conditions:

1. Environment: The company to obtain Consent for Establishment and Consent for Operation from KSPCB and environmental clearance from MoEF, Govt. of India or the Dept of Forest, Ecology & Environment, Govt. of Karnataka, if applicable.

2. Employment: The Company shall comply with the provisions of IT Policy of the State of Govt. of Karnataka with respect to local employment on the project. Prepare a plan for development of Human Resources required for the project, train local people. A copy of Human Resources Development plan shall be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

3. Vendor Development: Wherever there is scope for vendor development for the project, the company shall prepare a vendor development plan, develop local vendors and procure the required inputs, components and sub-assemblies from these local vendor units. A copy of the vendor development plan shall be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

4. Social Infrastructure Development: The Company is advised to take up social infrastructure development projects in the vicinity of the proposed location of the unit and comply with the stipulation of Company Act 2013. A copy of such projects shall be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

5. Others:

a) The company shall adopt rainwater harvesting, waste water recycling and water conservation techniques. Zero discharge facility should be adopted wherever applicable.

b) The company shall take all statutory and other necessary clearances from the competent authorities including Govt. of India.

c) As part of "Ease of Doing Business" Government vide order No. CI 89 SPI 2013, Dated: 20.12.2014 has accorded approval to operationalise e-Udyami Phase II for obtaining various clearances / approvals / licenses etc. through common e-platform for the projects approved through District Level Single Window Clearance Committee (DLSWCC) or State Level Single Window Clearance Committee (SLSWCC) or State High Level Clearance Committee (SHLCC) w.e.f. 01.01.2015.

d) The approvals / NOCs of following Departments have been covered under Phase II of e-Udyami.

i. Karnataka Industrial Areas Development Board.

ii. Karnataka Small Scale Industries Development Corporation.

iii. Karnataka State Pollution Control Board.

iv. Factories, Boilers, Industrial Safety and Health Department

v. Industries and Commerce Department

vi. Town Planning Department and Local Planning Authorities

vii. Municipal Administration Department

viii. BESCOM/GESCOM/HESCOM/CESCOM/MESCOM

ix. Karnataka State Fire and Emergency Services Department

x. Water Resources Department

e) The login and passwords which are used for filing application through e-Udyami Phase I are also applicable for filing application through e-Udyami Phase II. E-Udyami Phase II web application may be accessed through www.ebizkarnataka.gov.in and online application along with necessary documents may please be filed for any of above Departments' approval / NOCs.

f) Karnataka Udyog Mitra (KUM) would provide the necessary escort services for the speedy implementation of your project. You are requested to inform the progress made in the implementation of the project every quarter in the proforma.

This approval is valid for a period of two years from the date of issue of this Government Order.

PREAMBLE :

M/s. Ritnand Balved Education Trust has proposed to establish "University" with an investment of Rs. 120.63 crore, generating employment to about 400 persons at Beerasandra and Alurududdanahally Villages, Kundana Hobli, Devanahalli Taluk, Bengaluru Rural District..

In the 47th Land Audit Committee meeting held on 23.01.2018, the Committee, resolved to recommend to SLSWCC for approval of the project of M/s. Ritnand Balved Education Trust to establish "University" in 20 Acres of land to be purchased U/s 109 of KLR Act at Sy. Nos. 17/1, 17/4, 17/5, 17/6, 17/7, 18, 19/1, 19/3, 19/4, 21/3, 22/3, 27/2 of Beerasandra Village and Sy. Nos. 227/1, 227/2, 257/2 of Alurududdanahally Village, Kundana Hobli, Devanahalli Taluk, Bengaluru Rural District, subject to conformity of the land use as per zoning regulation of LPA.

The proposal was examined & approved in the 106th State Level Single Window Clearance Committee (SLSWCC) Meeting held on 30.01.2018.

Government has examined the recommendations made by the SLSWCC in all aspects.

Hence the following order.

GOVERNMENT ORDER No. CI 39 SPI 2018, BENGALURU, DATED: 08.02.2018

Government is pleased to accord in-principle approval to the investment proposal of M/s. Ritnand Balved Education Trust to establish "University" with an investment of Rs. 120.63 crore, generating employment to about 400 persons at Beerasandra and Alurududdanahally Villages, Kundana Hobli, Devanahalli Taluk, Bengaluru Rural District with the following infrastructure assistances,

conditions:

Read : 1) Proceedings of the 103rd State Level Single Window Clearance Committee (SLSWCC) meeting held on 04.10.2017.

2) Government Order No. CI 216 SPI 2017, Dated: 17.10.2017.

3) Proceedings of the 106th State Level Single Window Clearance Committee (SLSWCC) meeting held on 30.01.2018.

PREAMBLE :

The project proposal of M/s. Sterling Tools Ltd. was accorded approval in the 103rd SLSWCC meeting held on 04.10.2017 to establish "Fasteners" with an investment of Rs. 227.03 crore in 9 acre of land at Plot Nos. 109 & 110 of Vemgal KIADB Industrial Area, Kolar Taluk and District and Government Order read at (1) above was issued.

Now, the company vide letter dated: 11.01.2018 has informed that they have taken the position of the said plots on 08.01.2018 from KIADB and found that an extent of 0.54 acre of land which is adjoining to the allotted plot No. 109 is available and it is objecting the entrance and boundary of the plot and requested for approval for additional land of 0.54 acre adjoining to plot No. 109 & 110 of Vemagal KIADB Industrial Area, Kolar Taluk & District.

In the 47th Land Audit Committee meeting held on 23.01.2018, the Committee, resolved to recommend to SLSWCC for allotment of additional 0.54 acre of land adjoining to Plot No. 109 & 110 in Vemgal KIADB Industrial Area, Kolar Taluk and District, along with already approved land of 9 acres.

The proposal was examined & approved in the 106th State Level Single Window Clearance Committee (SLSWCC) Meeting held on 30.01.2018.

Government has examined the recommendations made by the State Level Single Window Clearance Committee in all aspects.

Hence the following order.

Government is pleased to approve for allotment of additional 0.54 acre of land adjoining to Plot No. 109 & 110 in Vemgal KIADB Industrial Area, Kolar Taluk & District, along with already approved land of 9 acres vide Government Order read at (2) above.

All other terms and conditions indicated in the Government order No. CI 216 SPI 2017, dated: 17.10.2017 remain unaltered.

Read : 1) Proceedings of the 105th State Level Single Window Clearance Committee (SLSWCC) meeting held on 30.12.2017.

2) Government Order No. CI 18 SPI 2018, Dated: 08.01.2018.

3) Proceedings of the 106th State Level Single Window Clearance Committee (SLSWCC) meeting held on 30.01.2018.

PREAMBLE :

The project proposal of M/s. Cornerstone Supply Chain Solutions Pvt Ltd. was accorded approval in the 105th SLSWCC meeting held on 30.12.2017, to establish "Integrated Industrial Park" with an investment of Rs. 451.20 crore in 296 acre 20 gunta of land at Sy. No. 1, 2, 4, 5, 6, 7, 8, 9 (with all sub-numbers) and 10 of Shantanapura Village, Hoskote Taluk, Bengaluru Rural District to be acquired and allotted by KIADB as SUC on consent basis and Government Order was issued vide No. CI 18 SPI 2018, dated: 08.01.2018 read at (2) above.

Now, the Promoter of the company in their letter dated: 12.01.2018 have informed that they have been able to obtain 100% consent from the land owners which is required for the project and the land owners would receive compensation from company and an undertaking will be given by the farmers that they would not claim any compensation from KIADB for the land acquired for the project and requested to amend SLSWCC approval and to incorporate the following:

"KIADB to acquire the land by collecting only Service Charges as the compensation to the land owners will be directly paid by the company wherever the consent is produced".

The proposal was examined & approved in the 106th State Level Single Window Clearance Committee (SLSWCC) Meeting held on 30.01.2018 to include in the Government order as follows:

"As regards request of the company that KIADB to collect only service charges from the project promoters for the land for which they have provided consent of the land owners, the Committee resolved to inform KIADB to collect charges as per KIADB norms".

Government has examined the recommendations made by the State Level Single Window Clearance Committee in all aspects.

Hence the following order.

GOVERNMENT ORDER No. CI 18 SPI 2017, BENGALURU, DATED: 14.02.2018

Government is pleased to approve to include in the Government Order read at reference (2) above as follows:

"As regards request of the company that KIADB to collect only service charges from the project promoters for the land for which they have provided consent of the land owners, the Committee resolved to inform KIADB to collect charges as per KIADB norms".

ಸಾಕ್ಷಿಯೊಂದಿಗೆ ಕಛೇರಿಗೆ ಹೋಗಿ ಆಪಾದಿತರಿಗೆ ಬಿಲ್ಲಿನ ಬಗ್ಗೆ ವಿಚಾರಿಸಿ ಚೆಕ್ಕು ತಯಾರಿದೆಯೇ ಎಂಬ ಬಗ್ಗೆ

ಕೇಳಲಾಗಿ, ಆಪಾದಿತ ಫಿರ್ಯಾದುದಾರರಿಗೆ ಬಾಕಿ ಅಕ್ರಮ ಸಂಭಾವನೆ ತಂದಿರುವ ಕುರಿತು ವಿಚಾರಿಸಿದ್ದು, ಫಿರ್ಯಾದುದಾರರು ದೋಷಪೂರಿತ `. 2000/- ನೋಟುಗಳನ್ನು ಆಪಾದಿತರಿಗೆ ನೀಡಿದ್ದು ಆಪಾದಿತರು

ಅದನ್ನು ಸ್ವೀಕರಿಸಿದ್ದು, ಕೂಡಲೇ ಫಿರ್ಯಾದುದಾರರು ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸರಿಗೆ ಸಂಜ್ಞೆಯನ್ನು ನೀಡಿದ್ದು,

ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸರು ಆಪಾದಿತರನ್ನು ರೆಡ್-ಹ್ಯಾಂಡೆಡ್ ಆಗಿ ಸೆರೆಹಿಡಿದಿರುತ್ತಾರೆ. ಮುಂದುವರಿದ

ತನಿಖೆಯಲ್ಲಿ ಆಪಾದಿತರ ವಿರುದ್ಧ ಸೆಷನ್ಸ್ ನ್ಯಾಯಾಲಯ, ಧಾರವಾಡ ಇಲ್ಲಿ ಚಾರ್ಜ ಶೀಟ್ ತಯಾರಿಸಿ,

ವರದಿಯನ್ನು ಮಾನ್ಯ ಲೋಕಾಯುಕ್ತರಿಗೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

ದೋಷಪೂರಿತ ಹಣವನ್ನು ಸಮೀಕರಿಸಿರುವ ಕುರಿತು ಆಪಾದಿತರು ವಿಚಾರಣೆಯಲ್ಲಿ ಸಾಕ್ಷಿ

ನುಡಿದಿರುವಂತೆ ಕು: ನಜಾಮ್ ಭಾನು ಬಿ. ಮೂರ್ನಾಳ, ಸಹಾಯಕ ಶಿಕ್ಷಕಿರವರಿಗೆ ಸಂಬಂಧಿಸಿದ

ವೈದ್ಯಕೀಯ ವೆಚ್ಚದ ಮರುಪಾವತಿ ಬಿಲ್ಲುಗಳು ಕಛೇರಿಯಲ್ಲಿ ಸ್ವೀಕೃತವಾಗಿದ್ದು, ಕ್ಲೇಮಿನ ಮೊತ್ತ ಮತ್ತು

ಅನುಮೋದಿತವಾಗಿರುವ ಮೊತ್ತ ತಾಳೆಯಾಗುತ್ತಿಲ್ಲವಾದ ಕಾರಣ, ಅದರಂತೆ ಹಿಂಬರಹವನ್ನು ಮುಖ್ಯ

ಲೆಕ್ಕಿಗರಿಗೆ ಕಳುಹಿಸಿದ್ದು, ನಂತರ ಕಡತವನ್ನು ಸಹಾಯಕ ಖಜಾನಾಧಿಕಾರಿಗಳಿಗೆ ಕಳುಹಿಸಲಾಗಿತ್ತು.

ಆಪಾದಿತರು ಹೇಳಿಕೆಯಲ್ಲಿ, ದಿ: 25-03-2011ರಂದು ನಾಲ್ಕು ಮಂದಿ ಅವರ ಬಳಿ ಬಂದು ಒತ್ತಾಯವಾಗಿ

ಅವರನ್ನು ಸೆರೆಹಿಡಿದಿದ್ದು, ಅದರಲ್ಲಿ ಒಬ್ಬರು ಹಣವನ್ನು ಅವರ ಜೇಬಿನಲ್ಲಿರಿಸಿ ನಂತರ ಸದರಿ ಹಣವನ್ನು

ತೆಗೆಯುವಂತೆ ಮಾಡಿ ನಂತರ ಅವರ ಕೈಗಳನ್ನು ದ್ರಾವಣದಿಂದ ತೊಳಿಸಲಾಯ್ತು ಎಂದು ತಿಳಿಸಿರುತ್ತಾರೆ. ಈ

ಪ್ರಕರಣದಲ್ಲಿ ಫಿರ್ಯಾದುದಾರರಾದ ಶ್ರೀ ಬಷೀರ್ ಅಹಮದ ರವರನ್ನು ಸಾಕ್ಷಿಯನ್ನಾಗಿ ಪರಿಗಣಿಸಿರುವುದಿಲ್ಲ.

ಸಮನ್ಸ್‌ಗಳನ್ನು ಸಾಕ್ಷಿದಾರರುಗಳಿಗೆ ಕಳುಹಿಸಿದಾಗ, ಫಿರ್ಯಾದುದಾರರು ಜೀವಂತವಾಗಿರುವುದಿಲ್ಲವೆಂದ,

ವರದಿ ನೀಡಿರುತ್ತಾರೆ. ಆದುದರಿಂದ ಫಿರ್ಯಾದುದಾರರು ಜೀವಂತವಿಲ್ಲದಿರುವುದರಿಂದ ಅವರನ್ನು

ಪ್ರಕರಣದಲ್ಲಿ ವಿಚಾರಣೆಗೆ ಒಳಪಡಿಸದೇ ಇರುವುದೆಂಬ ಮಂಡನಾಧಿಕಾರಿಗಳು ಸಲ್ಲಿಸಿರುವ ವರದಿಯನ್ನು

ಒಪ್ಪಿಕೊಳ್ಳಬಹುದಾಗಿದೆ.

ಪ್ರಕರಣದಲ್ಲಿನ ಮೂರು ಸಾಕ್ಷಿಗಳ ವಿಚಾರಣೆಯಲ್ಲಿನ ಪಾಟಿ ಸವಾಲಿನಲ್ಲಿ ಅವರುಗಳು ಸಾಕ್ಷಿಗಳನ್ನು

ನುಡಿದಿರುವಂತೆ, ಟ್ರ್ಯಾಪ್ ದಿವಸ ಪಂಚರುಗಳು ಫಿರ್ಯಾದುದಾರರ ಮತ್ತು ಪೊಲೀಸ್ ಸಿಬ್ಬಂದಿಯೊಂದಿಗೆಭಾಗ ೧ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜುಲೈ ೫, ೨೦೧೮ ೬೪೯ ಆಪಾದಿತರ ಕಛೇರಿ ಬಳಿ ಹೋಗಿದ್ದು, ಪೊಲೀಸ್ ಅಧಿಕಾರಿಯವರು ಫಿರ್ಯಾದುದಾರರನ್ನು ನೆರಳು

ಸಾಕ್ಷಿಯೊಂದಿಗೆ ಆಪಾದಿತರ ಕಛೇರಿಗೆ ಕಳುಹಿಸಿದ್ದು, ಸ್ವಲ್ಪ ಸಮಯದ ನಂತರ ಫಿರ್ಯಾದುದಾರರು ಅವರ

ಮುಖವನ್ನು ಕರ್‌ಚೀಫ್‌ನಿಂದ ಒರೆಸಿಕೊಳ್ಳುವಂತೆ ಮಾಡಿ ಸಂಜ್ಞೆಯನ್ನು ನೀಡಿದ್ದು, ಕೂಡಲೇ

ಫಿರ್ಯಾದುದಾರರು ಪೊಲೀಸ್ ಅಧಿಕಾರಿಯೊಂದಿಗೆ ಆಪಾದಿತರ ಬಳಿ ಹೋಗಿದ್ದು, ಫಿರ್ಯಾದುದಾರರು

ಆಪಾದಿತರನ್ನು ತೋರಿಸಿ ಇವರು ಅವರ ಬಳಿಯಿಂದ ಹಣ ಪಡೆದಿರುವುದಾಗಿ ತಿಳಿಸಿದ್ದು, ಪೊಲೀಸ್

ಅಧಿಕಾರಿಯವರು ಆಪಾದಿತರನ್ನು ಸೆರೆಹಿಡಿದಿದ್ದು ನಂತರ ಅವರ ಎರಡು ಕೈಗಳನ್ನು ಸೋಡಿಯಂ

ಕಾರ್ಬೋನೇಟ್ ದ್ರಾವಣದಲ್ಲಿ ತೊಳೆದಾಗ ಎರಡು ಕೈಗಳು ಗುಲಾಬಿ ಬಣ್ಣಕ್ಕೆ ತಿರುಗುತ್ತದೆ. ಈ ಬಗ್ಗೆ

ಆಪಾದಿತರನ್ನು ಕೇಳಲಾಗಿ, ಆಪಾದಿತರು ಅಕ್ರಮ ಹಣ ಅವರ ಟಿ-ಶರ್ಟ್ ಜೇಬಿನಲ್ಲಿದ್ದು, ನಂತರ ಹಣವನ್ನು

ಅವರ ಜೇಬಿನಿಂದ ತೆಗೆದು ನೋಟಿನ ಕ್ರಮ ಸಂಖ್ಯೆಗಳನ್ನು ತಾಳೆ ಮಾಡಿದಾಗ ಅವುಗಳು ಟ್ರ್ಯಾಪ್

ಪಂಚನಾಮೆಯಲ್ಲಿ ಫಿಯಾದುದಾರರಿಗೆ ಒಪ್ಪಿಸಲಾಗಿದ್ದ ನೋಟುಗಳೆಂದು ಖಚಿತಪಡಿಸಿಕೊಂಡು, ಸದರಿ

ಅಕ್ರಮ ಹಣವನ್ನು ಆಪಾದಿತರಿಂದ ವಶಪಡಿಸಿಕೊಂಡು ಅದನ್ನು ಮುಚ್ಚಿದ ಲಕೋಟೆಯಲ್ಲಿರಿಸಲಾಗಿರುತ್ತದೆ.

ಹಾಗೆಯೇ ಅವರ ಟಿ-ಶರ್ಟ್‌ನ್ನು ಸಹ ವಶಪಡಿಸಿಕೊಂಡಿದ್ದು, ಅದನ್ನು ಸೋಡಿಯಂ ಕಾರ್ಬೋನೇಟ್

ದ್ರಾವಣದಲ್ಲಿ ತೊಳೆದಾಗ ಟಿ-ಶರ್ಟ್ ಸಹ ಗುಲಾಬಿ ಬಣ್ಣಕ್ಕೆ ತಿರುಗಿರುತ್ತದೆ. ಮುಂದುವರೆದ ಪಾಟಿ

ಸವಾಲಿನಲ್ಲಿ ಸಾಕ್ಷಿದಾರರು ತಿಳಿಸಿರುವಂತೆ ಆಪಾದಿತರು ಹಣ ಕೇಳದೇ ಇದ್ದರೂ ಫಿರ್ಯಾದುದಾರರು

ಒತ್ತಾಯವಾಗಿ ಆಪಾದಿತರ ಟಿ-ಷರ್ಟ್ ಜೇಬಿಗೆ ಹಣ ಇಟ್ಟಿರುವುದು ಕುರಿತ ಸಲಹೆಯನ್ನು

ನಿರಾಕರಿಸಿರುತ್ತಾರೆ. ಮುಂದುವರೆದು ಆಪಾದಿತರು ರಕ್ಷಣಾ ಸಾಕ್ಷಿಯನ್ನು ಹಾಗೂ ಫಿರ್ಯಾದುದಾರರು ಮತ್ತು

ನೆರಳು ಸಾಕ್ಷಿಗಳ ಪಾಟಿ ಸವಾಲಿನಲ್ಲಿ ನೀಡಿದ ಸಾಕ್ಷಿಗಳನ್ನು ಪರಿಶೀಲಿಸಿದ ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸರು,

ತನಿಖೆಯಲ್ಲಿ ದೋಷಪೂರಿತ ಹಣವನ್ನು ಆಪಾದಿತರು ಸ್ವೀಕರಿಸಿದ್ದು, ಆಪಾದಿತರ ಎರಡು ಕೈಗಳನ್ನು

ಸೋಡಿಯಂ ಕಾರ್ಬೋನೇಟ್ ದ್ರಾವಣದಲ್ಲಿ ತೊಳೆದಾಗ ಎರಡು ಕೈಗಳು ಗುಲಾಬಿ ಬಣ್ಣಕ್ಕೆ ತಿರುಗಿರುತ್ತದೆ.

ಮತ್ತು ಅದು ರಾಸಾಯನಿಕ ತಜ್ಞರು ಅದನ್ನು ದೃಡೀಕರಿಸಿರುತ್ತಾರೆ. ಆದುದರಿಂದ ಆಪಾದಿತರ ವಿರುದ್ಧ

ಆರೋಪವನ್ನು ಶಿಸ್ತು ಪ್ರಾಧಿಕಾರ ಸಾಬೀತುಪಡಿಸಿರುವ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಟ್ರ್ಯಾಪ್ ಸಮಯದಲ್ಲಿ ಆಪಾದಿತರು

ಫಿರ್ಯಾದುದಾರರಿಂದ ಅಕ್ಷಮ ಸಂಭಾವನೆ ಪಡೆಯುವ ವೇಳೆಯಲ್ಲಿ ರೆಡ್ ಹ್ಯಾಂಡ್ ಆಗಿ ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸರಿಗೆ ಸಿಕ್ಕಿಬಿದ್ದಿರುವುದರಿಂದ ಕ.ನಾ.ಸೇ(ನಡತೆ) ನಿಯಮಗಳು 1957ರ ನಿಯಮ 3(1)(ii) ಮತ್ತು (iii) ರನ್ವಯ ತೀವ್ರವಾದ ದುರ್ನಡತೆ ಎಸಗಿರುವುದರಿಂದ ಇವರ ವಿರುದ್ಧ ಆರೋಪ ಸಾಭಿತಾಗಿರುವುದಾಗಿ

ವಿಚಾರಣಾಧಿಕಾರಿಗಳು ವಿಚಾರಣಾ ವರದಿ ನೀಡಿದ್ದಾರೆ.

ಅದರಂತೆ ಮೇಲೆ ಓದಲಾದ (5)ರಲ್ಲಿ ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತ ಶಿಫಾರಸ್ಸನ್ನು ಹಾಗೂ

ವಿಚಾರಣಾ ವರದಿಯ ಪ್ರತಿಯನ್ನು ಎರಡನೇ ಕಾರಣ ಕೇಳುವ ನೋಟೀಸು ಮೂಲಕ ಆರೋಪಿತರಿಗೆ

ದಿ: 25-07-2017ರಂದು ಜಾರಿಗೊಳಿಸಲಾಗಿತ್ತು. ಇದಕ್ಕೆ ಮೇಲೆ ಓದಲಾದ ಕ್ರಮ ಸಂಖ್ಯೆ(6)ರಲ್ಲಿ ಓದಲಾದ

ದಿನಾಂಕ: 30-10-2017ರ ಉತ್ತರದಲ್ಲಿ ಆರೋಪಿತ ಶ್ರೀ ಶಂಕರ, ಪ್ರಥಮ ದರ್ಜೆ ಸಹಾಯಕರು ತಮ್ಮ

ಸಮಜಾಯಿಷಿಯನ್ನು ಸಲ್ಲಿಸಿರುತ್ತಾರೆ. ಅದರಂತೆ ಆರೋಪಿತರ ಸಮಜಾಯಿಷಿಯನ್ನು ಪರಿಶೀಲಿಸಲಾಗಿ

ಆಪಾದಿತರ ಅಹವಾಲನ್ನು ಮತ್ತು ವಿಚಾರಣಾಧಿಕಾರಿಗಳು ಸಲ್ಲಿಸಿರುವ ವರದಿಯನ್ನು ಪರಿಶೀಲಿಸಲಾಗಿ

ಆರೋಪಿತರು ತಮ್ಮ ಸಮಜಾಯಿಷಿಯಲ್ಲಿ ತಿಳಿಸಿರುವಂತೆ ವಿಚಾರಣಾಧಿಕಾರಿಗಳು ಪ್ರಕರಣದಲ್ಲಿಯ ಬಹಳಷ್ಟು

ನಿಜವಾದ ವಿಚಾರಗಳನ್ನು ಪರಾಂಬರಿಸದೆ ಮತ್ತು ಅವರು ಸಲ್ಲಿಸಿರುವ ದಾಖಲೆಗಳು ಹಾಗೂ ವಿಚಾರಣೆಯ

ಅಹವಾಲನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳದೇ ಕೆಳಹಂತದಲ್ಲಿ ಲೋಕಾಯುಕ್ತ ಅಧಿಕಾರಿಗಳು ಸಲ್ಲಿಸಿದ ತನಿಖಾ

ವರದಿಯನ್ನು ಪತ್ರ ಪರಿಗಣಿಸಿ ಅವರ ಮೇಲಿನ ಆರೋಪ ರುಜುವಾತಾಗಿದೆ ಎಂದು ವರದಿಯಲ್ಲಿ

ಹೇಳಿರುವುದು ಇವರಿಗೆ ಅನ್ಯಾಯ ಮಾಡಿದಂತಾಗಿದೆ. ಪ್ರಕರಣದಲ್ಲಿ ಯಾವುದೇ ಲಂಚದ ಹಣ ಕುರಿತು

ಬೇಡಿಕೆ ಇರುವುದಿಲ್ಲ ಮತ್ತು ಪ್ರಕರಣದಲ್ಲಿ ಆರೋಪಗಳಿಗೆ ಸಂಪರ್ಕ ಕಲ್ಪಿಸಲು ಯಾವುದೇ

ಪುರಾವೆಗಳಿರುವುದಿಲ್ಲ ಎಂದು ತಿಳಿಸುತ್ತಾ ಇಲಾಖಾ ವಿಚಾರಣೆಯನ್ನು ಕೈ ಬಿಟ್ಟು ಇವರನ್ನು

ದೋಷಮುಕ್ತನೆಂದು ಆದೇಶ ಹೊರಡಿಸಲು ವಿನಂತಿಸಿದ್ದಾರೆ. ಸದರಿಯವರ ಸಮಜಾಯಿಷಿಯನ್ನು

ಪರಿಶೀಲಿಸಿದಾಗ ಅದರಲ್ಲಿ ಅವರು ನೀಡಿರುವ ಅಂಶಗಳಲ್ಲಿ ಯಾವುದೇ ಹೊಸ ಅಂಶಗಳು ಕಂಡುಬರದ

ಕಾರಣ ಲೋಕಾಯುಕ್ತರ ಶಿಫಾರಸ್ಸಿನಂತೆ ಇವರು ಫಿರ್ಯಾದುದಾರರಿಂದ ಅಕ್ರಮ ಹಣವನ್ನು ಪಡೆದು ಆ

ಮೂಲಕ ಅಪ್ರಮಾಣಿಕವಾಗಿ ನಡೆದುಕೊಂಡು ಕರ್ತವ್ಯದಲ್ಲಿ ಸಂಪೂರ್ಣ ಸಮಗ್ರತೆ ಮತ್ತು ಭಕ್ತಿ

ಕಾಯ್ದುಕೊಳ್ಳುವಲ್ಲಿ ಅವರು ವಿಫಲರಾಗಿದ್ದಾರೆ ಮತ್ತು ಗಂಭೀರ ಅಧಿಕೃತ ದುಷ್ಕøತ್ಯವನ್ನು ಎಸಗಿ ಕ.ನಾ.ಸೇ (ನಡತೆ) ನಿಯಮಗಳು 1957ರ ನಿಯಮ 3(i)(ii) ಮತ್ತು (iii) ರನ್ನು ಉಲ್ಲಂಘಿಸಿರುವುದು ಸ್ಪಷ್ಟವಾಗಿ

ಕಂಡುಬರುತ್ತದೆ.

ಈ ಎಲ್ಲಾ ಅಂಶಗಳನ್ನು ವಿಶ್ಲೇಷಿಸಿ, ಶ್ರೀ ಶಂಕರ, ಪ್ರಥಮ ದರ್ಜೆ ಸಹಾಯಕರು, ಖಜಾನೆ ಇಲಾಖೆ, ಅವರ ಉತ್ತರವನ್ನು ಒಪ್ಪಿಕೊಳ್ಳದೇ ಇವರು ವೈದ್ಯಕೀಯ ವೆಚ್ಚದ ಮರುಪಾವತಿ ಬಿಲ್ಲನ್ನು ಇತ್ಯರ್ಥಪಡಿಸಲು ಅಕ್ರಮ ಸಂಭಾವನೆ ಪಡೆದ ಆರೋಪವು ಸಾಬೀತಾಗಿದೆ ಎಂಬ ವಿಚಾರಣಾಧಿಕಾರಿಗಳ ವರದಿಯನ್ನು ಹಾಗೂ ಮಾನ್ಯ ಉಪ ಲೋಕಾಯುಕ್ತರು ಇವರ ಶಿಫಾರಸ್ಸಿನನ್ವಯ ದಂಡನೆ ವಿಧಿಸಲು ನಿರ್ಣಯಿಸಿದ ಸರ್ಕಾರವು ಮುಂದಿನಂತೆ ಆದೇಶಿಸುತ್ತದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಕಾರಣಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕರ್ನಾಟಕ ನಾಗರಿಕ ಸೇವಾ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಮೇಲ್ಮನವಿ) ನಿಯಮಗಳು 1957ರ ನಿಯಮ 8(vi)ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿದ ಸರ್ಕಾರವು ಶ್ರೀ ಶಂಕರ, ಪ್ರಥಮ ದರ್ಜೆ ಸಹಾಯಕರು, ಖಜಾನೆ ಇಲಾಖೆ, ಇವರನ್ನು ತಕ್ಷಣದಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಕಡ್ಡಾಯ ನಿವೃತ್ತಿಗೊಳಿಸಿದೆ.
