NOTIFICATION
No. DPAR 51 SFP 2014, Bangalore, Dated: 25th March, 2014.
" In O.A. No. 237/2012 and connected matters filed by IFS officers Association and others before the Hon'ble CAT, Bangalore Bench, the Hon'ble CAT vide its order dated 28-06-2013 while allowing the O.A. has passed the following order in regard to filling up of the vacancies of IFS cadre posts at DCF level:-
1) Annexure A10 and A11 must be reviewed
2) Following the spirit of Rule 9 (2) (a) & (b) as many DCF level posts may be manned by Conservator level officers, who can be spared for the balance vacancies.
3) Following the dictate of Rule 9 (2) (a) & (b) if at all it is felt that there are going to be vacancies at the DCF level and non-cadre officer is to be appointed,' it shall be done only by appointing them in the respective order in the Select List if any first being first and for the balance.
4) If above persons/individuals are also not sufficient to fill up the vacancy then the Government is free to prepare a list of competent eligible persons, draw up a further list among them according to seniority and then only on the basis of such seniority can non-cadre officers be posted into cadre posts.
5) It is the duty of the Government to ensure integrity of the cadre as it is one of the main components of federal structure.
6) As for as possible non-cadre officers shall not be appointed to cadre posts and only in the exceptions and in the method noted above such posts can be filled up by State Government even in case of necessity. This shall be so since the Forest Act and other connected legal matrix imposes heavy responsibility in the level of DCF and above as they are quasi-judicial authorities also under the Act such post shall not be held by persons selected on the basis of personal whims or other immeasurable criteria.
In pursuance of the said order and by following the IFS (Cadre) Rules, 1966 the State Government reviewed the Annexure A-10 and A-11 and transferred and posted 18 SFS officers who are eligible and whose names appeared in the zone of consideration for ೧೬೦೬ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಮೇ ೨೯, ೨೦೧೪ ಭಾಗ ೪ಎ selection to IFS for the select years 2008, 2009, 2010, 2011 and 2012. This was done considering the fact that only SFS officers who are currently in the eligibility list for the Select List can become IFS officers in the near future. The eligibility criteria for inclusion of State Forest Service officers in the zone of consideration to IFS is as follows:-
1) A member of State Forest Service who has completed not less than eight years of continuous service in SFS in the order of seniority.
2) A member of State Forest Service who has not crossed 54 years of age on the 1st day of January of the year for which the Select List is prepared.
Accordingly, by following the Hon'ble CAT order dated 28-06-2013 and also by following the IFS (Cadre) Rules, 1966 the State Government issued the Notification No: DPAR 162 SFP 2013, dated 5-11-2013 transferring and posting 18 SFS officers to IFS Cadre posts.
The above transfer order dated 05-11-2013 of the State Government was challenged before Hon'ble KAT in Application No. 7267/2013 by the aggrieved SFS officers most of whom do not figure in the eligibility list for the select lists of 2008, 2009, 2010, 2011 and 2012. The Hon'ble KAT in its order dated 17-12-2013 while allowing the Applications has quashed the transfer and postings of SFS officers made in Notification No. DPAR 162 SFP 2013, dated 05-11-2013. The operative portion of the said order is re- produced below:
"We make it clear that the Government is at liberty to follow the method suggested by the Hon'ble CAT and infact it is duty bound to see that it is done with a reasonable time. We also make it clear that this order does not come in the way of the Government effecting general transfers in respect of officers of SFS at DCF level as per the transfer guidelines without breaching any direction of the Hon'ble CAT." Further, the Hon'ble KAT vide its order dated 19-12-2013 in the same Application has clarified that this order does not apply to the postings of Sri Banerjee, SFS, Sri M.V. Amarnath, SFS and Sri K.L. Raghavendra, SFS since they have been posted to existing vacancies.
The State Government filed a Writ Petition No. 5539/2014 (S-KAT) before the Hon'ble High Court of Karnataka praying to quash the order of the Hon'ble KAT dated 17-12-2013. The Hon'ble High Court while disposing of the Writ Petition No.5539/2014 (S-KAT) clubbed with others has directed the State Government to re-do the entire list within 31-03-2014 by following the order of Hon'ble CAT dated 28-06-2013 and order of Hon'ble KAT dated 17-12-2013 and IFS (Cadre) Rules, 1966.
In pursuance of the directions of the Hon'ble High Court of Karnataka dated 05-03-2014 in W.P. No. 5539/2014 clubbed with others and in pursuance of para 4 of the operative portion of the Hon'ble CAT order dated 28-06-2013, in O.A. No. 237/2012 & others, the Government of Karnataka basing on officers in the zone of consideration for select lists 2008, 2009, 2010, 2011 and 2012 hereby prepares 'the list of competent eligible persons' for posting them against the IFS Cadre posts at DCF level as under:-

Whereas the draft of the Karnataka General Services (Pre- university Education) (Recruitment) Rules, 2013 was published as required by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No.ED 35 dgo2009 dated 20th March 2013 in part-IV-A of the Karnataka Gazette dated 18th April 2013 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the official Gazette.
And whereas said Gazette was made available to the public on 18th April 2013.
And whereas the objections and suggestions received within the period specified above, have been considered by the Government.
Now therefore in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely:-
RULES
1. Title and commencement.- (1) These rules may be called the Karnataka General Services (Pre- university Education) (Recruitment) Rules, 2013.
(2) They shall come into force on the date of their publication in the official Gazette.
2. Method of recruitment and minimum qualification.-The State Civil Service cadres in respect of the Karnataka General Services ( Pre-university Education) shall consists of the categories of posts with the scales of pay specified in column (2) of the Schedule below, their number, the method of recruitment and the minimum qualification, if any, shall be as specified in the corresponding entries in columns (3), (4) and (5) thereof.
3. Repeal and savings.- (1) The Karnataka General Services ( Pre-university Education) (Recruitment) Rules, 1996 are hereby repealed:
Provided that such repeal shall not,-
(a) affect the previous operation of said rules, notifications and orders or anything done or any action taken there under; or
(b) deprive any right which had accrued under the said rules.

| The Commission or the Authority shall invite applications by advertising vacancies in the Karnataka Gazette, and in more than one widely circulated newspapers of which at least one shall be in the regional language and such other media, as it may deemed fit, specifying the condition of eligibility, the manner of selection, the provisional number of vacancies to be filled and classification, according to Govt. Orders inforce. The Commission or the Authority shall conduct competitive Examination in the form of Objective Multiple Choice Questions. Selection under these rules shall be made by the Commission or the Authority in the order of merit determined only on the basis of marks secured in the competitive examination conducted by the Commission or the Authority. The competitive examination shall consist of two specific papers in the concerned subject and one paper in Kannada Language. (i) The Kannada Language paper shall carry 150 marks and shall be of 3 hours duration. The paper shall be of the standard equivalent to that of First language Kannada at S.S.L.C. level. The syllabus for this paper shall be the same as that of the syllabus for main examination specified in the Karnataka Recruitment of Gazetted probationer's (Appointment by Competitive examination) Rules 1997. The questions shall be of Multiple Choice type. The Candidate shall secure a minimum of 50 marks in order to get eligibility for selection. However the marks secured in the Language paper shall not be considered for the preparation of the merit list. (ii) The specific paper shall consist of the paper 1 and 2, which shall be in the concerned subject in which the candidate has passed the qualifying post graduate examination. Each paper shall carry 150 marks and shall be of 3 hours duration. The Commission or the Authority shall prepare question paper in both Kannada and English versions. The candidate may answer the papers either in Kannada or in English. The valuation of Multiple Choice questions shall be done on the basis of negative marks valuation in case of wrong answers. Quarter mark shall be deducted for each wrong answer. The syllabus for these papers shall be determined by the Commission or the Authority in consultation with the Appointing Authority. The Commission or the Authority shall on the basis of the marks secured in specific subject papers 1 and 2 in the competitive examination and subject to the orders in force from time to time relating to the reservation in appointments or posts, prepare a list of the selected candidates in the order of merit equal to the number of vacancies notified in the same manner specified above. The candidates belonging to the Scheduled Castes, Scheduled Tribes, other Backward classes and General merit shall be selected against vacancy left unfilled in the respective categories. If two or more candidates secure equal marks in the competitive examination the order of the merit of such candidates shall be fixed on the basis of their age, the person older in age being placed above the younger in age. The select list prepared shall be published in the Karnataka Gazette and such other media as the Commission or the Authority may deem fit and a copy thereof shall be sent to the appointing authority concerned. The fact of the selection shall be intimated by the Commission or the Authority to the candidates selected. There shall be no interview or viva voce. The Karnataka Examination Authority shall also prepare an additional list to the extent not exceeding 10% of the vacancies notified. The candidates not included in the main list but the number of candidates to be included in the additional list shall be 10% of the number of candidates in each of the reservation categories (horizontal and vertical) in the main list. There shall at least be one candidate in the additional list belonging to each of the reservation categories (horizontal and vertical) represented in the main list. The candidates whose names are included in the select list made available by the Commission may be appointed by the appointing authority in the order in which their names appear in the select list after satisfying itself about the suitability and the physical fitness of each candidate in accordance with the provisions of the Karnataka Civil Services (General Recruitment) Rules 1977. NOTIFICATION
The draft of the following rules further to amend the Karnataka Pre-University Education (Academic, Registration, Administration and Grant-in-aid etc.,) Rules, 2006, which the Government of Karnataka proposes to make in exercise of the powers conferred by section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995) is hereby published as required by sub-section (1) of section 145 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the official Gazette.
Any objection or suggestion which may be received by the State Government from any person with respect to said draft before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Principal Secretary to Government, Education Department (Primary and Secondary Education), M.S.Building, Bangalore-560 001.
DRAFT RULES
1.Title and commencement.- (1) These rules may be called the Karnataka Pre-University Education (Academic, Registration, Administration and Grant-in-aid etc.,) (Amendment) Rules, 2014.
(2) They shall come into force from the date of their publication in the official Gazette.
2.Amendment of rule 4.- In the Karnataka Pre-University Education (Academic, Registration, Administration and Grant-in-aid etc.,) Rules, 2006 (hereinafter referred to as the said rules), in rule 4, in sub- rule (8), after clause (ii), the following shall be inserted, namely:-
"(ii)(a) One Physical Education Teacher."
2.Amendment of rule 14.- In rule 14 of the said rules, in sub-rule (1) after clause (d), the following shall be inserted, namely:-
"(e) There shall not be less than 100 students together in I year and II year PUC classes for the post of physical education teacher."
