ಮತ್ತು ಗ್ರಾಮಾಂತರ ಯೋಜನಾ ಕಾಯ್ದೆ 1961ರ ಕಲಂ 4(ಸಿ)(3)(i)(iii)(iv)ರಡಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ರಡಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಗಂಗಾವತಿ ನಗರ ಯೋಜನಾ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ಕ್ರಮವಾಗಿ ಈ ಕೆಳಕಂಡಂತೆ ಅಧ್ಯಕ್ಷರು ಮತ್ತು ಸದಸ್ಯರನ್ನು ಸರ್ಕಾರದ ಇಚ್ಛಾ ಗಂಗಾವತಿ ನಗರ ಯೋಜನಾ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ಕ್ರಮವಾಗಿ ಈ ಕೆಳಕಂಡಂತೆ ಅಧ್ಯಕ್ಷರು ಮತ ು್ತ ಸದಸ್ಯರನ್ನು ಸರ್ಕಾರದ ಇಚ್ಛಾನುಸಾರ ಅಥವಾ 3 ವರ್ಷದ ಅವಧಿಯವರೆಗೆ ಇವುಗಳಲ್ಲಿ ಯಾವುದು ಮೊದಲು ಅಲ್ಲಿಯವರೆಗೆ ನಾಮನಿರ್ದೇಶನ ಮಾಡಿ ಆದೇಶಿಸಲಾಗಿದೆ.

WHEREAS the draft Notification regarding altering the limits of Mannekote village with its hamlets of Challakere Taluk, Chitradurga District, Karnataka State and constituting a new Village called Kodihalli was published as required by Section 6 of the Karnataka Land Revenue Act, 1964 (Karnataka Act No. 12 of 1964) in Notification No.RD 84 BHUDAPU 2009, dated 29-02-2012 in part IV-A of the Karnataka Gazette inviting objections or suggestions from all the persons likely to be affected thereby that the proposal will be taken into consideration on or after one month from the date of publication of the notification in the official gazette, addressed to the Deputy Commissioner, Chitradurga District.

AND WHEREAS the said gazette was made available to the public on 21-06-2012.

AND WHEREAS, no objections and suggestions are received by the Deputy Commissioner, Chitradurga District. NOW THEREFORE, in exercise of the powers conferred by Section 5 of the Karnataka Land Revenue Act, 1964 (Karnataka Act No. 12 of 1964), the Government of Karnataka makes the following alterations and constitutes a new village as specified in the following schedules.

ಕಾರ್ಮಿಕ ಇಲಾಖೆಯಲ್ಲಿ ಅನುಷ್ಠಾನಗೊಳಿಸುತ್ತಿರುವ ಕಾಯ್ದೆಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟ ಕಲಂಗಳಡಿಯಲ್ಲಿ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಕಾಇ 139 ಎಲ್ಇಟಿ 2011(2) ಬೆಂಗಳೂರು ದಿನಾಂಕ : 09-06-2011 ರಲ್ಲಿ ಇಲಾಖೆಯ ಅಧಿಕಾರಿಗಳು / ಹಿರಿಯ ಕಾರ್ಮಿಕ ನಿರೀಕ್ಷಕರು / ಕಾರ್ಮಿಕ ನಿರೀಕ್ಷಕರುಗಳನ್ನು ಸೂಕ್ತ ಪ್ರಾಧಿಕಾರಿಗಳನ್ನಾಗಿ ನೇಮಕ ಮಾಡಿ, ಕೋಷ್ಠಕದ 3 ಅಂಕಣದಲ್ಲಿ ನಮೂದಿಸಿರುವ ಕಾರ್ಯವ್ಯಾಪ್ತಿಯ ಸ್ಥಳೀಯ ಪರಿಮಿತಿಗಳಲ್ಲಿ ಅವರು ತಮ್ಮ ಪ್ರಕಾರ್ಯಗಳನ್ನು ಚಲಾಯಿಸಬಹುದಾದ ಪರಿಮಿತಿಗಳೆಂದು ಗೊತ್ತುಪಡಿಸಿ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಲಾಗಿತ್ತು.

ಸ್ವತಂತ್ರ ಕಾರ್ಮಿಕ ನಿರೀಕ್ಷಕರುಗಳಿಲ್ಲದ ತಾಲ್ಲೂಕುಗಳಲ್ಲಿ 21 ಸ್ವತಂತ್ರ ಕಾರ್ಮಿಕ ನಿರೀಕ್ಷಕರುಗಳ ಹುದ್ದೆಗಳನ್ನು ಸೃಜಿಸಿರುವ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ದಿನಾಂಕ:

09-06-2011 ರಂದು ಹೊರಡಿಸಿರುವ ಅಧಿಸೂಚನೆಯ ಕ್ರಮ ಸಂಖ್ಯೆ.146 ರಿಂದ 271 ರವರೆಗೆ ನಮೂದಿಸಿರುವ ಹೊಸ ಕ್ರಮ ಸಂಖ್ಯೆಗಳು ಸೇರಿದಂತೆ 'ಕಾರ್ಮಿಕ ನಿರೀಕ್ಷಕರುಗಳ' ಕಾರ್ಯವ್ಯಾಪ್ತಿಯನ್ನು ಈ ಸ್ವತಂತ್ರ ಕಾರ್ಮಿಕ ನಿರೀಕ್ಷಕರುಗಳ ಹುದ್ದೆಗಳ ಸೃಜನೆಗೆ ಸೀಮಿತಗೊಳಿಸಿ ಭಾಗಶಃ ಮಾರ್ಪಡಿಸಿ, ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಕಾಯ್ದೆಗಳಡಿಯಲ್ಲಿ ಅವರು ತಮ್ಮ ಪ್ರಕಾರ್ಯಗಳನ್ನು ಚಲಾಯಿಸಬಹುದಾದ ಸ್ಥಳೀಯ ಪರಿಮಿತಿಗಳೆಂದು ಗೊತ್ತುಪಡಿಸಿದೆ.

1. ಬೀಡಿ ಮತ್ತು ಸಿಗಾರ್ ಕೆಲಸಗಾರರ (ಜೌದ್ಯೋಗಿಕ ಷರತ್ತು) ಕಾಯ್ದೆ, 1966 [The Beedi & Cigar Workers (Conditions of Employment) Act, 1966] (ಕೇಂದ್ರ ಕಾಯ್ದೆ, 32-1966) ಕಲಂ-6(1) ಮತ್ತು ಕಲಂ 6(2)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ನಿರೀಕ್ಷಕರುಗಳನ್ನಾಗಿ;

2. ಬಾಲ ಕಾರ್ಮಿಕ (ನಿಷೇಧ ಮತ್ತು ನಿಯಂತ್ರಣ) ಕಾಯೆ,್ದ 1986 [The Child Labour (Prohibition & Regulation) Act ¹⁹⁸⁶] – (ಕೇಂದ್ರ ಕಾಯ್ದೆ, ಸಂಖ್ಯೆ 61 - 1986), ಕಲಂ-17ರ ಮೇರೆಗೆ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ನಿರೀಕ್ಷಕರುಗಳನ್ನಾಗಿ;

– 3. ಗುತ್ತಿಗೆ ಕಾರ್ಮಿಕ (ನಿಯಂತ್ರಣ ಮತ್ತು ರದ್ದತಿ) ಕಾಯ್ದೆ, 1970 [The Contract Labour ( Regulation & Abolition) Act 1970; (ಕೇಂದ್ರ ಕಾಯ್ದೆ, ಸಂಖ್ಯೆ 37- 1970) ಕಲಂ-28(1)ರ ಮೇರೆಗೆ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ನಿರೀಕ್ಷಕರುಗಳನ್ನಾಗಿ;

4. ಸಮಾನ ವೇತನ ಕಾಯಿದೆ, 1976 ರ [The Equal Remuneration Act 1976] - (ಕೇಂದ್ರ ಕಾಯ್ದೆ, 25-1976) ಕಲಂ-9(1)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ನಿರೀಕ್ಷಕರುಗಳನ್ನಾಗಿ;

8. ಮೋಟಾರು ಸಾರಿಗೆ ನೌಕರರ ಕಾಯ್ದೆ, 1961 [The Motor Transport Workers Act 1961] - ಕೇಂದ್ರ ಕಾಯಿದೆ 27- 1961) ಕಲಂ.4(1)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ನಿರೀಕ್ಷಕರುಗಳನ್ನಾಗಿ;

NOTIFICATION

In exercise of the powers conferred by Section 14 of the Unorganised Workers Social Security Act, 2008 ( Central Act 33of 2008) the Government of Karnataka,hereby makes the following Rules to be incorporated in the Unorganised Workers Social Security (Karnataka) Rules, 2009 namely:-

1. Title and Commencement:- (1) This Rules may be called the Unorganised Workers Social Security (Karnataka)( Amendment) Rules, 2013.

2. They shall come into force on the date of their publication in the official Gazette.

3. Amendment of Rule.12:- In lieu of the existing Rule 12, the following shall be substituted.

12. Registration of Unorganised Workers:

1. The Unorganised workers belonging to the categories as notified by the Government from time to time, shall apply in Form- I to District Administration along with Age Certificate in Form – III subject to the fulfilment of the following conditions namely;

i) The worker shall comply with Sections 2( l ) and 2(m) of the Un-Organised Workers Social Security Act, 2008 (ii).The Registering Authority shall satisfy that the applicant has complied with the Provisions of Section 2 ( l ) and 2 ( m ) of Unorganised Workers Social Security Act, 2008 and he shall collect registration fee of Rs.25/- in cash from the worker and register such worker as beneficiary of the Schemes of the Board and shall issue him / her a smart card and a receipt for the same .

2. (i) Every registered worker shall submit an application of annual subscription of Beneficiary in Form-II to District Administration alongwith a yearly contribution of Rs.100/-, which shall be remitted either to Bank Account of the Board or Cash or IPO or DD or Cheque obtained and Payable in Bangalore in the name of the Member Secretary of the Board (ii). In case, a beneficiary commits default in the payment of contribution for the next or subsequent year, he shall not be entitled for any benefits. But, with the permission of the Member Secretary or an officer authorized by him on this behalf and after satisfying the Officer that the non-payment of contribution was for the reasons beyond his control, or for reasonable grounds, he shall be continued as a beneficiary on payment of Rs.2 per month. This benefit shall be allowed to the beneficiary not more than twice, after which he shall cease to be a beneficiary.

3. The Registration of an unorganised worker shall be cancelled by the Registering Authority if such authority is satisfied that the Registration has been obtained by false statement/declaration or by suppression of facts, after giving an opportunity of being heard to the registered worker. Sufficient opportunity shall be provided to the affected worker by the Registering Authority to put forth his defence in the matter, before cancellation of his registration.
