4. ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿದಂತೆ, ಮಾನ್ಯ ಸರ್ವೋಚ್ಚ ನ್ಯಾಯಾಲಯವು, ಮೇಲೆ (1)ರಲ್ಲಿ ಓದಲಾದ ದಿನಾಂಕ:

27.02.2019ರ ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ. ಸಿಆಸುಇ 186 ಎಸ್ಆರ್ಎಸ್ 2018ರ ಅನುಷ್ಠಾನಕ್ಕೆ ತಡೆಯಾಜ್ಞೆ

ನೀಡಿರುವುದರಿಂದ, ಈ ಬಗ್ಗೆ ಸರ್ಕಾರದಿಂದ ಮುಂದಿನ ನಿರ್ದೇಶನ ನೀಡುವವರೆಗೆ ಸದರಿ ಆದೇಶದ ಅನುಷ್ಠಾನಕ್ಕೆ ಯಾವುದೇ

ಮುಂದಿನ ಕ್ರಮ ಕೈಗೊಳ್ಳತಕ್ಕದ್ದಲ್ಲ.

5. ಈ ಸೂಚನೆಗಳನ್ನು ಎಲ್ಲಾ ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರಗಳು ಕಟ್ಟುನಿಟ್ಟಾಗಿ ಪಾಲಿಸತಕ್ಕದ್ದು. ಅದನ್ನು ಪಾಲಿಸಲು ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರಗಳು ವಿಫಲರಾದಲ್ಲಿ ಸರ್ಕಾರವು ಅಂತಹ ವಿಫಲತೆಯನ್ನು ಗಂಭೀರವಾಗಿ ಪರಿಗಣಿಸಲಾಗುವುದು.

6. ಸರ್ಕಾರದ ಎಲ್ಲಾ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿಯವರು, ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಯವರು ಮತ್ತು ಕಾರ್ಯದರ್ಶಿಯವರು ಅವರ ಆಡಳಿತ ವ್ಯಾಪ್ತಿಗೊಳಪಡುವ ಸ್ವಾಯತ್ತ ಸಂಸ್ಥೆಗಳು / ವಿಶ್ವವಿದ್ಯಾಲಯಗಳು / ಸಾರ್ವಜನಿಕ ಉದ್ದಿಮೆಗಳು / ಆಯೋಗ / ನಿಗಮ / ಮಂಡಳಿಗಳು / ಸ್ಥಳೀಯ ಸಂಸ್ಥೆಗಳು ಮತ್ತು ಸರ್ಕಾರದಿಂದ ಅನುದಾನ ಪಡೆಯುವ ಸಂಸ್ಥೆಗಳಿಗೆ ಈ ಆದೇಶವನ್ನು ಪಾಲಿಸಲು ಸೂಚನೆಗಳನ್ನು ನೀಡತಕ್ಕದ್ದು.

Preamble:

1. In the Government Order dated 27.02.2019, read at (1) above, guidelines have been issued with regard to the implementation of the Karnataka Extension of Consequential Seniority to Government Servants promoted on the basis of Reservation (to the posts in the Civil Services of the State) Act, 2017.

2. In the Interlocutory Application No: 36981/2019 in W.P No. 764/2018 filed before the Hon'ble Supreme Court, challenging the said Government Order dated 27.02.2019, the Hon'ble Supreme Court has stayed the operation and implementation of the said Government order. An extract of the relevant portion of the order of the Hon'ble Supreme Court is reproduced below:

"As the matter is in the concluding stages and it is a matter of few weeks now for final decision, we accept the prayer made in the application and grant stay of the operation and implementation of the G.O. No. DPAR 186 SRS 2018, Bengaluru dated 27.02.2019."3 3. Since the Hon'ble Supreme Court has stayed the operation and implementation of the said Government Order dated 27.02.2019, the following order is hereby issued.

GOVERNMENT ORDER NO.DPAR 186 SRS 2018,

BENGALURU, DATED: 05.03.2019.

4. Since the Hon'ble Supreme Court has stayed the operation and implementation of the

said Government Order No. DPAR 186 SRS 2018, dated 27.02.2019 on 01.03.2019, no further

action shall be taken for operation and implementation of the said Government Order until

further directions are issued by Government in this behalf.

5. All the appointing authorities shall strictly follow the instructions contained in this order.

Any failure on the part of the appointing authorities to do so shall be viewed seriously by the Government.

6. All the Additional Chief Secretaries / Principal Secretaries/ Secretaries to Government shall instruct the autonomous bodies /universities /public undertakings / commissions /corporations / boards / local bodies and institutions receiving grant-in-aid from Government, coming under their administrative purview, to comply with this Government order.

In the meanwhile on 10.11.2014 the Hon'ble Supreme Court in W.P.No.412/2010 has passed an interim order:

"It is stated that on behalf of the petitioner as well as the respondent, the State Government has constituted a committee to examine and ascertain the politically Backward Class Community existing in the State of Karnataka. In the light of the said development, the counsel for either side report that the hearing of these matters can be fixed based on the outcome of the committee proceedings". Now, the Government as decided to constitute a new committee to examine, recommend and formulation of policy re- reservation for Politically backward classes under Article 243(D)(6) and 243 (T)(6) of Constitution of India, and by withdrawing the committee constituted as per the Government Order No.RDP 135 ZPS 2011, dated:19-09-2016. Hence, the following order:

The applicant- M/s. GAIL (India) Limited, Bengaluru was expecting the interpretation of their Notification on the lines of the one issued to M/s. GAIL GAS LIMITED. The wordings of the Notification in the applicant's case did not permit to do so. M/s. GAIL(India) Limited also contended that the exemption should be applicable to each invoice upto 25 lakhs for machinery and equipment and for each invoice upto 1 lakh for construction material.

In the meantime assessment orders have been passed for the years 2011-12 and 2012-13 levying Entry Tax, Penalty and interest as under:

Considering the fact that GAIL (India) Limited is a Government of India undertaking and the Project being implemented by M/s.GAIL (INDIA) LIMITED is towards achieving cleaner environment as well as the fact that tax and penalty amounts have already been paid based on the assessments made, the Commissioner of Commercial Taxes recommended vide letter read at (3) above that the Government may favourably consider the waiver of interest amount of Rs.10,40,354/- and Rs.4,75,232/- for the years 2011-12 and 2012-13 respectively by making necessary adjustments in Government accounts by grant route.

Taking the above facts into consideration, the Government has decided to waive-off the interest amount of Rs.15,15,586/- through the grant route. For this purpose provision of Rs.15.16 lakhs by including in the Supplementary Estimate-II during the year 2018-19. Hence the following order:

GAIL (India) Limited under section 8(3) of the KTEG Act, 1979 debitable to the Head of Account "2043-00-800-0-01-100 Financial Relief /Assistance – GAIL (India) Ltd.," and contra credit to the Receipt Head of Account "0049-04-800-5-08-other receipts" involving no cash outflow.

The Accountant General is requested to carry out necessary adjustments in the Books of accounts for 2018-19.

ಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸ

ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3) ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ. ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3) ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

ವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಆದುದರಿಂದ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಆದುದರಿಂದ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳ ಘೋಷಿಸಲಾಗಿದೆ.

ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಸ್ವತ್ತುಗಳು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಯಿಂದ ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ 2ನೇ ಹಂತದ ತುಮಕೂರು ರಸ್ತೆಯ ಬೆಂಗಳೂರು ಅಂತರ ರಾಷ್ಟ್ರೀಯ ವಸ್ತು ಪ್ರದರ್ಶನ ಕೇಂದ್ರದ ಹತ್ತಿರ ಮೆಟ್ರೋ ಸ್ಟೇಷನ್ ನಿರ್ಮಾಣಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಬೇಕಾಗಿದೆ. 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ. ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾಗಿರುವ ತಾರೀಖಿನ ನಂತರ ಬೆಂಗಳೂರು ವಿಭಾಗದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಮಂಡಳಿಯ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿ (ಮೆಟ್ರೋ) ಯವರ ಅನುಮತಿಯಿಲ್ಲದೆ ಸದರಿ ಸ್ವತ್ತುಗಳನ್ನು ವಿಲೆ ಮಾಡಲು ಒಪ್ಪಂದ ಕ್ರಯ, ಭೋಗ್ಯ, ಲೀಸ್, ಅದಲು-ಬದಲು ವಗೈರೆ ಮಾಡುವಂತಿಲ್ಲ ಮತ್ತು ಸದರಿ ಸ್ವತ್ತುಗಳಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆ ನಂತರ ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಮತ್ತಿತರ ಅಭಿವೃಧ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡುವಂತಿಲ್ಲ. ಒಂದು ವೇಳೆ ಮಾಡಿದರೂ 2013ರ ರೈಟ್ ಟು ಫೇರ್ ಕಾಂಪೆನ್ಸೇಶನ್ ಅಂಡ್ ಟ್ರಾನ್ಸ್‌ಪರನ್ಸಿ ಇನ್ ಲ್ಯಾಂಡ್ ಅಕ್ವಿರಿhುಶನ್, ರೀಹ್ಯಾಬಿಲಿಟೇಶನ್ ಅಂಡ್ ರಿಸೆಟ್‌ಲ್‌ಮೆಂಟ್ ಆ್ಯಕ್ಟ್ 2013 (Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013) ಮತ್ತು 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 30 ಅನ್ನು ಓದಿಕೊಳ್ಳುವ ಮೇರೆಗೆ (ಪರಿಹಾರಧನ ನಿಗಧಿ ಮಾಡುವಾಗ ಈ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳುವುದಿಲ್ಲ) ಮತ್ತು ಅಂತಿಮವಾಗಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದು.

ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ ಎರಡನೇ ಹಂತಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಲಾಗಿರುವ ಬೃಹತ್ ಬೆಂಗಳೂರು ಮಹಾನಗರ ಪಾಲಿಕೆಯ / ಗ್ರಾಮ ಪಂಚಾಯಿತಿಯ ವ್ಯಾಪ್ತಿಯೊಳಗೆ ಬರುವ ಈ ಕೆಳಕಂಡ ಸ್ವತ್ತುಗಳುಳ್ಳ ಪ್ರದೇಶಕ್ಕೆ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966ರ 7ನೇ ಅಧ್ಯಾಯವು ಈ ಅಧಿಸೂಚನೆಯ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆಂದು ಘೋಷಿಸಿದೆ.

ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಸ್ವತ್ತುಗಳು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಯಿಂದ ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ ಎರಡನೇ ಹಂತ ಅಭಿವೃಧ್ದಿಪಡಿಸುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಬೇಕಾಗಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ. ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ನೋಟೀಸು ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆಯಾಗಿರುವ ತಾರೀಖಿನ ನಂತರ ಬೆಂಗಳೂರು ವಿಭಾಗದ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಮಂಡಳಿಯ ವಿಶೇಷ ಭೂಸ್ವಾಧೀನಾಧಿಕಾರಿ (ಮೆಟ್ರೋ) ಯವರ ಅನುಮತಿಯಿಲ್ಲದೆ ಸದರಿ ಸ್ವತ್ತಿಗಳನ್ನು ವಿಲೆ ಮಾಡಲು ಒಪ್ಪಂದ ಕ್ರಯ, ಭೋಗ್ಯ, ಲೀಸ್, ಅದಲು-ಬದಲು ವಗೈರೆ ಮಾಡುವಂತಿಲ್ಲ ಮತ್ತು ಸದರಿ ಸ್ವತ್ತುಗಳಲ್ಲಿ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಣೆ ನಂತರ ಕಟ್ಟಡಗಳ ನಿರ್ಮಾಣ ಮತ್ತಿತರ ಅಭಿವೃಧ್ದಿ ಕೆಲಸಗಳನ್ನು ಮಾಡುವಂತಿಲ್ಲ. ಒಂದು ವೇಳೆ ಮಾಡಿದರೂ 2013ರ ರೈಟ್ ಟು ಫೇರ್ ಕಾಂಪೆನ್ಸೇಶನ್ ಅಂಡ್ ಟ್ರಾನ್ಸ್‌ಪರನ್ಸಿ ಇನ್ ಲ್ಯಾಂಡ್ ಅಕ್ವಿರಿhುಶನ್,8 ರೀಹ್ಯಾಬಿಲಿಟೇಶನ್ ಅಂಡ್ ರಿಸೆಟ್‌ಲ್‌ಮೆಂಟ್ ಆ್ಯಕ್ಟ್ 2013 (Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013) ಮತ್ತು 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 30 ಅನ್ನು ಓದಿಕೊಳ್ಳುವ ಮೇರೆಗೆ (ಪರಿಹಾರಧನ ನಿಗಧಿ ಮಾಡುವಾಗ ಈ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳುವುದಿಲ್ಲ) ಮತ್ತು ಅಂತಿಮವಾಗಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗುವುದು.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ. ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾದೀನಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ವಿಧಿ 28(1) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕದ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ವಿಧಿ 28(1) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ವಿಧಿ 28(1) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕ 3 ಪತ್ರಿಕೆ ಪುಟ ಸಂಖ್ಯೆ 627 ರಿಂದ 629 ರಲ್ಲಿ ಪ್ರಕಟವಾಗಿರುವ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 108 ಎಸ್‌ಪಿಕ್ಯೂ 2015, ಬೆಂಗಳೂರು ದಿನಾಂಕ: 22.02.2018ರ ಪ್ರಕಾರ 2015, ಬೆಂಗಳೂರು ದಿನಾಂಕ: 22.02.2018ರ ಪ್ರಕಾರ ರಾಜ್ಯ ಪತ್ರ ಭಾಗ-3 ಪತ್ರಿಕೆ ಪುಟ ಸಂಖ್ಯೆ 627 ರಿಂದ 629 ರಲ್ಲಿ ಪ್ರಕಟವಾಗಿರುವ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 108 ಎಸ್‌ಪಿಕ್ಯೂ "ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ" ಕೊತ್ತನೂರು ಡಿಪೋ ಸರ್ಕಾರದಲ್ಲಿ ಸದರಿ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಸ್ವತ್ತುಗಳ ಹೆಚ್ಚುವರಿ ವಿಸ್ತೀರ್ಣದ ಪ್ರದೇಶವನ್ನು "ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ" ಕೊತ್ತನೂರು ಡಿಪೋ ಸರ್ಕಾರದಲ್ಲಿ ಸದರಿ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಸ್ವತ್ತುಗಳ ಹೆಚ್ಚುವರಿ ವಿಸ್ತೀರ್ಣದ ಪ್ರದೇಶವನ್ನು ನಿರ್ಮಾಣದ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಇಚ್ಛೆಪಟ್ಟಿದೆ.

ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮಿನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮಿನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನ ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮಿನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನ ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3)ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ. ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3)ರ

ಆದುದರಿಂದ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಆದುದರಿಂದ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ಆದುದರಿಂದ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ್ಲ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲಿ ಘೋಷಿಸಲಾಗಿದೆ.

ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಸ್ವತ್ತನ್ನು ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ 2ನೇ ಹಂತಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966ರ ವಿಧಿ 28(1)ರಡಿಯಲ್ಲಿ ತನಗೆ ನಿಹಿತವಾಗಿರುವ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 108 ಎಸ್‌ಪಿಕ್ಯೂ 2015 ದಿ:22.02.2018ರನ್ವಯ ಹಂತ-2, ರೀಚ್-6ರ ಕೋತ್ತನೂರು ಡಿಪೋ ನಿರ್ಮಾಣಕ್ಕಾಗಿ ಭೂಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳುವ ಸ್ವತ್ತುಗಳಲ್ಲಿ ಈ ಕೆಳಕಂಡ ಸ್ವತ್ತನ್ನು ಅಲೈನ್‌ಮೆಂಟ್ ಮತ್ತು ನಕ್ಷೆ ಬದಲಾವಣೆಯಿಂದ ಮೆಟ್ರೋ ಯೋಜನೆಯ ಭೂಸ್ವಾಧೀನ ಪ್ರಕ್ರಿಯೆಯಿಂದ ಕೈಬಿಡಲಾಗಿದೆ.

ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ ಎರಡನೇ ಹಂತಕ್ಕಾಗಿ ಹೆಚ್ಚುವರಿಯಾಗಿ ಭೂಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಲಾಗಿರುವ ಈ ಕೆಳಕಂಡ ಸ್ವತ್ತುಗಳಿರುವ ಪ್ರದೇಶಕ್ಕೆ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆ 1966ರ 7ನೇ ಅಧ್ಯಾಯವು ಈ ಅಧಿಸೂಚನೆಯ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆಂದು ಘೋಷಿಸಲಾಗಿದೆ.

ಕೆಳಕಂಡ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಿರುವ ಸ್ವತ್ತುಗಳು ಹೆಚ್ಚುವರಿಯಾಗಿ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿಯಿಂದ ಎರಡನೇ ಹಂತದ ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ ಉದ್ದೇಶಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಬೇಕಾಗಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(1) (1966ರ 18ನೇ ನಂ.ಕಾಯ್ದೆಯ) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಸದರಿ ಸ್ವತ್ತುಗಳನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳುವ ಉದ್ದೇಶದಿಂದ ಈ ಅಧಿಸೂಚನೆ ಪ್ರಕಟಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆಯ ವಿಧಿ 35ರ ಮೇರೆಗೆ ಕೆಲಸ ನಿರ್ವಹಿಸಲು ಈ ಜಮೀನುಗಳಿಗೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಯನ್ನು ತಡೆಯುವುದಾಗಲೀ ಅಥವಾ ಅಡ್ಡಿಪಡಿಸುವುದಾಗಲೀ ಮಾಡಕೂಡದೆಂದು ಈ ಜಮೀನುಗಳಲ್ಲಿ ಆಸಕ್ತಿ ಹೊಂದಿರುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಗೂ ಈ ಮೂಲಕ ಎಚ್ಚರಿಸಲಾಗಿದೆ.

Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity:-

(i) Passport;

(ii) Driving License;

(iii) Service Identity Cards with photograph issued to employees by Central/State Govt. PSUs/Public Limited Companies;

(iv) Passbooks with photograph issued by Bank/Post Office;

(v) PAN Card;

(vi) Smart Card issued by RGI under NPR;

(vii) MNREGA Job Card;

(viii) Health Insurance Smart Card issued under the scheme of Ministry of Labour;

(ix) Pension document with photograph;

(x) Official identity cards issued to MPs/MLAs/MLCs, and

(xi) Aadhaar card.

9. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Office of another Assembly Constituency, such EPIC shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc., the elector shall have to produce one of the alternative photo documents mentioned in Para 8 above.

10. Notwithstanding anything in Para 8 above, overseas electors who are registered in the electoral roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.

IN SO FAR AS elections to the Legislative Assembly of Jammu and Kashmir are concerned, this notification shall be deemed to have been issued in terms of Rules 5 and 10 of the Jammu and Kashmir Conduct of Elections Rules, 1965 and under the Election Symbols (Reservation and Allotment) Order, 1968 as made applicable for elections to the Legislative Assembly of Jammu and Kashmir.
