Sub: Correction of entries in the corrigendum bearing No.KBW/M-1/3/ BNU/91-92, dated:31-03-2008 in respect of properties of Hazrath
Manick Shah Dargah, Avenue Road, Bangalore.
Ref: 1) Gazette Notification No.MBW/19(1)/64, dated:07-06-1965.
2) Corrigendum bearing No.KBW/M-1/3/BNU/91-92, dated:31-08-2008.
3) Representation No.Nil dated:27-03-2013 received from the Secretary, Dargah Hazrath Sothe Shah & Hazrath Manick Shah, Bangalore.
PREAMBLE:
The Dargah Hazrath Sothe Shah and Hazrath Manick Shah Dargah, Sunni, Avenue Road, Bangalore are Gazette notified Waqf institution notified at Sl.No.281, 284 and 286 vide Gazette notification No.MBW/19(1)/64, dated:07-06-1965 publish in official Gazette on 22-07-1965.
The Secretary of the above said Waqf vide his letter dated:27-03-2013 cited at reference (3) has reported that the area of land surrounding Dargah Hazrath Manick Shah situated at Avenue Road, Bangalore has neither been shown in the Gazette nor in the corrigendum cited at reference (1) & (2) and requested to incorporate the area of the land as proposed and issue Addendum in this behalf.
The matter was placed before the Board in its meeting held on 02-03-2013. Board vide subject No.10(9) has unanimously resolved directing Chief Executive Officer, Karnataka State Board of Auqaf to hold enquiry in this regard and submit the same before the Board. The enquiry was conducted the documents has been examined furnished by the President of the said Waqf and in his report has stated the present area in possession of the institution is 36380 Sq.ft and the other area prima facie appears to be encroached which has to be ascertained by a detailed survey.
The matter was placed before the Board in its meeting held on 02-09-2014 vide Addl. subject No.9, the enquiry conducted by the Chief Executive Officer was considered and it was unanimously resolved to issue an Addendum to incorporate the measurements as submitted by the said Waqf institution as the land surrounding the Dargah was not notified in the Gazette neither in the corrigendum.
A detailed survey to be conducted to ascertain area under encroachment.

Dargah Hazrath Moula Ali, Shah Bazar, Gulbarga is a registered Waqf property vide Certificate of Registration No.KBW/REG/10/GBA/97-98 dated 30-12-1998, measuring 80' X 45' feet.
The Waqf Officer, District Waqf Advisory Committee, Gulbarga vide letter dated 25-07-2014 reported that some discrepancies in the measurement of Waqf property belonging to above said Waqf and requested to correct the same by issuing Corrigendum. The records were examined and it is found that there was mistake crept in the Certificate of Registration with regard to the extent of property measuring 80' X 45' feet instead of measurement 250' X 150' feet. As per the Memorandum of Gift dated: 29-10-1996, gifted by Sri Syed Ismail S/o Syed Khasim Jagirdar,Gulbarga.
Hence, the matter was placed before the Hon'ble Chairman, Karnataka State Board of Auqaf, Bengaluru. The Hon'ble Chairman, has accorded the approval for correction of entries in the Certificate of Registration, as per the report of Waqf Officer, District waqf Advisory Committee, Gulbarga.
In view of the facts stated in the Preamble Hence the following Corrigendum.
