ವಿಷಯ : 2017-18 ನೇ ಸಾಲಿಗೆ ರಾಜ್ಯದ ರೈತರಿಗೆ ಪತ್ತಿನ ಸಹಕಾರಿ ಸಂಸ್ಥೆಗಳು ಶೂನ್ಯ ಬಡ್ಡಿ ದರದಲ್ಲಿ ವಿತರಿಸಿದ ಅಲ್ಪಾವಧಿ ಕೃಷಿ ಸಾಲಗಳಿಗೆ ಬಡ್ಡಿ ಸಹಾಯಧನ ದರ ನಿಗದಿಪಡಿಸಿ ಆದೇಶ.

ಓದಲಾಗಿದೆ : ¹) ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ : ಸಿಒ 177 ಸಿಎಲ್ಎಸ್ 2017, ದಿನಾಂಕ : 01-07-2017.

²) ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ : ಸಿಒ 252 ಸಿಎಲ್ಎಸ್ 2017, ದಿನಾಂಕ : 09-08-2017.

³) ಸಹಕಾರ ಸಂಘಗಳ ನಿಬಂಧಕರ ಪತ್ರ ಸಂಖ್ಯೆ : ಸಿಆರ್‌ಡಿ/ಸಿಎಬಿ-1/01/2017-18, ದಿ : 11-06-2018.

ಪ್ರಸ್ತಾವನೆ:

ಮೇಲೆ (1) ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರಿ ಆದೇಶದಲ್ಲಿ ರೈತರಿಗೆ ಸಹಕಾರ ಸಂಸ್ಥೆಗಳಿಂದ ರೂ. 3 ಲಕ್ಷಗಳವರೆಗಿನ ಅಲ್ಪಾವಧಿ ಕೃಷಿ ಸಾಲವನ್ನು ಶೂನ್ಯ ಬಡ್ಡಿ ದರದಲ್ಲಿ ನೀಡುವ ಯೋಜನೆಯನ್ನು ಷರತ್ತಿಗೊಳಪಟ್ಟು 2017-18ನೇ ಸಾಲಿಗೆ ಜಾರಿಗೊಳಿಸಿ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ(2)ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರಿ ಆದೇಶದಲ್ಲಿ 2016-17ನೇ ಸಾಲಿನಲ್ಲಿ ರೈತರಿಗೆ ಪತ್ತಿನ ಸಹಕಾರಿ ಸಂಸ್ಥೆಗಳು ಶೂನ್ಯ ಬಡ್ಡಿ ದರದಲ್ಲಿ ವಿತರಿಸಲಾದ ಅಲ್ಪಾವಧಿ ಕೃಷಿ ಸಾಲಗಳಿಗೆ ಕೇಂದ್ರ ಸರ್ಕಾರದ ವತಿಯಿಂದ ಒದಗಿಸಲಾಗಿರುವ ಶೇ. 3ರ ಬಡ್ಡಿ ಸಹಾಯಧನವನ್ನು ಪರಿಗಣಿಸಿ ಇದನ್ನು ಅಳವಡಿಸಿಕೊಂಡು ಶೇ. 6.9ರ ಬಡ್ಡಿ ಸಹಾಯಧನವನ್ನು ನಿಗದಿಪಡಿಸಿ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ (3)ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಸಹಕಾರ ಸಂಘಗಳ ನಿಬಂಧಕರು 2017-18ನೇ ಸಾಲಿನಲ್ಲಿ ಸಹಕಾರ ಸಂಸ್ಥೆಗಳ ಮೂಲಕ ಶೂನ್ಯ ಬಡ್ಡಿದರದಲ್ಲಿ ವಿತರಿಸಿದ ಅಲ್ಪಾವಧಿ ಕೃಷಿ ಸಾಲಗಳಿಗೆ ಸರ್ಕಾರದಿಂದ ಶೇ. 7ರ ಬಡ್ಡಿ ಸಹಾಯಧನ ದರ ನಿಗದಿಪಡಿಸಲು ಹಾಗೂ ಕೇಂದ್ರ ಸರ್ಕಾರದಿಂದ ಲಭ್ಯವಾಗುವ ಶೇ.3ರ ಪ್ರೋತ್ಸಾಹವನ್ನು ಡಿ.ಸಿ.ಸಿ ಬ್ಯಾಂಕುಗಳು ಪಡೆಯಲು ಸರ್ಕಾರಿ ಆದೇಶವನ್ನು ಕೋರಿ ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕೂಲಂಕುಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ : ಸಿಒ 104 ಸಿಎಲ್ಎಸ್ 2018, ಬೆಂಗಳೂರು, ದಿನಾಂಕ : 23-08-2018.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ 2017-18ನೇ ಸಾಲಿನಲ್ಲಿ ರೈತರಿಗೆ ಪತ್ತಿನ ಸಹಕಾರಿ ಸಂಸ್ಥೆಗಳು ಶೂನ್ಯ ಬಡ್ಡಿ ದರದಲ್ಲಿ ವಿತರಿಸುವ ಅಲ್ಪಾವಧಿ ಕೃಷಿ ಸಾಲಗಳಿಗೆ ಕೇಂದ್ರ ಸರ್ಕಾರದಿಂದ ಒದಗಿಸಲಾಗುವ ಶೇ. 3ರ ಬಡ್ಡಿ ಸಹಾಯಧನವನ್ನು ಪರಿಗಣಿಸಿ ಇದನ್ನು ಅಳವಡಿಸಿಕೊಂಡು ಶೇ. 6.80ರ ಬಡ್ಡಿ ಸಹಾಯಧನವನ್ನು ನಿಗದಿಪಡಿಸಿ ಈ ಮೊತ್ತದಲ್ಲಿ ಡಿ.ಸಿ.ಸಿ. ಬ್ಯಾಂಕ್ ಮತ್ತು ಫ್ಯಾಕ್ಸ್‌ಗಳಿಗೆ ಶೇ.4.4 : ಶೇ.2.4 ಅನುಪಾತದಲ್ಲಿ ನಿಗದಿಪಡಿಸಿ ಆದೇಶಿಸಲಾಗಿದೆ.

ಕೇಂದ್ರ ಸರ್ಕಾರದಿಂದ ಲಭ್ಯವಾಗುವ ಶೇ. 3ರ ಪ್ರೋತ್ಸಾಹ ಧನವನ್ನು ಜಿಲ್ಲಾ ಕೇಂದ್ರ ಸಹಕಾರ ಬ್ಯಾಂಕ್‌ಗಳು ಪಡೆಯಲು ಆದೇಶಿಸಲಾಗಿದೆ.

ಈ ಆದೇಶವನ್ನು ಆರ್ಥಿಕ ಇಲಾಖೆಯು ಟಿಪ್ಪಣಿ ಸಂಖ್ಯೆ : ಆಇ 114 ವೆಚ್ಚ-2/2018, ದಿನಾಂಕ : 07-08-2018 ರಲ್ಲಿ ನೀಡಿರುವ ಸಹಮತಿಯ ಮೇರೆಗೆ ಹೊರಡಿಸಲಾಗಿದೆ.

2012-13ನೇ ಸಾಲಿನ ಲೆಕ್ಕ ಪರಿಶೋಧನೆಯನ್ನು ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡುವ ಕುರಿತು.

ಪ್ರಸ್ತಾವನೆ :

ಮೇಲೆ ಓದಲಾದ ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ಪ್ರಾಥಮಿಕ ಕೃಷಿ ಪತ್ತಿನ ಸಹಕಾರ ಸಂಘ ನಿ., ಇರಕಲ್ಲಗಡ, ಕೊಪ್ಪಳ ಇದರ 2011-12 ಮತ್ತು 2012-13ನೇ ಸಾಲಿನ ಲೆಕ್ಕಪರಿಶೋಧಿತ ಲೆಕ್ಕಗಳನ್ನು ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡಲು ಲೆಕ್ಕಪರಿಶೋಧನಾ ನಿರ್ದೇಶಕರು ಕೋರಿರುತ್ತಾರೆ.

ಪ್ರಸ್ತಾವಿತ ಸಂಘದ 2009-10 ಮತ್ತು 2010-11ನೇ ಸಾಲುಗಳ ಲೆಕ್ಕಪರಿಶೋಧನಾ ವರದಿಗಳನ್ನು ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡಿರುವುದು ಸದರಿ ಮರು ಲೆಕ್ಕಪರಿಶೋಧನಾ ವರದಿಗಳಲ್ಲಿ ಅನೇಕ ವ್ಯತ್ಯಾಸಗಳು, ಅಪರ ತಪರ, ಶಿಲ್ಕುಗಳಲ್ಲಿ ವ್ಯತ್ಯಾಸ ಈ ರೀತಿ ಬಹಳಷ್ಟು ಲೋಪದೋಷಗಳು ಕಂಡು ಬಂದಿರುತ್ತದೆ. ಸಂಘವು 2011-12 ಮತ್ತು 2012-13ನೇ ಸಾಲುಗಳ ಲೆಕ್ಕಪರಿಶೋಧನೆಯನ್ನು ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡಲು ದಿನಾಂಕ : 17-09-2017 ರಂದು ನಡೆದ 2016-17ನೇ ಸಾಲಿನ ವಾರ್ಷಿಕ ಮಹಾಸಭೆಯಲ್ಲಿ ತೀರ್ಮಾನಿಸಿರುವುದಾಗಿ, ಅದರಂತೆ ಈ ಬಗ್ಗೆ ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡುವ ಅಗತ್ಯತೆ ಬಗ್ಗೆ ಪರಿಶೀಲಿಸಿ ವರದಿ ನೀಡುವಂತೆ ಲೆಕ್ಕಪರಿಶೋಧನಾ ಉಪ ನಿರ್ದೇಶಕರು, ಕೊಪ್ಪಳ ಇವರಿಗೆ ಸೂಚನೆ ನೀಡಲಾಗಿತ್ತೆಂದು ಸದರಿಯವರು ಪರಿಶೀಲಿಸಿ, ಈಗಾಗಲೇ ಆಗಿರುವ ಲೆಕ್ಕಪರಿಶೋಧನಾ ವರದಿ 2011-12 ಮತ್ತು 2012-13ನೇ ಸಾಲುಗಳಲ್ಲಿ ಅನೇಕ ಗಂಭೀರ ಲೋಪದೋಷಗಳು, ಶಿಲ್ಕು ವ್ಯತ್ಯಾಸ, ನಗದು ಪುಸ್ತಕದಲ್ಲಿ ವ್ಯತ್ಯಾಸ ಹಾಗೂ ಇತರೆ ಗಂಭೀರ ಲೋಪದೋಷಗಳು ಆಗಿರುವುದಾಗಿ ವರದಿ ಮಾಡಿರುತ್ತಾರೆಂದು ತಿಳಿಸಿ, ಅದಕ್ಕಾಗಿ ಪ್ರಸ್ತಾಪಿತ ಸಂಘದ 2011-12 ಮತ್ತು 2012-13ರ ಲೆಕ್ಕಪರಿಶೋಧನೆ ಲೆಕ್ಕಗಳನ್ನು ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡಲು ಅನುಮತಿಸಬೇಕೆಂದು ಸರ್ಕಾರವನ್ನು ಕೋರಿರುತ್ತಾರೆ.

ಸದರಿ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಪರಿಶೀಲಿಸಿ, ಕೆಳಕಂಡಂತೆ ಆದೇಶವನ್ನು ಹೊರಡಿಸಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಪ್ರಾಥಮಿಕ ಕೃಷಿ ಪತ್ತಿನ ಸಹಕಾರ ಸಂಘ ನಿ., ಇರಕಲ್ಲಗಡ, ಕೊಪ್ಪಳ ಇದರ 2011-12 ಮತ್ತು 2012-13ನೇ ಸಾಲುಗಳ ಪರಿಶೋಧಿತ ಲೆಕ್ಕಪತ್ರಗಳನ್ನು ಮರುಲೆಕ್ಕ ಪರಿಶೋಧನೆ ಮಾಡಲು ಶ್ರೀ ಎಸ್. ವೀರೇಶ್, ಹಿರಿಯ ಲೆಕ್ಕಪರಿಶೋಧಕರು, ಗಂಗಾವತಿ ಇವರನ್ನು ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ಅಧಿನಿಯಮ 1959ರ ಕಲಂ 63(13)ರ ರೀತ್ಯಾ ನೇಮಿಸಿ ಅನುಮತಿ ನೀಡಿದೆ.

ಮೇಲೆ ಓದಲಾದ (1) ರಲ್ಲಿ ಸಹಕಾರ ಸಂಘಗಳ ಲೆಕ್ಕಪರಿಶೋಧನಾ ನಿರ್ದೇಶಕರ ಪ್ರಸ್ತಾವೆಯಲ್ಲಿ ರೈತರ ವ್ಯವಸಾಯೋತ್ಪನ್ನ ಮಾರಾಟ ಸಹಕಾರ ಸಂಘ ನಿ., ಮಂಡ್ಯ ಇದರ 2007-2008ನೇ ಸಾಲಿನ ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ನಡೆಸಲು ಶ್ರೀ ಹೆಚ್. ಷಣ್ಮುಖಸ್ವಾಮಿ, ಸಹಕಾರ ಸಂಘಗಳ ಲೆಕ್ಕಪರಿಶೋಧನಾ ನಿರ್ದೇಶಕರು, ಕೊಡಗು ಜಿಲ್ಲೆ, ಮಡಿಕೇರಿ ಇವರನ್ನು ನೇಮಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಓದಲಾದ (2)ರಲ್ಲಿ ಸರ್ಕಾರದ ಆದೇಶವನ್ನು ಪ್ರಶ್ನಿಸಿ ಸಂಘದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರು ಮಾನ್ಯ ಗೌರವ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ : 47886/2011 ಅನ್ನು ದಾಖಲಿಸಿ ದಿನಾಂಕ : 09-01-2012 ರಂದು ಸದರಿ ಆದೇಶಕ್ಕೆ ತಡೆಯಾಜ್ಞೆ ತಂದಿರುತ್ತಾರೆ.

ಮೇಲ್ಕಂಡ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, 2007-08ನೇ ಸಾಲಿನ ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆಯನ್ನು ಅನುಷ್ಠಾನಗೊಳಿಸಲು ಅವಶ್ಯವಿರುವುದರಿಂದ ಶ್ರೀ ಎಸ್. ಷಣ್ಮುಖಸ್ವಾಮಿ ಇವರು ಉಪ ನಿಯಂತ್ರಕರು (ಹಣಕಾಸು), ಆಯುಕ್ತಾಲಯ, ಪಶುಪಾಲನಾ ಮತ್ತು ಪಶು ವೈದ್ಯ ಸೇವಾ ಇಲಾಖೆ, ಬೆಂಗಳೂರು ಇಲ್ಲಿನ ಅನ್ಯ ಸೇವೆಯಲ್ಲಿ ಹಾಲಿ ನಿಯೋಜಿತರಾಗಿರುವುದರಿಂದ ಪ್ರಸ್ತುತ ಆದೇಶವನ್ನು ಪರಿಷ್ಕರಿಸಿ ಶ್ರೀ ಮಾದೇಗೌಡ, ಸಹಕಾರ ಸಂಘಗಳ ಲೆಕ್ಕಪರಿಶೋಧನಾ, ಉಪ ನಿರ್ದೇಶಕರು, ಮಂಡ್ಯ ಜಿಲ್ಲೆ, ಮಂಡ್ಯ ಇವರಿಗೆ ವಹಿಸಲು ಆದೇಶ ನೀಡುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕೂಲಂಕುಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ರೈತರ ವ್ಯವಸಾಯೋತ್ಪನ್ನ ಮಾರಾಟ ಸಹಕಾರ ಸಂಘ ನಿ., ಮಂಡ್ಯ ಇದರ 2007-2008ನೇ ಸಾಲಿನ ಪರಿಶೋಧಿತ ಲೆಕ್ಕಗಳ ಮರು ಲೆಕ್ಕಪರಿಶೋಧನೆ ಮಾಡುವುದು ಸೂಕ್ತವೆಂದು ಭಾವಿಸಿ ಸರ್ಕಾರವು ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ : ಸಿಒ 35 ಸಿಎಲ್ಎಂ 2018, ಬೆಂಗಳೂರು, ದಿನಾಂಕ : 29-08-2018.

ಪ್ರಸ್ತಾವನೆ:

2018-19ನೇ ಸಾಲಿನ ಫೆಬ್ರವರಿ ಆಯವ್ಯಯ ಭಾಷಣದ ಕಂಡಿಕೆ-75 ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸೆಂಟ್ರಲ್ ಕೋ-ಆಪರೇಟಿವ್ ಬ್ಯಾಂಕ್, ಧಾರವಾಡ ಹಾಗೂ ಜಿಲ್ಲಾ ಸಹಕಾರ ಕೇಂದ್ರ ಬ್ಯಾಂಕ್, ವಿಜಯಪುರ ಬ್ಯಾಂಕುಗಳ ಶತಮಾನೋತ್ಸವದ ಅಂಗವಾಗಿ ನಿರ್ಮಾಣ ಮಾಡುವ ಕಟ್ಟಡಕ್ಕೆ ತಲಾ 5 ಕೋಟಿ ರೂ.ಗಳಂತೆ ಸರ್ಕಾರ ಮತ್ತು ಅಪೆಕ್ಸ್ ಬ್ಯಾಂಕ್ ವತಿಯಿಂದ ಸಹಾಯಧನವನ್ನು ನೀಡಲಾಗುವುದು ಎಂದು ಘೋಷಿಸಲಾಗಿದೆ.

ಮೇಲೆ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ನಿಬಂಧಕರು, ಕೆ.ಸಿ.ಸಿ ಬ್ಯಾಂಕ್, ಧಾರವಾಡ ಮತ್ತು ವಿಜಯಪುರ ಡಿ.ಸಿ.ಸಿ ಬ್ಯಾಂಕುಗಳ ಶತಮಾನೋತ್ಸವ ಕಟ್ಟಡವನ್ನು ನಿರ್ಮಾಣ ಮಾಡಲು ಸರ್ಕಾರ ಮತ್ತು ಅಪೆಕ್ಸ್ ಬ್ಯಾಂಕಿನ ವಂತಿಗೆ ತಲಾ ರೂ. 5.00 ಕೋಟಿಯನ್ನು ಬಿಡುಗಡೆ ಮಾಡಲು ಬ್ಯಾಂಕುಗಳು ಕೋರಿರುವುದಾಗಿ ತಿಳಿಸಿ, ಆದರೆ ಅಪೆಕ್ಸ್ ಬ್ಯಾಂಕಿನ ಪಾಲನ್ನು ಈ ಯೋಜನೆಗೆ ನೀಡಿದ್ದಲ್ಲಿ, ಅದರ ಆರ್ಥಿಕ ಸ್ಥಿತಿಯ ಮೇಲೆ ವ್ಯತಿರಿಕ್ತ ಪರಿಣಾಮ ಬೀರುವ ಸಾಧ್ಯತೆ ಇರುವುದರಿಂದ, ಅಪೆಕ್ಸ್ ಬ್ಯಾಂಕ್ ವತಿಯಿಂದ ನೀಡುವ ಸಹಾಯಧನದ ವಿಚಾರವನ್ನು ಕೈಬಿಡುವಂತೆ ಕೋರಿರುವುದಾಗಿ ತಿಳಿಸಿ, ಈ ಯೋಜನೆಗೆ ಸೂಕ್ತ ನಿರ್ಣಯ ಕೈಗೊಂಡು ಆಡಳಿತಾತ್ಮಕ ಅನುಮೋದನೆಯನ್ನು ನೀಡುವಂತೆ ನಿಬಂಧಕರು ತಮ್ಮ ಪ್ರಸ್ತಾವೆಯಲ್ಲಿ ಕೋರಿರುತ್ತಾರೆ.

ಘೋಷಣೆಯಂತೆ ಯೋಜನೆಗೆ ಅಪೆಕ್ಸ್ ಬ್ಯಾಂಕಿನ ಪಾಲನ್ನು ಒದಗಿಸಲು ಕೋರಲಾಗಿ, ಸದ್ಯದ ಹಣಕಾಸು ಪರಿಸ್ಥಿತಿಯಲ್ಲಿ ಕೆ.ಸಿ.ಸಿ ಬ್ಯಾಂಕ್, ಧಾರವಾಡ ಮತ್ತು ವಿಜಯಪುರ ಡಿ.ಸಿ.ಸಿ ಬ್ಯಾಂಕುಗಳ ಶತಮಾನೋತ್ಸವ ಕಟ್ಟಡ ನಿರ್ಮಾಣಕ್ಕೆ ಅಪೆಕ್ಸ್ ಬ್ಯಾಂಕಿನಿಂದ ಸಹಾಯಧನ ನೀಡಲು ಸಾಧ್ಯವಾಗುವುದಿಲ್ಲವೆಂದು ಲಿಖಿತವಾಗಿ ತಿಳಿಸಿರುತ್ತಾರೆ.

ಮೇಲಿನ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಆಯವ್ಯಯದಲ್ಲಿ ಘೋಷಣೆ ಮಾಡಿರುವಂತೆ ಸರ್ಕಾರದ ಪಾಲಿನ ಮಿತಿಗೆ ಸೀಮಿತಗೊಳಿಸಿ ಕೆ.ಸಿ.ಸಿ ಬ್ಯಾಂಕ್, ಧಾರವಾಡ ಮತ್ತು ವಿಜಯಪುರ ಡಿ.ಸಿ.ಸಿ ಬ್ಯಾಂಕುಗಳ ಶತಮಾನೋತ್ಸವ ಕಟ್ಟಡವನ್ನು ಮೊದಲು ಅಂದಾಜು ಮಾಡಿದ ತಲಾ ರೂ. 5.00 ಕೋಟಿಗೆ ಬದಲಾಗಿ ತಲಾ ರೂ. 2.50 ಕೋಟಿಗೆ ಕಡಿಮೆಗೊಳಿಸಿ ಕಟ್ಟಡ ನಿರ್ಮಿಸಲು ಯೋಜನೆ ರೂಪಿಸಿಕೊಳ್ಳಲು ತಿಳಿಸಿ, ಅದರಂತೆ ಈ ಮೊತ್ತವನ್ನು ಸರ್ಕಾರದಿಂದ ಮಂಜೂರು ಮಾಡಲು ಆಡಳಿತಾತ್ಮಕ ಆದೇಶ ಹೊರಡಿಸಲು ತೀರ್ಮಾನಿಸಿ, ಈ ಕೆಳಕಂಡ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕರ್ನಾಟಕ ಸೆಂಟ್ರಲ್ ಕೋ-ಆಪರೇಟಿವ್ ಬ್ಯಾಂಕ್ ನಿ., ಧಾರವಾಡ ಹಾಗೂ ಜಿಲ್ಲಾ ಸಹಕಾರ ಕೇಂದ್ರ ಬ್ಯಾಂಕ್, ವಿಜಯಪುರ ಬ್ಯಾಂಕುಗಳ ಶತಮಾನೋತ್ಸವದ ಅಂಗವಾಗಿ ನಿರ್ಮಾಣ ಮಾಡುವ ಕಟ್ಟಡಗಳಿಗೆ ಸರ್ಕಾರದಿಂದ ತಲಾ ರೂ. 2.50 ಕೋಟಿಗಳನ್ನು ಈ ಕೆಳಕಂಡ ಷರತ್ತಿಗಳಿಗೊಳಪಟ್ಟು ನಿರ್ಮಿಸಲು ಆಡಳಿತಾತ್ಮಕ ಅನುಮೋದನೆಯನ್ನು ನೀಡಿದೆ.

ಷರತ್ತುಗಳು :

1) ಕರ್ನಾಟಕ ಸೆಂಟ್ರಲ್ ಕೋ-ಆಪರೇಟಿವ್ ಬ್ಯಾಂಕ್, ಧಾರವಾಡ ಹಾಗೂ ಜಿಲ್ಲಾ ಸಹಕಾರ ಕೇಂದ್ರ ಬ್ಯಾಂಕ್, ವಿಜಯಪುರ ಬ್ಯಾಂಕುಗಳ ಶತಮಾನೋತ್ಸವದ ಅಂಗವಾಗಿ ಕಟ್ಟಡ ನಿರ್ಮಾಣಕ್ಕೆ ಉದ್ದೇಶಿಸಿದ್ದ ಮೂಲ ಅಂದಾಜು ಮತ್ತು ನೀಲನಕ್ಷೆಯನ್ನು ಈ ಬ್ಯಾಂಕುಗಳು ಪರಿಷ್ಕರಿಸಿ, ವೆಚ್ಚವನ್ನು ರೂ. 2.50 ಕೋಟಿಗೆ ಸೀಮಿತಗೊಳಿಸಿ ಯೋಜನೆಯನ್ನು ತಯಾರಿಸುವುದು.

2) ಕಟ್ಟಡ ನಿರ್ಮಾಣಕ್ಕೆ ಮೇಲಿನ ಮೊತ್ತಕ್ಕಿಂತ ಹೆಚ್ಚಿನ ವೆಚ್ಚವಾದಲ್ಲಿ, ಸರ್ಕಾರದಿಂದ ನಿಗಧಿಪಡಿಸಿದ ಮೊತ್ತಕ್ಕಿಂತ ಯಾವುದೇ ಹೆಚ್ಚುವರಿ ಮೊತ್ತವನ್ನು ಮಂಜೂರು ಮಾಡುವುದಿಲ್ಲ.

3) ಕಟ್ಟಡ ನಿರ್ಮಾಣದ ಸಮಯದಲ್ಲಿ ಕಟ್ಟಡದ ವೆಚ್ಚವು ಹೆಚ್ಚಾದಲ್ಲಿ, ಆಯಾ ಡಿ.ಸಿ.ಸಿ ಬ್ಯಾಂಕುಗಳು ತಮ್ಮ ಸ್ವಂತ ಬಂಡವಾಳದಿಂದ ಭರಿಸತಕ್ಕದ್ದು. 4) ಕಟ್ಟಡ ನಿರ್ಮಾಣದ ಅಂದಾಜು, ನೀಲನಕ್ಷೆ ಮತ್ತು ನಿರ್ಮಾಣ ಕಾರ್ಯಗಳನ್ನು ಪಾರದರ್ಶಕ ಕಾಯ್ದೆಯನುಸಾರ ಸರ್ಕಾರದ ನಿಯಮಗಳಂತೆ ನಿರ್ವಹಿಸತಕ್ಕದ್ದು.

5) ಕೆ.ಸಿ.ಸಿ. ಬ್ಯಾಂಕ್, ಧಾರವಾಡ ಮತ್ತು ಡಿ.ಸಿ.ಸಿ. ಬ್ಯಾಂಕ್, ವಿಜಯಪುರ ಇದರ ಕಟ್ಟಡ ನಿರ್ಮಾಣದ ಯೋಜನೆ ನಿಯಮಾನುಸಾರ ಅನುಷ್ಠಾನಗೊಳಿಸುವ ಬಗ್ಗೆ ನಿಬಂಧಕರು ಕಾಲಕಾಲಕ್ಕೆ ಅಗತ್ಯವೆನಿಸುವ ಸೂಚನೆಗಳನ್ನು ನೀಡಿ ಕ್ರಮವಿಡತಕ್ಕದ್ದು.

ಈ ಆದೇಶವನ್ನು ಯೋಜನಾ ಇಲಾಖೆಯ ಟಿಪ್ಪಣಿ ಸಂಖ್ಯೆ : ಪಿಡಿ 32 ಎಫ್ಆರ್ಒ 2018, ದಿನಾಂಕ : 20-08-2018 ಹಾಗೂ ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಟಿಪ್ಪಣಿ ಸಂಖ್ಯೆ : ಆಇ 166 ವೆಚ್ಚ-2/2018, ದಿನಾಂಕ : 27-08-2018ರಲ್ಲಿ ನೀಡಿರುವ ಅನುಮೋದನೆಯಂತೆ ಹೊರಡಿಸಿದೆ.

ಮೇಲೆ ಓದಲಾದ (2)ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ "ಸ್ಪಿನ್ನಿಂಗ್ ಮಿಲ್ ಇಂಡಸ್ಟ್ರೀಸ್", "ಬಟ್ಟೆಗಳಿಗೆ ಡೈ ಮಾಡಿ ಪ್ರಿಂಟ್ ಹಾಕುವುದು", " ಟೆಕ್ಸ್‌ಟೈಲ್ (ಸಿಲ್ಕ್) ಇಂಡಸ್ಟ್ರಿ" ಮತ್ತು "ಟೈಲರಿಂಗ್ (ದರ್ಜಿ)" ಉದ್ದಿಮೆಗಳಿಗೆ ಏಕರೂಪದ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ಸಾರ್ವಜನಿಕ ಹಿತದೃಷ್ಟಿಯಿಂದ ಪರಿಷ್ಕರಿಸಿ, ನಿರ್ಧರಿಸುವುದಕ್ಕಾಗಿ ಸಮಿತಿಯನ್ನು ರಚಿಸುವ ಬಗ್ಗೆ ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ, 1948ರ ಕಲಂ 5(1) (ಎ)ರನ್ವಯ ಹಾಗೂ ಸಹವಾಚಿತ ಕಲಂ 9ರನ್ವಯ ಮಾಲೀಕರ, ಕಾರ್ಮಿಕರ ಮತ್ತು ಸ್ವತಂತ್ರ ಸದಸ್ಯರನ್ನೊಳಗೊಂಡ ಪ್ರತಿನಿಧಿಗಳನ್ನು ಸೇರಿದಂತೆ, ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಯನ್ನು ರಚಿಸಲಾಗಿತ್ತು. ಈ ಸಮಿತಿಯು ಒಂದು ತಿಂಗಳೊಳಗಾಗಿ ಸರ್ಕಾರಕ್ಕೆ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ನಿಗಧಿಪಡಿಸುವ ಬಗ್ಗೆ ವರದಿಯನ್ನು ಸಲ್ಲಿಸತಕ್ಕದ್ದೆಂದು ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಓದಲಾದ (3)ರ ಕಾರ್ಮಿಕ ಆಯುಕ್ತರ ಪತ್ರದಲ್ಲಿ "ಸ್ಪಿನ್ನಿಂಗ್ ಮಿಲ್ ಇಂಡಸ್ಟ್ರೀಸ್", "ಬಟ್ಟೆಗಳಿಗೆ ಡೈ ಮಾಡಿ ಪ್ರಿಂಟ್ ಹಾಕುವುದು", "ಟೆಕ್ಸ್‌ಟೈಲ್ (ಸಿಲ್ಕ್) ಇಂಡಸ್ಟ್ರಿ" ಮತ್ತು "ಟೈಲರಿಂಗ್ (ದರ್ಜಿ)" ಉದ್ದಿಮೆಗಳಿಗೆ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ಪರಿಷ್ಕರಿಸಲು ರಚಿಸಿರುವ ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಗೆ ಕಾಸಿಯಾ, ಎ.ಐ.ಟಿ.ಯು.ಸಿ., ಮೆ: ಪ್ರಿಕಾಟ್ ಮೆರಿಡಿಯನ್ ಲಿ., ಆಯುಕ್ತರು, ಜವಳಿ ಅಭಿವೃದ್ದಿ ಹಾಗೂ ನಿರ್ದೇಶಕರು, ಕೈ ಮಗ್ಗ ಮತ್ತು ಜವಳಿ ಇಲಾಖೆ, ಕೆ.ಜಿ.ಎಫ್ ಹೊಲಿಗೆ ಕಾರ್ಮಿಕರ ಸಂಘ, ಕರ್ನಾಟಕ ಸ್ಟೇಟ್ ಟೈಲರ್ಸ್ ಅಸೋಸಿಯೇಷನ್, ಮಂಗಳೂರು ಈ ಸಂಘಗಳ ಪ್ರತಿನಿಧಿಗಳು ಸದರಿ ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಯಲ್ಲಿ ಸೂಕ್ತವಾದ ಪ್ರಾತಿನಿಧ್ಯ ನೀಡುವಂತೆ ಕೋರಿರುವ ಬಗ್ಗೆ ಪ್ರಸ್ತಾಪಿಸಿರುತ್ತಾರೆ.

ದಿನಾಂಕ: 19-06-2018ರಂದು ಗೌರವಾನ್ವಿತ ಮುಖ್ಯಮಂತ್ರಿಯವರ ಅಧ್ಯಕ್ಷತೆಯಲ್ಲಿ ನಡೆದ ಸಭೆಯ ಚರ್ಚೆಯ ಅಂಶಗಳಂತೆ ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಯನ್ನು ಪುನರ್ ರಚಿಸಲು ಆದೇಶಿಸಿರುವ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಮೇಲೆ ಓದಲಾದ (4)ರ ಪತ್ರದಲ್ಲಿ ಕಾರ್ಮಿಕ ಆಯುಕ್ತರು "ಟೈಲರಿಂಗ್ ಇಂಡಸ್ಟ್ರಿ", "ಟೆಕ್ಸ್‌ಟೈಲ್ (ಸಿಲ್ಕ್) ಇಂಡಸ್ಟ್ರಿ", "ಕ್ಲಾತ್ ಡೈಯಿಂಗ್ ಅಂಡ್ ಪ್ರಿಂಟಿಂಗ್ ಇಂಡಸ್ಟ್ರಿ" ಮತ್ತು "ಸ್ಪಿನ್ನಿಂಗ್ ಮಿಲ್ ಇಂಡಸ್ಟ್ರಿ", ಈ ನಾಲ್ಕು ಅನುಸೂಚಿತ ಉದ್ದಿಮೆಗಳಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿರುವ ಕಾರ್ಮಿಕರಿಗೆ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ಪರಿಷ್ಕರಿಸಲು, ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ, 1948ರ ಕಲಂ 5(1) (ಎ)ರನ್ವಯ ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಯನ್ನು ಪುನರ್ ರಚಿಸಲು ಸ್ವತಂತ್ರ ಸದಸ್ಯರು, ಕಾರ್ಮಿಕ ವರ್ಗದ ಪ್ರತಿನಿಧಿಗಳು ಮತ್ತು ಉದ್ಯೋಗದಾತರ ವರ್ಗದ ಪ್ರತಿನಿಧಿಗಳ ವಿವರವನ್ನು ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

(i) ಸದರಿ ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಯು ಕಾಲ-ಕಾಲಕ್ಕೆ ಸಭೆಗಳನ್ನು ಹಾಗೂ ಕಾರ್ಯಕಲಾಪಗಳನ್ನು ನಡೆಸಿ, ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ ದಿನಾಂಕದಿಂದ, ಎರಡು (02) ತಿಂಗಳೊಳಗಾಗಿ ಕನಿಷ್ಠ ವೇತನ ದರಗಳ ಪರಿಷ್ಕರಣೆಯ ವಿವರಗಳುಳ್ಳ ವರದಿಯನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸತಕ್ಕದು.

(ii) ತ್ರಿಪಕ್ಷೀಯ ಸಮಿತಿಯ ಸಭೆಗಳಲ್ಲಿ ಸರ್ಕಾರದಿಂದ ನಾಮನಿರ್ದೇಶಿತರಾದ ಸದಸ್ಯರು ಮಾತ್ರ ಪಾಲ್ಗೊಳ್ಳತಕ್ಕದ್ದು ಹಾಗೂ ನಾಮನಿರ್ದೇಶಿತ ಸದಸ್ಯರೊಂದಿಗೆ ಇತರೆ ಯಾರೇ ಆಗಲಿ ಸಭೆಯಲ್ಲಿ ಭಾಗವಹಿಸಲು ಅವಕಾಶವಿರುವುದಿಲ್ಲ.

ವಿಷಯ : ನೈಜ ನಕಲು ಪ್ರತಿಗಳ ದಾಖಲೆಗಳ ಪರಿಶೀಲನೆಗಾಗಿ ಇ-ದೃಡೀಕರಣ ಪೋರ್ಟಲ್ ಬಳಸುವ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ :

ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ನಾಗರಿಕ ಸೇವಾ ವಿತರಣೆಯನ್ನು ಸುಲಭಗೊಳಿಸುವ ದಿಸೆಯಲ್ಲಿ ಮಾಹಿತಿ ತಂತ್ರಜ್ಞಾನ ವ್ಯವಸ್ಥೆಯನ್ನು ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಬಳಕೆ ಮಾಡಲು ಕಾರ್ಯೋನ್ಮುಖವಾಗಿದೆ. ಈ ಉದ್ದೇಶವನ್ನು ಸಫಲಗೊಳಿಸುವ ಹಾದಿಯಲ್ಲಿ ಸರ್ಕಾರಿ ಸೇವೆಗಳನ್ನು ಪಡೆಯಲು ಮೂಲ ಪ್ರತಿ ಅಥವಾ ಮೂಲ ಪ್ರತಿಯ ನಕಲಿನ ಪ್ರಮಾಣೀಕೃತ ಪ್ರತಿಗಳನ್ನು ಸಲ್ಲಿಸುವುದು ಅತಿ ದೊಡ್ಡ ತೊಡಕಾಗಿದೆ. ಒಂದು ವೇಳೆ ಮೂಲ ಪ್ರತಿಯ ನಕಲಿನ ಪ್ರತಿಗಳನ್ನು ಸರ್ಕಾರಿ ಅಧಿಕಾರಿಯು ಡಿಜಿಟಲ್ ದೃಡೀಕರಣ ಮಾಡಿದ್ದಲ್ಲಿ, ಅವು ವಿದ್ಯುನ್ಮಾನ ಪ್ರತಿಗಳಾಗಿ ಉಳಿಯುವುದರಿಂದ ಅವುಗಳನ್ನು ಅನೇಕ ಬಾರಿ ಉಪಯೋಗಿಸಬಹುದಾಗಿದೆ. ಬ್ಲಾಕ್ ಚೈನ್ ಮುಂತಾದ ಸುಧಾರಿತ ತಂತ್ರಜ್ಞಾನಗಳ ಅಳವಡಿಕೆಯಿಂದಾಗಿ, ಆನ್‌ಲೈನ್ ದೃಡೀಕರಣಕ್ಕಾಗಿ ಸುರಕ್ಷಿತ ಮತ್ತು ವಿಶ್ವಾಸಾರ್ಹ ವೇದಿಕೆಯನ್ನು ಪಡೆಯಲು ಸಾಧ್ಯವಾಗುವುದು.

ಈ ಉದ್ದೇಶವನ್ನು ಗಮನದಲ್ಲಿಟ್ಟುಕೊಂಡು, http://eattest.karnataka.gov.in ಎಂಬ ಆನ್‌ಲೈನ್ ಪೋರ್ಟಲ್ ಅನ್ನು ಸೃಜಿಸಲಾಗಿದೆ. ಈ ಪೋರ್ಟಲ್ ಮೂಲಕ ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ಗೆಜೆಟೆಡ್ ಅಧಿಕಾರಿಗಳು (ಕೇಂದ್ರ ಸೇವೆ, ವೃಂದ-ಎ ಮತ್ತು ವೃಂದ-ಬಿ) ದಾಖಲೆಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಆನ್‌ಲೈನ್ ಮೂಲಕವೇ ದೃಡೀಕರಿಸಬಹುದಾಗಿದೆ. ಈ ಪೋರ್ಟಲ್ ಆಧಾರ್ ಒಳಗೊಂಡ ಇ-ಸಹಿ ಮತ್ತು ಬ್ಲಾಕ್ ಚೈನ್‌ಗಳ ಸಾಮರ್ಥ್ಯವನ್ನು ಒಳಗೊಂಡಿರುವುದರಿಂದ, ವಿದ್ಯುನ್ಮಾನ ದೃಡೀಕರಣ ಅಥವಾ ಇ-ದೃಡೀಕರಣಗಳನ್ನು ನಿರ್ವಹಣೆ ಮಾಡಲು ಸುರಕ್ಷಿತ ಮತ್ತು ವಿಶ್ವಾಸಾರ್ಹ ವೇದಿಕೆಯನ್ನು ಹೊಂದಲು ಸಾಧ್ಯವಾಗುವುದು.

ಹಾಲಿ ಜಾರಿಯಲ್ಲಿರುವ ಹಸ್ತ ಚಾಲಿತ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ, ನಾಗರಿಕರು ನಕಲು ಪ್ರತಿಗಳ ದೃಡೀಕರಣಕ್ಕಾಗಿ ಸರ್ಕಾರದ ಗೆಜೆಟೆಡ್ ಅಧಿಕಾರಿಗಳ ಸಹಾಯವನ್ನು ಕೋರುವುದು ಅಗತ್ಯವಾಗಿದೆ. ಯಾವುದೇ ಸೇವೆಗಳಿಗೆ ಅರ್ಜಿದಾರರು ಅರ್ಜಿ ಸಲ್ಲಿಸಲು ಅಪೇಕ್ಷ್ಷಿಸಿದ್ದಲ್ಲಿ, ಪ್ರತೀ ಬಾರಿಯೂ ದಾಖಲಾತಿಗಳ ದೃಡೀಕರಣ ಅಗತ್ಯವಾಗಿರುತ್ತದೆ. ಈ ಪ್ರಕ್ರಿಯೆಯು ಪದೇ ಪದೇ ಪುನಾರಾವರ್ತನೆ ಆಗುವುದರಿಂದ, ನಾಗರಿಕರ ಶ್ರಮ, ವೇಳೆ ಎಲ್ಲವೂ ವ್ಯರ್ಥವಾಗುವುದು. ದೃಡೀಕರಣ ಮಾಡಿರುವ ಸರ್ಕಾರಿ ಅಧಿಕಾರಿಗೂ ಸಹ ಅರ್ಜಿದಾರರ ಗುರುತನ್ನು ಮೌಲ್ಯೀಕರಿಸುವ ಕಾರ್ಯದಲ್ಲಿ ತೊಂದರೆಯಾಗುವುದು ಮತ್ತು ಈ ಕಾರ್ಯದಲ್ಲಿ ಒತ್ತಡ ಉಂಟಾಗುವುದು. ಇದಲ್ಲದೆ, ನಾಗರಿಕರು ದೃಡೀಕರಣಗೊಳ್ಳ ಬೇಕಾಗಿರುವ ತಮ್ಮ ದಾಖಲಾತಿಗಳನ್ನು ಇಲಾಖೆಗಳಿಗೆ ಖುದ್ದಾಗಿ ತಲುಪಿಸ ಬೇಕಾಗಿದೆ.

ಆಧಿಕಾರಿಗಳಿಗೆ ಇಂತಹ ದಾಖಲಾತಿಗಳು ಸಲ್ಲಿಸಲ್ಪಟ್ಟಲ್ಲಿ, ಅವುಗಳ ನೈಜತೆಯನ್ನು ಪರೀಕ್ಷಿಸಲು, ಮೂಲ ಪ್ರತಿಗಳನ್ನು ಅಧಿಕಾರಿಗಳು ಪರೀಕ್ಷಿಸುವುದು ಅನಿವಾರ್ಯವಾಗಿದೆ. ಇದಕ್ಕಾಗಿ ಆ ಪ್ರತಿಗಳನ್ನು ಕಛೇರಿಗೆ ಹಾಜರು ಪಡಿಸಲು ಸೂಚಿಸುವುದರಿಂದ, ಸರ್ಕಾರಿ ಅಧಿಕಾರಿಗಳಿಗೆ ಅನಗತ್ಯ ಕಾರ್ಯದ ಒತ್ತಡ ಮತ್ತು ನಾಗರಿಕರಿಗೆ ಕಿರುಕುಳ ಮತ್ತು ದೃಡೀಕೃತ ಪ್ರತಿಗಳನ್ನು ಪಡೆಯಲು ವಿಳಂಬ ಉಂಟಾಗುವುದು.

ಇ-ದೃಡೀಕರಣ ಪೋರ್ಟಲ್ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ತೊಂದರೆಗಳನ್ನು ನಿವಾರಿಸುವ ಉದ್ದೇಶ ಹೊಂದಿದೆ :

ನಕಲು ಪ್ರತಿ ದಾಖಲೆಗಳನ್ನು ಇಂಕ್ / ಸಹಿಯ ಮೂಲಕ ದೃಡೀಕರಿಸುವ ಬದಲು, ಇ-ಸಹಿ (ಆಧಾರ್ ಸೌಲಭ್ಯದ ಮೂಲಕ) ಮಾಡಬಹುದಾಗಿದೆ. ಇದರಲ್ಲಿ ಸಹಿಯನ್ನು ಪಿಕೆಐ (PKI - Public Key Infrastructure) ಬಳಸಿ ಮಾಡಲಾಗುವುದು. ಐಟಿ ಕಾಯಿದೆ 2000 ದಲ್ಲಿ ಇ-ಸಹಿಯು ಕೈಯಿಂದ ಮಾಡಿರುವ ಸಹಿಗೆ ಸಮನಾಗಿದೆ ಎಂದು ಗುರುತಿಸಲ್ಪಟ್ಟಿದೆ.

1. ಇದು ವೆಬ್ ಆಧಾರಿತ ಪೋರ್ಟಲ್ ಹೊಂದಿದ್ದು, ನಾಗರಿಕರು ಸಲ್ಲಿಸುವ ದೃಡೀಕರಣಗೊಳ್ಳಬೇಕಾದ ಪ್ರತಿಗಳ ನೈಜತೆಯನ್ನು ಯಾವುದೇ ಭೌತಿಕ ಪ್ರತಿಗಳ ವಿನಿಮಯ ಇಲ್ಲದೆ ಪರೀಕ್ಷಿಸಬಹುದಾಗಿದೆ.

2. ಅಂತರ್ಜಾಲದ ಮೂಲಕವೂ ದೃಡೀಕರಣಗೊಂಡಿರುವ ಪ್ರತಿಯ ನೈಜತೆಯನ್ನು ತ್ವರಿತವಾಗಿ ಪರಿಶೀಲಿಸಬಹುದಾಗಿದೆ. 3. ಈ ತಂತ್ರಾಶವು ಬ್ಲಾಕ್ ಚೈನ್ ತಂತ್ರಜ್ಞಾನವನ್ನು ಒಳಗೊಂಡಿದೆ. ನಾಗರಿಕರು ಸಲ್ಲಿಸುವ ಮಾಹಿತಿಯನ್ನು ವಿಸ್ತøತ ಮತ್ತು ತಪ್ಪು ಸಹಿಷ್ಣು ರೀತಿಯಲ್ಲಿ ಸಂಗ್ರಹಿಸುವುದರಿಂದ, ವಿರೂಪ ಮುಕ್ತ ವ್ಯವಸ್ಥೆಯನ್ನು ನೀಡಲು ಸಾಧ್ಯವಾಗುವುದು.

4. ದೃಡೀಕೃತ ಪ್ರತಿಗಳನ್ನು ಡೌನ್ ಲೋಡ್ ಮಾಡಿ ಮುದ್ರಿಸಬಹುದಾಗಿದೆ ಹಾಗೂ ಇವುಗಳನ್ನು ಅಧಿಕಾರಿಗಳು ಅಥವಾ ನಾಗರಿಕರು ಸ್ವಂತವಾಗಿ ಸಂಗ್ರಹಿಸಬಹುದಾಗಿದೆ.

5. ಇ-ಸಹಿ ಹೊಂದಿರುವ ದಾಖಲೆಗಳನ್ನು ನಾಗರಿಕರಿಗೆ ಇ-ಮೇಲ್ ಮೂಲಕ ಕಳುಹಿಸಬಹುದಾಗಿದೆ ಮತ್ತು ಡಿಜಿಲಾಕರ್ ಖಾತೆಯಲ್ಲಿಯೂ ನಾಗರಿಕರಿಗೆ ಇವು ಲಭ್ಯವಿರುತ್ತವೆ.

6. ದಾಖಲೆಗಳು ಪರಿಶೀಲನೆಗೊಂಡು ಇ-ದೃಡೀಕರಣ ವ್ಯವಸ್ಥೆಯಲ್ಲಿ ದೃಡೀಕರಣಗೊಂಡ ನಂತರ, ದೃಡೀಕೃತ ಪ್ರತಿಯು ಡಾಟಾ ಬೇಸ್‌ನಲ್ಲಿ ಶಾಶ್ವತವಾಗಿ ಉಳಿಯುವುದು. ದೃಡೀಕೃತ ಪ್ರತಿಯನ್ನು ಯಾವುದೇ ಬದಲಾವಣೆ / ವಿರೂಪಗೊಳಿಸಲು ಸಾಧ್ಯವಿಲ್ಲದಿರುವುದರಿಂದ, ಇವು ಯಾವಾಗಲೂ ಮಾನ್ಯತೆಯನ್ನು ಹೊಂದಿರುತ್ತವೆ.

7. ದೃಡೀಕರಣಗೊಂಡಿರುವ ಗಣಕೀಕೃತ ದಾಖಲೆಗಳನ್ನು ಹಲವಾರು ಬಾರಿ ಉಪಯೋಗಿಸಬಹುದಾಗಿದೆ. ಆದ್ದರಿಂದ ಈ ಆದೇಶ.

ನಾಗರಿಕರು ತಮ್ಮ ತಮ್ಮ ದಾಖಲೆಗಳನ್ನು ದೃಡೀಕರಿಸಿಕೊಳ್ಳುವಲ್ಲಿ ಯಾವುದೇ ತೊಂದರೆ ಅನುಭವಿಸಬಾರದು ಎನ್ನುವ ಉದ್ದೇಶದಿಂದ ಸರ್ಕಾರವು, ರಾಜ್ಯ ಸರ್ಕಾರದ ಯಾವುದೇ ಇಲಾಖೆಗಳು ದೃಡೀಕೃತ ಪ್ರತಿಗಳನ್ನು ಹೊಂದಲು ಇಚ್ಛಿಸಿದಲ್ಲಿ, ಇ-ದೃಡೀಕರಣ ಪೋರ್ಟಲ್ ಮೂಲಕ ದೃಡೀಕರಣ ಗೊಂಡಿರುವ ದಾಖಲಾತಿಗಳು ನಾಗರಿಕರಿಂದ ಸಲ್ಲಿಕೆಯಾದಲ್ಲಿ ಅವುಗಳನ್ನು ಮಾನ್ಯ ಮಾಡಬಹುದು ಎಂದು ಆದೇಶಿಸಲು ಹರ್ಷಿಸುತ್ತದೆ.

ಇಲಾಖಾ ಮುಖ್ಯಸ್ಥರು ತಮ್ಮ ಅಧೀನದ ಎಲ್ಲಾ ಅಧಿಕಾರಿ ಮತ್ತು ಸಿಬ್ಬಂದಿಗೆ ಈ ಬಗ್ಗೆ ಮಾಹಿತಿ ನೀಡುವುದು. ಇಲಾಖೆಗಳು ದೃಡೀಕರಣಗೊಂಡಿರುವ ಭೌತಿಕ ಪ್ರತಿಗಳನ್ನೂ ಸಹ ಮುಂದಿನ ಆದೇಶದವರೆವಿಗೆ ಅಂಗೀಕರಿಸುವುದನ್ನು ಮುಂದುವರೆಸಬಹುದಾಗಿದೆ.

ಸಂಬಂಧಿತ ಇಲಾಖೆಗಳ ಮುಖ್ಯಸ್ಥರು ಈ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಅನುಸರಣಾ ಪಾಲನೆಯನ್ನು ಖಚಿತಪಡಿಸಿಕೊಳ್ಳುವುದು.

Sub : Use of e-Attestation portal for verifying true copies of documents.

Preamble:

Government of Karnataka has been working towards the use of IT systems to ease delivery of services to citizens. One major impediment to this objective has been the necessity of submitting either an original document or a true certified copy of the original for availing Government services. It is felt that the citizen will benefit if the documents can be attested digitally by an officer and then used multiple times as a soft copy. with the use of new advances in technology like block chain etc. it is possible to have a secured and reliable platform for online attestation.

With this objective in mind, an online portal has been created at http://eattest.karnataka.gov.in, which will allow Gazetted officers employed with the Government of Karnataka (Central services, Group A and select Group B) to verify and attest documents online. This platform uses the strengths of Aadhaar based e-Sign and Blockchain to create a trustable and secured platform for managing electronic attestations or simply e-attestations.

The current manual process requires the citizen to seek help of a Gazetted officer, for creating a true certified paper copy. This is required each time he/she wishes to apply for any such service, which requires attested copies. This requires an unnecessary effort on part of the individual as he/she has to repeat the process each time such services are sought. Further, it adds on to the work burden of the attesting officer, who finds it difficult to validate the identity of the requestor. Also such attested documents necessarily have to be delivered physically by the citizen to the Department who requires such documents.

For the authorities to whom such attested documents are submitted, there is no alternative process to verify the authenticity of such submitted documents other than physically calling the original document and checking it again. This results in unnecessary work for Government officials and harassment and delay to citizens.

The e-Attestation portal, proposes to solve the above mentioned problems in the following ways

a. Instead of an Ink signing/stamping for attesting a document, e sign(using Adhaar Infrastructure) would be used where signing is done digitally using PKI (Public Key Infrastructure).This is recognized as a valid signature on par with physical signature as per the IT act ,2000.

b. It has a web based portal for verifying the authenticity of the attestation on attested document submitted by citizen to the concerned department without any exchange of physical copy of the documents taking place.

c. The authenticity of the attested document can be verified instantly by the requesting department on Internet .

d. The application uses blockchain technology to store the information provided by the citizens which will ensures that the data is stored in a distributed and in fault tolerant manner and would provide tamper proof system.

e. The attested document can be downloaded, printed or stored locally by the officer and the citizen.

f. The e-attested document is sent to the citizen through email and is available in the citizens Digilocker account.

g. Once a document is verified and attested by the e-Attestation system, attested document will remain in database for perpetuity. The document remains valid forever and any modification/tampering would not be possible.

h. Once attested the digital document can be used multiple number of times by sharing.

GOVERNMENT ORDER NO. DPAR 71 EGM 2018 BENGALURU, DATED: 13th July 2018.

In order to ensure that citizens do not face difficulty in getting the documents attested the Government is pleased to order that wherever attested document is desired by any of the departments of the State Government, documents e-attested through the e-attestation portal shall be considered valid form of submission of those documents. Heads of the departments shall ensure that officers and staff are informed accordingly. However, the departments can continue to accept the attested documents in hardcopy as well till further orders.

Concerned Head of the Departments should ensure compliance to the above protocol.

ಓದಲಾಗಿದೆ :

1. ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ: ಐಡಿಡಿ 78 ಐಟಿಎಸ್ 2009, ದಿನಾಂಕ : 09.12.2009.

ಪ್ರಸ್ತಾವನೆ:

ಮೇಲಿನ ಕ್ರಮ ಸಂಖ್ಯೆ (1) ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ತದಡಿ ಬಂದರು ಯೋಜನೆಯ ಅನುಷ್ಠಾನವನ್ನು ಕೈಗೊಳ್ಳಲು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಕೈಗಾರಿಕಾ ಮತ್ತು ಮೂಲಸೌಲಭ್ಯ ಅಭಿವೃದ್ಧಿ ನಿಗಮ ನಿಯಮಿತವನ್ನು (ಕೆಎಸ್ಐಐಡಿಸಿ) ನೋಡಲ್ ಸಂಸ್ಥೆಯಾಗಿ ನೇಮಕ ಮಾಡಲಾಗಿತ್ತು. ಸದರಿ ಯೋಜನೆಯನ್ನು ಅನುಷ್ಠಾನಗೊಳಿಸಲು ಒಂದು ಎಸ್.ಪಿ.ವಿ. (Special Purpose Vehicle)ಯನ್ನು ಕೆಎಸ್ಐಐಡಿಸಿಯವರಿಂದ ರಚಿಸಲಾಗಿತ್ತು. ತದಡಿ ಬಂದರು ಯೋಜನೆಯ ವಿವರವಾದ ಯೋಜನಾ ವರದಿಯನ್ನು ತಯಾರಿಸಲಾಗಿದ್ದು, ಕೇಂದ್ರ ಸರ್ಕಾರದ ಪರಿಸರ, ಅರಣ್ಯ ಮತ್ತು ಹವಾಮಾನ ಬದಲಾವಣೆ ಇಲಾಖೆಯಿಂದ ಹಂತ-1ರ ಒಪ್ಪಿಗೆ (clearance) ಪಡೆಯುವ ಪ್ರಕ್ರಿಯೆಯನ್ನು ಕೈಗೊಳ್ಳಲಾಗುತ್ತಿದೆ.

2. ಕ್ರಮ ಸಂಖ್ಯೆ (2) ರಲ್ಲಿ ಓದಲಾದ ಕೆಎಸ್ಐಐಡಿಸಿಯವರ ಪತ್ರದ ಮುಖಾಂತರ ಕೆಳಕಂಡಂತೆ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

ಅ. ಕರ್ನಾಟಕದ ಪಶ್ಚಿಮ ಕರಾವಳಿಯು 300 ಕಿ.ಮಿ ಉದ್ದವಿದ್ದು, ಅದರ ಪಶ್ಚಿಮ ಭಾಗದಲ್ಲಿ ನ್ಯೂ ಮಂಗಳೂರು ಬಂದರು ಮತ್ತು ಉತ್ತರ ಭಾಗದಲ್ಲಿ ಕಾರವಾರ ಬಂದರು (Naval Base) ಹೊಂದಿರುತ್ತದೆ. ಇದಲ್ಲದೇ ಕಾರವಾರ ಕಿರು ಬಂದರು ಅಭಿವೃದ್ಧಿಯನ್ನು ಪಡಿಸಲು ಯೋಜಿಸಲಾಗಿದೆ.

ಆ. ನ್ಯೂ ಮಂಗಳೂರು ಬಂದರು ಹೊರತಾಗಿ ಎಲ್ಲಾ ಕಿರು ಬಂದರುಗಳು ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆಯ ಆಡಳಿತವ್ಯಾಪ್ತಿಗೆ ಒಳಪಟ್ಟಿರುತ್ತವೆ. ಕೆಲವು ಬಂದರುಗಳನ್ನು ಕ್ಯಾಪ್ಟಿವ್ ಬಂದರು ನೀತಿಯಡಿ ಮತ್ತು ಪಾವಿನಕುರ್ವೆ ಬಂದರನ್ನು ಸ್ವೀಸ್ ಚ್ಯಾಲೆಂಜ್ ಮಾದರಿಯಲ್ಲಿ ಅಭಿವೃದ್ಧಿಗೊಳಿಸಲಾಗುತ್ತಿದೆ.

ಇ. ಪಶ್ಚಿಮ ಘಟ್ಟಗಳು ಇರುವುದರಿಂದ ಹಾಗೂ ರೈಲು ಮಾರ್ಗ ಇಲ್ಲದಿರುವುದರಿಂದ ಈ ಬಂದರುಗಳಿಂದ ಕರ್ನಾಟಕದ ಒಳನಾಡಿಗೆ ಸರಕುಗಳನ್ನು ಸಾಗಿಸುವುದು ದುಸ್ತರವಾಗಿರುತ್ತದೆ. ಕಬ್ಬಿಣದ ಅದಿರು, ಕಲ್ಲಿದ್ದಲು, ರಸಗೊಬ್ಬರಗಳ ಸಾಗಣೆಯು ಈ ಬಂದರುಗಳಿಂದ ಅಧಿಕ ಪ್ರಮಾಣದಲ್ಲಿ ಕೈಗೊಳ್ಳಲಾಗುವುದಿಲ್ಲ. ಹುಬ್ಬಳ್ಳಿ – ಅಂಕೂಲಾ ರೈಲು ಮಾರ್ಗದ ಯೋಜನೆಯ ಪರಿಸರ ತೆರವು ಪ್ರಕ್ರಿಯೆಯು ಕೇಂದ್ರ ಸರ್ಕಾರದ ಪರಿಸರ, ಅರಣ್ಯ ಮತ್ತು ಹವಾಮಾನ ಬದಲಾವಣೆ ಇಲಾಖೆಯಿಂದ ನಿರೀಕ್ಷಿಸಲಾಗಿದೆ. ಹುಬ್ಬಳ್ಳಿ – ಅಂಕೂಲಾ ರೈಲು ಮಾರ್ಗವನ್ನು ನಿರ್ಮಿಸಿದರೂ ಈ ಭಾಗದಲ್ಲಿ ಒಂದು ಬಂದರು ಯೋಜನೆಯ ಅವಶ್ಯಕತೆ ಮಾತ್ರ ಕಂಡುಬರುತ್ತದೆ.

ಈ. ಬಿಳಿಕೇರಿ ಬಂದರು ಯೋಜನೆಯನ್ನು ಕೇಂದ್ರ ಸರ್ಕಾರದ ಸಾಗರಮಾಲಾ ಯೋಜನೆಯಡಿ ಕೈಗೆತ್ತಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಿದೆ.

ಮೇಲ್ಕಂಡ ವಿವರಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಬಂದರು ವಿಷಯದ ಬಗ್ಗೆ ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆಯಿಂದ ಬಂದರುಗಳ ಬೇಡಿಕೆ, ಸಾಮರ್ಥ್ಯ ಹಾಗೂ ಅನುಕೂಲಗಳ ಬಗ್ಗೆ ಪರಿಶೀಲಿಸಿ, ತದಡಿ ಬಂದರು ಯೋಜನೆಯ ಅನುಷ್ಠಾನವನ್ನು ಕೈಗೊಳ್ಳಬಹುದಾಗಿದೆ.

ಆದುದರಿಂದ, ತದಡಿ ಬಂದರು ಯೋಜನೆಯ ಅನುಷ್ಠಾನವನ್ನು ಲೋಕೋಪಯೋಗಿ, ಬಂದರು ಮತ್ತು ಒಳನಾಡು ಜಲಸಾರಿಗೆ ಇಲಾಖೆಯ ಆಡಳಿತವ್ಯಾಪ್ತಿಗೆ ನೀಡುವುದು ಸೂಕ್ತವಾಗಿರುತ್ತದೆಯೆಂದು ಪ್ರಸ್ತಾಪಿಸಲಾಗಿದೆ.

3. ಕೆಎಸ್ಐಐಡಿಸಿ ಸಂಸ್ಥೆಯವರು ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿದ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಗಿನಂತೆ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ.

ಮೇಲೆ ಓದಲಾದ (1)ರಲ್ಲಿ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ದಿನಾಂಕ:30.04.2003ರಲ್ಲಿ ಉತ್ತರ ಕನ್ನಡ ಜಿಲ್ಲೆ, ಕುಮಟಾ ತಾಲ್ಲೂಕು, ಗೋಕರ್ಣ ಶ್ರೀ ಮಹಾಬಲೇಶ್ವರ ದೇವಾಲಯವನ್ನು ಅಧಿಸೂಚಿತ ಸಂಸ್ಥೆಗಳ ಪಟ್ಟಿಯ ಪುಟ ಸಂಖ್ಯೆ:734 ಕ್ರಮ ಸಂಖ್ಯೆ:92ರಲ್ಲಿ ಪ್ರಕಟಗೊಂಡಿರುತ್ತದೆ.

ಮೇಲೆ ಓದಲಾದ (2)ರಲ್ಲಿ ಕರ್ನಾಟಕ ಹಿಂದೂ ಧಾರ್ಮಿಕ ಸಂಸ್ಥೆಗಳು ಮತ್ತು ಧರ್ಮಾದಾಯ ದತ್ತಿಗಳ ಅಧಿನಿಯಮ 1997ರ ಸೆಕ್ಷನ್ 1(4)(i) ರ ಪ್ರಕಾರ "ಒಂದು ಮಠಕ್ಕೆ ಅಥವಾ ಅದಕ್ಕೆ ಸೇರಿದ ಒಂದು ದೇವಸ್ಥಾನಕ್ಕೆ ಈ ಕಾಯ್ದೆಯು ಅನ್ವಯಿಸತಕ್ಕದ್ದಲ್ಲ" ಎಂದಿರುವುದರಿಂದ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಕಂಇ 77 ಮುಸೇವಿ 2003, ದಿನಾಂಕ:30.4.2003 ರಲ್ಲಿನ ಉತ್ತರ ಕನ್ನಡ ಜಿಲ್ಲೆ, ಕುಮಟಾ ತಾಲ್ಲೂಕಿನ ಅಧಿಸೂಚಿತ ಸಂಸ್ಥೆಗಳ ಪಟ್ಟಿಯ ಪುಟ ಸಂಖ್ಯೆ 734 ಕ್ರಮ ಸಂಖ್ಯೆ 92 ರಲ್ಲಿನ ಉತ್ತರ ಕನ್ನಡ ಜಿಲ್ಲೆ, ಕುಮಟಾ ತಾಲ್ಲೂಕು, ಗೋಕರ್ಣ ಶ್ರೀ ಮಹಾಬಲೇಶ್ವರ ದೇವಸ್ಥಾನ ಮತ್ತು ಅದರ ಪರಿವಾರ ದೇವರುಗಳ ದೇವಸ್ಥಾನಗಳನ್ನು ಅಧಿಸೂಚಿತ ಸಂಸ್ಥೆಗಳ ಪಟ್ಟಿಯಿಂದ ಹೊರತುಪಡಿಸಿ ಆದೇಶಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ ಓದಲಾದ (3)ರಲ್ಲಿ ಸರ್ಕಾರದ ದಿನಾಂಕ:12.08.2008ರ ಆದೇಶವನ್ನು ಪ್ರಶ್ನಿಸಿ, ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಸಾರ್ವಜನಿಕರು, ಭಕ್ತಾದಿಗಳು ಹಾಗೂ ಗೋಕರ್ಣ ಶ್ರೀ ಮಹಾಬಲೇಶ್ವರ ದೇವಾಲಯದ ಆಡಳಿತವನ್ನು ಬಿ,ಪಿ,ಟಿ. ಕಾಯ್ದೆಯಡಿಯಲ್ಲಿ ನಿರ್ವಹಿಸುತ್ತಿದ್ದ ಮೊಕ್ತೇಸರರ ವಾರಸುದಾರರು ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಹಲವಾರು ರಿಟ್ ಅರ್ಜಿಗಳನ್ನು (ರಿಟ್ ಅರ್ಜಿ ಸಂ:30609/2008 ಹಾಗೂ ಇತರ ರಿಟ್ ಅರ್ಜಿಗಳು) ದಾಖಲ್ಮಾಡಿದ್ದು, ಸದರಿ ರಿಟ್ ಅರ್ಜಿಗಳನ್ನು ಒಟ್ಟುಗೂಡಿಸಿ, ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ವಿಭಾಗೀಯ ಪೀಠವು ದಿನಾಂಕ:10.08.2018ರಂದು ಇತ್ಯರ್ಥ ಪಡಿಸಿ ಸರ್ಕಾರದ ಪ್ರಶ್ನಿತ ಆದೇಶ ದಿನಾಂಕ:12.08.2008 ಅನ್ನು ರದ್ದುಪಡಿಸಿರುತ್ತದೆ ಹಾಗೂ ಪ್ರಶ್ನಿತ ಸದರಿ ದೇವಸ್ಥಾನದ ಆಡಳಿತ ನಿರ್ವಹಣೆಗಾಗಿ ಜಿಲ್ಲಾಧಿಕಾರಿ, ಉತ್ತರ ಕನ್ನಡ ಜಿಲ್ಲೆ ಇವರ ಅಧ್ಯಕ್ಷತೆಯಲ್ಲಿ ಜಿಲ್ಲಾ ಪೊಲೀಸ್ ಅಧೀಕ್ಷಕರು ಹಾಗೂ ಉಪ ವಿಭಾಗಾಧಿಕಾರಿ, ಕುಮಟ ಉಪವಿಭಾಗ ಇವರುಗಳನ್ನೊಳಗೊಂಡ ಮೇಲ್ವಿಚಾರಣಾ (Overseeing Committee) ಸಮಿತಿಯನ್ನು ರಚಿಸಿರುತ್ತದೆ ಹಾಗೂ ಸದರಿ ಸಮಿತಿಗೆ ದೇವಸ್ಥಾನದ ಉಪಾಧಿವಂತ ಮಂಡಳಿಯಿಂದ ಇಬ್ಬರು ಸದಸ್ಯರನ್ನು ಜಿಲ್ಲಾಧಿಕಾರಿಯವರು ಸರ್ಕಾರದ ಸಮಾಲೋಚನೆಯೊಂದಿಗೆ ನಾಮನಿರ್ದೇಶನ ಮಾಡುವಂತೆ ಹಾಗೂ ಇಬ್ಬರು ಗಣ್ಯವ್ಯಕ್ತಿಗಳು/ ವಿದ್ವಾಂಸರುಗಳನ್ನು ಸರ್ಕಾರವು ಉಸ್ತುವಾರಿ ಸಮಿತಿಗೆ ಸದಸ್ಯರನ್ನಾಗಿ ನಾಮನಿರ್ದೇಶನ ಮಾಡುವಂತೆ ನಿರ್ದೇಶನ ನೀಡಿರುತ್ತದೆ ಹಾಗೂ೮೯೪ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಅಕ್ಟೋಬರ್ ೨೫, ೨೦೧೮ ಭಾಗ ೧ ಸದರಿ ಮೇಲ್ಚಿಚಾರಣಾ ಸಮಿತಿಗೆ ಸಲಹೆಗಾರರನ್ನಾಗಿ ಮಾನ್ಯ ಸರ್ವೋಚ್ಛ ನ್ಯಾಯಾಲಯದ ನಿವೃತ್ತ ನ್ಯಾಯಮೂರ್ತಿಗಳಾದ ಶ್ರೀ ಬಿ.ಎನ್. ಶ್ರೀಕೃಷ್ಣ ರವರನ್ನು ನೇಮಕ ಮಾಡಿರುತ್ತದೆ.

ಮುಂದುವರೆದು ಸದರಿ ಅಂತಿಮ ತೀರ್ಪಿನ ಘೋಷಣೆ ನಂತರ ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯವು ಈ ಕೆಳಗಿನಂತೆ ಮಧ್ಯಂತರ ಆದೇಶವನ್ನು ನೀಡಿರುರತ್ತದೆ:-

"After pronouncement of order, learned Senior Counsel appearing for respondents sought stay of the order passed by this Court.

The same has, however, been opposed by the learned Senior Counsel as well as other Counsel appearing for the petitioners.

Although, we have directed that the arrangement by way of Constitution of a Committee known as "Overseeing Committee"

be made forthwith, having regard to the submissions made by learned Senior Counsel for the Petitioners, we direct that the arrangement

with regard to constitution of Overseeing Committee would take effect from 10th September, 2018."

ಮೇಲೆ ಓದಲಾದ (4)ರಲ್ಲಿ ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ದಿನಾಂಕ:10.08.2018ರ ತೀರ್ಪಿನ ವಿರುದ್ದ ಶ್ರೀ ರಾಮಚಂದ್ರಪುರ ಮಠದವರು ಮಾನ್ಯ ಸರ್ವೋಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ದಾಖಲಿಸಿರುವ ಎಸ್.ಎಲ್.ಪಿ. ಸಂಖ್ಯೆ:24015-20/2018 ರಲ್ಲಿ ದಿನಾಂಕ:07.09.2018ರಂದು ಈ ಕೆಳಕಂಡಂತೆ ಮಧ್ಯಂತರ ಆದೇಶವನ್ನು ನೀಡಲಾಗಿರುತ್ತದೆ;

"Issue notice, fixing a returnable date within eight weeks."

The interim order passed by the High Court on 10.08.2018 after pronouncement of the final

judgment shall continue, in the meantime."

ಮೇಲೆ ಓದಲಾದ (5)ರಲ್ಲಿ ಆಯುಕ್ತರು, ಧಾರ್ಮಿಕ ದತ್ತಿ ಇಲಾಖೆ ಇವರ ಪತ್ರಗಳಲ್ಲಿ, ಪ್ರಸ್ತಾಪಿತ ದೇವಾಲಯವನ್ನು ಶ್ರೀ ರಾಮಚಂದ್ರಾಪುರ ಮಠದ ವತಿಯಿಂದ ಸರ್ಕಾರದ ವಶಕ್ಕೆ ಹಿಂಪಡೆಯುವ ಕುರಿತು ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದ ದಿನಾಂಕ:10.08.2018ರ ಅಂತಿಮ ತೀರ್ಪಿನ ಘೋಷಣೆಯ ನಂತರ ನೀಡಿರುವ ಮಧ್ಯಂತರ ಆದೇಶ ಹಾಗೂ ಮಾನ್ಯ ಸರ್ವೋಚ್ಛ ನ್ಯಾಯಾಲಯ ನೀಡಿರುವ ದಿನಾಂಕ:07.09.2018ರ ಮಧ್ಯಂತರ ಆದೇಶದ ಹಿನ್ನಲೆಯಲ್ಲಿ ಕೈಗೊಳ್ಳಬೇಕಾದ ಕ್ರಮದ ಕುರಿತು ಕೆಲವೊಂದು ಅಂಶಗಳ ಬಗ್ಗೆ ಮಾನ್ಯ ಅಡ್ವೋಕೇಟ್ ಜನರಲ್ ಇವರಿಂದ ಕಾನೂನು ಅಭಿಪ್ರಾಯವನ್ನು ಪಡೆದು ಸರ್ಕಾರದ ಸೂಕ್ತ ನಿರ್ದೇಶವನ್ನು ನೀಡುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

ಮೇಲೆ ಓದಲಾದ (6)ರಲ್ಲಿ ಮಾನ್ಯ ಅಡ್ವೋಕೇಟ್ ಜನರಲ್ ಇವರು ಈ ಕೆಳಕಂಡಂತೆ ಅಭಿಪ್ರಾಯವನ್ನು ನೀಡಿರುತ್ತಾರೆ:-

"The High Court of Karnataka as per its order dated:10.08.2018 passed in Writ Petition No.30609/2008 and connected Writ Petition has quashed the Government Order dated:12.08.2008 whereby the management of Gokarna temple was transferred to Sri Ramachandrapura Mutt and has further held that Gokarna Temple shall continue to be included in the list of notified institutions as per Section 23 of the Hindu Religious & Charitable Endowment Act, 1997. The High Court has directed constitution of a Committee to be known as 'Overseeing Committee' under the Chairmanship of the Deputy Commissioner, Uttara Kannada District and has directed that the Committee shall ensure that the traditions of the temple are maintained, amenities and facilities are provided to the devotees and the Upadivantas/ Archaks are accredited.

On 10.08.2018 after the above order was passed, on an application filed by the Respondents, the Hon'ble High Court directed that the arrangements with regard to the constitution of the overseeing committee would take effect from 10th September, 2018. The Hon'ble High Court also directed to the Deputy Commissioner of U.K. district, to make an inventory of all the movable and immovable assets within a period of two weeks from the date of the said order.

The Respondents in the Writ Petition filed a Special Leave Petition before the Hon'ble Supreme Court of India.

The Supreme Court has not stayed the order passed by the High Court. Per contra the Supreme Court by its order dated:07.09.2018 has directed that the interim order passed by the High Court on 10.08.2018 shall continue. The resultant position is that the interim order of the High Court dated:10.08.2018 holds the field. As per the said interim order the Overseeing Committee is to take effect from 10.09.2018, meaning thereby that the Overseeing Committee shall ensure that the traditions of the temple are maintained, amenities and facilities are provided to the devotees and the Upadivantas / Archaks are accredited. This order of the High Court has to be implemented."

ಮೇಲ್ಕಂಡ ಎಲ್ಲಾ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಸರ್ಕಾರವು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಉತ್ತರ ಕನ್ನಡ ಜಿಲ್ಲೆ, ಕುಮಟಾ ತಾಲ್ಲೂಕು, ಗೋಕರ್ಣ ಶ್ರೀ ಮಹಾಬಲೇಶ್ವರ ದೇವಾಲಯ ಮತ್ತು ಅದರ ಪರಿವಾರ ದೇವರುಗಳ ದೇವಾಲಯವನ್ನು ಅಧಿಸೂಚಿತ ಸಂಸ್ಥೆಗಳ ಪಟ್ಟಿಯಿಂದ ಹೊರತುಪಡಿಸಿ, ದೇವಾಲಯದ ಸಂಪೂರ್ಣ ಆಡಳಿತವನ್ನು ಶಿವಮೊಗ್ಗ ಜಿಲ್ಲೆ, ಹೊಸನಗರ ತಾಲ್ಲೂಕು, ಶ್ರೀ ರಾಮಚಂದ್ರಾಪುರ ಮಠಕ್ಕೆ ಹಸ್ತಾಂತರಿಸಲಾಗಿದ್ದ ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ:ಕಂಇ 56 ಮುಆಬಿ 2008,ಭಾಗ ೧ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಅಕ್ಟೋಬರ್ ೨೫, ೨೦೧೮ ೮೯೫ ದಿನಾಂಕ:12.08.2008ರ ಆದೇಶವನ್ನು ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ:30609/2008 ಹಾಗೂ ಇತರ ಪ್ರಕರಣಗಳನ್ನು ಒಟ್ಟುಗೂಡಿಸಿ ನೀಡಿರುವ ದಿನಾಂಕ:10.08.2018ರ ತೀರ್ಪಿನನ್ವಯ ರದ್ದುಪಡಿಸಿರುವುದರಿಂದ ಪ್ರಸ್ತಾಪಿತ ದೇವಾಲಯವು ಅಧಿಸೂಚಿತ ಸಂಸ್ಥೆಯಾಗಿ ಮುಂದುವರೆದಿರುತ್ತದೆ.

ಅಲ್ಲದೆ ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ದಿನಾಂಕ:10.08.2018ರ ತೀರ್ಪಿಗೆ ಮಾನ್ಯ ಸರ್ವೋಚ್ಚ ನ್ಯಾಯಾಲಯವು ತಡೆಯಾಜ್ಞೆ ನೀಡದೆ ಇರುವುದರಿಂದ, ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ದಿನಾಂಕ:10.08.2018ರ ಅಂತಿಮ ತೀರ್ಪು ಮತ್ತು ಕರ್ನಾಟಕದ ಮಾನ್ಯ ಅಡ್ವೋಕೇಟ್ ಜನರಲ್ ಇವರು ನೀಡಿರುವ ಅಭಿಪ್ರಾಯದಂತೆ, ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯವು ನೇಮಿಸಿರುವ ಮೇಲ್ವಿಚಾರಣಾ ಸಮಿತಿಯು (Overseeing Committee) ಉತ್ತರ ಕನ್ನಡ ಜಿಲ್ಲೆ, ಕುಮಟಾ ತಾಲ್ಲೂಕು, ಗೋಕರ್ಣ ಶ್ರೀ ಮಹಾಬಲೇಶ್ವರ ದೇವಾಲಯ ಮತ್ತು ಅದರ ಪರಿವಾರ ದೇವರುಗಳ ದೇವಾಲಯಗಳ ಸಂಪೂರ್ಣ ಆಡಳಿತವನ್ನು ಸಮಸ್ತ ಚರ-ಸ್ಥಿರ ಆಸ್ತಿಗಳೊಂದಿಗೆ ಶಿವಮೊಗ್ಗ ಜಿಲ್ಲೆ, ಹೊಸನಗರ ತಾಲ್ಲೂಕು, ಶ್ರೀ ರಾಮಚಂದ್ರಾಪುರ ಮಠದಿಂದ ಕೂಡಲೇ ಸರ್ಕಾರದ ವಶಕ್ಕೆ ಪಡೆದು ಆಡಳಿತವನ್ನು ಕರ್ನಾಟಕ ಹಿಂದೂ ಧಾರ್ಮಿಕ ಸಂಸ್ಥೆಗಳು ಮತ್ತು ಧರ್ಮಾದಾಯ ದತ್ತಿಗಳ ಕಾಯ್ದೆ 1997 ಮತ್ತು ತಿದ್ದುಪಡಿ ಅಧಿನಿಯಮ 2011ರ ನಿಯಮಗಳಡಿ ನಿರ್ವಹಿಸಲು ಆದೇಶಿಸಿದೆ.

ಮೇಲೆ ಓದಲಾದ (7)ರ ಆದೇಶದಲ್ಲಿ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕೆಗಳ (ಸೌಲಭ್ಯ) (ತಿದ್ದುಪಡಿ) ಅಧಿನಿಯಮ, 2015ರ ಪರಿಚ್ಛೇದ 3(i)&(ii) ರ ತಿದ್ದುಪಡಿಯನ್ವಯ ರೂ.500 ಕೋಟಿಗಿಂತ ಹೆಚ್ಚಿನ ಬಂಡವಾಳ ಹೂಡಿಕೆಯ ಪ್ರಸ್ತಾವನೆಗಳಿಗೆ ರಾಜ್ಯ ಉನ್ನತ ಮಟ್ಟದ ಒಪ್ಪಿಗೆ ನೀಡಿಕೆ ಸಮಿತಿಯು ಅನುಮೋದನೆಯನ್ನು ನೀಡುವ ಅಧಿಕಾರ ಹೊಂದಿರುತ್ತದೆ. ಸದರಿ ಸಮಿತಿಗೆ ಸನ್ಮಾನ್ಯ ಮುಖ್ಯಮಂತ್ರಿಗಳು ಅಧ್ಯಕ್ಷರಾಗಿದ್ದು, ಮಾನ್ಯ ಬೃಹತ್ ಮತ್ತು ಮಧ್ಯಮ ಕೈಗಾರಿಕೆ ಸಚಿವರನ್ನು ಉಪಾಧ್ಯಕ್ಷರನ್ನಾಗಿ ನೇಮಕ ಮಾಡಿ ಸಮಿತಿಯನ್ನು ಪುನರ್ ರಚಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತುತ, ರಾಜ್ಯದಲ್ಲಿ ಬೃಹತ್ ಮತ್ತು ಮೆಗಾ ಕೈಗಾರಿಕೆಗಳ ಜೊತೆಗೆ ಸಣ್ಣ ಮತ್ತು ಮಧ್ಯಮ ಕೈಗಾರಿಕೆಗಳನ್ನು ಸ್ಥಾಪಿಸಲು ಸಣ್ಣ ಕೈಗಾರಿಕೆ ಇಲಾಖೆಯ ಪಾತ್ರವು ಅತ್ಯಂತ ಮಹತ್ವದ್ದಾಗಿದ್ದು, ಮೇಲ್ಕಂಡ ಸಮಿತಿಗೆ ಸಣ್ಣ ಕೈಗಾರಿಕೆಗಳ ಸಚಿವರ ಪ್ರಾತಿನಿಧ್ಯ ಇರುವುದರಿಂದ, ಸದರಿ ಸಮಿತಿಯನ್ನು ಈ ಕೆಳಕಂಡಂತೆ ಪುನರ್ ರಚಿಸುವುದು ಅವಶ್ಯವಾಗಿರುತ್ತದೆ.

Preamble:

The project proposal of M/s. Anthem Biosciences Pvt. Ltd., to establish a unit for "Manufacture of Organic and In-Organic Compounds" with an investment of `.235.00 crore generating employment for about 590 persons in 10 acres of land at Harohalli Industrial Area, Ramanagara District, was approved in the 39th SHLCC meeting held on 29.08.2015. Accordingly, Government Order read at (2) above was issued. KIADB has issued Allotment letter on 24.01.2018 for 8 acres of land in Plot No: 313-P, 314-P & 318-P of Harohalli, 2nd Phase Industrial Area.

Accordingly Possession Certificate No: IADB/DO-1&EE/21481/75/2018-19, dated: 13.04.2018 was issued.

Now, the Company vide its letter dated: 06.06.2018, requested to extend the approval for extension of time for further two years to implement the project.

Recommendation made during the meeting held under the Chairmanship of Principal Secretary to Government, Commerce and Industries Department on 29.06.2018 :

The representative of the company explained the action taken to implement the project. He informed that possession of land was handed over on 13.04.2018 by KIADB and lease cum sale agreement is issued. They have applied to Commissioner for Industrial Development for issue of Stamp duty exemption certificate to register the lease agreement. He has requested extension of time to implement the project by 2 years.

The effective steps taken by the company is noted in the meeting and after detailed discussions, it was decided in the meeting to recommend to SLSWCC for grant of extension of time by two years to implement the project.

The proposal was examined & approved in the 111th SLSWCC Meeting held on 01.08.2018.

Government has examined the recommendations made by the SLSWCC in all aspects.

Hence the following order.

GOVERNMENT ORDER No. CI 219 SPI 2015, BENGALURU, DATED 03.09.2018

The Government is pleased to approve to grant extension of time by two years to implement the project, with a condition that further request for extension of time to implement the project will not be considered.

Preamble:

State Level Single Window Clearance Committee in its 103rd meeting held on 04.10.2017 has approved the project proposal of M/s. Autoliv India Pvt. Ltd., to establish a unit for manufacture of "Electronic Controlling Unit for Driver less Car comprising of Night vision Sensor, Pedestrain safety system, Passenger Safety System, Primary and Secondary restraint system, Automatic Break Controls, Autonomous Driving, Automated Route (Trained), Automated Highway & City Driving assistance products" with an investment of `.213.00 crore, in 10 acres of land in Plot No.30 in IT Park Area of Hi-tech, Defence and Aerospace Park, Bengaluru. Accordingly, Government Order read at (2) above was issued.

The Company vide its letter dated 17.05.2018 above has stated the following:-

1. KIADB has issued Demand Notice on 03.01.2018 to remit land cost for allotting Plot No. 30 (Corner) measuring 10 acres of land in IT Park Area, Hi-tech, Defence and Aerospace Park.

2. Company has paid `. 8.63 crore to KIADB towards 30% land cost on 02.02.2018 for Plot No.30.

3. KIADB has issued allotment letter No.KIADB/HO/Allot/21758/18392/ 2017-18, dated: 26.02.2018 allotting 9.6 acres of land in Plot No. 25-P2 (IT Sector), Hi-tech, Defence and Aerospace Park.

4. Company represented to KIADB on 02.03.2018 regarding allotment of wrong Plot and less area and requested to allot Plot No.30, instead of Plot No.25-P2, KIADB has issued allotment letter No. KIADB/HO/Allot/21758/19673/ 2017-18 dated: 17.03.2018. In the same time company has received Caveat Petitions being Respondent vide W.P. No.12272/2018 from the Hon'ble High Court filed by M/s Venture Aerospace Components, staying the letter dated: 17.03.2018 of KIADB. Hence, the allotment of Plot No.30 went into litigation.

KIADB has proposed an alternate plot No. 31, 32-P and 33-P which is measured 12 Acres and allotted vide letter KIADB/HO/Allot/21758/934/2018-19 dated: 17.04.2018. Considering the stay order on plot no. 30, and no sight of immediate relief on this plot no. 30, Autoliv management constrained to explore alternate way to meet our project time line and customer deliver. After careful evaluation of the situation, internally and externally Autoliv Management took decision to go for an alternate option as suggested by KIADB to avoid any further delay in project.

Considering the shape of the plot no. 31, 32-P and 33, (part) and company's specific requirement of length and breadth of the plot, along with other technical and layout requirement to place various structures with the available space, it is not possible to do that in 10 acres in proposed alternate plot. Company has requested to 12 acres land to full fill the project requirement. KIADB and issued allotment letter for 12 Acres.

Justifications for additional land requirement:-

1. Specialized and hi-tech crash/sledge test system in their facility for testing purpose, which calls for specific shape and length of the building, to accommodate the desired building layout and hence minimum plot width which increases the area need to 12 acres instead of 10 acres. The additional land will be broadly used & earmarked for factory ,future expansion & area loss due to L shape of plot.

2. Company has four different facility namely testing facility, R & D center, corporate office, assembly unit of primary and secondary restrain systems. Considering the nature of activity each of them to be accommodated in a given format with separate blocks to meet the movement of men, material, Safety and sound & fire proofing.

3. The shape of the plot proposed in plot 31, 32-P and 33 is in L shape, which poses limitations to accommodate factory layout to the optimum level, which is the another reason making it essential to agree for 12 acres instead of 10 acres, which gives the opportunity to place all requirement and future expansion provision.

4. Company will be able to adhere to the criteria of 50% ground coverage as its built up area requirement for manufacturing and testing area are very specific, which are separate blocks in nature.

The company has requested for approval of additional requirement of 2 acres of land allotted by KIADB in Plot Nos. 31, 32-P and 33-P of (IT Park Area), Hi-tech, Defence & Aerospace Park, Devanahalli, Bengaluru with revised cost of project to `. 231.00 crore.

Preamble:

The Proposal of M/s Favorich Infra Pvt. Ltd., to establish a Mega Food Park at Bannenahalli Village, Bookanakere Hobli, Krishnarajpet, Mandya District with an investment of `.99.52 crore in 300 acres of land to be acquired and allotted by KIADB as SUC out of the land notified by KIADB, generating employment to about 2,000 persons was approved in the 27th SHLCC meeting held on 13.04.2012. Accordingly, Government Order read at (2) above was issued.

At the request of company, the amendments for approval to set up a "50 MW Solar Plant", with an additional investment of `.300 crore and extension of time by 2 years to implement the project was placed in the 88th SLSWCC held on 12.01.2016 and approved. Accordingly, Government Order was issued vide Government Order read at (4) above.

The company's request to grant extension of time by 30 months to implement the project running concurrent with GoI approval with a condition that further request for extension of time to implement the project will not be considered was placed in the 108th SLSWCC held on 27.02.2018 and approved. Accordingly, Government Order was issued vide Government Order read at (6) above.

The Company in its letters dated 09.07.2018, 17.07.2018 & 28.07.2018, have submitted that they have taken following effective steps to implement the project & uploaded the documents/informations.

1. Final approval from Ministry of Food Processing Industries (MOFPI), GOI on 22.12.2017 for the Mega Food Park Project.

2. Term loan sanction letter from M/s Union Bank of India for the project.

3. CFE from Karnataka State Pollution Control Board.

4. District Level Single Window Clearance of 7 projects for the Sub-lease.

5. Stamp Duty Exemption and Concessional Charges for Registration Certificate for Sub-lease.

6. Industrial Entrepreneurs Memorandum (IEM) from Government of India.

8. Received approval from drawing 2.5 MLD water from Hemavathi River during rainy season.

9. Received General License obtained from local Gram Panchyathi.

Ltd., to establish "Pet Bottles, Jars and Preforms" in 125 acre of land at Yadgir Industrial Area, Yadgir with an investment of `..489.11 Crores providing employment to 1160 persons was approved in the 27th SHLCC meeting held on 13.04.2012. Accordingly, Government Order read at (2) above was issued.

Further, 38th State High Level Clearance Committee (SHLCC) meeting held on 17.06.2015 has approved the time of extention of period for further two years. Accordingly, Government Order read at (4) above was issued.

Now company vide letter dated 06.10.2017 have submitted the details of action taken to implement the project as follows.

1. Obtained IEM from Government of India vide No. 954/SIA/IMD/2016, dated 03.06.2016.

2. Obtained possession of land on 10.05.2017 from KIADB.

3. Applied for building plan approval from KIADB on 12.06.2018.

4. Technology transfer agreement from Council of Scientific and Industrial Research- North East Institute of Science and Technology (CSIR NEIST), Jorhat, Assam, for lemon grass cultivation.

5. Construction of boundary wall and artificial ponds for Rain Water Harvesting and develop Social forestry all around the park.

Further the company has informed that, since the allotment of land in 2012 infrastructure like Power and water was not provided.

1. Approval to establish Research and Development Centre for essential aromatic oil and setting up Plant Nursery with establishment of essential oil and aromatic oil distillation plant.

State High Level Clearance Committee in its 41st meeting held on 05.10.2015 has approved the project proposal of M/s. Satarem Enterprises Pvt. Ltd., to establish "Municipal Solid Waste Management and Waste to Energy Power Generation" unit with an investment of `..240.00 crore, generating employment to about 300 persons in 30 acres of land at any other suitable location to be identified by KIADB. Accordingly, Government Order read at (2) above was issued.

The Company vide its letter dated: 03.02.2018 has Stated that KIADB yet to allot the land at Chikkahulur / Kamblipura in Hoskote Taluk for establishing the waste to energy project & the validity of approval has expired on 14.10.2017.

Recommendation made during the meeting held under the Chairmanship of Principal Secretary to Government, Commerce and Industries Department on 29.06.2018 :

The representative of the company informed in the meeting that KIADB has so far not allotted land for the project and hence implementation of the project could not be taken up.

CDO, KIADB informed that Hon'ble High Court has stayed the allotment of land at Chikkahulur and the land at Kamblipura is so far not been handed over to the Board by the Special D.C, Land acquisition.

After detailed discussions, it was decided in the meeting to recommend to SLSWCC for grant of extension of time by two years to implement the project.

Government is pleased to accord in-principle approval to the investment proposal of M/s. RGA Infrastructure to establish "IT/ITES SEZ" with an investment of `.144.08 crore generating employment to about 5124 persons at Chikkanahalli Village, Bengaluru East

1. Environment: The company to obtain Consent for Establishment and Consent for Operation from KSPCB and environmental clearance from MoEF, Govt. of India or the Dept of Forest, Ecology & Environment, Govt. of Karnataka, if applicable.

2. Employment: The Company shall comply with the provisions of applicable Policy of the State of Govt. of Karnataka with respect to local employment on the project. Prepare a plan for development of Human Resources required for the project, train local people. A copy of Human Resources Development plan shall be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

3. Vendor Development: Wherever there is scope for vendor development for the project, the company shall prepare a vendor development plan, develop local vendors and procure the required inputs, components and sub-assemblies from these local vendor units. A copy of the vendor development plan shall be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

4. Social Infrastructure Development: The Company is advised to take up social infrastructure development projects in the vicinity of the proposed location of the unit and comply with the stipulation of Company Act 2013. A copy of such projects shall be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

5. Others:

a) The company shall adopt rainwater harvesting, waste water recycling and water conservation techniques. Zero discharge facility should be adopted wherever applicable.

b) The company shall take all statutory and other necessary clearances from the competent authorities including Govt. of India.

ಮತ್ತು ವೇತನದಲ್ಲಿನ ಯಾವುದೇ ಹೆಚ್ಚಳ ಅಥವಾ ಉನ್ನತ ಹುದ್ದೆಗೆ ಮುಂಬಡ್ತಿ ಇತ್ಯಾದಿ ಯಾವುದೇ ಕಾರಣದಿಂದಾಗಿ ಬದಲಾಗತಕ್ಕುದ್ದಲ್ಲವೆಂದು ತಿಳಿಸಲಾಗಿದೆ.

ದಿನಾಂಕ: 01.07.2017 ರಿಂದ ದಿನಾಂಕ: 31.03.2018ರ ಅವಧಿಯಲ್ಲಿ ಮಿತ ಕುಟುಂಬ ಯೋಜನಾ ಕ್ರಮವನ್ನು ಅಳವಡಿಸಿಕೊಂಡ ಪ್ರಕರಣಗಳಲ್ಲಿ ಈ ಯೋಜನೆಯಡಿಯಲ್ಲಿ ವೈಯಕ್ತಿಕ ವೇತನ ರೂಪದಲ್ಲಿ ನೀಡಲಾಗುವ ವಿಶೇಷ ವೇತನ ಬಡ್ತಿಯನ್ನು 2012ರ ವೇತನ ಶ್ರೇಣಿಯ ದರದಲ್ಲಿ ಅಥವಾ 2018ರ ಪರಿಷ್ಕøತ ವೇತನ ಶ್ರೇಣಿಯ ದರದಲ್ಲಿ ಮಂಜೂರು ಮಾಡಬೇಕೆ? ಎಂಬ ಬಗ್ಗೆ ಸ್ಪಷ್ಟೀಕರಣವನ್ನು ಕೋರಲಾಗುತ್ತಿದೆ.

6ನೇ ವೇತನ ಆಯೋಗದ ಶಿಫಾರಸ್ಸಿನಂತೆ ಜಾರಿಗೆ ಬಂದಿರುವ ವೇತನ ಶ್ರೇಣಿಗಳು 01.07.2017 ರಿಂದ ಕಾಲ್ಪನಿಕವಾಗಿ ಜಾರಿಗೆ ಬಂದಿದ್ದು, ವೇತನ ಶ್ರೇಣಿಗಳ ಪರಿಷ್ಕರಣೆಯ ಆರ್ಥಿಕ ಸೌಲಭ್ಯವು 1ನೇ ಏಪ್ರಿಲ್ 2018 ರಿಂದ ಲಭ್ಯವಾಗುತ್ತದೆ. ಅಲ್ಲದೆ, ದಿನಾಂಕ: 01.07.2017 ರಿಂದ 31.03.2018 ರವರೆಗಿನಭಾಗ ೧ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಅಕ್ಟೋಬರ್ ೨೫, ೨೦೧೮ ೯೦೩ ಅವಧಿಗೆ ಪರಿಷ್ಕøತ ಶ್ರೇಣಿಯಲ್ಲಿನ ವೇತನ ನಿಗಧಿಯಿಂದಾಗಿ ಅಥವಾ ಪುನರ್ ನಿಗಧಿಯಿಂದಾಗಿ ವೇತನ ಮತ್ತು ಭತ್ಯೆಗಳ ಮತ್ತು ನಿವೃತ್ತಿ ವೇತನದ ಆರ್ಥಿಕ ಬಾಕಿಗೆ ಯಾವುದೇ ಸರ್ಕಾರಿ ನೌಕರನು ಅರ್ಹನಾಗಿರುವುದಿಲ್ಲ.

Energy Department's U.O. Note vide read at (3) above, informed that out of 2000 MW approved capacity 600 MW Solar Power Project is already implemented. For speedy implementation of the remaining 1400 MW Solar Power Projects action has been initiated.

In this background Energy Department has requested to renes the approval accorded for the Pavagada Solar Parks and extend the project implementation period for further three years.

Hence the following order.

Government is pleased to extend the validity period for approval accorded to M/s. Karnataka Solar Power Development Corporation Ltd., (KSPDCL) to establish "Solar Park" with all the infrastructure facilities for 2000 MW Solar Power Generation with an estimated total investment of around Rs.14,800.00 crore generating employment to about 8,000 persons at Pavagada Taluk, Tumkur District vide Government Order read at (1) above for further period of three years from the date of issue of this order.

All other terms and conditions indicated in the Government Order No. CI 234 SPI 2015, dated 29.10.2015 read at (1) above, remain unaltered.

the Budget 2018-19.

The Hon'ble Chief Minister has announced new scheme "Compete with China" at Para 100 in Budget Speech 2018-19 to increase the production capacity relating to industry in Karnataka.

India has some of the greatest engineering schools and producing a number of highly educated work forces, there are millions of persons who have not undergone formal higher education. Like China, India also has a huge low-skilled population. Low-cost manufacturing requires fewer skills, and any able-bodied person with normal IQ can be trained to work in manufacturing units. The proposal now is to create industrial clusters for producing specific category of goods in various districts of Karnataka.

In view of China's achievement in the area of manufacturing goods like solar power, electrical lightings, bathroom fittings, electronic toys etc., the Hon'ble Chief Minister has proposed to implement "Compete with China" Scheme in Budget 2018-19.

In order to compete with Chinese made goods, spare parts will be manufactured at and assembled in the identified districts at the village level/taluk level and will be marketed domestically and export market will also be explored. To increase human resources as complementary to this scheme, various training programs will be organized.

To implement the above scheme, the following are proposed by the Department:

(i) To procure Knowledge Partner services to assist in conducting detailed studies, formulating strategies and implementation of the program. The purpose of the study is to evaluate the present status and constraints with regard to the product based cluster development in specified districts and to prepare proper strategies & interventions for the same. The study intends to determine the actual field situation in respect of small scale industries including village industries and their problems in respect of inputs, labour and marketing of their output and to determine as to how these problems could be solved or at least minimized through the formation of suitable clusters.

(ii) State Level Steering Committee under the chairmanship of Hon'ble Chief Minister and Vice Chairmanship of Hon'ble Minister for Large & Medium Industries, Hon'ble Minister for SSI, Economic Advisor to Hon'ble Chief Minister, Chief Secretary, concerned ACS/Principal Secretaries/Secretaries, Commissioner for Industrial Development as Member Secretary, Deputy Commissioner, CEO, ZP, CII, KASSIA, FKCCI, other associations etc., will be constituted to deliberate on the suggestions provided by the Vision Groups/Program Mission Units and District Level Steering Committees and will work out the broad strategy of the scheme implementation.

(iii) Nine Sectoral "Vision Groups / Program Mission Units" headed by industry leader of the respective sector will be constituted to give suggestions on the implementation modalities for the respective cluster. Each PMU will comprise industry leaders of the sector, sectoral association, district industry association, Officers of Department of Industries & Commerce etc.

(iv) District Level Consultative Committee under the Chairmanship of concerned District In-charge Minister comprising of local MLA's/MLC's, ZP President/Vice-President, Deputy Commissioner, CEO, ZP, Joint Director DIC's of concerned districts etc. will be constituted to provide suggestions on implementation of the scheme in the district. (v) Skill Development Training Programs will be designed based on the inputs provided by Vision Groups/Program Mission Units and will be imparted in association with sector industries and industry associations at the District level.

This will be done through District Industries Centers in co-ordination with Skill Development Department. The cost of Skill Development Training including stipend, training cost, raw material cost etc., is up to Rs. 10,000/- per candidate per month. The duration of the training program will be decided based on the inputs by Vision Groups/Program Mission Units. Also, training centers will be established wherever required.

(vi) To appoint Visvesvaraya Trade Promotion Center (VTPC) initially as Scheme Co-ordination Agency and to provide administrative cost of 1% on the budget for administrative expenses. This will be provided to VTPC to assist the PMUs in identifying/selection of consultants, providing outsourced staff, promotion of clusters, secretarial services to PMUs/steering committees, co-ordinating training programs and building special incentive proposals to industries establishing in the clusters etc.

(vii) To approve the visit of Core Team of the Department to Guangzhou, Foshan and other clusters in China to study the model of clusters.

Under Head of Account 4860-60-600-0-02(132)-Compete with China Program Capital Expenses, Rs. 500 crore has been provided and Rs. 10 crore under Head of Account 2852-80-102-0-04(059)-Compete with China Program Other Expenses has been provided in Budget 2018-19. Training and Administrative Expenses have to be borne under Revenue Head of Account. However, Rs. 500 crore provided under Head of Account 4860-60-600-0-02(132) under Capital Head will be utilized for establishing training schools and also conducting training programs, which will help in implementing the above scheme.

Detailed working model of this Scheme will be formulated based on the Study Report of the identified Clusters, suggestions of the respective Vision Groups / Programme Mission Units and State Level Steering Committee.

Hence the following order:

In the circumstances explained in the preamble, Government is pleased to accord approval to implement "Compete with China"

Further, the Government also accorded approval for the following proposals:

(i) To procure Knowledge Partner services to assist in conducting detailed studies, formulating strategies and implementation of the program following the transparency procedures.

(ii) To constitute State Level Steering Committee under the Chairmanship of Hon'ble Chief Minister and Vice-Chairmanship of Hon'ble Minister for Large & Medium Industries.

(iii) To constitute Nine Sectoral "Vision Groups / Program Mission Units" headed by industry leader of the respective sector.

(iv) To constitute District Level Consultative Committee under the Chairmanship of concerned in-charge District Minister.

(v) To approve the cost of Skill Development Training including stipend, training cost, raw material cost etc., up to Rs. 10,000/- per candidate per month and to approve for establishment of Training Centers wherever required subject to approval from the competent authorities.

(vi) To utilize funds provided under Head of Account 4860-60-600-0-02(132) Compete with China Programs-Capital Expenses for establishment of Training Centers wherever required and for conducting training programs depending on the need and subject to approval from the competent technical and administrative authorities.

(vii) To appoint Visvesvaraya Trade Promotion Center (VTPC) as Scheme Co-ordination Agency and to provide administrative cost of 1% on the budget. Expenditure incurred on required and approved activities will be met under HoA 2852-80-102-0-04(059) - Compete with China Program - Other Expenses and Rs. 10 crore be released to VTPC during 2018-19.

(viii) To approve the visit of Core Team of the Department to Guangzhou, Foshan and other clusters in China to study the model of clusters with approval from the competent authorities.

ಮೇಲೆ ಓದಲಾದ (2) ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ನಿಯಮಗಳನ್ವಯ ವಸೂಲಿ ಮಾಡಲಾದ ಸಾಲ, ಷೇರು, ಅಥವಾ ರಾಜಸ್ವ ಪ್ರತಿ ಪ್ರಕರಣದಲ್ಲಿ ರೂ. 2.00 ಲಕ್ಷಗಳ ವರೆಗೆ ಹಾಗೂ ರೂ. 10.00 ಲಕ್ಷಗಳ ವಾರ್ಷಿಕ ಮಿತಿಗೊಳಪಟ್ಟು ಮನ್ನಾ ಮಾಡಲು ಇಲಾಖಾ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಯವರಿಗೆ ಅಧಿಕಾರ ಪ್ರತ್ಯಾಯೋಜಿಸಲಾಗಿರುತ್ತದೆ.

2. ಅನುಬಂಧ-2ರಿಂದ 5 ರವರೆಗಿನ ಕಡತಗಳನ್ನು ವಿಲೇ ಮಾಡಲು ವಾಣಿಜ್ಯ ಮತ್ತು ಕೈಗಾರಿಕೆ ಇಲಾಖೆಯ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಗಳು, ನಿರ್ದೇಶಕರು (ತಾಂತ್ರಿಕ ಕೋಶ), ಉಪ ಕಾರ್ಯದರ್ಶಿ ಮತ್ತು ಅಧೀನ ಕಾರ್ಯದರ್ಶಿ (ಸೇವೆಗಳು ಮತ್ತು ಸಮನ್ವಯ) ಇವರುಗಳಿಗೆ ಅಧಿಕಾರವನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸಿದೆ. ಈ ಅಧಿಕಾರಗಳನ್ನು ನಿಯಮಗಳಂತೆ ಅಗತ್ಯವಿದ್ದಲ್ಲಿ, ಇತರೆ ಇಲಾಖೆಗಳ ಸಮಾಲೋಚನೆ ಅಥವಾ ಅನುಮೋದನೆ ಪಡೆದು ನಿರ್ಧರಿಸುವುದು.

ಮಾನ್ಯ ಬೃಹತ್ ಮತ್ತು ಮಧ್ಯಮ ಕೈಗಾರಿಕೆ ಇಲಾಖೆಯ ಸಚಿವರಿಗೆ ಸಲ್ಲಿಸಬೇಕಾದ ಪ್ರಕರಣಗಳು

1. ಕರ್ನಾಟಕ ಸರ್ಕಾರ (ವ್ಯವಹಾರ ನಿರ್ವಹಣೆ) ನಿಯಮಗಳು 1977ರ ಅನುಸಾರ ಹಾಗೂ ಸ್ಥಾಯಿ ಆದೇಶಗಳ ಪ್ರಕಾರ ಗೌರವಾನ್ವಿತ ರಾಜ್ಯಪಾಲರು / ಸಚಿವ ಸಂಪುಟ ಮತ್ತು ಮುಖ್ಯಮಂತ್ರಿಗಳಿಗೆ ಸಲ್ಲಿಸಬೇಕಾದ ಪ್ರಕರಣಗಳು.

2. ಕೈಗಾರಿಕೆ ಮತ್ತು ವಾಣಿಜ್ಯ ಇಲಾಖೆಯ ಈ ಕೆಳಕಂಡ ವಿಷಯಗಳು:-

ಅ. ಗ್ರೂಪ್-ಎ ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಸೇವಾ ವಿಷಯಗಳು.

ಆ. ಗುಂಪು-ಎ ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಪರೀಕ್ಷಾರ್ಥ / ಸ್ಥಾನಪನ್ನ ಅವಧಿ ಘೋಷಣೆ ಕುರಿತ

ಇ. ಅಧಿಕೃತವಾಗಿ ವಿದೇಶಕ್ಕೆ ತರಬೇತಿ / ಕಾರ್ಯಾಗಾರ / ಸೆಮಿನಾರ್ ಇತ್ಯಾದಿಗಳಲ್ಲಿ ಭಾಗವಹಿಸಲು ನಿಯೋಜಿಸುವ ಪ್ರಸ್ತಾವನೆಗಳು.

ಉ. ಗ್ರೂಪ್-ಎ ವೃಂದದ ಅಧಿಕಾರಿಗಳ ವಿರುದ್ಧ ಶಿಸ್ತು ಪ್ರಕರಣಗಳನ್ನು ಹೂಡುವ ಹಾಗೂ ದಂಡನೆ ವಿಧಿಸುವ ಹಾಗೂ ಕ್ರಿಮಿನಲ್ ಮೊಕದ್ದಮೆಗಳಲ್ಲಿ ಅಭಿಯೋಜನಾ ಮಂಜೂರಾತಿ / ಲೋಕಾಯುಕ್ತ ಪ್ರಕರಣಗಳಿಗೆ ನಿಯಮ 14-ಎ ರಡಿ ಮಂಜೂರಾತಿ ನೀಡುವ ಕುರಿತು ಪ್ರಸ್ತಾವನೆಗಳು.

ಐ. ಇಲಾಖೆಯ ವಾರ್ಷಿಕ ವರದಿ/ನಿರ್ವಹಣಾ ಮುಂಗಡ ಪತ್ರದ ಅನುಮೋದನೆ.

ಒ. ಭಾರತ ಸರ್ಕಾರದೊಂದಿಗೆ ಸಂಬಂಧಿಸಿದ ವಿಷಯಗಳಲ್ಲಿ ಪ್ರಸ್ತಾವನೆ/ಪತ್ರಗಳನ್ನು ಸಲ್ಲಿಸುವುದು.

3. ಕೆ.ಐ.ಎ.ಡಿ.ಬಿ ಗೆ ಸಂಬಂಧಿಸಿದ ವಿಷಯಗಳು:-

ಅ. ಕೆ.ಐ.ಎ.ಡಿ.ಬಿ ಗ್ರೂಪ್ `ಎ' ಮತ್ತು ಗ್ರೂಪ್ `ಬಿ' ಅಧಿಕಾರಿಗಳ ನೇಮಕಾತಿ/ಮುಂಬಡ್ತಿ/ ವರ್ಗಾವಣೆ/ಸ್ಥಳ ನಿಯುಕ್ತಿ ಪ್ರಕರಣಗಳು.

ಆ. ಕೆ.ಐ.ಎ.ಡಿ.ಬಿ ಗ್ರೂಪ್ `ಎ' ಮತ್ತು ಗ್ರೂಪ್ `ಬಿ' ವೃಂದದ ಹುದ್ದೆಗಳ ಸೃಜನೆ/ಪದನಾಮ ಬದಲಾವಣೆ/ರದ್ದುಪಡಿಸುವ ಪ್ರಕರಣಗಳು.

ಈ. ಗುಂಪು `ಎ' ಮತ್ತು `ಬಿ' ವೃಂದದ ಲೋಕೋಪಯೋಗಿ ಇಲಾಖೆಯ ಅಧಿಕಾರಿಗಳ ಕೆ.ಐ.ಎ.ಡಿ.ಬಿ ನಿಯೋಜನೆ ಕುರಿತು ಅನುಮೋದಿಸಬಹುದಾದ ಪ್ರಕರಣಗಳು.

4. ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಯವರು ವಿಷಯಗಳ ಪ್ರಾಮುಖ್ಯತೆಯನ್ನು ಪರಿಗಣಿಸಿ ಮಾನ್ಯ ಸಚಿವರಿಗೆ ಸಲ್ಲಿಸಬಹುದಾದ ಪ್ರಕರಣಗಳು.

ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿರವರ ಹಂತದಲ್ಲಿ ವಿಲೇಗೊಳಿಸಬಹುದಾದ ಪ್ರಕರಣಗಳು

ಕೈಗಾರಿಕೆ ಮತ್ತು ವಾಣಿಜ್ಯ ಇಲಾಖೆ ಹಾಗೂ ಕೆ.ಐ.ಎ.ಡಿ.ಬಿ.ಯ ಈ ಕೆಳಕಂಡ ವಿಷಯಗಳು:-

1. ಖಾಸಗಿ ಕಾರ್ಯನಿಮಿತ್ತ ಸ್ವಂತ ರಜೆ / ಖರ್ಚಿನಲ್ಲಿ ವಿದೇಶ ಪ್ರವಾಸ ಕೈಗೊಳ್ಳುವ ಗುಂಪು-ಎ ವೃಂದದ ಅಧಿಕಾರಿಗಳಿಗೆ ಅನುಮತಿ ನೀಡುವ ಪ್ರಕರಣಗಳು.

2. ಗುಂಪು ಎ ವೃಂದದ ಅಧಿಕಾರಿಗಳಿಗೆ ಕಡ್ಡಾಯ ನಿರೀಕ್ಷಣಾ ಅವಧಿ ಮಂಜೂರಾತಿಗೆ / ನಿಯೋಜನಾ ಷರತ್ತುಗಳ ಪ್ರಕರಣಗಳು.

3. ಗುಂಪು ಎ ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಆಸ್ತಿ ಮತ್ತು ಹೊಣೆಗಾರಿಕೆ ತಃಖ್ತೆಗಳ ಅಂಗೀಕಾರ ಮತ್ತು ಸ್ಥಿರಾಸ್ತಿಗಳ ಅಂಗೀಕಾರ ಮತ್ತು ವಿಲೆಗೆ ಅನುಮತಿ ನೀಡುವ ಪ್ರಕರಣಗಳು.

4. ಕಾರ್ಯಹಂಚಿಕೆಯಾದ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ನ್ಯಾಯಾಲಯ ಪ್ರಕರಣಗಳಲ್ಲಿ ಸರ್ಕಾರಿ ವಕೀಲರು ತಯಾರಿಸಿ ಕಳುಹಿಸುವ ಆಕ್ಷೇಪಣಾ ಹೇಳಿಕೆಗಳಿಗೆ ಅನುಮೋದನೆ ನೀಡುವ ಪ್ರಸ್ತಾವನೆಗಳು.

5. ರಾಜ್ಯ ಮಟ್ಟದ ಏಕ ಗವಾಕ್ಷಿ ಸಮಿತಿ ಹಾಗೂ ರಾಜ್ಯ ಉನ್ನತ ಮಟ್ಟದ ಒಪ್ಪಿಗೆ ನೀಡಿಕೆ ಸಮಿತಿಗಳಲ್ಲಿ ಅನುಮೋದನೆಯಾದ ಯೋಜನೆಗಳ ಸರ್ಕಾರಿ ಆದೇಶ ಹೊರಡಿಸಲು ಅನುಮೋದನೆ.

6. ತಾಂತ್ರಿಕ ಕೋಶ ವಿಭಾಗದಲ್ಲಿ ಆಯವ್ಯಯದಲ್ಲಿ ಒದಗಿಸಿರುವ ಅನುದಾನವನ್ನು ಬಿಡುಗಡೆ ಮಾಡಲು ಅನುಮೋದಿಸುವ ಪ್ರಕರಣಗಳು.

7. ಕಾರ್ಯ ಹಂಚಿಕೆಯಾದ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಮಹಾಲೇಖಪಾಲರ ಲೆಕ್ಕ ಪರಿಶೋಧನಾ ಕಂಡಿಕೆಗಳಿಗೆ ಉತ್ತರಗಳು/ವಿಧಾನ ಮಂಡಲದ ವಿವಿಧ ಸಮಿತಿಗಳಿಗೆ ಉತ್ತರ ಒದಗಿಸುವ ಕುರಿತಾದ ಪ್ರಕರಣಗಳು.

8. ಕಾರ್ಯ ಹಂಚಿಕೆಯಾದ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಅಧಿಕಾರಿ/ನೌಕರರು ಸಂಸ್ಥೆಯ ಮುಖ್ಯಸ್ಥರ ಆದೇಶದ ವಿರುದ್ಧ ಸಲ್ಲಿಸುವ ಮೇಲ್ಮನವಿಗಳ ವಿಷಯಗಳು.

9. ಕಾರ್ಯ ಹಂಚಿಕೆಯಾದ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಿಸಿದ ಮುಖ್ಯಸ್ಥರ ದಿನಚರಿಗಳ ಪುನರ್‌ವಿಲೋಕನೆ.

10. ಕಾರ್ಯಹಂಚಿಕೆಯಾದ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ನ್ಯಾಯಾಲಯ ಪ್ರಕರಣಗಳಲ್ಲಿ ಸರ್ಕಾರಿ ವಕೀಲರು ತಯಾರಿಸಿ ಕಳುಹಿಸುವ ಆಕ್ಷೇಪಣಾ ಹೇಳಿಕೆಗಳಿಗೆ ಅನುಮೋದನೆ ನೀಡುವ ಪ್ರಸ್ತಾವನೆಗಳು.

11. ಕಾರ್ಯ ಹಂಚಿಕೆಯಾದ ವಿಷಯಗಳಿಗೆ ಸಂಬಂಧಿಸಿದ ಸಂಸ್ಥೆಗಳ ಪರಿಶೀಲನಾ ಸಭೆ/ಮಂಡಳಿ ಸಭೆಗಳನ್ನು ನಿಯಮಿತ ಕಾಲದಲ್ಲಿ ನಡೆಸುವುದು.

12. ಕೆ.ಐ.ಎ.ಡಿ.ಬಿಗೆ ನಿಯೋಜನೆಗೊಳ್ಳುವ ಗ್ರೂಪ್ `ಎ' ಮತ್ತು ಗ್ರೂಪ್ `ಬಿ' ವೃಂದದ ಅಧಿಕಾರಿಗಳಿಗೆ ಕಡ್ಡಾಯ ನಿರೀಕ್ಷಣಾ ಅವಧಿ ಮಂಜೂರಾತಿಗೆ ಸಂಬಂಧಿಸಿದ ಪ್ರಕರಣಗಳು.

ಗೌರವ್ ಗುಪ್ತ ಸರ್ಕಾರದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ, ವಾಣಿಜ್ಯ ಮತ್ತು ಕೈಗಾರಿಕೆ ಇಲಾಖೆ.

ಅನುಬಂಧ-3

ಉಪ ಕಾರ್ಯದರ್ಶಿ ರವರ ಹಂತದಲ್ಲಿ ವಿಲೇಗೊಳಿಸಬಹುದಾದ ಪ್ರಕರಣಗಳು

1. ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ ರವರು ನಿರ್ದಿಷ್ಟವಾಗಿ ವಿಲೇಗೊಳಿಸಲು ಸೂಚಿಸುವ ವಿಷಯಗಳು. 2. ಕೈಗಾರಿಕೆ ಮತ್ತು ವಾಣಿಜ್ಯ ಇಲಾಖೆಯ ಗ್ರೂಪ್ 'ಎ' ಮತ್ತು 'ಬಿ' ವೃಂದದ ಅಧಿಕಾರಿಗಳ ಕಾರ್ಯನಿರ್ವಹಣಾ ಪ್ರಮಾಣ ಪತ್ರ (53 F) ಪ್ರಸ್ತಾವನೆಗಳು.

3. ಪ್ರಸ್ತಾವನೆಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಅವಶ್ಯವಿರುವ ಹೆಚ್ಚುವರಿ ಮಾಹಿತಿಯನ್ನು ಇಲಾಖಾ ಮುಖ್ಯಸ್ಥರಿಂದ ಪಡೆಯಲು ಕ್ರಮ ವಹಿಸುವ ಪ್ರಕರಣಗಳು. 4. ದೂರು ಅರ್ಜಿಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಇಲಾಖಾ ಮುಖ್ಯಸ್ಥರಿಂದ ವರದಿ / ಅಭಿಪ್ರಾಯ ಕೋರುವ ವಿಷಯಗಳು. 5. ಇಲಾಖಾ ವಿಚಾರಣೆಯಲ್ಲಿ ನೇಮಕಗೊಂಡ ವಿಚಾರಣಾಧಿಕಾರಿಗಳಿಗೆ ನಿಯಮಾನುಸಾರ ಸಂಭಾವನೆ ಮಂಜೂರು ಮಾಡುವ ಪ್ರಸ್ತಾವನೆಗಳು. 6. ಇಲಾಖಾ ವಿಚಾರಣೆ ಪ್ರಕರಣಗಳಲ್ಲಿ ಲಿಖಿತ ಹೇಳಿಕೆ ಸಲ್ಲಿಸಲು ಒಟ್ಟು 15 ದಿನಗಳಿಗೆ ಮೀರದಂತೆ ಹೆಚ್ಚುವರಿ ಕಾಲಾವಕಾಶ ನೀಡುವ ಹಾಗೂ ಆರೋಪಿತರು ದಸ್ತಾವೇಜು ನೋಡಲು / ಪಡೆಯಲು ಇಚ್ಛಿಸಿದಾಗ ಅನುಮತಿ ನೀಡುವ ಪ್ರಕರಣಗಳು.

7. ವಾರ್ಷಿಕ ಗರಿಷ್ಠ ರೂ.20,000/- ಗಳಿಗೆ ಮೀರದಂತೆ ಒಂದು ಬಾರಿಗೆ ರೂ.10,000/- ಗಳವರೆಗಿನ ವಾಹನ ದುರಸ್ಥಿ ಮಂಜೂರಾತಿ ಪ್ರಸ್ತಾವನೆಗಳು. 8. ಮುಂಬಡ್ತಿ / ನಿವೃತ್ತಿ ಪ್ರಕರಣಗಳಲ್ಲಿ ಇಲಾಖಾ ವಿಚಾರಣೆ ಬಾಕಿ ಇರುವ ಕುರಿತು ವಸ್ತುಸ್ಥಿತಿಯನ್ನು ಇತರೆ ಇಲಾಖೆಗಳಿಗೆ ತಿಳಿಸುವ ಪ್ರಕರಣಗಳು. 9. ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರವು ಅನುಮೋದಿಸಿದ ಅಮಾನತ್ತು ಪ್ರಕರಣ / ಶಿಸ್ತು ಪ್ರಕರಣದಲ್ಲಿನ ಅಂತಿಮ ಆದೇಶ ಹೊರಡಿಸುವ / ಲೋಕಾಯುಕ್ತ ಪ್ರಕರಣಗಳು ಇವುಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಕರಡು ಆದೇಶಗಳ ಅನುಮೋದನೆ.

10. ಅರೆ ಸರ್ಕಾರಿ ನೆನಪೋಲೆಗಳನ್ನು ಪ್ರಥಮ ಎರಡು ಬಾರಿಗೆ (15 ದಿನಗಳ ಅಂತರದಲ್ಲಿ) ಕಳುಹಿಸುವ ಪ್ರಕರಣಗಳು. 11. ಮಾಹಿತಿ ಹಕ್ಕು ಅಧಿನಿಯಮಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಅರ್ಜಿದಾರರು ಸಲ್ಲಿಸುವ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಮಾಹಿತಿ ನೀಡುವುದು. 12. ನ್ಯಾಯಾಲಯ ಪ್ರಕರಣಗಳಿಗೆ ಸಂಬಂಧಿಸಿದ ಕಡತಗಳನ್ನು ಕಾನೂನು ಕೋಶದ ಮುಖ್ಯಸ್ಥರಿಗೆ ಕಳುಹಿಸುವುದು.

ವಿಲೇಗೊಳಿಸಬಹುದಾದ ಪ್ರಕರಣಗಳು.

(ಅವರವರಿಗೆ ಹಂಚಿಕೆಯಾಗಿರುವ ವಿಷಯಗಳಲ್ಲಿ)

1. ಪ್ರಸ್ತಾವನೆಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಅವಶ್ಯವಿರುವ ಹೆಚ್ಚುವರಿ ಮಾಹಿತಿಯನ್ನು ಇಲಾಖಾ ಮುಖ್ಯಸ್ಥರಿಂದ ಪಡೆಯಲು ಕ್ರಮ ವಹಿಸುವ ಪ್ರಕರಣಗಳು.

3. ಮುಂಬಡ್ತಿ/ನಿವೃತ್ತಿ ಪ್ರಕರಣಗಳಲ್ಲಿ ಇಲಾಖಾ ವಿಚಾರಣೆ ಬಾಕಿ ಇರುವ ಕುರಿತು ವಸ್ತುಸ್ಥಿತಿಯನ್ನು ಇತರ ಇಲಾಖೆಗಳಿಗೆ ತಿಳಿಸುವ ಪ್ರಕರಣಗಳು.

4. ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರವು ಕಡತದಲ್ಲಿ ಅನುಮೋದಿಸಿದ ವಿಷಯಗಳ ಕುರಿತು ಕರಡು ಪತ್ರ/ಆದೇಶಗಳ ಅನುಮೋದನೆ.

5. ಮಾಹಿತಿ ಹಕ್ಕು ಅಧಿನಿಯಮಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಅರ್ಜಿದಾರರು ಸಲ್ಲಿಸುವ ಮೇಲ್ಮನವಿಗಳನ್ನು ಪರಿಶೀಲಿಸಿ, ಮಾಹಿತಿ ನೀಡುವುದು.

6. ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿರವರು ಯಾವುದಾದರೂ ವಿಷಯಗಳು ಕುರಿತು ಅಧಿಕಾರವನ್ನು ಡೆಲಿಗೇಟ್ ಮಾಡಿದ್ದಲ್ಲಿ, ಅಂತಹ ವಿಷಯಗಳನ್ನು ನಿರ್ವಹಿಸುವುದು.

ಅಧೀನ ಕಾರ್ಯದರ್ಶಿ ರವರ ಹಂತದಲ್ಲಿ ವಿಲೇಗೊಳಿಸಬಹುದಾದ ಪ್ರಕರಣಗಳು

1) ನಿರ್ದಿಷ್ಟವಾದ ಪೂರ್ವ ನಿದರ್ಶನಗಳಿರುವ ಮತ್ತು ಸ್ಥಾಯಿ ಆದೇಶಗಳನ್ನು ಒಳಗೊಂಡ ಪ್ರಸ್ತಾಪಗಳು ಮತ್ತು ಬೇರೆ ಇಲಾಖೆಗಳಿಂದ ಸರ್ಕಾರದ ಅಧೀನ ಕಾರ್ಯದರ್ಶಿಯವರ ಹಂತದಲ್ಲಿ ಸ್ವೀಕರಿಸಿದ ಸಾಮಾನ್ಯ ಅನಧಿಕೃತ ಟಿಪ್ಪಣಿಗಳು ಮತ್ತು ಉಲ್ಲೇಖಗಳು.

2) ಉನ್ನತ ಅಧಿಕಾರಿಗಳು ನೀಡಿದ ಅಂತಿಮ ಆದೇಶಗಳಂತೆ ಸರ್ಕಾರದ ಆದೇಶಗಳು, ನೆನಪೋಲೆಗಳು ಮತ್ತು ಪತ್ರಗಳನ್ನು ಹೊರಡಿಸುವುದು. 3) ಸಚಿವಾಲಯದ ಇತರೆ ಇಲಾಖೆಗಳಲ್ಲಿನ ಅದೇ ಹುದ್ದೆಗಳಲ್ಲಿರುವವರಿಗೆ ಜ್ಞಾಪನ ಪತ್ರಗಳನ್ನು ಹೊರಡಿಸುವುದು. 4) ಸರ್ಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿದ ಅರ್ಜಿಗಳ ಮೇಲೆ ಮತ್ತು ತಡೆಯಾಜ್ಞೆ ಇಲ್ಲದ ಮೇಲ್ಮನವಿಗಳನ್ನು ಕೆಳಗಿನ ಅಂಶಗಳನ್ನು ಹೊರತುಪಡಿಸಿದ ಪ್ರಕರಣಗಳಲ್ಲಿ ಅಧಿಕಾರಿಗಳಿಂದ ವರದಿಗಳಿಗಾಗಿ ಕೋರುವುದು.

ಅ) ನಿಯಮಗಳನ್ನು ಪಾಲಿಸದ ಮತ್ತು

ಆ) ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಪ್ರಶ್ನಿಸಬೇಕಾದ ಪ್ರಕರಣವಲ್ಲದ ಅಥವಾ ಉನ್ನತ ಅಧಿಕಾರಿಗಳು ಈಗಾಗಲೇ ನಿರ್ಧರಿಸಿದ ಪ್ರಕರಣಗಳು.

5) ಅಭಿಪ್ರಾಯವನ್ನು ವ್ಯಕ್ತಪಡಿಸಿದ ಪ್ರಸ್ತಾಪಗಳಲ್ಲಿ ಇಲಾಖಾ ಮುಖ್ಯಸ್ಥರಿಗೆ ಮತ್ತು ಇತರೆ ಅಧಿಕಾರಿಗಳಿಗೆ ಹೆಚ್ಚುವರಿ ಮಾಹಿತಿಗಾಗಿ ಕೋರುವುದು. 6) ಮಾಹಿತಿ ಹಕ್ಕು ಅಧಿನಿಯಮಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಅರ್ಜಿಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಅರ್ಜಿದಾರರಿಗೆ ಮಾಹಿತಿ ನೀಡುವುದು. 7) ಕರ್ನಾಟಕ ನಾಗರಿಕ ಸೇವಾ ನಿಯಮಾವಳಿಗಳ ನಿಯಮ 1958 ರಡಿ ರಜಾ ನಗಧೀಕರಣ ಮಂಜೂರಾತಿ.

ADDENDUM ORDER

No. WRD 13 DSP 2017, Bengaluru, Dated 08-08-2018.

In continuation of the Government Order No: WRD 16 DSP 2016, Bengaluru, Dated: 29-05-2017 "According Administrative Approval to the Revised Cost of Rs. 581.18 cr of Dam Rehabilitation and Improvement Project (DRIP) with Loan Assistance from the World Bank" as per the concurrence of the Finance Department vide note No: FD 140 FC-1/17, Dated: 10-04-2017 the following is included.

The World Bank originally allocated Rs. 276.75 cr for the State with an initial funding pattern of 80:20, The original allocation was later re-appropriated to Rs. 305 Cr, for which the already approved State share is Rs. 61.00 cr.

The Revised Cost of Rs. 581 cr was approved in the 77th Screening Committee of DEA, this Revised Cost required an additional funding of Rs. 276 cr, for which the revised funding pattern is 70:30 and hence the State share is Rs. 82.85 cr.

The total State share to be borne by revising the funding pattern of additional Cost is Rs. 143.85 cr.

(Rs. 61.00 cr+Rs.82.85 cr.)

Already approval has been given to the total State share of Rs. 116.24 cr. Approval to be given as the balance amount to be borne by the State Government is Rs. 27.61 cr. (Rs. 143.85 cr-Rs. 116.24 cr)

In view of the above, the revision of the funding pattern of additional Cost of World Bank assisted Dam Rehabilitation and Improvement Project and to bear the balance State share of Rs. 27.61 Crores is hereby approved by the Government as per the concurrence of the Finance Department vide note No: FD 163 FC-1/18, Dated: 19-07-2018.

The Chief Engineer, Water Resources Development Organization and Nodal Officer (DRIP) should ensure that - 1) There will be no further revisions in the approved project cost i.e. Rs. 581.18 cr.

2) Completion/target date may be strictly adhered to.
