In exercise of the power conferred under Section 26 of the Prohibition of Employment as Manual Scavengers and heir Rehabilitation Act, 2013, the Government of Karnataka hereby notify the State monitoring Committee consisting of the Following members namely:-

1. The above said State Monitoring Committee shall meet at least once in every six months and proceedings shall be drawn and circulated.

2. The functions of the State Monitoring Committee shall be (under Section 27 of the Act) :-

(a) To monitor and advise the State Government and local authorities for effective implementation of this Act; (b) To co-ordinate the functions of all concerned agencies.

(c) To look into any other matter incidental their too or connected there with for implementation of this Act.

In exercise of the power conferred under Section 24(1) of the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013, the Government of Karnataka hereby notify the District Vigilance Committee and Sub divisional Vigilance Committee for each district and each sub-division.

1. The above said District and Sub-divisional Vigilance Committee shall meet atleast once in every three months:

2. The functions of Vigilance Committee shall be (under Section 25 of the Act) :-

(a) To advise the District Magistrate or, as the case may be, the Sub-Divisional Magistrate, on the action which needs to be taken, to ensure that the provisions of this Act or of any rule made thereunder are properly implemented;

(b) To oversee the economic and social rehabilitation of manual scavengers;

(c) To co-ordinate the functions of all concerned agencies with a view to channelize adequate credit for the rehabilitation of manual scavengers;

(d) To monitor the registration of offences under this Act and their investigation and prosecution.

The Chair person of District level vigilance Committees shall inform to all the MLAs and MLCs belonging to SC within the District and also the non-official members as and when nominated in this regard.

The Chair persons of Sub divisional level vigilance Committee shall inform to all the non-official members as and when nominated in this regard.

FOREST, ECOLOGY AND ENVIRONMENT SECRETARIAT

NOTIFICATION

Whereas in its Notification No. FEE 45 FWL 2000, Dated 16-10-2003 the Government of Karnataka, in exercise of the powers conferred under sub- section (4) of Section 35 of the Wildlife (Protection) Act, 1972 (as amended up to 1991), had declared an area of 643.392 Sq. Kms. in the districts of Kodagu and Mysore as Rajiv Gandhi (Nagarahole) National Park.

And whereas the National Tiger Conservation Authority (NTCA) vide the powers conferred on it by the Wildlife (Protection) Amendment Act, 2006 (39 of 2006) under Section 38- V had directed the State Governments to delineate the buffer or peripheral areas of the core or critical tiger habitat and notify the buffer zone vide its letter No. PS-MS (NTCA) 2007-Misc1 dated 16-11-2007.

Accordingly, the Government of Karnataka vide its Notification No. FEE 299 FWL 2007, Dated 20-12-2007 has notified the core or critical tiger habitat of the Rajiv Gandhi (Nagarahole) Tiger Reserve. For identifying the buffer or peripheral area around the core or critical tiger -habitat, due consultative process with the concerned Gram Sabhas of the villages lying in the limits of the buffer zone has- been gone through. Further, during the meeting held on 24-04-2010 under the chairmanship of the Principal Secretary to Government, Forest, Ecology and Environment Department, it has been resolved to include Reserved 'Forest blocks in Virajpet and Hunsur territorial divisions to an extent of 200.57 Sq. Kms within the limits of the buffer zone of Rajiv Gandhi (Nagarahole) Tiger Reserve.

Now, therefore, in exercise of the powers conferred under Section 38- V (4) of the Wildlife (Protection) (Amendment) Act, 2006 (39 of 2006), the Government of Karnataka hereby declare an area of 562.41 Sq. Kms. with boundary fully described in the schedule to this Notification as the "Buffer Zone" of the Rajiv Gandhi (Nagarahole) Tiger Reserve with effect from the date of issue of this Notification.

BOUNDARY DESCRIPTION

NORTH:

The line starts from the tri-junction gadi bandh of Dubare SF, Doddaharave SF and Anechowkur SF. The line runs south east direction passes all along the Northern boundary of Muthur village and touches the junction bandh of Muthur village and Kalathimmanahalli village; then the line runs south direction all along the Eastern boundary of Sy. No: 79 of Kalathimmanahalli and touches the junction bandh of Kalathimmanahalli and Sulugudu villages; then the line runs south east direction all along the eastern of Sy. No.' 60 of Sulugudu village and meets the junction bandh of Sulugudu village and Kogilavadi village; then the line runs passes through of Sy.

No.7 of Lakshmipura and touches the junction bandh of Lakshmipura and Habaluru village; then the line runs south east direction all along the eastern boundary of Sy.No. 133 of Habalur village; then the line passes south east direction the line cross the Piriyapatna to Virajpet main road and touches the Gadi tri junction bandh of Habaluru village. Inam H balati village and Anechowkur Sy. No. 1 then the line runs all along the northern boundary of Sy. No. 1 of Anechowkur and meets the tri junction gadi bandh of north east corner of Sy: No. 1 of Anechowkur Inam H balati village and North west corner of Sy. No. 66 of Malangi village then the line runs all along the western boundary, northern boundary and eastern boundary of Malangi village and touches the tri junction point of Malangi village.

Alaluru village and Uthenahalli village; then the line passes northern boundary of Uthenahalli village in north east direction and meets the junction point of Uthenahalli village and Panchavalli village; then the line runs the same direction touches the north east corner of Panchavalli village; then the line passes in south east direction of Panchavalli village boundary line and touches the junction bandh of Panchavalli Village and Kademanuganahalli village; then line runs south east direction and south west direction in boundary line of Kademanuganahalli village and meets the tri junction of bandh of Kademanuganahalli village Uduvepura and Kallabuchanahalli village then the line runs all along the northern boundary of Kallabuchanahalli and Shettahalli village; then the line passes northern boundary of Kallabuchanahalli in eastern direction and touches the gadi bandh of Kallabuchanahalli and Hanugodu village; then the line runs all along the eastern, north west, north east boundary of Hanugodu and touches the junction bandh of Hanugodu Kiranguru village of Hunasur Taluk; then the line passes all along the sounth eastern boundary of Kiranguru village and meets the junction bandh of Kirunguru village and Madahalli village of Hunasur Taluk, then the line runs east direction all along the Madahalli village and touches the junction bandh of Madahalli village and Harahalli village of Hunasur Taluk; then the line runs north east, south east; direction all along the Haralahalli village and meets the junction bandh of Harahalli village and Pananjanahalli Kaval of Hunsur Taluk; then the line runs all along the boundary of Panjanahalli Kaval and touches the eastern most corner of same village.

EAST:

Then the line passes eastern side of Panjanahalli Kaval and meets the gadi bandh of Panjanahalli Kaval and Kurubara hosalli village;

then the line passes all along the northern and eastern boundary of Kurubarahosalli village and meets junction bandh of Kurubarahosalli village of Hunsur Taluk and Bhimanahalli village of H.D. Kote Taluk; then the line passes all along northern and eastern boundary of Bhimanahalli village and meets gadi bandh of Bhimanahalli and Yelehundi Kaval; then the line runs in eastern boundary of Yelehundikaval and meets the Junction bandh of Yelehundi kaval and Somegowdanahundi of Hunsur Taluk; then the line passes eastern boundary of Somegowdanahundi and meets junction bandh of Somegowdanahundi and Unnur village; then the line runs all along the eastern boundary of Annur village meets the junction bandh of Annur village and Nanjanaikanahalli village of Hunsur Taluk; then the line all along the eastern boundary of Nanjanaikanahalli and meets the gadi bandh of Nanjanaikanahalli village and Boodanur village of H.D.Kote Taluk; then the line passes all along northern and eastern bounadary of Boodanur village and touches the junction bandh of Boodanur village and Chokgundanahalli village; then the line runs all along the eastern boundary of Chokgowdanahalli and the gadi bandh of Chokgundanahalli village and Sonahalli village; then the line runs all along eastern boundary.

SOUTH:

Then the line runs all along Kabini river and meets the interstate gadi bandh of Kakanakote State Forest of Karnataka and Wyanad Wildlife Sanctuary of Kerala State.

WEST:

From the above point the line continues along the inter-state boundary between Karnataka and Kerala States in northern direction, passes through Kymara up to the point where the western boundary of Nalkeri R.F. touches the said inter State Boundary.

Then the line continues along the western boundary of Nalkeri R.F. Hatghat R.F. and Arekere R.F. and joins the starting point at Gonikoppa Hunsur Road.

ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್-ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) (ಸ್ಥಳೀಯ ವೃಂದಗಳ ರಚನೆ ಹಂಚಿಕೆ ಮತ್ತು ವ್ಯಕ್ತಿಗಳ ವರ್ಗಾವಣೆ) ನಿಯಮಗಳು 2013ರ ನಿಯಮ 3 ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಕನ್ನಡ ಮತ್ತು ಸಂಸ್ಕøತಿ ಇಲಾಖೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ರಾಜ್ಯ ಮಟ್ಟದ ಸ್ಥಳೀಯ ವೃಂದ, ಪ್ರಾದೇಶಿಕ ಸ್ಥಳೀಯ ವೃಂದ ಹಾಗೂ ರಾಜ್ಯವ್ಯಾಪಿ ಸ್ಥಳೀಯ ವೃಂದವನ್ನು ಅನುಕ್ರಮವಾಗಿ ಅನುಬಂಧ-1, ಅನುಬಂಧ-2 ಹಾಗೂ ಅನುಬಂಧ-3 ರಲ್ಲಿರುವಂತೆ ಹುದ್ದೆಗಳನ್ನು ಗುರುತಿಸಿ ತಕ್ಷಣದಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಸ್ಥಳೀಯ ವೃಂದಗಳನ್ನು ಸೃಜಿಸಲಾಗಿದೆ.

ಭಾರತೀಯ ಸಂವಿಧಾನದ ಅನುಚ್ಛೇದ 371-ಜೆ ಯ ಅನುಷ್ಠಾನಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಹೊರಡಿಸಿರುವ ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್-ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) ಆದೇಶ 2013ರ 3 ಮತ್ತು 13ನೇ ಕಂಡಿಕೆಗಳಿಗೆ ಅನುಸಾರವಾಗಿ ಸಿ.ಆ.ಸು. ಇಲಾಖೆ (ಸೇವೆಗಳು-ಇ) ವಿಭಾಗವು ನಿರ್ವಹಿಸುತ್ತಿರುವ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯದ ಅಧೀನ ಕಾರ್ಯದರ್ಶಿ ವೃಂದಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಪದೋನ್ನತಿಯಲ್ಲಿ ಶೇಕಡ 8ರ ಪ್ರಮಾಣದಲ್ಲಿ ಹುದ್ದೆಗಳಲ್ಲಿ ಮೀಸಲಿರಿಸಿ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ ಸಿಆಸುಇ 917 ಸಅಸೇ 2013, ದಿನಾಂಕ 10-2-2014 ರಲ್ಲಿ ಸ್ಥಳೀಯ ವೃಂದವನ್ನು ರಚಿಸಿ ಅಧಿಸೂಚಿಸಲಾಗಿತ್ತು.

ಪ್ರಸ್ತುತ ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್-ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) (ಸ್ಥಳೀಯ ವೃಂದಗಳ ರಚನೆ, ಹಂಚಿಕೆ ಮತ್ತು ವ್ಯಕ್ತಿಗಳ ವರ್ಗಾವಣೆ) ನಿಯಮಗಳು 2013ರ ನಿಯಮ 6ರ ಉಪ ನಿಯಮ (2) ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಇದರೊಂದಿಗೆ ಅನುಬಂಧಿಸಿದ ಅನುಸೂಚಿಯಲ್ಲಿ ವಿಶಿಷ್ಟಪಡಿಸಿದ ಅಧಿಕಾರಿಗಳನ್ನು ಅಧೀನ ಕಾರ್ಯದರ್ಶಿ ವೃಂದದ ಸ್ಥಳೀಯ ವೃಂದಕ್ಕೆ ಹಂಚಿಕೆ ಮಾಡಿ ಈ ಮೂಲಕ ಅಧಿಸೂಚಿಸಿದೆ.

ವಿಷಯ : ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದರಾಬಾದ್-ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) ಸ್ಥಳೀಯ ವೃಂದಗಳ ರಚನೆ, ಹಂಚಿಕೆ ಮತ್ತು ವ್ಯಕ್ತಿಗಳ ವರ್ಗಾವಣೆ) ನಿಯಮಗಳು 2013ರ ಅನ್ವಯ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯದ ಸ್ಥಳೀಯ ವೃಂದಕ್ಕೆ ವ್ಯಕ್ತಿಗಳ ಹಂಚಿಕೆ ಕುರಿತು.

ಭಾರತೀಯ ಸಂವಿಧಾನದ ಅನುಚ್ಛೇದ 371-ಜೆ ಯ ಅನುಷ್ಠಾನಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಹೊರಡಿಸಿರುವ ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್-ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) ಆದೇಶ 2013ರ 3 ಮತ್ತು 13ನೇ ಕಂಡಿಕೆಗಳಿಗೆ ಅನುಸಾರವಾಗಿ ಸಿ.ಆ.ಸು. ಇಲಾಖೆ ಆಡಳಿತ ವಿಭಾಗವು ನಿರ್ವಹಿಸುತ್ತಿರುವ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯದ ಎಲ್ಲಾ ವೃಂದಗಳ ಹುದ್ದೆಗಳಿಗೆ ಪದೋನ್ನತಿ ಮತ್ತು ನೇರ ನೇಮಕಾತಿ ಸಲುವಾಗಿ ಶೇಕಡ 8ರ ಪ್ರಮಾಣದಲ್ಲಿ ಹುದ್ದೆಗಳನ್ನು ಮೀಸಲಿರಿಸಿ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ ಸಿಆಸುಇ 50 ಸಿವಿವಿ 2013, ದಿನಾಂಕ 25-11-2013 ರಲ್ಲಿ ಸ್ಥಳೀಯ ವೃಂದವನ್ನು ರಚಿಸಿ ಅಧಿಸೂಚಿಸಲಾಗಿತ್ತು.

ಪ್ರಸ್ತುತ ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಉದ್ಯೋಗ (ಹೈದ್ರಾಬಾದ್-ಕರ್ನಾಟಕ ಪ್ರದೇಶಕ್ಕೆ ನೇಮಕಾತಿಯಲ್ಲಿ ಮೀಸಲಾತಿ) (ಸ್ಥಳೀಯ ವೃಂದಗಳ ರಚನೆ, ಹಂಚಿಕೆ ಮತ್ತು ವ್ಯಕ್ತಿಗಳ ವರ್ಗಾವಣೆ) ನಿಯಮಗಳು 2013ರ ನಿಯಮ 6ರ ಉಪ ನಿಯಮ (2) ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಇದರೊಂದಿಗೆ ಅನುಬಂಧಿಸಿದ ಅನುಸೂಚಿಯಲ್ಲಿ ವಿಶಿಷ್ಟಪಡಿಸಿದ ನೌಕರರನ್ನು ಆಯಾ ವೃಂದಗಳ ಸ್ಥಳೀಯ ವೃಂದಕ್ಕೆ ಹಂಚಿಕೆ ಮಾಡಿ ಈ ಮೂಲಕ ಅಧಿಸೂಚಿಸಿದೆ.

ಉಳಿದಂತೆ ಸಿಆಸು ಇಲಾಖೆಯ ಆಡಳಿತ-ಡಿ ಶಾಖೆಯು ನಿರ್ವಹಿಸುತ್ತಿರುವ ಸಚಿವಾಲಯದ ಹಿರಿಯ ಬೆರಳಚ್ಚುಗಾರರು; ಬೈಂಡರ್; ಸಹಾಯಕ ಬೈಂಡರ್; ದೂರವಾಣಿ ಪ್ರಚಾಲಕರು; ಸಹಾಯಕ ಬೆರಳಚ್ಚು ಯಂತ್ರಜ್ಞ;

ಆಪರೇಟರ್ ಹಾಗೂ ಗ್ರಂಥಾಲಯ ಸಹಾಯಕರ ವೃಂದಗಳ ಸಂಬಂಧ ಸ್ಥಳೀಯ ನೌಕರರು ಅಭಿಮತ ಸಲ್ಲಿಸದಿರುವ ಕಾರಣ ಈ ವೃಂದಗಳಲ್ಲಿ ರಚಿಸಲ್ಪಟ್ಟ ಸ್ಥಳೀಯ ವೃಂದಕ್ಕೆ ಯಾರನ್ನೂ ಹಂಚಿಕೆ ಮಾಡುವ ಪ್ರಶ್ನೆ ಉದ್ಭವಿಸುವುದಿಲ್ಲ.

ಹೀಗಾಗಿ ದಿನಾಂಕ 25-11-2013ರ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ : ಸಿಆಸುಇ 50 ಸಿವಿವಿ 2013 ರಲ್ಲಿ ಮೀಸಲಿರಿಸಿದ ಸ್ಥಳೀಯ ವೃಂದದ ಹುದ್ದೆಗಳು ಪೂರ್ಣವಾಗಿ ರಿಕ್ತ ಸ್ಥಾನಗಳಾಗಿರುತ್ತವೆ.

ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಪರಿವಿಡಿಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಗುಲ್ಬರ್ಗಾ ಜಿಲ್ಲೆ, ಆಳಂದ ತಾಲ್ಲೂಕು ಹೊಡಲ ಗ್ರಾಮದಲ್ಲಿರುವ ಪುರಾತನ ಶ್ರೀ ರಾಮಲಿಂಗೇಶ್ವರ ದೇವಾಲಯವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವೆಂದು ಘೋಷಿಸುವ ಬಗ್ಗೆ ``ಕರ್ನಾಟಕ ಪ್ರಾಚೀನ ಮತ್ತು ಐತಿಹಾಸಿಕ ಸ್ಮಾರಕ ಮತ್ತು ಪುರಾತತ್ವ ನಿವೇಶನಗಳು ಮತ್ತು ಅವಶೇಷಗಳ ಅಧಿನಿಯಮ 1961ರ ಕಲಂ 4(1)ರಡಿ'' (ಕರ್ನಾಟಕ ಆ್ಯಕ್ಟ್ 1962) ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಪಾರಂಪರಿಕ ಸ್ಮಾರಕವನ್ನಾಗಿ ಘೋಷಿಸಲು೧೬೪೮ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜೂನ್ ೫, ೨೦೧೪ ಭಾಗ ೪ಎ ಅಭಿಪ್ರಾಯಪಟ್ಟು, ಅದರಂತೆ 2013ರ ಫೆಬ್ರವರಿ 14ನೇ ದಿನಾಂಕದ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದ ``ಭಾಗ-4ಎ'' ರಲ್ಲಿ ದಿನಾಂಕ 01-01-2013ರ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ ಕಸಂವಾಪ್ರ 389 ಕೆಎಂಯು 2012 ನ್ನು ಪ್ರಕಟಿಸಿ, ಅದರಿಂದ ಬಾಧಿತರಾಗುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಂದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ಪ್ರಕಟಿಸಲಾಗಿದ್ದು ಈ ಬಗ್ಗೆ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆಗಳು ಸ್ವೀಕೃತವಾಗಿಲ್ಲದಿರುವುದರಿಂದ ಈಗ ``ಕರ್ನಾಟಕ ಪ್ರಾಚೀನ ಮತ್ತು ಐತಿಹಾಸಿಕ ಸ್ಮಾರಕಗಳು ಮತ್ತು ಪುರಾತತ್ವ ಸ್ಥಳಗಳು ಮತ್ತು ಆವಶೇಷಗಳ ಅಧಿನಿಯಮ 1961ರ ಕಲಂ 4(3)'' ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಪರಿವಿಡಿಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಗುಲ್ಬರ್ಗಾ ಜಿಲ್ಲೆ, ಆಳಂದ ತಾಲ್ಲೂಕು ಹೊಡಲ ಗ್ರಾಮದಲ್ಲಿರುವ ಪುರಾತನ ಶ್ರೀ ರಾಮಲಿಂಗೇಶ್ವರ ದೇವಾಲಯವನ್ನು ರಾಜ್ಯ ಸಂರಕ್ಷಿತ ಸ್ಮಾರಕವೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಿದೆ.

In exercise of the powers conferred by sub-section (I) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Central Act 35 of 2009), the Government of Karnataka hereby makes the following rules further to amend the Karnataka Right of Children to Free and Compulsory Education Rules, 2012, namely:-

1. Title and commencement.- (I) These rules may be called the Karnataka Right of Children to Free and Compulsory Education (Amendment) Rules, 2014.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Insertion of new rule 6A, 6B, 6C and 6D.- In the Karnataka Right to Children to Free and Compulsory Education Rules, 2012, (hereinafter referred to as the said rules) after rule 6, the following shall be inserted, namely:-

"6A. Appointment of Attendance Authorities, prescribing their duties and responsibilities.- (I) The Education Co- ordinators working in the office of the Block Educational Officer, shall be appointed as Attendance Authorities for their respective jurisdiction.

(2) It shall be the duty of the Attendance Authority to notify the list of children within the age group of 6-14 years as maintained in this manner prescribed in sub-rules (l) to (5) of rule 6, one month before the beginning of the academic year, for the information of respective parents that they are under obligation to cause the children to attend a recognised school in the neighborhood with effect from the commencement of specified academic year.

(3) The Attendance Authority or any person appointed to assist such authority may make necessary enquiry with the parent or enquire any other person about such child's school attendance, and every such parent or other person shall be bound to answer such questions and to furnish such information as the case may be, to the best of his knowledge.

6B. Attendance Notice.- (1) Wherever a parent or guardian has failed to cause the child to attend the approved school even after seven days from the beginning of the academic year or the child continues to remain absent for more than seven days, the teacher or Head Master of the School shall enquire or verify with peer children and parent or guardian of the child regarding the absence of the child, and if it is found that there is no reasonable excuse for non -attendance, the teacher or Head Master shall notify the name of the child to the Attendance Authority immediately in writing in Form IV within three days threrafter and in no case beyond three days.

(2) If, the attendance authority is satisfied that the child is liable to attend an approved school under this rule, and that there is no reasonable excuse for the non-attendance of the child, it shall issue an attendance notice in the form-V and obtain the acknowledgement in the Form-VI by the parent directing the parent to cause the child to attend the approved school with effect from the date specified in the attendance notice.

(3) If any parent against whom an attendance notice has been issued in respect of his child under sub-rule (2), transfers the custody of the child to any other person during the period in which the attendance notice is in force, such parent shall be bound immediately to inform the attendance authority in writing of such transfer.

(4) Where the attendance notice has been issued to a parent in relation to his child under this rule, such notice shall have effect in relation to any other person to whom the custody of the child may be transferred during the period in which the attendance notice is in force, as it has effect in relation to the person against whom it was originally issued.

(5) A parent may, at any time, apply to the attendance authority for cancellation of the attendance notice on the ground that circumstances have arisen which provide a reasonable excuse for non-attendance; and thereupon, the attendance authority may, after holding an enquiry in the appropriate manner cancel or modify the attendance notice.

6C. Reasonable excuse for non attendance.- For the purpose of this rule, any of the following circumstances shall be deemed to be a reasonable excuse for the non-attendance of the child at an approved school, namely:-

(i) that the child is enrolled in a Government school or recognized private aided school or private un aided school.

(ii) that the child is receiving instruction in some other institution recognized by the state Government.

(iii) that the child has remained absent for the reasons such as floods, natural calamities, bundh or public riots etc., which are beyond his or parent's control.

(iv) that the child has been granted temporary leave of absence not exceeding the prescribed period by the competent authority.

6D. Measures for ensuring compulsory attendance of child in a formal school.- (1) Whenever a child fails to attend the school even after issue of attendance notice, without reasonable excuse, as a first step in this regard, the Attendance Authority shall direct the parent along with members of the School Development and Monitoring Committee, or the Grama Panchayat or urban local authority or local Non Government Organisation or Social worker to counsel the family on the importance of education and inadvisability of the child dropping out of the school.

(2) Even after .counseling and after exhausting the procedure explained above, if the parent or guardian fails to send the child to school from the next working day, the concerned Attendance Authority shall issue written attendance order in form VII and obtain೧೬೫೦ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜೂನ್ ೫, ೨೦೧೪ ಭಾಗ ೪ಎ acknowledgement in form VIII directing the parent to appear along with child before the CWC (Child Welfare Committee constituted under the provisions of Juvenile Justice Act, 2000) on a specified date and time.

(3) If necessary, the Attendance Authority shall take the help of the Special Juvenile Police or other authorities, under the Juvenile Justice Act, to bring the parents and child before the Child Welfare Committee.

(4) The Children Welfare Committee shall hear the parents and find out the reasons for the non-attendance of the child in the school.

(5) If the reasons given by the parents are economic in nature and the Children Welfare Committee is convinced of the genuineness of the need, the Child Welfare Committee shall sanction the preferred form of economic assistance to the family and ensure the presence of child in a specified school with immediate effect.

(6) The 'mitigating factors' and the criteria under which the Child Welfare Committee may sanction specified forms of assistance to the child and/or parents who are unable to fulfill the rights of their children due to their economic circumstances needs to be finalized and circulated to Child Welfare Committee Inability to fulfill the right to education shall be checked by the Children Welfare Committee based on the social and economic vulnerabilities.

(7) For the purpose of sanctioning assistance to the family of the vulnerable child, Child Welfare Committee shall, recommend the concerned officials and record the same, to render assistance under welfare schemes to implement the decision taken, on condition, however, that the child is sent to school regularly.

(8) Any parent/guardian who are not found eligible for economic assistance but not sending the child to school, or any parent/guardian who is eligible to and received the benefits but still not sending the child to school, and served with Attendance Notice, shall be dealt with in accordance with provisions contained in Chapter IV of Juvenile Justice Act, 2000 and such child shall be deemed to be "child in need of care and protection" under the Juvenile Justice Act, 2000 and Child Welfare Committee shall take action to enroll in a Government hostel linked to a school or residential school in form IX.

(9) In case the parent changes the custody of the child to any other person in respect of the child such person or guardian shall be bound to inform the Attendance Authority of such transfer within fifteen days."

3. Insertion of new Forms IV, V, VI, VII, VIII and IX Forms.- After form III of the said rules, the following shall be inserted, namely:_
