ವಿಷಯ:- ಮೈಸೂರು ಜೆ.ಪಿ.ನಗರ ಬ್ರಾಹ್ಮಣರ ಸಂಘ(ರಿ.) ಮೈಸೂರು ಈ ಸಂಘಕ್ಕೆ ಆಡಳಿತಾಧಿಕಾರಿಯ ಅವಧಿಯನ್ನು ವಿಸ್ತರಿಸುವ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ:-

ಮೇಲೆ ಕ್ರ.ಸಂ. (1) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಮೈಸೂರು ಜೆ.ಪಿ.ನಗರ ಬ್ರಾಹ್ಮಣರ ಸಂಘ(ರಿ) ಈ ಸಂಘಕ್ಕೆ ಕೇಂದ್ರ ಸ್ಥಾನಿಕ ಸಹಾಯಕರು ಹಾಗೂ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು, ಸಹಕಾರ ಸಂಘಗಳ ಜಂಟಿ ನಿಬಂಧಕರ ಕಚೇರಿ, ಮೈಸೂರು ಇವರನ್ನು ದಿನಾಂಕ 30.06.2017 ರಿಂದ 06 ತಿಂಗಳ ಅವಧಿಗೆ ಆಡಳಿತಾಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಕ್ರ.ಸಂ. (2) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿಯಾಗಿದ್ದ ಕೇಂದ್ರ ಸ್ಥಾನಿಕ ಸಹಾಯಕರು ಹಾಗೂ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು, ಸಹಕಾರ ಸಂಘಗಳ ಜಂಟಿ ನಿಬಂಧಕರ ಕಚೇರಿ, ಮೈಸೂರು ಇವರ ಬದಲಾಗಿ ಶ್ರೀ ಕೆ.ಎಸ್. ಹರೀಶ್‌ಕುಮಾರ್, ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು ಹಾಗೂ ಸಮಾಪನಾಧಿಕಾರಿಗಳು, ಮೈಸೂರು ಕಾಫಿ ಸಂಸ್ಕರಣ ಸಹಕಾರ ಸಂಘ ನಿ., ಮೈಸೂರು, ಇವರನ್ನು ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿಯಾಗಿ ನೇಮಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಕ್ರ.ಸಂ. (3) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸದರಿ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 31.12.2017 ರಿಂದ 30.06.2018 ರವರೆಗೆ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಕ್ರ.ಸಂ. (4) ರಲ್ಲಿ ಓದಲಾದ ಸಹಕಾರ ಸಂಘಗಳ ನಿಬಂಧಕರ ಪತ್ರದಲ್ಲಿ ಸಂಘದ ಚುನಾವಣೆ ನಡೆಸಲು ಮಾನ್ಯ ಜೆ.ಎಂ.ಎಫ್.ಸಿ. ನ್ಯಾಯಲಯ, ಮೈಸೂರು ಇಲ್ಲಿ ತಡೆಯಾಜ್ಞೆ ನೀಡಿರುವುದರಿಂದ ನಿಗಧಿತ ಅವಧಿಯಲ್ಲಿ ಚುನಾವಣೆಯನ್ನು ನಡೆಸಲು ಸಾಧ್ಯವಾಗದ ಕಾರಣ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿಯ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 01.07.2018 ರಿಂದ 31.12.2018 ರವರೆಗೆ ವಿಸ್ತರಿಸಲು ಕೋರಿರುತ್ತಾರೆ.

ಮೇಲೆ ವಿವರಿಸಿರುವ ಅಂಶಗಳನ್ನು ಪರಿಶೀಲಿಸಿ, ಮೈಸೂರು ಜೆ.ಪಿ.ನಗರ ಬ್ರಾಹ್ಮಣರ ಸಂಘ(ರಿ.) ಈ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 01.07.2018 ರಿಂದ 31.12.2018 ರವರೆಗೆ (ಆರು ತಿಂಗಳ ಅವಧಿಗೆ) ವಿಸ್ತರಿಸಲು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿದೆ. ಆದ್ದರಿಂದ, ಈ ಆದೇಶ.

ಆದೇಶ

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕರ್ನಾಟಕ ಸಂಘಗಳ ನೋಂದಣಿ ಕಾಯ್ದೆ 1960ರ ಕಲಂ 27-ಎ ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಮೈಸೂರು ಜೆ.ಪಿ.ನಗರ ಬ್ರಾಹ್ಮಣರ ಸಂಘ(ರಿ.), ಮೈಸೂರು ಈ ಸಂಘದ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 01.07.2018 ರಿಂದ 31.12.2018 ರವರೆಗೆ ಆರು ತಿಂಗಳ ಅವಧಿಗೆ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಿದೆ.

ಆಡಳಿತಾಧಿಕಾರಿಗಳು ಸದರಿ ಅವಧಿಯಲ್ಲಿ ಸಂಸ್ಥೆಯಲ್ಲಿನ ಅವ್ಯವಹಾರಗಳನ್ನು ಸರಿಪಡಿಸಿ, ಸಂಘದ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಚುನಾವಣೆ ನಡೆಸಿ, ಚುನಾಯಿತ ನೂತನ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಅಧಿಕಾರ ಹಸ್ತಾಂತರಿಸುವಂತೆ ಸೂಚಿಸಲಾಗಿದೆ.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ: (02)ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಶ್ರೀ ಚಂದ್ರಕುಮಾರ್ ಇವರ ಬದಲಿಗೆ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು, ಮೈಸೂರು ಇವರನ್ನು ಆಡಳಿತಾಧಿಕಾರಿಯಾಗಿ ನೇಮಿಸಿ, ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು, ಕ್ರಮವಾಗಿ ದಿನಾಂಕ: 14.07.2015 ರಿಂದ 06 ತಿಂಗಳು ಮತ್ತು 14.01.2016 ರಿಂದ ಮುಂದಿನ 06 ತಿಂಗಳು ಅವಧಿಗೆ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ:(03)ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 13.07.2016 ರಿಂದ 13.01.2017ರವರೆಗೆ ಮತ್ತು ದಿನಾಂಕ: 14.01.2017 ರಿಂದ 13.07.2017ರವರೆಗೆ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಿದೆ.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (04) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 14.07.2017 ರಿಂದ 13.01.2018 ಮತ್ತು ದಿನಾಂಕ: 14.01.2018 ರಿಂದ 13.02.2018 ರವರೆಗೆ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ ಕ್ರಮ ಸಂಖ್ಯೆ (05) ರಲ್ಲಿ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಕುಂಚಿಟಿಗರ ಸಂಘ ಮೈಸೂರು ಈ ಸಂಘದ ಚುನಾವಣೆ ನಡೆಸಲು ಮಾನ್ಯ ಜೆ.ಎಂ.ಎಫ್.ಸಿ. ನ್ಯಾಯಾಲಯದ ಮೈಸೂರು ಇಲ್ಲಿ ತಡೆಯಾಜ್ಞೆ ನೀಡಿರುವುದರಿಂದ ನಿಗಧಿತ ಅವಧಿಯಲ್ಲಿ ಸಂಘದ ಚುನಾವಣೆ ನಡೆಸಲು ಸಾಧ್ಯವಾಗದ ಕಾರಣ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 14.07.2018 ರಿಂದ ಮುಂದಿನ 06 ತಿಂಗಳ ಅವಧಿಗೆ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ವಿಸ್ತರಿಸಬೇಕೆಂದು ಕೋರಿರುತ್ತಾರೆ.

ಮೇಲೆ ವಿವರಿಸಿರುವ ಅಂಶಗಳನ್ನು ಪರಿಶೀಲಿಸಿದ ನಂತರ ಸಹಕಾರ ಸಂಘಗಳ ನಿಬಂಧಕರ ಶಿಫಾರಸ್ಸನ್ನು ಪರಿಗಣಿಸಿ ಕುಂಚಿಟಿಗರ ಸಂಘ ಮೈಸೂರು, ಈ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ: 14.07.2018 ರಿಂದ ಮುಂದಿನ 06 ತಿಂಗಳ ಅವಧಿಗೆ ವಿಸ್ತರಿಸಲು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿದೆ. ಆದ್ದರಿಂದ, ಈ ಆದೇಶ.

ಆಡಳಿತಾಧಿಕಾರಿಗಳು ಸದರಿ ಅವಧಿಯಲ್ಲಿ ಸಂಘದ ನ್ಯೂನತೆಗಳನ್ನು ಸರಿಪಡಿಸಿ, ಆಡಳಿತ ಮಂಡಳಿಗೆ ಚುನಾವಣೆ ನಡೆಸಿ, ಚುನಾಯಿತ ನೂತನ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಅಧಿಕಾರ ಹಸ್ತಾಂತರಿಸುವಂತೆ ಸೂಚಿಸಲಾಗಿದೆ.
