ಕರ್ನಾಟಕಸಕಾಲ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 2011ರ (ಕರ್ನಾಟಕಅಧಿನಿಯಮ 01, 2012) ಇವರ ಕಲಂ 04ರಲ್ಲಿನ ಹಾಗೂ ಕರ್ನಾಟಕ ಸಾಮಾನ್ಯ ಖಂಡಗಳ ಅಧಿನಿಯಮ 1899ರ 21 (KA III ¹⁸⁹⁹)ರಲ್ಲಿ ಪ್ರದತ್ತವಾಗಿರುವಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಸದರಿಅಧಿನಿಯಮದಅನುಸೂಚಿಯಲ್ಲಿ ಈ ಕೆಳಗಿನಂತೆ ತಿದ್ದುಪಡಿ ಮಾಡಿದೆ.

In exercise of powers conferred by sub-section (1) of Section 8 of the Factories Act 1948 (central Act LXIII of 1948) and sub- section (3) of Section 42 of Building and other Construction Workers (Regulation of Employment and Service Conditions) Act 1996 and in supersession of the notifications issued on behalf of the said Acts, the Government of Karnataka hereby appoints the officers specified in column (2) of the table below to be the inspectors for the purpose of the Factories Act, 1948 and Sections 38,39 & 40 of Building and other Construction Workers (Regulation of Employment and Service Conditions) Act 1996 and Rules 50 to 251 of Building and other Construction Workers (Regulation of Employment and Service Conditions) Karnataka Rules, 2006 for the Building & other construction projects of the cost exceeding Rs. 25 Crores and has assigned the limits specified in the corresponding column (3) thereof as the local limits within which each officer shall exercise the powers and performs the duties bestowed on them under this Acts with immediate effect and until further orders.

Whereas the Government of Karnataka having regard to the circumstances prevailing in the State are satisfied that it is necessary that the District Commissioners and District Magistrates and the Commissioners of Police in the State be emprowered to exercise the powers under sub-section (2) of section 3 of the Karnataka Prevention of Dangerous Activities of Boot-leggers, Drug-Offenders, Gamblers, Goondas, immoral Traffic Offenders, Slum-Grabbers and Video or Audio Pirates Act, 1985 (Karnataka Act No.12 of 1985).

Now, therefore in exercise of the powers conferred by sub-section (2) of Section 3 of the Karnataka Prevention of Dangerous Activities of Boot-leggers, Drug-Offenders, Gamblers, Goondas, immoral Traffic Offenders, Slum-Grabbers and Video or Audio Pirates Act, 1985 (Karnataka Act No.12 of 1985) the Government of Karnataka hereby direct that the District Magistrates and the Commissioners of Police in the State shall exercise the powers conferred by sub-section (1) of Section 3 of the Act within the limits of their jurisdiction for a period of three months from 10.12.2018 to 09.03.2019.

ಕರ್ನಾಟಕ ರಾಜ್ಯದಾದ್ಯಂತ "ಕಾಫಿ ಕ್ಯೂರಿಂಗ್" ಉದ್ದಿಮೆಯಲ್ಲ್ಲಿ ಯಾವುದೇ ಕೆಲಸದಲ್ಲಿ ತೊಡಗಿರುವ ಕಾರ್ಮಿಕರಿಗೆ ಈ ಕೆಳಕಂಡ "ಕನಿಷ್ಠ ವೇತನ ಕೋಷ್ಟಕ" ದಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿರುವಂತೆ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ಪರಿಷ್ಕರಿಸಲು ರಾಜ್ಯ ಸರ್ಕಾರವು ಪ್ರಸ್ತಾಪಿಸಿದೆ. ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ 1948 (ಕೇಂದ್ರ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: XI) ರ ಕಲಂ 3(1)(ಬಿ) ಮತ್ತು 5(1)(ಬಿ) ರಡಿಯಲ್ಲಿ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಈ ಕರಡು ಅಧಿಸೂಚನೆಯನ್ನು ಪ್ರಕಟಿಸಲಾಗಿದೆ. ಈ ಕರಡು ಅಧಿಸೂಚನೆಯನ್ನು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಲಾದ ದಿನಾಂಕದಿಂದ ಎರಡು (2) ತಿಂಗಳ ಅವಧಿಯೊಳಗೆ ಭಾದಿತರಾಗುವ ವ್ಯಕ್ತಿಗಳಿಂದ / ಉದ್ಯೋಗದಾತರಿಂದ / ಉದ್ಯೋಗಿಗಳಿಂದ / ಸಂಘ ಸಂಸ್ಥೆಗಳಿಂದ ಸಲಹೆಗಳನ್ನು ಹಾಗೂ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಸರ್ಕಾರದಿಂದ ಸ್ವೀಕರಿಸಲಾಗುವುದು. ತದನಂತರ ಬಂದ ಸಲಹೆಗಳನ್ನು ಹಾಗೂ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದಿಲ್ಲ. ಈ ಕುರಿತು ಸಲಹೆಗಳು ಹಾಗೂ ಆಕ್ಷೇಪಣೆಗಳೇನಾದರೂ ಇದ್ದಲ್ಲಿ ಸಾರ್ವಜನಿಕರು / ಉದ್ಯೋಗದಾತರು / ಉದ್ಯೋಗಿಗಳು / ಸಂಘ ಸಂಸ್ಥೆಗಳು ಅವುಗಳನ್ನು ಸರ್ಕಾರದ ಕಾರ್ಯದರ್ಶಿಗಳು, ಕಾರ್ಮಿಕ ಇಲಾಖೆ, ಕರ್ನಾಟಕ ಸರ್ಕಾರ, 4ನೇ ಮಹಡಿ, ವಿಕಾಸ ಸೌಧ, ಬೆಂಗಳೂರು-560001 ಅಥವಾ ಕಾರ್ಮಿಕ ಆಯುಕ್ತರು, ಕಾರ್ಮಿಕ ಭವನ, ಬನ್ನೇರುಘಟ್ಟ ರಸ್ತೆ, ಡೈರಿ ಸರ್ಕಲ್, ಬೆಂಗಳೂರು- 560029 ಇವರಿಗೆ ಸಲ್ಲಿಸಬಹುದಾಗಿರುತ್ತದೆ.

ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ 1948ರ ಕಲಂ 3(1)(ಬಿ) ಮತ್ತು 5(1)(ಬಿ)ರಡಿಯಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ "ಕನಿಷ್ಠ ವೇತನ ಕೋಷ್ಟಕ" ದಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವಂತೆ, ಕರ್ನಾಟಕ ರಾಜ್ಯದಾದ್ಯಂತ ಕನಿಷ್ಠ ವೇತನ ದರಗಳು ಜಾರಿಗೆ ಬರುವಂತೆ ಈ ಮೂಲಕ ಪರಿಷ್ಕರಿಸಲು ಪ್ರಸ್ತಾಪಿಸಿದೆ.

ಮೇಲ್ಕಂಡ ಕೋಷ್ಟಕದಲ್ಲಿಯ ಪರಿಷ್ಕ್ರತ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡ ಷರತ್ತುಗಳಿಗೊಳಪಟ್ಟು ನಿಗದಿಪಡಿಸಿದ್ದು, ಈ ಎಲ್ಲಾ

ಷರತ್ತುಗಳನ್ನು ಯಥಾವತ್ತಾಗಿ ಸಂಬಂಧಿಸಿದ ಉದ್ಯೋಗದಾತರು ಪಾಲಿಸಲು ಬಾದ್ಯಸ್ಥರಿರುತ್ತಾರೆ;

1. ವ್ಯತ್ಯಾಸವಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯ ಲೆಕ್ಕಾಚಾರ ಹಾಗೂ ಪಾವತಿ: ನಿಗಧಿತ ಕನಿಷ್ಠ ವೇತನ ಕ್ಕನುಗುಣವಾಗಿ ಪಾವತಿಸಬೇಕಾದ ವ್ಯತ್ಯಸ್ಥವಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯ ಲೆಕ್ಕಾಚಾರವನ್ನು ವರ್ಷಕ್ಕೊಮ್ಮೆ ಉದ್ಯೋಗದಾತರು ಮಾಡತಕ್ಕದ್ದು. ಹಿಂದಿನ ಕ್ಯಾಲೆಂಡರ್ ವರ್ಷದ ಹನ್ನೆರಡು (12) ತಿಂಗಳುಗಳ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕಗಳ ವಾರ್ಷಿಕ ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ ಹೆಚ್ಚುವರಿಯಾದ ಅಥವಾ ಕಡಿಮೆಯಾದ ಪ್ರಮಾಣವನ್ನು ಆಧರಿಸಿ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಪ್ರತಿ ವರ್ಷದ ಏಪ್ರಿಲ್ ಮೊದಲನೇ ದಿನಾಂಕದಿಂದ ಅನ್ವಯವಾಗುವಂತೆ ಉದ್ಯೋಗದಾತರು ಪ್ರತಿ ವರ್ಷ ಲೆಕ್ಕಾಚಾರ ಮಾಡಿ ಕಾರ್ಮಿಕರಿಗೆ ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು. ಆದುದರಿಂದ ಮೊದಲ ಲೆಕ್ಕಾಚಾರವು ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕದ (ಜನವರಿ 2016 ರಿಂದ ಡಿಸೆಂಬರ್ 2016ರ) ಸರಾಸರಿ ಆಧಾರದ ಮೇಲೆ 2017 ಏಪ್ರಿಲ್ ಒಂದ (1) ನೇ ತಾರೀಖಿನಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ. ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕ 6843 ಅಂಶಗಳಿಗಿಂತ ಹೆಚ್ಚಾಗುವ ಪ್ರತಿ ಅಂಶಕ್ಕೆ ಎಲ್ಲಾ ವರ್ಗದ ಕಾರ್ಮಿಕರಿಗೆ ದಿನ ಒಂದಕ್ಕೆ ನಾಲ್ಕು (4) ಪೈಸೆಯಂತೆ ಈ ಕೆಳಕಂಡ ವಿಧಾನದನ್ವಯ ಲೆಕ್ಕಾಚಾರ ಮಾಡಿ ತುಟ್ಟಿ ಭತ್ಯೆಯನ್ನು ಉದ್ಯೋಗದಾತರು ಪಾವತಿಸತಕ್ಕದ್ದು.

ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಲೆಕ್ಕಾಚಾರ ಮಾಡುವ ವಿಧಾನ:- ಮಾಸಿಕ ತುಟ್ಟಿಭತ್ಯೆ ಹಾಗೂ ದಿನದ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಕೆಳಕಂಡ ಸೂತ್ರಗಳನ್ವಯ ಕ್ರಮವಾಗಿ ಲೆಕ್ಕಾಚಾರ ಮಾಡತಕ್ಕದ್ದು;

ಅ) ಮಾಸಿಕ ವೇತನವನ್ನು ಪಡೆಯುವವರು:- ಮಾಸಿಕ ವೇತನ ಪಡೆಯುವ ಕಾರ್ಮಿಕರಿಗೆ ಈ ಕೆಳಕಂಡ ಸೂತ್ರದನ್ವಯ ತುಟಿಭತ್ಯೆಯನ್ನು ಲೆಕ್ಕ ಮಾಡತಕ್ಕದ್ದು ಹಾಗೂ ಲೆಕ್ಕಾಚಾರ ಮಾಡಿದಾಗ ಬಂದ ದರವು ಭಿನ್ನಾಂಕವಾಗಿದ್ದಲ್ಲಿ, ಅದನ್ನು ಸಮೀಪದ ರೂಪಾಯಿಗೆ ಪೂರ್ಣಗೊಳಿಸಿ ಪಾವತಿಸತಕ್ಕದ್ದು.

ಮಾಸಿಕ ತುಟ್ಟಿಭತ್ಯೆ = ಪ್ರತಿ ವರ್ಷ ಹೆಚ್ಚಾಗುವ ಅಥವಾ ಕಡಿಮೆಯಾಗುವ ಗ್ರಾಹಕ ಬೆಲೆ

ಸೂಚ್ಯಾಂಕದ ಅಂಶಗಳು (ಸಿ.ಪಿ.ಐ) x ತುಟ್ಟಿಭತ್ಯೆಯ ದರ x ಮೂವತ್ತು (30) ದಿನಗಳು

ಆ) ದಿನಗೂಲಿ ವೇತನ ಪಡೆಯುವವರು :- ದಿನಗೂಲಿ ಪಡೆಯುವ ಕಾರ್ಮಿಕರಿಗೆ ಮಾಸಿಕ ಕನಿಷ್ಠ ವೇತನ ದರವನ್ನು ಇಪ್ಪತ್ತಾರು (26) ದಿನಗಳಿಂದ ವಿಭಾಗಿಸಿ, {ನಾಲ್ಕು (4) ವಾರದ ರಜಾ ದಿನಗಳಿಗೆ ವೇತನವನ್ನು ನೀಡುವುದೂ ಸೇರಿದಂತೆ} ಈ ಕೆಳಕಂಡ ಸೂತ್ರದನ್ವಯ ಲೆಕ್ಕ ಮಾಡತಕ್ಕದ್ದು. ಲೆಕ್ಕಾಚಾರ ಮಾಡಿದಾಗ ಬಂದ ದರವು ಭಿನ್ನಾಂಕವಾಗಿದ್ದಲ್ಲಿ, ಅದನ್ನು ಸಮೀಪದ ರೂಪಾಯಿಗೆ ಉದ್ಯೋಗದಾತರು ಪೂರ್ಣಗೊಳಿಸಿ ಅರ್ಹರಾದ ಕಾರ್ಮಿಕರಿಗೆ ಪಾವತಿಸತಕ್ಕದ್ದು.

ದಿನದ ತುಟ್ಟಿಭತ್ಯೆ = ಪ್ರತಿ ವರ್ಷ ಹೆಚ್ಚಾಗುವ ಅಥವಾ ಕಡಿಮೆಯಾಗುವ ಗ್ರಾಹಕ ಬೆಲೆ ಸೂಚ್ಯಾಂಕದ ಅಂಶಗಳು (ಸಿ.ಪಿ.ಐ) x ತುಟ್ಟಿಭತ್ಯೆಯ ದರ x ಮೂವತ್ತು(30) ದಿನಗಳು / ಇಪ್ಪತ್ತಾರು (26)

2. ಸೇವಾ ಹಿರಿತನ ಪರಿಗಣನೆ ಭತ್ಯೆ : ಈ ಅಧಿಸೂಚನೆ ಜಾರಿಗೆ ಬಂದ ದಿನಾಂಕದಿಂದ ಯಾವುದೇ ಕಾರ್ಮಿಕನು ಒರ್ವ ಉದ್ಯೋಗದಾತರ ಸಂಸ್ಥೆಯಲ್ಲಿ ಅಥವಾ ಮಾಲೀಕರ ಅಧೀನದಲ್ಲಿ ನಿರಂತರ ಹತ್ತು (10) ವರ್ಷಗಳ ಸೇವೆಯನ್ನು ಸಲ್ಲಿಸಿದಲ್ಲಿ, ತನ್ನ ಪೂರ್ಣಗೊಳಿಸಿದ ಪ್ರತಿ ಹತ್ತು ವರ್ಷದ ಮೇಲ್ಪಟ್ಟ ಸೇವೆಗೆ ಅನುಗುಣವಾಗಿ ಆಯಾ ಕಾರ್ಮಿಕ ವರ್ಗಕ್ಕೆ ನಿಗದಿಪಡಿಸಿರುವ ಒಟ್ಟು ಮಾಸಿಕ ಕನಿಷ್ಠ ಮೂಲ ವೇತನದ ಮೇಲೆ ವರ್ಷವೊಂದರ ಸೇವೆಗೆ ಶೇಕಡಾ ಒಂದ (1) ರಷ್ಟು ಮೊತ್ತವನ್ನು ಸೇವಾ ಹಿರಿತನ ಪರಿಗಣನೆ ಭತ್ಯೆಯನ್ನಾಗಿ ಗರಿಷ್ಠ ಶೇಕಡಾ ಹತ್ತು (10) ರ ಮೇಲ್ಮಿತಿಗೆ ಒಳಪಟ್ಟು ಪಡೆಯಲು ಕಾರ್ಮಿಕರು ಅರ್ಹರಿರುತ್ತಾರೆ. ಪರಂತು ಈ ಅಧಿಸೂಚನೆ ಜಾರಿಗೆ ಬಂದ ದಿನಾಂಕಕ್ಕೆ ಇಪ್ಪತ್ತು (20) ವರ್ಷಕ್ಕಿಂತ ಹೆಚ್ಚಿನ ಸೇವೆಯನ್ನು ಸಲ್ಲಿಸಿದ ಕಾರ್ಮಿಕರಿದ್ದಲ್ಲಿ ಒಂದು ಸಲಕ್ಕೆ ಮಾತ್ರ ಸೇವಾ ಹಿರಿತನ ಮೊತ್ತವನ್ನು ಆಯಾ ಕಾರ್ಮಿಕ ವರ್ಗಕ್ಕೆ ನಿಗಧಿಪಡಿಸಿರುವ ಒಟ್ಟು ಮಾಸಿಕ ಕನಿಷ್ಠ ವೇತನದಭಾಗ ೪ಎ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜನವರಿ ೩, ೨೦೧೯ ೧೩ ಶೇ 10ರ ಗರಿಷ್ಠಮಿತಿಗೆ ಒಳಪಟ್ಟು ಪಡೆಯಲು ಅರ್ಹರಿರುತ್ತಾರೆ. ಈ ಸೇವಾ ಹಿರಿತನ ಪರಿಗಣನೆ ಭತ್ಯೆಯ ಮೊತ್ತವು ಮೇಲ್ಕಂಡ ಷರತ್ತು ಸಂಖ್ಯೆ 1ರಲ್ಲಿ ವಿಧಿಸಿದ ವ್ಯತ್ಯಾಸವಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಹೊರತುಪಡಿಸಿ, ಮೂಲವೇತನದ ಆಧಾರದಲ್ಲಿ ನಿಗದಿಪಡಿಸಿದ 'ಸೇವಾ ಹಿರಿತನದ ಪರಿಗಣನೆ ಭತ್ಯೆಯ ಮೊತ್ತ' ವಾಗಿರುತ್ತದೆ.

ವಿವರಣೆ: "ನಿರಂತರ ಸೇವೆಯನ್ನು ಲೆಕ್ಕ ಮಾಡಬೇಕಾದಾಗ ಹಿಂದಿನ ಆರ್ಥಿಕ ವರ್ಷದಲ್ಲಿ, ಸದರಿ ಸಂಸ್ಥೆಯಲ್ಲಿ ಕನಿಷ್ಠ ಎರಡು ನೂರ ನಲವತ್ತು (240) ದಿನಗಳು ಸೇವೆ ಸಲ್ಲಿಸಿದ ಕಾರ್ಮಿಕನು ಸದರಿ ವರ್ಷದಲ್ಲಿ ನಿರಂತರ ಸೇವೆ ಸಲ್ಲಿಸಿರುತ್ತಾನೆಂದು ಉದ್ಯೋಗದಾತರು ಪರಿಗಣಿಸತಕ್ಕದ್ದು" 3. ಮಹಿಳೆಯರಿಗೆ ಸಮಾನ ವೇತನ : ಮಹಿಳೆಯರು ಮತ್ತು ಪುರುಷರು ಒಂದೇ ರೀತಿಯ ಹಾಗೂ ಸಮ ಪ್ರಮಾಣದ ಕೆಲಸವನ್ನು ನಿರ್ವಹಿಸಿದ ಸಂದರ್ಭಗಳಲ್ಲಿ ಉಭಯತ್ರಯರಿಗೂ ಸಮಾನ ದರದ ವೇತನಗಳನ್ನು ಉದ್ಯೋಗದಾತರು ಸಮಾನ ವೇತನ ಕಾಯ್ದೆ-1976ರ ಪ್ರಾವಧಾನಗಳನ್ವಯ ಮಹಿಳಾ ಕಾರ್ಮಿಕರಿಗೆ ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು. 4. ಕಾರ್ಮಿಕರ ಹಕ್ಕುಗಳ ರಕ್ಷಣೆ: ಯಾವುದೇ ಪ್ರದೇಶ ಅಥವಾ ಸಂಸ್ಥೆಯಲ್ಲಿ ಕೆಲಸ ನಿರ್ವಹಿಸುತ್ತಿರುವ ಕಾರ್ಮಿಕರು ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಿಗದಿಪಡಿಸಿರುವ ಕನಿಷ್ಠ ವೇತನದ ದರಗಳಿಗಿಂತ ಹೆಚ್ಚಿನ ವೇತನವನ್ನು ಈಗಾಗಲೇ ಕೈಗಾರಿಕಾ ವಿವಾದಗಳ ಕಾಯ್ದೆ-1947 ರಡಿಯಲ್ಲಿಯ ಒಪ್ಪಂದ, ಕರಾರು ಅಥವಾ ಬೇರೆ ಯಾವುದೇ ರೀತಿಯನ್ವಯ ಪಡೆಯುತ್ತಿದ್ದಲ್ಲಿ, ಸದರಿ ಹೆಚ್ಚಿನ ವೇತನವನ್ನು ಮುಂದುವರೆದು ಪಡೆಯಲು ಕಾರ್ಮಿಕರು ಅರ್ಹರಾಗಿದ್ದು, ಅದನ್ನು ಪಾವತಿಸಲು ಉದ್ಯೋಗದಾತರು ಬಾಧ್ಯಸ್ಥರಿರುತ್ತಾರೆ.

5. ಸಮರೂಪದ ಕೆಲಸದ ವರ್ಗಗಳಿಗೆ ಸಮನಾದ ವೇತನ: ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಕೆಲಸದ ಸ್ವರೂಪದ ವರ್ಗವನ್ನು ನಮೂದಿಸದೇ ಇರುವ ಕೆಲಸದ ಸ್ವರೂಪದ ವರ್ಗಗಳಿಗೆ ಸೇರಿದ ಕಾರ್ಮಿಕರಿಗೆ ಅದೇ ಸ್ವರೂಪದ (ಸಮಾನ) ಕೆಲಸ ನಿರ್ವಹಿಸುತ್ತಿರುವ ಇತರೆ ಕೆಲಸದ ಸ್ವರೂಪದ ವರ್ಗದ ಕಾರ್ಮಿಕರಿಗೆ ಪಾವತಿ ಮಾಡುತ್ತಿರುವ ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು. ಈ ಕುರಿತು ಯಾವುದೇ ವಿವಾದ ಉದ್ಬವಿಸಿದಲ್ಲಿ, ಸಂಬಂಧಿಸಿದ ಉದ್ಯೋಗದಾತರು ಒಂದು ತ್ರಿಪಕ್ಷಿಯ (ಸ್ವತಂತ್ರ ಸದಸ್ಯರು-3, ಕಾರ್ಮಿಕ ಪ್ರತಿನಿಧಿಗಳು -3 ಹಾಗೂ ಉದ್ಯೋಗದಾತರು-3, ಹೀಗೆ ಒಟ್ಟು ಒಂಬತ್ತು ಜನರ) ಸಮಿತಿಯನ್ನು ರಚಿಸಿ, ಸದರಿ ಸಮಿತಿಯು ಸ್ವಾಭಾವಿಕ ನ್ಯಾಯತತ್ವಗಳನ್ನು ಪರಿಪಾಲಿಸಿ, ಪಕ್ಷಗಾರರ ವಾದಗಳನ್ನು ಆಲಿಸಿ, ಎಲ್ಲಾ ವಿವಾದಾಂಶಗಳನ್ನು ಹಾಗೂ ಕೆಲಸದ ಕೌಶಲ್ಯದ ವರ್ಗವನ್ನು ಸಹ ವಿಶ್ಲೇಷಿಸಿ ಎರಡು ತಿಂಗಳ ಅವಧಿಯೊಳಗೆ ನೀಡುವ ಕನಿಷ್ಠ ವೇತನ ದರದ ವರದಿಯನ್ವಯ ಕ್ರಮವಹಿಸತಕ್ಕದ್ದು.

ಸದರಿ ವರದಿಯ ಅನುಷ್ಠಾನಕ್ಕಾಗಿ "ಸಕ್ಷಮ ಅಧಿಕಾರಿ"ಯನ್ನು ಉದ್ಯೋಗದಾತರು ನಿಯುಕ್ತಿಗೊಳಿಸತಕ್ಕದ್ದು. ಸಕ್ಷಮ ಅಧಿಕಾರಿಯ ವರದಿ ಅನುಷ್ಠಾನ ಕ್ರಮದ ಬಗ್ಗೆ ಅಥವಾ ವರದಿಯ ಬಗ್ಗೆ ವಿವಾದವಿದ್ದಲ್ಲಿ, ಈ ಕುರಿತು "ಮೇಲ್ಮನವಿ ಪ್ರಾಧಿಕಾರಿ"ಯನ್ನು ಸಹ ನಿಯುಕ್ತಿಗೊಳಿಸಿ, ಉದ್ಯೋಗದಾತರು ಅಧಿಸೂಚನೆಯನ್ನು ಹೊರಡಿಸತಕ್ಕದ್ದು. ಒಂದು ತಿಂಗಳ ಕಾಲಮಿತಿಯೊಳಗೆ 'ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರಿ' ಹಾಗೂ 'ಮೇಲ್ಮನವಿ ಪ್ರಾಧಿಕಾರಿ' ಗಳು ಸ್ವಾಭಾವಿಕ ನ್ಯಾಯತತ್ವಗಳನ್ವಯ ಪ್ರಕರಣಗಳ ಇತ್ಯರ್ಥಕ್ಕೆ ಕ್ರಮವಹಿಸತಕ್ಕದ್ದು. 'ಮೇಲ್ಮನವಿ ಪ್ರಾಧಿಕಾರಿ' ಯ ನಿರ್ಣಯವು ಅಂತಿಮವಾಗಿದ್ದು, ಅದನ್ನು ಪಾಲಿಸಲು ಎಲ್ಲಾ ಪಕ್ಷಗಾರರು ಬಾಧ್ಯಸ್ಥರಿರುತ್ತಾರೆ. 6. ಕನಿಷ್ಠ ವೇತನ ಸ್ವೀಕರಿಸುವ ಹಕ್ಕಿನ ರಕ್ಷಣೆ: ತುಂಡು ಆಧಾರದ ಮೇಲೆ ಕೆಲಸ ಮಾಡುವ ಕಾರ್ಮಿಕರ ಎಂಟು (8) ಗಂಟೆಗಳ ಕೆಲಸದ ವೇತನವು ಅದೇ ಸ್ವರೂಪದ (ತರಹದ) ಕೆಲಸ ಮಾಡುವ ಕಾರ್ಮಿಕರ ಒಂದು ದಿನದ ವೇತನಕ್ಕಿಂತ ಕಡಿಮೆ ಇರದಂತೆ ಉದ್ಯೋಗದಾತರು ಕ್ರಮವಹಿಸತಕ್ಕದ್ದು. ಈ ಬಗ್ಗೆ ವಿವಾದವಿದ್ದಲ್ಲಿ ಮೇಲ್ಕಂಡ ಷರತ್ತು ಸಂಖ್ಯೆ-5 ರಲ್ಲಿಯ ವಿವಾದ-ಪರಿಹಾರ ವ್ಯವಸ್ಥೆಯನ್ನು ಉದ್ಯೋಗದಾತರು ಸೃಷ್ಟಿಸಿ, ಕಾನೂನುಸಮ್ಮತ ಪರಿಹಾರವನ್ನು ರೂಪಿಸತಕ್ಕದ್ದು.

7. ದುಡಿಮೆಯ ಅವಧಿಯ ಪ್ರಮಾಣಕ್ಕನುಗುಣವಾಗಿ ಕನಿಷ್ಠ ವೇತನ: ಒಂದು ದಿನದಲ್ಲಿ ನಾಲ್ಕು ಗಂಟೆ ಅಥವಾ ಅದಕ್ಕೂ ಹೆಚ್ಚು ಅವಧಿಗೆ ಕಾರ್ಮಿಕರು ಕಾರ್ಯನಿರ್ವಹಿಸಿದಲ್ಲಿ, ಒಂದು ದಿನದ ಕನಿಷ್ಠ ವೇತನವನ್ನು ಕಾರ್ಮಿಕರಿಗೆ ಪಾವತಿಸತಕ್ಕದ್ದು. ಒಂದು ದಿನದಲ್ಲಿ ಕಾರ್ಮಿಕರು ನಾಲ್ಕು ಗಂಟೆಗಳಿಗಿಂತ ಕಡಿಮೆ ಅವಧಿಯ ಕೆಲಸ ನಿರ್ವಹಿಸಿದಲ್ಲಿ, ಗಂಟೆಗಳ ವೇತನ ದರದ ಆಧಾರದಲ್ಲಿ ದುಡಿಮೆಯ ಅವಧಿಗೆ ಲೆಕ್ಕ ಹಾಕಿ, ಕನಿಷ್ಠ ವೇತನವನ್ನು ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು.

8. ಕನಿಷ್ಠ ವೇತನದ ಪಾವತಿಯ ವಿಧಾನ : ನಿಗಧಿತ ಕನಿಷ್ಠ ವೇತನದ ಮೂಲವೇತನ ಹಾಗೂ ತುಟ್ಟಿಭತ್ಯೆ ಲೆಕ್ಕಾಚಾರದಲ್ಲಿ ರೂಪಾಯಿಯ ಭಾಗಾಂಶವು ಬಂದ ಪಕ್ಷದಲ್ಲಿ ಅದನ್ನು ಸಮೀಪದ ಹೆಚ್ಚಿನ ರೂಪಾಯಿಗೆ ಉದ್ಯೋಗದಾತರು ಪೂರ್ಣಗೊಳಿಸಿ, ಕಾರ್ಮಿಕರಿಗೆ ಪಾವತಿಸತಕ್ಕದ್ದು.

9. ಬ್ಯಾಂಕ್ ಖಾತೆಯ ಮೂಲಕ ವೇತನ ಪಾವತಿ: ವೇತನ ಪಾವತಿ ಕಾಯ್ದೆ-1936ರ ಕಲಂ 6 ರ ಪ್ರಾವಧಾನದ ಅನ್ವಯ ಕಾರ್ಮಿಕರಿಗೆ ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು ನೇರವಾಗಿ ಕಾರ್ಮಿಕರ ಬ್ಯಾಂಕ್ ಖಾತೆಗೆ ವರ್ಗಾಯಿಸುವ ಮೂಲಕ ಪಾವತಿಸತಕ್ಕದ್ದು.

10. ಗುತ್ತಿಗೆ ಕಾರ್ಮಿಕರಿಗೆ ಕನಿಷ್ಠ ವೇತನ ದರಗಳ ಅನ್ವಯಿಸುವಿಕೆ: ಈ ಅನುಸೂಚಿತ ಉದ್ದಿಮೆಗೆ ಒಳಪಡುವ ಸಂಸ್ಥೆಗಳಲ್ಲಿ ಹೊರಗುತ್ತಿಗೆ ವ್ಯವಸ್ಥೆಯ ಮೂಲಕ ಗುತ್ತಿಗೆ ಕಾರ್ಮಿಕ (ನಿಷೇದ ಮತ್ತು ನಿಯಂತ್ರಣ) ಕಾಯ್ದೆ-1970 ಹಾಗೂ ಇತರೆ ಶಾಸನಬದ್ದ ವ್ಯವಸ್ಥೆಗಳನ್ವಯ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿರುವ ಕಾರ್ಮಿಕರಿಗೂ ಕೂಡಾ ಈ ಪರಿಷ್ಕ್ರತ ಕನಿಷ್ಠ ವೇತನ ದರಗಳನ್ನು ಉದ್ಯೋಗದಾತರು ಅನ್ವಯಿಸಿ, ಪಾವತಿಯನ್ನು ಮಾಡತಕ್ಕದ್ದು.

11. ಸಾಮಾಜಿಕ ಭದ್ರತೆಯ ಕಾಯ್ದೆಗಳಡಿಯಲ್ಲಿ ಉದ್ಯೋಗದಾತರ ವಂತಿಗೆಯ ಪಾವತಿ: ಕನಿಷ್ಠ ವೇತನದ ಮೊತ್ತವು (ಮೂಲ ವೇತನ + ತುಟ್ಟಿಭತ್ಯೆ) ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸಿದ ಕಾರ್ಮಿಕನ ಅರ್ಜಿತ ವೇತನವಾಗಿದ್ದು, ಉದ್ಯೋಗದಾತರು ಈ ಕೆಳಕಂಡ ಕಾಯ್ದೆಗಳಡಿಯಲ್ಲಿ ಪಾವತಿಸಬೇಕಾದ "ಉದ್ಯೋಗದಾತರ ವಂತಿಗೆ" ಯನ್ನು ಕಾರ್ಮಿಕರ ಅರ್ಜಿತ ಕನಿಷ್ಠ ವೇತನದ ಮೊತ್ತದಿಂದ ಕಡಿತಗೊಳಿಸದೆ, ಪ್ರತ್ಯೇಕವಾಗಿ ಉದ್ಯೋಗದಾತರ ಸಂಪನ್ಮೂಲದಿಂದಲೇ ಪಾವತಿ ಮಾಡತಕ್ಕದ್ದು;

1. ನೌಕರರ ರಾಜ್ಯ ವಿಮಾ ಕಾಯ್ದೆ-1948

2. ನೌಕರರ ಭವಿಷ್ಯ ನಿಧಿ ಹಾಗೂ ಇತರೆ ಪ್ರಾವಧಾನಗಳ ಕಾಯ್ದೆ-1952.

12. ರಜಾದಿನದಲ್ಲಿಯ ದುಡಿಮೆಯ ವೇತನ : ಕನಿಷ್ಠ ವೇತನ ಕೋಷ್ಠಕದಲ್ಲಿ ತೋರಿಸಿರುವ ವೇತನ ದರಗಳು ಒಂದು ತಿಂಗಳಿನಲ್ಲಿ ಬರುವ ವಾರದ ರಜಾ ದಿನಗಳ ವೇತನವನ್ನು ಒಳಗೊಂಡಿದ್ದು, ಸದರಿ ವಾರದ ರಜೆಯನ್ನು ಉದ್ಯೋಗದಾತರು / ಗುತ್ತಿಗೆದಾರರು ಕಡ್ಡಾಯವಾಗಿ ನೌಕರರಿಗೆ ನೀಡತಕ್ಕದ್ದು. ವಾರದ ರಜಾ ದಿನಗಳಂದು ಕಾರ್ಮಿಕರು ಕೆಲಸವನ್ನು ಮಾಡಿದ್ದಲ್ಲಿ, ದ್ವಿಗುಣ ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು / ಗುತ್ತಿಗೆದಾರರು ಕಾರ್ಮಿಕರಿಗೆ ಪಾವತಿಸತಕ್ಕದ್ದು.

ರಾಷ್ಟೀಯ ಹಾಗೂ ಹಬ್ಬದ ಸರ್ಕಾರಿ ರಜಾ ದಿನಗಳಂದು ಸದರಿ ಕಾರ್ಮಿಕರು ಕೆಲಸ ನಿರ್ವಹಿಸಿದಲ್ಲಿ, ಉದ್ಯೋಗದಾತರು / ಗುತ್ತಿಗೆದಾರರು ಅವರಿಗೆ ಸದರಿ ದಿನಕ್ಕೆ ಅನ್ವಯಿಸುವ ವೇತನದ ದ್ವಿಗುಣ ವೇತನವನ್ನು ಪಾವತಿಸಕ್ಕದ್ದು, ಅಥವಾ ಆ ಒಂದು ದಿನದ ವೇತನ ಹಾಗೂ ಒಂದು ವೇತನ ಸಹಿತವಾದ ಪರ್ಯಾಯ ರಜೆಯನ್ನು ಯಾವುದಾದರೊಂದು ದಿನ ಕಾರ್ಮಿಕರಿಗೆ ನೀಡತಕ್ಕದ್ದು.

13. ಹೆಚ್ಚುವರಿ ಅವಧಿ ದುಡಿಮೆಯ ವೇತನ: ಕೆಲಸಗಾರರು ದಿನದ ನಿಗಧಿತ ಅವಧಿಗಿಂತ ಹೆಚ್ಚು ಸಮಯ ಕೆಲಸ ನಿರ್ವಹಿಸಿದಲ್ಲಿ ಅಂತಹ ಕಾರ್ಮಿಕರಿಗೆ ಹೆಚ್ಚುವರಿ ಅವಧಿಯ ಕೆಲಸಕ್ಕೆ ಕನಿಷ್ಠ ವೇತನ ಕಾಯ್ದೆ-1948 ರ ಕಲಂ 14 ರನ್ವಯ ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು ಪಾವತಿಸತಕ್ಕದ್ದು.

14. ಅಪ್ರೆಂಟೈಸ್ ಅವಧಿಯ ವೇತನ : ಯಾವುದೇ ಉದ್ಯೋಗದಾತರ ಸಂಸ್ಥೆಯಲ್ಲಿ ಸೇವಾನುಭವ ಪಡೆಯುವುದಕ್ಕಾಗಿ ದಿ ಅಪ್ರೆಂಟೈಸ್ ಕಾಯ್ದೆ -1961 ರ ಪ್ರಾವಧಾನಗಳನ್ವಯ ತರಬೇತಿ ಪಡೆಯುವ ಅಪ್ರೆಂಟೈಸ್‌ಗಳಿಗೆ ದಿ ಅಪ್ರೆಂಟೈಸ್ ಕಾಯ್ದೆ -1961 ರ ಪ್ರಾವಧಾನಗಳನ್ವಯ ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು ಪಾವತಿಸತಕ್ಕದ್ದು.

15. ಸ್ಥಾಯಿ ಆದೇಶಗಳಲ್ಲಿಯ ಪ್ರಾವಧಾನಗಳನ್ವಯ ತರಬೇತಿ ಅವಧಿಯ ವೇತನ: ಯಾವುದೇ ಉದ್ಯೋಗದಾತರ ಸಂಸ್ಥೆಯಲ್ಲಿ ತರಬೇತಿ, ಪಡೆಯುವ ಉದ್ಯೋಗಿಗಳಿಗೆ ಔದ್ಯೋಗಿಕ ಉದ್ಯೋಗಗಳ (ಸ್ಥಾಯಿ ಆದೇಶಗಳ) ಕಾಯ್ದೆ 1946 ಹಾಗೂ ಅದರಡಿಯ ಕರ್ನಾಟಕ ನಿಯಮಗಳನ್ವಯ ಪ್ರಮಾಣೀಕೃತ ಸ್ಥಾಯಿ ಆದೇಶಗಳಲ್ಲಿ ಅಥವಾ ಮಾದರಿ ಸ್ಥಾಯಿ ಆದೇಶಗಳಲ್ಲಿ ನಿಗಧಿತವಾದ "ತರಬೇತಿ ಅವಧಿ"ಯಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆಯ ಮೂಲಕ ನಿಗಧಿಗೊಳಿಸಿದ ಕನಿಷ್ಠ ವೇತನದ ಶೇಕಡಾ 75 (ಎಪ್ಪತ್ತೈದು) ರಷ್ಟು ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು ಪಾವತಿಸತಕ್ಕದ್ದು.

16. ಸರ್ಕಾರದ ಯೋಜನೆ / ಕಾರ್ಯಕ್ರಮದಡಿಯಲ್ಲಿ ಹಾಗೂ ಸಾಮಾನ್ಯ ತರಬೇತಿಯ ಅವಧಿಯ ವೇತನ: ಮೇಲ್ಕಂಡ ಷರತ್ತು ಸಂಖ್ಯೆ 11 ಹಾಗೂ 12 ನ್ನು ಹೊರತುಪಡಿಸಿ, ತರಬೇತಿ ಪಡೆಯುವ ಉದ್ಯೋಗಿಗಳಿಗೆ (ಟ್ರೈನಿಗಳಿಗೆ) ಈ ಅಧಿಸೂಚನೆಯಡಿ ನಿಗಧಿಪಡಿಸಿದ ಕೆಲಸದ ಸ್ವರೂಪಗಳಿಗೆ ನಿಗಧಿಪಡಿಸಿರುವ ಕನಿಷ್ಠ ವೇತನವನ್ನು ಪಾವತಿಸತಕ್ಕದ್ದು. ಕೇಂದ್ರ ಸರ್ಕಾರ/ ರಾಜ್ಯ ಸರ್ಕಾರ ಯಾವುದೇ ತರಬೇತಿಗಾಗಿ ಯೋಜನೆಗಳನ್ನು ಹಾಗೂ ಕಾರ್ಯಕ್ರಮಗಳನ್ನು ರೂಪಿಸಿದ್ದು, ಸದರಿ ಯೋಜನೆಗಳು ಹಾಗೂ ಕಾರ್ಯಕ್ರಮಗಳನ್ನು ಉದ್ಯೋಗದಾತರು ಅನುಷ್ಠಾನಗೊಳಿಸುತ್ತಿದಲ್ಲಿ, ಸದರಿ ಯೋಜನೆಗಳಡಿಯಲ್ಲಿ / ಕಾರ್ಯಕ್ರಮದಡಿಯಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿರುವ ವೇತನವನ್ನು ಉದ್ಯೋಗದಾತರು ತರಬೇತಿ ಪಡೆಯುವವರಿಗೆ ಪಾವತಿಸತಕ್ಕದ್ದು.

17. ರೂಡಿಗತ ಸೌಲಭ್ಯಗಳ ಮುಂದುವರಿಕೆ: ಅಧಿಸೂಚಿತ ಕನಿಷ್ಠ ವೇತನಕ್ಕೆ ಹೆಚ್ಚುವರಿಯಾಗಿ ರೂಡಿ ಮತ್ತು ಪದ್ಧತಿಯನ್ವಯ ವಸ್ತು ರೂಪದಲ್ಲಿ ಯಾವುದೇ ಸಂಭಾವನೆಯನ್ನು ಉದ್ಯೋಗದಾತರಿಂದ ಕಾರ್ಮಿಕರು ಪಡೆಯುತ್ತಿದ್ದಲ್ಲಿ, ಸದರಿ ಹೆಚ್ಚುವರಿ ವಸ್ತು ರೂಪದ ಸಂಭಾವನೆಯನ್ನು ಮುಂದುವರೆಸಲು ಉದ್ಯೋಗದಾತರು ಬಾಧ್ಯಸ್ಥರಾಗಿರುತ್ತಾರೆ.

18. ದಿವ್ಯಾಂಗ ಕಾರ್ಮಿಕರ ವೇತನ: ವಿಕಲಚೇತನ ವ್ಯಕ್ತಿಗಳು ಕೆಲಸ ನಿರ್ವಹಿಸುತ್ತಿದ್ದಲ್ಲಿ ಸದರಿ ಕೆಲಸವನ್ನು ನಿರ್ವಹಿಸುತ್ತಿರುವ ಇತರೆ ಸಾಮಾನ್ಯ ಕಾರ್ಮಿಕರು

ಪಡೆಯುತ್ತಿರುವ ವೇತನಕ್ಕೆ ಸಮನಾಗಿ ವೇತನವನ್ನು ಪಡೆಯಲು ವಿಕಲಚೇತನ (ದಿವ್ಯಾಂಗ) ಕಾರ್ಮಿಕರು ಅರ್ಹರಾಗಿದ್ದು, ಇದನ್ನು ವಿಕಲಾಂಗ ವ್ಯಕ್ತಿಗಳು (ಸಮಾನ

ಅವಕಾಶಗಳು, ಹಕ್ಕುಗಳ ರಕ್ಷಣೆ ಹಾಗೂ ಪೂರ್ಣ ಭಾಗವಹಿಸುವಿಕೆ) ಕಾಯ್ದೆ-1995 ರ ಪ್ರಾವಧಾನಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಪಾವತಿಸಲು ಉದ್ಯೋಗದಾತರು

ಕ್ರಮವಹಿಸತಕ್ಕದ್ದು.

19. ಕನಿಷ್ಠ ವೇತನ ಮೊತ್ತದ ಕಡ್ಡಾಯ ಪಾವತಿ: ಕರ್ತವ್ಯ ನಿರ್ವಹಿಸಿದ ಕಾರ್ಮಿಕರಿಗೆ ಪಾವತಿ ಮಾಡುವ ಒಟ್ಟು ವೇತನವು, ಈ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿರುವ ಕನಿಷ್ಠವೇತನ ದರಗಳನ್ನು ಮತ್ತು ಕಾಲಕಾಲಕ್ಕೆ ವ್ಯತ್ಯಾಸವಾಗುವ ತುಟ್ಟಿಭತ್ಯೆಯನ್ನು ಸೇರ್ಪಡಿಸಿದಾಗ ಬರುವ ಮೊತ್ತಕ್ಕೆ ಕಡಿಮೆಯಾಗದಂತೆ ವೇತನವನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಉದ್ಯೋಗದಾತರು ಪಾವತಿಸಕ್ಕದ್ದು.

20. ಕಾರ್ಮಿಕರ ಕೆಲಸದ ಸ್ವರೂಪಗಳ ವರ್ಗೀಕರಣ: ಕಾರ್ಮಿಕರು ಉದ್ಯೋಗದಾತರ ಸಂಸ್ಥೆಯಲ್ಲಿ ನಿರ್ವಹಿಸುವ ಕೆಲಸದ ಸ್ವರೂಪವನ್ನು ಅವರ ಕೌಶಲ್ಯಗಳಿಗನುಗುಣವಾಗಿ ನಾಲ್ಕು (04) ವರ್ಗಗಳಲ್ಲಿ ವಿಂಗಡಿಸಿದ್ದು, ಅದರ ಸಾಮಾನ್ಯ ವ್ಯಾಖ್ಯಾನ ಈ ಕೆಳಗಿನಂತಿದೆ;

ಅ. ಅತಿ ಕುಶಲ: ಅತಿ ಕುಶಲ ಕೆಲಸಗಾರರು ಎಂದರೆ ಯಾರು ಹೆಚ್ಚಿನ ನೈಪುಣ್ಯತೆ ಕೆಲಸವನ್ನು ಅತಿ ಹೆಚ್ಚು ನಿಖರವಾಗಿ ಮಾಡಬಲ್ಲವರಾಗಿದ್ದು, ನಕ್ಷೆಯನ್ನು ಓದಬಲ್ಲ ಮತ್ತು ಅದರ ಆಧಾರದ ಮೇಲೆ ಕೆಲಸ ಮಾಡಬಲ್ಲವರಾಗಿದ್ದು, ಅವರ ವಿಭಾಗದ `ಕುಶಲ` ಮತ್ತು ಇತರೇ ಕೆಲಸಗಾರರ ಕೆಲಸವನ್ನು ನಿರ್ದೇಶಿಸಬಲ್ಲ ಸಾಮರ್ಥ್ಯವುಳ್ಳವರಾಗಿದ್ದು, ಆ ವಿಭಾಗದ ಕೆಲಸವನ್ನು ಸ್ವತಂತ್ರವಾಗಿ ನಿರ್ವಹಿಸಿಕೊಂಡು ಹೋಗಬಲ್ಲವರಾಗಿರಬೇಕು.

ಆ. ಕುಶಲ: ಕುಶಲ ಕೆಲಸಗಾರರು ಅಂದರೆ ಸ್ವತಂತ್ರವಾಗಿ ಹಾಗೂ ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಮತ್ತು ಕೆಲಸವನ್ನು ಸರಿಯಾಗಿ ಮಾಡಬಲ್ಲ ಸಾಮರ್ಥ್ಯವುಳ್ಳ ಕಾರ್ಮಿಕ. ಅವಶ್ಯ ಬಿದ್ದರೆ ಸರಳವಾದ ನಕ್ಷೆಗಳನ್ನು ಓದಿ, ಕೆಲಸ ಮಾಡುವ ಸಾಮರ್ಥ್ಯವುಳ್ಳವನಾಗಿರಬೇಕು.

ಇ. ಅರೆ ಕುಶಲ : ತನ್ನ ಕಸುಬಿನ ಬಗ್ಗೆ ಸಾಕಷ್ಟು ಜ್ಞಾನವಿರುವ ಹಾಗೂ ಪುನರಾವರ್ತನೆ ಕೆಲಸ ಮಾಡುವ ಸಾಮರ್ಥ್ಯವುಳ್ಳ ಹಾಗೂ ಯಂತ್ರೋಪಕರಣಗಳ ಸಹಾಯದಿಂದ ಸರಳವಾದ ಕೆಲಸಗಳನ್ನು ಮಾಡಬಲ್ಲವರು.

ಈ. ಕುಶಲರಲ್ಲದವರು : ಸ್ವತಂತ್ರವಾದ ನಿರ್ಣಯದ ಅವಶ್ಯಕತೆಯಿಲ್ಲದ ಅಥವಾ ಹಿಂದಿನ ಅನುಭವ ಇಲ್ಲದೆ ಆದರೆ ಉದ್ಯೋಗದ ವಾತಾವರಣದ ಪರಿಚಯವಿದ್ದು ಕೆಲಸ ಮಾಡುವುದು, ದೈಹಿಕ ಪರಿಶ್ರಮವಿಲ್ಲದೆ ವಿವಿಧ ರೀತಿಯ ವಸ್ತುಗಳು ಮತ್ತು ಸಾಮಾನ್ಯ ಜ್ಞಾನವಿರುವ ಕೆಲಸವನ್ನು ಮಾಡುವವರು.

In exercise of the powers conferred by Regulation 32 of the Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations 2010 and in continuation to the Notification No. EN 99 EBS 2016(III) Dt. 03-09-2016 issued in this behalf, the Govt. of Karnataka hereby notifies that the generating units having capacity to produce electricity above 1 MW from Solar Rooftop sources of energy shall be inspected by the Electrical Inspector or any officer appointed to assist the Electrical Inspector before commissioning. Solar rooftop generation units installed as per the KERC (Implementation of Solar Rooftop Photovoltic Power Plant) Regulations, 2016 shall be inspected periodically as per Regulations 30 of Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations, 2010.

RULES

1. Title and Commencement: (1) These rules may be called the Karnataka (Licensing of Electrical Contractors, Special wiring permit and grant of certificates and permits to Electrical Supervisors and Wiremen) (Amendment) Rules, 2018.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of rule 12: In the Karnataka (Licensing of Electrical Contractors, Special wiring permit and grant of certificates and permits to Electrical Supervisors and Wiremen) Rules, 2012 in rule 12, in Sub-rule (1) after clause (b), the following shall be inserted, namely:-

"Provided that, if the applicant has obtained electrical contractor license prior to the date of commencement of the Karnataka

(Licensing of Electrical Contractors, Special wiring permit and grant of certificates and permits to Electrical Supervisors and

Wiremen) (Amendment) Rules, 2018 for continuous period of ten years, the Board may grant the Electrical Contractor

license afresh based on the lapsed electrical contractor license, exempting from passing of Tenth Standard Examination."

In exercise of the powers conferred by sub-section (1) read with sub section(2) of Section 30 and sub-section (3) of Section 21 of the Micro, Small and Medium Enterprises Development Act, 2006 (Act 27 of 2006), in supersession of the earlier rules issued in G.O. CI 377 CSC 2006 dated: 07/03/2007 of Commerce and Industries Department, the Government of Karnataka hereby makes the following revised rules for facilitating the working of Micro and Small Enterprises Facilitation Council, namely:-

RULES

1. Short title and commencement:

(i) These rules may be called "the Karnataka State Micro and Small Enterprises Facilitation Council Rules, 2018".

(ii) They shall extend to the whole of the Karnataka State.

(iii) They shall come into force from the date of their publication in the official Gazette of Karnataka State.

2. Definition:- (1) In these rules, unless the context otherwise requires:

(i) "Act" means the Micro, Small and Medium Enterprises Development Act,2006 (Central Act 27 of 2006);

(ii) "Arbitration and Conciliation Act" means the Arbitration and Conciliation Act, 1996 (Act 26 of 1996);

(iii) Chairperson: means the Chairperson of the Council appointed under clause (i) of sub-section (1) of section 21 of the Act; (iv) "Council" means the Micro and Small Enterprises Facilitation Council established by the Government of Karnataka Under Section-20 of the Act;

(v) "Government" means the Government of Karnataka in the Department of Industries and Commerce:

(vi) "Institute" means any institution or centre providing alternate dispute resolution services referred to in sub-sections (2) and (3) of section 18 of the Act.

(vii) "Member" means a member of the Council;

(viii) "MSE" unit means a micro or small enterprise as per the provisions of Act.

(ix) "Section" means a section of the Act;

(x) "Schedule" means a schedule appended to these rules

(2) The words and expressions used and not defined, but defined in the Act shall have the meanings assigned to them in the Act.

3. Setting up of the Micro and Small Enterprises Facilitation Council:

(i) The Government shall establish at least one Micro & Small Enterprises Facilitation Council (MSEFC). However, if the work so demand can also set up more MSEFC exercising such jurisdiction and for such area as may be specified in the Notification.

(ii) The Government may also give secretariat assistance to MSEFC so appointed. It may also designate some official of the Secretariat to work as the secretary to the council who can be empowered by MSEFCs to issue notices or orders on behalf of the council.

(iii) The Government may provide a legal expert to assist the Council.

(iv) The Government may specify any fee and for processing charges paid while filing application.

(v) The Secretariat for council may have its own seal.

4. Manner of appointment of Chairperson:

The Government shall appoint Commissioner for MSME as Chairperson of the Council keeping in view the provisions as exist in sub Clause (i) of Clause (1) of section 21 of the Act. However, another senior officer can also be designated as Director of Industries for a limited purpose of being the Chairperson of the council.

5. Manner of Appointment of Members of MSEFC:

(i) The MSEFC shall consist of not less than three but not more than five members, including chairperson.

(ii) Member shall be appointed as per provisions of Clause (ii), (iii) and (iv) of sub-section (1) of Section 21 of the Act. -- (iii) A member appointed under clauses (ii),(iii) and (iv) of sub-section (1) of section 21 shall cease to be a member of the council if he or she ceases to represent the category or interest in which he or she was so appointed.

(iv) When a member of the council dies or resigns or is deemed to have resigned or is removed from office or becomes incapable of acting as a member, the Government may appoint another person to fill that vacancy.

(v) Any member of the council may resign from the council by tendering one month's notice in writing to the Government. (vi) The Government may remove any member from Office:-

a) if he is of unsound mind and stands so declared by a competent court; or೧೮ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜನವರಿ ೩, ೨೦೧೯ ಭಾಗ ೪ಎ b) if he becomes bankrupt or insolvent or suspends payment to his creditors ;or c) if he is convicted of any offence which is punishable under the India Penal Code (Act XLV of 1860), or d) if he abstains himself/herself from three consecutive meetings of the council without the leave of the Chairperson, and in any case from five consecutive meeting; or

e) acquires such financial or other interest as is likely, in the opinion of the Government, to affect prejudicially his functions as a member.

6. Honorarium to the Members of the Council:

The remuneration, honorarium or fees and any allowances that may be paid to the members shall be at rates as approved or notified by the Government.

7. Procedure to be followed in the discharge of functions of the Council:

(i) An aggrieved Micro or Small Enterprise [MSE] unit can move a reference to the Micro and Small Enterprises Facilitation Council having jurisdiction of the area in the format provided as Schedule-l of these rules. The reference must have the Udyog Aadhar Memorandum (UAM) number, mobile number and email address of aggrieved MSE unit as provided in Schedule-1.

(ii) Such references should be attached with fee or processing charges as notified by the Government vide para 3(iv) above and with an undertaking from aggrieved MSE unit that it has not moved a reference before the Civil Court on the same dispute.

(iii) Upon receipt of references from the supplier MSE unit, the Secretariat of the Council shall enter the data in the web portal created for this purpose.

(iv) After entering the data, acknowledgment of the receipt of reference shall be issued by the Secretariat to the applicant MSE unit through email.

(v) The council may examine the reference at preliminary stage to check regarding the fee or competency of MSE unit to file the reference.

(vi) In case, if the reference or the particulars entered in it are not found to the satisfaction of council, it may return the reference.

(vii) The Council shall either itself conduct conciliation in the matter or seek the assistance of any institute for conducting the conciliation and if it decides to do so, shall refer the parties to the Institute.

(viii) The Institute to which the issue is referred makes efforts to bring about conciliation and it shall submit its Report to the Council as soon as possible, usually within 15 days from reference to the Council.

(ix) Where the conciliation is not successful and stands terminated without any settlement between the parties, the Council shall either itself take up the dispute for further action, i.e, arbitration or refer it to an 'institute' for the same

(x) If the matter is referred to the institute, the institute shall arbitrate the issue as per the provisions of Arbitration and Conciliation Act, 1996 and refer the award to the Council.

(xi) The Council after finalizing the award, or receiving the award from the Institute shall consider the case and pass appropriate final orders in the matter.

8. Meetings of the council and Quorum:

(i) The meeting of the council shall be ordinarily held after giving seven days notice.

(ii) However, in case of urgency, it can be called at such short notice as the Chairperson may find suitable.

(iii) All the notices/communication of the meeting shall be informed to the petitioner including through SMS and email.

(iv) The council shall hold regular meetings, at least once a month.

(v) The quorum of meeting will be two in case if the number of members is three or four, and it will be three if the number of members is five.

9. Decisions of the MSEFC:

a. Any decision of the Council shall be made by a majority of its members present at the meeting of the Council.

b. Every reference made under section 18 to the Micro and Small Enterprises Facilitation Council shall be decided within a period of ninety days from the date of making such a reference.

c. The Secretariat shall upload the proceedings of every meeting of the council on the web portal created for the purpose.

d. No application for setting aside any decree, award or other order made either by the council itself or by any institution or centre providing alternate dispute resolution services to which a reference is made by the council, shall be entertained by any court unless the appellant (not being a supplier) has deposited with it seventy-five per cent of the amount in terms of the decree, award or, as the case may be, the other order in the manner directed by such court.

e. Notwithstanding anything contained in sub-rule (1) if authorized by the parties or all the members of the Council, questions of procedure may be decided by the Chairperson.

a. The council shall upload the basic information including the annual progress report of the council on the web portal created for the purpose.

b. The Council shall provide information to the Member Secretary of the National Board for Micro, Small and Medium enterprises as in the Act in the manner and form required from time to time.

11. Repeal and Saving

The Karnataka State Micro and Small Enterprises Facilitation Council Rules, 2007 are hereby repealed, "

Provided that-

(a) Such repeal shall not affect the previous operation of the said rules, or any notification or order made, or anything done, or any action taken thereunder;

(b) any proceedings under the said rules, pending at the commencement of these rules shall be continued and disposed of as far as may be, in accordance with the provisions of these rules, as if such proceedings were under these rules.

12. Removal of Difficulties

If any difficulty arises during the course of implementation of these Rules, the same shall be clarified by the State Government.

Now, therefore, in exercise of the power conferred by section 6 of the said Act, notice is hereby given for the information of all the persons likely to be affected thereby that the proposal will be taken into consideration after thirty days from the date of publication of the notification in the official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said proposal before the expiry of the period specified above will be considered by the State Government. ಕರ್ನಾಟಕ ಭೂಕಂದಾಯ ಅಧಿನಿಯಮ 1964 ರ (1964 ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 12) 6 ನೇ ಪ್ರಕರಣದಲ್ಲಿ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ದೇವಳವಾರಪಲ್ಲಿ ಗ್ರಾಮದ ಸರಹದ್ದುಗಳನ್ನು ಮಾರ್ಪಡಿಸಲು ಮತ್ತು ಹೊಸದಾಗಿ ಮರಿಮಾಕಲಹಳ್ಳಿ ಎಂಬ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ಸ್ಥಾಪಿಸುವ ಕುರಿತು ಸಂಖ್ಯೆ ಆರ್‌ಡಿ 108 ಕಂಗ್ರಾರ 2016, ದಿನಾಂಕ: 29-12-2016 ರ ಮೂಲಕ ಕರಡು ಅಧಿಸೂಚನೆಯನ್ನು ಅದರಿಂದ ಬಾಧಿತರಾಗಬಹುದಾದ ಎಲ್ಲ ವ್ಯಕ್ತಿಗಳಿಂದ ಅದನ್ನು ಸರ್ಕಾರಿ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಿದ ದಿನಾಂಕದಿಂದ ಮೂವತ್ತು ದಿನಗಳ ಒಳಗಾಗಿ ಆಕ್ಷೇಪಣೆಗಳು ಅಥವಾ ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ದಿನಾಂಕ: 26-01-2017 ರ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಿರುವುದರಿಂದ;

ಮತ್ತು ಸದರಿ ರಾಜ್ಯಪತ್ರವನ್ನು ಸಾರ್ವಜನಿಕರಿಗೆ ದಿನಾಂಕ: 09-05-2017 ರಂದು ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಲಾಗಿದೆ. ಈ ಸಂಬಂಧ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳು ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಸ್ವೀಕೃತವಾಗಿರುವುದಿಲ್ಲ.

ಆದ್ದರಿಂದ, ಈಗ, ಕರ್ನಾಟಕ ಭೂಕಂದಾಯ ಅಧಿನಿಯಮ 1964 ರ (1964 ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 12) 5 ನೇ ಪ್ರಕರಣದಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಮೂಲಕ ಮುಂದಿನ ಅಧಿಸೂಚನೆಯನ್ನು ಮಾಡುತ್ತಿದೆ, ಎಂದರೆ:-

ಅನುಸೂಚಿ-1

ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ದೇವಳವಾರಪಲ್ಲಿ ಗ್ರಾಮದ ಸರಹದ್ದಿನಿಂದ ಈ ಕೆಳಗಿನ ಕೋಷ್ಟಕದ (2) ನೇ ಕಾಲಂನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಮತ್ತು ಅದರ (3) ನೇ ಕಾಲಂನಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವ ಸರ್ವೆ ನಂಬರುಗಳು ಹಾಗೂ ವಿಸ್ತೀರ್ಣದ ಜಮೀನುಗಳನ್ನು ಬೇರ್ಪಡಿಸಿ ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ಮರಿಮಾಕಲಹಳ್ಳಿ ಎಂಬ ಹೆಸರಿನ ಹೊಸ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ರಚಿಸಿದೆ. ಈ ಹೊಸ ಗ್ರಾಮದ ಭಾಗವಾಗುವ ಹೊಸದಾದ ಸರ್ವೆ ನಂಬರುಗಳು ಅದರ (4) ನೇ ಕಾಲಂನಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದಂತೆ ಇವೆ:

ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ಮರಿಮಾಕಲಹಳ್ಳಿ ಎಂಬ ಹೆಸರಿನ ಹೊಸ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ರಚಿಸಲಾಗಿದೆ. ಸದರಿ ಹೊಸ ಗ್ರಾಮದ ಚೆಕ್ಕುಬಂದಿ ವಿವರಗಳು ಕೆಳಗಿನಂತಿರತಕ್ಕದ್ದು, ಎಂದರೆ:-

Whereas the draft of the Notification No RD 108 KAMGRARA 2016, Dated : 29-12-2016 regarding altering the limits of Devalavarapalli Village of Bagepalli Taluk and Chikkaballapura District and constituting a new revenue village called Marimakalahalli was published as required by Section 6 of the Karnataka Land Revenue Act, 1964 (Karnataka Act No.12 of 1964) in the Karnataka Gazette No. 75 Part IV-A dated : 26-01-2017 inviting objections or suggestions from all the persons likely to be affected thereby within thirty days from the date of its publication in the Official Gazette.

And Whereas, the said gazette was made available to the public on 09-05-2017 and Whereas, no objections and suggestions are received.

Now, therefore, in exercise of the powers conferred by Section 5 of Karnataka Land Revenue Act, 1964 (Karnataka Act No.12 of 1964) the Government of Karnataka hereby makes the following notification, namely:-

SCHEDULE-I

Land bearing survey numbers specified in column (2) of the table below and areas specified in column (3) thereof shall be excluded from the limits of said village of Bagepalli Taluk and Chikkaballapura District to form a new revenue village called as Marimakalahalli of Bagepalli Taluk and Chikkaballapura District. The new survey numbers which will form part of this new village are as specified in column (4) thereof.

the village shall be as specified below:-

The survey numbers and areas remaining in the Devalavarapalli Village specified in column (2) shall be assigned new survey numbers in the said village specified in column (4).

East: Boundary of Doddapalli Village West: Boundary of Kamasanapalli Village

North: Boundary of Somanathapura Village South: Boundary of Myakalapalli Village

The above shall come into effect from the date of publication of this notification in the Official Gazette .

ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ಕದಿರನ್ನಗಾರಿಕೋಟೆ ಗ್ರಾಮದ ಸರಹದ್ದಿನಿಂದ ಈ ಕೆಳಗಿನ ಕೋಷ್ಟಕದ (2) ನೇ ಕಾಲಂನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಮತ್ತು ಅದರ (3) ನೇ ಕಾಲಂನಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವ ಸರ್ವೆ ನಂಬರುಗಳು ಹಾಗೂ ವಿಸ್ತೀರ್ಣದ ಜಮೀನುಗಳನ್ನು ಬೇರ್ಪಡಿಸಿ ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ಗಡ್ಡಂಹಳ್ಳಿ ಎಂಬ ಹೆಸರಿನ ಹೊಸ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ರಚಿಸಿದೆ. ಈ ಹೊಸ ಗ್ರಾಮದ ಭಾಗವಾಗುವ ಹೊಸದಾದ ಸರ್ವೆ ನಂಬರುಗಳು ಅದರ (4) ನೇ ಕಾಲಂನಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದಂತೆ ಇವೆ:

ಟಿಪ್ಪಣಿ: ಸದರಿ ಗ್ರಾಮದ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಬರುವ ಗ್ರಾಮಠಾಣದ ಒಟ್ಟು ವಿಸ್ತೀರ್ಣದ ವಿವರಗಳು ಈ ಕೆಳಕಂಡಂತಿದೆ, ಎಂದರೆ:-

ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ಗಡ್ಡಂಹಳ್ಳಿ ಎಂಬ ಹೆಸರಿನ ಹೊಸ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ರಚಿಸಲಾಗಿದೆ. ಸದರಿ ಹೊಸ ಗ್ರಾಮದ ಚೆಕ್ಕುಬಂದಿ ವಿವರಗಳು ಕೆಳಗಿನಂತಿರತಕ್ಕದ್ದು, ಎಂದರೆ:-

ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ಕದಿರನ್ನಗಾರಿಕೋಟೆ ಗ್ರಾಮದ ಸರಹದ್ದಿನಿಂದ ಈ ಕೆಳಗಿನ ಕೋಷ್ಟಕದ (2) ನೇ ಕಾಲಂನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಮತ್ತು ಅದರ (3) ನೇ ಕಾಲಂನಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿರುವ ಸರ್ವೆ ನಂಬರುಗಳು ಹಾಗೂ ವಿಸ್ತೀರ್ಣದ ಜಮೀನುಗಳನ್ನು ಬೇರ್ಪಡಿಸಿ ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ತುರುಕೇಶಹಳ್ಳಿ ಎಂಬ ಹೆಸರಿನ ಹೊಸ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ರಚಿಸಿದೆ. ಈ ಹೊಸ ಗ್ರಾಮದ ಭಾಗವಾಗುವ ಹೊಸದಾದ ಸರ್ವೆ ನಂಬರುಗಳು ಅದರ (4) ನೇ ಕಾಲಂನಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದಂತೆ ಇವೆ:

ಚಿಕ್ಕಬಳ್ಳಾಪುರ ಜಿಲ್ಲೆಯ ಬಾಗೇಪಲ್ಲಿ ತಾಲ್ಲೂಕಿನ ತುರುಕೇಶಹಳ್ಳಿ ಎಂಬ ಹೆಸರಿನ ಹೊಸ ಕಂದಾಯ ಗ್ರಾಮವನ್ನು ರಚಿಸಲಾಗಿದೆ. ಸದರಿ ಹೊಸ ಗ್ರಾಮದ ಚೆಕ್ಕುಬಂದಿ ವಿವರಗಳು ಕೆಳಗಿನಂತಿರತಕ್ಕದ್ದು, ಎಂದರೆ:-

ಗ್ರಾಮದ ಸರ್ವೆ ನಂಬರುಗಳು ಮತ್ತು (2) ನೇ ಕಾಲಂನಲ್ಲಿ ನಮೂದಿಸಿದ ಕದಿರನ್ನಗಾರಿಕೋಟೆ ಗ್ರಾಮದಲ್ಲಿ ಉಳಿದಿರುವ ಪ್ರದೇಶಗಳಿಗೆ ಸದರಿ ಗ್ರಾಮದಲ್ಲಿ (4) ನೇ ಕಾಲಂನಲ್ಲಿ ನಮೂದಿಸಿದ ಹೊಸ ಸರ್ವೆ ನಂಬರುಗಳನ್ನು ನೀಡತಕ್ಕದ್ದು.

ಮೇಲಿನವು ಸರ್ಕಾರಿ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆಯು ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

Whereas the draft of the Notification No RD 64 KAMGRARA 2016, Dated : 08-12-2016 regarding altering the limits of Kadirannagarikote Village of Bagepalli Taluk and Chikkaballapura District and constituting a new revenue Villages called Gaddamhalli and Turukeshahalli was published as required by Section 6 of the Karnataka Land Revenue Act, 1964 (Karnataka Act No.12 of 1964) in the Karnataka Gazette No. 909 Part IV-A dated : 22-12-2016 inviting objections or suggestions from all the persons likely to be affected thereby within thirty days from the date of its publication in the Official Gazette.

And Whereas, the said gazette was made available to the public on 09-05-2017 and Whereas, no objections and suggestions are received.

Now, therefore, in exercise of the powers conferred by Section 5 of Karnataka Land Revenue Act, 1964 (Karnataka Act No.12 of 1964) the Government of Karnataka hereby makes the following notification, namely:-

SCHEDULE-I

Land bearing survey numbers specified in column (2) of the table below and areas specified in column (3) thereof shall be excluded from the limits of said Village of Bagepalli Taluk and Chikkaballapura District to form a new revenue Village called as Gaddamhalli of Bagepalli Taluk and Chikkaballapura District. The new survey numbers which will form part of this new Village are as specified in column (4) thereof.

Village shall be as specified below:-

Land bearing survey numbers specified in column (2) of the table below and areas specified in column (3) thereof shall be excluded from the limits of said Village of Bagepalli Taluk and Chikkaballapura District to form a new revenue Village called as Turukeshahalli of Bagepalli Taluk and Chikkaballapura District. The new survey numbers which will form part of this new Village are as specified in column (4) thereof.

the Village shall be as specified below:-

The survey numbers and areas remaining in the Kadirannagarikote Village specified in column (2) shall be assigned new survey numbers in the said Village specified in column (4).
