taken for implementation of the project. "
• Allocation of water is approved by the government "and they are laying pipes from the river to their factory to draw the water and a storage reservoir inside the factory premises which will be completed soon,
• Obtained Environmental Clearance from MOEF.
• Obtained CFE from KSPCB.
• "Obtained site clearance from Factories and Boilers Department and construction is going on.

4. Increase of VAT loan amount from 25% of gross VAT liability to 60% of gross VAT liability and period of loan from 7 year to 15 years.
5. Extension of repayment of VAT loan from 4 annual installments to 8 annual instalments from 8th year to 16th year.
6. Exemption from payment of property taxes to local government body.
7. Exemption from payment towards all approvals fees/deposits related to permanent power supply to BESCOM In the 33rd State High Level Clearance Committee (SHLCC) Meeting held on 19.11.2013, the proposal of the Company was discussed and approved.

The Government Order was issued vide Government Order No. CI 218 SPI 2010, dated: 02.06.2010 read a (2) above.
The SHLC Committee resolved to permit the company to establish the facility in 30 acres of land at Sy. No.69, 70 & 71 A, Belagal Village, Bellary Taluk & District and recommended to Deputy Commissioner Bellary District, to permit the company for purchase of the above land U/s 109 of KLR Act and conversion of the same thereafter.
Now, the company vide their letter dated: 25.10.2012 has stated that the application for grant of permission U/s 109 of KLR Act was submitted long back to DC Bellary District for purchase of land from the land owners and it took a very long time in DC's office and requested for grant of extension of time for two years to implement the project.

The company in its letter dated: 05.012012 had requested the amendment to the Government Order issued on 25.02.2011 with respect to the Sy. Nos. based on the request of the corrigendum to the original Government Order was issued on 10.05.2012.
However, the company had indicated in its letter dated: 15.05.2012 that again Sy. No. 85/3 is missed out in corrigendum. The company requested to include Sy. No. 85/3 which was included in the original Government Order.

Preamble:
The Proposal of M/s Udupi Power Corporation. Ltd., to establish a "2X660 MW Thermal Power Plant" at Yelluru Village, Udupi District with an investment of Rs. 6930.00 crore, was approved 23rd SHLCC meeting held on 19.06.2010. The Government Order was issued vide Government Order No. CI 366 SPI 2010, dated: 15.07.2010 read at (2) above.
Now, the company in their letter dated 18.10.2012 have requested to extend validity of the approval to the project up to December 2014 to enable them to pursue in correct perceptive, the project proposal with various statutory authorities to obtain statutory clearances required for the project.
In the letter they have mentioned that the company has taken following effective steps to implement the project.
• KIADB has acquired 168.10 acres of land, M/s Udupi Power Corporation Ltd., had deposited RS.18.491 crores to KIADB which was towards 100% cost of 168.10 acres of land.
• M/s Udupi Power Corporation. Ltd., has appointed M/s Fichtner as Engineering Consultants to the project to carry out the feasibility report for the project and to do the engineering for firming up plant layout and also B.O.P. system layout.
• M/s Udupi Power Corporation. Ltd., has retained Mis Jeeva Consultancy, Chennai for carrying out feasibility studies and for any augmentation required for CHP and Railway Transportation System from NMPT to project site.
• M/s Udupi Power Corporation Ltd., has also retained services of M/s Development Consultants Private Limited, Kolkata for carrying out the EIA for the proposed expansion.
• Deputy Commissioner, Udupi in email dated 15.06.2013 has submitted the issues need to be sorted by M/s Udupi Power Corporation Ltd. The following issues needs to be addressed by M/s Udupi Power Corporation Ltd.
a) There is no compensation provided to fishermen of the villages through which the water intake and out let pipes are going. The fishermen allege that because of the pipeline which is extended inside the sea, the fish catch has come down especially for the traditional small boat operators. Even though there is no statistical correlation with the presence of pipe line and reduction in fish catch, M/s Udupi Power Corporation Ltd., formally agreed in a meeting chaired by the then Hon'ble CM to give compensation for 300 fishermen two lakhs each as a lum sum. It is still pending,M/s Udupi Power Corporation Ltd., should be directed to take up some projects for the benefit of fishermen (Hospital group insurance etc) or give individual benefits.
b) There were 900 individual applications submitted before the grievances redressal sitting of technical expert committee for replacements of roof sheets, compensation for crop loss, loss due to corrosion of metal parts etc. In some cases the company compensated for the losses. But still pending applications are there.
c) The rehabilitation colony set up the M/s Udupi Power Corporation Ltd., is not developed fully or not up to the mark.
d) The return pipe which takes the salt water back to the sea is still breakable GRP pipes. The technical committee suggested replacing the pipes with MS pipes so that the chances of breages of pipes can be avoided where the possibility of salt water intrusion to paddy fields and the reduction in the fertility can be avoided.
e) Mandatory action like increasing the green belt area to be taken up by the company.
Managing Director, Karnataka Power Transmission Corporation Ltd., has expressed that interest of the state should be protected while according any approval to M/s Udupi Power Corporation Ltd.

Preamble:
The Proposal of M/s Arihant Ispat Pvt. Ltd., to establish a "Integrated Steel Plant - 1,00,000 TPA Capacity with 12 MW Captive Power Plant" with an investment of Rs. 241.96 crores in 125 acres of land Haraginadoni Village, Bellary Taluk, Bellary District was approved 10th and 13th SHLCC meeting held on 28.08.2007 and 13.03.2008. The Government Order was issued vide Government Order No. CI 71 SPI 2008, dated: 02.05.2008 read at (2) above.
SHLCC in is 23rd meeing held on 19.6.2010 approved the request of the company for change of location to Chikkantapura Village, Bellary District and extension of time to implement the project by two years. Accordingly Government Order was issued to the company.
In the 25th SHLCC meeting held on 14.07.2011, the Committee approved to consider and to issue Corrigendum to G.O No.CI 71 SPI 2008, dated 2l.07.2010 by Commerce & Industries Department by mentioning 125 acres of land in place of 100 acres.
Now, the company vide letter dated 26.12.2012 has stated that they have made all efforts to implement the project, but due to pending approvals from Government departments the implementation could not be taken off. Added to this, due to the Hon' ble Supreme Court decision on suspension of mining operations also has caused delay in implementation of the project.
In view of the above, the company has requested to grant another 2 years of extension time to implement the project.
In the 33rd State High Level Clearance Committee (SHLCC) Meeting held on 19.11.2013, the proposal of the Company was discussed and approved.
Government has examined the recommendations made by the State High Level Clearance Committee in the 33rd Meeting held on 19.11 .2013, in all aspects.

The Government Order was issued vide Government Order No. CI 174 SPI 2007, dated:
01.03.2008 read at (2) above.
Now, the Company vide their letter dated: 08.02.2013 has' requested for extension of time for two years to implement the project. It is stated in the letter that they have obtained the following clearances for the project.
• EC from MOEF GOI
• IEM from MOC GOI
• Factory registration certificate, on site emergency plan approval and factory license from the Department of Factories, Boilers, Industrial safety and health.
It is also informed that, after obtaining statutory clearances, they have commissioned the following units at Sidaginamola Village Bellary Taluk & District.

A Corrigendum read at (3) above was issued to correct the increased capacity 3 MMTPA Cement Plant with 150 MW Power Plant.
The company in their letter dated: 30.01.2013 informed that the State Government has issued notification U/s 109 of KLR Act and permitted the company to purchase lands and the company has purchased about 1300 acres of land and paid appropriate amount to the land owners.
The following are the effective steps taken by the company.
(cid:1) The company has been given limestone mining lease for captive use by the state Government.
(cid:1) Consent for establishment from KSPCB is pending.
(cid:1) Environment clearance is granted by MOEF in September 2012.
(cid:1) Company has applied for permission for drawing 1500 KLD of water from Kagina River.
In view of the above company has sought for extension of time by two years to implement the project.

ಮೇಲೆ ಓದಲಾದ ಕ್ರಮಸಂಖ್ಯೆ (4)ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಡಾ|| ಶಾರದಾ ಹೆಚ್. ಹಂಚಿನಾಳ, ಮುಖ್ಯ ವೈದ್ಯಾಧಿಕಾರಿಗಳು, ಸರ್ಕಾರಿ ಆಸ್ಪತ್ರೆ, ರಾಯಬಾಗ, ಬೆಳಗಾವಿ ಜಿಲ್ಲೆ ಇವರ ಲೋಕಾಯುಕ್ತ ಟ್ರ್ಯಾಪ್ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸದರಿಯವರನ್ನು ಸಕ್ಷಮ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಅಭಿಯೋಜನೆಗೆ ಒಳಪಡಿಸಲು ಸರ್ಕಾರದ ಮಂಜೂರಾತಿಯನ್ನು ನೀಡಲಾಗಿತ್ತು.
ಮೇಲೆ ಓದಲಾದ ಕ್ರಮಸಂಖ್ಯೆ (5)ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಡಾ|| ಶಾರದಾ ಹೆಚ್. ಹಂಚಿನಾಳ, ಮುಖ್ಯ ವೈದ್ಯಾಧಿಕಾರಿಗಳು, ಸರ್ಕಾರಿ ಆಸ್ಪತ್ರೆ, ರಾಯಬಾಗ, ಬೆಳಗಾವಿ ಜಿಲ್ಲೆ ಇವರ ದುರ್ನಡತೆ ಬಗ್ಗೆ ಇಲಾಖಾ ವಿಚಾರಣೆ ನಡೆಸಲು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 14(ಎ) ರಡಿ ಮಾನ್ಯ ಉಪಲೋಕಾಯುಕ್ತರಿಗೆ ವಹಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

19-03-2013ರಂದು ಶಿಕ್ಷೆ ವಿಧಿಸಿರುವುದರಿಂದ ಸದರಿಯವರನ್ನು ಸರ್ಕಾರಿ ಸೇವೆಯಿಂದ ವಜಾಗೊಳಿಸುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

65/2011ರಲ್ಲಿ ದಿನಾಂಕ : 19-03-2013ರಂದು ನೀಡಿರುವ ತೀರ್ಪಿನ ವಿರುದ್ಧ ರಾಜ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ಧಾರವಾಡ ಪೀಠದಲ್ಲಿ ಕ್ರಿಮಿನಲ್ ಅಪೀಲ್ ಸಂಖ್ಯೆ : 2592/2013ರಲ್ಲಿ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿದ್ದು. ದಿನಾಂಕ : 10-04-2013 ರಂದು ಗೌ|| ನ್ಯಾಯಾಲಯವು ತಮಗೆ ವಿಧಿಸಿರುವ ಶಿಕ್ಷೆಯನ್ನು ನಿಲಂಬನದಲ್ಲಿಟ್ಟಿದೆ ಮತ್ತು ತಮ್ಮ ಮಕ್ಕಳು ವೈದ್ಯಕೀಯ ಶಿಕ್ಷಣ ಪಡೆಯುತ್ತಿದ್ದು, ಅವರ ಖರ್ಚುಗಳನ್ನು ತಮ್ಮ ವೇತನದಿಂದ ಭರಿಸಬೇಕಾಗಿರುವುದರಿಂದ ತಮ್ಮ ವಿರುದ್ಧ ಯಾವುದೇ ಕ್ರಮ ಕೈಗೊಳ್ಳಬಾರದೆಂದು ಕೋರಿರುತ್ತಾರೆ.
ಗೌ|| ಸರ್ವೋಚ್ಛ ನ್ಯಾಯಾಲಯವು ಕಾಲೇಜು ಶಿಕ್ಷಣ ಉಪನಿರ್ದೇಶಕರು (ಆಡಳಿತ) ಮದ್ರಾಸ್-ವಿರುದ್ಧ-ಎಸ್. ನಾಗೂರ ಮೀರ ಪ್ರಕರಣದಲ್ಲಿ (ಎಐಆರ್ 1995 ಎಸ್‌ಸಿ 1364) ನೀಡಿದ ತೀರ್ಪಿನ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ದಂಡನಾದೇಶವನ್ನು ನಿಲಂಬನೆಯಲ್ಲಿದ್ದರೆ ಅಥವಾ ಮೇಲ್ಮನವಿ ಇತ್ಯರ್ಥದಲ್ಲಿರುವಾಗ ಜಾಮೀನಿನ ಮೇಲೆ ಬಿಡುಗಡೆ ಪಡೆದಿದ್ದಾರೆ ಎಂಬ ಕಾರಣಕ್ಕಾಗಿ ಶಿಸ್ತುಕ್ರಮ ಜರುಗಿಸುವುದನ್ನು ತಡೆಹಿಡಿಯಬೇಕಾದ ಅಗತ್ಯವಿರುವುದಿಲ್ಲ ಎಂದು ಆದೇಶಿಸಲಾಗಿದೆ, ಇಂತಹ ಪ್ರಕರಣಗಳಲ್ಲಿ ಯಾವ ರೀತಿ ಕ್ರಮವಹಿಸಬೇಕೆಂಬ ಬಗ್ಗೆ ಸಿ.ಆ.ಸು. ಇಲಾಖೆಯು ಸುತ್ತೋಲೆ (ಸಂಖ್ಯೆ ಸಿಆಸುಇ 9 ಸೇಇವಿ 95, ದಿನಾಂಕ : 26-06-1996) ಹೊರಡಿಸಿದ್ದು, ಈ ಕೆಳಕಂಡಂತೆ ಸೂಚನೆ ನೀಡಿದೆ.
"ಸಂವಿಧಾನದ ಅನುಚ್ಛೇದ 311(2)ರ ಅಡಿಯಲ್ಲಿನ ಎರಡನೇ ಪರಂತುಕದ ಖಂಡ (ಎ)ಯು 'ಕ್ರಿಮಿನಲ್ ಆರೋಪದ ಮೇಲೆ ದೋಷಸಿದ್ಧಿಯಾಗುವಂತೆ ಮಾಡಿದ ನಡತೆಯ ಬಗ್ಗೆ ಹೇಳುತ್ತದೆಯಾದ್ದರಿಂದ ದೋಷಸಿದ್ಧಿಯಾಗಿರುವುದನ್ನು ನಿಲಂಬನದಲ್ಲಿಡುವ ಪ್ರಶ್ನೆ ಉದ್ಭವಿಸುವುದಿಲ್ಲ. ಆದ್ದರಿಂದ, ಆಪಾದಿತ ಸರ್ಕಾರಿ ನೌಕರನು ಕ್ರಿಮಿನಲ್ ನ್ಯಾಯಾಲಯದ ಆದೇಶದ ವಿರುದ್ಧ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿದ್ದಾನೆ ಅಥವಾ ಇತರೆ ವ್ಯವಹರಣೆ ಹೂಡಿದ್ದಾನೆ. ಅಥವಾ ಮೇಲಿನ ನ್ಯಾಯಾಲಯವು ಕ್ರಿಮಿನಲ್ ನ್ಯಾಯಾಲಯದ ದಂಡನೆ ಆದೇಶವನ್ನು ನಿಲಂಬನದಲ್ಲಿಟ್ಟಿದೆ ಅಥವಾ ಆತನ ಮೇಲ್ಮನವಿ ಇತ್ಯರ್ಥದಲ್ಲಿರುವಾಗ ಜಾಮೀನಿನ ಮೇಲೆ ಬಿಡುಗಡೆ ಪಡೆದಿದ್ದಾನೆ' ಎಂಬ ಕಾರಣಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು, 1957ರ ನಿಯಮ 14(1)ರನುಸಾರ ಕ್ರಮ ಜರುಗಿಸುವುದನ್ನು ತಡೆಹಿಡಿಯಬೇಕಾದ ಅಗತ್ಯವಿಲ್ಲ. ಇಂತಹ ಎಲ್ಲಾ ಸಂದರ್ಭಗಳಲ್ಲಿ ಸೂಕ್ತವಾದ ಕ್ರಮ ಎಂದರೆ, ಒಮ್ಮೆ ಒಬ್ಬ ಸರ್ಕಾರಿ ನೌಕರನು ಕ್ರಿಮಿನಲ್ ನ್ಯಾಯಾಲಯದ ದಂಡನೆಗೆ ಗುರಿಯಾದರೆ, ಆತನು ಸಲ್ಲಿಸಿರಬಹುದಾದ ಮೇಲ್ಮನವಿ ಇತ್ಯರ್ಥವಾಗುವವರೆಗೂ ಕಾಯದೆ ಸಂವಿಧಾನದ ಅನುಚ್ಛೇದ 311(2)ರಡಿಯಲ್ಲಿರುವ ಎರಡನೇ ಪರಂತುಕದ ಸಮರ್ಥನೆ ಪಡೆದಿರುವ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು 1957ರ ನಿಯಮ 14(1)ರನುಸಾರ ಶಿಸ್ತಿನ ಕ್ರಮ ಕೈಗೊಳ್ಳತಕ್ಕದ್ದು. ಇಲ್ಲವಾದಲ್ಲಿ, ಕ್ರಿಮಿನಲ್ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ತೀವ್ರ ಆರೋಪಕ್ಕಾಗಿ ದೋಷಸಿದ್ಧಿಯಾಗಿ ದಂಡನೆಗೆ ಗುರಿಯಾದಂತಹ ವ್ಯಕ್ತಿಯು ಸೇವೆಯಲ್ಲಿ ಮುಂದುವರಿಯಲು ಅವಕಾಶ ಕಲ್ಪಿಸಿದಂತಾಗುತ್ತದೆ. ಆದ್ದರಿಂದ, ಮೇಲ್ಮನವಿ ಆದೇಶವು ಇತ್ಯರ್ಥವಾಗುವುದನ್ನು ಕಾಯುವುದು ಸೂಕ್ತವಲ್ಲ. ಆದರೆ, ಒಂದು ವೇಳೆ ಆಪಾದಿತ ಸರ್ಕಾರಿ ನೌಕರನು ಮೇಲಿನ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಖುಲಾಸೆ (acquit) ಯಾದರೆ, ಶಿಸ್ತು ಪ್ರಾಧಿಕಾರಿಯು ಆದೇಶವನ್ನು ಪರಿಷ್ಕರಿಸಬಹುದು. ಒಂದು ವೇಳೆ ಸರ್ಕಾರಿ ನೌಕರರನ್ನು ಪುನಃ ಸೇವೆಗೆ ತೆಗೆದುಕೊಂಡಲ್ಲಿ, ಆತನು ಸೇವೆಯಲ್ಲಿ ಮುಂದುವರಿದಿದ್ದರೆ ಅರ್ಹನಾಗಿರುತ್ತಿದ್ದಂಥ ಎಲ್ಲ ಸೌಲಭ್ಯಗಳಿಗೂ ಹಕ್ಕುಳ್ಳವನಾಗುತ್ತಾನೆ." ಮೇಲೆ ಓದಲಾದ ಕ್ರಮಸಂಖ್ಯೆ (10)ರ ಪತ್ರದಲ್ಲಿ ಡಾ|| ಶಾರದಾ ಹೆಚ್. ಹಂಚಿನಾಳ, ಮುಖ್ಯ ವೈದ್ಯಾಧಿಕಾರಿಗಳು, ಇವರನ್ನು ಸರ್ಕಾರಿ ಸೇವೆಯಿಂದ ವಜಾಗೊಳಿಸಲು ಕರ್ನಾಟಕ ಲೋಕಸೇವಾ ಆಯೋಗದ ಸಹಮತಿ ಕೋರಲಾಗಿತ್ತು.

ಮುಂದುವರೆದು, ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ದಿನಾಂಕ : 03-03-2014ರ ಪತ್ರದಲ್ಲಿ ಈ ಕೆಳಕಂಡ ಅಂಶಗಳನ್ನು ನಿವೇದಿಸಿರುತ್ತಾರೆ.
ಕರ್ನಾಟಕ ಕೋ ಆಪರೇಟಿವ್ ಉಲನ್ ಟೆಕ್ಸ್‌ಟೈಲ್ ಮಿಲ್ ಲಿ., ಕಮದೋಡ, ರಾಣಿಬೆನ್ನೂರು ಗಿರಣಿಗೆ ಅನುದಾನ ಮಂಜೂರು ಮಾಡುವ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕರ್ನಾಟಕ ತಾಂತ್ರಿಕ ಸಲಹಾ ಸೇವಾ ಸಂಸ್ಥೆ (ಟೆಕ್ಸಾಕ್), ಇವರಿಂದ ಅಪ್ರೈಸಲ್ ಮಾಡಿಸಿದ್ದು, ಅಪ್ರೈಸಲ್ ವರದಿಯನ್ನು ಟೆಕ್ಸಾಕ್ ಸಂಸ್ಥೆಯವರು ನೀಡಿರುತ್ತಾರೆ.
(1) ಸದರಿ ಸಂಸ್ಥೆಯವರ ಅಪ್ರೈಸಲ್ ನಂತೆ :-
• ಸಂಸ್ಥೆಯು 29 ಎಕರೆ ಜಾಗವನ್ನು ಹೊಂದಿದ್ದು, ಇದರಲ್ಲಿ ಉತ್ಪಾದನಾ ಚಟುವಟಿಕೆ ಹಾಗೂ ಕೌಶಲ್ಯ ಅಭಿವೃದ್ಧಿ ಕೇಂದ್ರವನ್ನು ಸ್ಥಾಪಿಸಲು ಉದ್ದೇಶಿಸಲಾಗಿದೆ.
• ಉತ್ಪಾದನಾ ಚಟುವಟಿಕೆಯಲ್ಲಿ ಮುಖ್ಯವಾಗಿ ಕಚ್ಚಾ ಉಣ್ಣೆ ಸಂಸ್ಕರಣೆ, ಉಣ್ಣೆ ನೂಲು ಉತ್ಪಾದನೆ ಹಾಗೂ ಉಣ್ಣೆ ಉತ್ಪನ್ನಗಳ ಸಂಸ್ಕರಣೆ ಒಳಗೊಂಡಿರುತ್ತದೆ.
• ಈ ಉತ್ಪಾದನೆ ಚಟುವಟಿಕೆಯಿಂದಾಗಿ ಸುಮಾರು 75 ಜನರಿಗೆ ಉದ್ಯೋಗ ಅವಕಾಶ ಕಲ್ಪಿಸಿದಂತಾಗುತ್ತದೆ. ಈ ಕೇಂದ್ರದಿಂದ ವಾರ್ಷಿಕ ಸುಮಾರು 3.15 ಲಕ್ಷ ಕೆ.ಜಿ.ಗಳ ಉಣ್ಣೆ ನೂಲು ಉತ್ಪಾದಿಸಲು ಸಹಕಾರಿಯಾಗುತ್ತದೆ. ಅಲ್ಲದೆ ಸುತ್ತಮುತ್ತಲಿನ ಕಂಬಳಿ ನೇಕಾರರಿಗೆ ಉತ್ತಮ ಗುಣಮಟ್ಟದ ನೂಲು ಪೂರೈಕೆಗೆ ಅನುಕೂಲವಾಗುತ್ತದೆ.
• ಕೌಶಲ್ಯ ಅಭಿವೃದ್ಧಿ ಕೇಂದ್ರದಲ್ಲಿ ಉಣ್ಣೆ ಕತ್ತರಿಸುವ, ಕಚ್ಚಾ ಉಣ್ಣೆ ಸಂಸ್ಕರಣೆ, ಕೈಮಗ್ಗ ನೇಯ್ಗೆ, ವಿದ್ಯುತ್ ಮಗ್ಗ ನೇಯ್ಗೆ, ನಿಟ್ಟಿಂಗ್, ಕಸೂತಿ, ಉಣ್ಣೆ ಉತ್ಪನ್ನಗಳ ಅಭಿವೃದ್ಧಿ ಹಾಗೂ ಇತರೆ ತರಬೇತಿ ಕಾರ್ಯಕ್ರಮ ಹಮ್ಮಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಲಾಗಿದೆ.
• ಈ ತರಬೇತಿ ಕೇಂದ್ರದಿಂದ ವಾರ್ಷಿಕ ಸುಮಾರು 1,140 ಫಲಾನುಭವಿಗಳಿಗೆ ತರಬೇತಿ ನೀಡಲು ಉದ್ದೇಶಿಸಲಾಗಿದೆ.

ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಮೇ ೮, ೨೦೧೪ ಭಾಗ ೧ ೭೪೦ಈ ಯೋಜನೆ ಅನುಷ್ಠಾನಗೊಳಿಸುವುದರಿಂದ ಸುತ್ತಮುತ್ತಲಿನ ನೇಕಾರರಿಗೆ ಹೆಚ್ಚಿನ ಅನುಕೂಲವಾಗಲಿದೆ ಎಂದೂ ಯೋಜನೆಯ ಒಟ್ಟು ವೆಚ್ಚವು ರೂ. 755.80 ಲಕ್ಷಗಳಾಗಿರುತ್ತದೆ ಎಂದು ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ವಿವರಿಸಿ, ರೂ. 2.00 ಕೋಟಿಗಳನ್ನು ಬಿಡುಗಡೆ ಮಾಡುವಂತೆ ಶಿಫಾರಸ್ಸು ಮಾಡಿರುತ್ತಾರೆ.
ಪ್ರಸಕ್ತ ಸಾಲಿನಲ್ಲಿ ನೇಕಾರರ ವಿಶೇಷ ಪ್ಯಾಕೇಜ್ ಯೋಜನೆಯಡಿ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆ 2851-00-103-0-62-059ರಡಿ ರೂ. 2.00 ಕೋಟಿಗಳು ಉಳಿತಾಯವಾಗುವ ಸಾಧ್ಯತೆ ಇದ್ದು, ಈ ಮೊಬಲಗನ್ನು ಕರ್ನಾಟಕ ಕೋ ಆಪರೇಟಿವ್ ಉಲನ್ ಟೆಕ್ಸ್ ಟೈಲ್ ಮಿಲ್ ಲಿ., ಕಮದೋಡ, ರಾಣಿಬೆನ್ನೂರು ಗಿರಣಿಗೆ ಬಿಡುಗಡೆ ಮಾಡುವಂತೆ, ಶಿಫಾರಸ್ಸು ಮಾಡಿ ಜವಳಿ ಆಯುಕ್ತರು ಸರ್ಕಾರದ ಆದೇಶಕ್ಕಾಗಿ ಕೋರಿರುತ್ತಾರೆ.
ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರ ಮೇಲ್ಕಂಡ ಪ್ರಸ್ತಾವನೆಗಳನ್ನು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಕಂಡ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ಹಾಗೂ ಜವಳಿ ನಿರ್ದೇಶಕರು, ಜವಳಿ ಇಲಾಖೆ, ಇವರು ಕರ್ನಾಟಕ ತಾಂತ್ರಿಕ ಸಲಹಾ ಸೇವಾ ಸಂಸ್ಥೆ (ಟೆಕ್ಸಾಕ್) ಬೆಂಗಳೂರು, ಸಂಸ್ಥೆಯವರು ಕರ್ನಾಟಕ ಕೋ-ಆಪರೇಟಿವ್ ಟೆಕ್ಸ್‌ಟೈಲ್ಸ್ ಮಿಲ್ಸ್ ನಿಯಮಿತ, ಕಮದೋಡ, ರಾಣಿಬೆನ್ನೂರು, ಹಾವೇರಿ ಜಿಲ್ಲೆ, ಈ ಗಿರಣಿಯ ಕಾರ್ಯ ಯೋಜನೆಯ ಅಪ್ರೈಸಲ್ ವರದಿಯ ಆಧಾರದ ಮೇರೆಗೆ ಸದರಿ ಗಿರಣಿಯು ಈಗಾಗಲೇ ಸ್ಥಾಪಿಸಲು ಉದ್ದೇಶಿಸಿ ಸ್ಥಗಿತಗೊಳಿಸಿರುವ ಕಾಮಗಾರಿಗಳನ್ನು ಮುಂದುವರೆಸಿಕೊಂಡು ಹೋಗಲು, ನೇಕಾರರ ವಿಶೇಷ ಪ್ಯಾಕೇಜ್ ಯೋಜನೆಯಡಿ ರೂ. 2.00 ಕೋಟಿಗಳನ್ನು ಬಿಡುಗಡೆ ಮಾಡಲು ಶಿಫಾರಸ್ಸು ಮಾಡಿ ಸಲ್ಲಿಸಿರುವ ಪ್ರಸ್ತಾವನೆಯ ಪ್ರಕಾರ ರೂ. 2.00 (ರೂಪಾಯಿ ಎರಡು ಕೋಟಿಗಳು ಮಾತ್ರ) ಕೋಟಿಗಳ ಅನುದಾನವನ್ನು ಬಿಡುಗಡೆ ಮಾಡಲು ಸರ್ಕಾರದ ಮಂಜೂರಾತಿ ನೀಡಲಾಗಿದೆ.
ಈ ಅನುದಾನದ ಬಾಬ್ತು ಖರ್ಚನ್ನು ಪ್ರಸ್ತುತ 2013-14ನೇ ಸಾಲಿನ ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆ 2851-00-103-0-62-059ರಡಿ ಉಳಿತಾಯವಾಗಿರುವ ಹಣಕಾಸಿನ ಅವಕಾಶದಿಂದ ಭರಿಸತಕ್ಕದ್ದು.
ಜವಳಿ ಆಯುಕ್ತರು ಶಿಫಾರಸ್ಸು ಮಾಡಿರುವಂತೆ ಈ ಅನುದಾನವನ್ನು ಕಚ್ಚಾ ಉಣ್ಣೆ ಸಂಸ್ಕರಣಾ ಘಟಕ ನಿರ್ಮಾಣ, ನೀರಿನ ತೊಟ್ಟಿ ನಿರ್ಮಾಣ, ಕಚ್ಚಾ ಉಣ್ಣೆ ಸಂಸ್ಕರಣಾ ಯಂತ್ರ ಖರೀದಿ, ಸ್ಪಿನ್ನಿಂಗ್ ಯಂತ್ರೋಪಕರಣ ಖರೀದಿ, ಸಂಪನ್ಮೂಲ ಕೇಂದ್ರ, ಜನರೇಟರ್, ವಿದ್ಯುತ್ ಮತ್ತು ನೀರು ಸಂಪರ್ಕಕ್ಕೆ ಮಾತ್ರ ಖರ್ಚು ಮಾಡತಕ್ಕದ್ದು.
ಕೈಮಗ್ಗ ಮತ್ತು ಜವಳಿ ಇಲಾಖೆಯ ಲೆಕ್ಕಾಧಿಕಾರಿಯವರು ಹಣ ಸಂದಾಯ ಸ್ವೀಕೃತಿಯ ಮೇಲೆ ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ಹಾಗೂ ನಿರ್ದೇಶಕರು, ಕೈಮಗ್ಗ ಮತ್ತು ಜವಳಿ ಇಲಾಖೆ, ಇವರ ಮೇಲು ರುಜುವಿನೊಂದಿಗೆ ಈ ಹಣವನ್ನು ಖಜಾನೆಯಿಂದ ಪಡೆದು ಕರ್ನಾಟಕ ಕೋ ಆಪರೇಟಿವ್ ಉಲ್ಲನ್ ಟೆಕ್ಸ್‌ಟೈಲ್ ಮಿಲ್ ಲಿ., ಕಮದೋಡ, ರಾಣಿಬೆನ್ನೂರು ತಾಲ್ಲೂಕು, ಹಾವೇರಿ ಜಿಲ್ಲೆಯ ಸದರಿ ಗಿರಣಿಗೆ ಸಹಾಯಧನವನ್ನು ಬಿಡುಗಡೆ ಮಾಡತಕ್ಕದ್ದು.
ಈ ಅನುದಾನದ ಮಂಜೂರಾತಿಯು ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ವಿಧಿಸುವ ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಗಳಿಗೊಳಪಟ್ಟಿರುತ್ತದೆ. ಸದರಿ ಯೋಜನೆಯ ಪ್ರಗತಿಯನ್ನು ಕಾಲಕಾಲಕ್ಕೆ ಜವಳಿ ಆಯುಕ್ತರು ಮೇಲ್ವಿಚಾರಣೆ ಮಾಡಿ ಹಂತಹಂತವಾಗಿ ಪ್ರಗತಿ ವರದಿಯನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.
ಸದರಿ ಮೊತ್ತದ ಅನುದಾನದ ಬಳಕೆ ಮಾಡಿರುವ ಬಗ್ಗೆ ಹಣ ಬಳಕೆ ಪ್ರಮಾಣ ಪತ್ರವನ್ನು ಸಲ್ಲಿಸತಕ್ಕದ್ದು.
ಜವಳಿ ಅಭಿವೃದ್ಧಿ ಆಯುಕ್ತರು ಸದರಿ ಮೇಲ್ಕಂಡ ನಿರ್ಮಾಣ/ಯಂತ್ರೋಪಕರಣ ಖರೀದಿ ಮಾಡಲು ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಸಂಗ್ರಹಣೆಗಳಲ್ಲಿ ಪಾರದರ್ಶಕತೆ ಅಧಿನಿಯಮಗಳನ್ವಯ ಯೋಜನೆಯನ್ನು ಅನುಷ್ಠಾನಗೊಳಿಸತಕ್ಕದ್ದು.
ಈ ಆದೇಶವನ್ನು ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಅನಧಿಕೃತ ಟಿಪ್ಪಣಿ ಸಂಖ್ಯೆ : ಆಇ 163 ವೆಚ್ಚ-1/2014, ದಿನಾಂಕ : 26-02-2014ರಲ್ಲಿ ನೀಡಿರುವ ಸಹಮತದನ್ವಯ ಹೊರಡಿಸಲಾಗಿದೆ.
