(2) They shall come into force from the date they are notified on the Notice Board of the Central Offices of KSRTC, Bangalore.

II Amendment to Schedule 'A' of Regulation-3(2): under the Administration Department

Category 9:Junior Assistant-cum-Data Entry Operator (Class–III)

1) Every first of ten vacancies by promotion of Helper (Office), Havildar, Office Helpers (Sweeping) or Office Helpers (Horticulture)

a) Pass in SSLC or equivalent qualification.

b) Must have rendered a service of not less than three (3) years as Helper (Office) or Havildar, Office Helper (Sweeping) or Office Helper (Horticulture).

c) An employee must have passed Computer Literacy Test conducted by the Corporation or by any agency approved by the Corporation. The syllabus for Computer Literacy Test and the number of papers, duration of such test and maximum marks shall be as prescribed by the Corporation or any other authority authorized by the Corporation from time to time.

Or

Must pass the same within a period of ONE YEAR from the date of promotion.

However, an employee who has attained the age of 50 years is exempted from passing the computer literacy test.

2) Remaining nine vacancy by Direct Recruitment

a) Pass in PUC in Arts, or Commerce or Science or equivalent qualification of recognized Authority, 10+2 of ICSC, CBSC (Excluding PUC or 12th Standard of Open University / Open school /JOC/JLC & Diploma).

b) A selected candidate must pass Computer Literacy Test conducted by the Corporation or by any agency approved by the Corporation within a period of THREE MONTHS from the date of selection. The syllabus for Computer Literacy Test and the number of papers, duration of such test and maximum marks shall be as prescribed by the Corporation or any other authority authorized by the Corporation from time to time.

III. Title and commencement:-

(1) These Regulations may be called the Karnataka State Road Transport Corporation (C&R) Regulation 1982 (Amendment) 2018.

(2) They shall come into force from the date they are notified on the Notice Board of the Central Offices of KSRTC, Bengaluru.

II Amendment to Regulation- 6A(i)(a), 6A(i)(b), 6B(vi)(b), 6BC(i) & 7(6) :

Regulation: 6 A. Procedure for Selection of candidates for all Class – III posts other than Driver, Driver-Cum-Conductor and

Security Guard.

(i) The Selection Authority shall prepare a list of names of candidates eligible for selection:

(a) In respect of Class-III other than statewide cadre posts on the basis of 25% of marks secured in the qualifying examination and 75% marks secured in the Common Aptitude Test (CAT):

The written/Common Aptitude Test (CAT) shall be conducted through Government Agencies viz IISc/IIM/IIT/ KEA/KPSC/Any other Central/State Government agency/ State or Central Government University/ autonomous institutions as may be decided by the Managing Director, KSRTC.

In case where the above agencies are not available to conduct Common Aptitude Test (CAT), Question paper shall be set by the above said authorized institutions and Common Aptitude Test (CAT) may be conducted by any other agencies selected through tender process by the Managing Director.

Common Aptitude Test (CAT) may be conducted through Online or Offline as decided by Managing Director from time to time.

(b) In respect of Class-III posts of State wide cadre on the basis of the total marks secured in the qualifying examination and the marks secured in Common Aptitude Test (CAT).

The written/Common Aptitude Test (CAT) shall be conducted through Government Agencies viz IISc/IIM/IIT/KEA/KPSC/Any other Central/State Government agency/ State or Central Government University/ autonomous institutions as may be decided by the Managing Director, KSRTC.

Or

In case where the above agencies are not available to conduct Common Aptitude Test (CAT), Question paper shall be set by the above said authorized institutions and Common Aptitude Test (CAT) may be conducted by any other agencies selected through tender process by the Managing Director.

Common Aptitude Test (CAT) may be conducted through Online or Offline as decided by Managing Director from time to time.

Provided that if specific degree is prescribed as qualification for any post referred to in this item, the marks secured in the qualifying examination shall be calculated proportionately equal to fifty marks and the marks secured in the test shall be calculated proportionately equal to fifty marks and where a degree in general is prescribed as qualification for any post referred to in this item the marks secured in the qualifying examination shall be calculated proportionately equal to twenty five marks and marks secured in the test shall be calculated proportionately equal to seventy five marks.

B. Procedure for Selection for the post of Driver, Class – III and Security Guard, Class-III.

(vi) (b) The Selection Authority shall prepare a final selection list of candidates eligible for appointment on the basis of 25% of marks secured in the qualifying examination and 75% marks secured in the Common Aptitude Test (CAT):

The written/Common Aptitude Test (CAT) shall be conducted through Government Agencies viz IISc/IIM/IIT/ KEA/KPSC/Any other Central/State Government agency/ State or Central Government University/ autonomous institutions as may be decided by the Managing Director, KSRTC.

Or

In case where the above agencies are not available to conduct Common Aptitude Test (CAT), Question paper shall be set up the above said authorized institutions and Common Aptitude Test (CAT) may be conducted by any other agencies selected through tender process by the Managing Director.

BC. Procedure for Selection to Class-III posts of Artisan, Assistant Traffic Inspector, Technical Assistant and Technical

Assistant (Printing).

(i) The Selection Authority shall prepare a final selection list of candidates eligible for appointment on the basis of 25% of marks secured in the qualifying examination and 75% marks secured in the Common Aptitude Test (CAT):

The written/Common Aptitude Test (CAT) shall be conducted through Government Agencies viz IISc/IIM/IIT/KEA/KPSC/Any other Central/State Government agency/ State or Central Government University/ autonomous institutions as may be decided by the Managing Director, KSRTC.

Or

2. Letter dated 04-06-2018 filed on 13-06-2018 with supporting

M/s. Pioneer Enterprises, Travelers point, Ist Floor, 30 Sheshadri Road, Ananda Rao Circle, Bengaluru. (TIN: 29470282848) has requested to clarify the applicability of Entry tax for period from 2010-11 to 2017-18, if the "Rock drilling tools" are purchased from outside the State.

2. The undersigned is empowered under Section 12(7) of KTEG Act, 1979, to clarify the rate of tax payable under the Act if it is considered necessary or expedient so to do for the purpose of maintaining uniformity in assessments and collections of revenue or for the removal of any doubt. It is considered that the clarification requested by the applicant is within the scope of aforesaid provision and it is necessary that clarification be issued for the purpose of maintaining uniformity in the work of assessments and collection of revenue and also for removal of doubts.

3. The assessee Mr Gnanasekaran V was given the opportunity of hearing on 13-06-2018 who filed letter dated 04-06-2018 and submitted supporting documents for Rock drilling tools. The assessee is of the view that he is dealing in Down-The-Hole (DTH)Button bits and Down-The-Hole (DTH) hammers which come under the category of Rock drilling tools and explained their feature as under.

used in bore well drilling rigs. Bore well drilling rigs are used mainly for agricultural purposes and drinking water purposes. DTH Button bits is not a part of any machinery or its attachments and it is a consumable part.

b. DTH Hammers and its parts are also consumables which are used in Water well drilling rigs. It is not a part of any machinery or its attachments.

4. At the time of hearing, the applicant has contended that the ratio of clarification issued/ judgments rendered in the case of M/s. Sansera Engineering (P) Limitedand M/s. R.K. Powergen Pvt Limited are not applicable to their case as the goods involved in these cases are drill bits, cutters, reamers etc which are tools related with Lathe machinery.The images of the tools have also been submitted.

5. The matter is examined.

i) A Down-The-Hole drill, usually called DTH by most professionals is basically a mini jack hammer screwed on the bottom of a drill string. The fast hammer action breaks hard rock into small flakes and dust and is blown clear by the air exhaust from DTH hammer. The DTH hammer is one of the fastest ways to drill hard rock. DTH hammer is located directly behind the drill bit. The drill pipes transmit the necessary feed force and the rotation to hammer and bits.

ii) DTH button bits and DTH hammers are used as fitting or fixtures to the machinery in order to carry out the desired operation, viz drilling a hole. Without these tools, machinery cannot be used for the required purpose. No doubt, the Rocking drilling tools wear out after numerous repeated use and require to be replaced. However, even other parts and accessories of machinery also require to be replaced after repeated use. It is not as if Rock drilling tools are intended for single use and thereby get consumed after any such single use just like fuel which gets consumed in its use.

iii) In the case of Annapoorna Carbon Industries Company Vs. State of Andhra Pradesh reported in 37 STC 378, the Hon'ble Supreme Court has held that arc carbons used in projectors or other cinematographic equipments are their accessories. While delivering its judgement, the Hon'ble Court, referring to accessories has observed as under:-

"We find that the term "accessories" is used in the schedule to describe goods

which may have been manufactured for use as an aid or addition. A sense in

which the word "accessory" is used is given in Webster's Third New

International Dictionary as follows: "an object or device that is not essential in

itself but that adds to the beauty, convenience, or effectiveness of something

else." Other meanings given there are: "supplementary or secondary to

something of greater or primary importance;" "additional"; "any of several

mechanical devices that assist in operating or controlling the tone resources

of an organ". "Accessories" are not necessarily confined to particular

machines for which they may serve as aids. The same item may be an

accessory of more than one kind of instrument."

iv) The same view was held by the Hon'ble Supreme Court in the case of Union Carbide India Limited Vs, State of Andhra Pradesh, reported in 98 STC 1. These decisions apply squarely to the issue under consideration. It is clear therefrom that the Supreme Court did not hold 'arc carbon' as consumable.

v) In the case of Pioneer Enterprises Vs. Joint Commissioner of Commercial Taxes(Appeals) and another, reported in 134 STC 138, the Hon'ble High Court of Karnataka has held that when an item is used only for obtaining enhanced efficiency of performance of the main product and does not form a part or an essential integral part of the main product, it is an accessory. In the case of State of Uttar Pradesh and another Vs. Kores (India) Limited, reported in 39 STC 08, the Hon'ble Supreme Court held that typewriter ribbon is an accessory and not a part of the typewriter. Ribbon of a typewriter wears out frequently and is not sold along with a typewriter. It is not an essential and integral part of the typewriter. But, the typewriter cannot work without a ribbon. In other words, ribbon aids the typewriter in its functioning.

Under these circumstances, the Hon'ble Supreme Court held that it is an accessory. The position of ribbon in a typewriter is similar to a Rock drilling tool in a machinery.

vi) In commercial parlance, 'consumable' means something meant for consumption. As per Shorter Oxford English dictionary, 'consumable' means 'an article intended for consumption, not for repeated use' (emphasis supplied).

Similarly, accessory means 'an additional or subordinate thing; an adjunct, on accompaniment; a minor fitting or attachment' (emphasis supplied).

tool is a part of the machinery. In view of the Supreme Court decision cited above and drawing analogy therefrom, it is to be held that the subject tools are not consumables but accessories.

viii) Thus, on the basis of Supreme Court decisions cited above and commercial parlance, tools are not consumables. DTH button bits are tools which are an additional aid to the bore well drilling rigs. As held by the Supreme Court in similar cases cited above, tools would squarely fall in the category of accessories.

ix) The Notification No. FD 11 CET 2002 dated: 30.03.2002, Sl. No.7 of the table in the notification reads as under:-

"7. Machinery of all kinds and parts and accessories

thereof but excluding agricultural machinery - 2%

Since Rock drilling tools are parts / accessories of machinery, they become liable to tax in terms of the above notification.

It is clarified that "Rock drilling tools" are liable to entry tax @ 2% as "Machinery parts / accessories" as per Sl. No. 7 of Notification No. FD 11 CET 2002 dated: 30.03.2002, during the period from 01.04.2002 to 30.06.2017.

2. ಈ ರಸ್ತೆಯ ಮೇಲಿನ ಬಳಕೆದಾರರ ಶುಲ್ಕ (User Fee) ಸಂಗ್ರಹಣೆಯನ್ನು Karnataka Road User Fee Rules, ದಿನಾಂಕ: 07-03-2015 ನಿಯಮಗಳ ಪ್ರಕಾರ ದರಗಳನ್ನು ಲೆಕ್ಕ ಮಾಡಲಾಗಿರುತ್ತದೆ.

3. ಅದರಂತೆ, ದಿನಾಂಕ: 01-04-2018 ರಿಂದ 31-03-2019 ರವರೆಗೆ ಅನುಬಂಧ-1 ರಲ್ಲಿನಂತೆ ಅನ್ವಯವಾಗುವ ದರಗಳನ್ನು ಲೆಕ್ಕಮಾಡಲಾಗಿದೆ ಹಾಗೂ ಈ ಅಧಿಸೂಚನೆಯು ಸೌವದತ್ತಿ – ರಾಮದುರ್ಗ - ಹಲಗಟ್ಟಿ - ಬಾದಾಮಿ - ಪಟ್ಟದಕಲ್ಲು - ಕಮತಗಿ ರಾಜ್ಯ ಹೆದ್ದಾರಿ-34, 14 & 44 ರ ರಸ್ತೆಯಲ್ಲಿ 0.00 ಕಿಮೀ ಯಿಂದ 127.26 ಕಿಮೀ ವರೆಗೆ ಒಟ್ಟು 127.26 ಕಿಮೀ ಉದ್ದದ 2-ಪಥದ ರಸ್ತೆಗೆ ಮಾತ್ರ ಅನ್ವಯವಾಗುತ್ತದೆ.

Hence, the approval has been accorded for the collection of user fee on this road vide Government Order No. PWD 118 EAP 2016, Bengaluru, dated: 31-03-2017.

2. Calculation of rates for the collection of User Fee on this road is done as per the Karnataka Road User Fee Rules, Dated: 07-03-2015.

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ದಿ ಕಾಯ್ದೆಯ 1966ರ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18) ವಿಧಿ 3(1)ರಂತೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ಕಾಲಂ 2ರಲ್ಲಿ ನಮೂದಿಸಿರುವ ಮೈಸೂರು ಜಿಲ್ಲೆ, ಮೈಸೂರು ತಾಲ್ಲೂಕು, ಜಯಪುರ ಹೋಬಳಿ, ಕಡಕೊಳ ಗ್ರಾಮದ ಸರ್ವೆ ನಂಬರ್‌ನಲ್ಲಿ ಈ ಕೆಳಕಂಡ ಪಟ್ಟಿಯಲ್ಲಿನ ಕಾಲಂ 6ರಲ್ಲಿ ತೋರಿಸಿರುವ ಚಕ್ಕುಬಂದಿಯುಳ್ಳ ಕಾಲಂ 3 ರಿಂದ 5ರಲ್ಲಿ ನಮೂದಿಸಿರುವ ವಿಸ್ತೀರ್ಣದ ಜಮೀನುಗಳನ್ನು ಕೈಗಾರಿಕಾ ಪ್ರದೇಶವೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಿದೆ.

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ದಿ ಕಾಯ್ದೆಯ 1966ರ (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18) ವಿಧಿ 1(3)ರಂತೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ಕಾಲಂ 2ರಲ್ಲಿ ನಮೂದಿಸಿರುವ ಮೈಸೂರು ಜಿಲ್ಲೆ, ಮೈಸೂರು ತಾಲ್ಲೂಕು, ಜಯಪುರ ಹೋಬಳಿ, ಕಡಕೊಳ ಗ್ರಾಮದ ಸರ್ವೆ ನಂಬರ್‌ನಲ್ಲಿ ಈ ಕೆಳಕಂಡ ಪಟ್ಟಿಯಲ್ಲಿನ ಕಾಲಂ 6 ರಲ್ಲಿ ತೋರಿಸಿರುವ ಚಕ್ಕುಬಂದಿಯುಳ್ಳ ಕಾಲಂ 3 ರಿಂದ 5ರಲ್ಲಿ ನಮೂದಿಸಿರುವ ವಿಸ್ತೀರ್ಣದ ಜಮೀನುಗಳಿಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ಅಧ್ಯಾಯ ವಿಧಿ 7(ಎ)ರನ್ವಯ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶವೆಂದು ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಚುರಗೊಂಡ ದಿನಾಂಕದಿಂದ ಅನ್ವಯವಾಗುವಂತೆ ಘೋಷಿಸಿದೆ.

ಈ ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ದಿ ಮಂಡಳಿಗೆ, ಕೈಗಾರಿಕಾ ಸ್ಥಾಪನೆಗಾಗಿ ಅಭಿವೃದ್ದಿಪಡಿಸುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಬೇಕಾಗಿದೆ ಎಂಬುದಾಗಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಅಭಿಪ್ರಾಯಪಟ್ಟಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ದಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ. ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಪ್ರವೇಶಿಸುವ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾದ ದಿನಾಂಕದ ನಂತರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ದಿ ಮಂಡಳಿಯ ಮೈಸೂರು ವಿಭಾಗೀಯ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿಯವರ ಅನುಮತಿ ಇಲ್ಲದೇ ಸದರಿ ಜಮೀನನ್ನು ಒಪ್ಪಂದ, ಕ್ರಯ, ಭೋಗ್ಯ, ಗುತ್ತಿಗೆ ಅದಲು ಬದಲು ಅಥವಾ ಮತ್ತಾವುದೇ ರೀತಿಯಲ್ಲಿ ವಿಲೇವಾರಿ ಮಾಡುವಂತಿಲ್ಲ ಮತ್ತು ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಅಥವಾ ಮತ್ತಿತರ ಯಾವುದೇ ಅಭಿವೃದ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡಕೂಡದು. ಹಾಗೆ ಮಾಡಿದ್ದಲ್ಲಿ 1894ರ ಭೂ ಸ್ವಾಧೀನ ಕಾಯ್ದೆಯ ಕಲಂ 24ರ (ನಿಯಮ 7)ರ ಅನ್ವಯ (1894ರ ಕೇಂದ್ರ ಕಾಯ್ದೆ 1) 1961ರ ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 17ರಲ್ಲಿ ತಿದ್ದುಪಡಿಯಾದಂತೆ ಮತ್ತು 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ದಿ ಅಧಿನಿಯಮದ ವಿಧಿ 30ರ ಅನ್ವಯ ಅಂತಿಮವಾಗಿ ಭೂಸ್ವಾಧೀನಪಡಿಸಿಕೊಂಡು ಪರಿಹಾರ ನಿಗದಿಪಡಿಸುವಾಗ ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದಿಲ್ಲ ಮತ್ತು ಅಂತಿಮವಾಗಿ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದು. ಈ ಜಮೀನುಗಳ ನಕ್ಷೆೆಯನ್ನು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ದಿ ಮಂಡಳಿಯ ಮೈಸೂರು ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿಯವರ ಕಛೇರಿಯಲ್ಲಿ ಪರಿಶೀಲನೆಗೆ ಇಟ್ಟಿದೆ.
