ಹಣಕಾಸು ಸಂಸ್ಥೆಯಾದ ಮೆ: ಹಿಂದೂಸ್ಥಾನ್ ಇನ್‌ಫ್ರಾಕಾನ್ (ಇಂಡಿಯಾ) ಲಿ., ಮತ್ತು ಇತರ ಸಹವರ್ತಿ ಕಂಪನಿಗಳು/ ಸಂಸ್ಥೆಗಳು ವಂಚಕ ವಹಿವಾಟುಗಳಲ್ಲಿ ತೊಡಗಿದ್ದು, ಅವುಗಳ ಠೇವಣಿದಾರರಿಗೆ ಠೇವಣಿಗಳನ್ನು ಹಿಂದುರುಗಿಸುವಲ್ಲಿ ವಿಫಲರಾಗಿರುವುದು ಸರ್ಕಾರದ ಗಮನಕ್ಕೆ ಬಂದಿದೆ. ಹಾಗಾಗಿ ಸರ್ಕಾರವು, ಕರ್ನಾಟಕ ಹಣಕಾಸು ಸಂಸ್ಥೆಗಳ ಠೇವಣಿದಾರರ ಹಿತಾಸಕ್ತಿ ಸಂರಕ್ಷಣಾ ಅಧಿನಿಯಮ, 2004 (ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 30, 2005) ರ ಅಡಿಯಲ್ಲಿ ನಿರ್ದಿಷ್ಠಪಡಿಸಿರುವ ಉಪ ಬಂಧುಗಳಿಗೆ ಅನುಸಾರವಾಗಿ ಕ್ರಮ ಜರುಗಿಸಲು ನಿರ್ಧರಿಸಿದೆ.
ಸದರಿ ಕಂಪನಿಗಳಿಗೆ ಸೇರಿದ ಸ್ವತ್ತುಗಳು ವಿವಿಧ ಜಿಲ್ಲೆಗಳಲ್ಲಿ ವಿಸ್ತರಿಸುವುದು ಮತ್ತು ಅವುಗಳ ಠೇವಣಿದಾರರು ಕರ್ನಾಟಕ ರಾಜ್ಯದೆಲ್ಲೆಡೆ, ಬಹುಶಃ ಇತರ ರಾಜ್ಯಗಳಲ್ಲಿಯೂ ಹರಡಿರುವುದು ವರದಿಯಾಗಿದೆ. ಇಂತಹ ಪ್ರಕರಣ ಪುನರಾವರ್ತನೆಯನ್ನು ತಡೆಯುವ ಸಲುವಾಗಿ ಎಲ್ಲಾ ಠೇವಣಿದಾರರಿಂದ ಕ್ಲೇಮುಗಳನ್ನು ಆಹ್ವಾನಿಸುವುದಕ್ಕೆ ಮತ್ತು ಮೆ: ಹಿಂದೂಸ್ಥಾನ್ ಇನ್‌ಫ್ರಾಕಾನ್ (ಇಂಡಿಯಾ) ಲಿ., ಮತ್ತು ಇತರ ಸಹವರ್ತಿ ಕಂಪನಿಗಳು/ಸಂಸ್ಥೆಗಳಿಗೆ ಸೇರಿದ ಸ್ವತ್ತುಗಳನ್ನು ಜಪ್ತಿ ಮಾಡುವುದಕ್ಕೆ ಒಬ್ಬರು ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರಿಯ ಅಧಿಕೃತಗೊಳಿಸುವುದು ಅವಶ್ಯಕವಾಗಿದೆ.
ಆದ್ದರಿಂದ, ಕರ್ನಾಟಕ ಹಣಕಾಸು ಸಂಸ್ಥೆಗಳ ಠೇವಣಿದಾರರ ಹಿತಾಸಕ್ತಿ ಸಂರಕ್ಷಣಾ ಅಧಿನಿಯಮ, 2004 (ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 30, 2005)ರ ಪ್ರಕರಣ 5ರ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಸಹಾಯಕ ಆಯುಕ್ತರು, ಬೆಂಗಳೂರು ಉತ್ತರ ಉಪ ವಿಭಾಗ, ಬೆಂಗಳೂರು – ಜಿಲ್ಲೆ ಇವರನ್ನು ಈ ಅಧಿನಿಯಮದ ಉದ್ದೇಶಗಳನ್ನು ಕಾರ್ಯಗತಗೊಳಿಸುವ ದೃಷ್ಟಿಯಿಂದ ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರಿಯನ್ನಾಗಿ ಈ ಮೂಲಕ ನೇಮಿಸಲಾಗಿದೆ.
ಸಕ್ವಮ ಪ್ರಾಧಿಕಾರಿಯು ಸರ್ಕಾರದ ಪರವಾಗಿ ಈ ಅಧಿನಿಯಮದ ಪ್ರಕರಣ 3ನ್ನು ಒಳಗೊಂಡಂತೆ ಉಪಬಂಧಗಳ ಅಡಿಯಲ್ಲಿ ಯುಕ್ತ ಕ್ರಮ ಕೈಗೊಳ್ಳುವುದಕ್ಕಾಗಿ ಮೆ: ಹಿಂದೂಸ್ಥಾನ್ ಇನ್‌ಫ್ರಾಕಾನ್ (ಇಂಡಿಯಾ) ಲಿ., ಮತ್ತು ಇತರ ಸಹವರ್ತಿ ಕಂಪನಿಗಳು/ಸಂಸ್ಥೆಗಳಿಗೆ ಸಂಬಂಧಪಟ್ಟಂತೆ ತಕ್ಷಣ ಜಾರಿಗೆ ಬರುವಂತೆ ಮೇಲೆ ಹೇಳಿರುವ ಉದ್ದೇಶವನ್ನು ಕಾರ್ಯಗತಗೊಳಿಸಲು ಅಗತ್ಯವಾಗಿರುವಂತಹ ಎಲ್ಲಾ ಅಧಿಕಾರಗಳನ್ನು ಹೊಂದಿರತಕ್ಕದ್ದು.
