NOTIFICATION

NO. FD 130 EXP-12 2015, BENGALURU, Dated: 8TH September 2015

In exercise of the powers conferred by sub-section (1) of Section 25 of the Karnataka Transparency in Public Procurements Act, 1999 (Karnataka Act 29 of 2000) the Government of Karnataka hereby makes the following rules further to amend the Karnataka Transparency in Public Procurement Rules, 2000, namely:-

1. Title and Commencement:- (1) These rules may be called the Karnataka Transparency in Public Procurement (Amendment) Rules, 2015.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 25 :- In the Karnataka Transparency in Public Procurements Rules, 2000 (herein after referred to as the said rules, in rule 25, in sub-rule (2),-

(a) for the proviso and Explanation, the following shall be substituted namely :-

"Provided that for a period of five years 01-10-2014, Good manufactured by Micro and Small Enterprise located in the State shall be given fifteen percent price preference against the large and Medium Industries of the State and Industries of other States during Government Departments purchases, subject to the following conditions, namely :-

(i) An enterprise shall be registered with the Director of Industries and Commerce, Government of Karnataka as a Micro and Small Enterprises, under Micro Small and Medium Enterprises Development Act, 2006, (Central Act 27 of 2006) ; and

(ii) An enterprise shall produce a certificate obtained from the said authority certifying that it is a Micro and small Enterprises.

(b) after clause (e), the following shall be inserted, namely :-

"(f) in a tender where the tenderers are both from the State of Karnataka as well as from outside the State of Karnataka, the Sales Tax/Vat shall be excluded for the evaluation of the price."

3. Amendment of rule 26:- In rule 26 of the said rules, after sub rule (4), the following shall be inserted, namely :-

"(5) Micro and Small Enterprises registered with NSIC under a single point vendor registration scheme, shall be facilitated by providing tenders sets free of cost, exempting from payment of Earnest Money Deposit during purchases by all Government Department and State owned PSUs."

ಅಧಿಸೂಚನೆ ಸಂ:ಸಇ/34/ಎಂಆರ್ಇ/1/2011, ದಿ:24/06/2011ರ ಮೂಲಕ ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) ಅಧಿನಿಯಮ 1966ರ ಕಲಂ 144 ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕೊಪ್ಪ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯನ್ನು ಶೃಂಗೇರಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯೊಂದಿಗೆ ವಿಲೀನಗೊಳಿಸಿ ಕೊಪ್ಪ, ನರಸಿಂಹರಾಜಪುರ ಮತ್ತು ಶೃಂಗೇರಿ ತಾಲ್ಲೂಕುಗಳನ್ನೊಳಗೊಂಡ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರಕ್ಕೆ ಶೃಂಗೇರಿಯಲ್ಲಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯನ್ನು ಸ್ಥಾಪಿಸಿ ಕೇಂದ್ರ ಸ್ಥಾನವನ್ನು ಕೊಪ್ಪದಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿದೆ.

ಮತ್ತು ಆದಕಾರಣ ಕಾಲಕಾಲಕ್ಕೆ ಹೊರಡಿಸಲಾದ ಸರ್ಕಾರಿ ಅಧಿಸೂಚನೆಗಳ ಮೂಲಕ ಶೃಂಗೇರಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರದಲ್ಲಿ ಈ ಕೆಳಕಂಡಂತೆ ನಮೂದಿಸಿದ ಕೃಷಿ ಉತ್ಪನ್ನಗಳನ್ನು ಮಾರಾಟ ನಿಯಂತ್ರಣಕ್ಕೆ ಒಳಪಡಿಸಲಾಗಿದೆ.

ಮತ್ತು ಆದಕಾರಣ, ಮೇಲೆ ನಮೂದಿಸಿದ ಕೃಷಿ ಉತ್ಪನ್ನಗಳ ಪರಿಣಾಮಕಾರಿ ಮಾರಾಟ ನಿಯಂತ್ರಣಕ್ಕಾಗಿ ಶೃಂಗೇರಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯನ್ನು ಈ ಕೆಳಗಿನ ಅನುಸೂಚಿಯಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದಂತೆ ಎರಡು ಪ್ರತ್ಯೇಕ ಕೃಷಿ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರಗಳನ್ನಾಗಿ ವಿಭಜಿಸಲು ಸರ್ಕಾರವು ಉದ್ದೇಶಿಸಿದೆ.

ಆದ್ದರಿಂದ, ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) ಅಧಿನಿಯಮ, 1966ರ ಕಲಂ 3ನ್ನು ಓದಿ ಕಲಂ 145(1)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಸರ್ಕಾರವು ಶೃಂಗೇರಿ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ಸಮಿತಿಯ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರವನ್ನು ವಿಭಜಿಸಿ, ಈ ಕೆಳಗಿನ ಅನುಸೂಚಿಯ 4ನೇ ಅಂಕಣದಲ್ಲಿ ನಮೂದಿಸಿದ ಕೃಷಿ ಉತ್ಪನ್ನಗಳ ಮಾರಾಟ ನಿಯಂತ್ರಣಕ್ಕಾಗಿ 3ನೇ ಅಂಕಣದಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರದ ಪರಿಮಿತಿಯನ್ನೊಳಗೊಂಡಂತೆ 2ನೇ ಅಂಕಣದಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದ ಎರಡು ಪ್ರತ್ಯೇಕ ಮಾರುಕಟ್ಟೆ ಕ್ಷೇತ್ರಗಳನ್ನು ವಿಭಜಿಸಲು ಈ ಮೂಲಕ

ಮೇಲಿನ ಉದ್ದೇಶಿತ ಪ್ರಸ್ತಾವಕ್ಕೆ ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) ಅಧಿನಿಯಮ, 1966 ರ ಕಲಂ 3 ರನ್ವಯ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿದ್ದು, ಯಾವುದೇ ಆಕ್ಷೇಪಣೆಗಳು/ಸಲಹೆಗಳು ಇದ್ದಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆಯು ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಅಥವಾ ಕನ್ನಡ ದಿನಪತ್ರಿಕೆಯಲ್ಲಿ ಯಾವುದರಲ್ಲಿ ತಡವಾಗಿ ಪ್ರಕಟವಾಗುವುದೋ ಆ ದಿನಾಂಕದಿಂದ 32 ದಿವಸದೊಳಗಾಗಿ ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿಗಳು, ಸಹಕಾರ ಇಲಾಖೆ, ಕರ್ನಾಟಕ ಸರ್ಕಾರ, ಬಹುಮಹಡಿಗಳ ಕಟ್ಟಡ, ಬೆಂಗಳೂರು 560001 ಇವರಿಗೆ ಸಲ್ಲಿಸಲು ಸೂಚನೆ ನೀಡಲಾಗಿದೆ.

1. Title and Commencement :- (1) These rules may be called the Karnataka Forest Department Services (Recruitment) (Amendment) Rules, ²⁰¹⁵.

2. Amendment of Schedule I : In the Karnataka Forest Department Services (Recruitment) Rules, 2003 (hereinafter refereed as the said rules), in schedule-I, for the entries relating to the category of post of "Assistant Surgeon (Veterinary)" at Serial number 16, for the words and brackets " Assistant Surgeon (Veterinary), the words :Veterinary Officer" shall be substituted.

3. Amendment of Schedule II : In sechedule-II of the said rules, for the entries relating to the catergory of post of "Assistant Surgeon (Venterinary)" at serial number 16, for the words and brackets "Assistant Surgeon (Veterinary), the words "Veterinary Officer" shall be substituted namely:-
