ಮೇ#ೆ (1)ರಲ್ಲಿ ಓದ#ಾದ ಆದೇಶದನ್ವಯ, ರಾಜ್ಯದಲ್ಲಿ ಭ್ರಷ್ಟಾಚಾರ ತಡೆ ಅಧಿನಿಯಮ, 1988ನ್ನು ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಮೇ#ೆ (1)ರಲ್ಲಿ ಓದ#ಾದ ಆದೇಶದನ್ವಯ, ರಾಜ್ಯದಲ್ಲಿ ಭ್ರಷ್ಟಾಚಾರ ತಡೆ ಅಧಿನಿಯಮ, 1988ನ್ನು ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಮೇ#ೆ (1)ರಲ್ಲಿ ಓದ#ಾದ ಆದೇಶದನ್ವಯ, ರಾಜ್ಯದಲ್ಲಿ ಭ್ರಷ್ಟಾಚಾರ ತಡೆ ಅಧಿನಿಯಮ, 1988ನ್ನು ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಜಾರಿಗೆ ತರಲು ಹಾಗೂ ಸ್ವತಂತ್ರವಾಗಿ ತನಿಖೆ ನಡೆಸಲು ಒಂದು ಪ್ರತ್ಯೇಕ ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು (Anti Corruption ಜಾರಿಗೆ ತರಲು ಹಾಗೂ ಸ್ವತಂತ್ರವಾಗಿ ತನಿಖೆ ನಡೆಸಲು ಒಂದು ಪ್ರತ್ಯೇಕ ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಜಾರಿಗೆ ತರಲು ಹಾಗೂ ಸ್ವತಂತ್ರವಾಗಿ ತನಿಖೆ ನಡೆಸಲು ಒಂದು ಪ್ರತ್ಯೇಕ ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು Bureau) ಸೃಜಿಸ#ಾಗಿದೆ.

ಮೇ#ೆ (2)ರಲ್ಲಿ ಓದ#ಾದ ಆದೇಶದಲ್ಲಿ, ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಸೃಜಿಸಿ ಹೊರಡಿಸಿರುವ ದಿ:14.03.2016ರ ಮೇ#ೆ (2)ರಲ್ಲಿ ಓದ#ಾದ ಆದೇಶದಲ್ಲಿ, ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಸೃಜಿಸಿ ಹೊರಡಿಸಿರುವ ಮೇ#ೆ (2)ರಲ್ಲಿ ಓದ#ಾದ ಆದೇಶದಲ್ಲಿ, ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಸೃಜಿಸಿ ಹೊರಡಿಸಿರುವ

ಸ್ಥಾಪಿತವಾದ ನಿಗಮ/ಮಂಡಳಿಗಳು ಮತ್ತು ವಿಧಾನ ಮಂಡಲದ ಅಧಿನಿಯಮದಡಿ ಸ್ಥಾಪಿತವಾಗಿರುವ ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳು ಹಾಗು ಸ್ಥಾಪಿತವಾದ ನಿಗಮ/ಮಂಡಳಿಗಳು ಮತ್ತು ವಿಧಾನ ಮಂಡಲದ ಅಧಿನಿಯಮದಡಿ ಸ್ಥಾಪಿತವಾಗಿರುವ ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳು ಹಾಗು ಸ್ಥಾಪಿತವಾದ ನಿಗಮ/ಮಂಡಳಿಗಳು ಮತ್ತು ವಿಧಾನ ಮಂಡಲದ ಅಧಿನಿಯಮದಡಿ ಸ್ಥಾಪಿತವಾಗಿರುವ ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳು ಹಾಗು ಎ#್ಲಾ ಶಾಸನಬದ್ಧ ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಜಾಗೃತ ಕೋಶಗಳನ್ನು ಚಾಲನೆಗೊಳಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಕಾರ್ಯವಿಧಾನ/ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಕಾರ್ಯವಿಧಾನ/ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಎ#್ಲಾ ಶಾಸನಬದ್ಧ ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಜಾಗೃತ ಕೋಶಗಳನ್ನು ಚಾಲನೆಗೊಳಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ

ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ / ಇ#ಾಖೆಗಳಲ್ಲಿ ಒಂದು ಜಾಗೃತ ಕೋಶ ಇರತಕ್ಕದ್ದೆಂದೂ ಹಾಗೂ ಆಯಾ ಇ#ಾಖೆಗಳ ಇ#ಾಖೆಗಳಲ್ಲಿ ಒಂದು ಜಾಗೃತ ಕೋಶ ಇರತಕ್ಕದ್ದೆಂದೂ ಹಾಗೂ ಆಯಾ ಇ#ಾಖೆಗಳ ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ / ಕಾರ್ಯದರ್ಶಿಗಳ ನಂತರದ (officer next in seniority) ಅಧಿಕಾರಿಯನ್ನು ಸದರಿ ಜಾಗೃತ ಕೋಶದ ಅಧಿಕಾರಿಯನ್ನು ಸದರಿ ಜಾಗೃತ ಕೋಶದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ / ಕಾರ್ಯದರ್ಶಿಗಳ ನಂತರದ ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿ (Chief Vigilance Officer)

ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಸಂಬಂಧಿಸಿದಂತೆ ಸರ್ಕಾರದ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿ ಇವರನ್ನು ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸ#ಾಗಿದೆ. ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಸಂಬಂಧಿಸಿದಂತೆ ಸರ್ಕಾರದ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿ ಇವರನ್ನು ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸ#ಾಗಿದೆ. ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಸಂಬಂಧಿಸಿದಂತೆ ಸರ್ಕಾರದ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿ ಇವರನ್ನು ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸ#ಾಗಿದೆ.

ಮೇ#ೆ (4)ರಲ್ಲಿ ಓದ#ಾದ ಅ.ಟಿಯಲ್ಲಿ ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿ ಹಾಗೂ ಜಾಗೃತ ಅಧಿಕಾರಿಗಳ ವರ್ಗಾವಣೆ/ನಿವೃತ್ತಿ ಇತ್ಯಾದಿಗಳ ಸಂದರ್ಭಗಳಲ್ಲಿ ಈ ಹಿಂದೆ ಹೊರಡಿಸಿದ ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿ/ಜಾಗೃತ ಅಧಿಕಾರಿಗಳ ನೇಮಕಾತಿ ಆದೇಶದಲ್ಲಿ ನಮೂದಿಸಿದ ಪದನಾಮಕ್ಕೆ ಬೇರೆ ಮಟ್ಟದ ಅಧಿಕಾರಿಗಳು ನೇಮಕಾತಿ ಆದ ಸಂದರ್ಭಗಳಲ್ಲಿ ಆಯಾ ಬದ#ಾವಣೆಯಾದ ಪದನಾಮಗಳ ಅನುಸಾರ ಆಯಾ ಇ#ಾಖೆಯ ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ/ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ/ ಕಾರ್ಯದರ್ಶಿಗಳ ನಂತರದ ಅಧಿಕಾರಿಯನ್ನು (officer next in seniority) ಹೊಸದಾಗಿ ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿ (Chief Vigilance Officer)ಯನ್ನಾಗಿ ನೇಮಿಸಿ ಆದೇಶ ಹೊರಡಿಸಲು ಕೋರಿರುತ್ತಾರೆ.

ಅಲ್ಲದೆ ಸಚಿವಾಲಯದ ಎ#್ಲಾ ಇ#ಾಖೆಗಳು ತಮ್ಮ ಹಾಗೂ ತಮ್ಮ ಆಡಳಿತ ವ್ಯಾಪ್ತಿಗೆ ಒಳಪಡುವ ಎ#್ಲಾ ನಿರ್ದೇಶನಾಲಯ/ಆಯುಕ್ತಾಲಯ, ಕ್ಷೇತ್ರ ಇ#ಾಖೆ, ಸಾರ್ವಜನಿಕ ಉದ್ದಿಮೆಗಳು, ಸರ್ಕಾರದಿಂದ ಸ್ಥಾಪಿತವಾದ ನಿಗಮ/ಮಂಡಳಿಗಳು ಮತ್ತು ವಿಧಾನ ಮಂಡಲದ ಅಧಿನಿಯಮದಡಿ ಸ್ಥಾಪಿತವಾಗಿರುವ ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳು ಹಾಗೂ ಎ#್ಲಾ ಶಾಸನಬದ್ಧ ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಹಾಗೂ ಜಿ#್ಲಾ ಮಟ್ಟ/ವಲಯ ಮಟ್ಟದ ಕಚೇರಿಗಳಲ್ಲಿ ನೇಮಿಸ#ಾಗಿರುವ ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿ/ಜಾಗೃತ ಅಧಿಕಾರಿಗಳ ವಿಳಾಸ, ದೂರವಾಣಿ, ಇತ್ಯಾದಿ ಎ#್ಲಾ ವಿವರಗಳನ್ನು ಆಯಾ ಇ#ಾಖೆಗಳ ಅಂತರ್ಜಾಲದಲ್ಲಿ ಕೂಡ#ೇ ಮಾಹಿತಿ ಕೊಂಡಿ(Information Link)ಯನ್ನು ಅಳವಡಿಸುವ ವ್ಯವಸ್ಥೆ ಮಾಡುವಂತೆ ತಿಳಿಸಿರುತ್ತಾರೆ.

ದಿನಾಂಕ:04.07.2016ರ ಆದೇಶದಲ್ಲಿ ನಮೂದಿಸಿದ ಸಿಆಸು(ಇ-ಆಡಳಿತ) ಇ#ಾಖೆಯ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿಗಳು ವಯೋ ನಿವೃತ್ತಿ ಹೊಂದಿರುತ್ತಾರೆ. ಆದ್ದರಿಂದ ಸರ್ಕಾರ ಉಪ ಕಾರ್ಯದರ್ಶಿ, ಸಿಆಸು(ಇ-ಆಡಳಿತ) ಇ#ಾಖೆ ಇವರನ್ನು ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸಲು ತೀರ್ಮಾನಿಸಿದೆ. ಆದ್ದರಿಂದ ಈ ಆದೇಶ

ಅಲ್ಲದೆ ಸಚಿವಾಲಯದ ಎ,್ಲಾ ಇ,ಾಖೆಗಳು ತಮ್ಮ ಹಾಗೂ ತಮ್ಮ ಆಡಳಿತ ವ್ಯಾಪ್ತಿಗೆ ಒಳಪಡುವ ಎ,್ಲಾ ನಿರ್ದೇಶನಾಲಯ/ಆಯುಕ್ತಾಲಯ, ಕ್ಷೇತ್ರ ಇ,ಾಖೆ, ಸಾರ್ವಜನಿಕ ಉದ್ದಿಮೆಗಳು, ಸರ್ಕಾರದಿಂದ ಸ್ಥಾಪಿತವಾದ ನಿಗಮ/ಮಂಡಳಿಗಳು ಮತ್ತು ವಿಧಾನ ಮಂಡಲದ ಅಧಿನಿಯಮದಡಿ ಸ್ಥಾಪಿತವಾಗಿರುವ ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳು ಹಾಗೂ ಎ,್ಲಾ ಶಾಸನಬದ್ಧ ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಹಾಗೂ ಜಿ,್ಲಾ ಮಟ್ಟ/ ವಲಯ ಮಟ್ಟದ ಕಚೇರಿಗಳಲ್ಲಿ ನೇಮಿಸ,ಾಗಿರುವ ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿ/ ಜಾಗೃತ ಅಧಿಕಾರಿಗಳ ವಿಳಾಸ, ದೂರವಾಣಿ, ಇತ್ಯಾದಿ ಎ,್ಲಾ ವಿವರಗಳನ್ನು ಆಯಾ ಇ,ಾಖೆಗಳ ಅಂತರ್ಜಾಲದಲ್ಲಿ ಕೂಡ,ೇ ಮಾಹಿತಿ ಕೊಂಡಿ(Information Link)ಯನ್ನು ಅಳವಡಿಸುವ ವ್ಯವಸ್ಥೆ ಮಾಡುವಂತೆ ತಿಳಿಸಿರುತ್ತಾರೆ.

ಮೇ,ೆ(4)ರಲ್ಲಿ ಓದ,ಾದ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಣಾಧಿಕಾರಿಯವರು, ಇ-ಆಡಳಿತ ಕೇಂದ್ರ, ಇವರ ದಿನಾಂಕ: 12.09.2016ರ ಟಿಪ್ಪಣಿಯಲ್ಲ್ಲಿ ತಿಳಿಸಿರುವಂತೆ ಯೋಜನಾ ನಿರ್ದೇಶಕರು, ಕೆಸ್ವಾನ್ ಯೋಜನೆ, ಇ-ಆಡಳಿತ ಕೇಂದ್ರ, ಇವರನ್ನು ಮುಖ್ಯ ಜಾಗೃತ ಅಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸಲು ತೀರ್ಮಾನಿಸಿದೆ. ಅದರಂತೆ, ಈ ಕೆಳಕಂಡ ಆದೇಶ

ಮೇ4ೆ (2)ರಲ್ಲಿ ಓದ4ಾದ ಆದೇಶದಲ್ಲಿ, ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಸೃಜಿಸಿ ಹೊರಡಿಸಿರುವ 4ಾದ ಆದೇಶದಲ್ಲಿ, ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಸೃಜಿಸಿ ಹೊರಡಿಸಿರುವ ದಿನಾಂಕ 14.03.2016ರ 4ಾದ ಆದೇಶದಲ್ಲಿ, ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳವನ್ನು ಸೃಜಿಸಿ ಹೊರಡಿಸಿರುವ

ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಹೊರಡಿಸ4ಾಗಿದೆ. ಅಲ್ಲದೆ

ದಿನಾಂಕ 22.06.2016ರ ಆದೇಶದ ಕಂಡಿಕೆ 1(1)ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯದ ಎ4್ಲಾ ಇ4ಾಖೆಗಳಲ್ಲಿ ಒಂದು ಆದೇಶದ ಕಂಡಿಕೆ 1(1)ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯದ ಎ4್ಲಾ ಇ4ಾಖೆಗಳಲ್ಲಿ ಒಂದು ಆದೇಶದ ಕಂಡಿಕೆ 1(1)ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯದ ಎ4್ಲಾ ಇ4ಾಖೆಗಳಲ್ಲಿ ಒಂದು (officer next in seniority) ಅಧಿಕಾರಿಯನ್ನು ಸದರಿ ಜಾಗೃತ ಕೋಶದ

5. Verification of records of the file reveal the following:

(a) The Central Government has communicated its previous approval under Section 5(1) of the MMDR Act for grant of mining lease for Iron ore and Manganese ore over an extent of 4.86 hectares in Sy.No.84/3 and 85/3 in Kenkere village, Hosadurga Taluk, Chitradurga District on 24.12.2008.

(b) The following conditions have been mentioned in the previous approval granted under Section 5(1) of the MMDR Act, 1957 by the Central Government:

"Before allowing grant of mining lease the State Government may also kindly ensure the

compliance of the amended provisions of MMDR Act, 1957 and MC Rules, 1960, and other

applicable Acts and Rules including Forest (Conservation) Act, 1980".

(c) In view of this, applicant's rights have been considered under Section 10A(2)(c) of the MMDR Act subject to compliance of conditions prescribed in the previous approval under Section 5(1) accorded by Government of India and by following procedures prescribed under Rule 8 of MOAHCEM Concession Rules, 2016.

(d) The applicant is eligible for grant of mining lease as per Rule 8 of MOAHCEM Concession Rules, 2016 only after compliance of the conditions imposed by Government of India in its previous approval letter granted under Section 5(1) of the MMDR Act, 1957.

(e) The applicant has submitted the following statutory clearances:

(i) NOC from DC, Chitradurga:IND.CR/3/2005-06 dtd:22.06.2005 (12.19 acre) (ii) IBM approved Mining Plan No:279/858/2005/BNG/2080 dtd:05.10.2005 (4.86 ha.) (iii)] EC No.FEE/14/ENV/2004 dated:16.01.2004 (4.86 ha)

(iv) KSPCB No. KSPCB/RO/CTA/CFE/Mines/2005-06/1252 dtd:28.10.2005 (4.86 ha) (v) FC: Not applicable since patta land.

6. The application of Smt. Mariam Mohammed Siddiqua Patel for Iron ore and Manganese ore has been processed under the provisions of the amended MMDR Act, 1957 and MOAHCEM Concession Rules, 2016 and compliance by way of submission of the above statutory clearances.

The proposal of the Commissioner, Department of Mines & Geology with respect to the application of Smt. Mariam Mohammed Siddiqua Patel is accepted.

7. In view of the foregoing paras, following order:

The Government hereby grants mining lease in favour of Smt. Mariam Mohammed Siddiqua Patel for Iron ore and Manganese Ore only over an area of 4.86 hectares in Sy.No.84/3 and 85/3 in Kenkere village, Hosadurga Taluk, Chitradurga District, for a period of 50 years.

In addition to the statutory clearances, at para (5b) Reclamation and Rehabilitation (R & R) Plan is also required to be submitted before commencement of mining operations as per the Hon'ble Supreme Court order dated 18.04.2013 in WP No.562/2009 of Samaja Parivarthana Samudaya. Wherein the Hon'ble Supreme Court has restricted production limit of iron ore to 30 MMT pertaining to Bellary Chitradurga and Tumakuru Districts of Karnataka State.

The Director, Department of Mines and Geology shall re-verify that the necessary approval and clearances are in order and then proceed to execute the Mine Development and Production Agreement/ Mining Lease Deed as per Rule-8 of the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016, other Acts and Rules, as applicable from time to time.

The applicant shall abide by the terms and conditions as appended to this Government Order.

c) The lease shall also be subject to the Rules, issued U/S 18 of the Mines & Minerals (D&R) Act, 1957.

d) The lessee shall be governed by all conditions that may be incorporated in the lease deed, to be executed.

e) The lessee shall abide by the rules contained in the Karnataka State Forest Manual, if the lease area covers any forest land.

f) Government shall have the right of purchasing the ore at current market rates.

g) The lease would be determined if the lessee fails to execute the lease deed.

h) The lease shall be for a period of fifty years only.

i) Mining Lease Deed execution sketch shall be within the area for which the Government of India accorded its approval under Section 5(1) of MMDR Act, 1957.

j) Extent mentioned above is subject to availability/ verification after survey and demarcation and reduction if necessary.

k) The mining operation shall be carried out only after submission and approval of R&R Plan by the Central Empowered Committee.

l) The lessee shall pay applicable dead rent, cess as per schedule III and royalty as per schedule-II of the Act and as amended from time to time.

m) The total area held by the applicant under mining lease including the present one, shall not exceed 10 Sq. Km. Mining operations shall not be commenced/conducted unless a qualified manager and other supervisory staff are appointed as required under the Matalliferous Mines Regulations, 1961 and relevant notices are sent to the Director-General of Mines Safety, Dhanbad with a copy of the same to the concerned Director of Mines Safety.

5. Verification of records of the file reveal the following:

(b) The following conditions have been mentioned in the previous approval granted under Section 5(1) of the MMDR Act, 1957 by the Central Government:

(c) The Applicant has submitted Forest Clearance to an extent of 39.70 hectares out of which Central Empowered Committee has finalized and accepted 38.70 hectares.

(d) In view of this, applicant's rights have been considered under Section 10A(2)(c) of the MMDR Act subject to compliance of conditions prescribed in the previous approval under Section 5(1) accorded by Government of India and by following procedures prescribed under Rule 8 of MOAHCEM Concession Rules, 2016.

(e) The applicant is eligible for grant of mining lease as per Rule 8 of MOAHCEM Concession Rules, 2016, only after compliance of the conditions imposed by Government of India in its previous approval letter granted under Section 5(1) of the MMDR Act, 1957.

(f) The applicant has submitted the following statutory clearances.

The application of M/s Sri Nandi Mining Company is processed under the provisions of Section 10A(2)(C) of the amended MMDR Act, 1957 and MOAHCEM Concession Rules, 2016.

LoI is construed in the instant case, as the competent authority under the law prescribed after following due process of law mandated under statute arrived at intent to grant a Mining Lease.

Hence, the application of M/s. Sri Nandi Mining Company has been processed as the applicant Company is eligible for grant of mining lease as per Section 10A(2)(C) of the amended MMDR Act, 1957 and Rule 8 of MOAHCEM Concession Rules, 2016. As per Rule 8 of MOACHEM Concession Rules, 2016 the applicant Company has submitted Letter of compliance along with the following statutory clearances and required documents:-

1. IBM approved mining plan: No.MP/OTF.MECH-78(KNT)/GOA/2015-16 dtd:09.11.2015.

2. EC:No:SEIAA 1593 MIN 2015 dtd:05.03.2016.

3. KSPCB (CFE): No.48 PCB/SEO/MINE/CFE/2016-17/160 dtd:11.05.2016.

4. Land Conversion(NA) order: ಆರ್.ಬಿ/ಎಲ್ ಎನ್ ಎ/ಸಿ ಆರ್-37/2013-14 ದಿನಾಂಕ:09.07.2013.

5. NOC from DC, Bagalkot No.ಕಂ:ವಿ.ಎಂ.ಎನ್ಎಲ್:ಸಿಆರ್-38:2010-11, ದಿನಾಂಕ: 17.07.2013 Therefore, the proposal of the Director, Department of Mines & Geology for grant of mining lease in favour of M/s. Sri Nandi Mining Company for Limestone over an extent of 8.10 hectares in Naganapur village, Mudhol taluk, Bagalkot District is accepted.

7. In view of the foregoing paras, following order:

The Government hereby grants mining lease in favour of M/s Sri Nandi Mining Company for Limestone over an area of 8.10 hectares in Naganapur village, Mudhol Taluk, Bagalkot District for a period of 50 years.

The Director of Mines and Geology shall re-verify that the necessary approval and clearances are in order and then proceed to execute the Mine Development and Production Agreement/ Mining Lease Deed as per Rule-8 of the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016, other Acts and Rules, as applicable from time to time.

The applicant company shall abide by the terms and conditions as appended to this Government Order.

Terms and Conditions of the Mining Lease sanctioned in Government order No: CI 212 CMC

2016 dated: 26.12.2016 in accordance with MMDR Act, 1957 and Rules made these under.

Mining lease should be in respect of Limestone only. If other mineral(s) are found in association with Limestone, he should not mine or win the said mineral(s).

a) All terms and conditions prescribed under Rule 12 of MOAHCEM Rules, 2016.

c) The lease shall also be subject to the Rules, issued U/S 18 of the Mines & Minerals (D&R) Act, 1957.

d) The lessee shall be governed by all conditions that may be incorporated in the lease deed, to be executed.

e) The lessee shall abide by the rules contained in the Karnataka State Forest Manual, if the lease area covers any forest land.

f) Government shall have the right of purchasing the mineral for which lease has been granted at current market rates.

g) The lease would be determined if the lessee fails to execute the lease deed.

h) Extent mentioned above is subject to availability/ verification after survey and demarcation and reduction if necessary.

i) Mining Lease deed execution sketch shall be within the area of applied sketch submitted by the applicant along with application.

j) The lease shall be for a period of fifty years as per Section 8 of MMDR Act, 1957.

k) The lessee/s shall pay applicable dead rent, cess as per schedule III and royalty as per schedule-II of the Act and as amended from time to time.

l) The total area held by the applicant/s under mining lease including the present one, shall not exceed 10 Sq. Km.

m) Mining operations shall not be commenced / conducted unless a qualified manager and other supervisory staff are appointed as required under the Metalliferous Mines Regulations, 1961 and relevant notices are sent to the Director-General of Mines Safety, Dhanbad with a copy of the same to the concerned Director of Mines Safety.

n) The Mining lease is subject to any other conditions as prescribed by Government from time to time.

5.The Government of Karnataka issued grant notification of mining lease vide Notification No. DMG/MLS/988/AML 2006/2013-14 dated 03.10.2013 for Limeshell over an extent of 10.00 acres in Sy. No. 290/A of Kundapura village & taluk, Udupi District. Thereafter, application of applicant has been considered as the applied area was free for grant of mining lease and directed the applicant to submit statutory clearances.

6.Further, the Government of India, Ministry of Environment & Forest in corrigendum dated:29.03.2011 removed certain typographical and grammatical error for harmonizing the provision of notification vide SO No.19E dated:06.01.2011. Some of the highlights of the above said corrigendum is "Those Minerals not available outside CRZ area and collection of dead shells by traditional communities for poultry and animal feed supplements has been permitted in the water bodies attracting CRZ notification."

7. The application of M/s. Padmashree Limeshell prop: U.Radhakrishna is processed under the provisions of Section 10A(2)(C) of the amended MMDR Act, 1957 and MOAHCEM Concession Rules, 2016.

8. Letter of Intent is construed in the instant case, as the competent authority under the law prescribed after following due process of law mandated under statute arrived at intent to grant a Mining Lease. Hence, the application of M/s Padmashree Limeshell prop: U.Radhakrishna has been considered as the applicant is eligible for grant of mining lease under Section 10A(2)(C) of the amended MMDR Act, 1957 and Rule 8 of MOAHCEM Concession Rules, 2016. As per Rule 8 of MOACHEM Concession Rules, 2016 the applicant Company has submitted Letter of compliance on 22.12.2016 along with the following statutory clearances and required documents:-

2. KSPCB /BO/SEO-4/Mines/Circular /2007-08/100 dated:8.5.2007

3. NOC from DC, Udupi No.MM/CC/R-68/2007-08 dated: 6.6.2008

9. Therefore, the proposal of the Director, Department of Mines & Geology for grant of mining lease in favour of M/s Padmashree Limeshell prop: U.Radhakrishna for Limeshell over an extent of 10.00 acres in Sy. No.290/A of Kundapura village & taluk, Udupi District is accepted.
