1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ :- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ಕಾರ್ಯಕಲಾಪಗಳ ನಿರ್ವಹಣೆ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2014 (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ಕಾರ್ಯಕಲಾಪಗಳ ನಿರ್ವಹಣೆ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2014 (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ಕಾರ್ಯಕಲಾಪಗಳ ನಿರ್ವಹಣೆ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2014 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(೧೫೭)೧೫೮ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಫೆಬ್ರವರಿ ೫, ೨೦೧೫ ಭಾಗ ೪ಎ (2) ಇವು, ಸರ್ಕಾರಿ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಣೆಯಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಮೊದಲನೇ ಅನುಸೂಚಿಯ ತಿದ್ದುಪಡಿ :- ಕರ್ನಾಟಕ ಸರ್ಕಾರದ (ಕಾರ್ಯಕಲಾಪಗಳ ನಿರ್ವಹಣೆ) ನಿಯಮಗಳು. 1977ರ ಮೊದಲನೇ ಅನುಸೂಚಿಯ 15ನೇ ಬಾಬಿನ ಮೊದಲ ಪರಂತುಕದ ನಂತರ ಈ ಮುಂದಿನ ಪರಂತುಕವನ್ನು ಸೇರ್ಪಡೆ ಮಾಡತಕ್ಕದ್ದು, ಎಂದರೆ,-

"ಮತ್ತು ಪರಂತು ಕಾಮಗಾರಿಯ ಮೂಲ ಅಂದಾಜು ರೂ.5.00ಕೋಟಿ ಅಂದಾಜಿಗಿಂತ ಕಡಿಮೆ ಇದ್ದು, ನಂತರ ಪರಿಷ್ಕøತ ಅಂದಾಜು ರೂ.5.00ಕೋಟಿ

ಮೀರಿದ್ದಲ್ಲಿ ಅಂತಹ ಪ್ರಕರಣವನ್ನು ಸಚಿವ ಸಂಪುಟದ ಮುಂದೆ ಮಂಡಿಸತಕ್ಕದ್ದು"

ಸಂಖ್ಯೆ: ಡಿಸಿಎ 12 ಎಆರ್‌ಬಿ 2014, ಬೆಂಗಳೂರು, ದಿನಾಂಕ: 21ನೇ ಅಕ್ಟೋಬರ್, 2014.

ಭಾರತ ಸಂವಿಧಾನ 166 ನೇ ಅನುಚ್ಛೇದದ ಕಲಮು (2) ಮತ್ತು (3) ರಿಂದ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ರಾಜ್ಯಪಾಲರು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ವ್ಯವಹಾರ ಹಂಚಿಕೆ) ನಿಯಮಗಳು. 1977 ಇದಕ್ಕೆ ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡಲು ಕೆಳಕಂಡ ನಿಯಮಗಳನ್ನು ಈ ಮೂಲಕ ರಚಿಸಿದ್ದಾರೆ, ಎಂದರೆ :-

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ :- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ವ್ಯವಹಾರ ಹಂಚಿಕೆ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2014 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇವುಗಳು ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಿದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಅನುಸೂಚಿ XI ಕ್ಕೆ ತಿದ್ದುಪಡಿ :- ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ವ್ಯವಹಾರ ಹಂಚಿಕೆ) ನಿಯಮಗಳು. 1977ರ ಅನುಸೂಚಿ XI ರಲ್ಲಿ (ಇನ್ನು ಮುಂದೆ ಸದರಿ ನಿಯಮಗಳೆಂದು ಕರೆಯಲಾಗುವ),-

(ಎ) "ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆ" ಎಂಬ ಶೀರ್ಷಿಕೆಗೆ "ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳ ಇಲಾಖೆ" ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು.

(ಬಿ) "ಡಿ ನೌಕರಿ ಭರ್ತಿ ನಿಯಮಗಳು ಮತ್ತು ನೇಮಕಗಳು" ಉಪಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿ "ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆ"

ಎಂಬ ಪದಗಳು ಬರುವಲ್ಲೆಲ್ಲ "ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳ ಇಲಾಖೆ" ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು.

3. ಅನುಸೂಚಿ XI-A ಕ್ಕೆ ತಿದ್ದುಪಡಿ :- ಸದರಿ ನಿಯಮಗಳ ಅನುಸೂಚಿ XI-A ರಲ್ಲಿ "ಕಾನೂನು, ನ್ಯಾಯ ಮತ್ತು ಮಾನವ ಹಕ್ಕುಗಳ ಇಲಾಖೆ" ಎಂಬ ಶೀರ್ಷಿಕೆಗೆ "ಕಾನೂನು ಇಲಾಖೆ" ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು.

1. Title and Commencement :- (1) These Rules may be called the Karnataka Government (Allocation of Business) (Amendment) Rules, 2014.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of Schedule XI :- In Schedule XI to the the Karnataka Government (Allocation of Business) Rules, 1977, (hereinafter referred to as the said rules),-

(a) For the heading "DEPARTMENT OF PARLIAMENTARY AFFAIRS AND LEGISLATION", the words "DEPARTMENT OF PARLIAMENTARY AFFAIRS" shall be substituted;

(b) Under the sub-heading "D. Recruitment Rules and Appointments" for the words "Department of Parliamentary Affairs and Legislation" wherever they occur, the words "Department of Parliamentary Affairs" shall be substituted;

3. Amendment of Schedule XI-A :- In Schedule XI-A to the said rules, for the heading "DEPARTMENT OF LAW, JUSTICE AND HUMAN RIGHTS" the words "LAW DEPARTMENT" shall be substituted;

ಭಾರತ ಸಂವಿಧಾನದ 166 ನೇ ಅನುಚ್ಛೇದದ ಕಲಮು (2) ಮತ್ತು (3) ರಿಂದ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ರಾಜ್ಯಪಾಲರು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ಕೆಲಸಗಳ ಹಂಚಿಕೆ) ನಿಯಮಗಳು. 1977 ಇದಕ್ಕೆ ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡಲು ಈ ಕೆಳಕಂಡ ನಿಯಮಗಳನ್ನು ಈ ಮೂಲಕ ರಚಿಸಿದ್ದಾರೆ, ಎಂದರೆ :-

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ :- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ಕೆಲಸಗಳ ಹಂಚಿಕೆ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2014 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇವುಗಳು, ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ.

2. ಅನುಸೂಚಿ XIII-ಎ ಗೆ ತಿದ್ದುಪಡಿ :- ಕರ್ನಾಟಕ ಸರ್ಕಾರದ (ಕೆಲಸಗಳ ಹಂಚಿಕೆ) ನಿಯಮಗಳು. 1977ರಲ್ಲಿ (ಇನ್ನು ಮುಂದೆ ಸದರಿ ನಿಯಮಗಳೆಂದು ಕರೆಯಲಾಗುವ) ಅನುಸೂಚಿ XIII-ಎ ಯಲ್ಲಿ,-

(i) "ಎ.ನೀರಾವರಿ" ಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿ ಕ್ರಮ ಸಂಖ್ಯೆ." 4 ಸಣ್ಣ ನೀರಾವರಿ ವಲಯಗಳು" ನ್ನು ಕೈಬಿಡತಕ್ಕದ್ದು;

(ii) "ಎ.ಎ.ಅಂತರ್ಜಲ" ಶೀರ್ಷಿಕೆ ಮತ್ತು ಅದರಡಿಯಲ್ಲಿ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳನ್ನು ಕೈಬಿಡತಕ್ಕದ್ದು; ಮತ್ತು

(iii) "ಬಿಬಿ. ಪ್ರವಾಹ ನಿಯಂತ್ರಣ ಮತ್ತು ನಿರ್ವಹಣೆ" ಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿ "ಕಡಲ ಗೋಡೆ ನಿರ್ಮಾಣಕ್ಕೆ" ಎಂಬ ಪದಗಳ ನಂತರ "ಮತ್ತು ಸಣ್ಣ ನೀರಾವರಿಗೆ ಸಂಬಂಧಿಸಿದ ಪ್ರವಾಹ ನಿಯಂತ್ರಣ ಮತ್ತು ಸಂರಕ್ಷಣಾ ಕಾಮಗಾರಿಗಳಿಗೆ" ಎಂಬ ಪದಗಳನ್ನು ಸೇರ್ಪಡೆ ಮಾಡತಕ್ಕದ್ದು.

2. ಅನುಸೂಚಿ XIII-ಬಿ ರ ಸೇರ್ಪಡೆ :- ಸದರಿ ನಿಯಮಗಳ ಅನುಸೂಚಿ XIII-ಎ ನಂತರ, ಈ ಕೆಳಕಂಡದ್ದನ್ನು ಸೇರ್ಪಡೆ ಮಾಡತಕ್ಕದ್ದು ಎಂದರೆ,-

3. ಬಾಂದಾರ, ಸೇತುವೆ ಸಹಿತ ಬಾಂದಾರ ಮತ್ತು ಕಿಂಡಿ ಅಣೆಕಟ್ಟುಗಳು.

4. ಮೇಲ್ಮೈ ಏತ ನೀರಾವರಿ ಯೋಜನೆಗಳು.

5. ಸಣ್ಣ ನೀರಾವರಿಗೆ ಸಂಬಂಧಿಸಿದ ಪ್ರವಾಹ ನಿಯಂತ್ರಣ ಮತ್ರು ಸಂರಕ್ಷಣಾ ಕಾಮಗಾರಿಗಳು.

ಇ. ನೌಕರಿಭರ್ತಿ ನಿಯಮಗಳು ಮತ್ತು ನೇಮಕಗಳು

1. ಸಣ್ಣ ನೀರಾವರಿ ಮತ್ತು ಅಂತರ್ಜಲ ಅಭಿವೃದ್ಧಿ ಇಲಾಖೆಯ ಆಡಳಿತ ನಿಯಂತ್ರಣದ ಅಡಿಯಲ್ಲಿ ಬರುವ ಸೇವೆಗಳಿಗೆ ಮತ್ತು ಹುದ್ದೆಗಳಿಗೆ ಸಂಬಂಧಿಸಿದ ನೌಕರಿಭರ್ತಿ ನಿಯಮಗಳು.

2. ಸಿಬ್ಬಂದಿ ಮತ್ತು ಆಡಳಿತ ಸುಧಾರಣೆ ಇಲಾಖೆಯ ಅಡಿಯಲ್ಲಿ ಬರುವವರನ್ನು ಹೊರತುಪಡಿಸಿ ಸಣ್ಣ ನೀರಾವರಿ ಮತ್ತು ಅಂತರ್ಜಲ ಅಭಿವೃದ್ಧಿ ಇಲಾಖೆಯ ಆಡಳಿತ ನಿಯಂತ್ರಣದ ಅಡಿಯಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿರುವ ಅಧಿಕಾರಿಗಳ ಮತ್ತು ಸಿಬ್ಬಂದಿಯ ನೇಮಕಗಳು, ಸ್ಥಳ ನಿಯುಕ್ತಿಗಳು, ವರ್ಗಾವಣೆಗಳು, ರಜೆ ಇತ್ಯಾದಿ.

In exercise of the powers conferred by clauses (2) and (3) of the Ariticle 166 of the Constitution of India, the Governor of Karnataka hereby makes the following rules further to amend the Karnataka Government (Allocation of Business) Rules, 1977, namely:-

1. Title and Commencement :- (1) These Rules may be called the Karnataka Government (Allocation of Business) (Amendment) Rules, 2014.

(2) They shall come into force on the date of their publication in the official Gazette.

2. Amendment of Schedule XIII-A :- In the Karnataka Government (Allocation of Business) Rules, 1977, (hereinafter referred to as the said rules) in the Schedule XIII-A ,-

(i) Under the heading "A. Irrigation item no. "4. Minor Irrigation Zones" shall be omitted;

(ii) The heading "AA. Ground Water" and entries relating thereunder shall be omitted; and

(iii) Under the heading "BB. Flood control and Management" after the words "Construction of Sea Walls" the words "and Flood control and protection works pertaining to minor irrigation" shall be inserted.

2. Insertion of Schedule XIII-B :- After Schedule XIII-A, of the said rules, the following shall be inserted, namely,-

Minor irrigation and ground Water Development Department

A. Minor Irrigation

1. Development and maintenance of tanks having 40 to 2000 hectares of catchment area.

2. Constructioon of new tanks and percolation tanks.

3. Construction of barrages, barrages with bridge and vented dams.

4. Surface lift irrigation schemes.

5. Flood control and protection works pertaining to minor irigation.

6. Minor Irrigation Zones.

B. Ground Water Division

All matters pertaining to Ground water

C. Jalasmvardhana Yojana Sangha

All matters pertainiing to Jalasamvardhana Yojana Sangha

D. Codes and Manuals

Preparation of Codes and Manuals in respect of departments under its administrative control.

E. Recruitment Rules and Appointments

1. Recruitment rules relating to the services and posts under the administrative control of Minor Irrigation and Ground water Development Department.

2. Appiointments, postings, transfers, leave, etc., of the officers and staff working under the administrative control of Minor Irrigation and Ground water Development Department except those coming under the Department of Personnel and Administrative Reforms.
