ಸಹಕಾರ ಸಂಘ ನಿ., ಮುಳಬಾಗಿಲು ಕಾರ್ಯವನ್ನು ನಿರ್ವಹಿಸದೇ ಸ್ಥಗಿತಗೊಂಡಿರುವ ವೀರಭದ್ರನಗರ ಹಾಲು ಉತ್ಪಾದಕರ ಸಹಕಾರ ಸಂಘ ನಿ., ಮುಳಬಾಗಿಲು ತಾಲ್ಲೂಕು ಈ ಸಂಘವನ್ನು ಸಮಾಪನೆಗೆ ಒಳಪಡಿಸಿ ಸಂಘಕ್ಕೆ ಸಮಾಪನಾಧಿಕಾರಿಯನ್ನು ನೇಮಕ ಮಾಡುವ ಬಗ್ಗೆ. ತಾಲ್ಲೂಕು ಈ ಸಂಘವನ್ನು ಸಮಾಪನೆಗೆ ಒಳಪಡಿಸಿ ಸಂಘಕ್ಕೆ ಸಮಾಪನಾಧಿಕಾರಿಯನ್ನು ನೇಮಕ ಮಾಡುವ ಬಗ್ಗೆ. ತಾಲ್ಲೂಕು ಈ ಸಂಘವನ್ನು ಸಮಾಪನೆಗೆ ಒಳಪಡಿಸಿ ಸಂಘಕ್ಕೆ ಸಮಾಪನಾಧಿಕಾರಿಯನ್ನು ನೇಮಕ ಮಾಡುವ ಬಗ್ಗೆ.

ವೀರಭದ್ರನಗರ ಹಾಲು ಉತ್ಪಾದಕರ ಸಹಕಾರ ಸಂಘ ನಿ., ಮುಳಬಾಗಿಲು ತಾಲ್ಲೂಕು ಇದು ತನ್ನ ಕಾರ್ಯವನ್ನು ನಿರ್ವಹಿಸದೇ ಹಾಲು ಉತ್ಪಾದಕರ ಸಹಕಾರ ಸಂಘ ನಿ., ಮುಳಬಾಗಿಲು ತಾಲ್ಲೂಕು ಇದು ತನ್ನ ಕಾರ್ಯವನ್ನು ನಿರ್ವಹಿಸದೇ ಹಾಲು ಉತ್ಪಾದಕರ ಸಹಕಾರ ಸಂಘ ನಿ., ಮುಳಬಾಗಿಲು ತಾಲ್ಲೂಕು ಇದು ತನ್ನ ಕಾರ್ಯವನ್ನು ನಿರ್ವಹಿಸದೇ ಸ್ಥಗಿತಗೊಂಡಿರುವುದಾಗಿ ಸಂಘವನ್ನು ಪುನ:ಶ್ಚೇತನಗೊಳಿಸಲು ಸಾಧ್ಯವಿಲ್ಲದಿರುವುದರಿಂದ ಸಮಾಪನೆಗೊಳಿಸಬೇಕೆಂದು ಉಲ್ಲೇಖದ ಪತ್ರದಲ್ಲಿ ಕೋಲಾರ ಸ್ಥಗಿತಗೊಂಡಿರುವುದಾಗಿ ಸಂಘವನ್ನು ಪುನ:ಶ್ಚೇತನಗೊಳಿಸಲು ಸಾಧ್ಯವಿಲ್ಲದಿರುವುದರಿಂದ ಸಮಾಪನೆಗೊಳಿಸಬೇಕೆಂದು ಉಲ್ಲೇಖದ ಪತ್ರದಲ್ಲಿ ಕ ಸ್ಥಗಿತಗೊಂಡಿರುವುದಾಗಿ ಸಂಘವನ್ನು ಪುನ:ಶ್ಚೇತನಗೊಳಿಸಲು ಸಾಧ್ಯವಿಲ್ಲದಿರುವುದರಿಂದ ಸಮಾಪನೆಗೊಳಿಸಬೇಕೆಂದು ಉಲ್ಲೇಖದ ಪತ್ರದಲ್ಲಿ ಕ ಉಪವಿಭಾಗದ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು ಶಿಫಾರಸ್ಸು ಮಾಡಿರುತ್ತಾರೆ.

ಕಾಯ್ದೆ 1959 ರ ಕಲಂ 72 ರನ್ವಯ ಸಮಾಪನೆಗೊಳಿಸುವುದು ಸೂಕ್ತವೆಂದು ಅಭಿಪ್ರಾಯಪಟ್ಟಿರುವುದಾಗಿ ತಿಳಿಸಿರುತ್ತಾರೆ. ಕಾಯ್ದೆ 1959 ರ ಕಲಂ 72 ರನ್ವಯ ಸಮಾಪನೆಗೊಳಿಸುವುದು ಸೂಕ್ತವೆಂದು ಅಭಿಪ್ರಾಯಪಟ್ಟಿರುವುದಾಗಿ ತಿಳಿಸಿರುತ್ತಾರೆ.
ಮೇಲ್ಕಂಡ ಅಂಶಗಳ ಹಿನ್ನಲೆಯಲ್ಲಿ ಕೋಲಾರ ಹಾಲು ಒಕ್ಕೂಟದ ಅಧಿಕಾರಿಗಳು ಮತ್ತು ಕೋಲಾರ ಉಪವಿಭಾಗ ಮೇಲ್ಕಂಡ ಅಂಶಗಳ ಹಿನ್ನಲೆಯಲ್ಲಿ ಕೋಲಾರ ಹಾಲು ಒಕ್ಕೂಟದ ಅಧಿಕಾರಿಗಳು ಮತ್ತು ಕೋಲಾರ ಉಪವಿಭಾಗದ ಸಹಕಾರ ಸಂಘಗಳ ಮೇಲ್ಕಂಡ ಅಂಶಗಳ ಹಿನ್ನಲೆಯಲ್ಲಿ ಕೋಲಾರ ಹಾಲು ಒಕ್ಕೂಟದ ಅಧಿಕಾರಿಗಳು ಮತ್ತು ಕೋಲಾರ ಉಪವಿಭಾಗ ಸಹಾಯಕ ನಿಬಂಧಕರ ಅಭಿಪ್ರಾಯದಂತೆ ಹಾಗೂ ಶಿಫಾರಸ್ಸು ಮೇರೆಗೆ ಸಂಘವನ್ನು ಸಮಾಪನೆಗೊಳಿಸುವುದು ಸೂಕ್ತವೆಂದು ಅಭಿಪ್ರಾಯಪಟ್ಟು ಸಂಘಕ್ಕೆ ಸಹಾಯಕ ನಿಬಂಧಕರ ಅಭಿಪ್ರಾಯದಂತೆ ಹಾಗೂ ಶಿಫಾರಸ್ಸು ಮೇರೆಗೆ ಸಂಘವನ್ನು ಸಮಾಪನೆಗೊಳಿಸುವುದು ಸೂಕ್ತವೆಂದು ಅಭಿಪ್ರಾಯಪ ಸಹಾಯಕ ನಿಬಂಧಕರ ಅಭಿಪ್ರಾಯದಂತೆ ಹಾಗೂ ಶಿಫಾರಸ್ಸು ಮೇರೆಗೆ ಸಂಘವನ್ನು ಸಮಾಪನೆಗೊಳಿಸುವುದು ಸೂಕ್ತವೆಂದು ಅಭಿಪ್ರಾಯಪ ಸಮಾಪನಾಧಿಕಾರಿಯನ್ನು ನೇಮಕ ಮಾಡಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ. ಸಮಾಪನಾಧಿಕಾರಿಯನ್ನು ನೇಮಕ ಮಾಡಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

ಇವರನ್ನು ಸಮಾಪನಾಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಕ ಮಾಡಿ ಆದೇಶವನ್ನು ಹೊರಡಿಸಿರುತ್ತೇನೆ.

ಜವಾಬ್ದಾರಿಗಳನ್ನು 3 ತಿಂಗಳ ಒಳಗಾಗಿ ಸಂಘದ ಸಮಾಪನಾಧಿಕಾರಿಗಳು ಸಂಘದ ಸಂಪೂರ್ಣ ಪ್ರಭಾರವನ್ನು ಪಡೆದು ಸಂಘದ ಆಸ್ತಿ-ಜವಾಬ್ದಾರಿಗಳನ್ನು 3 ತಿಂಗಳ ಒಳಗಾಗಿ ಸಂಘದ ಸಮಾಪನಾಧಿಕಾರಿಗಳು ಸಂಘದ ಸಂಪೂರ್ಣ ವಿಲೇವಾರಿ ಮಾಡಿ ಸಂಘದ ನೋಂದಣಿಯನ್ನು ರದ್ದುಪಡಿಸಲು ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸಲ್ಲಿಸುವಂತೆ ಸೂಚಿಸಿದೆ. ವಿಲೇವಾರಿ ಮಾಡಿ ಸಂಘದ ನೋಂದಣಿಯನ್ನು ರದ್ದುಪಡಿಸಲು ಪ್ರಸ್ತಾವನೆಂi

Accordingly, the purchasing dealer has filed police complaint to the jurisdictional police officer, on 12.03.2014 and executed indemnity bond in Form `G' in favour of Government as laid down under Rule 12(2) and 12(9) of CST Act 1956. 10-07-2007ರಲ್ಲಿ ಕರ್ನಾಟಕ ಭೂ ಸುಧಾರಣೆ ಅಧಿನಿಯಮ 1961 ರ ಕಲಂ 109 ರಡಿಯಲ್ಲಿ ನೀಡಲಾದ ಅನುಮತಿಯ ಅವಧಿಯು ಮುಕ್ತಾಯವಾಗಿರುವ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ತದನಂತರ ಕಂಇ 71 ಎಲ್ಆರ್ಎಂ 2009, ದಿನಾಂಕ: 10- 08-2009ರಲ್ಲಿ ದಿನಾಂಕ: 10-07-2009 ರಿಂದ ಅನ್ವಯವಾಗುವಂತೆ 2 ವರ್ಷಗಳವರೆಗೆ ಕಾಲಾವಧಿ ವಿಸ್ತರಿಸಲಾಗಿತ್ತು. ತದನಂತರ ಆರ್‌ಡಿ 87 ಎಲ್ಆರ್ಎಂ 2011, ದಿನಾಂಕ: 16-07-2012ರಲ್ಲಿ ದಿನಾಂಕ: 10-07-2011ರಿಂದ ಅನ್ವಯವಾಗುವಂತೆ ಇನ್ನೂ 2 ವರ್ಷಗಳವರೆಗೆ ಕಾಲಾವಧಿ ವಿಸ್ತರಿಸಲಾಗಿತ್ತು.
ಅರ್ಜಿದಾರರ ಕೋರಿಕೆಯಂತೆ ಸಕಾಲದಲ್ಲಿ ಉದ್ದೇಶವನ್ನು ಪೂರೈಸಿಕೊಳ್ಳಲು ಉಂಟಾದ ಅನಿವಾರ್ಯ ಕಾರಣಗಳನ್ನು ಸರ್ಕಾರವು ಪರಿಶೀಲಿಸಿದ ನಂತರ ಅರ್ಜಿದಾರರ ಉದ್ದೇಶ ಪೂರೈಸಿಕೊಳ್ಳಲು ಕರ್ನಾಟಕ ಭೂ ಸುಧಾರಣೆ ನಿಯಮಗಳು 1974ರ ನಿಯಮ 38(ಡಿ)ರಂತೆ ಸದರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 10-07-2013ರಿಂದ ಅನ್ವಯಿಸುವಂತೆ ಒಂದು ವರ್ಷದ ಮಿತಿಗೆ ಒಳಪಟ್ಟು ಕಾಲಾವಧಿ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಿದೆ.

(1) ಪ್ರತಿಯೊಂದು ಘಟಕವು , ಕರ್ನಾಟಕ ಮಾಲಿನ್ಯ ನಿಯಂತ್ರಣ ಮಂಡಳಿಯು ಕಾಲಕಾಲಕ್ಕೆ ನಿಗದಿಪಡಿಸಬಹುದಾದಂತೆ ವಾಯು (ಮಾಲಿನ್ಯ ಪ್ರತಿಬಂಧ ಮತ್ತು ನಿಯಂತ್ರಣ) ಅಧಿನಿಯಮ, 1981 ಮತ್ತು ಪರಿಸರ ಸಂರಕ್ಷಣೆ ಅಧಿನಿಯಮ, 1986 ಮತ್ತು ಅದರಡಿಯಲ್ಲಿ ರಚಿಸಲಾದ ನಿಯಮಗಳ ಉಪಬಂಧಗಳಿಗೆ ಬದ್ಧವಾಗಿರತಕ್ಕದ್ದು.
(2) ಪ್ರತಿಯೊಂದು ಘಟಕವು ಶಬ್ದ (ವಿನಿಮಯಗಳು ಮತ್ತು ನಿಯಂತ್ರಣ) ನಿಯಮಗಳು, 2000 ಇದಕ್ಕೆ ಅನುಸಾರವಾಗಿರತಕ್ಕದ್ದು.
(3) ಕಲ್ಲುಪುಡಿ ಮಾಡುವ ಒಂದು ಘಟಕವು (ಕ್ರಷರ್) ಅಥವಾ ಘಟಕಗಳ ಸಮೂಹವು ವಾಯುಮಾಲಿನ್ಯ ನಿಯಂತ್ರಣ ಕ್ರಮಗಳ ಜೊತೆಗೆ, (ಸಂದರ್ಭಾನುಸಾರ, ರಾಷ್ಟ್ರೀಯ ಹೆದ್ದಾರಿ ಅಥವಾ ರಾಜ್ಯ ಹೆದ್ದಾರಿ ಅಥವಾ ಪ್ರಧಾನ ಜಿಲ್ಲಾ ರಸ್ತೆ ಅಥವಾ ಗ್ರಾಮ ವಸತಿ ಪ್ರದೇಶ ಅಥವಾ ದೇವಾಲಯ ಅಥವಾ ಶಾಲೆಗೆ ಸಮಾನಾಂತರವಾಗಿ) ಎಲ್ಲಾ ಮೂರು ಕಡೆಗಳಲ್ಲಿ 15 ರಿಂದ 20 ಅಡಿ ಎತ್ತರದ ಗೋಡೆ / ಜಿಐ ಶೀಟ್ ರಕ್ಷಣೆ ಒದಗಿಸತಕ್ಕದ್ದು.
(4) ಅರ್ಜಿದಾರನು:-
(ಎ) ಆ ಸ್ಥಳದಿಂದ ಧೂಳು ಹೊರಕ್ಕೆ ಹೋಗದಂತೆ ತಡೆಗಟ್ಟಲು ದೊಡ್ಡ ಪ್ರಮಾಣದಲ್ಲಿ ಧೂಳು ಹೊರ ಹಾಕುವ ಮೂಲಗಳಿಗೆ ಕಟ್ಟಡ ಆವರಣಗಳನ್ನು ನಿರ್ಮಿಸುವಂಥ ಅವಶ್ಯವಾದ ಧೂಳು ತಡೆ ವ್ಯವಸ್ಥೆಯನ್ನು ಅಳವಡಿಸಕೊಳ್ಳತಕ್ಕದ್ದು.
(ಬಿ) ಬಿರುಸಾಗಿ ಬೀಸುವ ಗಾಳಿಯನ್ನು ತಡೆದುಕೊಳ್ಳುವಂಥ ಆಂಗಲ್ ಸ್ಟ್ರಕ್ಚರ್‌ಗಳ ಆಸರೆಯ ಹಂದರವಿರುವ ಜಿ.ಐ ಶೀಟುಗಳ (1.66ಮಿ.ಮೀ ಮತ್ತು 1.25 ಮಿ.ಮೀ ದಪ್ಪದ ಜಿ.ಐ. ಶೀಟ್‌ಗಳ ಆವರಣ ಬೇಲಿಯನ್ನು (enclosures) ನಿರ್ಮಿಸತಕ್ಕದ್ದು.
(ಸಿ) ನೀರು ಸಂಗ್ರಹವಾಗುವುದನ್ನು ತಡೆಗಟ್ಟುವ ಹಾಗೆ ಇಳಿಜಾರು ಛಾವಣಿ ಅನುಕ್ರಮವಾಗಿ ನಿರ್ಮಿಸತಕ್ಕದ್ದು.
(ಡಿ) ಪರಿಸರಕ್ಕೆ ಧೂಳು ಬಿಡುಗಡೆಯಾಗುವುದನ್ನು ತಡೆಗಟ್ಟಲು ಪೂರ್ತಿಯಾಗಿ ಮುಚ್ಚುವಂಥ ಹಾಪರ್ ಬಾಟಂ/ಉತ್ಪನ್ನವನ್ನು ಇಳಿಸುವ ಕನ್ವೇಯರ್‌ನಂಥ ಸಾಮಗ್ರಿ ವರ್ಗಾವಣೆ ತಾಣವನ್ನು ವ್ಯವಸ್ಥೆಗೊಳಿಸತಕ್ಕದ್ದು.
(ಇ) ಜಾ ಕ್ರಷರುಗಳ ಪಕ್ಕದಲ್ಲಿ ಮತ್ತು ತಳಭಾಗದಲ್ಲಿ ತೆರೆದಿರುವ ಭಾಗಗಳಲ್ಲಿ ಪೂರ್ಣವಾಗಿ ಮುಚ್ಚುವಂಥ ಆವರಣ ಬೇಲಿ ನಿರ್ಮಿಸಲು ಸಾಧ್ಯವಿಲ್ಲದಿದ್ದಲ್ಲಿ, ಪರಿಸರಕ್ಕೆ ಧೂಳು ಬಿಡುಗಡೆಯಾಗುವುದನ್ನು ತಡೆಗಟ್ಟಲು ಅವುಗಳಿಗೆ ಜಿಐ ಶೀಟ್‌ಗಳು/ ರಬ್ಬರ್ ಫ್ಲಾಪ್ ಅಥವಾ ಯಾವುದೇ ಇತರ ಸಾಮಗ್ರಿಯಿಂದ ಸೂಕ್ತವಾಗಿ ಮುಚ್ಚುವ ವ್ಯವಸ್ಥೆ ಮಾಡಲಾಗಿದೆ ಎಂಬುದನ್ನು ಖಚಿತಪಡಿಸಿಕೊಳ್ಳತಕ್ಕದ್ದು.
(ಎಫ್) ಎತ್ತರದಿಂದ ವಸ್ತುಗಳು ಅಡೆತಡೆಯಿಲ್ಲದೆ ಬೀಳುವಾಗ ಪರಿಸರದೊಳಗೆ ಧೂಳು ಬಿಡುಗಡೆಯಾಗುವುದನ್ನು ತಡೆಗಟ್ಟಲು ಉತ್ಪನ್ನವನ್ನು ಇಳಿಸುವ ಕನ್ವೇಯರ್‌ಗಳಲ್ಲಿ ಟೆಲಿಸ್ಕೋಪಿಕ್ ಚ್ಯೂಟ್‌ಗಳನ್ನು ಅಳವಡಿಸಲಾಗಿದೆಯೆಂದು ಖಚಿತಪಡಿಸಕೊಳ್ಳತಕ್ಕದ್ದು, ರಾಶಿಯ ಗಾತ್ರಕ್ಕೆ ಅನುಗುಣವಾಗಿ ಈ ಚ್ಯೂಟ್‌ಗಳನ್ನು ಉದ್ದದಲ್ಲಿ ಸರಿಹೊಂದಿಸಿಕೊಳ್ಳಬಹುದು.
(ಜಿ) ಧೂಳಿನ ಬಿಡುಗಡೆಯನ್ನು ತಡೆಗಟ್ಟಲು, ರಬ್ಬರ್ ಫ್ಲಾಪ್‌ನೊಂದಿಗೆ ( ಎಲ್ಲೆಲ್ಲಿ ಸಾಧ್ಯವೋ ಅಲ್ಲಲ್ಲಿ ) ಶಾಪ್ಟರ್ ಮೋಟಾರು ಡ್ರೈವರ್ ಕನ್ವೆಯರ್ ಬೆಲ್ಟ್‌ಗಳ ಮೇಲೆ, ಮುಂತಾದ ಕಡೆಗಳಲ್ಲಿ ಆವರಣ ಬೇಲಿಯಲ್ಲಿ ತೆರೆದ ಕಿಂಡಿಗಳನ್ನು ಏರ್ಪಡಿಸತಕ್ಕದ್ದು.
(ಹೆಚ್) ಧೂಳಿನ ಮೋಡವನ್ನು ನಿವಾರಿಸಲು, ಧೂಳು ಉತ್ಪಾದನೆಯಾಗುವ ಮೂಲಗಳ ಮೇಲೆ ವಿಶೇಷ ನಳಿಕೆಗಳ ಮೂಲಕ ಸಣ್ಣದಾಗಿ ನೀರಿನ ತುಂತುರು ಹನಿಗಳನ್ನು ಸಿಂಪಡಿಸುವುದನ್ನು ಒಳಗೊಂಡಂತೆ ಪರಿಣಾಮಕಾರಿ ಧೂಳು ನಿವಾರಣಾ ವ್ಯವಸ್ಥೆಯನ್ನು ಕಲ್ಪಿಸತಕ್ಕದ್ದು.
(ಐ) ನೀರು ಸಿಂಪರಣೆ ನಳಿಕೆಯ ಕಟ್ಟಿಕೊಳ್ಳುವುದನ್ನು ತಡೆಗಟ್ಟಲು ಅದನ್ನು ಕಾಲಕಾಲಕ್ಕೆ ಶುಚಿಗೊಳಿಸತಕ್ಕದ್ದು.
(ಜೆ) ವೃತ್ತಿ ಸುರಕ್ಷತಾ ಕ್ರಮವಾಗಿ, ಎಲ್ಲಾ ಕೆಲಸಗಾರರಿಗೆ ಮೂಗು ಮುಚ್ಚಿಕೊಳ್ಳುವಂಥ ಮುಸುಕನ್ನು ಒದಗಿಸತಕ್ಕದ್ದು.
(5) ಧೂಳಿನ ಕಣಗಳು ಹರಡುವುದನ್ನು ತಡೆಗಟ್ಟಲು ಬೇವು, ಹುಣಸೆ, ಗೋಲ್ಡ್ ಮೊಹರ್, ಮುತ್ತುಗದ ಮರ, ಮುಂತಾದ ಯಾವುದೇ ಇತರ ಸ್ಥಳೀಯ ತಳಿಯ ದಟ್ಟವಾದ ಎಲೆಗಳುಳ್ಳ ನಿತ್ಯಹರಿದ್ವರ್ಣ ಮರಗಳನ್ನು ಒಳಗೊಂಡ ಸಮರ್ಪಕ ಹಸಿರು ವಲಯವನ್ನು ಎಲ್ಲಾ ಕಲ್ಲುಪುಡಿ ಮಾಡುವ ಘಟಕಗಳು (ಕ್ರಷರ್‌ಗಳು) ಬೆಳೆಸತಕ್ಕದ್ದು."
(6) ದಿನಾಂಕ:21.06.2014 ರಂದು ನಡೆದ ಜಿಲ್ಲಾ ಕಲ್ಲುಪುಡಿ ಘಟಕಗಳ ಲೈಸೆನ್ಸಿಂಗ್ ಮತ್ತು ನಿಯಂತ್ರಣ ಪ್ರಾಧಿಕಾರದ ತೀರ್ಮಾನದಂತೆ ಕರ್ನಾಟಕ ಭೂಕಂದಾಯ ಕಾಯಿದೆ 1964 ಕಲಂ 95 ರಂತೆ ಖಾಸಗಿ ಜಮೀನಿನಲ್ಲಿ ಕಲ್ಲುಪುಡಿ ಘಟಕ ಸ್ಥಾಪಿಸುವ ಅರ್ಜಿದಾರರು ಕಡ್ಡಾಯವಾಗಿ ಭೂಪರಿವರ್ತನೆಯನ್ನು ಮಾಡಿಸಿಕೊಳ್ಳತಕ್ಕದ್ದು.

In exercise of the powers conferred by sub-section (1) of section 88 of BWSSB Act the draft of the Bangalore Water Supply and Sewerage Board (Absorption of Manager (Legal) appointed on deputation basis in the Bangalore Water Supply and Sewerage Board) Regulations 2014, which the Bangalore Water Supply and Sewerage Board proposes to make Regulations with the previous approval of the Government of Karnataka, is hereby published as required by sub-section (2) of the said section, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after 15 days from the date of its publication in the Official Gazette.
Any objection or suggestion which may be received by the Bangalore Water Supply and Sewerage Board from any person with respect to the said draft before the expiry of the period specified above will be considered by the Board. Objections and suggestions may be addressed to the Chairman, Bangalore Water Supply and Sewerage Board, Cauvery Bhavan, K.G.Road, Bangalore.
DRAFT REGULATIONS
1. Title and commencement:
(a) These regulations may be called the Bangalore Water Supply and Sewerage Board (Absorption of Manager (Legal) appointed on deputation basis in Bangalore Water Supply and Sewerage Board) Regulations, 2014.
(b) They shall come into force from the date of its publication in the Official Gazette.
2. Definitions: In these regulations unless the context otherwise requires,:-
(a) 'Act' means the Bangalore Water Supply and Sewerage Act, 1964 (Karnataka Act 36 of 1964).
I. "Deputation of Manager (Legal)" means an officer appointed in the Bangalore Water Supply and Sewerage Board on deputation basis from the Karnataka State Finance Corporation.
II. "Schedule" means schedule appended to these regulations.
III. Other words and expressions used in these rules but not defined shall have the same meaning respectively assigned to them in the Act.
3. Absorption of Manager (Legal) on deputation in the Bangalore Water Supply and Sewerage Board:
(1) Notwithstanding anything contained, in the Bangalore Water Supply and Sewerage Board (Cadre and Recruitment) Regulations, 1981 or any other rules or regulations made or deemed to have been made under the provisions of the Bangalore Water Supply Act, 1964, governing the method of recruitment of the employees of Board, the Manager (Legal) appointed on deputation from the Karnataka State Finance Corporation specified in Column (2) of the schedule and who has been continued as such from 1st March 2014 is absorbed in the equivalent category of post with scale of pay specified in columns (5) and (6) thereof respectively, in the Bangalore Water Supply and Sewerage Board services.
The absorption is subject to fulfillment of following:
i. If he/she was disqualified for appointment under the Karnataka Civil Services (General Recruitment) Rules 1977 on the date of his/her appointment as an Manager (Legal) in the Karnataka State Finance Corporation.
ii. If he/she does not possess the minimum academic qualification, if any, specified in the rules or regulations of recruitment applicable for the recruitment to the post in which he/she is absorbed .
4. Pay, pension, leave and Seniority of Persons absorbed under these regulations:- Notwithstanding anything contained in the rules or regulations governing the salary Allowances and Conditions of Service of the employees of the Board:
(a) The basic pay shall be fixed in the pay scale applicable to the category of post in which she is absorbed under rule 3 shall ensure no loss of pay or salary drawn immediately before absorption.

(c) The Services rendered in the Board on deputation as Manager (Legal) prior to the date of absorption shall count for the purpose of leave etc. and not for the purpose of seniority.
(d) The service rendered in KSFC prior to the date of deputation shall count for purpose of gratuity subject to transfer of gratuity amount by KSFC for the service rendered in KSFC.
