SUMMER VACATION OF 2017

The High Court will remain closed for Summer Vacation from Tuesday the 2nd May, 2017 to Saturday the 27th May 2017 (Both days inclusive).

No appeals, Petitions or Applications and any other paper of Civil nature will be received during the Vacation, except in cases where it is sought to obtain urgent interim orders like stay orders, interim directions and temporary injunctions etc.

Criminal Appeals, Criminal Revision Petitions, Criminal Petitions and urgent applications in Criminal matters will be received during the Summer Vacation.

Vakalathnama, Process Fee and Process memos in all pending matters will be received in the office and compliance of office objections is also permitted during Summer Vacation.

There will be no sittings during Summer Vacation at Dharwad and Kalaburagi Benches. Urgent matters of the nature

specified above pertaining to Dharwad and Kalaburagi Benches may be filed / moved before the Principal Bench at Bengaluru.

During the Summer Vacation, the working hours of the office of the High Court of Karnataka, Principal Bench at Bengaluru, Dharwad and Kalaburagi Benches shall be from 10.15 AM to 02.00 PM, except on Vacation Court Sitting Days. On Vacation Court Sitting Days, the working hours shall be from 10.15 AM to 05.00 PM. Saturdays will not be working days during Summer Vacation.

Papers will be received from 10.30 AM to 12.30 PM on working days, except on Vacation Court Sitting Days. On vacation Court Sitting days papers will be received from 10.30 AM to 3.00 PM at Principal Bench, Bengaluru and Dharwad Bench. In respect of Kalaburagi Bench, papers will be received from 7.30 AM to 9.30 AM on working days, except on Vacation Court Sitting days. On vacation Court sitting days papers will be received from 7.30 AM to 12.00 noon.

Vacation Benches mentioned hereunder will sit on Wednesday the 3rd, Friday the 5th, Tuesday the 9th, Thursday the 11th, Tuesday the 16th, Thursday the 18th, Tuesday the 23rd and Thursday the 25th May, 2017 in Court Halls mentioned against them on the "SITTING DAYS" noted below at 10.30 AM during the Vacation to hear urgent matters. Matters of the nature referred to above filed during vacation and inclusive of the day previous to the sitting day will be posted before the respective Benches. But those cases filed on the sitting day will not be posted on that day, except by the Special Orders/permission of the Vacation Bench.

On the days of sitting, after completion of the work of the Division Bench, Hon'ble Judges sitting in Division Bench will sit single and take up Single Bench matters.

Memos for posting will not be entertained by the Registrar (Judicial) or the Deputy Registrar during Summer Vacation.

Motions to take up the case/s shall be made before the respective Benches.

Subject :- Referring cases of fake documents to Forensic Laboratory of the State for investigation.

In view of the directions given by the Hon'ble High Court of Karnataka, Dharwad Bench in Criminal Petition No.100822/2016 it is hereby directed that the all investigating Officers/agencies in the state should strictly adhere to the following;

a) Investigation shall be conducted strictly in accordance with law ensuring that there is no deviation from the procedure.

b) In case where investigations are taken up with reference to documents said to be forged or fake, the same shall be referred to Forensic Laboratory of the state and not to private laboratories for expert opinion regarding handwriting, signature or the age of the writing in the document.

This is to prevent the possible manipulation in securing favourable reports and to manipulate the final report.
