ಈ ಕೂಡಲೇ ಜಾರಿಗೆ ಬರುವಂತೆ ಹಾಗೂ ಮಂಗಳೂರು ನಗರ (ಉತ್ತರ) ವಿಧಾನ ಸಭಾ ಕ್ಷೇತ್ರದ ಬಗರ್ ಹುಕುಂ ಸಾಗುವಳಿ ಸಕ್ರಮೀಕರಣ ಸಮಿತಿಯನ್ನು
ವಿಧಾನ ಸಭಾ ಕ್ಷೇತ್ರದ ಬಗರ್ ಹುಕುಂ ಸಾಗುವಳಿ ಸಕ್ರಮೀಕರಣ ಸಮಿತಿಯನ್ನು ಈ ಕೂಡಲೇ ಜಾರಿಗೆ ಬರುವಂತ ಮುಂದಿನ ಆದೇಶದವರೆಗೆ ಈ ಕೆಳಕಂಡಂತೆ ರಚಿಸಲಾಗಿದೆ. ಮುಂದಿನ ಆದೇಶದವರೆಗೆ ಈ ಕೆಳಕಂಡಂತೆ ರಚಿಸಲಾಗಿದೆ.

The services of Sri K.Chiranjivi, Under Secretary to Government of Karnataka, presently working as OSD to Hon'ble Chief Minister (C.M.R.F), are placed at the disposal of the Government of India for being appointed as Additional Private Secretary to Hon'ble Minister for Railways (Shri.D.V.Sadananda Gowda) with immediate effect on co-terminus basis or till he ceases to function as Additional Private Secretary to the Minister or until further orders, whichever event occurs earlier.

WHEREAS, a number of complaints have been received from various organizations and individuals regarding the alleged irregularities committed by Dr. H.B. Walikar, Vice-Chancellor of Karnatak University, Dharwad. The Registrar of Karnatak University, Dharwad has also reported regarding the functioning of the Vice-Chancellor which is not in conformity with the established rules and regulations. The media has also highlighted the malfunctioning and maladministration of Karnataka University alleging irregularities in recruitment and construction works. The alleged irregularities are:
1) Irregularities committed in awarding tender for construction works and purchase of various equipments and other items in gross violation of KTPP Act.
2) Irregularities in the appointment of teaching staff to various faculties in violation of recruitment rules, procedures and UGC norms.

4) Violation of Model Code of Conduct during elections to the Legislative Council.
5) Not following H.E. the Governor and Chancellor's directions issued vide letter No. GS 8 GUM 98 dated 13.08.1998.
It is therefore, felt absolutely necessary to hold an Inquiry to probe into the complaints against Dr. H.B. Walikar; Vice-Chancellor of Karnatak University, Dharwad.
NOW, THEREFORE, I ,VAJUBHAI RUDABHAI VALA, Governor of Karnataka and Chancellor of the Universities in Karnataka, in exercise of the powers conferred on me by Section 8(1) read with Section 12 of the Karnataka State Universities Act, 2000, hereby appoint Justice B. Padmaraj, former Judge of High Court of Karnataka, No.1288, 13th Main, 3rd Cross, Judicial Layout, GKVK Post, Bangalore -560 065, to hold an Inquiry into the allegations made against Dr. H.B. Walikar, Vice-Chancellor, Karnatak University, Dharwad with the following terms of reference:
To probe and enquire into:
1) Financial irregularities in purchase of various office automation items, laboratory equipments and networking components for the development of the institution, in violation of KTPP Act / Rules and also without calling the tenders and thereby substandard equipments have been purchased and bills have been paid very promptly during the year 2011-14 and thereby causing financial loss to the tune of more than Rs.3 crores to the university.
2) Irregularities committed in the construction of building under various schemes sanctioned by the UGC or State Government by piece work contract without calling for tenders and thereby violated the provisions of the KTTP Act.
3) The recruitment of around 110 teaching staff since the year 2010, in violation of the recruitment rules, procedure and UGC norms, by recruiting the candidates who are under-qualified or not qualified and such appointments have been made by the Vice Chancellor just at the verge of his retirement, in violation of the directions No.GS 8 GUM 98, dated 13.10.1998 issued by His Excellency the Governor of Karnataka.
4) Noncompliance of Audit Objections involving crores of rupees.
5) The bills submitted showing expenditure in the name of Government auditors who visited the university and made payment of huge amount to the private hotels, even though the Government auditors were in no way concerned with the UGC Expert Committee visiting the university during the year 2011.
6) The violation of model code of conduct by the Vice Chancellor during the Legislative Council elections of graduate constituency, by conducting interview on 22nd and 23rd May, 2014 for the selection of Assistant Professors in various departments of the university and issued orders in the midnight of 24th May, 2014 by hastily calling Syndicate meeting.
7) Any other irregularities connected to the above terms.
He shall complete the Inquiry in fifteen days and submit the report of Inquiry along with recommendations on the action to be taken.
The Secretarial assistance, Office, transport and accommodation for Justice B. Padmaraj shall be provided by the Registrar, Karnatak University, Dharwad. Other terms and conditions will be issued separately.

Hence, on the findings I, VAJUBHAI VALA, Governor of Karnataka and Chancellor of the Universities in Karnataka, in exercise of the powers conferred on me by Section 9 of the Karnataka State Universities Act, 2000, hereby direct the Registrar, Karnataka University, Dharwad to lodge the complaint for abuse of office, criminal misconduct and breach of trust against the Vice-Chancellor and others and get the matter investigated under the provision of Prevention of Corruption Act, Indian Penal Code and other relevant provisions.

2. He shall be entitled to TA, DA and Executive Class Flight charges.
3. The sitting of the Commission shall be in Dharwad.
4. The Inquiry Officer shall have all the powers and obligations stipulated in Section 8 of the Karnataka State Universities Act, 2000.
5. The Inquiry Officer shall be entitled to have Secretarial assistance from the Karnatak University, Dharwad.
6. The Karnatak University, Dharwad shall provide suitable accommodation and conveyance facilities to the Inquiry Officer to hold the inquiry.
7. The Inquiry Officer shall submit his report to His Excellency the Chancellor as per Notification No. GS 3 KUM 2014 dated 12th September, 2014 and 1st October, 2014.
8. All expenses shall be borne by the Karnatak University, Dharwad.

Whereas, the draft of the Karnataka Ports(Landing and Shipping Fees)(Amendment) Rules, 2012 which the Government of Karnataka proposes to make in exercise of the powers conferred by section 3 read with clause (b) of sub-section(1) of section 10 the Karnataka Ports(Landing and Shipping Fees) Act 1961 (Karnataka Act 20 of 1961) was published in Notification No. PWD 225 PSP 2010 dated: 26.06.2012 of Karnataka Gazette dated: 26.07.2012 as required under sub-section (1) of section 10 inviting objection and suggestion from all person likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.
Whereas, the said Gazette was made available to the Public on 26th July 2012.
And whereas, objections and suggestions received in respect of the said draft have been considered by the State Government.
Now, therefore, in exercise of the powers conferred by section 3 read with clause (b) of sub-section(1) of section 10 of the Karnataka Ports(Landing and Shipping Fees) Act 1961(Karnataka Act 20 of 1961) the Government of Karnataka hereby makes the following rules, namely:-
RULES
1. Title & Commencement
i. These rules may be called the Karnataka Ports (Landing & Shipping Fees) (Amendment) Rules, 2014. ii. They shall come in to force from the date of their publication in the official Gazette.
2. Substitution of Schedules :- In the Karnataka Ports(Landing and Shipping Fees) Rules, 1964 (herein after referred to as the said rules) for schedules A, B, C, E, F, G, H and I of the said rules, the following shall be substituted, namely:-

1. Wharfage shall be in addition to any changes towards rent for storage of goods in the quays, warehouses, transit sheds or landing places of the port.
2. The Stevedores/CHA/Port User filing export application to the Port Authority shall be held solely and severally responsible for any act or omission for breach of any laws, acts, rules, procedures, orders etc., and for authentication of any documents / papers filed before the Port Authorities in respect of the cargo loaded / unloaded to the vessels.
3. The Stevedores/CHA/Port User filing export application to the Port Authority shall be held solely and severally responsible for the authentication of the quantity of cargo loaded / unloaded to the vessels.
4. All goods intended for shipment shall be assessed on export application and wharfage shall be paid before the goods are shipped.
5. All goods landed within the limits of the port shall be assessed on import application and the wharf age shall be paid before the goods are delivered.
6. The port shall not assume custody of any export cargo / import cargo and handle the same at the wharf or jetties.
7. Overtime allowance admissible.
8. For the purpose of levy of fees, less than half metric tonne shall be reckoned as half metric tonne and half Metric Tonne and more but less than one tonne shall be reckoned as one Metric tonne.
9. Tiles, Bricks, Coconuts (The rates in respect of which have been fixed for unit of 1,000) 500 and above will be reckoned as one unit and below 500 will be charged at half the rates.
10. Where the unit of charge is by weight it shall be the gross weight and not the net weight.
11. Where the unit of charge is by measurement 1.4 cubic meters (40-44 cft) shall be reckoned as one metric tonne.
12. The weight of firewood loaded upto the gunwale will be calculated at two thirds of the registered tonnage of the vessel and if loaded above the gunwale it will be taken as three fourths of tonnage of the vessels. When the firewood is loaded below the gunwale or if some other cargo is also loaded in the same vessel the fees shall be levied on firewood, be actual measurement adopting 2 cubic meters equal to one metric tonne.
13. 0.5 Metric tonne or above, or 0.7 cubic meter and above shall be reckoned as one metric tonne and below that quantity shall be reckoned as half tonne.
14. 0.5 Cubic meters and above shall be reckoned as one cubic meter.
15. Goods exempted from wharfage charges.
i. Bonafide consumable / non-consumable ship stores.
ii. Passenger and seaman's bonafide baggage and personal effects accompanying them.
iii. Empty gunnies and twines / Dunnage wood sent to ship to facilitate landing or loading of cargoes.

1. The period of day is calculated from 6.00 A.M. on the date following that on which Cargo is stored.
2. Goods will be stored at owners risk and the Port authorities do not accept responsibility of safe custody.
3. The stacking of the goods shall be confined only to the area specifically permitted by the Officer appointed under section 4 of the Act.
4. If cargo is stacked on any of river bed before shipment or after landing instead of within the public landing place, such river bed shall be deemed to be included, within the extent of landing place and ground rent levied accordingly.
5. No cargo shall remain on the wharves for a period exceeding eight weeks without specific written permission from the Director of Ports & Inland Water Transport, Karwar.
6. Subletting of Port premises including buildings should not be permitted.
7. Sugar and Pulses and other essential commodities as declared by the Government of India shall not be allowed to remain in the port area after 30 days. In case such cargoes remains after 30 days demurrage at the rate of Rs. 5/- per wharfage unit per day shall be levied in addition to the fees specified above.
8. Penalty under sub-section(2) of Section 3 shall be payable at 25% per annum on the delayed payments of any charge under the schedule of rates. (Delay in payments by user will be counted only 7 days after the date of raising the bills by Port Authority)

NOTE:-
1. The payment of the charge will not automatically entitle a person to get a pass.
2. The permission to enter the port area shall be specifically obtained from the Port Authority.
3. The persons having photo identity will be issued temporary pass by the Port Authority on the payment of the above prescribed fees and it is not transferable.
4. Whenever damage to the port property is caused by any vehicle / machinery plying within the port premises, the respective port user / owner of the vehicle / machinery shall accept liability thereof and pay the damages resulting there from.

1. For use of port land for a period not exceeding three years, the conditions imposed in Form "A" of this rule is applicable.
2. For use of port land for a period exceeding three years, the conditions imposed in Form "B" of this rule is applicable.
3. The Director of Ports & Inland Water Transport, Karwar may sanction the port land for the period of 3 years.
4. The Port Officers appointed by section(4) of the Karnataka Ports (Landing & Shipping Fees) Act 1961 may sanction the port land for the period of 11 months.

NOTE:-
1. Fees at double the rate period in excess of 10 days will be levied for steamers.
2. Fees at double the rate for period in excess of 6 days will be levied for sailing vessels, remaining alongside the wharf.
3. Day means the period of 24 hours commencing from 6 a.m.
4. A vessel or vessels tied alongside another vessels lying alongside the wharf shall be construed as the vessel lying alongside the wharf.
5. As far as possible the tankers/vessels which will complete loading/discharge within 24 hrs will be given preference over other vessel. In case of ousting priority, the beneficiary vessel has to pay the shifting charges.
6. The vessel for whose convenience an adjacent berth(s) is (are) kept vacant due to the nature of cargo to be handled at that particular berth shall be charged berth hire charges applicable to the berths kept vacant in addition to berth hire charge for the berth occupied by the vessel.

2. The port users registering with the Port Authority should comply with the conditions imposed in Form "C" of this rules.
3. The Port user registered shall abide by all the conditions / directions issued by the Port Authority.

3. Insertion of new Schedule M:- After Schedule (L) to the said rules, the following schedule shall be inserted, namely:-

3. The user is required to pay Pilotage fees for docking and undocking of the vessel as per the schedule of rates approved by the Government Notification.
4. The user is required to pay electricity charges at five times the actual unit consumed as per prevailing rates of Mangalore Electricity Supply Company (MESCOM).
5. The users intend to apply for the use of Dry Dock shall have to pay five days rent in advance along with the application.
6. The user is required to furnish undertaking to the Port department on a stamp paper worth of Rs. 100/- abiding the rules & regulations of the port department.
7. In case of emergent repairs of departmental crafts or other Government crafts the user will have to vacate the Dry Dock within 24 hours of intimation.
8. User shall have to pay all the fees before undocking of the respective vessel from the Dry Dock.
9. Penalty under Sub section (2) of section 3 shall be payable at twice the rate of fees specified above for the delayed payment.
