ಅಧಿಸೂಚನೆ
ಸಂಖ್ಯೆ : ಲೋಇ 96 ಪಿಎಸ್‌ಪಿ 2015, ಬೆಂಗಳೂರು, ದಿನಾಂಕ: 19-10-2015.
ಪ್ರವಾಸೋದ್ಯಮ ಇಲಾಖೆಯು 2015-2020ರ ಪ್ರವಾಸೋದ್ಯಮ ನೀತಿಯನ್ನು ಜಾರಿಗೆ ತಂದಿದ್ದು, ಸದರಿ ಪ್ರವಾಸೋದ್ಯಮ ನೀತಿಯಲ್ಲಿ "ಕ್ರೂಸ್ ಟೂರಿಸಂ"ಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಈ ಕೆಳಕಂಡ ಅರ್ಹತಾ ಮಾನದಂಡ, ನಿಯಮ ಮತ್ತು ಷರತ್ತುಗಳನ್ನು ಅಳವಡಿಸಿಕೊಳ್ಳಲು ಆದೇಶಿಸಿದೆ :
1. ಈ ರಿಯಾಯಿತಿಯು ಕ್ರೂಸ್ ಟುರಿಸಂನ ಉದ್ದೇಶಕ್ಕೆ ಬಳಸುವ ಟೂರಿಸಂ ಬೋಟಗಳು, ಪ್ಯಾಸೆಂಜರ್ ಬೋಟಗಳು, ಪೆಡಲ್ ಬೋಟುಗಳು, ಪ್ಯಾರಸೆಲಿನ್ ಬೋಟಗಳು ಹಾಗೂ ಕ್ರೂಸ್ ಬೋಟುಗಳಿಗೆ ಮಾತ್ರ ಅನ್ವಯಿಸುತ್ತದೆ.
2. ಟೂರಿಸಂ ಬೋಟ್ ಹೊಂದಿದ ಸಂಸ್ಥೆ/ ಮಾಲಿಕರು ಪ್ರವಾಸೋದ್ಯಮ ಇಲಾಖೆಯಿಂದ ನೋಂದಾಯಿಸಿರಬೇಕು.
3. ಟೂರಿಸಂ ಬೋಟ್ ಹೊಂದಿದ ಸಂಸ್ಥೆ/ ಮಾಲಿಕರು ಕನಿಷ್ಠ 2 ನಾವೆಗಳನ್ನು/ ಬೋಟ್‌ಗಳನ್ನು ಪ್ರವಾಸೋದ್ಯಮ ಚಟುವಟಿಕೆಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಖರೀದಿಸಬೇಕು.
4. ಇಂತಹ ತೆರಿಗೆ ವಿನಾಯತಿಯನ್ನು ಪ್ರವಾಸೋದ್ಯಮ ನೀತಿ ಅವಧಿಯಲ್ಲಿ ಸುಮಾರು 200 ಟೂರಿಸಂ ಬೋಟುಗಳಿಗೆ ವಿಸ್ತರಿಸಲಾಗುವುದು (2 ಬೋಟುಗಳು/ನಾವೆಗಳು ಪ್ರತಿ ಒಬ್ಬರಿಗೆ/ಸಂಸ್ಥೆಗೆ)
5. ಟೂರಿಸಂ ಉದ್ದೇಶಕ್ಕೆ ಬಳಸುವ ಬೋಟುಗಳು ಸಮುದ್ರದಲ್ಲಿ/ನದಿಯಲ್ಲಿ ಸಂಚರಿಸುವ ಪೂರ್ವದಲ್ಲಿ ಕರ್ನಾಟಕ ಇನ್‌ಲ್ಯಾಂಡ್ ವೆಸಲ್ಸ್ ಆಕ್ಟ್ 1917 (ಪರಿಷ್ಕ್ರತ ಆಕ್ಟ್ 2006)ರ ಕಲಂ 15(4)ರ ಅಡಿಯಲ್ಲಿ ನೋಂದಣಿ ಹಾಗೂ ಕಲಂ 9ರ ಅಡಿಯಲ್ಲಿ ಸರ್ವೆ ಪ್ರಮಾಣ ಪತ್ರವನ್ನು ಹೊಂದಿರಬೇಕು.
6. ಟೂರಿಸಂ ಉದ್ದೇಶಕ್ಕೆ ಬಳಸುವ ಬೋಟುಗಳು Hull and Machinery Insurance, Life Saving Appliances Certificate, Communication Equirpment Certificate ಮತ್ತು Minimum Safe Manning Certificate ಗಳನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಹೊಂದಿರಬೇಕು.
7. ಕರ್ನಾಟಕ ಹಾರ್ಬರ್ ಕ್ರಾಪ್ಟ್ ನಿಯಮ 1963ರ ಅಡಿಯಲ್ಲಿ ಕರ್ನಾಟಕ ರಾಜ್ಯದೊಳಗೆ ಸಂಚರಿಸುವ ಟೂರಿಸಂ ನಾವೆಯ ಚಾಲಕರು/ಇಂಜೀನ್ ಡ್ರೈವರಗಳು ಸಾರಂಗ್ ಪ್ರಮಾಣ ಪತ್ರವನ್ನು/ಇಂಜೀನ್ ಡ್ರೈವರ್ ಗ್ರೇಡ್-III ಪ್ರಮಾಣ ಪತ್ರವನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಹೊಂದಿರಬೇಕು.
8. ಟೂರಿಸಂ ಉದ್ದೇಶಕ್ಕೆ ಬಳಸುವ ಬೋಟುಗಳ ರಕ್ಷಣಾ ಸಾಧನಗಳಾದ ಲೈಪ್ ಜಾಕೆಟ್ ಮತ್ತು ಲೈಪ್ ಬಾಯ್ಸ್‌ಗಳನ್ನು ಹಾಗೂ ಸಂಪರ್ಕ ಸಾಧನಗಳಾದ VHF ಗಳನ್ನು ಹೊಂದಿರಬೇಕು.
9. ಕರ್ನಾಟಕ ಪ್ರವಾಸೋದ್ಯಮ ಇಲಾಖೆಯೊಂದಿಗೆ ಗುತ್ತಿಗೆ ಕರಾರು ಹೊಂದಿರಬೇಕು (ಲೀಸ್ ಒಪ್ಪಂದ) ಮತ್ತು ಪ್ರವಾಸೋದ್ಯಮ ಚಟುವಟಿಕೆಗಾಗಿ ಪ್ರವಾಸೋದ್ಯಮ ಇಲಾಖೆಗೆ ಮಾತ್ರ ಬೋಟುಗಳು/ನಾವೆಗಳನ್ನು ಓಡಿಸುವುದು.
೧೫೧೬ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಡಿಸೆಂಬರ್ ೩೧, ೨೦೧೫ ಭಾಗ ೪ಎ10. ಲೀಸ್ ಅವಧಿ ಮುಗಿದ ತಕ್ಷಣ ಈ ಬೋಟ್ ಮಾಲಿಕರು ಸಂಬಂಧಿಸಿದ ನಿರ್ದೇಶಕರು ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆ, ಇವರಿಗೆ ಮಾಹಿತಿ ಒದಗಿಸುವುದು.
11. ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪ್ರವಾಸೋದ್ಯಮ ಇಲಾಖೆಯ ನಿಬಂರ್ಧಗಳನ್ನು ಮೀರಿ ಅಥವಾ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪ್ರವಾಸೋದ್ಯಮವಲ್ಲದ ಉದ್ದೇಶಕ್ಕಾಗಿ ಬೋಟಗಳನ್ನು ಯಾವುದೇ ಸಂದರ್ಭದಲ್ಲಿ ಬಳಸಿದಲ್ಲಿ ಬೋಟುಗಳಿಗೆ ನೀಡಿರುವ ತೆರಿಗೆ ವಿನಾಯಿತಿಯು ಕೂಡಲೇ ರದ್ದಾಗುತ್ತದೆ.
12. ತೆರಿಗೆ ವಿನಾಯಿತಿಗೆ ಅರ್ಹರಾಗಿರುವ ಟೂರಿಸಂ ಬೋಟುಗಳನ್ನು ಪ್ರವಾಸೋದ್ಯಮ ಇಲಾಖೆಯು ಗುರುತಿಸಿ ನಿರ್ದೇಶಕರು, ಬಂದರು ಮತ್ತು ಒ.ಜ.ಸಾ ಇಲಾಖೆ, ಕಾರವಾರ ಇವರಿಗೆ ಶಿಫಾರಸ್ಸು ಮಾಡತಕ್ಕದ್ದು ಅದರಂತೆ ನಿರ್ದೇಶಕರು, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆ, ಕಾರವಾರ ಇವರು ತೆರಿಗೆ ಪಾವತಿಯಿಂದ ವಿನಾಯಿತಿ ನೀಡಲು ಕ್ರಮವಹಿಸತಕ್ಕದ್ದು.
13. ಪ್ರವಾಸೋದ್ಯಮ ಅಭಿವೃದ್ಧಿ ಸಮಿತಿಯು ಮುಖ್ಯವಾಗಿ ಟೂರಿಸಂ ಉದ್ದೇಶಕ್ಕೆ ಬಳಸುವ ಬೋಟುಗಳನ್ನು/ನಾವೆಗಳನ್ನು ಕರ್ನಾಟಕ ಇನ್‌ಲ್ಯಾಂಡ್ ವೆಸಲ್ಸ್ ಆಕ್ಟ್ 1917ರಡಿ ನಿರ್ಮಿಸಿ, ನೋಂದಣಿ ನಿಯಮ ಹಾಗೂ ಅಧಿನಿಯಮಗಳನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಪಾಲಿಸುವುದು.

SLAO SR (TU-RA RAILWAY)11/2011-12 'Whereas the Governor of Karnataka vide notification No. RD 86 AQT .2012, Date: 28.11.2012 notified the land. described in the specification mentioned in the notification which is required !or the public purpose, namely for the Land Acquisition of 64-08: 1/2 and 5733.76 Sq.Mt of Site for the purpose of Tumkur-Rayadurga Railways at Annena halli Grama, .Kasaba Hobli, Tumkur Taluk, Tumkur District under section 6 of the Land 'Acquisition Act 1894. This notification was published in the Karnataka State Gazette dated 05.01.2012 and Gramachavadi dated: 19.03.2013. As per section 11(1) of the Land Acqusition Act 1894, the validity of the notification is for 2 years to prepare the Award and its limitation period expires on 18.03.2015.
The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013 came into force on 01.01.2014. As per provision of Section 24(1 )(a) of this Act, where no award under section 11 of the Land Acquisition Act, 1894 has been made, then all provisions of this Act relating to the determination shall apply.
Whereas, that The Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 has come into force with effect from dated 01.01.2014 and absence of Rules framed by virtue of the powers conferred under section 109 of this Act to State Government and this process may take some time. Therefore, due to unavoidable circumstances it may not be possible to get the award notification of section 11 (1) of the Land acquisition Act, 1894, which is now equivalent to section 24(1) (a) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013.
Hence, in exercise of the powers conferred under first provision of section 25 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement act 2013, the Governor of Karnataka is pleased to extend the time limit of notification No. RD 86 AQT 2012 dated 28.11.2012 issued under section 6 of the Land Acquisition Act- 1894. The last date of publication of this notification is dated 05-01-2012 and 19-03-2013 in Gramachavadi. The last date on which the award was to be finished within 2 Years.( 19.03.2013-18.03.2015) Now for the above said reason, a further period of 08 months from 18.03.2015 is accorded for preparing the Award according to Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013.
