Smt. .V. Vijayalakshmi, Under Secretary, Karnataka State Police Complaints Authority ('State Authority' in short) is designated as the Public Information Officer under Section 5(1) of the Right to information Act, 2005 ('Act in short) in respect of the State Authority.

Appeals, if any, under Section 19(1) of the Act shall be before Sri. N.U. Shivu, Private Secretary to Chairman of the Karnataks State Police complaints Authority.

ಮೇಲೆ ಓದಲಾದ ಪತ್ರದಲ್ಲಿ ಹಾಸನ ಜಿಲ್ಲೆ ಅರಕಲಗೂಡು ತಾಲ್ಲೂಕು, ಕಸಬಾ ಹೋಬಳಿ, ಅರಕಲಗೂಡು ಗ್ರಾಮದ ಸ.ನಂ.239 ರಲ್ಲಿ 05-00 ಎಕರೆ ಗೋಮಾಳ ಜಮೀನನ್ನು ಅಲ್ಪಸಂಖ್ಯಾತರ ಮೊರಾರ್ಜಿ ದೇಸಾಯಿ ವಸತಿ ಶಾಲೆಗೆ ಸ್ವಂತ ಕಟ್ಟಡ ಹೊಂದಲು ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ನಿಯಮಗಳು, 1966ರ ನಿಯಮ 97(4)ರಂತೆ ಗೋಮಾಳ ಶೀರ್ಷಿಕೆಯಿಂದ ತಗ್ಗಿಸಿ, ಇದೊಂದು ವಿಶೇಷ ಪ್ರಕರಣವೆಂದು ಪರಿಗಣಿಸಿ, ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ಕಾಯ್ದೆ, 1964ರ ಕಲಂ 71ರಡಿಯಲ್ಲಿ ಕಾಯ್ದಿರಿಸುವ ಕುರಿತು ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ.

ಹಾಸನ ಜಿಲ್ಲೆ, ಅರಕಲಗೂಡು ಗ್ರಾಮದ ಸ.ನಂ.239 ರಲ್ಲಿ ಪಹಣಿ ಪತ್ರಿಕೆ ಪ್ರಕಾರ 41-19 ಎಕರೆ/ಗುಂಟೆ ಜಮೀನು "ಸರ್ಕಾರಿ ಗೋಮಾಳ" ಎಂದು ವರ್ಗೀಕರಣಗೊಂಡಿರುತ್ತದೆಂದು ವರದಿ ಮಾಡಿರುತ್ತಾರೆ. ಆ ಪೈಕಿ 5-00 ಎಕರೆ ಜಮೀನನ್ನು ಅಲ್ಪಸಂಖ್ಯಾತರ ಮೊರಾರ್ಜಿ ದೇಸಾಯಿ ವಸತಿ ಶಾಲೆಯ ಕಟ್ಟಡ ನಿರ್ಮಿಸಲು ಕಾಯ್ದಿರಿಸುವಂತೆ ಕೋರಿದ್ದಾರೆ. ಅರಕಲಗೂಡು ಗ್ರಾಮದಲ್ಲಿ ಜಾನುವಾರುಗಳ ಸಂಖ್ಯೆ 1726 ಇದ್ದು ಒಟ್ಟು 128-24 ಎಕರೆ ಗೋಮಾಳ ಜಮೀನು ಲಭ್ಯವಿರುತ್ತದೆ. ಆದರೆ ನಿಯಮಿಸಲಾದ ಮಿತಿಗಿಂತ ಕಡಿಮೆ ಗೋಮಾಳವಿದ್ದು, ಜಾನುವಾರುಗಳಿಗನುಗುಣವಾಗಿ ಗೋಮಾಳದ ಜಮೀನು ಲಭ್ಯವಿರುವುದಿಲ್ಲ. ಸ.ನಂ.239ರ ಜಮೀನು ಅರಕಲಗೂಡು ಗ್ರಾಮದ ಅಕ್ಕಪಕ್ಕದ ಗ್ರಾಮಗಳಲ್ಲಿ ಲಭ್ಯವಿರುವ ಗೋಮಾಳ ಜಮೀನನ್ನು ಜಾನುವಾರುಗಳ ಮೇವಿಗಾಗಿ ಉಪಯೋಗಿಸಲಾಗುತ್ತಿದೆ ಎಂದು ವರದಿ ಮಾಡಿರುತ್ತಾರೆ. ಆದ್ದರಿಂದ ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ನಿಯಮಗಳು, 1966ರ ನಿಯಮ 97(4)ರನ್ವಯ ಗೋಮಾಳ ಶೀರ್ಷಿಕೆಯಿಂದ ತಗ್ಗಿಸಿ, ಇದೊಂದು ವಿಶೇಷ ಪ್ರಕರಣವೆಂದು ಪರಿಗಣಿಸಿ, ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ಕಾಯ್ದೆ, 1964ರ ಕಲಂ೫೧೪ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಡಿಸೆಂಬರ್ ೨೦, ೨೦೧೮ ಭಾಗ ೨ 71ರಡಿಯಲ್ಲಿ ಅಲ್ಪಸಂಖ್ಯಾತರ ಮೊರಾರ್ಜಿ ದೇಸಾಯಿ ವಸತಿ ಶಾಲೆಯ ಕಟ್ಟಡ ನಿರ್ಮಿಸಲು ಅಲ್ಪಸಂಖ್ಯಾತರ ಕಲ್ಯಾಣ ಇಲಾಖೆಗೆ ಕಾಯ್ದಿರಿಸಲು ಕೋರಿರುತ್ತಾರೆ.

ಮೇಲ್ಕಂಡ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕೂಲಂಕುಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಹಾಸನ ಜಿಲ್ಲೆ, ಅರಕಲಗೂಡು ತಾಲ್ಲೂಕು, ಕಸಬಾ ಹೋಬಳಿ, ಅರಕಲಗೂಡು ಗ್ರಾಮದ ಸ.ನಂ.239 ರಲ್ಲಿ 05-00 ಎಕರೆ ಗೋಮಾಳ ಜಮೀನನ್ನು ಕರ್ನಾಟಕ ಭೂ ಕಂದಾಯ ನಿಯಮಗಳು, 1966ರ ನಿಯಮ 97(4)ರನ್ವಯ ಗೋಮಾಳ ಶೀರ್ಷಿಕೆಯಿಂದ ತಗ್ಗಿಸಿ, ಕರ್ನಾಟಕ ಭೂ ಮಂಜೂರಾತಿ ನಿಯಮಗಳು, 1969ರ ನಿಯಮ 22-ಎ(3)(i)ರನ್ವಯ ಅಲ್ಪಸಂಖ್ಯಾತರ ಮೊರಾರ್ಜಿ ದೇಸಾಯಿ ವಸತಿ ಶಾಲೆಯ ಕಟ್ಟಡ ನಿರ್ಮಿಸಲು ಅಲ್ಪಸಂಖ್ಯಾತರ ಕಲ್ಯಾಣ ಇಲಾಖೆಗೆ ಹಸ್ತಾಂತರಿಸಿದೆ.

ಷರತ್ತುಗಳು:-

1) ಮಂಜೂರಾತಿ ಆದೇಶದಲ್ಲಿ ಪ್ರಸ್ತಾಪಿತ ಜಮೀನಿನ ಪ್ರಚಲಿತ ಮಾರುಕಟ್ಟೆ ದರವನ್ನು ಕಡ್ಡಾಯವಾಗಿ ನಮೂದಿಸತಕ್ಕದ್ದು. 2) ಮಂಜೂರಾದ ಭೂಮಿಯನ್ನು ವಿನಾಶಕಾರಿಯಾದ ಅಥವಾ ಖಾಯಂ ಆಗಿ ಹಾನಿಕಾರಕವಾಗುವ ರೀತಿಯಲ್ಲಿ ಬಳಸತಕ್ಕದ್ದಲ್ಲ. 3) ಮಂಜೂರಾದ ಜಮೀನನ್ನು ಕಂದಾಯ ಇಲಾಖೆಯ ಅನುಮತಿ ಇಲ್ಲದೆ ಮಾರಾಟ ಮಾಡುವುದಾಗಲೀ, ಗುತ್ತಿಗೆ/ ಉಪಗುತ್ತಿಗೆ ನೀಡುವುದಾಗಲೀ, ಅಡಮಾನ, ವರ್ಗಾವಣೆ, ದಾನ, ಇತರೆ ಯಾವುದೇ ರೀತಿಯ ಪರಭಾರೆಯನ್ನು ಮಾಡಬಾರದು.

4) ಮಂಜೂರಾದ ಜಮೀನಿನ ಯಾವುದೇ ಭಾಗವು ಸಾರ್ವಜನಿಕ ಉದ್ದೇಶಕ್ಕೆ ಅಗತ್ಯವಾಗಿದ್ದಲ್ಲಿ ಸರ್ಕಾರವು ಸದರಿ ಜಮೀನನ್ನು ಪರಿಹಾರ ನೀಡದೇ ಹಿಂತೆಗೆದುಕೊಳ್ಳುವ ಹಕ್ಕನ್ನು ಹೊಂದಿರುತ್ತದೆ.

5) ಮಂಜೂರಾದ ಜಮೀನು ಸಂಸ್ಥೆಗೆ ಅವಶ್ಯವಿಲ್ಲವೆಂದು ಕಂಡುಬಂದಲ್ಲಿ ಕಂದಾಯ ಇಲಾಖೆಗೆ ಹಿಂತಿರುಗಿಸತಕ್ಕದ್ದು. 6) ಮಂಜೂರಾದ ಜಮೀನಿನಲ್ಲಿ ಅಭಿವೃದ್ಧಿ ಕಾರ್ಯಗಳನ್ನು ಪ್ರಾರಂಭಿಸುವ ಪೂರ್ವದಲ್ಲಿ ಶಾಸನಬದ್ದವಾಗಿ ಪಡೆಯಬೇಕಾದ ಪರವಾನಗಿಗಳನ್ನು ಸಂಬಂಧಿತ ಪ್ರಾಧಿಕಾರಗಳಿಂದ ಪಡೆಯತಕ್ಕದ್ದು ಹಾಗೂ ನಿಯಮಾನುಸಾರ ಪಾವತಿಸಬೇಕಾದ ಎಲ್ಲಾ ರೀತಿಯ ಶುಲ್ಕಗಳನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಪಾವತಿಸತಕ್ಕದ್ದು.
