ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಇಎನ್ 21 ವಿಎಸ್‌ಸಿ 2014 ದಿನಾಂಕ: 14.10.2015ಕ್ಕೆ ಮುಂದುವರೆದಂತೆ ಉಲ್ಲೇಖ (2), (3) ಮತ್ತು (4)ರ ಅಧಿಸೂಚನೆಗಳಲ್ಲಿ ತುಮಕೂರು ಜಿಲ್ಲೆಯ ಪಾವಗಡ ತಾಲ್ಲೂಕಿನ ನಾಗಲಮಡಿಕೆ ಹೋಬಳಿಯ ವಳ್ಳೂರು, ಬಳಸಮುದ್ರ, ಕ್ಯಾತಗಾನಚರ್ಲು, ರಾಯಚರ್ಲು ಮತ್ತು ತಿರುಮಣಿ ಗ್ರಾಮಗಳಲ್ಲಿ ಸ್ಥಾಪಿಸಲು ಉದ್ದೇಶಿಸಿರುವ ಸೋಲಾರ್ ಪಾರ್ಕಿನ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಸೌರ ವಿದ್ಯುತ್ ಘಟಕಗಳನ್ನು ಸ್ಥಾಪಿಸಲು ಬಳಸುವ ಜಮೀನುಗಳನ್ನು ಕರ್ನಾಟಕ ಭೂಕಂದಾಯ (ತಿದ್ದುಪಡಿ) ಅಧಿನಿಯಮ 2015 ರೊಂದಿಗೆ ಓದಿಕೊಂಡಂತೆ ಕರ್ನಾಟಕ ಭೂಕಂದಾಯ ಅಧಿನಿಯಮ, 1964 ರ 95(10) ಪ್ರಕರಣ, (2015 ರಕರ್ನಾಟಕಅಧಿನಿಯಮ, ಸಂಖ್ಯೆ: 31)ರ ಅಡಿಯಲ್ಲಿ ಸೌರ ವಿದ್ಯುತ್ ಉತ್ಪಾದನಾ ಘಟಕಗಳ ಸ್ಥಾಪನೆಗೆ ಸಂಬಂಧಿಸಿದ ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರದಿಂದ ಅನುಮೋದನೆಗೊಂಡ ದಾಖಲೆಗಳೊಂದಿಗೆ, ಭೂ ಪರಿವರ್ತನೆ ಶುಲ್ಕ ಮತ್ತು ಅನ್ವಯಿಸುವ ಇತರೆ ಎಲ್ಲಾ ಶುಲ್ಕಗಳನ್ನು ಪಾವತಿಸಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದಲ್ಲಿ, ಅಂತಹ ಭೂಮಿಯು ಸೌರ ವಿದ್ಯುತ್ ಉತ್ಪಾದನಾ ಘಟಕ ಸ್ಥಾಪನೆಗೆ ಭೂ ಪರಿವರ್ತನೆಗೊಂಡಿದೆ ಎಂದು ಪರಿಭಾವಿಸತಕ್ಕದ್ದೆಂದು ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತುತ ಅಧ್ಯಕ್ಷರು, ಕೆ.ಎಸ್.ಪಿ.ಡಿ.ಸಿ.ಎಲ್. ರವರುತಮ್ಮ ಪ್ರಸ್ತಾವನೆ ದಿನಾಂಕ: 04.09.2018ರಲ್ಲಿ ಈವರೆಗೆ ಸರ್ಕಾರದಿಂದ 17306 ಎಕರೆ ಭೂಮಿಗೆ ಅಧಿಸೂಚನೆ ನೀಡಲಾಗಿದ್ದು, ಇದರಲ್ಲಿ 4962 ಎಕರೆ ಜಮೀನಿನ ರೈತರು ನಿರಾಕರಿಸಿದ್ದರಿಂದ ಹಾಗೂ ಸೌರ ಪಾರ್ಕಿನ ವ್ಯಾಪ್ತಿಯ ಹೊರಗಡೆ ಇದ್ದುದ್ದರಿಂದ ಗುತ್ತಿಗೆ ಕರಾರು ಮಾಡಿಕೊಂಡಿರುವುದಿಲ್ಲವೆಂದು ಮತ್ತು 12,700 ಎಕರೆ ಭೂಮಿಗೆ ಈಗಾಗಲೇ ಗುತ್ತಿಗೆ ಕರಾರು ಮಾಡಿಕೊಂಡಿರುವುದಾಗಿ ಹಾಗೂ ಈಗಾಗಲೇ ಗುತ್ತಿಗೆ ಕರಾರು ಮಾಡಿಕೊಂಡಿರುವ 356 ಎಕರೆ ಮತ್ತು ಗುತ್ತಿಗೆ ಕರಾರು ಮಾಡಲು ಬಾಕಿ ಇರುವ 130 ಎಕರೆ (ತಿರುಮಣಿ : 83 ಎಕರೆ 33 ಗುಂಟೆ, ರಾಯಚೆರ್ಲು: 164 ಎಕರೆ, ವಳ್ಳೂರು: 95 ಎಕರೆ 28 ಗುಂಟೆ, ಬಳಸಮುದ್ರ: 123 ಎಕರೆ 01 ಗುಂಟೆ ಮತ್ತು ಕ್ಯಾತಗಾನಚೆರ್ಲು: 17 ಎಕರೆ 34 ಗುಂಟೆ) ಒಟ್ಟು 486 ಎಕರೆ 14 ಗುಂಟೆ ಜಮೀನನ್ನು ಅಧಿಸೂಚನೆ ಹೊರಡಿಸುವಂತೆ ಕೋರಿರುತ್ತಾರೆ.

ಉಲ್ಲೇಖ (2) ರಿಂದ (5) ಕ್ಕೆ ಮುಂದುವರೆಸುತ್ತಾ, ಈ ಅಧಿಸೂಚನೆಯ ಅನುಬಂಧದಲ್ಲಿ ನಮೂದಿಸಿರುವ ಪಾವಗಡ ತಾಲ್ಲೂಕಿನ ನಾಗಲಮಡಿಕೆ ಹೋಬಳಿಯ ವಳ್ಳೂರು, ಬಳಸಮುದ್ರ, ಕ್ಯಾತಗಾನಚೆರ್ಲು, ರಾಯಚೆರ್ಲು ಮತ್ತು ತಿರುಮಣಿ ಗ್ರಾಮಗಳಲ್ಲಿನ ಸರ್ವೆ ನಂಬರ್ ಹಾಗೂ ಭೂಮಾಲೀಕರ ಹೆಸರುಗಳನ್ನೊಳಗೊಂಡ ಜಮೀನುಗಳನ್ನು ಉದ್ದೇಶಿತ ಸೌರ ಪಾರ್ಕ್‌ಗೆ ಸೇರ್ಪಡಿಸಿ, ಸೌರ ವಿದ್ಯುತ್ ಘಟಕಗಳ ಸ್ಥಾಪನೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರದಿಂದ ಅನುಮೋದನೆಗೊಂಡ ದಾಖಲೆಗಳೊಂದಿಗೆ, ಭೂ ಪರಿವರ್ತನೆ ಕೋರಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದಲ್ಲಿ ಸದರಿ ಭೂಮಿಗಳೂ ಸಹ ಸೌರ ವಿದ್ಯುತ್ ಉತ್ಪಾದನಾ ಘಟಕ ಸ್ಥಾಪನೆಗೆ ಭೂ ಪರಿವರ್ತನೆಗೊಂಡಿವೆಎಂದು ಪರಿಭಾವಿಸಲು ಸರ್ಕಾರ ಅನುಮತಿಸಿದೆ.

ಮುಂದುವರೆದು, ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಣಾಧಿಕಾರಿ, ಕೆ.ಎಸ್.ಪಿ.ಡಿ.ಸಿ.ಎಲ್. ಇವರುಅನುಬಂಧದಲ್ಲಿರುವ ಸೌರ ಪಾರ್ಕಿಗೆ ಸೇರ್ಪಡಿಸಲು ಪ್ರಸ್ತಾಪಿಸಿರುವ ಸದರಿ ಜಮೀನುಗಳ ಮಾಲೀಕತ್ವ/ವಾರಸುದಾರರು, ಸರ್ವೆ ನಂಬರ್ಇತ್ಯಾದಿ ದಾಖಲಾತಿಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಖಾತರಿ ಪಡಿಸಿಕೊಳ್ಳತಕ್ಕದ್ದು.

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ, 1966 (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 1966) (ಈ ಮುಂದೆ ಪ್ರಸ್ತುತ ಕಾಯ್ದೆ ಎಂದು ಹೇಳಲಾಗಿದೆ) ಕಲಂ 28(1)ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದಡಿ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 824 ಎಸ್‌ಪಿಕ್ಯೂ 2007, ದಿನಾಂಕ: 17.12.2007 (ಈ ಮುಂದೆ ಅಧಿಸೂಚನೆ ಎಂದು ಹೇಳಲಾಗಿದೆ)ರಂದು ಹೊರಡಿಸಿ ದಿನಾಂಕ: 18.12.2007ರಂದು ಪ್ರಕಟವಾದ ರಾಜ್ಯ ಪತ್ರದ ಪುಟ 1ರಿಂದ 35ರವರೆಗೆ (ಭಾಗ-3)ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಪ್ರಸ್ತುತ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಮೆ|| ಬಿ.ಎಂ.ಎಂ. ಇಸ್ಪಾಟ್ ಲಿ. ಇವರ ಉದ್ದೇಶಿತ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿಗಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ತನ್ನ ಉದ್ದೇಶವನ್ನು ಪ್ರಕಟಿಸಿತ್ತು.

ಅದರಂತೆ ಪ್ರಸ್ತುತ ಕಾಯ್ದೆಯನ್ವಯ, 28ರ ಉಪ ಕಲಂ (3)ರನ್ವಯ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿದೆ ಮತ್ತು ಈ ಕೆಳಗೆ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳೂ ಪ್ರಸ್ತುತ ಅಧಿಸೂಚನೆಯಲ್ಲಿಯೂ ಕಾಣಿಸಲ್ಪಟ್ಟಿವೆ ಹಾಗೂ ಪ್ರಸ್ತುತ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕೆಂದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನವರಿಕೆಯಾಗಿದೆ.

ಆದುದರಿಂದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966 (ಕರ್ನಾಟಕ ಕಾಯ್ದೆ 18:1966)ರ ಕಲಂ 28ರ ಉಪ ಕಲಂ (4)ರನ್ವಯ ವಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಈ ಕೆಳಗೆ ಅನುಸೂಚಿಯಲ್ಲಿ ಕಾಣಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕೆಂದು ಈ ಮೂಲಕ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಘೋಷಿಸಿದೆ.
