Captain. Dr. K. Rajendra, KAS was, selected to. Karnataka Administrative Service (Junior Scale} in the 1999 batch of Gazetted Probationers selected through Karnataka Public Service Commission and was appointed to. State Government Service vide Notification dated: 01.02.2006. The officer joined the service on 02.02.2006. Prior to joining Karnataka Administrative Service, the Officer served in the Indian Army as a Short Service Commissioned (SSC) Officer in the Remount Veterinary Corps during the period from 22.03.1993 to. 31.03.1998.
The officer had requested to consider his case for promotion to Indian Administrative Service in terms of 4th proviso to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955 by reckoning his service as Short Service Commissioned Officer in the Indian Army from 22.03.1993 to 31.03.1998 and also, his continuous service in KAS from 02.02.2006 onwards. The issue of promotion of Captain. Dr. K. Rajendra, KAS in terms of 4th provison to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955 has been examined· in consultation with the Union Public Service Commission (UPSC) and also the Government of೨೭೪ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಮೇ ೧೨, ೨೦೧೬ ಭಾಗ ೨ India, Department of Personnel & Training. On the advice of the UPSC, a clarification was sought from the Government of India, Department of Personnel & Training regarding counting of the service rendered in Short Service Commission and consequential deemed date of appointment in SCS in terms of 4th ·proviso to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955. The Government of India, Department of Personnel & Training in its letter dated: 18.01.2016 has furnished its clarification stating that in accordance with 4th proviso to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955, granting the benefit of deemed date of appointment in the State Civil Service in the Emergency Commissioned and Short Service Commissioned officers appointed to the State Civil Service, is the subject matter exclusively falling within the domain of the State Government. Hence, it has been requested to take further necessary action in the matter accordingly, as per the provisions contained in the relevant Recruitment Rules of its State Civil Service Officers.
Responding to the letter dated: 18.01.2016 of the Government of India, Department of Personnel & Training, the UPSC in its letter dated: 01.02.2016 has requested the State Government to take necessary action for issuance of an Order regarding counting of the service in Short Service Commission and the consequential deemed date of appointment in KAS in terms of 4th provison to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955 with respect to Captain Dr. K. Rajendra, KAS.
The issue of counting of the service rendered in Short Service Commission and assigning consequential deemed date of appointment in KAS· in terms of 4th proviso to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955 has been examined in the light of the clarification furnished by the Gol, DoPT vide its letter dated: 18.01.2016 and also the advice of the UPSC contained in letter dated: 01.02.2016 vis-a-vis the provisions contained in the Recruitment Rules of the State Civil Service Officers and also the Karnataka Government Servants (Seniority) Rules, 1957.
There is no special provision in either the Recruitment 'Rules pertaining to SCS officers or in the KAS (Seniority) Rules, 1957 to determine the seniority by reckoning the service rendered in Short Service Commission of the Indian Army. Hence, it is necessary to consider the issue of counting of service in Short Service Commission and assigning consequential deemed date of appointment in KAS with specific reference to contents of 4th proviso to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955.
Captain Dr. K. Rajendra, KAS had served in the Indian Army as Short Service Commissioned Officer during the period from 22.03.1993 to 31.03.I998. Having regard to this, the seniority of the Captain Dr. K. Rajendra has to be notionally fixed just below the last person in the batch selected to the Karnataka Administrative Service through the Karnataka Public Service Commission immediately after Captain Dr. K. Rajendra joined the Indian Army. Subsequent to joining of Captain Dr. K. Rajendra in the Indian Army during 1993, the 1997 batch officers have been appointed to Karnataka Administrative Service through the Karnataka Public Service Commission and Shri. S.B. Shettennavar is the last.person in the 1997 batch. Hence, Captain Dr. K. Rajendra has to be assigned seniority immediately after Shri. S.B. Shettennavar.
The name of Shri. S.B. Shettennavar is at Serial No. 964 in the Final Gradation List of KAS Group-A Junior Scale Cadre as on 01.01.2004 covering the period from 01.11.1956 to 31.12.2003 published vide Notification No. DPAR 03 SKG 2000,.

Accordingly, Captain Dr. K. Rajendra is assigned notional seniority in the Final Gradation List of KAS Group-A Junior Scale Cadre as on .01.01.2004 covering the period from 01.11.1956 to 31.12.2003 published vide Notification No. DPAR 03 SKG 2000,

This assignment of deemed seniority is subject to the following conditions:-
i. This assignment of deemed seniority is for the limited purpose of promotion to lAS in terms of 4th proviso to Regulation 5(2) of the lAS (Appointment by Promotion) Regulations, 1955.
ii. This notional fixation of seniority shall come into force prospectively and this shall not disrupt any promotions already made to the lAS of Karnataka Cadre.
iii. This shall not confer any other right on the officer to claim any other service benefit by virtue of this notional fixation of seniority in KAS.
